Ulrich Rips Con Edison for ‘Unfair’ Rate Hike

By Michael V. Cusenza City Councilman Eric Ulrich (R-Ozone Park) this week submitted written testimony in opposition to what the South Queens lawmaker characterized as Consolidated Edison’s “unfair” proposed rate hikes.

In January, Con Edison sought approval from the State Public Service Commission for new electric and gas delivery rates in 2020. The proposal, according to the utility, seeks an additional $485 million to run the company’s electric delivery system in 2020 and $210 million for the natural gas delivery system.

According to Con Ed, over the next three years, on average, electric rates will go up by 13.5 percent in that time. Electric bills will increase 4.2 percent this coming year, then 4.7 percent the following year, and an additional 4 percent in 2022.

The utility is also expected to raise the price of natural gas, with a 7.5-percent increase in 2020, 8.8 percent in 2021 and 7.2 percent in 2022.

“Our proposal will build on the progress we have made in putting tools in the hands of our customers to help them manage their energy usage,” Con Ed President Tim Cawley said earlier this year. “We’re making it easier for them to take advantage of energy efficiency, charge electric vehicles and com-

municate with us. We’re also improving our response to severe weather events and taking steps to protect the environment.”

However, Ulrich on Tuesday argued that the proposed rate hikes are far above the rate of inflation and would make it difficult for seniors and individuals living on a fixed income to cover the cost of utilities. Ten percent of Con Ed customers are already roughly 60 days behind on paying

their bills, according to a recent Spectrum News NY 1 report.

“New Yorkers already pay some of the highest utility rates in the nation. As a member of the New York City Council, I see firsthand how difficult it can be for some families to make ends meet. These unfair rates are simply not tenable for many of my constituents. I urge the Public Service Commission to decline Con Ed’s rate

hike request,” Ulrich wrote. “I am proud to submit this testimony to defend my constituents against these egregious rate hikes.

Con Edison is one of the wealthiest energy companies in the United States, with more than $10 billion in annual revenue, and over $48 billion in assets. There is no rhyme or reason behind the company’s proposed hikes other than to extract more money from hardworking New Yorkers.”

The utility claimed in January that it was seeking approval for the rate hikes “to fund infrastructure and other investments that would give customers more convenient access to clean, energy-saving products; enhance safety and reliability; and make it easier for customers to get information about their usage and service.”

Con Edison was scheduled to hold a public hearing on Wednesday, Dec. 11, at 6 p.m. at the SUNY Global Center on E 55th Street in Manhattan.

Council Greenlights Parking Bill

Cusenza The City Council on Tuesday overwhelmingly approved a bill that authorizes the Police Department to tow away unattended vehicles that are obstructing a sidewalk, crosswalk, fire hydrant, bicycle lane, or bus lane if said vehicle poses a threat to safety or would inhibit the safe and expeditious passage of Metropolitan Transportation Authority buses.

The measure, which garnered 45 affirmative votes and 0 negative votes, also calls for the NYPD to issue a report in January of 2021 that includes, for each month in 2020, the number of vehicles towed disaggregated by police precinct.

By Michael V. Cusenza Twenty veterans of the U.S. Armed Forces die by suicide each day. In the past six years, 270,720 Americans have taken their own lives—45,120 of whom have been veterans or service members, according to the RAND Corporation.

These alarming numbers spurred vets, active duty military, advocates, medical experts, and elected officials to rally Saturday for immediate action to better support service members and veterans and ensure they have access to the care they need.

Following a Senate Armed Services Personnel Subcommittee hearing led

by Sen. Kirsten Gillibrand (D-N.Y.) last week, the senator unveiled a new, twopronged approach to begin addressing the crisis. According to the National Institute on Drug and Abuse, 50 percent of military personnel believe seeking help for mental health issues would negatively affect their career. As such, Gillibrand is calling for a review of the Military Command Exception for any changes that can be made to make mental health care more accessible to service members. The Military Command Exception provides a list of requirements for military mental health professionals to report visits by service members to their commanders. These rules include vague requirements such as: harm to self, harm to others, harm to mission, special personnel, inpatient care, and other special circumstances. In a letter to the Department of Defense, Gillibrand notes that consistent and sustained mental health care is vital to combating the crisis of military suicides, and service members must be able to trust mental health providers to keep confidentiality.

