Attorneys General Urge FTC to Take Action Against Deceptive Marketing Practices

By Forum Staff A coalition of nearly twodozen chief law enforcement officers has reached out to the Federal Trade Commission urging the agency to adopt regulations to prevent consumers from being deceived by negative-option marketing schemes, State Attorney General Tish James, co-leader of the allied group, announced Tuesday.

According to the coalition of 23 attorneys general, with negative-option marketing, a marketer presents consumers with an offer and the consumers’ silence or failure to take action in response to that offer is deemed acceptance or approval of the offer. One especially problematic type of a negative-option offer involves a so-called “free” trial, in which consumers are offered a trial period of a product or service gratis. To receive the free trial, consumers are required to submit their credit or debit card number. However, the free trial has additional terms and conditions—which, according to the coalition, are not clearly or conspicuously disclosed to the consumer—stating that unless consumers cancel the goods or services they are agreeing to continue to receive and pay for them.

“Significant problems continue in any type of marketing where a consumer’s silence is deemed to be acceptance, thereby upsetting the common expectation that a consumer is not bound until there is a mutual agreement—in effect a handshake where each party af-

firmatively accepts the material terms of the agreement,” the AGs wrote. “This is not what happens in negative-option marketing in which consumers often find themselves in a sales plan where they are being billed and called upon to pay for products and services; and the circumstances fail to show that material terms were clearly and conspicuously disclosed or affirmatively agreed upon. Further, when consumers seek to

extricate themselves from these plans, they often run into multiple roadblocks in effectuating a cancellation and obtaining a refund of monies paid.”

In a 13-page letter to the FTC, the coalition argues for the commission to use its rulemaking authority to further expand existing negative-option regulations which were adopted in 1973 and regulate only one type of negativeoption marketing—the delivery

of merchandise where consumers receive periodic announcements that merchandise will be delivered unless they decline within a set time frame (i.e. book-of-themonth clubs).

In the missive, the attorneys general argue that expansion of regulations would achieve the following: Informed Consent: In addition to consenting to any trial offer, sellers should have to obtain a separate consent to charge for goods or services after the trial period has ended.

Periodic Notices: Sellers should be required to send regular notifications to consumers enrolled in negative option plans that disclose the timing, amount, and method by which the seller bills the consumer for the renewal, and that provides the consumer with a convenient method to cancel the goods or services.

Define Simple Cancellation Processes: Consumers should be allowed to cancel their memberships using the same method they used to enroll in a program.

Refunds: Consumers who are unwittingly enrolled in negative option plans should be entitled to a refund from the date the free trial ended and their enrollment began to be charged.

Don’t Fall Victim to Online Shopping Scams: FBI

That was the latent message this week from the Federal Bureau of Investigation as online shoppers—and schemers—gear up for the holiday gifting season.

According to the bureau’s Internet Crime Complaint Center, thousands of people become victims of holiday scams every year. The two most prevalent of these shakedowns are non-delivery and non-payment crimes. In a non-delivery scam, a buyer pays for goods or services they find online, but those items are never received. A non-payment scam involves goods or services being shipped, but the seller is never paid.

In 2018 alone, the IC3 estimates that non-delivery and non-payment scams together affected more than 65,000 victims, causing a staggering $184 million in losses.

Similar scams to beware of this time of year are auction fraud, in which a product is misrepresented on an auction site; and gift-card fraud, when a seller asks you to pay with a pre-paid card, according to the IC3.

day season or any other time of year: • Always get a tracking number for items purchased online so you can make sure they have been shipped and can follow the delivery process.

• Be wary of sellers who post an auction or advertisement as if they reside in the U.S., then respond to questions by stating they are out of the country on business, family emergency, or similar reasons.

• Avoid sellers who post an auction or

advertisement under one name but ask that payment be sent to someone else.

• Consider canceling your purchase if a seller requests funds be wired directly to them via a money transfer company, prepaid card, or bank-to-bank wire transfer.

Money sent in these ways is virtually impossible to recover, with no recourse for the victim. Always remember that anyone who asks you to use one of these forms of payment might be a scammer. A credit card is

generally the safest way to pay for an online purchase.

• Avoid sellers who act as authorized dealers or factory representatives of popular items in countries where there would be no such dealers.

• Verify the legitimacy of a buyer or seller before moving forward with a purchase.

