Councilmen Call on Cuomo to Temporarily Close Public Transit System

By Michael V. Cusenza Four City councilmen recently sent a letter to Gov. Andrew Cuomo recommending a temporary closure of the city subway and bus systems for at least a week for the deep cleaning of trains, buses, and stations.

Councilmen Bob Holden (D-Middle Village), Eric Ulrich (R-Ozone Park), Peter Koo (D-Flushing), and Mark Gjonaj (D-Bronx) signed the missive expressing “grave concern” over the Metropolitan Transportation Authority and its workers, and the belief that “drastic measures must be taken to stop the spread of COVID-19 in our transit system.”

The pandemic has ravaged the ranks of the MTA: nearly 3,000 workers have tested positive for COVID-19; 79 employees have died from the virus.

“MTA employees are going to work every day with woefully inadequate personal protective equipment. They are given one mask and one pair of gloves for an entire week while continuing to work among the filth of the subway tunnels. The union rep also reports that the employees receive practically no biohazard training that would have prepared them for this situation,” the elected officials wrote. “As a result, MTA workers are dying at a faster rate than any other frontline workers.”

“Stations are being disinfected twice a day, rolling stock, subway cars, buses, Metro-North, Long Island Rail Road cars are being disinfected on a regular basis as well,” MTA Chairman and CEO Patrick Foye said.

Later in the letter, the councilmen note that they believe “that the New York City transit system is a primary contributor to the spread of COVID-19.” During the week-long closure, the pols recommend that the City and State “partner with forhire vehicle services to provide rides to

essential workers. All tolls and parking restrictions, except for no standing, should also be lifted during the shutdown to allow essential workers to drive and park their personal vehicles close to work. Upon reopening the system, all commuters should be required to wear face coverings, and

there should be daily shutdowns from midnight to 5 a.m. for deep cleaning.

“It is time for a direct and coordinated approach from the City and State to bring this crisis to an end,” the four councilmen concluded.

MTA Chairman and CEO Patrick Foye called the shutdown suggestion a “well intentioned” but “bad idea.”

“We’re providing MTA essential service on subways and buses, 75 percent of normal, pre-pandemic service. And we’re providing that for 5 percent of our customers.

But those 5 percent of our customers are the first responders and essential employees that I mentioned before. We’re carrying those customers safely. It’s a safe environment for our customers and our employees.

Stations are being disinfected twice a day, rolling stock, subway cars, buses, MetroNorth, Long Island Rail Road cars are being disinfected on a regular basis as well.

And that creates an environment where customers and employees can feel safe.

The consequence of shutting the subways down would frankly disrupt the ability of healthcare workers, firefighters, that list that I went through before, including transit workers, to get to and from their jobs, and frankly, would make the consequences of this terrible pandemic even worse,” Foye said on Monday on “PIX 11 Evening News.”

Halt Utility Shut-offs during Crisis: Pols

By Michael V. Cusenza More than 100 members of Congress recently urged the leaders of both Legislative chambers to put a nationwide moratorium on essential utility service disconnections as Americans are asked to stay home throughout the COVID-19 pandemic.

In a letter to House Speaker Nancy Pelosi, Senate Majority Leader Mitch McConnell, House Minority Leader Kevin McCarthy, and Senate Minority Leader Chuck Schumer, 113 senators and representatives pointed out that losing access to basic utilities including electricity, water, heat, and internet adds to the economic burdens already felt during the tumultuous public health crisis. Utilities provide New Yorkers the ability to follow essential Centers for Disease Control and Prevention guidelines and help stop the spread of COVID-19.

Specifically, access to running water is essential for consistent hand washing, while electricity keeps refrigerators running, allowing families to preserve food and delay trips to the grocery store, the elected officials noted.

The utility shut-off moratorium would not only provide comfort and security for American families, the pols said, but it would also begin to address the systemic issues driving utility burdens across the country. Newly unemployed Americans

Kirsten Gillibrand (D-N.Y.) said. “As we ask people to stay home, wash their hands, and follow public health guidelines, we must ensure all Americans have uninterrupted access to critical utilities. We are in this together, and it is our duty as public officials to make these resources available for the public good.”

