City Calls for ‘Fair’ Marijuana Legalization as Queens DA Announces Opposition

By Michael V. Cusenza Mayor Bill de Blasio on Thursday endorsed the “safe and fair” legalization of marijuana in the Big Apple, days after Gov. Andrew Cuomo highlighted legalizing adult use of recreational marijuana as one of his 2019 Justice Agenda proposals.

De Blasio also released the Mayor’s Task Force on Cannabis Legalization report on Thursday, which calls for a strong, public health-focused regulatory framework and the empowerment of local government to prevent corporate greed, foster small businesses and meet the demands of communities across the five boroughs.

De Blasio convened the task force in July to identify the goals and challenges that should guide the City’s preparations for potential legalization. According to the mayor, if recreational use of marijuana were legalized, the City would seek to: • Create local licensing programs, regulate public places of consumption, regulate home and commercial cultivation and manufacturing, and regulate home delivery services.

• Establish zoning and area restrictions for cannabis businesses, as well as restrictions on the density to determine how the location of cannabis businesses can best fit into the fabric of its communities.

• Enforce age limits of 21 and over with civil rather than criminal penalties to violations of cannabis regulations to the greatest extent possible consistent with public safety.

• Recommend automatic expungement of criminal records relating to conduct that may be legalized, including personal use and possession of certain quantities – subject to notice and opportunity by district attorneys’ offices to raise objections in specific

providing that banking and professional services for cannabis-related businesses do not violate State law.

• Allocate tax revenue, licensing fees, and other sources of financing to administer the new industry and support cannabis businesses and workers, with a focus on target populations and community reinvestment.

• Develop an incubator program to provide direct support to equity applicants in the form of counseling services, education, small businesses coaching, and compliance assistance.

While legalization seems to gain steam by the day, there are elected City officials who do not approve. Queens District Attorney Richard Brown noted on Thursday that while he encourages “thoughtful public debate” on the subject, he ultimately is not in favor green-lighting recreational consumption of the green.

“Respectfully I don’t believe anyone can

say that legalization of marijuana is a positive step for our society or society or our children,” Brown said. “If memory serves me correctly, until fairly recently both the governor and the mayor felt the same way.”

The district attorney also said that deliberation over the legalization of recreational marijuana consumption “is finally moving to the forum that it should have been in all along—the New York State Legislature. The Legislature created the law and I have long said if the law is to be changed, it is the Legislature alone that should change it. It should not be changed by simply ignoring the laws that currently exist.”

Additionally, Brown cited a memorandum issued earlier this year by the State Association of County Health Officials that opposed the legalization of recreational marijuana. He also pointed to a study in Colorado released in September that stated that since marijuana legalization in Colorado in 2014, marijuana-related traffic deaths increased 151 percent and all traffic deaths by 35 percent. Colorado past month marijuana use shows an increase of 45 percent compared to the three-year average prior to the legalization of recreational marijuana in the state. Colorado past month marijuana use for ages 12 and older is ranked third in the nation and is 85 percent higher than the national average. The yearly rate of emergency room visits related to marijuana also increased by 52 percent after legalization, Brown noted.

“No state that has legalized recreational marijuana has legalized the public burning or smoking while driving—nor apparently does New York intend to. Yet the vast majority of arrests for marijuana stem from those activities,” the DA added. “So however violations of the new law are classified, we may face the same disparity issues we currently face now.”

Classic Christmas was at it's finest with standby's, as well as some lesser known fare, all equally well received by an audience who was obvously moved with by a stirring rendetion of "O Holy Night" to close the second act.

studied music throughout college and hone thier performance skills under the tutilidge of dad Gerard, who is a skilled vocalist and guitarist as well.

The sisters made their neighborhood debut in November of 2016 at Nana's where they dazzled audiences with thier presentation of Broadway on the Boulevard.

