Legalizing Recreational Marijuana, Passing Dream Act, Congestion Pricing among Proposals in Cuomo’s Ambitious ‘2019 Justice Agenda’

Cusenza Governor Andrew Cuomo on Monday unveiled a package of 20 ambitious proposals—including legalizing adult use of recreational marijuana; passing the Dream Act and Child Victims Act; and adopting a congestion pricing plan to help pay for the overhaul of the city subway system—that he wants the State Legislature to tackle during the first 100 days of the new session next year.

Officially dubbed his “2019 Justice Agenda,” Cuomo also characterized the proposals as “New York’s Declaration of Independence from Washington.”

This year, the governor broke with tradition, laying out his aggressive legislative agenda in December 2018 at the Roosevelt Institute in Manhattan, instead of waiting until the State of the State address to enable the Legislature to commence action on these top priorities immediately upon convening.

“We declare independence from this federal government’s policies. We disconnect from the

agenda as New York’s restoration of true democracy, restoring fairness, progress and pride.”

Highlights of the 2019 Justice Agenda include: Cuomo said he will end the disproportionate criminalization of one race over another by regulating, legalizing, and taxing adult use of recreational marijuana.

The governor pledged to fight to ensure that society holds those who abuse children accountable criminally and civilly by passing the Child Victims Act “once and for all.”

“While the federal government has declared war on new immigrants, New York is standing up for our immigrant communities. This year, New York will pass the Dream Act once and for all to ensure a higher education system that opens the door of opportunity to all of our children,” Cuomo promised.

The governor also bluntly stated that “after decades of neglect and diffused responsibility, the MTA is in dire need of funding and reorganization.” Cuomo said

To “improve our democracy,” Cuomo said the Justice Agenda calls for encouraging citizens to

engage in the democratic process by allowing voting by mail, enacting early voting, instituting same day and automatic voter registration, synchronizing federal and state elections and making Election Day a State Holiday to ensure as many people as possible participate in the democratic process.

In his remarks on Monday, the governor also addressed equal protection in NY’s criminal justice system. He promised that by next year the State will end cash bail and enact speedy trial and discovery reforms.

Cuomo also pledged to codify the Gender Expression Non-Discrimination Act into State law and end conversion therapy. And the governor said he and the Democrat-led State Legislature will “fight to pass the Reproductive Health Act and the Comprehensive Contraceptive Coverage Act within the first 30 days of the new session.”

Cuomo also said that he will work to codify the health exchange into law and pass a law to ensure pre-existing conditions continue to be covered by insurance companies regardless of what happens at the federal level.

“Let us show this nation what we can get done, the change we can make, the lives we can better.

Let us remind people there’s nothing that we can't accomplish when we work together,” the governor said as he concluded his remarks on Monday.

Howard Beach becoming Riskier for Children: Report

Howard Beach is becoming riskier for children, according to alarming new data in the latest edition of a report published by a leading NYC nonprofit child advocacy organization.

Citizens’ Committee for Children of New York recently released the 2018 volume of its “Community Risk Ranking” resource, an analysis that looks at 18 indicators across six domains of child wellbeing—Economic Security, Housing, Health, Education, Youth, and Family & Community—to determine where risks concentrate in the five boroughs. According to CCC, in order to identify communities where families are more likely to face risks, it ranked NYC’s 59 community districts from highest to lowest risk, within each domain and overall, and placed community districts into one of five risk categories: highest risk, moderate-high risk, moderate risk, moderate-low risk, and lowest risk.

“Knowing where disparities are declining or increasing helps community members, policymakers, service providers, and philanthropic organizations prioritize investments and develop new programs or initiatives to achieve better outcomes for children and families in the city,” CCC wrote in this year’s Community Risk Ranking.

The Rockaways seem to be moving in the opposite direction overall as a district trending toward lower risk. In 2009, the Rockaways scored an overall 18. The district jumped to 29 in 2016 and into the moderate risk category from the moderate-high risk category.

In terms of specific domains, Howard Beach fared the worst in Health. It is the fifth-highest risk district out of the 59 community districts in the city when it comes to Health.

Reputed Mobsters Sentenced for Racketeering

By Forum Staff Reputed Bonanno organized crime family soldier Frank Salerno has been sentenced to five years in prison for racketeering conspiracy, federal prosecutors announced on Thursday.