In the letter, the officials pushed for at least a six-month nationwide moratorium

in order to provide a sufficient grace period for families to recover from unemployment and other pandemic-related impacts.

Additionally, the missive requests that all late fees and bill payments for low-income families be forgiven through the end of the grace period.

“We applaud the many utilities and that have taken voluntary steps to prevent disconnections during this crisis. Many states have also issued orders to keep utility services connected.For all of us to get through this together we need to have a national policy with clear standards that utilities can follow, and ensure that no family is left behind in the patchwork of policies,” the pols wrote.“The federal government should provide utilities with support for operations as well as customers, especially in light of declining utility revenues caused by unemployment, small business shutdowns, and rising poverty.Congress cannot simply give low-wealth Americans a shortterm reprieve on disconnections without ensuring them adequate time to recover from job losses and other coronavirus impacts. Families should not be condemned to a growing and unpayable utility burden that comes due at the end of this national emergency. We must ensure that these essential services are maintained when the COVID-19 pandemic threat has passed and the country’s economy has stabilized.”

“We need to get it right. You got one chance to restart the economy the right way,” Hizzoner told Bill Hemmer on Fox News. “If we rush when we are still in the throes of this crisis, if we let people come back together and start gathering again, and there are lessons, again from around the world and from our own past that show us when you take the foot off the gas too early, you could have a spread again. So my point would be, show consistent progress reducing this disease, start to drive it down to the point that we can contain it. We have

a small enough number of cases to actually know where we are quarantining people again, the right way. We are testing widespread, so we can drive it back once and for all. And if we don’t, you don’t want to see a boomerang affect. You do not want to see this thing reassert.”

As expected, not many area residents were fans of the decision.

“A full beach closure would be difficult to enforce and would deal a devastating blow to the local economy. We are already seeing significant gains in the fight against COVID-19 and we don’t know where we will be in June when the budget is adopted,” City Councilman Eric Ulrich (R-Ozone Park) said. “This decision is premature.”

EDITORIAL Ignorance Is...Lethal As the weeks of quarantine start to mount up, there is no doubt that we are feeling the pressure of the limitations imposed

by Covid-19. The rays of hope that we get on a daily basis when witnessing the actions of everyday heroes sacrificing for our good, is something that really helps to ease the stress and tension. It gives us hope and reminds us that there is much good in the world.

Those sacrifices help put into perspective what we are really dealing with. But then there are other perspectives that seem to be completely removed from reality. They are the perspectives that dull those rays of hope and put all of us at risk.

You can witness those by turning on the TV or watching a video of Georgia’s Gov. Brian Kemp when he announced his decision to reopen business in his state, including gyms, tattoo parlors, nail salons, massage parlors and bowling alleys among others–– providing of course, that social distancing and hygiene are maintained. I for one have to say that as much as I long to return to my weekly massages, I don’t think getting one from six feet away would really prove therapeutic. Or how about a mani-pedi from across the room? And although I do not subscribe to getting tattoos, I would imagine that even the most inked among us would

be a little hesitant to have anything etched into their skin from a distance. Clearly, lifesaving social distancing cannot be upheld under certain circumstances.

Here on a local level I was both shocked and totally disgusted when during a weekend drive through Rockaway, residents were observed, with their children in tow, walking through the streets, maskless and gloveless, on handball courts and in parks and along the boardwalk with no regard for viral hygiene, social distancing or any other measures in place to save lives. My life. Your life.

Not just their lives. Is it possible that these

people just don’t care?

There are two words I hope not to hear come from my grandchildren’s mouths: stupid and moron. The connotations to me are so distasteful, however it seems that every time I get out in my car and see the way some people are behaving, I am finding occasion to use both of them so frequently it’s truly disturbing.

I doubt very much whether it would be possible to find someone who would admit to being very happy or satisfied with the current state of life. Someone who was happy to be out of work or unable to pay their mort-

gage or rent. Or others who were happy to be cut off from their family and friends.

From hugging their grandkids. But we can get back what we are missing now if we do what we must.

Everyone wants to return to normal but this fight is so much bigger than us on so many levels that it would be a disaster of monumental proportions if we rush getting back to things as we once knew them.

