National Violent Crime Decreases Slightly: FBI

By Michael V. Cusenza Overall violent crime, which covers murder and non-negligent manslaughter, rape, robbery, and aggravated assault, declined 0.2 percent in 2017 when compared with 2016 data, according to the Federal Bureau of Investigation’s annual compilation of crime statistics released on Monday.

The information in “Crime in the United States, 2017” was presented to the agency’s Uniform Crime Reporting Program by more than 16,000 law enforcement agencies across the country.

According to the national offense analysis, there were more than 1.2 million violent crimes reported to UCR nationwide in 2017. There was a 0.7-percent decrease in murders and a 4-percent decrease in robberies from 2016 to 2017.

However, there were an estimated 135,755 rapes reported to law enforcement in 2017. This estimate was 2.5 percent higher than the 2016 estimate, and 19.4 percent higher than the 2013 estimate.

Other violent crime highlights in this year’s FBI report: • When considering fiveand 10-year trends, the 2017 estimated violent crime total was 6.8

• There were an estimated 382.9 violent crimes per 100,000 inhabitants in 2017, a rate that fell 0.9 percent when compared with the 2016 estimated violent crime rate, and dropped 16.5 percent from the 2008 estimate.

• Aggravated assaults accounted for 65 percent of violent crimes reported to law enforce-

ment last year. Robbery offenses accounted for 25.6 percent of violent crime offenses; rape accounted for 8 percent; and murder accounted for 1.4 percent.

• Information collected regarding types of weapons used in violent crime showed that firearms were used in 72.6 percent of the nation’s murders, 40.6 percent of robberies, and 26.3 percent of aggravated assaults.

Property crime, which includes burglary, larceny-theft, motor vehicle theft, and arson, also declined—3 percent—from 2016 to last year. According to the report, there were more than 7.7 million property crimes in 2017.

Burglaries decreased 7.6 percent and larceny-thefts decreased 2.2 percent. However, motor vehicle thefts increased 0.8 percent from 2016 to 2017.

The “Crime in the United States, 2017” property offense overview: • The 10-year trend showed that property crimes decreased 21.3 percent in 2017 when compared with the 2008 estimate.

• In 2017, the rate of property crime was estimated at 2,362.2 per 100,000 inhabitants, a 3.6-percent decrease when compared with the 2016 estimated rate. The 2017 property crime rate was 13.6 percent less than the 2013 estimate and 26.5 percent less than the 2008 estimate.

• Larceny-theft accounted for 71.7 percent of all property crimes in 2017. Burglary accounted for 18.2 percent, and motor vehicle theft for 10 percent.

• Property crimes in 2017 resulted in losses estimated at a staggering $15.3 billion.

“We want to have greater transparency and accountability in policing. One way to get there is by improving the data,” said FBI Director Chris Wray. “That data will give us a more complete picture of what’s really going on in our communities and allow us to do what we need to do to keep people safe.”

State AG Sues Student Loan Debt-Relief Companies

By Forum Staff Nine student loan debt-relief companies, their financing firm, and two individuals with leadership roles in several of the companies are being sued for allegedly fraudulently, deceptively, and illegally advertising, marketing, offering for sale, selling, and financing student debt-relief services to consumers nationwide, including thousands of New Yorkers, according to State Attorney General Barbara Underwood, who filed the suit on Thursday.

The student loan debt-relief companies named in the lawsuit are Debt Resolve, Inc.; Hutton Ventures, LLC; Progress Advocates, LLC; Progress Advocates Group, LLC; Student Advocates, LLC; Student Advocates Group, LLC; Student Advocates Team, LLC; Student Loan Care, LLC; and Student Loan Support LLC. Debt Resolve, Inc., a New York company, is the majority owner of two of the other student loan debt relief entities. The two named individuals are Bruce Bellmare and Stanley Freimuth, the current and past CEOs of Debt Resolve, Inc. The financing company named in the lawsuit is Equitable Acceptance Corporation.

front fees and/or usurious interest rates.

The defendants typically charge a consumer more than $1,000 for their services, which are available for free through the federal government or the consumer’s student loan servicer, according to the complaint.

