First passed in 1994, the Violence Against Women Act was set to expire on Sunday. Citing the midterm elections, Congress was able to extend the life of the law through Dec. 7 via a stopgap spending bill. However, organizations such as WBASNY are urging the House and Senate to approve the long-term coverage provided by the 2018 VAWA Reauthorization Act. According to WBASNY, the reauthorization also contains housing provisions that “are particularly important for improving the safety of survivors fleeing abuse.” It would ensure that victims cannot be evicted or denied housing based on the criminal activity of their abusers; would prohibit housing discrimination against victims of domestic violence, enabling victims to maintain safe housing through emergency transfers and vouchers; and would guarantee survivors the right to seek help from law enforcement or emergency assistance without retaliation.

EDC officials indicated that the alliance will complement FreightNYC, the City’s plan to overhaul the Big Apple’s aging freight-distribution systems through investments to modernize maritime and rail assets and establish new distribution facilities. FreightNYC promises to create nearly 5,000 goodpaying jobs and a more sustainable and resilient supply chain network, Mayor Bill de Blasio said in July when he unveiled the initiative.

“Investments in barging and the creation of a northeast barge council will ensure that the shift to barging from trucking is an effective and inclusive process that benefits all New Yorkers,” City Councilman Paul Vallone (D-Bayside), chairman of the Committee on Economic Development, said on Friday.

In a conversation immediately before press time, Senator Joseph Addabbo told The Forum that an answer to the pigeon problem at the 84th Street underpass is on the way.

Under consideration to prevent the health hazards and unsanitary conditions as a result of the pigeon population in the area, are two possible plans of action. Boards which prevent the birds from landing and nesting used in other locations with similar conditions, may not be viable due to the wide width of the sidewalk at the site. Addabbo says that the second alternative is netting.

Spikes, considered to be an inhumane solution and which actually aid the pigeons in building their nests, are not a consideration.

“I want residents to know that help is on the way,” said Addabbo. “Please understand that this is a personal priority of mine and that it will be taken care of.

It’s getting done no matter what.”

The senator noted that while he cannot pin down an exact date, due to the need to coordinate efforts between all agencies involved, residents can count on [the problem] being addressed in the quickest fashion possible.

City Council Approves Legislation to Establish Jamaica Bay Task Force

By Michael V. Cusenza The City Council recently approved a legislative package that includes a bill to establish the Jamaica Bay Task Force.

According to the council, Introduction 750-A would create the body to provide advice and recommendations to the City regarding the cleanup of Jamaica Bay and its resiliency. The duties of the task force will include a review of measures proposed to restore and maintain the water quality and ecological integrity of the bay and an analysis of the impacts of sea-level rise on the bay and the surrounding watershed, including the underground aquifer and groundwater service area.

The environmental protection package includes two other pieces of legislation. Introduction 628-A would require the City to create a map of the areas of the city that are most vulnerable to flooding due to the anticipated impacts of climate change and sea level rise. This local law would also require the City to create a mitigation plan to address the flooding. The initial map would be prepared by 2020 and subsequent maps would need to be prepared no later than April 22, 2023 and no later than every

process by which excess groundwater is removed from the lower levels of existing buildings to facilitate building operations. The bill would also require the City to study the efficiency and efficacy of existing geothermal systems in City buildings.

Stringer Calls for Major Revision of City Charter

By Forum Staff As the 2019 City Charter Revision Commission last week kicked off its initial public hearings, Comptroller Scott Stringer released a new report detailing 65 recommended changes—many of them significant—to the governing document that is often referred to as NYC’s constitution.

Among the proposals in “A New Charter to Confront New Challenges,” Stringer is calling for a Chief Diversity Officer in every City agency, giving greater urban planning expertise to community boards, strengthening building-code enforcement, and establishing procurement timeframes. It also covers topics such as cybersecurity, adopting instant runoff voting, strengthening services for children citywide, and strengthening the campaign finance system, among others.

The comptroller’s analysis is organized in three sections: Creating a Fairer, More Equitable New York; Building a 21st Century Government; and Demanding Accountability & Transparency.