If you’re using an online marketplace or auction website, check their feedback rating. Be wary of buyers and sellers with mostly unfavorable feedback ratings or no ratings at all.

• Avoid buyers who request their purchase be shipped using a certain method to avoid customs or taxes inside another country.

• Be suspect of any credit card purchases where the address of the cardholder does not match the shipping address. Always receive the cardholder’s authorization before shipping any products.

• Always be wary of deals that seem too good to be true.

If you do become the victim of a holiday scam, contact your bank immediately, FBI officials instructed. You should also inform the nearest NYPD precinct, authorities added, and file a complaint with the IC3 at ic3. gov.

Lindenwood Homes Marred by Racist Graffiti

That was how one Lindenwood homeowner described her initial reaction Thanksgiving morning after she first laid eyes on her fence—the pristine white fence now defaced with vulgar and seemingly incoherent messages autographed in bright red spray paint.

In a Tuesday evening phone interview, the long-time Lindenwood resident, who requested that The Forum not print her name for fear of reprisal, recalled that her neighbor knocked on her door around 8:30 Thursday morning to show her what he discovered as he walked his dog.

“ONE DAY I WILL COME BACK TO THIS AND SEE HOW SUCCESSFUL I AM!” and “I NEED P***Y ASAP,” was scrawled along the fence at the house on 151st Avenue between 81st and 82nd streets in large block letters. Additionally, she noticed the word “F**K” painted on a tree in front of her home.

“I guess you could say I was in shock,” the victim posited, “because I’m here [in Lindenwood] for 25 years; in this house for 17 [years]. I was kind of taken aback.”

The homeowner quickly learned that she was not alone. Across the street from her residence, the same artist left “F**K WHITE PEOPLE” in black paint with each word un-

derlined in red on the sidewalk in front of another abode.

By 9 a.m. the block was swarming with law enforcement.

“Acts of intolerance are not acceptable,” said Capt. John Costello, commanding officer of the 106th Precinct However, as of Wednesday afternoon, the perpetrator had not been identified or caught.

The 106 has beefed up its presence in the area.

“The detectives are still investigating it,” Neighborhood Coordination Officer Pete Paese told The Forum Monday.

Area residents were puzzled by the hate crime in such a quiet neighborhood in The World’s Borough.

When asked if Lindenwood was an exclusive community, the homeowner whose fence was damaged by the graffiti replied “absolutely not—especially not Lindenwood. We have a multitude of nationalities, personalities, and races.”

She also noted that she was not going to let this affect her this holiday season.

“We just put up Christmas decorations,” she reported. “This is supposed to be the happiest time. You just can’t let certain things get under your skin.”

Dozens of Homes in South Ozone Park, Jamaica Flooded with Human Waste after SewrMain Blockage

By Michael V. Cusenza The City will use emergency procurement to hire contractors to clean dozens of homes in South Ozone Park and Jamaica that were affected by last weekend’s sewer main blockage, Mayor Bill de Blasio announced Monday.

To date, the City has confirmed that 74 homes were affected by flooding. The Department of Environmental Protection has installed a bypass pump to assist with flooding while repairs to the sewage line at 150th Street and South Conduit Avenue are ongoing and additional equipment is brought into the area, the mayor added.

“I feel for the homeowners in Queens who were affected by the sewage blockage this weekend,” de Blasio said. “We are implementing the emergency procurement process to ensure that homes are cleaned quickly, and we are going to work with each and every New Yorker who experienced flooding to make sure they get back on their feet.”

The Department of Small Business Services is working with Emergency Management on the effort. Scrubbing will continue until all homes are clean, de Blasio pledged, while residents file claims with their insur-

ance companies and reimbursement claims with the City comptroller.

“DEP and my office will be investigating the cause of this sewer backup,” said City Comptroller Scott Stringer. “In addition, as the cause of the incident is investigated, I urge impacted homeowners to file a notice of claim with my office within 90 days of the incident and to contact their insurance companies immediately.”

