Council Approves Creation of Hit-Run Alert System Let Your House Say…

Council Speaker Melissa Mark-Viverito and her colleagues recently voted 47-0 in favor of instituting a public alert system for hit-and-run incidents.

By Michael V. Cusenza City Council recently approved several pieces of proposed legislation, including a bill that calls for the creation of a public alert system for hit-and-run incidents.

Introduction 1463-A, which passed the City’s legislative body last week by a 47-0 tally, would require the City to establish a system, similar to America’s Missing: Broadcast Emergency Response (AMBER) Alerts, to notify the public and media of hit-and-run incidents resulting in serious injury or fatality, in order to assist in the identification of drivers responsible for these events.

“From January to September, 42 hit-andrun crashes were reported and only 18 arrests were made. We cannot tolerate these crimes knowing that families are left destroyed and mourning the loss of a loved one,” said Councilman Ydanis Rodriguez (D-Manhattan), chairman of the Council Transportation Committee and the sponsor of the measure. “This irresponsible driving behavior has triggered me to advocate for an alert system for the purpose of increasing the number of hit-and-run arrests in NYC. Using technology already available to us to make New Yorkers aware of hit-and-run crashes that resulted in severe physical harm or death will make the more than eight million New Yorkers a resource for the NYPD in finding the suspect.”

The bill was inspired by Jean Paul Guerrero, a.k.a. DJ Jinx Paul, a popular Latin radio personality who was killed in Brooklyn in a hitand-run on Dec. 19, 2016. He was 39 years old.

Kevin Ozoria, 28, has been charged as the alleged driver in the fatal accident.

Additionally on Thursday, the council voted in favor of a bill that would officially

deem “revenge porn” illegal. Sponsored by Councilman Rory Lancman (D-Hillcrest), Intro. 1267-A would prohibit the nonconsensual distribution of sexually explicit videos or images of another person, with the intent to cause harm to the person depicted in such videos or images. The bill also prohibits any legitimate threat to do so. The measure creates both a criminal penalty and a civil cause of action, and contains limited exceptions, Lancman noted.

“With passage of this landmark legislation, New York City finally calls revenge porn exactly what it is: a crime,” said Lancman, chairman of the Committee on Courts and Legal Services. “For too long, our laws failed to keep up with our technology, leaving victims of revenge porn unable to seek justice and hold perpetrators accountable. That changes today. Criminalizing revenge porn will ensure New Yorkers are protected and those who take part in this despicable conduct will face serious consequences. I commend the victim advocates, law enforcement personnel and revenge porn survivors who raised their voices to make this day a reality.”

The council also approved legislation that would require City employees and contractors to protect all identifying information— including contact information, sexual orientation, religion, and immigration status—by limiting its collection, disclosure, and retention, except where required by law. Requests for the collection or disclosure of identifying information would be processed by a newly established privacy officer within each agency who would analyze whether the collection or disclosure would further the purpose or mission of the agency.

Crowley Concedes to Holden as Civic President Completes Upset Bid Defeats incumbent by 137 votes to capture District 30 seat

Cusenza Incumbent 30th District City Councilwoman Elizabeth Crowley (D-Glendale) on Wednesday finally conceded the race to her opponent, Juniper Park Civic President Bob Holden, more than a week after Election Day. Holden held a razor-thin lead over Crowley—just 133 votes— after all precincts reported. The incredibly tight political fight then turned its weary eyes to paper ballots. After Holden’s lead slightly augmented to 137 tallies, Crowley apparently acknowledged that it was all over.

She was the only incumbent on the council this year to lose her bid for re-election.

In September, Crowley trounced Holden in the Democratic primary. But Holden was already prepared to run in the general election on the Reform and Conservative lines when he was approached

by Queens GOP leadership and asked if he’d like to run on the Republican line via a Wilson Pakula waiver.

He accepted. And the rest is World’s Borough political history.

“I want to congratulate my good friend Councilman-elect Bob Holden. He upset the apple cart last night,” said City Councilman Eric Ulrich (R-Ozone Park), who cruised to victory over Democratic challenger Mike Scala to earn a third, and final, four-year term on the council.

Holden was raised in Maspeth

and resides in Middle Village. He has been married to his wife, Amy, for 43 years. They have three children and three grandchildren.

Holden is a professor at New York City College of Technology in the Department of Communication Design and a working graphic designer. For 25 years he held the office of president of the Juniper Park Civic Association, which serves Middle Village and Maspeth. He has been a member of Community Board 5 since 1988, and its Public Safety Committee chairman for the past 13 years. Holden also is the founder and president of the Juniper Valley Park Conservancy Inc., an organization that raises funds and organizes volunteers to care for the park.

District 30 covers Glendale, Maspeth, Middle Village, Ridgewood, Woodside and Woodhaven.