Officials noted that earlier this month, John Ambrosio, 74, an acting captain in the Gambino organized crime family, and Anthony Saladino, 67, a Gambino associate, were sentenced to 51 and 63 months’ imprisonment, respectively, for racketeering conspiracy. Ambrosio, Saladino, and Salerno were the last of seven defendants to be sentenced on a superseding indictment charging Gambino and Bonanno members and associates with racketeering conspiracy, including predicate acts of drug trafficking, loan sharking, gambling and obstruction of justice, prosecutors added.

According to the indictment, between January 2014 and December 2017, Ambrosio and his co-conspirators engaged in a racketeering conspiracy, which included loansharking, operating illegal gambling businesses, narcotics distribution conspiracy, and obstruction of justice conspiracy.

Whitestone resident Salerno, 43, routinely collected payments from extortionate loans and gambling-related debts, often at the direction of Ambrosio. In one intercepted conversation, Saladino and Thomas Anzalone, 44, of Ozone Park, discussed unpaid gambling debts, during which Saladino said he would give the debtor “something to be scared about.” On another occasion, Saladino admitted to an undercover agent that he and Salerno were involved in organized crime, stating that Salerno “has got that thing (pointing to his shirt button),” indicating membership in organized crime. In another intercepted call, Saladino recounted for Ambrosio a collection effort in which he threat-

ened an individual, saying “when I get my hands around your f-----g neck, everything is going to pop out of your ears.”

Ambrosio also was involved with a variety of gambling operations, including illegal poker games, electronic gaming machines and internet sports betting, with Salerno, Saladino, Whitestone resident Alessandro Damelio, 49, and Joseph Durso, 26, being responsible for many of the day-to-day operations. Anzalone, Damelio, Durso, Saladino and Salerno distributed a variety of narcotics, including cocaine, marijuana and Xanax. When Ambrosio and his co-conspirators were arrested on Dec. 12, 2017, law enforcement agents executed search warrants at various locations, including a storage facility in Nassau County, and recovered gambling and loan sharking records, electronic gaming machines, narcotics and drug paraphernalia and numerous firearms, including two AR-15 rifles, a .38-caliber revolver and a sawed-off shotgun.

As part of his sentence, Ambrosio will forfeit $100,000, including $66,116 in cash that was seized from his Long Island residence, prosecutors said.

“Organized crime continues to plague our communities with violence, coercion, and intimidation,” said FBI New York Assistant Director-in-Charge Bill Sweeney. “The mobsters grow richer while their victims live in fear as they struggle to make payments while dealing with daily threats. Today’s sentences demonstrate that the shirt button of a ‘made man’ is no match for a badge – the FBI/ NYPD Joint Organized Crime Task Force is committed to investigating and rooting out organized crime wherever it occurs, and the perpetrators will be brought to justice.”

Anzalone was sentenced on July 24 to two years and 10 months in federal prison; and Damelio and Durso were sentenced on July 11, and Nov. 5, respectively, to two months’ imprisonment.

Again I don’t intend to defend a friend, just to represent an accurate portrayal of character. I damn well don’t always agree with him, but I always respect him and the fact that he calls it like he sees it. If you don’t like Eric Ulrich, your answer is very simple, don’t vote for him, just don’t make the presumption that he is not fit for the job because his enemies spin untrue tales.

The criticism intended to do the most damage of Ulrich in the press release comes from Hornak himself who points to the councilman’s “undermining of Assemblywoman Nicole Malliotakis's Mayoral campaign by his support for Bo Dietl in that race. But, it is in the very next paragraph where Hornak falls victim to one of the deadliest traps of all. Being slain by words, which you yourself put out there. The next quote he includes comes from the Whitestone Republican Club President, Vickie Palladino. It’s not so much what Palladino says about Sliwa, although it reads like she wants to become wife number 5, it’s simply the fact that Palladino was a paid staffer for the very same Bo Dietl Ulrich is attacked for supporting. Bo Dietl is a “bad man” according to Hornak just not when one of his cronies is employed by him.