The administration has set up a service center at the Courtyard Marriot at 145-11 North Conduit Ave. to function as a central point for homeowners to reach resources; hours of operation are 9 a.m. to 8 p.m. City workers at the service center will help affected residents fill out claim forms from the Comptroller in order to be reimbursed for out-of-pocket expenses. According to Emergency Management, this work may involve

potentially taking down sheet rock, ripping up carpets and other flooring materials, and related work. Materials taken down or removed due to the sewage backup during the work process will not be replaced; that will be the homeowner’s responsibility. Anything that homeowners wish to retain from the work area should be removed prior to the contractor arriving to begin work. If the property is not properly cleared for work, the contractor will move on to the next homeowner’s property and the appointment will need to be rescheduled.

OEM and the City Fire Department brought in portable heaters for those whose boilers were affected. Drinking water remains safe and unaffected, de Blasio declared.

“I’ve seen for myself the distress residents faced when their holiday weekend was disrupted by the destructive sewage backup that has left many homes seriously affected,” said U.s. Rep. Greg Meeks (DJamaica). “While we work with the City to use emergency contractors to unflood basements and restore the sewage system, I urge residents in need to seek services at the Courtyard Marriot where we will have City representatives available to address your concerns.”

By Forum Staff Unless Congress approves funding for Community Health Centers by Dec. 20, CHCs could lose more than 70 percent of their federal grant funding, causing the facilities to cut or scale back the services they provide more than 29 million Americans, according to U.S. Sen. Kirsten Gillibrand (D-N.Y.).

While a short-term extension removes the immediate threat of disruption for CHCs, the senator said centers across the country are already reporting indirect impacts from the threat of a lapse in funding for the Community Health Center Fund, which makes up more than 70 percent of federal grant funding for health centers. Even with another extension for these programs, the uncertainty around funding continues to pose major challenges, Gillibrand reported. If the CHCF is not reauthorized altogether, the Health Resources and Services Administration predicts that this 70-percent reduction in federal funding could result in nearly 9 million patients losing access to primary and preventive care, roughly 47,000 providers and staff losing their jobs, and approximately 2,400 sites closing. Health centers in New York State could stand to lose more than $185 million and nearly 400,000 patients could lose access to care. New York alone could lose up to a whopping $900 million in economic activity without reauthorization of the CHCF. So New York’s junior senator on Tuesday launched a new push to extend, raise, and reauthorize funding for the CHCs across New York and the country. In a letter to congressional leadership, Gillibrand noted CHCs provide high-quality, comprehensive, and lowcost care to millions of New Yorkers, and provide services to patients regard-

less of income and insurance coverage.

Along with primary health care, Gillibrand said, CHCs also offer oral health care, mental health services, substance abuse treatment, case management, transportation assistance, housing support, and translation assistance. There are 65 federally funded community health center organizations that provide health care services to 761 health sites across the Empire State that serve more than two million patients. In New York, 68 percent of patients served are low-income; 53 percent are covered

by Medicaid; and 16 percent are uninsured. In addition, over 650,000 patients are children, 104,000 patients are homeless, and 18,000 patients are veterans. Nationally, there are 1,400 federally funded health centers that operate at nearly 12,000 sites and serve 29 million patients.

“Community Health Centers are important to New York’s economic stability, which in 2017 generated nearly $5 billion for our economy and created 35,000 full-time and part-time jobs,” the senator added.

In her missive to Senate Majority Leader Mitch McConnell, Senate Minority Leader Chuck Schumer, House Speaker Nancy Pelosi, and House Minority Leader Kevin McCarthy, Gillibrand noted that CHCs rely on longterm and robust funding to ensure that they have the resources and stability to maintain and expand the services they provide, train and recruit providers, purchase equipment, and plan strategically to meet current and future needs of the community. She called on Congress to extend, raise, and reauthorize funding for CHCs in accordance with the Community Health Center and Primary Care Workforce Expansion Act of 2019, legislation she cosponsors, to secure funding for CHCs for the next five years.

Shea Sworn in as New Top Cop

By Michael V. Cusenza Dermot Shea on Monday was sworn in as the 44th police commissioner of New York City.

Shea, 50, succeeds Jim O’Neill, who announced last month that he would be stepping down for a security opportunity in the private sector.

A native of Sunnyside, Shea began his service as a police officer in 1991 and rose through the ranks to become chief of Crime Control Strategies and deputy commissioner for Operations under O’Neill’s predecessor, the legendary Bill Bratton, where Shea oversaw and honed the NYPD’s trailblazing CompStat system.

