Street Crew Busted for Stealing Tires and Rims from Cars in more than a Dozen Queens Communities

By Forum Staff Two Queens men and one Brooklyn man have been variously charged with grand larceny and other crimes for allegedly stealing tires and rims from cars parked on streets in Queens, Queens District Attorney Melinda Katz announced Thursday.

The pit-stop style strippings occurred throughout the borough, and in the middle of the night, between November 2019 and May 2020, Katz noted.

Jonathan Pacheco, 30, is the main defendant and when it became known that he was wanted by police, he fled the state. Pacheco was apprehended in Pennsylvania and extradited to Queens last week to face charges.

Pacheco’s co-defendants are fellow Queens resident Fabian Rodriguez, 33, and Jacob Martinez, 29, of Brooklyn.

All three men are variously charged in three complaints with auto stripping in the first degree, criminal possession of stolen property in the fourth degree and grand larceny in the fourth degree.

According to the charges, on November 7, 2019, Pacheco is observed on video surveillance around 12:32 a.m. in the vicinity of 233rd Street in Oakland Gardens. He parked his Subaru directly across from a 2019 Honda Civic and

with an unknown accomplice allegedly removed the lug nuts from the Honda’s wheels and took all four tires and rims. When the owner of the vehicle returned to the spot where he had parked his car, the Honda was propped on top of milk crates.

The accused ring of thieves repeated this scenario, with Pacheco driving throughout Queens in search of parked Hondas. Over the course of six months, the crew struck in

Bellerose, Hollis, Forest Hills, Middle Village, Fresh Meadows, Flushing, Ozone Park, Richmond Hill, Glendale, Jamaica Hills, Bayside, Maspeth and Rego Park. Sometimes Pacheco worked with one or two co-defendants and sometimes with other unapprehended and unknown individuals.

Katz said on February 24, 2020, Pacheco and the two co-defendants along with an unapprehended other are observed on video

surveillance parking their Subaru and Ford near a black 2019 Honda Accord at the intersection of 153rd and Reeves streets around 1:30 a.m. All three defendants allegedly participated in this theft. Martinez hauled milk crates from the Ford to the Honda and then carried two tires and two rims back to the Ford. Rodriguez also rolled a tire and rim to the waiting Ford. After all four tires and rims were removed from the Honda, Pacheco put the car jack back in his Subaru and the three defendants and an unapprehended other left the scene.

The DA added that Pacheco participated in a total of 14 steals and made deals to sell the stolen tires and rims to a buyer he did not know was an undercover detective. In January and February 2020, Pacheco offered to sell the tires and rims to his “buyer” and set up a meeting to exchange eight stolen tires and rims for a total of $1350 cash.

In all, the defendants allegedly stole up to approximately $42,000 worth of tires and rims.

“Under the cover of darkness, and armed with car jacks and lug wrenches, these defendants allegedly stole tires and rims from more than a dozen cars,” Katz added. “This kind of thievery costs car owners thousands of dollars, but this crew is now officially out of business.”

While the fire is still officially under investigation, sources told NBC 4 New York that fire marshals discovered an accelerant on the property and suspect that the blaze may have been set intentionally.

By Forum Staff Essential provisions to protect and harness New York’s water resources are included in the final 2020 Water Resources Development Act, Senate Minority Leader Chuck Schumer and Sen. Kirsten Gillibrand (both D-N.Y.) announced Thursday.

In the legislation, called “America’s Water Infrastructure Act of 2020,” the senators secured language that would authorize new studies and projects to protect communities across New York and restore critical ecosystems in the Hudson River Estuary. This includes authorization for a new feasibility study for Lake Ontario coastal resiliency, as well as authorization to construct the Hudson-Raritan Estuary Ecosystem Restoration Project, the Army Corps East Rockaway Inlet to Rockaway Inlet and Jamaica Bay Hurricane Sandy Reformulation Project, the Hashamomuck Cove coastal storm risk management project, and several projects critical to New York’s water resources, navigation and watershed restoration.

The bill also includes language to expedite completion of many new projects, including the Lake Montauk Harbor Navigation Project, key to New York’s water restoration, risk management, and navigation.