I am hoping for the government to tighten restrictions as much as necessary––not relax them. And I am looking for careless individuals to stop their disrespect of those of us who are holding to that which keeps everyone safe. We all remember the request that came from authorities in reporting on terrorism: If You See Something, Say Something. If you are in a space or situation where someone is not observing that which will keep you safe that you’d better SAY SOMETHING, loud and clear.

We’re all looking toward having our world back but let’s make sure we are alive to see that happen. We must not rush. Thinking that because the curve is flattened you can go out and forget all the guidelines is ignorant. Now we realize we’ve always been told that ignorance is bliss but these are Covid-19 times where ignorance is lethal.

Nursing Homes to Swiftly Report Virus Cases

Forty-three residents at the New Franklin Rehabilitation and Healthcare Facility in Flushing have succumbed to COVID-19.

Cusenza Nursing homes must immediatelyreport any new COVID-19 cases and pandemic-related deaths toresidents, their loved ones, and the Centers for Disease Control and Prevention, according to an order from the U.S. Centers for Medicare and Medicaid Services, Rep. Grace Meng (D-Flushing) announced Monday.

Under the new CMS directive, at a minimum, nursing homes must inform residents and their representatives within 12 hours of the occurrence of a single confirmed infection of COVID-19, or three or more residents or staff with new-onset of respiratory symptoms that occur within 72 hours. Also, updates to residents and their representatives must be provided weekly, or each subsequent time a confirmed infection of COVID-19 is identified and/or whenever three or more residents or staff with new onset of respiratory symptoms occurs within 72 hours. Facilities will include information on mitigating actions implemented to prevent or reduce the risk of transmission, including if normal operations in the nursing home will be altered. This information must be reported in accordance with existing privacy regulations and statute, CMS officials noted.

On Friday, Meng sent a letter to President Donald Trump urging him to help combat the high numbers of deaths that are occurring at nursing homes across the Empire State, particularly in Queens, due to the pandemic.

According to the State Department of Health, as of April 17, 215 residents across 11 borough nursing homes had succumbed to COVID-19. At the New Franklin Rehabilitation and Healthcare Facility in Flush-

ing, 43 deaths have been attributed to the virus.

“The deaths at our nursing homes have been tragic and heartbreaking,” Meng said.

“The elderly are among our most vulnerable populations.”

The congresswoman’s correspondence calledon Trump to use any means possible to expeditiously manufacture COVID-19 tests, and prioritize them for New York so that local long-term care facilities can conduct the testing that is needed. Meng also urged the president to increase coronavirus funding for nursing homes, and improve data on COVID-19 cases in these facilities to help contain and mitigate the spread of the virus.

By Sunday night, CMS had issued the memorandum detailing the new COVID-19 reporting requirements for nursing homes.

“Telling nursing homes that they must make families aware of COVID-19 cases is something that has been urgently needed, and I’m pleased that the Trump administration will be moving forward with its new rule following my request to the president,” Meng said.“Family members of nursing home residents have a right to know this information. It will help ensure that they can do everything possible to protect their loved ones, and it will go a long way towards controlling and preventing the spread of the illness. We must do all we can to safeguard the health and safety of our elderly population.”

The CMS is a federal agency within the Department of Health and Human Services that administers the Medicare program and works in partnership with state governments to administer Medicaid, the Children’s Health Insurance Program, and health insurance portability standards.

Man Charged in 102nd Precinct Detective’s Death Denied Early Release

Cusenza The recidivist thief being held on Rikers Island pending trial for an alleged string of robberies that culminated in the February 2019 murder of a City cop in Richmond Hill had his petition for early release denied by a Queens Supreme Court judge, District Attorney Melinda Katz recently announced.

Christopher Ransom, 28, was indicted in March 2019 for the line-of-duty death of 102nd Precinct Det. Brian Simonsen, 42, and the wounding of Sgt. Matthew Gorman, who were responding to a call of a robbery in a cell phone store on Atlantic Avenue when they were mistakenly hit by other officers also responding to the chaotic scene allegedly initiated by Ransom.

Katz noted that as highly contagious COVID-19 continues to ravage the five boroughs, her Office is reviewing myriad requests from defense attorneys to have their clients sprung from City lockup. According to Katz, earlier this month she was alerted to 20 defendants whose immediate release the defense sought in a mass writ.

Six applications were for defendants with parole violations; Katz did not oppose to the release of four of those defendants.

