Two Men Indicted in Shooting Death of 102nd Precinct Det. Brian Simonsen

By Forum Staff A borough grand jury has indicted two men for the line-of-duty death of City Police Det. Brian Simonsen and the wounding of Sergeant Matthew Gorman, who were responding to a robbery in a cell phone store last month when they were mistakenly hit by other officers also responding to the chaotic scene, Chief Assistant District Attorney Jack Ryan, on behalf of Queens DA Richard Brown, announced on Monday.

Christopher Ransom, 27, formerly of St. John’s Place in Brooklyn, and Jagger Freeman, 25, of Merrick Boulevard in Jamaica, were arraigned Monday morning on a 23-count indictment charging them with second-degree murder, first- and second-degree robbery, second-degree assault, third- and fourth-degree grand larceny, fourth-degree criminal possession of a weapon. Ransom is additionally charged with second-degree aggravated manslaughter. Ransom, who was shot during the alleged robbery, is still in the hospital, Ryan noted.

Justice Kenneth Holder remanded Ransom and Freeman and ordered them to return to court on May 15.

According to the charges, on Tuesday, Feb. 12, the two defendants arrived together at the T-Mobile store on 120th Street and

Atlantic Avenue in Richmond Hill. Shortly after 6 p.m., Freeman walked pass the store, peered through the windows and then communicated via cell phone with Ransom.

Moments later, Ransom—wearing a dark hoodie slung over his head with a mask covering part of his face—entered the store.

While Freeman was allegedly posted outside as a lookout, Ransom is alleged to have brandished a black pistol and ordered the two employees inside the store to remove the cash from the registers and remove the iPhones and cash from the back room safes.

Shortly thereafter, according to charging

documents, Ransom allegedly exited the back room and re-entered the main store area—still holding what appeared to be a gun—as members of the City Police Department entered the location.

Continuing, according to the charges, after Ransom spotted the cops retreat from the store, he allegedly exited with the phony weapon in-hand and pointed it at police officers, who immediately began to discharge their weapons.

Detective Simonsen, a 19-year veteran of the NYPD, was fatally shot once in the torso.

He was 42 years old. Sergeant Matthew Gorman, 31, was seriously wounded as a result of being shot in his left leg. Ransom was shot, but survived. Freeman ran from the scene the moment gunfire erupted.

“This was a tragic incident that should have never happened,” Ryan said.

According to the charges, in addition to the two men being indicted in the Feb. 12 hold-up at the T-Mobile store where the two police officers were shot, the pair is also charged with robbery for hitting another T-Mobile location on Feb. 8. Ransom is also indicted for allegedly robbing from cell phone stores on Oct. 23 and Oct. 28, 2018, and another mobile phone shop on Jan. 19, 2019.

If convicted, both men face up to 50 years to life in prison.

Public Encouraged to Comment on State’s $1.2B Van Wyck—JFK Airport Access Plan

Cusenza Borough residents and business owners are encouraged to issue comment by Monday, March 18, on the State Department of Transportation’s Draft Environmental Impact Statement: the plan to increase capacity on the Van Wyck Expressway and improve vehicular access to John F. Kennedy International Airport.

The $1.22 billion project’s official designation is: Van Wyck Expressway Capacity and Access Improvements to JFK Airport. Accord-

ing to NYSDOT, the needs for the massive undertaking are: to increase capacity on the VWE to and from JFK Airport; to improve the operations and geometry of the ramps; and to address structural deficiencies of the bridges within the project limits.

The purpose of the project is to provide increased capacity on the VWE between the Kew Gardens Interchange and JFK Airport to improve vehicular access to and from the airport, NYSDOT noted. In addition, the project will address operational, geometric, and struc-

tural deficiencies on the VWE between the Kew Gardens Interchange and JFK Airport.