Schumer and Gillibrand secured a report on emergency flood protection for lakes in the new legislation, a critical piece to improving the use of existing Army Corps authorities for Lake Ontario flood protection.

The WRDA authorizes water resources studies and projects and sets policies for navigation, flood control, hydropower, recreation, water supply, and emergency management for the Army Corps. The final legislative text passed in the House and is set to appear on the Senate floor for votes in coming days.

What the Latest COVID Relief Deal Means for New York

By Forum Staff With a bipartisan spending and COVID relief deal just reached, Senate Minority Leader Chuck Schumer on Monday detailed its pending impact on New York as more than $50 billion dollars.

The deal includes direct relief checks, extending enhanced unemployment insurance, and secures another round of forgivable Paycheck Protection Program for small businesses, restaurants and nonprofits across the state. As part of the deal, more than $13 billion flows directly to New York State governments via education funding, transit funding and highways, vaccine distribution, COVID health funding, emergency assistance for renters and more.

Schumer emphasized that the following figures are tentative: Over $6.5 Billion for NY in Enhanced Unemployment Compensation – The bill provides billions in additional federal relief for struggling New Yorkers by extending the historic unemployment insurance reforms established in the CARES Act through March 14, 2021. Importantly, it reinstates the critical lifeline of the enhanced unemployment assistance, providing an additional $300 per week on top of all state and federal unemployment benefits. The bill also:

Part of the aid earmarked for NY in the new COVID relief bill will go toward vaccine distribution.

Extends the Pandemic Unemployment Assistance program, which provides unemployment benefits to the self-employed, freelancers, gig workers, part-time workers and other New Yorkers in non-traditional employment, and increases the number of weeks of PUA benefits an individual can claim from 39 to 50.

Provides 24 additional weeks of federally-funded unemployment insurance benefits to New Yorkers who have exhausted their regular state benefits.

Continues the full federal financing of state Shared Work programs, allowing thousands of New York employers to keep their valued employees on payroll during

this downturn.

Delivers a federally-funded $100 per week additional “mixed-earner” benefit to New Yorkers who have a combination of traditional (W-2) and independent employment (1099) income (1099) and are disqualified from receiving PUA because they are still eligible for regular state benefits. $9 Billion for New Yorkers – Direct cash payments to New Yorkers, including $600 for individuals making up to $75,000, $1,200 for couples making less than $150,000, and an additional $600 per child. This amounts to $2,400 for a family of (4).

$260 Million – FEMA’s funeral assistance – financial aid to those who have lost a loved one among the over 35,000 deaths in New York caused by COVID – which comes at no cost to the State.

“New York State governments will directly receive over $13 billion dollars in a variety of ways from mass transit aid, to education aid, to money for vaccinations and testing. In addition to direct relief checks, extending enhanced unemployment insurance, this deal provides another round of PPP and grants for small businesses across the state, including set-asides for minorityowned and other underserved businesses and new larger forgivable loans for restaurants as part of a funding bridge to the Biden administration where we will to fight secure additional relief,” said Schumer. “In addition, the center of New York’s cultural life—independent music and live event venues, Broadway, independent movie theaters, museums and other cultural institutions—will receive dedicated aid to stay alive here in New York. Direct aid in the form of education funding, transit funding and highways, vaccine distribution and COVID health funding, along with emergency assistance for renters are just some of the immediate ways this legislation will help the state and city’s budgets amid the crisis.”

By Forum Staff Governor Andrew Cuomo on Saturday announced he has signed an Executive Order providing additional support for two of the groups hardest hit by the COVID-19 pandemic—vulnerable homeowners and the restaurant industry. Under Executive Order 202.83, local governments can continue to provide property tax exemptions for lowincome senior citizens and persons with disabilities who own property through 2021 by lifting an in-person renewal requirement which would put vulnerable New Yorkers at risk of infection from COVID. Additionally, the sales tax deadline for restaurants in orange zones which have been required to suspend

This raises obvious concerns amid the COVID-19 public health emergency as those eligible to receive these benefits are among those most susceptible to the virus. This modification will decrease density in assessor’s offices to limit the spread of COVID and ensure critical tax relief.

