According to the charges, Claros allegedly continued a course of sexual abuse, including fondling and oral sex, at Claros’s

home after soccer drills and training. The complaint alleges this conduct continued until the victim was 17 years old. “This is a very disturbing case,” Katz said. “The mother of this aspiring soccer player allowed her son to be alone with the defendant believing he would be a mentor and help her son realize his athletic potential. Instead, the defendant allegedly betrayed that trust and sexually abused the boy for years. Now the defendant will face justice in our courts for his alleged actions.”

Claros has been indicted for allegedly sexually assaulting a 12-year-old student for five years in his Richmond Hill home on Park Lane South.

By Forum Staff A borough soccer coach has been indicted for allegedly sexually assaulting a 12-year-old student from 2013 through 2018 in his Richmond Hill residence, Queens District Attorney Melinda Katz recently announced. Jose Claros, 57, has been arraigned on a seven-count indictment charging him with course of sexual conduct against a child in

the first degree, sexual abuse in the first degree, criminal sexual act in the first degree, and endangering the welfare of a child. Claros has been ordered to return to court on March 25. According to the charges, during the Memorial Day Weekend in 2013, the victim played in an away soccer tournament where he met the defendant. By Michael V. Cusenza City Councilman Eric Ulrich (R-Ozone Park) recently reached out to the City Department of Education to change its protocols for COVID-19 school closures. In a letter penned to new Schools Chancellor Meisha Ross Porter, Ulrich details the many challenges parents in his district are currently facing as a result of the ongoing closures. “For more than a year now, students have had their entire academic lives upended by the pandemic. Distance learning simply does not provide the same quality of education and necessary social interaction for our students,” Ulrich wrote. “Additionally, as parents and guardians have been returning to work, finding childcare during the school hours has become a massive burden – and oftentimes, a costly one… During a time of such economic uncertainty, we cannot afford to put parents in a position where they must choose between putting food on the table and caring for their child during school hours.” In a memo to parents, Porter noted when students who opt-in to blended learning during the opt-in window, which begins Wednesday, March 24, would be allowed to return to school buildings:

• Students in district 3-K, Pre-K, and grades K-5, including students in District 75, who opt into blended learning during this optin window will return to buildings in April. • Students in grades 6-12 who opt into blended learning during this opt-in window will return at a later date, and we will communicate more details as soon as possible. In his letter, Ulrich notes that his office has been inundated with complaints from constituents. “In recent months, schools in my district have been opened and closed so many times that hundreds of parents have contacted my office to complain,” he writes. “In some cases, entire buildings were closed on account of just two positive cases.” Ulrich goes on to explain that no other facility or business has such a strict standards for operating, urging DOE to ease up on the protocols. “While we can all agree that the safety of our children and DOE staff is the highest of priorities – no other businesses, offices, or facilities have such strict guidelines for closures,” Ulrich adds. “In order to begin returning to normalcy, it is imperative we provide our children in-person learning and reopen our schools.”

Owner of Pharmacies in Queens and Brooklyn Charged in Fraud and Kickback Scheme By Forum Staff

An indictment has been unsealed in federal court in Brooklyn charging Robert John Sabet, the owner of Lucky Care Pharmacy in Flushing and Brooklyn Chemists in Gravesend with conspiracy to commit health care fraud, conspiracy to defraud the United States by paying kickbacks and bribes in connection with the provision of health care services, and unlawfully spending the proceeds of his fraud, prosecutors recently announced. As set forth in court filings, since September 2016, Sabet, 44, allegedly conspired to bill Medicare and Medicaid for expensive prescription drugs that were not eligible for reimbursement because they were not needed or not dispensed. Sabet also allegedly conspired to pay kickbacks and bribes to customers to convince them to fill prescriptions at his pharmacies, and to pay customers cash in exchange for the ability to bill Medicare and Medicaid for over-the-counter health carerelated products on their behalf. In December 2020, Sabet allegedly wired nearly $100,000 from

Investigators conducted a search warrant at Sabet’s home at the time of his arrest and seized a 2020 Porsche Taycan worth more than $250,000, as well as cash and luxury goods. “The defendant’s alleged participation in health care fraud, and his payment of kickbacks and bribes, corrupted the trusted relationship between pharmacies and pa-

tients, and potentially harmed the very people that the Medicare and Medicaid programs are intended to serve,” said former Acting Brooklyn U.S. Attorney Seth DuCharme. If convicted, Sabet faces a maximum sentence of 10 years in prison for conspiracy to commit health care fraud; five years in prison for conspiracy to pay kickbacks and bribes and 10 years in prison for unlawful spending. “Billing Medicare and Medic-

