LaGuardia Airport Contractor Charged with Prevailing Wage Theft

By Forum Staff A contractor has been arrested for allegedly underpaying 28 workers by more than $40,000 in wages and benefits for a publiclyfunded construction project at LaGuardia Airport, State Attorney General Barbara Underwood announced on Thursday.

Marjan Kasapinov and EMLO Corp. were arraigned on Thursday on charges of failure to pay the prevailing rate of wage or supplements, offering a false instrument for filing in the first degree, and failure to secure worker’s compensation insurance—all felonies. They were released on their own recognizance and ordered to return on Oct. 10.

According to the charges, Kasapinov, doing business as EMLO Corp. in Paterson, N.J., was contracted to perform asbestos removal work on several LaGuardia buildings between March 2014 and March 2015. Kasapinov, 63, is accused of allegedly submitting certified pay-

roll records – paperwork required to be filed with the Port Authority – that falsely listed the amount of money in wages and benefits paid to his workers, resulting in 28 construction workers being underpaid by $40,000. Kasapinov is also alleged to have failed to secure the required worker’s compensation insurance for

his company, even though asbestos removal work is hazardous.

“Companies doing business with municipalities, state agencies, and authorities are legally bound to pay their employees the fair and prevailing wage. In this case, the defendant chose to enrich himself at the expense of

his own workers,” said Port Authority Inspector General Michael Nestor. “Today’s arrest will serve notice to all contractors that the Port Authority of NY & NJ will not tolerate wage fraud or any other criminal misconduct on public projects.”

If convicted, Kasapinov faces up to 1 1/3 to 4 years in prison, prohibition from performing public work for five years, and payment of back wages to his employees.

“Contractors that corrupt public projects and fail to pay their workers will be held accountable,” Underwood said. “Workers deserve fair pay of the wages and benefits they’ve earned—not to be exploited by their employer.”

State Inspector General Catherine Leahy Scott added, “These charges should send a clear message that my law enforcement partners and I will not tolerate any business that tries to cheat the system, especially while putting their own employees at a disadvantage.”

Thirteen Borough Residents Charged with Smuggling $450M+ of Counterfeit Goods from China to U.S.

By Forum Staff Six indictments and a criminal complaint were unsealed in Brooklyn federal court on Thursday charging 22 people—13 from Queens—with illegally bringing into the U.S. millions of dollars of Chinese-manufactured goods by smuggling them through ports of entry on the East and West Coasts, according to prosecutors.

The charges include conspiracy to traffic, and trafficking, in counterfeit goods; conspiracy to smuggle, and smuggling, counterfeit goods into the U.S.; money laundering conspiracy; immigration fraud and unlawful procurement of naturalization. In addition, the government restrained nine real properties in Queens, Staten Island, and Brooklyn, belonging to the defendants, authorities noted.

They used “burner” phone numbers and “burner” email accounts—obtained by using false or incomplete information—in order to conceal their true identities. The counterfeit goods, according to federal prosecutors, were transported by trucks to self-storage facilities in Queens, Brooklyn, and Long Island, where the goods were unloaded and stored. Wong and others allegedly smuggled or attempted to smuggle 23 40-foot shipping containers into the country loaded with counterfeit items. The estimated Manufacturers’ Suggested Retail Price of these items, had they been genuine, would have been more than $450 million, government officials noted.

Feds File Complaint to Stop LIC Company from Selling Adulterated Seafood Products

By Forum Staff The United States has filed a civil complaint in federal court in Brooklyn against Foo Yuan Food Products Company, Inc. of Long Island City, its owner and President Hsing Chang, and its Secretary Susan Chang, seeking to permanently stop them from preparing and distributing adulterated seafood products in violation of federal law, Department of Justice officials announced on Monday.

According to the complaint, Foo Yuan prepare, pack, hold and distribute refrigerated and frozen ready-to-eat fish balls, fried fish cakes and fried fish balls. The U.S. alleges that Foo Yuan failed to adequately control the risk of Clostridium botulinum and Listeria monocytogenes (L. mono.) growth and toxin formation in susceptible fish and fishery products.