Gillibrand also is calling on the Department of Veterans Affairs and DOD to improve the support veterans receive during their transition from military service to civilian life. Periods of transition have been identified as a particularly vulnerable time for veterans and service members. According to DOD, nearly 40 percent of veterans or service members who died by suicide had either entered or exited service, or had experienced a geographical move in the last 90 days or would in the coming 90 days. Veterans who have left service within the past year are 2.5 times more likely to die by suicide than their active duty counterparts, and the rate is even higher among female veterans. The program to assist veterans as they transition to civilian life, the DOD’s Transition Assistance Program, currently consists of a meeting with a counselor to identify a pathway once leaving service. The actual training consists of several workshops and classroom sessions that educate service members on areas such as benefits and resources for finding a job, and is approximately 1-2 weeks long. Gillibrand is calling on the VA and DOD to work more closely to build a comprehensive transition program that provides more internships, reintegration programs, and on-the-job training to help veterans as they transition from military service to civilian life.

“Suicide in the military community—both among current service members and veterans—is a serious and devastating problem, and it is painfully clear that we are not doing nearly enough to address it,” the senator said. “That is why today, I am calling for new action to give our service members and veterans the support they need.”

Cost of Incarceration at All-Time High

By Forum Staff The City spends a record high $337,524 to incarcerate one person for a full year, or $925 per day—an 85-percent increase since 2014, according to a new analysis of the Department of Correction released Friday by City Comptroller Scott Stringer.

At the same time, Stringer noted, while the DOC’s budget declined for the first time in recent history, falling $60 million to about $1.3 billion in Fiscal Year 2019, an additional $1.3 billion was spent on jail-related expenses outside the DOC budget—including employee fringe benefits and pension contributions, and correctional health care services.

And violent incidents continue to rise disproportionately to the declining incarcerated population, Stringer reported. In FY 2019, the rate of fight and assault infractions per incarcerated person rose by 12 percent, while the rate of assaults on staff rose by 37 percent and the rate of use of force rose by 42 percent.

As the average daily jail population fell by 41 percent over the past decade, the raw number of fight and assault infractions in jail went up by 79 percent and the raw number of incidents and allegations of correction officer use of force on incarcerated individuals more than tripled.

The number of tort claims filed for personal injury at a correctional facility has nearly quadrupled to 3,894 in FY 2018 from 1,061 in FY 2008.

creased to 7,938 in FY 2019 from 8,896 in FY 2018, the share of the population designated

by DOC as having a propensity to violence has increased disproportionately. From FY 2014 to FY 2019, the share of the jail population identified by DOC as a “security risk” increased from 8.2 percent to 16.4 percent, as the share of the population with a mental health diagnosis grew from 38 percent to 45 percent.

The analysis is the Comptroller’s 6th annual update of DOC spending and performance trends. The report uses budget data, claims against the City, reports of violence in

Stringer noted that as the City moves to construct four new jail facilities in Queens, Brooklyn, the Bronx, and Manhattan, and implement sweeping changes to bail, discovery, and speedy trial laws, the report’s findings “underscore the continued financial and personal costs” of the current jail system.

“It’s time to fundamentally transform our criminal justice system—and key to that is an efficient corrections system committed to safety and rehabilitation. Although our jail system has shrunk, this analysis shows

that the system has not changed, as spending, violence, and the use of force continue to rise disproportionately. For long-term savings—and the long-term good of our City—we must start seeing better all-around outcomes as our jail population declines,” the comptroller said. “Our vastly reduced jail population should be yielding significant savings that we can reinvest in communities and strategies that keep our jail population as small as possible and turn the page from decades of mass incarceration. We have far more work to do.”