Sister Joanna's professional aspirations as an actor/singer span musical theater, opera, and film. She continues with training in clas-

sical voice and has studied with faculty of the Juilliard School, Manhattan School of Music, and Yale Drama.

City Skipped Mandatory Inspections of Hundreds of Child Care Centers: Audit

The City Department of Health and Mental Hygiene failed to conduct required inspections of more than half of the child care centers that served the City’s Universal Pre-Kindergarten program in Fiscal Year 2017, according to a new audit released on Thursday by City Comptroller Scott Stringer.

Under its own rules, the agency is supposed to conduct two types of inspections each year at each center: one by an Early Childhood Education Consultant, focused on staffing and curriculum, and another by a Public Health Sanitarian, focused on physical conditions. Both types are called “initial inspections,” which trigger further investigation if deficiencies are found, Stringer said. Yet the audit uncovered that in FY17, DOHMH skipped both of those inspections at 73 centers and that hundreds of other centers received just one initial inspection, in direct violation of DOHMH protocols, the comptroller noted.

However, as Stringer pointed out, under DOHMH’s protocols and according to its staff, monitoring and compliance inspections are not substitutes for the two mandatory initial inspections.

DOHMH’s “initial inspections” are complete program reviews to determine whether child care centers are in compliance with the City Health Code. As such,

they are more comprehensive than compliance and monitoring inspections, which focus on specific issues raised by prior inspections, complaints, or administrative actions.

According to the audit, department of Health records show that during FY17, a total of 531 of the 1,035 audited group child care centers failed to receive at least one required inspection, in violation of DOHMH protocol. Specif-

ically, in addition to the 73 centers that received no initial inspection: 312 centers did not receive an inspection from an Early Childhood Education Consultant; and 146 centers did not receive an inspection from a Public Health Sanitarian. A further review of DOHMH inspection records for fiscal years 2015 through 2017 revealed a widespread and long-standing lack of oversight as DOHMH failed to perform all inspections at between

48 and 60 percent of audited centers in each year.

Stringer called on DOHMH to immediately inspect the 73 centers auditors uncovered. The comptroller also recommended that the agency reform its inspection tracking protocol and overhaul its reporting mechanism to ensure that reports and oversight processes do not allow initial inspections to be skipped or records to go missing.

Stringer also noted that this is the third audit that his office has conducted of DOHMH’s oversight of group child care centers, and the third in which notable deficiencies were found.

“For the safety and well-being of our children, DOHMH’s own rules require it to comprehensively inspect every child care center at least twice every year. Skipping inspections at hundreds of child care centers is unacceptable,” Stringer said. “As a parent of young children, I find this audit extremely disturbing. As comptroller, what’s even more alarming is that DOHMH refuses to acknowledge the problem and fix it. When it comes to protecting our city’s children, we cannot allow any agency to deny the facts.”

City Initiative Provides Gifts for Families in Need

According to the City, the Secret Snowflake initiative has served more than 13,000 NYC children through answered letters and in-kind donations over the last five years.

By Forum Staff The City has engaged nearly 2,000 volunteers to answer letters from 3,400 children and families in need across the five boroughs this holiday season through Secret Snowflake, a holiday gift-giving initiative, Mayor Bill de Blasio announced on Thursday.

According to the administration, Secret Snowflake recruits more than 150 City employees as well as private sector employees from nearly 30 Big Apple businesses and matches them with thousands of youth and families. NYC Service supplements these gifts with donations from more small and large Gotham businesses and received 2,100 in-kind donations this year.

The initiative relies on help from other City agencies. The Administration for Children’s Services, the Department of Social Services, the Department of Homeless Services, and the Mayor’s Office to End Gender-Based Violence collect letters from children and families served by their agencies before the holiday season.

“Thanks to NYC Service’s Secret Snowflake initiative, more than 1,000 children experiencing homelessness will receive toys, books, clothing and school supplies this holiday season,” said Department of Homeless Services Administrator Joslyn Carter. “Homelessness affects every neighborhood in our city, and we are grateful for New Yorkers’ dedication to spreading the holiday spirit through generosity and com-

passion for neighbors in need.”