“I had a tremendous advantage of having watched Dermot Shea in action for six years,” Mayor Bill de Blasio said on Monday at 1 Police Plaza. “And if you watch him, if you’ve ever seen him at a CompStat meeting, if you’ve ever seen him in a strategy session, you see an extraordinary, active mind. You see a man who believes we can go much farther, not just a little bit—we can go much farther.

Someone who has such inherent faith in this department and the men and women who make it great, but also has a belief in our people and a love for the people of this city. When he grills a colleague, it’s not out of anger, it’s out of hope that we can get even better. When he puts an idea out that no one’s thought about before or been willing to say out loud, it’s because he’s not afraid to dream. It’s a rarity that

you get to watch someone for six years through thick and thin deal with every kind of scenario. But what I saw was a man who was always ready to innovate, always ready to hope, and I saw the inspirational impact that he had on others.”

Last month, Shea vowed that as top cop he would apply precision policing and Neighborhood Policing to target gang-related violence, take guns off the streets, and continue the City’s historic reduction in crime.

In remarks delivered Monday, Shea reminisced on his first foot post as a rookie in the 46th Precinct in the Bronx, and ruminated on what it means to be a police officer protecting the city that seems to be the center of the universe.

“Policing is about more than public safety, it’s about service. It’s about, as the mayor said, providing hope to those sometimes that have no hope; it’s about protecting those who cannot protect themselves. It’s about changing lives,” Shea said. “So this is my message to police officers: Never forget for one second, not one second, the impact that you have on others’ lives. It’s not always easy to measure but I guarantee to you it is happening. From a police officer comforting a crime victim in their darkest hour, to standing watch as people walk home, preventing them from ever becoming victims and the trauma that comes with it, to working with kids and being a role model, you do all of this and so much more and sometimes in an eight-hour shift. You literally change people’s lives.”

He is merciful because, through His own sufferings, He can sympathize with ours. He is faithful because He endured to the end. The human nature of Christ enables Him to have compassion for us far more than if He were only God, and this is a great encouragement for us to pray directly to Him for help. Our relationship to Him can be personal, and He Himself will impart to us the strength, forgiveness, and joy that we need on life’s journey. He was made like us in temptation so that we can be made like Him in victory.

Far more than a holiday decoration, a picture of baby Jesus is a message that God has been with us in our humanness and now invites us to be with Him at His throne.

EDITORIAL A tip of the hat to the City Council, which recently approved a comprehensive package of legislative measures to crack down on the improper use of City-issued parking permits, known as placards.

The legislation is designed to rein in misuse of placards throughout the five boroughs.

According to the council, the package would enhance enforcement of placard abuse and dangerous illegal parking by establishing a six-month pilot program requiring the Police Department to evaluate sites throughout the City based on complaints related to placard abuse and document their enforcement efforts with photographs. This work would be reviewed by the Department of Investigation, which is now for the first time being tasked with investigations into the enforcement of permit misuse. The City will also have new enhanced penalties for using a fake placard and clear guidelines for revoking the placards of individuals who repeatedly misuse their permit, the council noted.

not a right. When people abuse this privilege and flout traffic laws, they not only create inconvenience to drivers and cyclists who follow the rules—they make the streets dangerous for everybody,” said Councilwoman Maragaret Chin (D-Manhattan).

Additionally, the package creates a standardized application process for City-issued parking permits to better manage the process

of receiving a placard and mandates that the City develop a comprehensive plan on the use and distribution of placards. The bills would also expand the ability to report placard abuse and illegal parking by requiring the City’s 311 service to accept complaints and photographs related to illegal parking and misusing parking permits. These bills will also increase the penalty for using a fake placard and sets clear guide-

lines for revoking the placards of individuals who repeatedly misuse their permit. The package includes legislation requiring periodic reporting on the improper use of placards and reports of illegal parking by official City vehicles. Finally, the package would prohibit official City vehicles from blocking a bike lane, bus lane, crosswalk, sidewalk, or fire hydrant.

“Placard abuse is corruption,

plain and simple, and the City Council is cracking down,” said Council Speaker Corey Johnson.

“Street space in New York City is too valuable a commodity to let placards—both real and fake— have the run of the place. Passing this package of bills is another major step forward in our efforts to make it easier to get around New York City in ways that are efficient, safe, and environmentally sustainable.”