Under the Governor’s Executive Order, local governments can automatically renew 2021 benefits for all property owners who received the benefit in 2020 unless the locality has reason to believe an individual has changed their primary address, added another owner to the deed, transferred the property to a new owner, or passed away.

In addition to the flexibility provided for

these benefits, the Executive Order provides a three-month extension to the deadline for restaurants in orange zones, including New York City, to turn over sales taxes to the state.

Restaurants in impacted areas were required to suspend indoor dining temporarily. Extending the sales tax deadline for payment of taxes due on December 21 to March 2021 will ease tax burdens for restaurants and bars in communities where COVID-19 metrics necessitated additional restrictions. This action also provides a degree of temporary relief as New York continues to fight to ensure the federal government provides real fiscal relief for these small businesses. Affected restaurants should follow guidance from the Tax Department to request this relief.

“As alleged in the indictment, the defendants manipulated information in over a dozen pharmacies to defraud the Medicare program, including by taking advantage of systems that were intended to assist patients during the COVID-19 pandemic,” said Acting Brooklyn U.S. Attorney DuCharme.

By Forum Staff An indictment was unsealed in federal court in Brooklyn on Monday charging the two owners of over a dozen pharmacies in New York City and on Long Island for their roles in a $30 million health care fraud and money laundering scheme in which they exploited emergency codes and edits in the Medicare system that went into effect due to the COVID-19 pandemic in order to submit fraudulent claims for expensive cancer drugs that were never provided, ordered or authorized by medical professionals.

Brothers Peter Khaim, 40, and Arkadiy Khaimov, 37, both of Forest Hills, are charged with one count of conspiracy to commit health care fraud and wire fraud, and one count of conspiracy to commit money laundering. Khaim was separately charged with two counts of concealment money laundering and one count of aggravated identity theft. Khaimov was separately charged with two counts of concealment money laundering.

According to the indictment, the defendants used COVID-19 emergency override billing codes in order to submit fraudulent claims to Medicare, for which they were paid over $30 million for cancer medication Targretin Gel 1 percent including for claims where the medication never was purchased by the pharmacies, prescribed by physicians or dispensed to patients – often during periods when pharmacies were non-operational – and using doctors’ names on prescriptions without their permission. The defendants allegedly acquired control over more than a dozen New York pharmacies by paying others to pose as the owners of the pharmacies and hiring pharmacists to pretend to be supervising pharmacists at the pharmacies for the purpose of obtaining pharmacy licenses.

Targretin Gel 1 percent has an average wholesale price of approximately $34,000 for each 60-gram tube.

The indictment also alleges that with the proceeds of the fraud, the defendants engaged in a money laundering conspiracy by creating sham pharmacy wholesale companies which they named after pre-existing pharmacy wholesalers, and fabricated references to invoices to make it appear that funds transferred from the pharmacies to the sham pharmacy wholesale companies were for legitimate pharmaceutical drug purchases. In the first phase of this conspiracy, the defendants conspired with an international money launderer who arranged for funds to be wired from the sham pharmacy wholesale companies to companies in China for distribution to individuals in Uzbekistan. In exchange, the defendants received cash from an unlicensed money transfer business, minus a commission that was deducted by the money launderer. In the second phase of this conspiracy, when the fraudulent proceeds exceeded the amount of cash available, the defendants caused others to transfer funds back from the sham wholesale companies to the defendants, their relatives, or their designees, in the form of certified cashier’s checks and cash that was dropped off at their residences in the middle of the night. The defendants used the proceeds of the scheme to purchase real estate and luxury items.

GETTING WARMED UP IS Harder For Some...

Grumbling about the cold won’t make it go away, and for some people, those dealing with thyroid conditions, the winter can be especially taxing.

We’ve put together some tips for those of you with thyroid conditions and how to survive the winter in a little more comfort.

The thyroid gland is like a thermostat for our bodies. People with a sluggish thyroid are prone to having low body temperature and are prone to cold intolerance. If your thyroid function is low, you need to take some precautions to protect your health.

Strategies for warming up and giving your thyroid a break: Get plenty of rest.

Keep your home temperature warm.

If you happen to have a landlord that is stingy with the heat, getting a note from your doctor may provide some prodding. If you do need to go out into the cold, dress in layers.