Additionally, the Mayor’s Office for International Affairs also engages the diplomatic community in service during the holidays. This year, participants included the Permanent Missions of Afghanistan, Austria, Bahamas, Belgium, Colombia, Fiji, Germany, Japan, Mexico, Montenegro, New Zealand, Peru, Russian Federation, Singapore, and Sweden. The Consulates General of Czech Republic, Estonia, Finland, Germany, Lebanon, Peru, Philippines, Portugal, Seychelles, and Singapore also participated, along with the Delegation of the European Union to the United Nations in New York, the Taipei Economic and Cultural Office, the United Nations, and members of the Mayor’s Office for International Affairs.

“The Secret Snowflake initiative offers us the opportunity each year to engage with the world’s largest diplomatic community to help bring joy to vulnerable New Yorkers,” said MOIA Commissioner Penny Abeywardena. “This year, representatives from more than 25 countries and international organizations collected gifts for over 175 youth and their families. We appreciate the generosity of our international partners, and we are grateful for this annual chance to serve the local communities of New York City in celebration of the season.”

EDITORIAL SHUT OUT “America is a shining city upon a hill whose beacon light guides freedom-loving people everywhere,” Ronald Reagan, the Great Communicator, proclaimed on Election Eve, Nov. 3, 1980, in his acclaimed “A Vision for America” address.

However, as we have painfully learned over the past week, it seems that our country is run by petulant children who couldn’t care less about America as the ultimate example of progress, righteousness, and decency that every other country strives to be.

We find ourselves in the middle of another government shutdown. Yet, as the hours of inaction seem to pile up, all we hear about is who is to blame for the shutdown. Both sides have sought to brand this lesson in incompetence as the other guy’s fault: On one side of the chasm, you have Democratic leaders who have dubbed it the Trump Shutdown; while our Commander in Chief has sporadically referenced a Democrat Shutdown on Twitter.

Instead of assigning blame, or digging in heels, or looking to pundits and talking heads and their nonsensical scoreboards trying desperately to determine which side is the political winner so far and prognosticate about who will emerge victorious at the end—however far away the finish line seems to be—how about they focus on the losers: the American people.

The past seven days have been a ridiculous game of one-upsmanship via official statements and the verbal excrement that passes for Twitter posts.

“Republicans control the House, the Senate, and the White House. But instead of honoring his responsibility to the American people, President Trump threw a temper tantrum and convinced House Republicans to push our nation into a destructive Trump Shutdown in the middle of the holiday season. President Trump has said more than 25 times that he wanted a shutdown and now he has gotten what he wanted,” wrote Senate Minority Leader Chuck Schumer and Speaker-designate Nancy Pelosi.

“The Democrats, whose votes we need in the Senate, will probably vote against Border Security and the Wall even though they know it is DESPERATELY NEEDED. If the Dems vote no, there will be a shutdown that will last for a very long time. People don’t want Open Borders and Crime!” President Trump tweeted on Friday.

“The government is shut down for one reason: the President’s insistence on a border wall that is an affront to our values and that will not make us safer.

It’s time for Republicans in Congress and the President do their job and pass a funding bill that will keep our government running. The thousands of federal employees and their families who call New York City home should not be pawns for Donald Trump's backwards immigration policies,” said Mayor Bill de Blasio in a statement issued on Saturday.

There are so many more statements and posts that we could site here but just don’t have the space (or stomach) to accommodate them. But you get the point: These childish tit-for-tat games and name-calling gets us—yes, US—nowhere fast and for a long time.

We voted you guys into your cushy, well-paid gigs.

Enough with the statements and posts. You’re pillaging the city upon a hill. And its people—you remember them, right?—are the ones left holding the bill.

