By Michael V. Cusenza Mayor Bill de Blasio and City Council Speaker Corey Johnson on Friday announced that they have reached an early handshake agreement on a balanced, $92.8 billion budget for Fiscal Year 2020.

“I am very proud of the Fiscal Year 2020 budget—a budget that bolsters our city’s reserves to protect future generations and improves the quality of life for all residents—while also ensuring citywide savings,” Johnson said. “This budget is a result of a united council fiercely advocating on behalf of our constituents and prioritizing initiatives that will benefit all New Yorkers.”

According to de Blasio, highlights of the latest Adopted Budget include: • Placing 200 additional social workers in Department of Education schools, including mental health specialists, to help support students and provide necessary social and emotional support ($26 million).

• Investing jointly with the City Council in an expansion of criminal justice-related diversion programs, such as post-arrest diversion, supervised release and transitional housing.

• Installing low noise “rumbler” sirens on FDNY vehicles to help reduce noise pollution ($1.5 million).

• Funding for Vision Zero public awareness campaigns to educate drivers and support pedestrian and cyclist safety ($5 million).

• Launching NYC Care to guarantee healthcare access for 600,000 uninsured New Yorkers and enhance MetroPlus, NYC’s Public Option, by increasing enrollment and improving access to care, includ-

ing mental health services ($25 million in FY2020, ramping up to $100 million in FY2022).

• Expanding 3-K for All by funding 1,900 new seats in the Bronx (District 8) and Brooklyn (District 32) for next school year. This investment brings 3-K to 14 districts and 20,000 children by September 2020, and includes the 10 highest-need dis-

tricts in the city ($25 million).

• Increasing mayoral funding for 2020 Census outreach staff and public awareness campaigns to ensure a fair and accurate count that gives New York City its fair share ($22 million for a total mayoral investment of $26 million).

• Retrofitting City buildings as part of NYC’s Green New Deal ($60 million).

• Providing annual funding for the “Bridging the Gap” program that provides social services and academic support for

students in shelters ($14 million).

Johnson and council leadership touted some of the quality of life improvements in the spending plan: • Enhancing Library Funding: The biggest investment in libraries to date includes $16 million from the administration, $14 million from the council, and a nearly $3 million cost-savings restoration.

• Picking up More Trash: This allocation of $8.6 million is for extra sanitation services including for extra litter baskets throughout the five boroughs. This is more than double the amount allocated last year.

• Providing Senior Meals: This is for the cost increases for food service workers and meals in senior centers.

• Removing Tree Stumps: This $1 million allocation will provide additional resources to remove tree stumps throughout the five boroughs.

• Offering Translation Services at Poll Sites: This funding of $640,000 to support an agreement with the Council and the Mayor’s Office of Immigrant Affairs to launch a supplementary program to provide poll-site interpretation services in languages not covered by the Board of Elections.

• Street Resurfacing: Funding to resurface 1,100 lane miles across the five boroughs.

De Blasio also noted that the FY2020 Adopted Budget includes more than $300 million in new savings, on top of the $2.5 billion achieved in the Citywide Savings Program over Fiscal Years 2019 and 2020 since last adoption. These savings were, in part, attained through the administration’s first Program to Eliminate the Gap (in which City agency heads are directed to cut costs in their respective budgets), and a permanent reduction of 2,600 City-funded positions; 325 additional vacancies will be reduced in this plan, adding $25 million in savings, de Blasio said.

“The Fiscal Year 2020 Adopted Budget creates greater fairness for all New Yorkers. We’ve reached an agreement that promises to create a pathway to pay parity for our early childhood education providers to address recruitment and retention issues, expands services that prevent unnecessary detention and fights the widespread national attack on access to abortion care,” the mayor added. “We’re also strengthening our support services in schools by providing over 200 social workers for students who need them most, fulfilling our commitment to senior affordable housing, and putting our new expanded speed camera program into action. We’re accomplishing all of this while protecting the City’s fiscal health by increasing savings and adding $250 million to our already historic levels of budget reserves.”

Mobile Sports Betting not looking Like a Winner in 2019 Albany Legislative Session

By Michael V. Cusenza Supporters of legalizing mobile sports betting in the Empire State experienced the thrill of victory and the agony of defeat all in the same week as the measure seemed to stall in the Assembly days after overwhelmingly passing the State Senate.

With the 2019 Albany legislative session set to come to a close at midnight Wednesday, all signs pointed to the bill hitting a brick wall in the Assembly Standing Committee on Codes.

“I think that one is going to wait for another day,” WNYC state government and politics reporter Fred Mogul posited on “The Brian Lehrer Show” on Monday. “It’s not likely to pass this session.”