Sabet’s alleged payment of bribes and kickbacks also threatens the integrity of federal health care programs. According to Addabbo, TLC Virtual Resiliency was created in direct response to a call for help from professionals struggling emotionally during the COVID-19 pandemic. TLC Virtual Resiliency offers a group-based, wellness and resiliency-building program delivered through a unique social support network and customized, virtual workshops. These interactive services are meant to help manage stress, achieve employee wellness, and promote productivity in the workplace. Burnout at the workplace can result from chronic stress that has not been managed. It can be characterized by: • Feelings of energy depletion or exhaustion; • Increased mental distance from one’s job, or feelings of negativism or cynicism related to one’s job; and • Reduced professional efficacy. Workplace stress and burnout has been shown to lead to: • Increased risk-taking behavior, including problems with alcohol and tobacco; • Emotional issues; • Health concerns, where many employees take extra sick leave, and some of their illnesses may directly result from work-related stress; • Absenteeism; • Job dissatisfaction; and • Job turnover. According to TLC, “When we are under stress, the survival urges to fight, flight or freeze are activated (or awoken). Although these urges were adaptive when we were being chased by wild animals, now they are contrary to our physical and mental wellbeing. The survival urges were adaptive for short term stressors (e.g. being chased). We call this the acute stress response. Short-term survival responses

to long term stressors, often referred to as chronic stress (e.g COVID-19), can have negative consequences to our mental and physical health, such as depression and high blood pressure.” “It is already stressful enough living in New York City, going to work and trying to make ends meet to provide for your family. Being in the middle of a global pandemic, especially in high-stress professions like healthcare or education, can put anyone on the verge of burnout,” Addabbo added. “TLC Virtual Resiliency was created specifically to help these professionals better manage their stress, and thrive in these high-stress situations.” In order to help employees, TLC-VR creates a psychoeducational curriculum with educational content on resilience and coping skills that offers evidence-based techniques uniquely tailored to meet the changing needs of the individual company and its users. WORKING FROM HOME CAN BE PAINFUL Despite the advances against COVID-19, many people are still working from home full time or at least a great part of the time an escalation some common conditions have been exacerbated as a result of the restrictions imposed by the Covid-19 pandemic. The most prevalent complaint comes from people that are experiencing severe neck pain and stiffness and other ailments affecting their backs. Obviously, creating the perfect work at home scenario can be difficult for a number of reasons including availability of space, equipment, seating and a host of others. Even those not having to create a “work-athome” environment are faced with additional time on their hands that is being taken up by excessive periods on computers and smart phones. The most important advice we can offer on this front is trying to be aware of posture. If you do not have an ergonomic workspace, you are likely slouching over a dining table, bed, couch or the beloved coffee table. Used as very temporary solutions, these factors might not have such adverse effects but considering we really have no idea when this situation will be resolved, now is a good time to take some steps to stop the conditions from wreaking havoc especially for those with pre-existing back and neck problems. Stop slouching sitting on a couch or a bed doesn’t exactly suit you spine too well. In fact the posture encouraged in any seating of those types to hunch over your laptop or a phone is a recipe for disaster to your spinal column. You round your shoulders, put your head down and introduce much stress and pressure to your neck and back. No slouching! There is no perfect posture for sitting all day.