Additionally, the suit alleges, the defendants then rely on “Student Loan Advisors” to sell student loan debt-relief agreements to consumers by phone. Despite holding themselves out as being knowledgeable

about student loans, the so-called Student Loan Advisors are in reality telemarketers with no specialized experience or expertise, who sell virtually identical student loan debt-relief agreements to borrowers using the same sales scripts and pitches.

Student Loan Advisors repeatedly make false and deceptive misrepresentations to consumers such as: • telling borrowers that they are from the federal government, are a part of the

federal student loan program, are working with the federal student loan program, or are working with a federal student loan servicer – when in fact, they are not affiliated with the federal government or student loan servicers; • telling borrowers that they cannot enroll in the debt-relief services offered on their own – when in fact, borrowers can work directly with their servicers or use the Department of Education website to obtain student loan debt-relief services at no additional cost; and • telling borrowers that they can eliminate their student loan debt by making a number of payments to one of the defendants – when in fact, making these payments will not reduce, let alone eliminate, their student loan debt.

The lawsuit seeks injunctive relief, a declaration that defendants’ contracts with borrowers are null and void, restitution, damages, disgorgement, penalties, and costs.

New Yorkers’ student loan debt is estimated at $86.54 billion, according to a 2017 Consumer Financial Protection Bureau report. The U.S. DOE estimates that 92-percent of all outstanding student loans are federal student loans.

The senator speaks from experience. In 2016, Addabbo collaborated with the State DOT to resolve an issue of excessive pigeon waste at the underpass along 80th Street under the Long Island Expressway in Middle Village. After studying the location, the agency placed wooden boards underneath the roadway to prevent pigeons from congregating.

He will have some help. According to City Councilman Eric Ulrich (R-Ozone Park), the Wildcat Service Corporation staff is set to clean the area—with power washers—by Friday, Sept. 28. Additionally, Ulrich has expressed his desire to install a mural dedicated to military veterans on the west side wall of the underpass.

Property Crimes on the Rise in Howard Beach: Cops damaging cars—breaking windows, etc.—to gain access and pilfer items of value.

“Please just take your belongings with you when you leave your car,” Bohannon said.

The commander also cautioned that thefts of tires and rims, especially those on new model Honda Accords and Infiniti autos, are slightly on the uptick. Bohannon pledged to tackle the issue, noting that his officers have been coordinating lately with the department’s Auto Crimes Division.

A Queens community responder recruiting for City Community Emergency Response Teams was another featured speaker at Tuesday’s meeting.

The CERT program, which started in 2003, is composed of volunteers that receive

training from a number of the city’s elite emergency first responders. After completing training, CERT volunteers support their local communities by assisting City agencies that prepare for and respond to emergencies.

Howard Beach resident Sincede Savoca, who completed the CERT volunteer training program in March, said Superstorm Sandy and its aftermath inspired her to join the Queens team.

“When you’re not prepared for an emergency, you feel lost,” Savoca said.

By Michael V. Cusenza Crime in the 106th Precinct has ticked up over the last four weeks, with property crimes—auto-related offenses, specifically— leading the way, according to the command’s top cop and the latest available City Police Department statistics.

“We’re not taking robberies, we’re not taking murders, thank God,” Deputy Inspector Brian Bohannon, the precinct’s commanding

officer, said on Tuesday at the Howard Beach Lindenwood Civic meeting. “But we are seeing property crimes.”

Overall crime is up 13 percent compared to the same 28-day period last year. Both grand larceny and grand larceny auto have jumped 25 percent.

According to federal prosecutors, Kingsley created the bomb that killed George Wray outside his Springfield Gardens home in July 2017.

By Forum Staff A Brooklyn man who was arrested earlier this year for a package bomb that killed a Springfield Gardens resident outside his home in July 2017 has been indicted on a new charge, federal prosecutors recently announced.

A grand jury returned a superseding indictment against Victor Kingsley, 37, adding a charge of attempted use of a weapon of mass destruction based on a fully assembled explosive device that police found in his apartment when he was arrested for the Springfield Gardens incident in February.