The bottom line here is, I divorced myself from the political sphere a long time ago, precisely because of people like Robert Hornak, Vickie Palladino and Phil McManus. Rank amateur, manipulative bottom-feeders, they seek to cull favors with candidates of their personal choosing and collectively personify all that make politics virtually lethal. The real problem is they're trying to take unsuspecting voters with them down a road that blackens the names and sullies the reputations of those that simply don't suit THIER PURPOSE. If they did it with fact, that would be fine. But when they choose to make comparisons where there are none and spew bold-faced lies, someone needs to point to the truth. That would be me.

Joann Ariola and Eric Ulrich are not the best thing since sliced bread. But then, I don’t like sliced bread. I like bread that is hearty and crusty and doesn’t go limp when you take a bite. They are both public servants who have given much of themselves to their beliefs and for the benefit of others. You don’t have to like them. You don’t have to vote for them. But what you have to do is recognize when they’re being lied about. We all deserve that.

Manhattan Man Charged in Vicious Hate Crime Attack on Woman

By Forum Staff A Manhattan man has been charged with assault as a hate crime in a subway attack on a female who was riding a Manhattan bound E train last month.

The defendant, identified as Allasheed Allah, 54, of 109th Street subjected the woman to homophobic slurs before physically assaulting her.

District Attorney Brown said, “Queens County is the most diverse county in the nation. It is home to many races, nationalities and sexual orientations. Crimes motivated by bias – particularly those involving violence – will never be tolerated in this county." T Allah is presently being held pending arraignment in Queens Criminal Court on charges of second- and third-degree assault as a hate crime and second-degree aggravated harrassment.

Queens, was seated on a Manhattan rd bound E train when the defendant engaged her in a verbal dispute. During the dispute, defendant Allah began making homophobic slurs towards Ms. Kaur and her friend.

As the two women began to walk away, defendant Allah followed them and struck Ms. Kaur in the back of her head and then once in her chest causing her to fall and strike her head and neck on a pole before hitting the floor.

Allah admitted that he told her “not to kiss her again in front of me because she was disrespecting me with all that gay (expletive) she been doing. I stood up and told her kiss her again you dyke (expletive) and watch what happens. I pushed the girl, she turned around and then she fell.” Ms. Kaur was immediately transported to a local Queens hospital where she underwent treatment for a fractured spine.

If convicted, Allah faces three and onehalf to 15 years in prison.

Acid Attack Duo Cop to 2015 Assault and Scheme to Embezzle $750K from Nonprofit Agency

The 49-year-old accountant and her 35-year-old associate pleaded guilty to first-degree assault for the acid attack of a woman, who was the director of a non-profit and had been investigating the more than $750,000 stolen from the company between 2013 and 2015.

District Attorney Brown said, “In pleading guilty, the former employee now admits to stealing from an organization that used its funds to help those in need. The two defendants together plotted to take grave steps to conceal this crime. The duo jointly conspired to inflict bodily harm to an innocent woman, the organization’s director, who was looking into the missing funds. As a result of the acid attack, the victim suf-

Elmhurst Man Ran Suffolk County Drug Lab: Feds

By Michael V. Cusenza An Elmhurst man has admitted to authorities that he has been operating a chemical lab in Suffolk County in which he cooked up and curated large amounts of ecstasy and marijuana, according to federal prosecutors.

Joseph Guida, 44, an employee of the City Department of Environmental Protection, was taken into custody on Monday in Queens by U.S. Department of Homeland Security Investigations agents.

According to the criminal complaint, on Wednesday, Dec. 5, officers of HSI’s Customs and Border Protection intercepted a package that was mailed from a location in China to Guida’s Elmhurst residence. Before the package was delivered, a border search was conducted, which revealed the presence of a white powdery substance. A subsequent chemical analysis confirmed that the substance was methylglycidate, a precursor to MDMA or ecstasy.

On Thursday, Dec. 13, HSI Special Agent Kevin Russell and other law enforcement officers visited Guida in Elmhurst.

“After meeting the defendant, I left my telephone contact information with him,” Russell stated in the complaint.

“Following that meeting, the defendant placed a telephone call to me—which I recorded—and stated, in substance, that he maintained a residence in Mastic, New York, which he used as a ‘cook lab’ to produce quantities of MDMA. Guida further stated, in substance, that he cultivated marijuana at the Mastic lab and that quantities of MDMA were located inside of the Mastic lab.”