Even if you sat perfectly erect you could have pain in your back and neck. The key here is to get up regularly, change your positioning and walk around and stretch a little. Hunching over puts a tremendous strain on your neck and back. Try rolling up a pillow and placing it in the hollow arch of your back to give support to the lumbar and prevent pain. Change your posture throughout the day Switch chairs and sitting surfaces regularly keep switching between different chairs and sitting surfaces because when you shift things around, you’re not putting a lot of pressure on just one area and the strain on your body will migrate to different parts instead of settling on concentrated areas. Fluff up your seat. Get up every 40 minutes. The most impotent change you can make to your routine right now is to get up at least every 40 minutes. You take breaks at home for coffee or to go to the bathroom so treat this equally. Take 5 minutes every 40 minutes and you’ll be doing your back a big favor. Prepare a workstation Remember that the screen of your laptop should be just below your eye level, so you should elevate the height of the screen to avoid the strain your neck. You can prop up the laptop with books to reach the optimum height. Secondly, you may also try to increase the font size to avoid putting a strain on your eyes and even put a blue light filter on the screen. To raise the laptop, you may use a box. City Planning Commission Approves Zoning for Coastal Flood Resiliency By Forum Staff City Planning Commission Chair Marisa Lago today announced that the City Planning Commission approved Zoning for Coastal Flood Resiliency, citywide zoning rules that would result in all types of buildings being better able to withstand and recover from major disasters and sea level rise and which will also translate to lower flood insurance costs. “ZCFR is a game-changer for the residents and businesses who call New York City’s floodplain their home. This citywide zoning overhaul is simultaneously broad and flexible enough to help our incredibly diverse communities and building types better withstand, and then recover more quickly from, storms like Sandy, as well as slowly rising sea levels. Thank you, ZCFR, for making our future and our city more sustainable,” said CPC Chair Marisa Lago. The vote comes eight years after Superstorm Sandy struck city shores, killing 43 New Yorkers and leaving $19 billion in damage to homes and businesses. The proposal, which now moves to the City Council for review and approval, updates and improves on emergency rules established in the wake of Sandy, and makes them permanent. These changes will help to better protect the 800,000 New Yorkers, and tens of thousands of affordable homes, businesses and jobs, located in the current and future floodplain. Currently, buildings are restricted by zoning regulations that do not take resiliency into account and thus force New Yorkers to choose between interior space and resiliency improvements. ZCFR will make it easier for buildings to meet or exceed modern resiliency codes without sacrificing their basement, for example, by adding some much-needed zoning flexibility. For example, with ZCFR, a NYCHA or Mitchell-Lama complex in Lower Manhattan or Manhattan Beach will be able to construct an elevated mechanical building in its yard to address the needs of the entire campus. A single- or two-family homeowner in the Rockaways doing substantial rehab or building anew will be entitled to additional overall building height to elevate their structure above the Base Flood Elevation, established by the U.S. Federal Emergency Management

An industrial business in the South Bronx will be allowed to build a mezzanine in buildings difficult to floodproof, giving them a space to safely store sensitive equipment or important files. Critically, the proposal will also limit construction of new nursing homes in high-risk areas because of their vulnerable residents. “These zoning changes will help make New York City’s coastal neighborhoods safer, stronger and better prepared for extreme weather. As climate change continues to worsen, it has never been more important to unlock new opportunities for New Yorkers who want to invest in the resiliency of their homes and neighborhoods,” said Jainey Bavishi, director of the Mayor’s Office of Resiliency. “We

applaud the City Planning Commission for their support of this proposal and look forward to its consideration by the City Council.” After four years of intense community-engagement, the proposed changes received support from most Community Boards and Borough Presidents. It’s the result of more than 200 public meetings the Department of City Planning held with New Yorkers since 2016, garnering ideas and feedback to develop and strengthen the plan. The proposal’s four main goals: • Encourage resiliency in the current and future floodplain: ZCFR would expand where flood resilient zoning provisions apply, so that buildings in both the city’s 1 percent annual chance

floodplain and 0.2 percent annual chance floodplain, those areas of New York City that, by 2050, are also expected to have a 1 percent chance of a flood event in any given year, can meet or exceed the flood-resistant construction standards set by FEMA or NYC’s Building Code. This expanded floodplain increases the number of buildings that could be retrofitted to resiliency standards by nearly 50 percent, allowing building owners throughout the city’s floodplain to proactively raise living space and important equipment out of harm’s way. • Support long-term resilient design of all building types: Flexible zoning would allow building owners to raise habitable spaces and other building support features above expected flood eleva-

tions, without causing poorly designed, tall and narrow structures that don’t match neighboring homes. Regulations would incentivize active uses to be kept at the sidewalk level, and floodproofed ground floors with improved streetscapes. • Allow for adaptation over time through incremental retrofits: ZCFR would allow buildings to elevate or relocate important mechanical, electrical, and plumbing equipment, or backup systems like generators, above the expected height of floodwaters. This can be done either within the building, atop of the structure, or on a separate platform. • Facilitate future recovery by reducing regulatory obstacles: As seen by the COVID-19 pandemic, disasters arrive in all forms. Rather than writing new emergency provisions each time a crisis strikes, ZCFR would place recovery provisions in the Zoning Resolution, so they can be quickly selected based on the issues caused by the disaster and recovery period. These provisions include cutting down on red tape and paperwork, and allowing additional time for an affected, grandfathered business to reopen, even if it doesn’t conform with current zoning. In addition to ZCFR, the CPC approved zoning changes in three neighborhoods as part of DCP’s Resilient Neighborhood Initiative—Old Howard Beach in Queens and Gerritsen Beach and Sheepshead Bay in Brooklyn. These actions address resiliency challenges that are specific to the conditions found in these areas: In Old Howard Beach, zoning changes are proposed to limit the construction of attached homes, which are harder to retrofit and elevate than detached homes because of their shared walls. In Gerritsen Beach, zoning changes, including the establishment of a new Special Coastal Risk District, are proposed to limit future density and cap building heights at 25 feet above the flood elevation to more closely match the area’s built character. In Sheepshead Bay, the existing Special Sheepshead Bay District would be updated to align it with ZCFR and prohibit belowgrade plazas, which are prone to flooding. The City Council will hold public hearings on all four these proposals, followed by votes later this spring.