Samuel Rodriguez, 39, of 130th Street in College Point is awaiting arraignment in Queens Criminal Court on a complaint charging him with seconddegree unlawful surveillance.

District Attorney Brown said, “The defendant is accused of an egregious invasion of privacy in an attempt to satisfy his lewd sexual desires. Jamaica Man Charged in Borough Native Sworn in November Shooting Death as Civil Court Judge

Murder charges have been filed against 33-year-old Queens man in connection with a fatal shooting that followed a dispute on November 3.

Lhosni Colot, 33, of 164th Street, in theJamaica section of Queens was also charged with manslaughter and criminal possession of a weapon.

Colot is charged in the shooting death of 22-year-old Tymel West after the two men had a verbal altercation on a Jamaica street around 10:50 p.m. Moments later, Colot shot the 22-year old in cold blood.

West was rushed to the hospital by private means but succumbed to his injuries.

“A young man’s life was cut short as a result of a senseless dispute that ended in gun violence. The defendant is alleged to have committed a cold-blooded murder on a residential street in Jamaica, Queens.

He now faces a lengthy term of incarceration.”

Queens Criminal Court Judge David J. Kirschner on a complaint charging him with second-degree murder, first-degree manslaughter and second-degree criminal possession of a weapon.

Colot was immediately remanded to custody.

His next court date is January 3, 2019.

If convicted, Colot faces up to 25 years to life in prison.

Borough native Lourdes Ventura was recently sworn in as a judge for the City Civil Court Queens.

“I have full confidence in Lourdes as a judge to uphold the laws, knowing she has the best interest in mind for Queens,” said Assemblyman Mike Miller (at lectern) who spoke at the Borough Hall ceremony.

Miller noted that the Richmond Hill resident is the first Latina to serve as president of the Queens County Women’s Bar Association.

STAYING HEALTHY IN THE WINTER Now that we have all had to face the fact that winter is upon us, we realize it's a time when rumors about getting sick from the cold are bantered about.

Remember your mother saying: "Don't go out in the cold with a wet head, you'll get sick." While freezing strands of hair on your head doesn't produce the most desirable effect this is only one of the many myths and misconceptions about winter health that many people mistake as fact.

We came across a few tips we'd like to share about staying healthier in the cold winter months.

First of all there's the old, "you lose most of your body heat through your head."

Nope. Research has shown that if you're not a hat person, you will not lose anymore than 10% of your body heat through your head.

Then of course, there are the color of your mucous myths. Many think that green is not a good sign, when in fact green mucous signifies that whatever ails you is coming to an end. Yellow is a sign that your body is still fighting and clear mucous signifies that you're at the beginning stages of illness.

You might have heard that you can get the flu from a flu shot, but alas, that is not true either. There is no live virus in the shot so NO you CANNOT get the flu from the shot. If you get the nasal spray vaccine however, you may experience flu symptoms.

Moving right along, how many of you think that dry radiator heat can cause the flu or a cold? Again not true. Oh yes the radiator type heat can dry out your nasal membranes and cause a lot of discomfort and even nosebleeds, but you're not getting either a cold or the flu from that source.

Finally, we've all heard this one for sure: Shoveling snow can cause a heart attack!

Unlike other cold weather myths, this one is actually true. Cold constricts your arteries and sudden extreme activity increases the workload on your heart making shoveling even more stressful than most winter sports. Those over 60 and anyone with high blood pressure, diabetes or high cholesterol should take extreme precaution. You can reach a dangerous heart rate in just two minutes! If you must do it, use a small shovel and take frequent breaks.

By Forum Staff The platform girders at 111th Street on the JZ line in Richmond Hill will be replaced beginning January 2019 as part of structural improvements at several Jamaica Line stations, MTA New York City Transit announced on Friday.

According to NYCT, the elevated 111th Street station, which currently serves more than 3,200 weekday customers, opened for service in 1917, and its structure has not been replaced since the station was built.