On Confession Tape, Alleged Karina Vetrano Killer Recounts Savage Attack

By Forum Staff The video recording of accused Karina Vetrano killer Chanel Lewis stoically recounting for detectives how he brutally murdered the beloved Howard Beach resident took center stage on Monday in a borough courtroom during a pre-trial evidentiary hearing.

According to the New York Post, Vetrano’s family endured the details of Karina’s final moments as Lewis detailed them for investigators inside the 107th Precinct stationhouse. Her parents and sister watched the footage of the February confession in horror.

Lewis, 21, told cops that he grabbed Vetrano, 30, as she jogged past him inside Spring Creek Park on Aug. 2, 2016. She fought for her life as Lewis tried his best to knock her out.

“She didn’t yell. She was finished,” Lewis said in the Post story. “I finished her off, I strangled her. She fell into the puddle and drowned.”

Though Vetrano had been sexually assaulted, Lewis insists on the tape he had nothing to do with that element of the attack.

“I didn’t do any of the stuff they said, sexual assault and stuff like that,” he said.

When asked for a motive, Lewis answered, “Because a guy

moved into my house and the neighborhood.”

Lewis’ family apparently could not bear to sit through the entire footage.

“His family left the room,” Karina’s dad, Phil Vetrano, told the Post. “They couldn’t listen to his confession. We know where the coward got his cowardliness from. The truth hurts.

It’s pathetic.”

Phil Vetrano and NYPD investigators discovered his daughter’s body that summer night lying in a marshy area, approximately fifteen feet from a trail near 161st Avenue and 78th Street in the park.

Lewis, an East New York resident, was arrested in February, six months after the murder. He was arraigned in April on a 13-count indictment charging him with murder and sexual abuse in the strangulation death of Vetrano: four counts of first-degree murder; five counts of second-degree murder; two counts of first-degree aggravated sexual abuse; and two counts of first-degree sexual abuse.

According to court records, Lewis’ trial date is scheduled for Jan. 9, 2018.

If convicted, he faces up to life in prison without the possibility of parole.

By Forum Staff U.S. Rep. Grace Meng (D-Flushing) recently met with U.S. Transportation Secretary Elaine Chao on Capitol Hill where they discussed excessive aircraft noise over Queens communities.

According to Meng, she explained that increased airplane noise over the borough is a top concern of many constituents. The congresswoman said that she is constantly advocating for more federal resources for noisemitigation efforts – whether through new technologies or practices – and urged Chao to work with her to address the problem.

the Dahlia charter bus crash that took place two months ago in Flushing. Three people were killed in the accident and several others were injured. Meng noted that she urged Chao to work with her on preventing future crashes once the National Transportation Safety Board completes its investigation into the incident.

Peralta is distributing a pamphlet detailing the rights of automobile owners as they pertain to towing in the five boroughs.

By Forum Staff State Sen. Jose Peralta (D-East Elmhurst) is now distributing a pamphlet to constituents detailing the rights of automobile owners as they pertain to towing situations.

Peralta said he wanted to protect consumers after fielding complaints from constituents who had to pay hefty fines to towing companies after their vehicles were removed from private parking lots.

The senator noted that in 2015, more than 1,400 drivers filed complaints with the City reporting that tow trucks operators had illegally removed their vehicles. A year earlier, the Legal Aid Society and the City Department of Consumer Affairs were able to obtain approximately $30 million in fines and restitution for consumers, Peralta said.

“The goal of handing out this pamphlet is to ensure drivers know their rights when their cars are being towed by private operators, who at times use intimidating tactics. We must ensure these operators act accordingly with the law

and don’t rip off or try to rip off New Yorkers,” the senator added. “Simply put, this is about letting the public know about their rights and ways to fight back against abusive predatory towing operators.”

According to the Know Your Rights: Towing pamphlet: • A tow operator can remove improperly parked vehicles and can collect up to but not more than $125 for removal and the first three days of storage, combined.

• No vehicle shall be removed by a tow operator from private property without expressed written authorization by the owner of the private property. Such authorization shall be required for each vehicle removed.

• A vehicle which is removed shall be taken directly to a facility for storage maintained by the person licensed to engage in towing.

• Within 30 minutes of the vehicle’s arrival at a facility for storage, they must notify the local police precinct.

Jamaica Man Charged in Fourth of July Drive-By Shooting that Left Two Dead

Homeless Man Sentenced to 22 Years in Prison for Beating Man to Death in Far Rockaway

By Forum Staff A homeless man, convicted in the brutal beating of his 57-year-old victim has been sentenced to 22 years in prison.

Danthony A. Horton, 36, of no known address, was sentenced following a manslaughter conviction in the savage beating death of Ricardo Cruz back in May 2016.