Some defendant’s cases were resolved with Katz’s consent or withdrawn. Last Wednesday, the DA’s Office opposed the release of

the remaining eight defendants—including Ransom—at a hearing that was presided over by Queens Supreme Court Justice Kenneth Holder. After a lengthy court proceeding this morning, the Court dismissed the defense petition.

Additionally, on Tuesday, City Comptroller Scott Stringer sent a letter to Mayor Bill de Blasio and Department of Correction Commissioner Cynthia Brann calling on the administration to protect the health and safety of correctional facility staff and

incarcerated individuals who are at risk amid the COVID-19 pandemic. In his missive, Stringer raised concerns that crowded City jails are ill-equipped to protect people during such an outbreak and that DOC has not provided enough information about how they are managing the spread of the virus.

Stringer said he urged the City to take a series of steps to prioritize the health and safety of people in custody and staff, including releasing more incarcerated individuals, reducing jail admissions, providing daily updates on the number of people tested and hospitalized, improving safety of housing areas and access to medical care, and offering face masks and soap at no cost.

“The rise in deaths and confirmed cases of COVID-19 within New York City correctional facilities is alarming and makes clear that Rikers Island must be a central focus in the battle against this public health emergency,”the comptroller added. “The City’s response thus far falls far short and fails to match the scale of this mounting crisis. We have to act immediately and do more to protect correctional staff and people in custody, because New York City’s ability to stop the spread of COVID-19— and address the mounting racial and ethnic disparities in infection rates—is dependent on the work we do in our City jails.”

Sting Operation Nabs PPE Mask Price Gougers

By Forum Staff Three borough men have been arrested for allegedly selling 1,000 medical masks at 10-times the regular price, Queens District Attorney Melinda Katz announced Monday.

Yuriy Borukhov, 33, Maisey Khovasov, 23, and Michael Borukhov, 23, were issued desk appearance tickets and ordered to appear in court on Aug. 15. At that time, the defendants will be formally charged with a City Administrative Code violation.

Last month, the City Department of Consumer Affairs enacted an emergency rule declaring price gouging unconscionable for a merchant to sell or offer goods or services with an excessive price increase during an imminent threat to public health.

According to the charges, an undercover detective with the NYPD Financial Crimes Task Force posing as a buyer responded to an online advertisement offering 1,000 face masks for $10 each. After approximately two weeks of trading text messages, a meet was set up for the morning of Friday, April 17. The “buyer” met Yuriy Borukhov and Khavasov at a designated spot in Queens shortly after 10 a.m. One of the men asked the undercover detective if he was there to buy masks. And when the “buyer” confirmed, a third man, Michael Borukhov approached and they all walked toward a waiting Chrysler automobile.

Three Queens residents have been arrested for allegedly selling 1,000 R95 medical masks at 10-times the regular price.

According to the charges, Michael Borokhov allegedly opened the car’s trunk and produced two boxes containing 240 R95 face masks made by 3M. Moments later, the undercover detective gave the three men $10,000 in cash. The three men were

promptly arrested for price gouging. Law enforcement allegedly recovered another 820 R95 masks in the same Chrysler.

“We are in the midst of a global pandemic. Thousands of people have died and medical workers do not have enough

personal protection equipment to do their jobs safely. The governor and mayor have mandated that all people wear masks in public. Sadly, these three men allegedly thought about pocketing a profit as a result of the coronavirus outbreak by price gouging,” Katz said. “This is unconscionable and will not stand in Queens County.”

Face masks such as the ones the defendants were allegedly peddling normally sell for up to $1 each, Katz noted.

“Exploiting peoples’ need to protect themselves for personal gain is always wrong,” Police Commissioner Dermot Shea said. “It is unconscionable in an ongoing pandemic, when everyone from healthcare providers to police officers to everyday New Yorkers needs this lifesaving equipment, and I commend our detectives and law enforcement partners for working together to discover and end this scam.”

U.S. Postal Inspector in Charge Philip Bartlett added, “This global pandemic represents trying times for everyone; especially those who are fighting on the front lines protecting the citizens of this great country.

During a crisis of this magnitude, we must come together as a country to fight this common enemy. Unfortunately, these three individuals chose to use this opportunity to make money price gouging PPE. Their conduct is shameful and un-American.”