Because Queens Borough President Melinda Katz and the City Parks Department will hold a ribbon cutting ceremony for the new Queens Vietnam Veterans Memorial in Elmhurst Park on Friday, Dec. 20 at 10:00 a.m.

That’s right. It’s finally here.

Built on the northwest corner of Elmhurst Park, the first-of-its-kind boroughwide memorial in Queens features the names of 371 service members who called Queens home and died during the Vietnam War or served and are classified as “missing in action.” The memorial also recognizes borough veterans who have since lost their lives as a result of their service during the conflict.

will flank the space. One will bear the name of the memorial, the five crests of the military and the Vietnam Service Medal, which is awarded to all military members who served in the Vietnam War. On the inside of this wall will be an etching of bamboo, which represents a common element of the war.

The second wall will offer a history of the Vietnam War that will list key events and dates. This wall will also bear the names of Queens residents who served in the Viet-

nam War who were either killed in action or are listed as missing.

Construction of the memorial has been long sought after by many of the nearly 59,000 Queens veterans, led by late former Vietnam Veterans of America Chapter 32 President Pat Toro. Prior to his passing in 2014, the Marine Corps vet was a staunch advocate for a boroughwide memorial to recognize the sacrifices made by hundreds of Queens residents and their families during the Vietnam War.

Following Toro’s lead, current Chapter 32 President Manuel Edenhofer, former group president Michael O’Kane and Vietnam Veterans of America National President John Rowan were instrumental in continuing to seek the funding needed to design and build the memorial.

The memorial’s design and construction was fully funded by Borough President Katz, who has allocated $2.3 million in capital funding between fiscal years 2017-18, which

comes on top of the $550,000 first secured in FY2008 by then-City Councilwoman Katz.

“In 2008 Pat Toro had an idea for one central memorial for all of the Queens war dead,” O’Kane said. “Borough President Melinda Katz was the first to sign on and offer support for this project.

Without her support this wouldn’t have gotten done. Chapter 32 of the Vietnam Veteran of America offers our thanks for her backing and support.”

Vets and elected officials broke ground on the memorial site in November 2018.

“To our veterans of the Vietnam War, we know the sacrifices you made, the sacrifices your families made. The Queens Vietnam Veterans Memorial will help ensure generations never forget, and remind our borough, city and nation to remain ever grateful,” Katz said at the time.

Prolific ‘Fisherman’ Sentenced to up to Three Years in Prison for Stealing Mail

By Forum Staff A Long Island man has been sentenced to up to three years in prison for stealing mail—including numerous checks valued in excess of $50,000—from U.S. Post Office mailboxes, Acting Queens District Attorney John Ryan announced Tuesday.

Travis Everett a.k.a. Lamont Everett, 26, pleaded guilty in October to second-degree criminal possession of stolen property. He was sentenced Tuesday to one to three years in prison.

According to the charges, on Nov. 8, 2018, at approximately 1:38 a.m., Everett was spotted on a monitored NYPD live video feed approaching a blue mailbox at 108th Street and 63rd Drive in Rego Park.

Everett placed an object inside the box, proceeded to pull repeatedly on an attached string and was able to re-

move mail from inside the mailbox.

Everett repeated this process several times during a five-minute period.

When he was caught and questioned by the police, Everett said that he had dropped his keys in the mailbox.

According to the charges, Everett was “mailbox fishing”—a federal crime in which envelopes containing checks and sensitive documents are “fished out” of blue curbside U.S. Postal Service collection boxes by resourceful crooks using a makeshift rod: an adhesive connected to a weighted object that is attached to the end of a string or rope.

Everett had two batteries attached to a rat glue trap with a shoe string. Police found four pieces of mail on the floor of Everett’s vehicle, 32 checks in the glove compartment, and 314 checks were inside the trunk. The value of the recovered checks totaled more than $300,000 and some of the recovered checks

had been fraudulently altered.