According to NYSDOT, the Van Wyck is a vital transportation corridor providing access to and from the John F. Kennedy International Airport, which is a major international gateway to the United States, with 70 carriers serving 100 international non-stop destinations. Overall, the airport handles 58.9 million passengers with over 400,000 aircraft operations annually and is one of the world’s leading international air cargo centers. Ac-

cording to the “Recommendations for a 21st Century Airport for the State of New York,” a report prepared by the Airport Advisory Panel in January 2017, the number of passengers at JFK Airport is expected to grow by nearly onethird to a total of over 75 million passengers by 2030. The VWE also serves as the major route for commercial truck traffic to get to and from the airport, with trucks accounting for eight percent of morning peak volume and five percent of evening peak volume on I-678.

Q52 SBS is Only Route in NYC to Earn ‘A’ Grade from Leading Straphanger Advocacy Group

By Michael V. Cusenza The Q52, for many years a steady sight for South Queens eyes, has earned an “A” grade from a leading straphanger advocacy organization’s annual Metropolitan Transportation Authority bus route analysis.

The 52, which now leads the polarizing Cross Bay-Woodhaven Corridor Select Bus Service route, actually was the only route in the five boroughs to receive an “A” from the Bus Turnaround Coalition.

The addition of dedicated bus lanes, all-door boarding, and consolidation of stops led to a 66-percent reduction in bus bunching compared to service on the Q52 in 2017. On the Q53 SBS, which uses the same bus lanes, bunching fell 45 percent.

According to the BTC, the impact of bus lanes, all-door boarding, stop consolidation, and signal priority on SBS routes is clear to see. Overall, SBS bus are faster than local routes (8.2 mph vs. 6.4 mph) and have significantly lower bunching rates (7.9 percent vs.

Half of all routes still got a “D.” There were 58 “F” grades, 124 “D”; 57 “C”; 8 “B”; and a single “A.” “When bus service doesn’t make the grade, bus riders are the ones who get held back,” said Jaqi Cohen, campaign coordinator for the New York Public Interest Research G Straphangers Campaign.

Cusenza A Woodhaven woman who was convicted in October 2015 of offering sexual favors and cash to a City police officer investigating a suspected domestic abuse incident at her residence in exchange for dropping criminal charges against her recently won her appeal and had the conviction overturned

by Supreme Court, Appellate Division, Second Department in Brooklyn, according to the appellant and Thomson Reuters FindLaw.com.

Luander Stephans, 35, was found guilty of thirddegree bribery and falsely reporting an incident. She faced up to seven years in prison at the time.

According to trial testimony, cops from the 102nd Precinct arrived at Stephans’ residence at approximately 12:30 a.m. on Oct. 16, 2014, in response to an alleged domestic violence incident and discovered that her husband had previously been issued an order of protection which was still in effect. While an investigation was being conducted, Stephans allegedly offered to give investigating Officer Raymond Persaud $700 in cash and her phone number so they could go on dates and have sex if the charges were dropped.

A few days later, on Oct. 20, 2014, Stephans called the 102nd Precinct stationhouse on 118th Street in Richmond Hill and reported to a detective that while she was at the stationhouse on Oct. 16, Persaud “felt her breast, grabbed her private parts and asked her for $2,500 in cash.” Stephans further reported that since that day, she allegedly had received numerous calls from Persaud telling her “not to say anything.”

In its Decision issued in January, the appellate court ordered that “the judgment” against Stephans “is reversed, on the law and as a matter of discretion in the interest of justice…and a new trial is warranted.”

ments, and exacerbating the city’s gridlock as more people turn to road-clogging ride-hail services like Uber and Lyft.”

This year’s grades show some evidence of widespread improvement compared to 2017, though it may be imperceptible to most riders. In 2018, 30 fewer bus routes received a failing grade

than the year before, due largely to reductions in bus bunching.

On frequent bus routes, the rate of bunching declined from 14 percent to 11 percent. The MTA attributes these reliability gains to better dispatching practices that keep buses more evenly spaced.

According to the BTC’s analysis of real-time MTA data, bus speeds for the average passenger were just 6.6 mph in 2018, down from 6.8 mph in 2017. On frequent routes, where buses are scheduled to arrive at least every 15 minutes, 1 in 9 buses arrived bunched, creating frustrating, unpredictable gaps in service.

The coalition has called for more bus lanes in the city and initiatives to keep said lanes unobstructed. The group also emphasized strong coordination between the City Department of Transportation and the MTA to roll out bus lanes, transit-signal priority, all-door boarding, and redesigned bus routes as smoothly and rapidly as possible.