Congestion Pricing Debate Heats Up Cold City Streets

Car drivers would be charged $11.52; trucks, $25.34; cabs and app-based for-hire vehicles, $2 to $5 per ride. The revenue generated by such a tolling initiative would most likely exceed $1 billion annually, Fix NYC noted.

However, congestion pricing is not, by any measure, wildly popu-

lar.

On Sunday, a coalition of elected officials, union reps, and concerned residents held a press conference at Queens Plaza North expressing strong opposition to any proposed congestion pricing plan—or “tax,” as they have characterized it.

“A congestion tax would be disastrous for Queens, Brooklyn, and Long Island residents,” said

It would raise the cost of doing business with the cost of congestion taxing being passed onto businesses. It would raise the cost of consumer goods, with business passing along extra costs to consumers. It would limit the competitive ability of these local small businesses; and it

would impose a monetary barrier to Manhattan for outer borough residents, who often travel to the city to visit a doctor, watch a show or enjoy a night out in Manhattan. New York cannot burden the backs of these other borough working and middle class residents, already struggling with the rising costs of living with a new congestion tax. We must find alternative funding streams including the restoration of a commuter tax, an increase in the gas cap, ads the use of revenue from marijuana legalization for transportation funding.”

City Councilman I. Daneek Miller (D-St. Albans) added, “My Southeast Queens community shouldn’t be forced to pay a regressive and burdensome tax when it doesn’t have a multitude of accessible transit options like those in Manhattan, especially when programs such as the reduced fare LIRR Atlantic Ticket offer viable alternatives that actually benefit outer borough residents.

MTA Board Approves $17B Budget

A looming fare hike dominated the final MTA Board meeting of 2018.

By Michael V. Cusenza With some version of a fare and toll increase in the offing, the Metropolitan Transportation Authority Board recently voted to approve a $17 billion budget.

The board will vote on a hike plan next month. The added cost to ride is expected to rake in roughly $270 million. One fare hike initiative calls for the base fare to jump to $3 from the current $2.75. The other program would keep the base fare as is while hitting hard the wallets of customers who purchase weekly and monthly passes.

Board materials depicted an already beleaguered agency in fiscal peril.

“MTA’s finances are structurally imbalanced, with expenses surpassing revenues.

Budgets for 2017 and 2018—and now for 2019 as well—have been balanced with ‘one-shot’ actions. Over the past year and a half, projected MTA revenues have declined significantly…with fare and toll revenues down $1,027 million, dedicated taxes down $586 million and other operating revenue down $160 million.”

The latest budget is balanced through 2019; however, the board projects deficits of $510 million, $816 million and $991 million for 2020 through 2022, respectively.

And passenger revenue seems to continue to nosedive. On Wednesday, the board blamed the snowballing negative trend on: “Increased fare evasion; planned subway service changes to accommodate construction and maintenance/repair work; increased use of for-hire vehicle services; and increases in telecommuting and the use of e-commerce.”

ues to project net 4 percent biennial fare/ toll increases (the equivalent of 2 percent per year), which is lower than the projected two-year inflation rates of 5.3 percent and 4.7 percent in 2019 and 2021, respectively.

Consistent with recent Plans, a March 1st implementation is assumed for both the 2019 and 2021 increases. The annualized yield of these increases is projected to be $316 million and $329 million, respectively.

Maintains prior plan investments: The plan maintains major investments for the Long Island Rail Road “Forward” plan, the “Bus Plans” at New York City Transit and MTA Bus, and the Metro-North Railroad “Way Ahead” plan. Also included is maintenance of the Subway Action Plan, which will be funded from Phase 1 of congestion pricing, using fees from for-hire vehicle trips.

Bus and Subway Guidelines: Bus and subway service guidelines, which have been reviewed and approved by the board, are used to maintain an appropriate level of service based upon actual ridership on a route. The guidelines provided an objective standard of maximum loads for different times of day, and are intended to minimize the occurrences when buses or trains are either overcrowded or underutilized.

During years of ridership growth, these service guidelines were the basis for increased service where it was warranted, but over the past several years as ridership has declined, guideline-based service reductions had been deferred. With ridership levels not rebounding, NYCT is proposing service guideline adjustments beginning in 2020 that result in savings of $41 million annually, with reductions of $10 million for subway service and $31 million for bus service.