Boyfriend of Kew Gardens Hills Woman Charged in Knife Attack on her and 6-Year-Old Daughter

By Forum Staff A 30-year-old Brooklyn resident has been charged with attempted murder, assault and other crimes after stabbing his girlfriend’s 6-year-old child in the neck and then stabbing the child’s mother in the throat, when she tried to intervene. The double stabbing occurred early on Thanksgiving Day, Kew Garden Hills.

“The defendant in this case is accused of attacking an innocent child with a knife and then turning the blade on the girl’s mother when she tried to stop him. This was a heinous act of violence that put both victims at grave risk. The defendant is in custody and now faces spending decades in prison as punishment for his alleged criminal actions,” Acting District Attorney Ryan said.

Steven Bagu, 30, of Cozine Avenue of

East New York in Brooklyn was arraigned before Queens Criminal Court Judge Jeffrey Gershuny on a complaint charging him with second-degree attempted murder, first- and second-degree assault, first-degree attempted assault, first-degree unlawful imprisonment, endangering the welfare of a child and fourth-degree criminal possession of a weapon.

Judge Gershuny remanded the defendant and ordered him to return to court on February 13, 2020. On Thursday, November 28, 2019, between 2 and 4:30 a.m. the defendant’s girlfriend awoke to the sound of her daughter screaming. The woman ran into the living room where she saw Bagu standing over her 6-year-old daughter with a knife in his right hand. The little girl had been stabbed in the neck and was bleeding.

According to the complaint, child’s

mother attempted to get to her daughter, but the defendant blocked her. She turned to go toward the door to get help but the defendant jumped in front of her and grabbed her. The woman repeatedly tried to escape until Bagu stabbed her in the throat with the knife.

For the next two hours, the defendant held both the woman and her daughter captive. Bagu fell asleep and the mother was able to escape the apartment and get to a neighbor’s apartment for help and called 911. Bagu was apprehended at the scene.

Both victims were taken to nearby hospitals.

The child received stitches to close a puncture wound to her neck. Her mother underwent surgery after her trachea was punctured by the blade of the knife. If convicted, Bagu faces up to 25 years in prison.

Ice-Pick Wielding Killer Pleads Guilty to Manslaughter for Stabbing Far Rockaway Man to Death

By Forum Staff Acting Queens District Attorney John M. Ryan announced today that a 55-year-old Bedford-Stuyvesant resident has pleaded guilty - on the eve of trial – A Brooklyn resident has plead guilty to manslaughter on the eve before trial, for brutally stabbing of a Far Rockaway man to death.

Norbert Williams, 55, of Decatur Street in Bed-Stuy knocked on the door of Joseph Smart’s apartment and asked for the help in June of 2017. Smart told the victim he needed his help with a couple of guys who were bothering him and Smart barefoot and in shorts and an undershirt rushed to his aid. Williams and the 47-year-old victim entered the stairwell of the building, where the defendant suddenly attacked the man.

Acting District Attorney Ryan said, “This was a rageinduced stabbing frenzy that is wholly unacceptable. The defendant has now admitted to this heinous crime and is facing a lengthy term of imprisonment when sentenced.”

On the eve of jury selection, before Queens Supreme Court Justice Kenneth C. Holder the defendant plead guilty to second-degree manslaughter. Council Set to Consider Legislation that Would Reduce Paper Receipt Waste

By Forum Staff The City Council will hold upcoming hearings on bills designed to give customers more choice over receiving receipts and phase out the use of BPA-coated receipt paper, Council Speaker Corey Johnson announced Friday.

The city’s legislative body is set to consider four bills that will look at providing consumers with the option of declining a paper receipt in exchange for an e-receipt; providing customers with the option not to print receipts; requiring the recycling of receipts; and alternatives to BPA/BPS (bisphenol A/bisphenol S) paper.

“Buying a candy bar shouldn’t require a four-foot receipt. Yet many retailers burn through unnecessary amounts of paper while exposing millions of New Yorkers to harmful toxins. I look forward to a day when these receipts are tossed out for good,” said Councilman Costa Constantinides (D-Astoria), chairman of the Council Committee on Environmental Protection.

Councilwoman Debi Rose (D-Staten Island) said, “At a time when we need to reduce waste and our carbon footprint, receipts seem to be getting longer and longer, and most go straight to the shredder or trash can. We have the technology for electronic receipts. We should utilize it as a default across our city, with paper as a secondary option for those who expressly prefer it.”