In addition, legal mobile sports betting will put a serious dent in the existing underground and illegal wagering industry.

“Experiences in other states have demonstrated that implementing sports betting without a mobile component leaves those states where people cannot wager with their phones or other devices at a competitive disadvantage,” the senator continued. “Ultimately, I hope the governor will choose to embrace the great benefits that sports betting, including the mobile component, will bring to New York in terms of employment, additional funding for education, addressing illegal gambling, and ensuring our competitiveness with other states.”

DA Candidates Comment on Handling of Vetrano Case

Chanel Lewis, 22, ultimately was sentenced in April to life in prison without the possibility of parole for the August 2016 murder of Vetrano, 30, who was grabbed from a Spring Creek Park running path, beaten, sexually abused, and strangled to death near her Howard Beach home. He is appealing the verdict.

Last week at the debate, several candidates said the investigation and subsequent prosecution beg for the benefits of fresh eyes.

“Confessions should be videotaped from the beginning to the end,” Katz said during the debate. “And when there isn’t an attorney present for some reason, less weight should be given to the confession—but there should always be an attorney present. You have to videotape it, and you can’t be allowed to give snippets of it if you’re presenting it in front of a jury. You have to be able to see the whole videotaped confession.”

Finch Fan Pinched at JFK Airport

By Michael V. Cusenza A man traveling to NYC from Guyana was arrested Sunday at John F. Kennedy International Airport for allegedly attempting to smuggle nearly three-dozen live birds into the country, according to federal prosecutors.

Francis Gurahoo, 39, allegedly concealed 34 live finches in his carry-on luggage, with each feathered creature ensconced in a plastic hair-curler.

Gurahoo’s Customs and Border Protection declaration stated that he was entering the United States without any wildlife. According to a U.S. Fish and Wildlife Service Special Agent Gabriel Harper, Gurahoo admitted that he had intended to smuggle the finches into the country and to avoid

quarantine by placing the birds inside of his carry-on luggage. Gurahoo said that he had planned to sell the finches for approximately $3,000 each (totaling approximately $100,000). He also admitted that he knew what he did was wrong but was motivated by

potential financial gain, the complaint notes.

According to federal officials, CBP officers working at JFK have intercepted numerous passengers trying to bring finches, which are small, seed-eating birds, into the U.S. from Guyana by concealing them in

various manners without declaring the birds on the required importation forms.

“My investigation has revealed that individuals keep finches to enter them in singing contests in Queens and Brooklyn,” Harper said. “In such contests, often conducted in public areas like parks, two finches sing and a judge selects the bird determined to have the best voice. Many who attend the singing contests wager on the birds. A finch that wins these competitions becomes valuable and can sell for in excess of $5,000. Although certain species of finch are available in the United States, species from Guyana are believed to sing better and are therefore more highly sought after. An individual willing to smuggle finches into the United States from Guyana can earn a large profit by selling these birds in the New York area.”

The borough president has allocated $1.25 million for upgrades at Harold Schneiderman Playground in Lindenwood.

Cusenza Some South Queens schools and parks are set to benefit from the $65 million in Fiscal Year 2020 discretionary funds that Borough President Melinda Katz has allocated for critical constructions, renovations, and upgrades across 80 capital projects throughout The World’s Borough.

Katz unveiled the earmarks—part of the $92.8 billion FY20 budget agreement recently reached by the mayor and City Council—on Tuesday.

The borough president’s allocations include: • $23.5 million for Queens parks and recreational facilities; • $13.1 million for K-12 public schools; • $10.3 million for cultural institutions; • $1.5 million for Queens libraries Of that $65 million, in the southern swath of the borough: $250,000 has been set aside

for security cameras at Frank Charles Memorial Park; Hamilton Beach Park in Hamilton Beach will also get $250,000 for security cameras; Katz has secured $2 million for upgrades at Frederick Judge Playground in South Ozone Park; $1.25 million has been allocated for upgrades at Harold Schneiderman Playground in Lindenwood; and $350,000 will fund the construction of school bleachers at MS 137 in Ozone Park.

Since entering office in January 2014, Katz has appropriated $335 million in discretionary funds for borough infrastructure projects.

“These are substantial public investments for not only renovations, expansions and enhancements, but also into the future for the growing communities and families of Queens,” Katz said. “From our public schools to affordable housing to parks to hospitals, when deciding where to invest precious resources, we know that if it’s good for families, it’s good for Queens.”

Queens Ranks Dead Last in EMS Response Times

Last year, of the nearly 62,000 medical emergencies in Queens requiring paramedics, help failed to arrive in less than 10 minutes 55 percent of the time.