De Blasio Unveils $89 Billion Fiscal Year 2021 Executive Budget

According to Mayor de Blasio, the $89 billion Executive Budget was “crafted in light of immense fiscal hardship.”

By Michael V. Cusenza Mayor Bill de Blasio on Thursday detailed the City’s Executive Budget for Fiscal Year 2021—a balanced $89 billion spending plan that was, according to Hizzoner, “crafted in light of immense fiscal hardship.”

Facing a staggering $7.4-billion tax revenue hit across FY2020 and FY2021, the administration slashed and burned the budget by $3.4 billion, compared to the FY2020 plan that was adopted in June 2019.

As expected, the economic fallout from the COVID-19 pandemic has its fingerprints all over the budget. According to the City, to date, it has spent more than $700 million to fight COVID-19, with the expectation of spending $3.5 billion on it by the end of the calendar year. This includes more than $170 million to make sure that no one goes hungry; this is in addition to food security investments the City traditionally makes. Health + Hospitals, the largest public health system in the country, has felt the full weight of the pandemic, adding $100 million to increase staffing, and support the agency’s efforts to save lives and prevent the virus from spreading further. To protect New Yorkers who are actively fighting this outbreak, the City has spent almost $200 million in Personal Protective Equipment. And to support small businesses that are facing extreme economic hardship, the administration has allocated $50 million in grants and loans to help them get through the tough times.

According to de Blasio, in order to balance the budget while prioritizing critical needs, the administration has achieved savings of $2.7 billion across FY2020 and FY2021. This includes Program to Eliminate the Gap(mandatory savings program that includes agency budget cuts, programmatic cuts, and a hiring freeze) savings of $2.1 billion ($600 million recurring annually) and $550 million in citywide savings ($220 million recurring annually).

These are pauses and adjustments to critical programs that cannot operate during this time of crisis, the mayor explained.

Administration officials saidthey have adjusted operational programs to ensure there is no gap in necessary services and will reevaluate as soon as we have navigated through the pandemic.

There are businesses in this city still operating, and could employ workers that are subsidized by the city and state government now more than ever. If regular employees are able to work from home and remotely, we should allow SYEP students to as well.”

City Comptroller Scott Stringer said the new spending plan is another siren call to Washington for much-needed help.

“In this public health emergency there is nothing more important than providing for the most vulnerable New Yorkers—communities of color, immigrants, seniors, and those experiencing homelessness.

The mayor’s budget relies on a mix of savings, reserves, and federal stimulus funds to maintain a balanced budget. A more robust savings program in prior years would have helped to build up a bigger cushion to protect against cuts that will be devastating in particular to New York City’s youth,” Stringer said. “What is abundantly clear, however, is that in order for us to get on our strongest fiscal footing, we need the federal government to step up. New York City is both the epicenter of this crisis and the financial capital of the country.

The national recovery starts here, and the federal government needs to provide wide-ranging, robust financial support in recognition of our central role.”

Stimulus Checks off Limits to Debt Collectors: AG

By Forum Staff Financial relief provided through economic impact payments are exempt from garnishment under New York law, State Attorney General Tish James declared Saturday in an official guidance issued to NY banking institutions, creditors, and debt collectors.

The Coronavirus Aid, Relief, and Economic Security (CARES) Actauthorized the U.S. Department of Treasury to send billions of dollars to Americans struggling as a result of the economic fallout of the COVID-19 public health crisis; Treasury is in the process of issuing stimulus checks of up to $1,200 for eligible adults and up to $500 for eligible children to help offset the costs of essentials, like housing, groceries, car payments, and other necessary expenses.

However, these emergency impact payments were not designated as exempt from garnishment—a legal mechanism that typically involves the “freezing” of funds in a bank account by creditors or debt collectors, allowing collectors to potentially benefit before consumers, James noted.

“This official guidance makes clear that banks and debt collectors cannot freeze or seize stimulus funds that are on their way to New York families,” the NY AG said,“and any institution that violates this guidance will face swift legal action from my office.”

James indicated that the guidance issued last weekend is based on multiple state and federal consumer protection laws and clarifies that any attempt to garnish stimulus funds from New Yorkers will be treated as a violation of these laws.

