Cuomo Again Vetoes Jamaica Bay Protection Legislation

By Forum Staff Earlier this month Governor Cuomo once again vetoed a bill sponsored by State Sen. Joe Addabbo, Jr. and Assemblywoman Stacey Pheffer Amato (both D-Howard Beach) aimed at increasing the standard of dredging materials that is placed into Jamaica Bay’s burrow pits.

According to Addabbo and Pheffer Amato, the two-part bill would end the sunset clause on the original bill to protect the bay, so it would be permanent law in New York State instead of being voted on every two years. It also seeks to change the criteria for filling the Jamaica Bay borrow pits to comply with federal Ocean Dumping Act criteria.

“Even though the governor vetoed this bill again, I intend on re-introducing it next year and then continuing to negotiate with the state agencies,” Addabbo said.

“After seeing the incredible improvement of the water quality of Jamaica Bay — with advocates saying the bay is the healthiest it has been in decades — and with the reemergence of marine wildlife to the area, Assemblywoman Pheffer Amato and I believe that the sunset clause on this bill should be removed and it should be made permanent. With such a positive impact on Jamaica Bay, we also want to make the waters even cleaner by further improving the quality of dredging materials.”

Area community advocates, including the Jamaica Bay Ecowatchers, have praised the bill and how much it has improved the bay. Animals such as seals and even whales

have been spotted off the shores.

Decriminalize Marijuana: Rep. Hakeem Jeffries

By Forum Staff The U.S. House of Representatives on Friday passed the Marijuana Opportunity Reinvestment and Expungement (MORE) Act of 2020. The bipartisan legislation would end the federal prohibition and criminalization of marijuana by removing it from the Controlled Substances Act and facilitate the expungement of low-level federal marijuana convictions, as well as incentivizing state and local governments to do the same.

Today’s vote marks the first time since the passage of the Controlled Substances Act of 1970 that a Congressional chamber has voted on legislation to remove marijuana from its prohibitive classification under federal law.

According to Rep. Hakeem Jeffries (DQueens and Brooklyn), the Marijuana Opportunity, Reinvestment, and Expungement (MORE) Act would: Decriminalize marijuana at the federal level by removing the substance from the Controlled Substances Act, apply this retroactively to prior and pending convictions and enable states to set their own policies.

Require federal courts to expunge marijuana arrests and convictions and resentence those still in custody or under court supervision for a marijuana offense.

Prevent the government from denying an individual their federal benefits, student financial aid or security clearances needed to obtain government jobs because of marijuana use.

Authorize the assessment of a 5% excise tax on marijuana sales at the manufacturer level to fund programs to provide services to individuals most adversely impacted by the War on Drugs, including reentry services, job training and substance use treatment.

Fund equitable licensing programs so that states and localities can implement inclusive marijuana licensing systems that minimize barriers to marijuana licensing and maximize employment for individuals most adversely impacted by the War on Drugs.

“The failed war on drugs first began almost 50 years ago when Richard Nixon declared drug abuse ‘public enemy number one.’ At the time, there were less than

200,000 people incarcerated in America.

Today there are 2.3 million. Disproportionately Black and Latino,” Jeffries said in remarks delivered on the House floor.

“Many of those who have been incarcerated over the years [are] imprisoned for nonviolent drug offenses, including possession of marijuana. The United States incarcerates more people than any other country in the world. We have ruined lives, families and communities. It’s a stain on our democracy. The possession of marijuana is done in equal if not greater numbers by white Americans, when compared to Black Americans. And yet in community after community after community, Blacks and Latinos make up approximately 75-80% of the arrests and prosecutions. How can that be? Marijuana use is either socially acceptable behavior or criminal conduct. But it can’t be socially accepted behavior in some neighborhoods and criminal conduct in other neighborhoods when the dividing line is race. And that’s why we must pass the MORE Act, decriminalize marijuana in America and bring to life the principle of liberty and justice for all.”

A 22-year-old man on Monday was shot in the head on Liberty Avenue in Ozone Park.

By Michael V. Cusenza A 22-year-old man was shot to death Monday night in Ozone Park, according to police and published reports.

The still-unidentified victim was discovered unconscious and unresponsive on Liberty Avenue near 90th Street, authorities said. He was rushed to Jamaica Hospital Medical Center where he later succumbed to his wounds.