Upon further investigation, two of the recovered checks—originally written out in the amounts of $41,202 and $52,639—had been mailed from Fresh Meadows. Another victim had endorsed several checks—including one for $1,757—and dropped them in a mailbox on Flatbush Avenue and

Avenue R in Brooklyn.

“This kind of brazen thievery is unacceptable,” Ryan said.

In a separate case in Manhattan, Everett pleaded guilty on Nov. 6 to first-degree identity theft and second-degree criminal possession of a forged instrument. Everett will be sentenced on Jan. 8, at which time he faces up to three years in prison,

to run concurrent with his Queens sentence.

Everett’s Manhattan case relates to six separate incidents in September and October 2016 during which Everett was captured on bank surveillance video depositing stolen and subsequently forged checks into bank accounts belonging to complicit account holders, and withdrawing the illicit funds from these accounts.

“A theft from the blue collection box is a theft from customers who place significant trust in the rich history and tradition of the Postal Service. Our customers expect their mail to get to its intended destination without delay and without being stolen. The defendant violated this trust,” said Philip Bartlett, inspector in charge of the New York Division of the U.S. Postal Service.

Shahid Burton, 19, of Vernon Boulevard in Long Island City was identified after a transit officer stopped him for going through a subway turnstile with another individual in March.

By Forum Staff Bishop Jesé Milagrosa, the spiritual leader of Our Lady of La Salette Church in Bayside, Queens, has been charged with sexually assaulting a male member of his congregation over a 3-year period, beginning in 2011 when the victim was a pre-teen. “The defendant is accused of using his position as head of the church to take advantage of an innocent child for his own sexual gratification,” said Acting District Attorney Ryan said Bishop Milagrosa, 69, of Bayside, was arraigned before Queens Criminal Court Judge Karina Alomar on a complaint charging him with predatory sexual assault against

a child, first-degree course of sexual conduct against a child, and first-, second- and third-degree criminal sexual act. Bishop Milagrosa was ordered held on $250,000 bail and to return to court on December 20, 2019. If convicted, the defendant faces 10 years to up to life in prison.

Acting District Attorney Ryan said that, according to the investigation, the victim became an active member of Our Lady of La Salette Church, a traditionalist church in Bayside, at a young age and allegedly spent much of his time, out of school, with the defendant. Beginning on or about May 12, 2011, according to the criminal complaint, Bishop Milagrosa engaged in sexual acts with the victim, who

was only 12 at the time. This course of sexual conduct allegedly continued, on and off, until April 16, 2014.

According to the complaint, in a recorded conversation, the victim confronted the defendant on October 28, 2018, about engaging in sexual acts with him as a child. The defendant also allegedly made admissions to detectives at the time of arrest stating in Spanish in sum and substance that he had both oral and anal contact with the victim.

The MTA and TWU Local 100 have reached a tentative agreement that provides a new four-year contract for more than 37,000 transit employees.

By Forum Staff The Metropolitan Transportation Authority and the Transit Workers Union Local 100 have reached a tentative agreement that provides a new fouryear contract for more than 37,000 transit employees, both parties announced Thursday.

The contract covers more than 30,000 TWU employees working for New York City Transit and 6,600 employees of the Manhattan and Bronx Surface Transit Operating Authority, which include bus operators, maintainers, cleaners, maintainers and other employees who work out of seven bus depots in Manhattan and the Bronx.

Under the terms of the agreement, which is subject to ratification by the union’s members and approval by the MTA Board, NYC Transit will pay an average net wage increase of 2.3 percent each year through May 2023. Before giving effect to health savings and increases in availability, a 1-percent increase in wages is approximately equal to $36 million, offset by $44 million in savings in the health plan and availability. Once the contract is ratified, workers would receive a 2-percent increase for 2019, a 2.25-percent increase in 2020, a 2.5-percent increase in 2021, and a 2.75-percent increase in 2022.