Mayor, Schools Chancellor Laud $130M Restoration to School Budgets By Forum Staff Mayor Bill de Blasio and Schools Chancellor Meisha Porter on Monday announced a full hold harmless of school budgets that were impacted by this year’s mid-year adjustment in light of federal stimulus education dollars funding for education. Every year, the mid-year adjustment process equitably redistributes funds from schools that had less student need than projected at the beginning of the school year to schools that experienced greater need. This year, schools will receive funding for any money they previously owed, including money they have already paid back, resulting in a restoration of over $130 million to almost 880 school budgets to help support them during these challenging times. Schools that received additional funding through the mid-year adjustment will still keep the full amount that was committed to them, which totals approximately $110 million for over 640 schools. “With stimulus funding we can officially return money to schools that would be lost to the registration process. Every year, school budgets are adjusted to account for enrollment and need changes -- this process ensures that funding follows the students and that we have equity across schools. School year 202021 enrollment projections were developed prior to the pandemic and did not account for COVIDdriven enrollment fluctuations. Therefore, funding equivalent to

100 percent of each schools’ enrollment loss against their projections will be restored. Earlier this month, the administration announced a 25-percent restoration of school budgets impacted by the mid-year adjustment which totaled approximately $44 million. “As a former principal, I know that holding schools harmless will be a huge relief for our school leaders and I’m thrilled we can do this after such a challenging time,” said Schools Chancellor Meisha Porter.

“This would not have been possible without support from our partners in the federal government and I’m so grateful for their shared commitment to our students, staff and school communities.” The City has made record investments directly in schools to help keep communities safe, and this new restoration to school budgets that experienced pandemic-driven enrollment fluctuations will provide much needed relief. The funding can be used

to address staffing needs, provide services for students such as after school tutoring and other direct academic services, and purchase supplies and materials. As always, at any time during the school year, the DOE will work with schools that request additional funding and in recognition of additional staffing needs associated with COVID-19, the City said it is making regular adjustments to funding allocations to ensure schools have the necessary staffing support. This year, the administration also provided additional financial support to schools with demonstrated inperson staffing needs. This funding includes: • $80 million to fund staffing needs • $50 million in cleaning supplies and PPE • $22 million for ventilation repairs, air purifiers, and partitions • $10 million for the Situation Room • $10 million for a planning grant to help prepare for the new school year • $5.7 million for an increased contract nursing rate

Schumer Calls on CDC to Conduct Outreach, Build Confidence in COVID Vaccines By Forum Staff Senate Majority Leader Chuck Schumer on Sunday called on the Centers for Disease Control to deploy a $1 billion dollar blitz to educate, conduct outreach and build more confidence in the effective COVID-19 vaccines. Schumer said a national blitz, where New York gets a sizable allocation of fed dollars to help overcome vaccine hesitancy, will help speed our larger recovery. Schumer said this kind of effort, right now, is even more important with the rise in COVID variants, like the Brazil variant just documented in Brooklyn. Schumer also says the funds he wants directed at this CDC effort are already in the coffers of the agency, thanks to the recent passage of the American Recovery Plan. Schumer said the vaccine supercharge he announced this past Friday, which includes 1.65 million vaccines a week to New York by the end of April, won’t maximize public immunity if swaths of people refuse to actually get a vaccine. Schumer said he wants federal CDC dollars for this blitz to go towards boots-on-the-ground here in New York, door-knocking, the use of technology, multi-lingual strategies and even town halls. Schumer said the number of New Yorkers and people across the country who are willing to get a vaccine has increased as more people receive it, and hear about it. A recent poll from the Kaiser Family Foundation “found that 55 percent of adults have already gotten their first dose or are plan-

ning to as soon as it becomes available, whereas in December just 37 percent said the same.” The same poll said that the portion of people who are unsure about getting the vaccine—what the Foundation calls the “wait and see” group—has shrunk. Schumer and other experts say this is a promising sign that suggests confidence in the vaccine is increasing as the public sees neighbors, family members and professional peers receive a COVID vaccine without dangerous or limiting health effects. Schumer praised President Joe Biden’s work that has led to these improvements, and said that in order to advance these positive facts, a CDC-led blitz that ensures facts reign and delivers a barrage of truth could help us achieve herd immunity faster. However, despite these positive steps, Schumer said there is still an urgent need to address vaccine hesitancy. The most recent polls show that 1 in 3 adults will either refuse a vaccine or are unsure if they will take it when it is offered to them. A study this week found that barely half of front-line health-care workers have received their first dose of the vaccine, with huge numbers of them saying they weren’t confident in its safety and effectiveness.