City Achieves HIV/AIDS Milestone

By Forum Staff New York City has reached the UNAIDS 90-90-90 goals—90 percent of all people with HIV know their status; 90 percent of all people diagnosed with HIV are on treatment; and 90 percent of all people diagnosed with HIV who are on treatment are virally suppressed— two years ahead of schedule, Mayor Bill de Blasio announced Monday.

As of 2018 in the five boroughs, 93 percent of people with HIV have been diagnosed; 90 percent of people diagnosed with HIV are on treatment; and 92 percent of people on treatment are virally suppressed. And last month, the City Health Department released the 2018 HIV Surveillance Annual Report, which showed the number of people newly diagnosed with HIV in New York City in 2018 fell below 2,000 for the first time since annual HIV reporting began in 2001.

NYC Health Commissioner Oxiris Barbot, M.D., said Gotham “is charting a path to zero new diagnoses.”

The Big Apple is the first Fast-Track city in the U.S. to reach the 90-90-90 milestone. The Fast-Track Cities initiative is a global partnership of more than 300 cities and municipalities around the world working to achieve the aforementioned UNAIDS targets.

“Years of hard work and determination has put New York front and center in the global fight against HIV/AIDS,” de Blasio said. “With more New Yorkers receiving treatment than ever, the day of zero diagnoses is closer than ever— something many believed unthinkable

On Sunday, World AIDS Day, Gov. Andrew Cuomo announced that HIV incidence—or the estimated number of new HIV infections—continue to fall to historically low levels. Additionally, data from 2018 shows 82 percent of newly diagnosed New Yorkers were connected with care within 30 days of diagnosis, Cuomo noted.

The new data indicate that the Empire State is on track to achieve the governor’s goal of “Ending the Epidemic” by the end of 2020. The “Ending the Epidemic” initiative was launched in 2014 to significantly reduce HIV infections by the end of next year and achieve the first-ever decrease in the number of people living with HIV in New York.

As the governor noted, “Ending the Epidemic” does not mean the absolute elimination of HIV/AIDS, which would require a cure for those currently living with HIV/AIDS and a vaccine to prevent future transmission, but rather what public health officials call “bending the curve,” which occurs when the annual number of estimated new HIV infections is lower than the number of people with HIV who die in a given year.

“These record-low levels of estimated new HIV infections and other key metrics—including new data showing we are connecting people to care sooner—demonstrate once again that while our work is not done, we are making important progress toward bending the curve on an epidemic that has taken the lives of too many people for too long,” Cuomo added.

Experts say the holidays have psychological consequences for many people and the fact that chronic stress has been proven to lower immunity and can cause excretory, digestive and reproductive systems to stop working properly. It can also cause you to eat unhealthy snacks to cope, leading to unwanted weight gain.

Stress is not the only holiday health concern. Exposure to an abundance of foods and drinks can lead to a lot of mindless eating. Weight gained now is difficult to shed come January.

Experts suggest that you sit back to take a 10-minute break after your first helping. You very well might realize that you’re already full or want only a small portion of seconds. Remember not to go anywhere for the holidays on an empty stomach. It usually causes you to overeat.

You can indulge in your favorite holiday foods without packing serious pounds if you make a few food swaps to some holiday regulars. For instance, replace

sour cream with greek yogurt and trade mashed potato with mashed sweet potato. Move away from heavy dips like blue cheese and spinach and artichoke and try healthy bean-based dips and homemade hummus.

Remember you're in close contact with a greater number of people, potentially increasing your exposure to germs.

You can still feel your best during the holidays. Follow these tips for maintaining a healthy mind and body.

• Get the flu vaccine.

• Carry disinfecting wipes. Germs can linger on surfaces long after an infected person has come and gone. Wipe down surfaces with disinfecting wipes and allow them to air-dry before touching them.

• Balance your activities. Leave days open to relax and do things you want to do, make sure you take a spin around the neighborhood and look at the Christmas lights. Try delegating some tasks to others.

• Keep up an exercise routine. Early morning is a good time to exercise because you may have to free up other time later in the day for shopping or parties. Exercise also can improve energy levels and relieve stress.

• Don’t focus on food. Focus more on enjoyable activities. Save indulgences for holiday treats and eat sensibly otherwise.