Cruz – who was already laying unconscious on the ground – was then repeatedly kicked in the head and left for dead by the defendant.

District Attorney Brown said,

“This was a brutal and senseless act of violence. The victim had already been struck so hard by the defendant that he was unconscious and laying slumped on the ground. Although two male passers-by physically stopped the defendant from continuing his assault, the defendant returned to the scene and kicked the defenseless man repeatedly in the head. The Court has now sentenced the defendant to a lengthy term of incarceration.”

Acting Queens Supreme Court Justice Deborah Stevens Modica, found the defendant guilty of first-

degree manslaughter following a three-week long bench trial earlier this month, and sentenced Horton last Thursday, to 22 years in prison to be followed by five years’ post release supervision.

Comptroller Launches Interactive Site Analyzing NYC Economy

City Comptroller Scott Stringer recently launched a new website that, according to NYC’s chief fiscal officer, presents data on the city’s economy in an accessible, open, and easy-to-manipulate way.

Stringer said that comptroller. nyc.gov/EconomicData will allow “everyday New Yorkers, policymakers, and economists” to explore the data that underpins the comptroller’s Quarterly Economic Reports and analyze the city’s economic performance over time.

According to the comptroller, between July and September 2017, Gotham’s economy continued to grow, expanding by 3.6 percent.

And positive leading economic indicators point to future growth in the five boroughs, Stringer noted.

The comptroller’s Quarterly Economic Update is released every three months. According to Stringer, the report tracks the city’s “economic health” and analyzes its economy “in a national context.”

growth in the city accelerated from last quarter, and was once again stronger than the rest of the country, Stringer noted; • Since the city’s economic recovery began at the end of 2009, it has added an average of 23,500 jobs per quarter — resulting in an average annual growth rate of 2.7 percent. Over the same time period, the national growth rate was just 2 percent; • The city’s unemployment rate, adjusted for seasonality, was

4.9 percent in the 3rd quarter — up from an all-time low of 4.3 percent in the 1st and 2nd quarters of the year – but initial unemployment claims continue below trend; • Continuing a years-long trend, most of the new private-sector jobs added in the 3rd quarter — 13,100 jobs, or 45 percent — were in low-wage industries. An almost equal number, 13,000 jobs (44.9 percent) were in medium-wage industries; • The remainder of the jobs

created in the 3rd quarter—10.1 percent—were in high-wage industries. On this metric, NYC is lagging the nation — in the 3rd quarter, 16.2 percent of all new jobs in the U.S. were high-wage jobs; • Just 36 percent of new jobs were in the export sector, which, as Stringer pointed out, provides goods and services to those outside the NYC metro area, while the remainder were in the local job sector.

Ozone Park Crash Claims 18-Year-Old Driver

Xylique Lovelace-Loney was killed when two cars collided Sunday night at the intersection of Sutter Avenue and 80th Street.

Cusenza An 18-year-old man was killed and another young man was injured late Saturday night in a two-vehicle crash at an infamous Ozone Park intersection, according to police and published reports. Xylique Lovelace-Loney was driving eastbound on Sutter Avenue shortly after 10 p.m. when his car collided with an auto heading northbound on 80th Street, cops said. The jarring impact sent both vehicles into parked cars.

After firefighters cut Lovelace-Loney out of his sedan, emergency medical service personnel rushed him to Jamaica Hospital Medical Center, where he later died. The other driver, 21, suffered minor injuries.

Residents who live near the crash site said the intersection is notoriously dangerous.

“There’s been so many accidents here. I don’t even let the kids play out in the front,” Rondel Boodram told CBS New York. “My wife has petitioned to get a four-way stop sign and nothing, so we’re hoping this tragic event helps us get a stop sign or stoplight here. It’s crazy.”

On Sunday morning, City Councilman Eric Ulrich (R-Ozone Park) called the accident “every parent’s worst nightmare,” and indicated that he would be meeting with officials from the City Department of Transportation and 106th Precinct this week “to see if there is any way to make this intersection safer.”

Cuomo Announces Ramp-Up of Charter and Tour Bus Inspections across State

By Michael V. Cusenza Governor Andrew Cuomo this week announced a multi-agency enforcement initiative to target potentially illegal interstate charter and tour bus companies operating in New York.

Cuomo said he directed the State Department of Transportation, Department of Motor Vehicles and State Police to increase the frequency of random roadside inspections of interstate charter and tour buses to protect visitors and travelers, especially during the holiday season, and prevent fraudulent companies from operating in the Empire State.

“This enforcement effort will help take these illegal and unsafe buses off New York roads, protecting the health and safety of passengers and motorists alike,” Cuomo said, adding that the surge in inspections over the past two months has already resulted in 112 unsafe buses and 96 unqualified drivers being taken off the road. “With this multiagency operation, we are cracking down on these bad actors and seeking to give travelers a peace of mind as they book their trips this holiday season.”