Area residents told The Forum that the neighborhood is fairly quiet. At least two neighbors, who declined to give their names, told The Forum that they heard two “pops” Monday night, but dismissed them as sounds emanating from an enhanced street racing automobile.

The investigation is ongoing.

In other Ozone Park crime news, on Monday, a borough grand jury indicted

Steven Cohen, 63, on charges of murder, attempted murder, criminal possession of a weapon and other offenses for allegedly shooting and killing a 26-year-old deli worker in October.

According to the charges, on Oct. 26 at approximately 6:15 p.m. inside the Cross Bay Express Deli, at 137-02 Cross Bay Boulevard, the defendant, became embroiled in an argument with the victim when he was ordered out of the store. Cohen left the deli but returned a short time later allegedly with a Colt revolver. The defendant is accused of pointing the gun at Tarwala Mahmadkhurshid, the deli worker he’d argued with, and then fired multiple times. The victim was struck in the abdomen by a single bullet. The defendant then allegedly fired the weapon again, this time aiming for another deli employee, but he missed his intended target.

A 12-year-old boy and his 7-year-old cousin are safe and sound after several hours of self-induced anxiety gripped their South Ozone Park community Monday.

According to police and published reports, around 9 a.m. the boy surreptitiously swiped the keys to his parents’ white Range Rover, hopped in the luxury SUV and drove away from his 115th Street

LI Man Indicted in Pregnant GF Homicide

By Forum Staff A Long Island man has been indicted by a Queens grand jury and arraigned in Supreme Court on murder charges in the October death of his pregnant girlfriend, Queens District Attorney Melinda Katz recently announced.

Goey Charles, 30, has been charged with second-degree murder. Remand has been continued for Charles and he is set to return to court on Feb. 3.

Katz said that on Oct. 23, at about 2:50 a.m. video surveillance shows the defendant in a white Dodge Challenger pull over at 216-07 Horace Harding Expwy. Charles exits the driver’s seat of the car—which was registered to the victim—and then gets in the back where Vanessa Pierre, 29, is seated and moving, according to the video footage. Soon after the defendant closes the door behind him, the woman appears motionless and stretched out

across the length of the backseat. At approximately 4:38 a.m., the defendant is allegedly seen exiting the vehicle and then dragging the pregnant woman’s body out of the car, leaving her on the sidewalk. He then gets back in the car and drives away.

DA Katz said around 6 a.m., a passerby saw Pierre on the ground at the location.

There was a pair of gray sweatpants wrapped around her neck. She was unresponsive and unconscious, and when emergency respond-

ers arrived on the scene, she was pronounced dead.

“The defendant is accused of committing a despicable, irreparable act of domestic violence – killing the young woman who was to be the mother of his child, dragging her limp body from a car and then abandoning her body alongside a road,” Katz said. “He will be held accountable for his alleged actions.”

If convicted, Charles faces up to 25 yearsto-life in prison.

By Forum Staff On Saturday, U.S. Rep. Grace Meng (DFlushing) called for changes to the Trump administration’s COVID-19 vaccination plan that would force states to sign an agreement in which the personal identification information of vaccine recipients would be shared with the federal government.

In a letter Meng led to Health and Human Services Secretary Alex Azar and Centers for Disease Control and Prevention Director Dr. Robert Redfield, the Congresswoman called for the agreement to not require the collection of personal identifiable information, such as Social Security, passport, and driver license numbers from those who receive the vaccine, and that it prohibit any individual identification data from being shared with non-health federal agencies. Under the current Data Use Agreement, HHS can share the personal information with other federal agencies including the Department of Homeland Security, which could use the data to target undocumented immigrants.

“All people, including immigrants, deserve to access the COVID-19 vaccine without fear or reservation of having their personal identification information shared with non-health-related federal agencies,” Meng said. “Sharing this data will instill fear in our immigrant communities, and deter immigrants from being vaccinated.

Providing the vaccine must be free of politics, and we urge that revisions be made so that it is not mandatory for states to collect and share vaccinated individuals’ personal identifiable information with the federal government. I await a response to our letter.”

The correspondence was signed by a total of 48 members of Congress.

“Already too many undocumented immigrants and those in mixed status families avoid accessing healthcare and needed government services because they fear doing so will reveal their status and upend their lives,” said Frankie Miranda, President and CEO of the Hispanic Federation. “At a time when we need complete public confidence and participation to finally end this pandemic, our public health agencies and political leaders must send a clear signal that no one has anything to fear from the COVID-19 vaccination program. A failure to revise the Data Use Agreement will result in lower rates of participation in immigrant communities and undermine the success we all seek.”