The complaint alleges that Foo Yuan vio-

lated the Federal Food, Drug, and Cosmetic Act by causing adulterated food to be introduced into interstate commerce or delivered for introduction into interstate commerce.

It also alleges that Foo Yuan further violated the law by causing food to become adulterated while it was being held for sale after the shipment of one or more of its components in interstate commerce.

“When food processors ignore federal laws concerning the preparation of food, they subject the public to serious health risks,” said Brooklyn U.S. Attorney Richard Donoghue.

“The Department of Justice has asked the court to stop the defendants from processing, packaging or distributing any more food until they establish that they can comply with federal laws and regulations designed to avert those health risks.”

Current Conditions, Future Plans for Lindenwood Lot Leave Neighbors Anxious

By Patricia Adams Residents living near 78th Street and 149th Avenue in Lindenwood seemed to be caught in the crossfire of a zoning war they say has brought their quality of life to an alltime low and is threatening their property value.

Speculation continues to swirl around developer Zannis Angelidakis’s intention for the property. Earlier this year, the City Department of Buildings issued a construction permit for a proposed four-story structure featuring 46 individual units and 30 parking spaces.

Rumors of plans focused on converting the vacant lot into a low-income housing complex sparked heated debates at community meetings and raised concerns in the neighborhood.

“Whatever he’s building is a concern of the future,” said one resident who spoke to The Forum on condition of anonymity. “But right now we are living with the filth he continues to dump on the property, and the rats and other vermin that have taken up residence in our homes and backyards due to his negligence.”

According to GallopNYC, by using therapeutic horsemanship, the trained staff help riders not only learn how to ride a horse, but develop life skills and build a bond with the horse.

Addabbo said he saw “firsthand the amazing work that GallopNYC does” when he visited the Forest Hills stable on Monday, Aug. 13.

“I saw children and adults excited to get on their horse and take it for a spin around the stable. I heard stories from volunteers about how GallopNYC helped them overcome their issues with physical ailments like multiple sclerosis,” the senator noted.

“For as long as I am in office I will not entertain any zoning change that would be detrimental to the community whatsoever,” the councilman said. “If the developer attempts to build something that would be bad for my constituents he’d better be prepared to deal with me.”

A source close to Angelidakis said the developer has pledged to not use the investment property for low-income housing.

The same source has offered to set up a meeting between this newspaper and the developer when Angelidakis returns from Greece in three weeks.

Autistic South Richmond Hill Teen Missing

Police recently reached out the public via social media for help in locating a non-verbal Autistic man last seen in South Richmond Hill early last week.

Detectives assigned to the 102nd Precinct noted that Bryan Rampersaud, 19, has been missing since Sunday, Aug. 12, around 6 p.m., when he was last seen in the vicinity of 101st Avenue and 114th Street wearing a red T-shirt and red shorts.

Byford Praises Plan that Will ‘Modernize MTA from Top to Bottom’

By Michael V. Cusenza Moments after riding the J line to York College’s Milton G. Bassin Performing Arts Center, New York City Transit President Andy Byford openly yearned for the day when the ancient R42 iron horse that carried him to Jamaica Tuesday evening is finally put out to pasture.

“It belongs on the scrap heap,” Byford deadpanned.

According to his recently released strategy to modernize the Metropolitan Transportation Authority subway and bus system, which he detailed and discussed on Tuesday at the agency’s first Fast Forward Plan town hall meeting, in just five years the scrap heap is exactly where you’ll find elderly R42s—and the previous manner in which the MTA served the city.

“I want to transform the culture so that it’s customerled. Everything we do is with you in mind,” an ebullient Byford said at the event that seemed to be equal parts intervention and promotion. “This is no mere tweak. Fast Forward is designed to turn around transit in this city—but it won’t be cheap and it won’t be easy. It’s a comprehensive modernization from top to bottom.”

And this operation is in desperate need of an overhaul, Byford said.

“The stark reality is that this great system finds itself in a state of emergency,” he added.