Jamaica Man Charged with Two Separate South Richmond Hill Slayings

By Michael V. Cusenza A Jamaica man has been charged with the shooting deaths of two men in South Richmond Hill—one in December 2017 and the other just four weeks later, Queens District Attorney Richard Brown announced on Friday.

Richard Davenport, 42, was arraigned Thursday on a six-count indictment charging him with two counts of second-degree murder and four counts of second-degree criminal possession of a weapon.

He was ordered held without bail and to return to court on Feb. 27.

According to the charges, at approximately 3 a.m. on Dec. 19, 2017, Davenport was a passenger in a Mercedes-Benz that drove several times past a Cadillac Escalade parked on 125th Street off of Atlantic Avenue and just outside of Phil “Scooter” Rizzuto Park. The Escalade was occupied by the victim, Dail Ramessar, 21, and four other individuals. Video surveillance of the scene allegedly

shows the Mercedes parked nearby; Davenport, who was dressed in a hooded sweatshirt, and Woodhaven’s Neville Brown, 38, exit the vehicle and approach the Cadillac from opposite sides. Davenport then allegedly fires several times into the Escalade, striking

Ramessar. The men fled the scene in the Mercedes. Ramessar was rushed to Jamaica Hospital Medical Center, where he died.

According to charging documents, at roughly 9:30 p.m. on Jan. 16, 2018, video surveillance allegedly shows the same Mer-

cedes-Benz stopped on 105th Avenue near 135th Street. Davenport, who was again wearing a hooded sweatshirt, exits the vehicle and approaches the victim, Omaree Morrison, as he walks on 135th Street. Davenport allegedly fired his weapon in Morrison’s di-

rection, striking the 19-year-old man several times. Morrison was rushed to Jamaica Hospital but succumbed to multiple gunshot wounds.

Ballistic tests of the shell casings recovered from the scene of the Morrison murder matched the gun used in the Ramessar homicide in December 2017, Brown noted before commending the efforts of investigators assigned to the 106th and 102nd precincts.

“Because of the great work of the NYPD detectives, this defendant has now been apprehended and will be vigorously prosecuted for his actions,” the DA promised.

If convicted, Davenport faces up to 50 years to life in prison.

Neville Brown was captured back in January by State Police in the town of Fishkill. According to court records, he pleaded not guilty on Tuesday at his arraignment. He was remanded to City Department of Correction custody and ordered to return to court on Feb. 27.

By Forum Staff A Queens Village man has been sentenced to 30 years and five months in prison for murdering an employee of a Long Island convenience store during a robbery, federal prosecutors announced on Monday.

Jermaine Jackson, 25, pleaded guilty to the charge in December 2017.

According to federal officials, on Dec. 16, 2016, Jackson and a co-conspirator entered the Al Mini Market in Valley Stream wearing a mask over the lower portion of his face and brandishing a semi-automatic handgun.

Jackson held the store’s employees at gunpoint while his cohort attempted to steal money from the cash register. Edwin Lopez, one of those employees, grabbed a bottle and resisted the robbery, at which point Jackson shot him once. Jackson then at-

tempted to leave the store but Lopez chased him. Jackson turned around and shot Lopez several more times, killing him. Jackson and his partner fled the establishment emptyhanded, prosecutors noted.

“The actions of Mr. Jackson brought an unknowable grief to the Lopez family that will be felt for years to come,” said U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives Special Agent-in-Charge Ashan Benedict. “Today’s sentence provides some semblance of closure to a family that never deserved to be touched by this senseless violence. May Mr. Jackson spend every minute of his sentence pondering his grievous actions and the toll they took on an innocent family.”

Jackson’s prison sentence is to be followed by five years’ supervised release, U.S. District Court Judge Sandra Feuerstein said.

City detectives recently reached out to the public for help in locating a man wanted for slashing a victim across the face with a razor last month on an Ozone Park street.

Investigators identified the suspect as Ralphie Cintron. According to police reports, Cintron allegedly slashed the victim at approximately 3:15 p.m. on Nov.

15 in front of 103-02 Liberty Avenue, causing serious injuries. Cintron is now wanted for felony assault.