The deal includes a suite of provisions that, combined and enacted in partnership with the TWU, will ensure the MTA delivers on advancements in operations while realizing savings for the financial plan. This includes a commitment to a one-and-a-half day improvement in employee availability—the number of days an employee is available and reporting to work—which will deliver an estimated $17 million in annual savings to the MTA. Availability has steadily de-

creased since 2000, the agency reported.

After an improvement of one day in employee availability is achieved, any additional savings will be jointly shared between the TWU and MTA. The agreement also includes a recognition of overtime equalization as an important priority for both the MTA and TWU, to ensure that opportunities for overtime are equally available to eligible employees and that overtime is efficiently allocated. The MTA has indicated that it will also enforce existing contractual agreements in order to achieve this priority.

The pact allows for mutual swaps of shifts between employees in similar job classes across all TWU members for the first time, giving employees increased flexibility in scheduling while ensuring sufficient coverage for critical operational roles and minimizing overtime.

The union made worker safety a priority issue during contract talks. The TWU and MTA pledged to work together to increase public awareness of assaults on transit workers, advocate for increased usage of existing provisions in State law that classify worker assaults as a felony, and create a task force that includes partners in law enforcement to ensure these issues receive necessary attention and that all parties have a sustained focus on solutions. NYCT and TWU will also cooperate to explore the use of new technologies to increase track worker and flagger safety, the parties noted Thursday.

MTA Chairman Pat Foye said the new contract “reflects the hard work of thousands of transit employees who have helped us reach the highest on-time subway performance in more than half a decade, while providing a fair deal for taxpayers and our more than eight million daily customers.”

WHEN THE SWELLING GETS TOUGH: DEALING WITH EDEMA Many people suffer from swelling of the feet and ankles, a painful and difficult chronic condition.

While there are many reasons for such swelling, some of them can be treated through the use of compression socks and/or medications and supplements, while others could signal serious medical problems involving the heart, lungs, kidneys or thyroid.

Make sure you investigate the source of the edema you are facing and work with your doctor and your pharmacist to relive the swelling and prevent it from recurring.

Swollen feet can be caused by excessive accumulation of fluid in the tissues, generally painless, usually found in older people, overweight persons, pregnant women or a consequence of long periods in standing or sitting position.

Here are some of the actions that you can take to reduce the swelling: --Put a pillow under your legs when resting to keep the feet in a higher position than the rest of the body --Wear elastic stockings that your pharmacist can help you choose according to measurements and degree of compression --Do not spend too much time seated or staying in the same position

--Exercise can reduce swelling of the legs. Blood flows naturally from the legs to the heart. Exercises stimulate normal blood circulation.

--Raising the legs above the heart--promotes blood circulation to the brain --Weight loss-obesity slows blood circulation in the entire body. Losing weight helps blood to circulate better and can reduce inflammation in the extremities.

--Reduce salt intake and adopt a balanced diet Finally you can try these two fairly successful home remedies: Applications with vinegar – alternation, one hot, another cold are an alternative treatment for leg swelling. Mix two equal parts of water and vinegar soak a towel, and apply for 7-10 minutes. Repeat 2-3 times.

-Boil 250 ml water, 1 / 2 tablespoon molasses 1 tablespoon anise. Keep it boiling until only a half of the mixture will remain. Drink this mixture in three or four rounds during the day as it can reduce swelling of the feet, provided a chronic disease does not trigger it.

Remember if the swelling persists or is accompanied by other symptoms like shortness of breath or any discomfort in the chest, seek medical help immediately.

TWA Hotel at JFK Airport Earns Historic Preservation Award

By Michael V. Cusenza The TWA Hotel at John F. Kennedy International Airport recently earned the Excellence in Historic Building Rehabilitation honor at the 2019 State Historic Preservation Awards.

The TWA Hotel transformed the former Trans World Airlines terminal, which was designed by world-renowned architect Eero Saarinen in 1962 and closed to the public in 2001, into the centerpiece of a modern 512-room hotel that preserves its neo-futuristic design. The hotel has 50,000 square-feet of event space, a 10,000 squarefoot observation deck and pool, and a 10,000 square-foot fitness facility. Opening in May 2019, the project also incorporated a Lockheed Constellation L1649A “Starliner” aircraft—a post-WWII passenger airliner and one of only four remaining in the world—as a cocktail lounge.