In the first section, Stringer outlines one of the primary recommendations of the report: the creation of the Chief Diversity Officer position inside the mayor’s cabinet and within each City agency, a role tasked with

overseeing minority and women business enterprise programs, tracking and measuring diverse talent, and encouraging M/WBEs to bid on city contracts.

“We’ve seen firsthand in the Comptroller’s Office that a Chief Diversity Officer helps break down walls and transform how agencies invest in city businesses with an eye toward equity,” Stringer noted. “Without this position, we perpetuate a system that fails to build wealth in communities that have historically been left behind.”

The comptroller focuses on construction in the five boroughs in the second section of his report. In it he proposes creating a new Office of Inspection, which will be responsible for all building and housing inspection and remediation. Such responsibilities should be removed from the Department of Buildings and Housing Preservation and Development so that they can focus more on their other respective responsibilities.

And in the Demanding Accountability & Transparency section, Stringer suggests: structuring the capital budget to allow the public to identify and understand the cost of individual capital projects; providing better and more comprehensive information about the condition of capital assets; and reporting on the changes in the cost and status of capital projects.

“Since the last major charter revision nearly 30 years ago, New York City has grown by 1.2 million people and the world has changed around it, yet its charter is not prepared to meet the needs of today’s challenges,” Stringer said. “The Charter Revision Commission is an opportunity for us to build a better government that takes aim at our affordability crisis and builds a fairer city by giving a voice to New Yorkers.”

The executive director of the LPC since 2014, Carroll succeeds Meenakshi Srinivasan, who tendered her resignation in April.

“Having dedicated my career to protecting the heritage of the city I love, it is a dream realized and an incredible honor to be appointed by the mayor and entrusted by the [City] Council to lead the commission,” Carroll said.

“I look forward to continuing to work with the commissioners and staff to preserve and celebrate sites that reflect the diversity and rich history of our city and to partnering with property owners, elected officials, preservationists, and communities to ensure these sites remain relevant for generations to come.”

The commission is tasked with preserving and protecting the city’s architecturally, historically, and culturally significant buildings and sites.

“The next head of the Landmarks Preservation Commission should be someone who truly understands and value of preserva-

tion and I believe that we have that in Sarah Carroll,” said City Councilwoman Adrienne Adams (D-Jamaica), chairwoman of the Subcommittee on Landmarks, Public Siting, and Maritime Uses. “I look forward to working with Ms. Carroll and believe that she will help us to preserve the character and the special history of New York.”

Carroll, who earned a bachelor’s degree in art history at Bates College and a master of fine arts degree from the Savannah College of Art & Design, has been characterized as a “life-long preservationist” with more than 20 years of professional experience protecting historic resources in the Big Apple. The NYC native started her career at LPC, where she has served in various capacities over the past 24 years.

Prior to her tenure as executive director, Carroll was the LPC’s director of Preservation.

In that role, she led the creation of the agency’s first comprehensive instructional manual on how to file permit applications; created the FasTrack permit process to expedite applications for certain work types; and developed historic district master plans and rules to allow applicants to more easily navigate LPC’s regulatory process.

One Dead after Waves Wipe Fishermen off Jetty

A pair of fishermen was swept off a Breezy Point jetty on Saturday.

Good Samaritan boaters managed to pull one of the men onto their vessel where he received medical attention from firefighters. Both were rushed to the pier at Kingsborough Community College, then transported to Coney Island Hospital.

“We received a call for two people in the water. When we arrived on scene, one individual was on a civilian boat already.

The second person was still in the water, but the good Samaritans were holding onto them to stop them from drowning,” said FDNY Lt. Steve Szewczyk. “We secured the individual in the water on a board and had the civilians hold them while we began treating the individual on the boat. NYPD arrived on scene and dropped two divers in to help get the person out of the water. EMS took over care once we brought them back to land.”

The identities of both men were not made public.

Homeless Man Attacks Woodhaven Mom: Police

Cops on Tuesday caught up to the homeless man who allegedly beat a woman unconscious before snatching her purse—all in front of her toddler son on a Woodhaven street.