Borough WWII Hero Honored at Home

Elected officials, civic leaders, and grateful South Queens residents join hosts City Councilman Eric Ulrich (ROzone Park) and the Woodhaven Cultural and Historical Society on Saturday at a renaming ceremony to honor the legacy of the Rev. Lawrence Lynch: an Irish-American priest and longtime Woodhaven resident who comforted soldiers during World War II. Ulrich sponsored legislation last year that called for renaming the patch of land at Rockaway Boulevard and Atlantic Avenue “Rev Lawrence

According to the WCHS, Lynch often sought out the most dangerous battlegrounds to assuage the wounded and give dying soldiers their last rites, a Catholic ritual. On April 25, 1945, during the battle on Okinawa in Japan, Lynch was traveling with a soldier when a shell struck and killed him instantly. He was just 38 years old. More than 4,000 servicemen attended Mass at his graveside in Okinawa at the end of June, after victory had been secured.

Michael Gianaris (D-Astoria) and Assemblywoman Linda Rosenthal (DManhattan) recently introduced legislation that would prohibit the sale of dogs, cats, and rabbits in pet stores across the Empire State in an effort to abolish the so-called puppy mill-to-pet-store pipeline.

According to the American Society for the Prevention of Cruelty to Animals, New York has one of the highest concentrations of pet stores in the nation. Despite pet stores’ claims that their puppies come from well-regulated, humane breeders, dogs bred in these facilities often spend their entire lives in small, dirty, wire cages, the ASPCA indicated. Mother dogs are treated as nothing more than breeding machines, and puppies as nothing more than assembly-line products, the non-profit organization added.

“Time after time, the pet industry has demonstrated that it is not interested in ensuring the welfare of the dogs it churns out, nor is it interested in transparency or public accountability,” said Bill Ketzer, senior director of State legislation for the ASPCA, Northeast region. “These badlyregulated commercial dog breeders have only one goal: breed the highest volume of puppies possible at the lowest cost for the retailer. In turn, pet stores do everything in their power to sell these dogs, conveniently excluding well-documented health and behavior risks in their pitch to buyers who believe they are going home with a healthy, well-bred puppy. We are grateful that Senator Gianaris and Assemblymember Rosenthal are moving the needle forward with this bill to protect pets and consumers.”

According to the ASPCA, the federal government “has failed to adequately regulate puppy mills.” A breeder licensed by the U.S. Department of Agriculture must only abide by “insufficient, abysmal survival standards.” Enforcement is lacking, and penalties are weak. New York took action in 2014 to enact a new pet store law allowing local governments to crack down on cruel and unscrupulous pet dealers, but the law restricts them to limiting certain sources based on USDA inspection history.

The ASPCA has claimed that the USDA has since purged its breeder inspection database of any meaningful information on breeder inspection reports, hiding their documentation of puppy mill cruelty from regulators and consumers who wish to verify breeder inspection history. Despite several attempts by lawmakers and animal welfare groups, the USDA has continued to suppress this information for nearly two years, rendering all such local laws ineffective, according to the ASPCA. “By ensuring that pet stores can offer only rescues for adoption, this legislation will protect consumers, help to shut down the mills and end the puppy to-pet store pipeline,” Rosenthal said. “Our animal shelters and rescue organizations are overflowing with animals needing forever homes; it’s time we start connecting rescue animals with loving homes through adoption in pet stores.”

ASPCA officials noted that while prohibiting the sale of dogs, cats, and rabbits in pet stores, the bill would continue to allow pet stores to offer quality products and services and to offer space to shelters and rescues to showcase animals available for adoption from such organizations.

MTA Praises Progress of Train Speed

By Forum Staff In total, since the late summer of 2018, a safety committee has approved increases to speed limits at more than 100 locations, and MTA New York City Transit has implemented more than 50 of them.

These increases follow recently announced improvements in service showing that the Subway Action Plan is working, including a 50-percent reduction in major incidents and a 32-percent rise in on-time performance system-wide, NYCT President Andy Byford announced on Friday.