The role model for this revolution? The London Underground, according to Byford the Brit. He noted that the Tube was in a similar state of apocalyptic disarray 20 years ago. Now, it’s one of the best systems in the world.

• A state-of-the-art fleet of new subway cars and buses: Within five years, riders will be benefit from more than 650 new subway cars, more than 1,200 refurbished cars, and 2,800 new buses including 200 electric buses. Byford said that he has expressed a desire to achieve a fully electric bus fleet.

• A completely redesigned bus route network: The entire route network for local and express buses in the five boroughs is being re-evaluated and redesigned based on ridership patterns, road operating conditions and input from customers, route neighbors, advocates and others.

• Improving customer service and communication: The plan includes a new “Strategy and Customer Experience” division to ensure the interests of customers are considered in all decisions. Improvements include performance tracking dashboards, train and bus arrival info, wayfinders and roaming station agents. Within the next five years, screens will be installed in all stations and on more than 3,000 subway cars to provide real-time location-specific information, as well as a new mobile-friendly website and app launching this year. The quality assurance of public address systems in stations, on subway cars and on buses will be strengthened, Byford promised.

Council Leaders Demand more Info from Trump Administration on Families Awaiting Reunification

Cusenza City Council Speaker Corey Johnson and Councilman Carlos Menchaca (D-Brooklyn), chairman of the Immigration Committee, on Monday released an open letter to Trump administration officials appealing for more information on the status of families that have been affected by the administration’s family separation policy implemented earlier this year. According to the councilmen, the administration has yet to comply or provide any information on a plan to reunify the families, despite an order from a federal judge issued three weeks ago.

“We write to express our frustration and deep disappointment with the inhumanity and lack of transparency around the Trump administration’s ‘zero-tolerance’ policy, which remains in effect and resulted earlier this summer in the separation of families crossing the U.S. border,” Johnson and Menchaca wrote. “Although ‘family separation’ at the U.S.-Mexico border

OIf you thought that the Catholic priest sex abuse scandal was tucked in our collective rear-view mirror; that the most abominable, heinous atrocities visited upon victims had already been laid bare across every conceivable media platform years ago, news out of the Commonwealth of Pennsylvania last week has compelled us to think again.

Attorney General Josh Shapiro revealed the comprehensive—and revolting—findings of a statewide investigative grand jury that spent two years uncovering abuse of children by priests, and a systematic cover up spanning decades by senior church leaders in Pennsylvania and the Vatican.

The grand jury’s 884-page report detailed the panel’s work and findings, including: • 301 Catholic priests identified as predator priests who sexually abused children while serving in active ministry in the church.

• Detailed accounts of over 1,000 children victimized sexually by predator priests, with the grand jury noting it believed the real number of victims was in the “thousands.”

• Senior church officials, includ-

Bayside Man Gets 10-Year Sentence for Kidnapping Housekeeper

By Forum Staff A 35-year-old Bayside man will spend the next 10 years behind bars after Queens Supreme Court Justice Robert C. Kohm sentenced him for kidnapping his housekeeper.

Devanand Lachman who plead guilty to second-degree kidnapping will also be subject to five years supervised release at the end of his prison sentence. His wife, Ambar Lachman, also 35, plead guilty to unlawful imprisonment and was sentenced to five years probation for her role in the February 2015, unlawful imprisonment of the then54-year-old victim.

“The victim in this case was brutalized by the male defendant, who struck her several times and held her against her will,” said DA Richard Brown. “The female defendant aided her husband in this heinous crime. The defendants suspected their housekeeper - who had been working for them for several months - had stolen from their home. On February 13, 2015, Daisy Machuca arrived at the Lachman home at approximately 8 a.m. to clean. At roughly 1 p.m., Devanand Lachman and an unapprehended male entered the residence on 217thStreet in Bayside with knives anda firearm. The men took a phone and wallet from Machuca, then 54; Lachman accused the victim of taking cash and a gold chain from the house and punched her several times.