According to the NYPD, Derrick Chirse, 57, was arrested Tuesday afternoon at an East Flatbush, Brooklyn shelter. Police said the victim, 35, and her 4-year-old boy were walking on 84th Street near Atlantic Avenue on Monday around 2 p.m. when Chirse allegedly approached her and demanded the purse.

Before she could react, Chirse allegedly punched the woman four times in the face and head until she passed out. He then bolted, purse in hand, up 84th Street while several good Samaritans gave chase.

The victim and her son were taken to Jamaica Hospital Medical Center. The boy was not physically harmed, cops said.

In a word: Wow. Here’s how correspondent Bill Whitaker described the subject of the first story of Sunday’s broadcast: “In the annals of ‘60 Minutes,’ we have rarely come across a doctor like Florida physician Barry Schultz.”

Think about that. 50 years of reporting around the world. Schultz must be quite impressive, right?

We wouldn’t exactly go with impressive.

In July, Schultz was sentenced to 157 YEARS in prison for pushing pain-killing pills on people at an astronomical rate. Look at these numbers: U.S. Drug Enforcement Administration records indicate that one of Schultz’s patients was prescribed nearly 17,000 potent oxycodone pills in a seven-month period; another got more than 23,000 over eight months.

Do the math: That’s more than 100 pills a day.

At one point, Schultz even prescribed 1,000 painkillers to a pregnant woman.

The men allegedly used the instant messaging mobile application KIK to share images of children as young as 1 engaging in various sexual acts.

61 counts of promoting a sexual performance by a child and possessing a sexual performance by a child and one-count of fifthdegree conspiracy. The defendant was held on $10,000 bail and to return to court on October 9, 2018.

If convicted, he faces up to fifteen years in prison.

According to the complaint, investigators assigned to the New York City Police Department’s

Computer Crimes Squad originally investigated a cybertip report from the National Center for Missing and Exploited Children that a Queens man, who was later apprehended, had uploaded images of child pornography to his Google account in 2016. During this wide-ranging investigation law enforcement seized in excess of 5,000 illicit images and videos of minors from the home of that apprehended individual.

The individual, who admitted to knowingly possessing and sharing the data, used his cell phone to trade these images with defendant Gallardo. One of the items recovered from the apprehended other’s cell phone was a conversation from a “KIK” chat that he had with defendant Gallardo, which took place between September 23, 2016, and October 27, 2016.

ing in various sexual acts.

In one specific chat occurring on October 27, 2016, the men discussed their actions. The apprehended male followed up this exchange by sending images containing child abuse images, and asked Gallardo to trade. Gallardo promptly sent the apprehended other an image of a female child who appeared no older than eight engaging in a sexual act with an adult male.

In June 2018, detectives traced the KIK records related to the 2016 exchange to an IP address, and subsequently to the defendant’s place of residence. When confronted by law enforcement officials, the defendant admitted to using KIK to swap pornographic images with the apprehended male and identified the above-referenced photo of the female child.

Law enforcement officials obtained the defendant’s permission to perform a forensic examination on electronic items that were later confiscated from the defendant’s home, including his iPhone and iPad, which resulted in the discovery of dozens of additional images of child pornography.

NY AG Applauds $148 M Uber Settlement

By Forum Staff Ride sharing company Uber Technologies, Inc. recently reached a deal with all 50 states and the District of Columbia that requires Uber to pay a record penalty of $148 million to settle allegations that it intentionally concealed a 2016 data breach in violation of state data breach notification laws, according to New York Attorney General Barbara Underwood.

The pact also requires Uber to adopt model data breach notification and data security practices and a corporate integrity program for employees to report unethical behavior, and hire an independent third party to assess its data security practices, Underwood noted.

Two years ago, hackers based in the U.S. and Canada secretly informed security officials at Uber that they had downloaded the personal information of 57 million riders and drivers, 25 million of whom were in the U.S. and 7.7 million of whom were drivers. The information stolen included names, email addresses, and mobile phone numbers; drivers’ license information pertaining to approximately 600,000 drivers nationwide was also stolen. After providing proof of the massive data breach, the hackers demanded “six figures” to delete the data and not disclose the breach. Uber ultimately paid the hackers $100,000 to conceal the attack.