Cusenza At least two elected officials are calling on JetBlue airline CEO Robin Hayes and pushing him to keep JetBlue’s headquarters in Queens and the airline’s thousands of jobs in New York. Amid a report saying New York’s “hometown airline” is weighing a move from its Long Island City headquarters to another location outside the state, Senate Majority Leader Chuck Schumer on Thursday made the case to Hayes to keep the 1,300-person Queens headquarter jobs, and the roughly 7,000 JetBlue employees who report to New York locations every day right where they are.

“JetBlue has always said it best: since their start up in 1998, to their first flight from JFK in 2000, their home, heart and soul have always remained in New York,” Schumer said. “The purpose of my call to Mr. Hayes was simply to remind him that JetBlue’s roots and its future are here in New York. With the critical pandemic relief dollars we just delivered on to help save airlines like JetBlue, and the thousands and thousands of New Yorkers they already employ, the airline should actually clear the runway to grow here, not recede. Bottom line, I am confident JetBlue will remain New York’s hometown airline for a long time to come.”

Bill Calls to End Outsourcing, Invest in American Companies By Forum Staff U.S. Sen. Kirsten Gillibrand (D-N.Y.) on Thursday called for “bold actions” to invest in American companies, protect jobs, and ensure coronavirus relief funds are reinvested in the United States economy. Gillibrand recently cosponsored the bicameral No Tax Breaks for Outsourcing Act, legislation that would protect U.S. jobs by ending tax incentives created by the 2017 Trump tax giveaway bill, which send jobs and profits overseas, according to the senator. Additionally, Gillibrand joined Senate Democrats in urging President Joe Biden to temporarily suspend trade waivers that could allow foreign companies to bid on projects funded by the American Rescue Plan. In an effort to give U.S. companies and their workers a fair shot at these government contracts and ensure COVID-19 relief and recovery funds are reinvested in the U.S., Gillibrand and her colleagues are pushing to close loopholes that allow foreign firms — which do not have American workers or pay American taxes — to bid as American companies. By suspending these waivers while trade-pact terms are renegotiated with our trade partners, the United States would put Americans back to work, reduce shortages for crucial items like Personal Protective Equipment, ventilators, and chemical inputs for pharmaceuticals, and boost domestic industries responsible for those products. Specifically, the No Tax Breaks for Outsourcing Act would repeal offshoring incentives by: Equalizing the tax rate on profits earned abroad to the

tax rate on profits earned in the U.S. It would end the preferential tax rate for offshore profits by eliminating the deductions for “global intangible low-tax income” and “foreign-derived intangible income” and applying GILTI on a per-country basis. Repealing the 10 percent tax exemption on profits earned from certain investments made overseas. In addition to the half-off tax rate on profits earned abroad, the

Trump tax exempts from taxation entirely a 10 percent return on tangible investments, such as plants and equipment, made overseas. The new bill would eliminate this offshoring incentive. Treating “foreign” corporations that are managed and controlled in the U.S. as domestic corporations. Ugland House in the Cayman Islands is the five-story legal home of over 18,000 companies, many of them really American companies in disguise. This section would treat corporations worth $50 million or more and managed and controlled within the U.S. as the U.S. entities they in fact are, and subject them to the same tax as other U.S. taxpayers. It would deem certain mergers between U.S. companies and smaller foreign firms to be U.S. taxpayers, no matter where in the world the new companies claim to be headquartered. Specifically, the combined company would continue to be treated as a domestic corporation if the historic shareholders of the U.S. company own more than 50 percent of the new entity. If the new entity is managed and controlled in the U.S. and continues to conduct significant business here, it would continue to be treated as a domestic company regardless of the percentage ownership. Eliminating tax break for foreign oil and gas extraction income. Oil and gas extraction income earned abroad gets a further break on the already half-off rate other industries pay on their offshore profits. This provision would eliminate this special tax break for big oil and gas companies.