According to the attorney general, under Empire State law, certain types of

property—including public benefits like public assistance, social security, and veterans’ and retirement benefits—are exempt from execution, levy, attachment, garnishment, or other legal process by a creditor seeking to satisfy a monetary judgment. The State Court of Appeals has held that exemption statutes “are to be construed liberally in favor of debtors” because exemptions “serve the important purpose of protect[ing] the debtor’s essential needs.”

According to James, CARES Act payments are similarly aimed at debtors’ or borrowers’ essential needs and—under James’ guidance—will therefore be treated and are subject to the same protections as statutorily exempt payments, and will not be subject to garnishment.

After Congress passed the CARES Act, but still left vulnerable Americans susceptible to predatory creditors, James led a bipartisan coalition of 25 states in calling on Treasury Secretary Steve Mnuchin and the Trump administration to ensure CARES Act payments would be exempt from garnishment, but, as of Saturday, the Treasury Department had refused to do so.

James said that the guidance issued last weekend is in response to Treasury’s inaction.

James also pointed out that the guidance addresses what are known as “setoffs”—in which a bank seizes funds in a consumer’s account at the bank to pay a debt owed to the bank. CARES Act payments are now exempt from this “abusive and unfair practice,” James noted; and she has indicated that she is urging all financial institutions to follow the lead of the nation’s largest banks and halt collection on negative account balances to give their customers access to the economic impact payments.

Over the past 6 weeks or so, we have shared with you many of the aspects of Covid-19 that can have myriad physical effects and consequences. Bu this week we would like to share with you some information from the Center for Disease Control (CDC) on how to cope with the affects Covid-19 may impose mentally.

Undoubtedly, we have all heard of the devastating ramifications that stress can have on our minds and our bodies. Facing this pandemic before us adds an additional dimension to worry. The fears and anxiety associated with the unknown and the danger presented by this virus can be a great magnifier to stress.

Coping with stress will help make you, the people you care about, and your community stronger.

Stress during an infectious disease outbreak can include • Fear and worry about your own health and the health of your loved ones • Changes in sleep or eating patterns • Difficulty sleeping or concentrating • Worsening of chronic health problems • Worsening of mental health conditions • Increased use of alcohol, tobacco, or other drugs We all react differently to stressful situ-

Tips for Flying during Pandemic

By Forum Staff As the number of travelers choosing to fly has plummeted over the last couple of months due to the COVID-19 pandemic,the airline industry has nearly ground to halt.

However, for those who must fly, the Transportation Safety Administration recently provided tips to remember before heading out to the airport: 1:TSA is currently allowing one liquid hand sanitizer container, up to 12 ounces per passenger, in carry-on bags until further notice.

2:Travelers are permitted to bring individually-packaged alcohol or anti-bacterial wipes in carry-on or checked luggage. Jumbo containers of hand wipes are also allowed in carry-on or checked luggage.

3:Travelers are allowed to wear masks during the security screening process, however a TSA officer may ask the traveler to adjust the mask to visually confirm their identity during the travel document checking process.

At First-Ever Remote Meeting, Council Set to Introduce COVID-19 Relief Package

By Forum Staff During the City Council’s firstever remote Stated Hearing on Wednesday, Gotham’s legislative body was scheduled to introduce a COVID-19 relief package that aims to protect tenants, help small businesses, and find creative ways to address the public health crisis brought on by the pandemic.

Highlights include a bill that extends time for virus-impacted tenants to repay rent and pay back debts, as well as new protections from harassment for all renters, including the city’s small businesses.

The package will also include a NYC Essential Workers Bill of Rights, would require premiums for non-salaried essential employees at large companies, prohibitions on the firing of essential workers without just cause, and paid sick leave for gig workers.

Andrew Cuomo’s statewide 90-day eviction moratorium provided renters with temporary relief, the City must ensure that its impacted tenants are protected from evictions in the long-term as they get back on their feet and recover from the harmful impacts of this crisis, Johnson said. The council will therefore consider legislation that prevents marshals and the City’s sheriffs from the taking and resti-

tution of property or the execution of money judgments. This means that evictions and the collection of debt would be paused for all NYC renters, including residential and commercial tenants. It also means those renters would have additional time to repay their rent. This bar would apply to actions against all New Yorkers for the duration of the crisis. Further, for New Yorkers impacted by COVID-19, marshals and sheriffs would be barred from

collecting debts and performing evictions until April 2021.