In the spring of 2017, Uber’s Board of Directors directed a law firm to investigate Uber’s security team in the wake of unrelated litigation involving the alleged theft of trade secrets related to self-driving cars.

As part of this inquiry, the law firm learned of the breach and ransom payment. Upon learning of the breach, the board hired a forensic firm to investigate it. Uber ultimately provided notice of the breach in late No-

vember 2017, a year after it occurred.

Underwood pointed out that general business law requires companies that experience a breach involving certain personal information, including driver’s license numbers, to provide notice “in the most expedient time possible and without unreasonable delay.” By intentionally concealing the breach and failing to disclose it for a year, Uber violated the law, Underwood said.

The settlement between the Empire State and Uber requires the company to fork over $5.1 million and: • Comply with New York’s data breach and consumer protection laws regarding protecting residents’ personal information and notifying them in the event of a breach concerning their personal information; • Take precautions to protect any user data Uber stores on third-party platforms outside of Uber; • Use strong password policies for its employees to gain access to the Uber network; • Develop and implement a strong overall data security policy for all data that Uber collects about its users; • Hire an outside qualified party to assess Uber’s data security efforts on a regular basis and draft a report with any recommended security improvements. Uber will implement any such security improvement recommendations; and • Develop and implement a corporate integrity program to ensure that Uber employees can report any ethics concerns they have about any other Uber employees to the company.

“This record settlement should send a clear message: we have zero tolerance for those who skirt the law and leave consumer and employee information vulnerable to exploitation,” Underwood added.

GETTING READY FOR WINTER Part Two-Keeping Bugs Away Last week, we talked about the flu shot and how your pharmacist can help you avoid getting laid up with the bug nobody wants to get.

But lesser germs than the flu can cause just as much discomfort and your pharmacist is just the person to help you steer clear of many of the germs of winter.

To begin with, germs are much better off if they are contained and disposed of quickly.

THe first bit of comon sense fRom your pharmacist is : DON'T PASS IT ON! CATCH IT-- Germs spread easily. Always carry tissues and use them to catch your cough or sneeze.

FIND THE GARBAGE PAIL--Germs can live for several hours on tissues. Dispose of your tissue as soon as possible.

KILL IT--Hands can transfer germs to every surface you touch. Clean your hands as soon as you can.

If you are feeling a little under the weather, try to rest, eat well, avoid stress and keep hydrated. If you have a fever, you may need extra fluids. Your pharmacist may reccomend ibuprofen and/or aspirin to treat fever and pain, or they may suggest that you inhale steam with a decongestant in to help clear a blocked nose.

Cold and flu medicines are among the top

sellers in phamacies during the winter. Some of the remedies combine painkillers with decongestants, which can help to manage symptoms, and can really help you manage a cold.

There are some benefits, particularly for children, in catching a few coughs and colds.

In fact, children get a lot more colds than adults becasue their bodies are still building immunities. They can also be treated using some over-the-counter painkillers, to ease discomfort and help bring down a fever. Both acitomeniphen and ibuprofen are available as a liquid for children, and can be given from the age of about three months. Always check with your doctor if you aren’t sure which treatments you can give your child.

While most bugs will run their course without doing any real harm, you or your child should see a doctor if you or your child have a chronic condition – such as asthma, diabetes or heart disease or a very high temperature and feel ill. If your child stops drinking and is unusually lethargicor if thier fever doesn’t respond to acetomenphin or ibuprofen Babies, as well as older and frailer people, should get help if they're unwell.

Borough Figures Impact Kavanaugh Hearings, Vote

By Michael V. Cusenza For at least a few minutes on Friday, President Donald Trump wasn’t the most famous figure in the nation’s capital with a connection to Queens.

That’s because Astoria resident Ana Maria Archila decided to confront U.S. Sen. Jeff Flake (R-Ariz.) regarding his announcement that morning that he would vote to confirm embattled Judge Brett Kavanaugh for the Supreme Court seat left vacant after Justice Anthony Kennedy retired in July. Archila, 39, and another woman went to Flake’s office in the Senate Russell Office Building where they learned of his decision.