Meng wrote in the missive, “As we continue our fight against this highly contagious and invisible enemy, we must keep in mind that immigrants make up a disproportionate number of essential workers who risk their own lives to save lives, keep our cities running, and ensure Americans have access to food. With record-breaking numbers of new COVID-19 cases across the U.S. and more projected through this holiday season, we urge you to swiftly make the necessary changes to the Data Use Agreement, so that all people – regardless of background and immigration status – will access the vaccines without fear or reservation. We look forward to hearing from you by Wednesday, December 9, 2020 on this urgent matter.

Last week, Gov. Andrew Cuomo, joined by numerous advocacy organizations, also sent a letter to Secretary Azar expressing the same concerns, Meng noted.

Promote Small Businesses Throughout the city, Business Improvement Districts, Chambers of Commerce, and other business associations are working with small businesses to put together events and special deals to encourage New Yorkers to shop local. The City should elevate these efforts and expand their reach.

From LinkNYC terminals to ads on the subway and bus to various websites, to Small Business Services, the City should be leveraging these resources to coordinate with local business associations and promote small businesses.

Specifically, the City should work to promote NYC & Company’s “All In NYC: Neighborhood Getaways” campaign, which offers participating small businesses, museums and other attractions a chance to promote assorted discounts, sales or buy-one-get-onefree offers across the five boroughs.

Allow Businesses a “Cure Period” to Address and Fix Violations City and State agencies should take a dramatically different approach to inspections and fines, seeking to collaborate with businesses rather than punish them.

Moving forward, any violations that do not pose an immediate hazard to the public should be granted a 30-Day “cure period” to address and rectify the issue.

Rather than taking a punitive approach and issuing a fine, the City should grant all businesses the opportunity to remediate problems.

“For so many retail stores and mom-and-pop shops, the holiday season is usually one of the busiest and most profitable times of year,” Stringer added. “But this year, lagging tourism, slow economic progress and the threat of a second wave pose big challenges for small businesses already struggling from earlier shutdowns. We need to get creative about how we support and promote our small businesses this holiday season – that means cutting red tape, helping businesses develop a digital footprint, and pedestrianizing our neighborhoods and public spaces so New Yorkers are encouraged to walk, shop, and eat local. There is no economic recovery for New York City without our small businesses. I urge the City to embrace our recommendations to kickstart that recovery.”

By Forum Staff Queens District Attorney Melinda Katz announced Friday that Luz and Rosendo Tejeda, of Manhattan, have been charged with grand larceny and other crimes for allegedly swindling a disabled woman and her elderly mother out of more than $500,000. The couple is accused of switching bank accounts to have the victim’s monthly annuities deposited into their personal account between November 2016 through September 2020.

Rosendo Tejeda, 63, of Lenox Avenue was arraigned Wednesday before Queens Criminal Court Judge Mary Bejarano on a complaint charging him with grand larceny in the second degree, criminal possession of stolen property in the second degree and endangering the welfare of an incompetent person.

Luz Tejeda, 56, now of East 14th Street in Hazelton, PA., was arraigned late last night before Queens Criminal Court Judge Bejarano on a complaint charging her with grand larceny in the second degree, criminal possession of stolen property in the second degree, attempted grand larceny in the second degree, identity theft in the first degree, scheme to defraud in the first degree and endangering the welfare of an incompetent person. The defendants’ return date is February 5, 2021. If convicted, they both face up to 15 years in prison.

District Attorney Katz said, defendant Luz Tejeda was hired to coordinate home care for the 43-year-old victim who was born deaf, blind, immobile and intellectually disabled. A lawsuit alleging medical malpractice was filed on behalf of the victim and when a settlement was reached the cash was disbursed via monthly annuity payments. Working in the family’s Corona home, defendant Luz Tejeda devel-

oped a friendly relationship with the elderly mother. The senior – who does not speak or read English - trusted the worker and her husband and signed documents giving the Tejedas shared guardianship of her daughter.

Continuing, according to the charges, in the fall of 2016 the defendants allegedly reached out to the financial services company disbursing the monthly annuity and requested the deposits be diverted to their personal bank account. In June 2019, the defendants also submitted a letter supposedly written by the incapacitated victim to change her physical address to their own Manhattan home.