Another bill sponsored by Johnson and Councilwoman Adrienne Adams (D-Jamaica) would address commercial tenant harassment. According to Johnson and Adams, the council will consider legislation to make threatening any commercial tenant based on their status as a COVID-19 impacted business or person a form of harassment punishable by a civil pen-

alty of $10,000 to $50,000.

A measure sponsored by Councilwoman Carlina Rivera (D-Manhattan) and Johnson would temporarily suspend personal liability provisions in leases and other rental agreements of COVID-19 impacted businesses while the state of emergency is in effect, ensuring that city business owners don’t face the loss of their businesses and personal financial ruin or bankruptcy.

“These bills provide relief where it is needed most right now, including protecting tenants from eviction. It’s essential that New Yorkers get the rent cancellation they need, but in the meantime, we need to give renters peace of mind that we won’t let them suffer irreparable harms. We’re also protecting small businesses and essential workers, who have been so hard hit,” Johnson said. “We must take these steps to help make sure that New York City remains the vibrant, diverse and exciting place it was before COVID ravaged our neighborhoods.”

The council will hold hearings on each of the bills over the next week and a half.

“The COVID-19 outbreak has laid bare the deep, systemic inequities that run through our city and has exposed how the right to basic health and safety are too often out of reach for New Yorkers due to class and skin color,” Comptroller Stringer said.

By Forum Staff City Comptroller Scott Stringer recently released an analysis of the inequities in housing, health, food security, environmental quality, and access to technology that disproportionately impact the city’s most vulnerable communities amid the COVID-19 pandemic and quarantine, especially people of color, immigrants, seniors, and low-income New Yorkers.

The report, Stringer said, spotlights the adverse conditions prevalent among these communities—and why they must be addressed as part of any strategic approach to mitigate impacts of the virus and assist those who are isolated, overwhelmed, and in dire need.

The comptroller’s analysis examines overcrowded and dilapidated housing, which is particularly prevalent in neighborhoods with high immigrant populations, including western borough communities Jackson Heights, Elmhurst, and Corona; single-parent and immigrant households living below the poverty line; elderly and disabled New Yorkers living alone; neighborhoods with poor air quality and high asthma rates; and other New Yorkers who are facing severe isolation, deprivation, and risk of exposure to COVID-19.

The analysis takes a data-driven approach to examining and mapping some of these populations by community district in the hopes that they may serve to guide the City’s ongoing efforts to help New Yorkers in need, contain the virus, and to arm communities with information that could help to stem the tide.

To protect the city’s most vulnerable communities during the COVID-19 pandemic and beyond, Stringer has called on the City to conduct a multi-faceted strate-

gic approach to protecting these vulnerable New Yorkers, including using vacant hotels and dormitories to house the homeless and alleviate overcrowding; providing PPE to all cleaning and maintenance workers and home health aides; creating a bank of cleaning supplies to all New Yorkers living in unsanitary conditions; drafting a comprehensive educational recovery plan that provides targeted resources to students who have fallen behind; expanding access to regional enrichment centers for children in shelters, temporary housing, and singleparent households; and expanding space on sidewalks and parks and pedestrianizing streets, among other recommendations.

“The COVID-19 outbreak has laid bare the deep, systemic inequities that run through our city and has exposed how the right to basic health and safety are too often out of reach for New Yorkers due to class and skin color,” Stringer said. “As we grapple with this unprecedented loss of life and livelihood, we must acknowledge that communities of color have long sounded the alarm about the persistent inequities that have plagued New York City. And the data is clear: communities of color, particularly Black and Latinx New Yorkers, immigrants, seniors, and low-income individuals and families are the targets most vulnerable to this virus. Our City’s efforts to combat COVID-19 must center on these communities, recognize the disparities, and take them on—from alleviating overcrowded housing, to improving poor air quality, to expanding internet access, to eliminating discriminatory loopholes in our social safety net. We are defined as a society by how we treat our most vulnerable. We have the tools, we have the data, we have the solutions, and right now—not later—is the time to act.”