According to charging documents, Kingsley built the explosive device used in the July 28, 2017 murder as part of his broader effort to retaliate violently against several officers who were part of a City Police Department unit that had arrested him in January 2014. Despite the 2014 arrest eventually resulting in the dismissal

of charges, Kingsley sought revenge against the officers. Ultimately, he arranged for the explosive device to be placed outside of 222nd Street residence where Kingsley mistakenly believed one of his target officers resided. The building owner, George Wray, 73, inadvertently detonated the device when he tried to open it. He succumbed to his injuries four days later.

Kingsley continued to acquire explosive device parts, according to federal officials. He was arrested at his Brooklyn residence on Feb. 28, 2018. During the search of his apartment, agents seized another fully assembled destructive device contained in a mailing tube identical to the one used for the July 2017 device, as well as large quantities of incendiary powder.

This additional destructive device is the basis for the new charge in the superseding indictment, prosecutors noted.

If convicted on all counts, Kingsley faces a maximum sentence of life in prison or death.

St. Francis Prep students have the opportunity to take advantage of the best classroom in the world – New York City.

But many Prep students have the opportunity to spend part of their summers around the world, not only soaking in the culture, heritage, and food of other countires, but also sharing their own talents and abilities.

The first of three Prep trips that travelled abroad this last summer was through the where students visited Spain, Portugal, and Morocco. In addition, students were able to appreciate the beautiful architecture, and different culture as well as learn a few phrases in the various languages they encountered.

pean Holocaust – Berlin, Warsaw, Prague, Krakow, Prague and Munich. The students visited the Holocaust camps of Auschwitz and Dachau.

The final trip was Prep’s Music department’s tour of England. The school’s Jazz Band, Singers, and Chamber Orchestra visited Oxford, Stratford-upon-Avon, Canterbury, and London.

In all, eighty three students and families were able to visit sites such as the Harry Potter Studios, Blenheim Palace, the birthplace of Sir Winston Churchill, Canterbury Cathedral, where Thomas Becket was martyred, and the Tower of London.

Additionally, the ensembles performed at the Stratford River Festival for an audience in the thousands.

Ulrich Calls for Student Discount Program

By Forum Staff The City Economic Development Corporation should offer students free and reduced NYC Ferry fares, Councilman Eric Ulrich (ROzone Park) wrote on Friday in a letter to EDC President James Patchett in which he urges the agency to adopt a student discount program similar to the one granted by the Metropolitan Transportation Authority.

“Since NYC Ferry’s launch last year, I have been approached by a number of constituents who have expressed the need for a student discount program,” Ulrich said, noting that only seniors and people with disabilities are eligible to receive reduced NYC Ferry fares.

The popular ferry system, which opened on May 1, 2017, is not integrated with MTA buses and trains. So families with students that rely on both ferry and MTA service to get to and

from school wind up paying two separate fares.

And that’s not fair, Ulrich added.

“New York City public schools are open 180 days per year. Families with students that currently depend on both NYC Ferry and MTA service are spending $990 more annually than those that rely solely on MTA service,” the councilman noted. “Oftentimes, the added financial burden deters students from utilizing the more efficient ferry service, adding an hour to their commute to save money.”

Ulrich said that he “wholeheartedly” believes that students “deserve” a discount.

“Nearly 30 percent of all New York City students are living below the poverty line,” the councilman noted. “Low-income families have greatly benefitted from the MTA’s program, which provides more than half-a-million students with free and/or discounted MetroCard rides during specific hours on weekdays.”

EDITORIAL You might have missed it, but this week Gov. Andrew Cuomo signed an important piece of legislation.

S8987A/A 11011-B adds acute pain management to the list of conditions for which medical marijuana can be recommended as an alternative to opioid use. The new law will also allow for substance use disorder treatment providers to recommend medical marijuana to help patients manage underlying pain that contributes to the abuse of substances such as opioids.

The measure will formalize into law the regulatory change that was implemented by the State Department of Health earlier this year that added opioid replacement and opioid use disorder to the existing list of conditions for which a patient can qualify for medical marijuana. In order to recommend medical marijuana for pain management, a registered practitioner must determine that the patient’s pain degrades health and functional capability, along with certain other requirements.

However, the new law has its detractors. The executive director of the New York Association of Alcoholism and Substance Abuse Providers, John Coppolla, characterized it as “misguided.”