Borough DEP Inspector Accepted Bribes from Asbestos Abatement Contractor: Authorities

By Michael V. Cusenza A City Department of Environmental Protection inspector has been charged with engaging in a long-term bribery relationship with an asbestos abatement contractor, City and State officials announced on Monday.

Samuel Nebedum, 66, was arraigned on Monday in Queens on a criminal complaint charging him with bribe receiving in the second degree and official misconduct. He was released on his own recognizance and ordered to return to court on Jan. 11.

According to a joint State Attorney General and City Department of Investigation probe, Nebedum allegedly accepted cash bribes, meals, and fish in exchange for providing various benefits to the contractor, including intentionally overlooking violations at the contractor’s worksites and the referral of additional abatement business for more than 10 years.

According to the complaint, Nebedum has been a DEP inspector for 28 years, and during the course of his employment allegedly accepted over $10,000 in bribes from a contractor during that time. The complaint alleges that in exchange for these bribes, Nebedum used his position as an inspector to give advance notice prior to official DEP inspections taking place at this contractor’s jobsites, ignored asbestos removal violations at this contractor’s jobsites, and referred additional business to the contractor, which stemmed from his official jobsite visits—all in violation of DEP policy.

According to the U.S. Environmental Protection Agency, asbestos is a mineral fiber that naturally occurs in rock

and soil. Asbestos fibers may be released into the air by the disturbance of asbestos-containing material during product use, demolition work, building or home maintenance, repair, and remodeling. Exposure to asbestos, the EPA said, increases your risk of developing lung disease. Three of the major health effects associated with asbestos exposure are lung cancer; mesothelioma, a rare form of cancer that is found in the thin lining of the lung, chest and the abdomen and heart; and asbestosis, a serious progressive, long-term, non-cancer disease of the lungs.

According to prosecutors, DEP is the primary City agency responsible for the regulation of the asbestos abatement industry. Proper abatement procedures involve requiring all workers at a jobsite to wear Personal Protective Equipment, which includes a protective mask and hazmat suit; wetting down all Asbestos Containing Material when removed, so as to prevent asbestos from becoming airborne; the setting up of a proper decontamination unit with proper air-monitoring equipment, to ensure the work area does not have air containing ACM escaping; and the dumping of materials containing ACM at designated disposal facilities. According to the complaint filed on Monday, Nebedum allegedly ignored these regulations during the course of this bribery scheme, putting the health of many workers and city residents at risk for inhaling and ingesting asbestos.

“As we allege, [Nebedum] abused his position by shamelessly accepting bribes—not only violating the public trust, but also jeopardizing New Yorkers’ health and safety,” State Attorney General Barbara Underwood added.

Addabbo noted that perhaps the most important issue that will come before the com-

mittee next year will be the future of legal sports betting in the Empire State. In May, the U.S. Supreme Court lifted the federal ban on sports betting, allowing states to decide if they want to permit wagering on such events.

The Racing, Gaming and Wagering Committee’s purview includes oversight of the state’s racetracks, video lottery terminal placements, care of retired racehorses, off-track betting, the New York State Lottery, charitable gaming, and other issues associated with racing and wagering in New York. The panel also oversees the operations and regulatory mission of the State Gaming Commission, as well as the work of the New York Racing Association, which runs the Aqueduct, Belmont, and Saratoga tracks.

Feds Find 70 Live Finches in JFK Passenger’s Bag A traveler recently was caught trying to smuggle nearly six-dozen live finches through John F. Kennedy International Airport, according to federal officials.

The man arrived on Sunday, Dec. 8, on a flight from Georgetown, Guyana. During the course of inspection, U.S. Customs and Border Protection agriculture specialists discovered 70 live finches concealed within hair rollers in a black duffel bag. They were subsequently detained under quarantine and turned over to the U.S. Department of Agriculture Veterinary Services.

According to the U.S. Fish and Wildlife Service, some people import finches to enter them in singing competitions in Queens and Brooklyn. Many who attend the contests wager on the birds.

Four borough hospitals are among the two-dozen Gotham medical facilities set to participate in the nation’s first city-led nurse residency program.

Mount Sinai Queens in Astoria; NewYork-Presbyterian Queens in Flushing; Elmhurst Hospital; and Queens General Hospital in Jamaica and 20 other hospitals are part of the new Citywide Nurse Residency program, Mayor Bill de Blasio, Deputy Mayor J.