By Michael V. Cusenza For several years now, Queens has, by far, logged the longest Emergency Medical Service response times in the city, according to a disquieting report recently released by the Independent Budget Office.

In each of the years 2014 through 2018, The World’s Borough had a higher share of serious medical emergencies that took paramedics more than 10 minutes to respond to than any of the other boroughs. Last year, of the nearly 62,000 medical emergencies in Queens

requiring paramedics, help failed to arrive in less than 10 minutes a jaw-dropping 55 percent of the time. And more than 20 minutes elapsed before paramedics arrived at more than 5,000 (8 percent) serious medical emergencies in Queens in 2018.

According to the IBO, citywide in 2018, paramedics responded within 10 minutes to 54 percent of roughly 314,000 serious medical emergencies. This is well below the 90 percent goal set in 1996 when the City Fire Department took over ambulance operations from the public hospital system in order to better coordinate ambulance and firefighter responses to medical emergencies as well as to reduce redundant staffing in the agencies.

According to the IBO, medical emergency calls received by the 911 system are categorized according to perceived seriousness, with a basic distinction being Advanced Life Support incidents versus generally less serious Basic Life Support incidents. ALS incidents include cardiac conditions, difficulty in breathing, unconsciousness, major burn cases, and other serious medical emergencies.

BLS incidents include a wide range of conditions such as non-critical injuries, conditions involving emotionally disturbed patients, patients with abdominal pain or other sickness, and drug and alcohol abuse cases.

Men Charged with Selling Illegal Cigarettes

Investigators allegedly recovered 115 cartons of cigarettes with all 1,150 packs bearing counterfeit tax stamps from the 78th Street home of Mohammed Ahmed.

By Forum Staff Two East Elmhurst men have been charged in connection with the sale of thousands of cigarettes from businesses in Queens, Brooklyn, and Manhattan, Acting Queens District Attorney Jack Ryan announced on Thursday.

Mohamed Khan, 44, was arraigned last Wednesday on a complaint charging him with second- and fourth-degree grand larceny, first-degree criminal possession of a forged instrument, violation of tax law cigarette and tobacco products tax, endangering the welfare of a child, and possession or transportation of untaxed cigarettes with intent to sell. Khan was released on his own recognizance and ordered to return to court on Aug. 6, 2019.

According to the charges, Khan was the subject of a long-term investigation that began around September 2019. Last Tuesday, police executed a court-authorized search warrant for Khan’s home and four businesses. Investigators knocked on Khan’s 78th Street residence at the same time that his wife approached the front door and she also knocked. When there was no answer, police forced the door open and allegedly found the couple’s child—no more than 2 years old—alone in the house. In pursuit of Khan, police exited the back door and entered a second residence belonging to Khan and found him barefoot, wearing only underwear and hiding behind a door.

A search of Khan’s home, according to the charges, allegedly resulted in the seizure of 21,570 packs of cigarettes—21,150 of those packs did not have a New York State tax stamp and 410 packs allegedly had counterfeit tax stamps. Investigators also allegedly recovered 52,000 counterfeit stamps yet to be affixed and $177,125 in cash in various places throughout the home.

According to the charges, pursuant to court-authorized search warrants, police raided the Sunnyside Minimart on 48th Street where Khan is listed as the president of the business. Police seized more than 16 cartons of cigarettes with packs inside allegedly affixed with counterfeit tax stamps.

A search of the Village Smoke shop on First Avenue in Manhattan, where Khan is also the president, police recovered more than four cartons of cigarettes containing 45 packs allegedly bearing counterfeit tax stamps.

According to the complaint, Khan is also the owner of Flatbush Convenience on Flatbush Avenue in Brooklyn and Second Avenue Convenience on Second Avenue in Manhattan. Police searches, pursuant to court-authorized warrants, recovered another 70 packs of cigarettes combined at both locations and they all allegedly had counterfeit tax stamps affixed to them.

Mohammed Ahmed, 37, also was arraigned last Wednesday on a separate complaint charging him with first-degree criminal possession of a forged instrument, third-degree grand larceny, and violation of tax law cigarettes and tobacco tax. Ahmed was released on his own recognizance and ordered to return to court on Aug. 6, 2019.

Police also executed a court-authorized search warrant at the 78th Street home of Ahmed, an associate of Khan. Investigators allegedly recovered 115 cartons of cigarettes with all 1,150 packs bearing counterfeit tax stamps.