The trackside girders, which are steel structures that hold the platforms and canopy supports in place, have deteriorated and now must be replaced to ensure continued safety. Due to the nature of the deterioration, the equipment required for the replacement, and the girders’ location immediately adjacent to the tracks and under platforms, train service cannot operate at 111th Street while crews remove and rebuild the girders and the platforms on top of them. Beginning at 5 a.m. on Monday, Jan. 14, 2019, JZ trains will bypass 111th Street in both directions while the girders are replaced and the platforms are demolished and rebuilt, the agency said.

Similar work at the 104th Street and 121st Street stations had been scheduled to provide one-direction service during the

repairs, which stretched the construction timeline to more than a year, NYCT noted.

By closing the 111th Street station in both directions, the construction timeline will be reduced to approximately six months.

Currently, the area is served by both the subway and the local Q56 bus, which operates along Jamaica Avenue and mirrors the JZ route in the area. During the girder replacement project, NYCThas indicated that it will provide enhanced Q56 bus service between 111th Street and 121st Street.

Customers using MetroCards will get an additional free transfer when transferring from the Q37/Q56 to the J line at 104th Street, 121st Street or Woodhaven Boulevard stations. Customers can also use the nearby 104th Street or 121st Street stations.

NYC Transit has pledged to post signage and make announcements at 111th Street, nearby stations, and on trains to notify customers so they can plan ahead and learn about the service alternatives. Transit staff has conducted outreach with the local community and elected officials and will continue to reach out to the community and businesses ahead of and during the service diversion. Customer ambassadors will be staffed at the station before and in the first days of the service bypass to provide more customer information, NYCT promised.

New ‘Neighborhood Pillars’ Program to Protect Tenants, Preserve Affordability: Mayor

By Forum Staff A new program will help finance each stage of the process of acquiring and rehabilitating existing rent-stabilized and unregulated buildings to protect current tenants and preserve affordability in neighborhoods across the five boroughs, the City announced on Thursday.

The Neighborhood Pillars program aims to fund the acquisition and preservation of nearly 7,500 homes over the next eight years.

According to de Blasio administration officials, this effort will be made possible by funding commitments from the Community Preservation Corporation, Wells Fargo Foundation, the City Housing Development Corporation, and the City Department of Housing Preservation and Development in coordination with the nonprofit Neighborhood Restore Housing Development Fund Corporation.

With a commitment of $2 million from Wells Fargo Foundation and $2 million from the Community Preservation Corporation, the City has established a new Down Payment Assistance Fund dedicated to pre-qualified nonprofit community-based organizations looking to purchase rent-stabilized and unregulated buildings and finance their rehabilitation and the preservation of their affordability through the new Neighborhood Pillars program, Mayor de Blasio said.

nounced in 2017 as part of de Blasio’s Housing New York 2.0 plan, is the latest in a series of efforts to address these issues, and both improve the quality and preserve the long-term affordability of the city’s housing stock.

Community based non-profit organizations are often well-positioned to identify the buildings most at risk of speculation and rapid turnover, City officials noted; but these organizations often lack the capital needed to make down payments and compete successfully in the acquisition market. The Neighborhood Pillars Down Payment Assistance Fund, the first of its kind, will help level the playing field by providing qualified not-for-profits with technical assistance and capital to use as a down payment or deposit on a contract to acquire properties and cover limited pre-acquisition costs, according to the administration.

Richmond Hill Father and Son Indicted for Theft of $500K+ from Armored Car

By Michael V. Cusenza Three men, including a Richmond Hill father and son, have been indicted for their roles in the theft of $510,000 from an armored car on Nov. 2 in Valley Stream, L.I., federal prosecutors announced on Friday.

The indictment was unsealed in federal court in Suffolk County and charged Alexis Laguerra, Raymond Soto, Jr., and his father, Raymond Soto with bank larceny. Laguerra, 30, was previously arrested on a complaint and released on $250,000 bail. The Brooklyn resident was arraigned on Friday, pleaded not guilty, and was continued released on bail.