In addition to the re-direction of annuity payments in excess of $500,000 to their own personal accounts, according to the charges, defendant Luz Tejeda allegedly completed an application with Settlement Resources of New York, Ltd to borrow more than $145,000 against the victim’s future annuity payments and further received loan advances totaling $9,400 that were deposited into the defendant’s personal accounts.

This commencement of the criminal investigation stopped the disbursement of monies to the defendants in September 2020.

DA Katz said the elderly mother was under the impression the monthly deposits had stopped due to the financial institution filing bankruptcy.

The scheme was discovered when a new, kind and compassionate health care attendant attending to the elderly mother realized the household was not receiving monies to support the mother and her incapacitated daughter and made a referral to the Queens County District Attorney’s Elder Fraud Unit.

Glaucoma is an eye disease that can damage the optic nerve. It is the optic nerve that supplies visual information from your brain directly to your eyes.

The most common form of this disease is primary open-angle glaucoma, which is especially dangerous because it has no symptoms except gradual vision loss. For this reason it is imperative that you do yearly comprehensive eye exams so that vision changes can be detected and monitored.

Acute-angle closure glaucoma, is a medical emergency. If you experience any of the following symptoms, you should see your doctor immediately: Severe eye pain accompanied by nausea, vomiting, redness in the eye, sudden vision disturbances including blurred vision, and or seeing colored rings around lights.

Glaucoma can be caused by fluid buildup in the channels of your iris or cornea.

Normally, a clear fluid, known as aqueous humor, passes through these channels and fills the front part of the eye. If however, there is a blockage or partial obstruction, the pressure in your eye may increase. This can lead to damage of the optic nerve and loss of sight.

While glaucoma is the second leading cause of blindness in the world, no one knows what causes the increase of pressure (IOP) in the eyes. IOP can be caused by dilating eye drops, medications like corticosteroids, high blood pressure or reduced blood flow to the optic nerve. People 60 and over are at increased risk and for African-Americans the risk grows after 40. Patients with diabetes and high blood pressure and heart disease also have an increased risk of developing glaucoma.

17 Years for Food Cart Stab Slay

By Forum Staff A 34-year-old man has pleaded guilty in the September 2018 stabbing death of a Long Island man who was patronizing a food cart in Jackson Heights when he was attacked, Queens District Attorney Melinda Katz announced Tuesday.

John Daves, whose address is unknown, has pleaded guilty to first-degree manslaughter. He is scheduled to be sentenced on Feb. 3. The Hon. Kenneth Holder indicated that he will sentence Daves to 17 years in prison, to be followed by five years’ post-release supervision.

Shortly after 9:30 p.m. on Sept. 27, 2018, at the intersection of 80th Street

and Roosevelt Avenue, Daves and the victim, Miguel Angel Becerra-Perez, were both waiting at a food cart to place their orders. The two men exchanged words and a verbal argument ensued. Daves then grabbed a knife from the food cart; video surveillance of the scene shows him chase the 25-year-old victim down the street, catch up to him and then stab BecerraPerez in the right arm and chest. The victim died as a result of the attack.

“A minor dispute while ordering at a food cart escalated into a man being chased down and brutally stabbed to death,” Katz added. “This was a needless act of violence that should never have happened.”

Mayor Appoints Conn. Native as Acting Transportation Commissioner

By Forum Staff Mayor Bill de Blasio on Friday appointed Margaret Forgione the Acting Commissioner of the City Department of Transportation.

Forgione, a 26-year DOT veteran and the department’s current Chief Operations Officer, will assume the role when Commissioner Polly Trottenberg leaves her position on Friday, Dec. 11.

According to the administration, Forgione has served at DOT in senior roles since 1994, most recently as COO, a position she has held since June 2016. Prior to that, Forgione had served as DOT’s Manhattan borough commissioner. She has also led DOT’s Arterial Maintenance Unit, directed the Adopt-A-Highway program, and served as a special assistant to the First Deputy Commissioner.

Forgione began her work in NYC government as a senior analyst in the Mayor’s Office of Operations.

As COO, Forgione oversaw the agency’s operational divisions, totaling roughly 5,000 employees, including within the Staten Island Ferry, Bridges, Roadway Repair and Maintenance, Sidewalks and Inspection Management, Traffic Operations, Transportation Planning and Management, the Office of