• Talk to someone. If the holidays have you feeling blue, talk to a friend or family member.

City Changing Official NYC Map to Make Rikers Island a Public Space by 2026

Taylor Center on Rikers Island and the Brooklyn Detention Complex, also known as “Brooklyn House”—next year, the City on Monday began the land use process to officially prohibit the incarceration of individuals on Rikers Island after Dec. 31, 2026, when the borough-based jail system is expected to be in operation.

The land use application filed Monday by the Mayor’s Office of Criminal Justice, the Department of Correction and the Speaker of the City Council is the first step in the Uniform Land Use Review Process to change the island’s designation on the official City map to a public place.

“This is a major step for New York City, and shows our deep commitment to closing Rikers Island. We are moving away from the failed policies of mass incarceration and showing the world that Rikers’ days are numbered,” said Council Speaker Corey Johnson.

noted. Any future plans will require a new planning and public review process, including a separate approval for any environmental review process as necessary.

According to the administration, Brooklyn House is set to shutter by the end of January; ENTC will close its doors for good in March. They will be the second and third jails closed by the administration, joining

the George Motchan Detention Center, a former Rikers facility, which the City closed last year.

“The proposed change to the City map to establish Rikers Island as a public space solidifies the administration’s commitment to end incarceration in this space,” said Councilwoman Adrienne Adams, chairwoman of the Council Subcommittee on

Landmarks, Public Sitings, and Dispositions. “The people of New York City deserve to have a meaningful say in the future of the island and I applaud the public participatory planning effort. This is an exciting step forward so that New York City can move toward ending an inhumane and environmentally unsound system of mass incarceration.”

In addition to the new announced closures, the City recently announced its initial timeline for finding and securing firms to execute the design-build demolition and construction process for the borough-based jails. Requests for Qualifications for early work items were published last month with the remaining RFQs to be issued in the first quarter of 2020.

“Rikers Island has been a stain on New York City for nearly a century, with thousands of people subjected to physical and mental anguish under a broken system,” Councilman Costa Constantinides (D-Astoria) said. “As the representative for Rikers Island, I am proud to see the ULURP commence to ensure these 413 acres are never again used for this kind of torture. fect, which allowed New York consumers to opt out of receiving pre-recorded or “robocalls.” However, since the establishment of the national Do Not Call Registry, consumers have seen an increase in live telemarketing calls, requiring this change in the State law, the governor noted.

“This loophole is a license to annoy New Yorkers that telemarketers have taken advantage of for far too long,” Cuomo said. “With these new protections, we can help ensure New Yorkers receive fewer unwanted calls and their privacy is protected once and for all.”

According to YouMail, a company that tracks robocalls, 25 billion robocalls were placed nationwide in the first five months of this year. Unwanted robocalls have disproportionately targeted New Yorkers, who had logged 1.5 billion of them as of June 2019.

“People live busy lives, and the last thing that they need to deal with are disruptive calls from telemarketers. Over the last few years, the amount of nuisance calls has increased drastically, and this bill would curb these bothersome calls,” said State Sen. Todd Kaminsky (D-Long Island).

According to the administration, the legislation takes effect in 90 days.

Bill Aims to Inform Consumers of Recalls

If a company sells a dangerous item, that company should rightly be expected to market the recall as aggressively as they marketed the sale of the product,” Rep. Meng said.

Meng noted that currently the average response rate of consumers for most recalls is only between 4 and 18 percent.

She said her legislation would increase notifications for all types of recalls by requiring businesses to post recall notices on their websites and on all social media accounts. For a mandatory recall, businesses would be required to notify the public by spending at least 25 percent of the money they used for traditional marketing of the product. For a voluntary recall and settlement, companies would be urged to notify consumers by using at least 25 percent of the product’s original traditional marketing budget and 100 percent of the social media marketing budget. The bill would also mandate that the Consumer Product Safety Commission provide an annual report to Congress on participation rates for each recall.

“Each year, businesses launch nearly 30,000 new products, but some of those items may endanger the health and safety of our families and our homes,” Meng said.

“We can’t expect busy parents and consumers to consistently check for possible problems every time they purchase a product. If a company sells a dangerous item, that company should rightly be expected to market the recall as aggressively as they marketed the sale of the product.”