Hot baths are a nice way to get yourself warm without making your thyroid do all the work!

If you can’t make it to your local pharmacy to buy a heating pad, try filling an old sturdy sock with rice. Make sure you tie the end securely and then heat it in the microwave for two minutes—just be careful that it’s not too hot when applying it to your body!

Soaking your feet in hot water for 5-10 minutes will warm up the rest of your body.

Cuddling and holding hands with your significant other or your pets can help you get through the cold. Spouses and pets are will share their heat with you for back and belly rubs. Did you know that the saying “Three Dog Night” is thought to originate from Eskimos who would keep dogs in their igloos to help them warm up on particularly cold nights!

Balancing your blood sugar will help you stay warm. Be sure to eat high quality fats and proteins every few hours and limit sugary and starchy foods.

Foods known as thermogenic can increase the metabolism, and can actually create heat when converting food to energy. Some common spices in this category are: chili, mustard, red pepper, black pepper and red-hot chili peppers.

Don’t leave friends and family “out in the cold,” let them know you need a little more heat than the average bear.

Remember, people with thyroid conditions are more likely to experience the “Winter Blues”.

Last but not least, winter puts us at risk for Vitamin D deficiency. Stop in and talk to your pharmacist about a quality replacement.

DOI Issues Report on NYPD’s Response to Floyd Killing-Inspired Protests in NYC

By Forum Staff City Department of Investigation Commissioner Margaret Garnett issued a report Friday detailing the investigation into the response of the NYPD to the George Floyd protests held throughout the City from May 28, 2020, through June 20, 2020. The mayor directed DOI to conduct a review of the NYPD’s response, a directive that was later codified in Executive Order 58 and signed on June 20, 2020. In addition, on May 31, 2020, DOI received a request from City Council Speaker Corey Johnson and Councilmember Ritchie Torres, Chair of the Oversight & Investigations Committee, to investigate the NYPD’s approach to policing the protests.

DOI’s investigation focused on the NYPD’s institutional and operational response to the protests, including but not limited to its planning, strategy, enforcement actions, intelligence collection and dissemination, training, and police-community relations. As part of the investigation, DOI also examined the history and current structures of civilian police oversight in New York City. The report made 20 recommendations to the NYPD to improve their response to mass protests and two recommendations regarding streamlining and improving police oversight in the city. DOI Commissioner Margaret Garnett said, “This investigation sets out DOI’s

findings on the important issues of how the NYPD responds to mass protests, and the structure of civilian police oversight in this City. Our hope is that these factual findings, analysis, and recommendations will contribute to meaningful changes at the NYPD, as well as provide a map toward greater police transparency through a comprehensive and coordinated police oversight approach. I urge the NYPD and elected officials to implement the recommendations outlined in this

Report and embrace the opportunity for reform.” DOI’s investigation identified several deficiencies in the NYPD’s response to the protests that undermined public confidence in the NYPD’s discharge of its responsibility to protect the rights of the public to engage in lawful protest. Specifically: • The NYPD lacked a clearly defined strategy tailored to respond to the large-scale protests of police and policing. The NYPD largely defaulted to application of “disorder

control” tactics and methods, without adjustment to reflect their responsibility to facilitate lawful First Amendment expression.

• The NYPD’s use of force and certain crowd control tactics to respond to the Floyd protests resulted in excessive enforcement that contributed to heightened tensions.

Some policing decisions relied on intelligence without sufficient consideration of context or proportionality. The NYPD collected specific intelligence that warranted consideration in making policing judgments; however, intelligence alone does not dictate a particular police response, which was, at times, disproportionate.

• The NYPD deployed officers who lacked sufficient, or sufficiently recent, training on policing protests. With the exception of officers in specialized units, most officers responding to the protests had not received recent relevant training for policing protests.

• The NYPD lacked a centralized community affairs strategy for the Floyd protests.

The NYPD Community Affairs Bureau was not part of the planning or strategy for policing the Floyd protests.

• The NYPD lacked a sufficient data collection system to track relevant protest data.

DOI determined that the NYPD lacks a reliable, consistent method to capture relevant protest data including the total number of protest-related arrests.