“Selling untaxed cigarettes is a booming business for bootleggers, who cheat both New York State and the City out of muchneeded revenue,” Ryan said. “The main defendant in this case allegedly padded his pockets with money. Both defendants now face prison time as a result of their alleged greed.”

Lyme Disease Month was just held in May and although this disease does not share the health care spotlight like cancer, heart disease, diabetes or other killers, Lyme is a prolific disease that affects more than 300,00 people in the United States every year and destroys their life as they know it.

As a tick borne illness that is exceedingly hard to diagnose it can have debilitating and devastating effects on its victims.

Lyme has been left in the shadows of medical research for diagnosis, treatment and curative measures for more than 40 years.

Many current Lyme treatments are not covered by insurance and are so expensive most people simply can’t pay for them.

Because the symptoms vary so much from patient to patient , mainstream practitioners have an increasingly hard tome in establishing a firm diagnosis.

The summer months, when most cases are contracted, find us outside more and in tick infested areas.

Studies show that over 95% of all cases of Lyme come from just 14 states, of which New York is one. And June and July bring on the largest percentage of those cases.

Lyme is no different than many other illnesses in the sense that prevention is by far, the best cure.

To protect yourself, know where to expect ticks– grassy, brushy or wooded areas. Treat your

clothing with products containing 0.5% permethrin. Use EPA registered insect repellents containing DEET, picaridin, IR3535, and others but ask your pharmacist to help you choose. Always walk in the center of trails.

After coming indoors check clothing. Wash and dry in very high temperatures. Remember the ticks pets carry can attach to people later. Always shower right after you come in.

Conduct full body checks on you and your children. Focus on the following areas: under arms, in and around the ears, inside the belly button, behind knees, in and around the hair, between legs and around waist.

Look for early signs: fever, chills, headaches, fatigue, muscle and joint aches and swollen lymph nodes. About 80% of people will develop Erythema migrans (EM) rash which will begin 3 to 30 days after the bite. The rash may feel warm but is rarely itchy or painful.

Days to months after the bite you may experience headaches and neck stiffness, heart palpitations, severe joint pain and swelling, dizziness, nerve pain, shooting pain, problems with short term memory.

We cannot impress upon you the seriousness of this illness and what it can do to the lives of patients and their loved ones. If you have questions or concerns about Lyme please ask your pharmacist for help. Many resources are also online.

By Michael V. Cusenza Over the last seven days, Gov. Andrew Cuomo has signed landmark legislation on rent reform and access to Empire State driver’s licenses.

The State Legislature on Friday passed the Housing Stability and Tenant Protection Act of 2019—or what State Senate leaders have characterized as the strongest affordable housing and tenant protections legislation in New York history. According to the Senate Democratic Majority, the new law will make the rent regulation system and tenant protection initiatives permanent, rather than having them sunset as was the policy in the past.

The legislation also repeals high-rent vacancy deregulation as well as “vacancy bonus” and “longevity bonus” provisions. This omnibus bill also reforms potential rent increases for major capital improvements and for individual apartment improvements to better protect tenants. Additionally, the legislation extends certain tenant protections statewide, implements protections for mobile and manufactured home tenants, and empowers qualified localities throughout the state to implement the rent stabilization system.

“At the beginning of this legislative session, I called for the most sweeping, aggressive tenant protections in state history. I’m confident the measure passed today is the strongest possible set of reforms that the Legislature was able to pass and is a major step forward for tenants across New York,” Cuomo said.

The Senate and Assembly on Monday passed the Driver’s License Access and Privacy Act—or Green Light NY—which restores the right to obtain a license, regardless of immigration status, that existed prior to Sept. 11,

2001. According to Senate leadership, Green Light NY will allow non-commercial driver license or learner’s permit applicants to be able to submit additional proofs of identity to be eligible for a non-federal license. It also waives the social security number requirement if the applicant signs an affidavit that they have not been issued a social security number and provides the Department of Motor Vehicles with discretion to approve additional proofs of identity and age. The legislation also protects the data of the applicants from unwarranted release.

The Cuomo administration reached out to the U.S. Solicitor General Noel Francisco asking him to review Green Light NY “to ensure that undocumented individuals who apply for driver’s licenses or identification cards would not be unintentionally exposed to a federal government seeking to use their information for deportation.” However, it seems that Francisco never responded to the inquiry. Counsel to the Governor Alphonso David noted that since NY Attorney General Tish James stated that “she believes there are ‘safeguards’ in the bill, and it can be defended; in other words, it cannot be weaponized to be used against undocumented individuals” Cuomo would sign the bill.

On Tuesday, State Sen. Joe Addabbo, Jr. (D-Howard Beach) defended his vote in favor of the contentious legislation.