According to Byford, more than 20 new locations have received speed-limit increases since the last update announcement on this program on Jan. 21. When eventually implemented throughout the entirety of the system, the speed limit increases will manifest as “tangible, noticeable improvements” to commute times for many subway users, Byford said.

In order to identify areas in the system through which trains can safely pass at higher speeds, a special team known as the “SPEED Unit”—Subway Performance Evaluation, Education and Development Unit - was assembled in 2018. Composed of NYC Transit employees with various specialties and established in tandem with union officials, has traversed almost every mile of track over the last several months, Byford reported. The team conducts various tests to determine whether or not certain segments of track might be able to support higher speeds than currently permitted, without compromising existing standards for safety and passenger comfort.

In addition to testing for raising speed limits, the SPEED Unit is also tasked with testing the accuracy of speed regulating signals called “grade time signals” or “timer

signals,” with more than 95 percent of some 2,000 such signals tested since the initiative began in summer 2018. Byford pointed out that approximately 350 faulty timer signals have been discovered, and 105 of them have been recalibrated so far in very laborintensive work to inspect, diagnose and repair or replace numerous possible pieces of equipment during times of exclusive track access for workers such as weekends or nights.

Byford also noted that the safety committee reviewing speed-limit increases includes members of NYC Transit’s Office of System Safety, as well as other personnel who work on operations planning, service delivery, and track and signal maintenance and repair.

“Since I first arrived here, I have been relentless about identifying ways to improve our daily operations and bring better service to the millions who ride our trains each day,” Byford said. “By meticulously examining places where trains can go faster safely, we are bringing tangible daily benefits to our customers. As always, I commend all of our workers who are working so hard to improve the lives of our customers.”

The $20 billion Subway Action Plan was launched in July 2017 at the direction of Gov. Andrew Cuomo and funded by the governor, State Legislature, and the City, with the goal of taking extraordinary measures to stabilize and improve the more than 100-year old subway system.

“With the SAP fully funded, we are accelerating the plan’s completion and are seeing the results,” MTA Acting Chairman Fernando Ferrer said in January. “Our customers and the city are already benefiting from these programs, and we look forward to building upon this progress as the plan continues.”

EDITORIAL Rise & Dine It is 9:30 am and you are feeling hungry. What meal would you probably look for? Breakfast is what I eat at 9:30 am. However, In 2014, the Daily News and WNYC reported that more than 56 percent of schools began serving lunch before 11 a.m. This year, not much has changed. Throughout the city, public schools are sending students to the cafeteria as early as 9 a.m. and calling it lunch. All NYC Public Schools serve free Breakfast to students roughly 30-60 minutes before their 1st instructional period begins. If they are then serving breakfast only 2 hours later what is the likelihood that students are even hungry by then? The average school day is 6 hours and twenty minutes. If they are being served lunch within the first two hours what are they going to do when they are hungry again during the remaining four hours?

The DOE says the director of operations at each Borough Office advises principals that lunch should begin no earlier than fourth period when possible. Fourth period, depending on the school’s start time should begin around 10:30am.

Susan E. Wagner High School in Staten Island serves lunch at 8:58 a.m. six minutes before its 2014 lunchtime, according to OFNS. The school had 3,284 students last year, according to the DOE’s 2017-2018 School Quality Guide.

Robert A. Van Wyck Junior High School here in Queens serves lunch at 9 a.m., compared to 9:57 a.m. in 2014. The school had 1630 students last year, according to the DOE’s 2017-2018 School Quality Guide.

Jamaica High School, which served lunch at 9:06 a.m. in 2014, closed at the end of that school year. Today, four different schools, including the High School for Commu-

nity Leadership (HSCL), operate in the building. In 2014, HSCL served lunch at 9:06 a.m.

Tottenville High School had 3,808 students last year, according to the DOE’s 2017-2018 School Quality Guides. It has two cafeterias and five lunch periods, the first beginning at 9:37 a.m. and the last ending at 1:33 p.m. Even with 2 cafeterias serving lunch to 3,808 students is impossible to do without starting before 4th period.