According to the administration, since mid-September, NYSDOT investigators and State Police have performed 1,115 roadside bus inspections across the state, including 274 in the five boroughs.

During roadside inspections, drivers’ licenses and credentials are verified and log books are checked for accuracy; bus components such as fuel systems; brakes, wheels and tires; lighting devices; steering mechanisms;

exhaust systems; and the bus body, including the structural integrity of the chassis/frame, are inspected to ensure safe operations.

According to the State, the most common out-of-service violations cited for drivers were: not being medically qualified; not being properly licensed; not having log book filled out.

The most common out-of-service violations for the company/vehicle were: seating capacity exceeds manufacturer’s seating capacity; emergency exit violations; not having the proper operating authority.

The State indicated that all out-of-service defects must be resolved before the operator and/or vehicle can resume operations. In addition, inspection results are uploaded to a federal database and both federal and State officials use the roadside data to target poorperforming companies for further enforcement action.

“These targeted inspections ordered by Gov. Cuomo are enhancing safety on New York’s roads and getting dangerous drivers off the street so residents, visitors, and tourists can travel with ease during the upcoming holiday season,” said NYSDOT Acting Commissioner Paul Karas. “New York already has one of the most rigorous and aggressive commercial vehicle inspection programs in the nation and additional roadside inspections help build upon our previous successes.”

With Housing NY 2.0, City Sets Sights on Building, Preserving 300K Affordable Homes

Mayor Bill de Blasio recently released the City’s “Housing New York 2.0” plan, laying out new tools and programs to build and preserve affordable homes for 300,000 Gotham families by 2026 – up from the previously announced goal of 200,000 homes by 2024.

According to the administration, under the accelerated and expanded plan, the City will boost the number of affordable homes for seniors and families to 25,000 per year, while also increasing resources and strategies for affordable homeownership programs and not-for-profit organizations purchasing rent-regulated buildings to preserve affordability. The resources and strategies actually will help create 200,000 affordable homes two years ahead of schedule—by 2022—de Blasio said.

According to the Hizzoner, since the original Housing New York initiative launched in 2014, the City has: financed the creation or preservation of affordable homes for more than 78,000 households across the five boroughs; tripled the share of affordable housing for households earning less than $25,000; and doubled funding for housing construction and preservation.

• Protect affordability at MitchellLama buildings, which represent some of the last already existing affordable homeowner-

ship opportunities.

• Unlock affordable homeownership to help low- and moderate-income New Yorkers build equity, improve the quality of their homes, and stabilize city neighborhoods by financing construction of co-operatives and condominiums for first-time home buyers and by offering home-repair loans.

• Unlock the potential of vacant lots long considered too small or irregular for traditional housing with innovative smaller homes, and develop more affordable hous-

ing on lots long used for parking at existing Mitchell-Lama and federally regulated senior affordable housing complexes.

• Capitalize on advances in technology and innovative design to expand modular building and micro-units that can lower the cost of construction, build new homes faster, and respond to the city’s changing demographics.

“I am pleased that the City’s new opendoor financing program will promote the construction of cooperative and condominium buildings,” said City Councilman Barry Grodenchik (D-Oakland Gardens), a member of the Council committees on Land Use and Housing and Buildings. “Representing tens of thousands of residents of co-operative and condominium housing units, I know that co-operative and condominium housing can make the dream of home ownership a reality for New Yorkers. At the same time, the home fix program will help New Yorkers stay in their homes by providing financing for necessary repairs; I worked on a similar program in the Queens borough president’s office and saw how impactful it was.”

De Blasio noted that HNY 2.0 requires an additional $150 million per year in the current four-year financial plan, bringing the City’s investment in achieving the 100,000 more homes – or 300,000 total homes – to about $1.3 billion per year over the next nine years.

EDITORIAL TRULY THANKFUL As we approach yet another holiday season, it’s easy to feel overwhelmed, even defeated.

It’s hard to see a way to get everything cleaned, prepared, purchased, wrapped, cooked, basted, hung or made on time, especially in an economy like this one. Makes it pretty hard to get excited about the “fun” season of rushing around slated for December.

While it may once have been a fairly peaceful, slightly larger than average family meal, Thanksgiving seems to have become the starting line for a full month of hardcore holiday festivities. We start shopping within a few hours of the Thanksgiving feast. By the time the dishes are clean, the Christmas tree should be up. Once that’s done, we need to do some more shopping, bake cookies, reconnect with anyone we’ve ever been fond of, water the tree, send out cards – wait, it’s already January?

But, allegedly, that’s not what Thanksgiving is supposed to be about. In all the