Additionally, the TWA project has restored the terminal’s most iconic spaces, which will now include dining options such as Paris Café by Jean-Georges and the Ambassador’s Club, as well as museum exhibitions devoted to the New York Jet Age, the defunct airline’s history, and the midcentury modern design movement.

Created in 1980, the State Historic Preservation Awards are awarded by the Office of Parks, Recreation and Historic Preservation each year to honor excellence in the protection and revitalization of historic and cultural resources. Cuomo also signed legislation in 2013 to bolster State use of rehabilitation tax credits, which have spurred billions of dollars in completed investments of historic commercial properties and tens of millions in owner-occupied historic homes.

“Historic preservation helps encourage reinvestment and revitalization in our cities, towns and neighborhoods,” State Parks Commissioner Erik Kulleseid said. “This year’s awards demonstrate the extraordinary commitments, hard work and strong partnerships that have made preservation an important tool for community renewal, economic development and job growth in New York.”

By Forum Staff The Metropolitan Transportation Authority’s “top-to-bottom mismanagement” of a $600 million contract with Bombardier Transit Corporation to produce 300 subway cars is rife with dysfunction and defects—and nearly three years behind schedule, according to an audit released Monday by City Comptroller Scott Stringer.

The audit found that throughout the seven-year extended contract term Bombardier consistently failed to timely meet project milestones, comply with technical requirements, produce acceptable work, and promptly correct serious defects in critical structural components of the subway cars. In addition, the report showed that the MTA failed to adequately oversee Bombardier’s contract performance and timeliness and failed to complete required annual contractual evaluations to hold Bombardier accountable.

According to Stringer, in 2012, the MTA entered into a $599 million contract with Bombardier for the design, production, and delivery of 300 R179 subway cars.

The contract called for Bombardier to deliver 10 prototype cars to the MTA by January 2015 and all 300 cars by January 2017.

Bombardier missed both deadlines—and

by January 2017 had delivered only 18 of the 300 cars for which the contract called.

As of the date of the audit, delivery is still incomplete and is now 35 months behind the original contract schedule, Stringer noted.

Although the MTA and Bombardier negotiated revised deadlines, a $1.27 million payment reduction, and Bombardier’s agreement to deliver 18 additional subway cars at no additional cost, Bombardier again failed to meet the extended deadline

of January 2019, delivering only 162 cars by that date. As of December 2019—nearly three years after the original project completion date—the MTA has reported that 298 of the 318 cars now required have been delivered, of which 278 are in service, the comptroller reported.

“The taxpayers who foot the bill for the MTA’s $600 million contract with Bombardier were promised new, state-of-the-art train cars to help modernize the city’s ailing, outdated transit system. Instead, commuters are dealing with more delays and more subway breakdowns as we wait for trains that are three years behind schedule,” Stringer said. “This audit reveals that MTA’s top-to-bottom mismanagement of Bombardier’s contract—from missed deadlines to bad welding to poor design—cost New Yorkers as much as $35 million to keep old, broken-down cars on the tracks long past their expiration date. By shedding light on these issues today, we are urging the MTA to exercise far greater accountability, oversight, and responsibility in their management of these critical contracts. New Yorkers are paying for a 21st century subway system and deserve nothing less.”

The Comptroller’s Office noted that MTA New York City Transit said it “fundamentally disagrees with the audit conclusions in several respects. It is dramatically short-sighted of the audit to conclude that the completion of the contract had been substantially delayed from the outset of the contract in 2012. Further, in measuring the quality of Bombardier’s performance and NYCT’s oversight primarily on the basis of the original milestone dates, the audit fails to recognize the complexity of the typical rail vehicle design and manufacturing process and the valid reasons for delays that occurred including unforeseeable technical issues.”