“Yesterday, we heard compelling testimony from Dr. Ford, as well as a persuasive response from Judge Kavanaugh… I left the hearing yesterday with as much doubt as certainty,” Flake said in a statement released Friday morning. “What I do know is that our system of justice affords a presumption of innocence to the accused, absent corroborating evidence. That is what binds us to the rule of law. While some may argue that a different standard should apply regarding the Senate’s advice and consent responsibilities, I believe that the constitution’s provisions of fairness and due process apply here as well. I will vote to confirm Judge Kavanaugh.”

After reading the statement, the two women cornered the senator in a nearby el-

evator. Video of the confrontation quickly went viral.

“I have two children. I cannot imagine that for the next 50 years, they will have to have someone in the Supreme Court who has been accused of violating a young girl,” an anguished Archila said to a visibly uncomfortable Flake. “Look at me when I’m talking to you. You’re telling me that my assault doesn’t matter. That what happened to me doesn’t matter. And that you’re going to let people that do these things into power.

That’s what you’re telling me when you vote for him.”

Several hours later, Flake indicated that his vote would be conditional upon an FBI investigation of the claims against Kavanaugh.

Also on Friday, three female members of Congress who represent Queens communities marched from the steps of the U.S. Capitol to the Senate Judiciary Committee hearing room to protest the panel’s vote on Kavanaugh.

“The committee’s rush to vote without an investigation, and without hearing from all the witnesses, will go down as a dark and shameful day in our nation’s history,” said Rep. Queens DA Richard Brown stands amid more than $200,000 in cash and with just a fraction of the thousands of packs of untaxed cigarettes seized following the arrests of a eight individuals, who allegedly ran a complex cigarette smuggling ring that stretched from Virginia and Maryland into Queens, Brooklyn, and Long Island.

By Forum Staff Eight defendants,including two fathers and their sons, have been arrested for their connection in an illegal cigarette ring in which over 150,000 counterfeit tax stamps and nearly 63,000packs of cigarettes were siezed.

The defendants are from Queens, Long Island, Brooklyn and Virginia and have been charged with grand larceny, conspiracy and other crimes for allegedly operating a complex multi-state cigarette smuggling ring.

District Attorney Brown said, “The defendants in this case are modern-day bootleggers… This smuggling ring raked in millions of dollars at the expense of New Yorkers. Purchasing cheaper cigarettes from out of state and applying counterfeit tax stamps on them cheats both the state and city out of much-needed tax revenue.”

The defendants were identified as Nicholas Galafano, 56, of 248thSt. in LittleNeck, Queens, his sons YaseenGalafano, 22, and Musa Galafano, 25, also of 248thSt. in Little Neck, Queens; Ahmad Abualrub, 61, and his son Hassan Abualrub, 18, both of Brighton 3rd Street in Brooklyn; BeatriceVillafane, 46, of Meadowbrook Road in Hempstead, Long Island; NasirJafri, 43, of Giselle Court in Chantilly, Virginia; and Lisa Penda, 33, of Elk Street in Hempstead, Long Island.

All eight are charged in multiple criminal complaints with second-degree grand larceny, a cigarette and tobacco products

tax law felony, second-degree criminal possession of a forged instrument and fourth-degree conspiracy, and were before Queens Criminal Court Judge Toni Cimino, who released them on their own recognizance and ordering a return to court on November 27, 2018.

If convicted, the defendants face between 8 to 30 years in prison.

According to the criminal charges, a long-term investigation, which included court-authorized search warrants, grand jury subpoenas and other investigative tools, uncovered a multi-state conspiracy to smuggle cigarettes purchased in Virginia, transported to New York and then resold with counterfeit New York State tax stamps.

The defendants stole nearly $1 million in taxes that would have been collected if the cigarettes had been sold with the appropriate and legal tax stamps.

In 2018 alone,Jafri is alleged to have purchased more than 37,000 cartons of cigarettes from big box stores in Virginia and Maryland. The cigarettes were then allegedly driven into New York and sold to Nicholas Galafano.

Defendants Ahmad and Hassan Abualrub allegedly purchased the non-New York taxed cigarettes from Nicholas Galafano and transported them to Brooklyn where they sold the cigarettes to their customers in both Brooklyn and Queens.