“Overall, the benefits of enabling undocumented immigrants to apply for licenses far outweigh the argument that those who are in this country illegally should not be able to receive them,” the senator said. “The Green Light Bill makes good fiscal and good public policy sense, and I see it as an important safety measure, particularly in terms of traffic safety.”

Addabbo Jamaica Bay Contamination Bill Passes Both Houses

By Forum Staff The State Senate and Assembly have voted in favor of a measure to permanently extend protections against contamination in Jamaica Bay, the bill’s sponsor, Sen. Joe Addabbo, Jr. (D-Howard Beach), announced Monday.

According to Addabbo, the original law he crafted in 2014 barred the State Department of Environmental Conservation from approving any plans by the U.S. Army Corps of Engineers to place hazardous dredged materials into the estuary’s borrow pits. These are areas of Jamaica Bay’s floor where excavations have been made to allow for the passage of larger ships.

Under current law, the senator noted, these environmental safeguards expire on June 30 of 2022.

“The delicate ecology of Jamaica Bay, which includes unique salt marshes, demands that we implement permanent protections to guard against any environmental degradation that may result in a loss of wildlife habitat, compromised water quality, or other negative consequences for the area,” Addabbo warned.

“Simply said, we need to remain vigilant to ensure that our beautiful bay isn’t ever allowed to become a dumping ground for harmful pollutants.”

In addition, the research that has more recently come to light highlights the amazing role that the deep portions of the bay play in supporting massive amounts of marine life that would cease to exist should they be filled in. We commend Sen. Joe Addabbo and Assemblymember Stacey Pheffer Amato for their efforts on this bill and in fighting to protect Jamaica Bay for future generations by making permanent the prohibition on dumping contaminated fill into the waters of this bay.”

The companion measure, sponsored by Assemblywoman Stacey Pheffer Amato (DHoward Beach), has been passed by the Assembly and is awaiting delivery to Gov. Andrew Cuomo.

By Forum Staff In an effort to stem the tide of assaults on transit workers and combat the growing problem of fare evasion, the State will dispatch 500 additional uniformed officers to the city subway and bus systems, Gov. Andrew Cuomo announced on Monday after an agreement was reached with Mayor Bill de Blasio, Manhattan District Attorney Cyrus Vance, Police Commissioner Jim O'Neill, and Metropolitan Transportation Authority Chairman Pat Foye.

The pact calls for the Manhattan DA’s Office to provide $40 million over four years to support the MTA’s anti-fare evasion actions by covering associated costs of the personnel and providing construction modifications to target station locations.

The funds will go towards training and equipment for members of anti-fare evasion teams, including MTA PD, Bridge and Tunnel officers, and NYPD. In addition to working on anti-fare evasion actions, the fare deterrence teams will provide worker safety protections to MTA employees. The funds will also support enhanced technology in the stations, as well as infrastructure hardening, and aid in the research of new station designs for track access.

According to the administration, from 2013 and 2017, assaults reported by New York City Transit workers have increased by 15.2 percent, and lost revenue from fare evasion jumped to $225 million in 2018 from $105 million in 2015. New data released Monday indicate that the upward trend is continuing with year-to-date totals reaching $243 million in the 12-month period ending in March 2019.

According to the State, the MTA fare

evasion problem coupled with the growing reports of assaults on MTA workers has led to concern among many riders who believe there is a greater need for police presence in the subway and transit system. In 2018 there were 101 assaults against transit workers qualifying as felonies and misdemeanors. There were also 26 cases in which workers were threatened and 2,318 incidents of harassment against transit workers, ranging from verbal abuse to contact without injury. Once fully implemented, the Fare Enforcement Task Force—comprised of 200 NYPD officers, 300 MTA Police Department officers and Bridge & Tunnel Officers, and 70 City Transit EAGLE Team members—will be deployed to targeted locations with the highest levels of incidents of assault on MTA workers and the subway stations and bus routes with the highest ridership rates. The additional MTA personnel will receive training to support this effort prior to deployment.

“This year we succeeded in making historic reforms to the MTA and provided significant new funding streams that will overhaul the system,” Cuomo said. “But the MTA is still plagued by problems of public safety, attacks against transit workers and persistent fare evasion—issues that have only worsened in recent years. This new multi-pronged effort will improve safety on the system overall, protect workers from these incomprehensible assaults, and deter fare evasion by deploying 500 new uniformed officers on our subways and buses.”

Fare evasion is illegal and may subject the evader to arrest, although the majority of offenders are issued a transit adjudications bureau summons or criminal court summons, the governor noted.