“The use of medical marijuana as an alternative to FDA approved and

research supported addiction medicines (methadone, buprenorphine, naltrexone) will increase the risk of relapse and overdose,” Coppolla added. “Making medical marijuana available to treat addiction will have no meaningful impact on our effort to combat the pandemic of opioid overdose and addiction.”

“We know that medical marijuana can be a helpful alternative for a wide range of illnesses and conditions,” said Lt. Gov. Kathy Hochul. “By expanding the approved list, we are providing New Yorkers with new options, and preventing the danger that comes from opioid addiction.”

State Sen. George Amedore (RKingston), chairman of the Senate Standing Committee on Alcoholism and Substance Abuse, added, “When we look at solutions to help us combat the heroin and opioid epidemic, we must ensure prescribers and patients have

every resource and option at their disposal.”

We couldn’t agree more with Mr. Coppolla’s assessment of methadone and drugs like Suboxone—they’ve saved lives. But they’ve claimed them, too.

“Pragmatically, since it is now law, it is imperative that science and research are used to guide the regulatory infrastructure for implementation,” Coppolla said. “The NYS Department of Health must ensure that the public does not receive the message that medical marijuana is a suitable replacement for methadone, buprenorphine, or naltrexone for the treatment of opioid dependence. It is critical that funding be dedicated to educate physicians and treatment professionals about this new law as well as the public at large, so that we do not increase the likelihood of relapse and overdose.”

Science and research. More funding to educate doctors and addiction professionals. We agree with those observations as well.

There are no silver bullets out there, no panaceas without side effects. We just see this medical marijuana option as another arrow in our quiver in the fight for future generations.

South Queens Pharmacist Charged in Scheme to Defraud Medicare and Medicaid

By Forum Staff The owner of four South Queens pharmacies has been indicted for allegedly submitting millions of dollars in claims as part of a scheme to defraud Medicare and Medicaid, federal prosecutors announced on Monday.

According to the indictment, Aleah Mohammed, 33, also known as “Aleah Haniff,” was the owner and operator of Superdrugs Inc., Superdrugs I Inc., Superdrugs II Inc. and S&A Superdrugs II Inc., located in South Richmond Hill, South Ozone Park, and Jamaica.

“These investigations matter because the subjects are stealing money each and every one of us pays in taxes to fund these programs,” said FBI-NY Assistant Director-in-Charge Bill Sweeney.

“What adds insult to injury, defrauding the government and stealing money is rarely about anything more than spending money on frivolous things like pricy jewelry and fast cars. Our ultimate goal is to stop these fraudsters from wasting the millions they steal so it can go to the patients and taxpayers who depend on it.”

If convicted of health care fraud, Mohammed faces a maximum sentence of 10 years’ imprisonment.

According to the City, Love Your Block supports residents in transforming public spaces and engaging neighborhood volunteers to make local change. Twenty-five community groups will be selected as Love Your Block winners and rewarded a $1,000 grant, project management support, and City agency (Department of Environmental Protection, Department of Parks and Recreation, Department of Sanitation, and the Department of Transportation) services to improve their neighborhood, including pest control and removal; tree stewardship workshops; graffiti removal; repair of and installation of street signs and street lights; traffic safety surveys; and installation of bicycle racks, speed bumps, and more.

“NYC Service believes that volunteerism is a catalyst for civic engagement in New York City,” said NYC Chief Service Officer Paula Gavin. “Love Your Block supports residents to engage their neighbors and address local needs through service.

FLU SHOT BASICS: Part 1 More than 200,000 people are hospitalized and 36,000 people die from seasonal flu complications each year in the United States.

Speak to your local pharmacist about getting vaccinated early and take everyday precautions such as frequent hand washing, use of alcohol hand gels, and coughing into your upper sleeve or elbow.

Eighteen percent of adults got their flu shots from a pharmacist or at another community location during last year’s flu season, and officials expect that number to grow. Approximately 30 states now allow pharmacists to vaccinate children (usually within specified age limits)..

Remember if you got the shot last year and think you can take this year off, think again.

Unfortunately the vaccine fades after six to eight months, especially in kids.