School principals are the deciding factor in determining school lunch times. However in schools that are overcrowded or share space with other schools principals may not have much of a choice. They need to take into consideration the capacity of school cafeterias and the safety of students when deciding who will eat lunch when. Putting principals in a situation where they must bargain and negotiate with colleagues for prime lunch periods is an indication that something is wrong with our system. Principals should be instructional leaders and spend their time ensuring that the quality of classroom instruction is effective and equitable across their school building and in the system at large. When principals are expected to sit at a bargaining table with not only other DOE principals but charter school staff as well, and argue over feeding their students lunch at an appropriate time we should have no wonder why graduation rates citywide are only at 74%.

“School meals are proven to support academic achievement and are a critical source of nutrition for food-insecure students who depend on free or reduced price school meals,” says Diane Pratt-Heavner, spokesperson for the Virginia-based School Nutrition Association. If students are

fed lunch too early they will choose not to eat. They need the nutrition to optimally perform in class and on assessments. However, in countless NYC DOE schools we are feeding students too early causing them to be distracted by hunger pains later in the day. Are we setting them up to fail?

City Councilmember Mark Treyger, a former Brooklyn public school teacher who chairs the Council’s Committee on Education agrees that we are doing a disservice to students by feeding them lunch too early in the day. “Why are we starting lunch at 9 in the morning just to check a box and denying the fullness of the opportunity,” Treyger says.

“If students have school starting at 7:30 in the morning they might have a lunch period that is very early as well. How does the DOE intend to accommodate needs? The system is not being built around the needs of children.”

“The link between food and learning is really strong and children need to eat whole, nutrient-dense foods for lunch,” says Andrea Strong, a journalist and founder of the parentled advocacy group The NYC Healthy School Food Alliance.

“It leads to obesity when kids leave school hungry. They go for what’s easy and think, ‘I need snacks, I need snacks.’ So they get a candy bar because it’s quick to fill you up.”

My message to the mayor and the chancellor is loud and clear, if you want to see students perform to their potential decrease the number of students in large schools, provide adequate facilities to feed students at appropriate meal times and allow principals to be instructional leaders instead of negotiators. No one should be forced to eat lunch at 9:06am and not have access to food again until after 2:00pm. So why do we force our New York City Public School children to do just that?

Ban Kid-Friendly E-Cig Flavors Now: Schumer

According to a 2016 report, e-cigarettes are marketed by promoting flavors that appeal to youth—including candy, fruit flavorings, whipped cream, even juice—and that such marketing has resulted in increased use of tobacco products among children and teens.

By Forum Staff Senate Minority Leader Charles Schumer (D-N.Y.) on Sunday urged outgoing U.S. Food and Drug Administration Commissioner Scott Gottlieb to ensure a ban on kid-friendly e-cigarette flavors like candies, juices, fruits, cookies and more.

Schumer wants Gottlieb to secure the restriction before he resigns his FDA post at the end of March. New York’s senior senator also announced that he will demand a new nominee for the post pledge to continue Gottlieb’s unfinished business on e-cigs before they are confirmed.

Schumer cited new data that indicates that e-cig use among youth is “surging.”

He wants Gottlieb to immediately: Finalize the ban of flavored e-cigarette products in convenience stores, where a majority of New York City and Long Island-area kids acquire their e-cigs and flavor pods; and once-and-for-all deem e-cigs as official tobacco products, a move that has been delayed for years, according to Schumer. The delay means that e-cig flavors have been able to stay on the market for years without a comprehensive review of their public health implications.

“Commissioner Gottlieb was bucking the trend of a lobbyist-friendly administration, and at my personal urging, led the charge to rein in e-cigarettes and the lengths they go to hook kids,” Schumer said. “This work must continue in his absence.”

The senator also pledged on Sunday that he will ask the next FDA commissionernominee to publicly declare that they will continue Gottlieb’s work on e-cigs before they are confirmed.

The current law on the books that the FDA should use to rein in e-cigs and curtail marketing to kids begins with the Tobacco Control Act, Schumer said. That law, which the senator helped to push and pass in 2009, provides the FDA with authority over tobacco-like products such as e-cigs.