Raymond Soto, 48, a.k.a. Razor, also was arraigned on Friday. He pleaded not guilty and was ordered detained. As of Wednesday evening, his son, Raymond, Jr., 28, a.k.a. Rambo, was still on the lam.

of Friday, Nov. 2 was to empty automated teller machines at bank branches and refill each ATM with “fresh money” of between $99,800 and $275,000. Upon arrival at an HSBC Bank branch on Sunrise Highway in Valley Stream at 2:22 a.m., Laguerra and John Doe #1 exited the armored car and entered the bank. The unoccupied armored car was subsequently stolen and later recovered nearby. The three bags of cash, each containing $170,000, were gone.

Additionally, Laguerra and the younger Soto had an agreement to destroy text messages they had exchanged setting up the heist.

On Friday morning, law enforcement officers executed a search warrant at the Sotos’ 91st Avenue residence and allegedly recovered $131,000 in cash packaged in the same manner as cash is packaged by GardaWorld. Authorities also allegedly found a gun, ammunition, and a quantity of marijuana and cocaine in the Sotos’ apartment.

Glendale Men Allegedly Linked to Deadly Heroin

By Forum Staff Two Glendale have been arrested for allegedly conspiring to sell heroin and fentanyl in Queens between January and September 2018, federal prosecutors announced on Thursday.

Douglas Marra, 34, a.k.a. “Dougie” and Joseph McClean, 34, a.k.a. “Max B” were arraigned on Thursday on a criminal complaint charging them with conspiracy to distribute and possess with intent to distribute heroin and fentanyl.

According to the complaint, in January 2018, U.S. Department of Homeland Security Investigations and the City Police Department began investigating a heroin and fentanyl drug-trafficking organization in Queens. Following an overdose death in the borough, law enforcement interviewed an individual who said that the overdose victim had obtained heroin from “Dougie” and that “Dougie” works

and McClean. Agents then initiated a series of undercover drug transactions with Marra. During one of those transactions, Marra told an undercover police officer, “This stuff is hot. My friend died off of it.” Ultimately, when Marra was not able to provide drugs, McClean directed other suppliers to complete the narcotics transaction.

L.I. Man Sentenced to Nearly Five Years in Prison for $62M Ponzi Scheme

By Forum Staff A Long Island man was recently sentenced to 56 months in prison for orchestrating a Ponzi scheme over four years that caused investors to lose approximately $62 million, according to federal prosecutors.

Gershon Barkany, 34, pleaded guilty to wire fraud in June 2013. He has also been ordered to pay restitution in an amount to be determined later and forfeiture of $62 million.

According to officials, between December 2009 and March 2013, Barkany induced more than 10 victims to invest approximately $62 million by promising to use their money in “risk-free” deals to purchase, and then immediately re-sell at a profit, commercial real estate properties located in NYC and New Jersey. No such deals existed, and the investors lost their entire investments. Relying on Barkany’s representations, one victim invested $46.5 million as a down payment on an office building in Manhattan, a hotel in Atlantic City and properties in Queens and the

Federal authorities noted that shortly after Barkany’s arrest on March 28, 2013, two additional victims contacted the Federal Bureau of Investigation and reported that they had been defrauded by Barkany. He induced those investors to give him approximately $7.5 million by promising to use their money in a “risk-free” deal to purchase, and then immediately re-sell at a profit, an office building in Manhattan. In furtherance of the scheme, Barkany created fraudulent documents, including a purchase agreement purportedly signed by the seller of the office building and an escrow agreement allegedly signed by a third-party escrow agent. Once again, the promised deal did not exist, and the investment was lost.

Barkany also diverted some of the funds he received to pay victims whom he had earlier defrauded, and used approximately $7.8 million of investors’ monies for personal expenses and gambling.