And speaking of kids, specifically those with asthma, a recent study found that one in hree parents of children with asthma didn’t get their child vaccinated, mainly because of fears.

However, studies show that children with asthma who catch the flu have a higher risk of serious complications and are four times as likely to be hospitalized than children without asthma.

arrived on the scene, beside the FluMist nasal spray and the traditional shot, healthy adults ages 18 to 64 have a third vaccine choice: the Fluzone Intradermal vaccine. It has an ultrafine needle that is one tenth the size of traditional needles and inserted just a few millimeters into the skin.

Studies show it’s as safe and effective as the other options, but it creates less soreness at the injection site. What’s more important, it requires a much smaller amount of the vaccine, which could be essential in the event of a shortage. The intradermal vaccine has shown to provide an immune response similar to the regular flu shot given in the muscle to adults ages 18-64.

While staving off the flu is at the top of the list of winter health priorities, it’s not the only culprit of the season.

Common colds, coughs, congestion, allergies and other winter bugs can arrive at your proverbial doorstep and keep you under the weather fora long time. Next week we will talk about many things we can provide to help make this a better winter.

Cuomo Touts Continued Efforts to Raise Awareness of Dangers of Opioids, Synthetic Cannabinoids

By Forum Staff Governor Andrew Cuomo on Thursday announced continued efforts to raise awareness of the dangers of opioids—including fentanyl and synthetic marijuana.

As part of these efforts, a joint letter from the Commissioners of the State Education Department, Department of Health, and the Office of Alcoholism and Substance Abuse Services is being sent to school districts detailing the risks associated with these drugs and reminding them of the resources offered by the State to educate students and communities.

Injection drug use among high school students doubled from 2005 to 2015; and in 2017, more than 6 percent of high schoolers reported having used synthetic marijuana, according to the State. As use of these drugs among young people in New York continues to rise, Cuomo said he’s urging school districts to take action to address the ongoing crisis.

“We will continue to bolster our efforts to keep this poison out of the hands of our children,” the governor added, “and I encourage schools to join us in this fight by using the free resources available to them to keep students healthy and safe.”

Jamaica Man Sentenced to 35 Years in Prison in Teen Sex Exploitation Case

By Forum Staff A Jamaica man has been sentenced to 35 years’ incarceration and 10 years’ supervised release following his conviction in December 2017 for enticing a 16-year-old girl to travel from her native Australia to the U.S. to engage in sexual activity, federal prosecutors announced on Friday.

Sean Price, 40, was found guilty of four charges: interstate and foreign enticement to engage in sexual activity, interstate and foreign transportation of a minor to engage in sexual activity, a Mann Act violation and attempted sexual exploitation of a child.

According to court proceedings, in the fall of 2016, Price established an online relationship with a 16-yearold girl who lived in Australia. By January 2017, they were communicating with each other daily through messages on Facebook, with much of the discussion concerning Price’s desire to engage in sex with the girl, and how she could travel from Australia to join Price in New York City without law enforcement or her parents finding out. The Facebook chat messages demonstrated that Price openly discussed the girl’s age with her, and told her repeatedly that he wanted to be sexually intimate with her.

Price and the girl also discussed obtaining a fake passport so the girl could travel internationally, and he offered to impersonate the girl’s father to help her get through airport security in the United States. In chat messages, Price

After months of planning, Price wired the girl more than $900 to purchase a plane ticket to fly to Los Angeles in late March of 2017. Shortly afterwards, on April 11, the girl flew on a roundtrip ticket from Sydney, Australia to L.A., where Price was waiting for her arrival. Price hired a rental car, and drove across the country to his home in Jamaica.

According to prosecutors, Price admitted in a post-arrest statement that he and Jane Doe were involved sexually during their cross-country trip and while they were living in Queens until she was found by law enforcement in his home four weeks later. Following her successful recovery by officers of the City Police Department, Jane Doe was returned to her family in Australia. In a recent submission to the Court, Jane Doe’s mother recounted the trauma Jane Doe and her family continue to struggle with in the aftermath of Price’s actions.

Prosecutors also noted on Friday that restitution to Jane Doe’s guardians will be determined at a later date.