But the FDA has yet to use its authority to fully regulate e-cigarettes. Schumer, however, says the incremental steps taken during Gottlieb’s tenure—though critical and appreciated—have been a crawl when compared to the e-cig adoption craze among kids and more rapid action must be taken. The senator says the FDA must move faster to beat back the e-cig addiction trend among the teenage age group by banning kid-friendly flavors and marketing attempts that make liquid and chemicallylaced nicotine look like an innocent—and delicious—food product.

According to a 2016 report conducted by the U.S. Surgeon General, e-cigarettes are marketed by promoting flavors that appeal to youth—including candy, fruit flavorings, whipped cream, even juice—and that such marketing has resulted in increased use of tobacco products among children and teens. Schumer said that when the FDA fully extends its regulatory authority to ecigarettes, it will specifically acknowledge the harms posed to youth by flavored tobacco products. According to the U.S. Centers for Disease Control and Prevention, more than nine of every 10 young adult e-cigarette users said they use e-cigarettes flavored to taste like menthol, alcohol, candy, fruit, chocolate, or other sweets. More than eight of every 10 youth ages 12-17 who use e-cigarettes said they use flavored e-cigarettes.

Although some may argue that it’s too early to introduce the subject matter of this column, I’ve always subscribed to the common sense theories behind early preparation.

“Tress” is more, some fathers learned, at PS 97’s Dads Do Your Daughters’ Hair event on Monday in Woodhaven.

“Our dads were very excited to learn how to do their daughters’ hair!” Parent Coordinator Amelia Joseph said of The Forest Park School’s second annual lesson on locks. “A few dads told us that mom made sure they didn’t miss this event.”

One of PS 97’s moms, Mrs. Contreras, hosted the hair affair and shared her talents by showing the dads—and some moms—how to care for their daughters’ ’dos. She taught all how to make a twist with a clip and a twisted pony tail.

All in attendance received a goody bag of accessories and a water spray bottle so they could practice at home.

District 28 Residents Mull Budget Projects

By Forum Staff Residents of City Council District 28 in South Queens will soon have the opportunity to vote on how to spend $1 million of the public budget on community projects, Councilwoman Adrienne Adams (D-Jamaica) announced on Monday.

Participatory Budgeting, the popular democratic process in which community members directly decide how to spend part of a public budget, is on its way to CD 28—Jamaica, Richmond Hill, Rochdale Village, and South Ozone Park—for the first time, Adams noted.

“No one knows the needs of our community better than the people who live there,” the councilwoman added. “I am blessed to represent such a diverse community and will fulfill my campaign promise to empower the people of District 28 by giving them a voice. I truly value public input and we will build upon our year of progress together in our first Participatory Budgeting cycle.”

According to Adams, as PB Vote Week (March 30 through April 7) approaches, her staff will coordinate specific voting sites throughout District 28 where residents ages 11 and older will be able to cast their ballot for the neighborhood capital projects that best serve the district. Residents will be able to vote in person or online for up to five ideas that were vetted by community representatives and City agencies over the past year. Online voting will be available during PB vote week at pbnyc.org/vote.

By Forum Staff City Councilman Eric Ulrich (R-Ozone Park ) and the American-Italian Cancer Foundation are set to host a no-cost mammogram event in Ozone Park next Friday, March 22.

Sponsored by the councilman, the event will offer no-cost breast cancer screenings on the AICF Mammogram Bus which will be parked in front of Ulrich’s district office at 93-06 101st Ave. Eligibility requirements: women aged 40-79 with health insurance; women aged 50-79 without health insurance; currently living in New York City; no mammogram in the past 12 months.

No co-pays required and deductibles are waived. Uninsured patients also welcomed, Ulrich noted.

Joint Port Op Nets Colossal $77M Coke Haul

Cusenza A special joint operation at the Port of New York/Newark featuring law enforcement officers representing no less than six government agencies from the federal, State, and City levels seized a shipping container last month containing approximately 3,200 pounds of cocaine, with an estimated street value of $77 million.

According to U.S. Customs and Border Protection, the container arrived at the port on Feb. 28. A CBP spokesperson told The Forum that based on shared law enforcement information, the container was selected for closer scrutiny, leading to the discovery of 60 packages filled with a white powdery substance that field-tested positive for cocaine.