Lachman’s wife returned home and watched her husband beat and burn Machuca with a blowtorch.She told the victim they knew she’d stolen from them and told her she’d be killed if she didn’t tell them where the money and jewelry were.

Ambar Lachman then took the victim’s keys and she and the two men drove to Machuca’s Long Island home where they searched, to no avail, for the stolen items. Authorities say that they threatened the maid with death if she did not return the items when they came back the next day.

After the trio left the house, Machuca called police to report the incident.

Two Jamaica Men Convicted in 2015 Shooting Death of Bronx Man

Back to School Part Two: Making a healthy return When doing the back to school checklist, don't forget to include getting a physical at the top of the list. And although it's weeks away, be sure that appointments are scarce around this time, so do not put it off! These visits take time to do correctly and if there are any issues with meeting back to school requirements, you'll have enough time to have them taken care of.

NYS Department of Education requires a physical exam form for new entrants and students in grades Pre-K or K, 1, 3, 5, 7, 9 & 11. Check with your school to see what the requirements are for a vision exam as well.

Remember to bring the forms to the Dr.'s appointment along with a list of any documentation needed by the school that allows the school to administer any of your child's medications.

If kids are vaccinated elsewhere, bring those records with you as well.

If you have any concerns or questions about your child's health, take the time to prepare a list of questions. Many parents share concerns over the same topics,: diet and nutrition, sleep habits, allergies and medications. It's true our kids are going back to school to grow their minds but it's our responsibility to make sure they are in the physical condition to thrive in the school

environment.

In addition to the physical exam, it's a good idea to have their hearing tested once a year.

Be on the alert for any hearing or vision loss and bring it up to the doctor immediately.

Back to school means your child will be eating at least one meal out of the home every day and they need to be encouraged to make healthy food choices at school. Plenty of fruits and vegetables are at the top of the list and they should always to be encouraged to chose water over juice or soda.

Conforming to healthy routines will keep kids at their top performance level and establishing after school routines will help kids stay on track. Healthy snacks before homework work wonders, along with one hour of physical activity and a two-hour limitation for anything with a screen-handheld, TV or computer.

Routines should carry right up until bedtime and include brushing teeth, bathing and reading before bed.

Finally, sleep is the magic ingredient to success, in and out of the classroom. Pre-K or K, 1, 3, 5, 7, 9 & 11; Students between the ages of 6-13 years should be getting 9-11 hours per night.

Norman Seabrook Convicted at Federal Bribery Trial

By Michael V. Cusenza Norman Seabrook, who not long ago wielded power as a highly influential city labor leader, was convicted of bribery last Wednesday in Manhattan federal court.

The former president of the Correction Officers’ Benevolent Association was retried this summer after his initial proceeding last November ended in a mistrial. Seabrook, 58, was found guilty of conspiracy to commit honest services wire fraud and honest services wire fraud.

Seabrook and Murray Huberfeld, 57, a founder and part-owner of Platinum Partners hedge fund, were indicted in July 2016. According to charging papers, Huberfeld paid Seabrook $60,000, and promised future bribe payments, in exchange for Seabrook’s investment of $20 million of COBA money in Platinum Partners. Huberfeld actually worked out a formula in which Seabrook would be paid a kickback of a portion of the profits from COBA’s investment that the hedge funder estimated could be between $100,000 and $150,000 per year.

Huberfeld pleaded guilty to fraud in May. He admitted to conspiring with an intermediary, Jona Rechnitz, to cause the fund to pay $60,000 to Rechnitz’s company by falsely representing that the money was payment for courtside tickets to eight New York Knicks basketball games. Instead, as

COBA is the city’s largest correction officers union and the largest municipal jail union in the country. It represents more than 9,000 correction officers in the five

boroughs, including at Rikers Island. Until his June 2016 arrest, Seabrook had been the union’s president for more than 20 years. According to federal prosecutors, Seabrook’s power over the affairs of COBA was rarely questioned by his Executive Board due to his ability to affect their assignments, pay, and hours. Seabrook’s control extended to the union’s finances, including the administration of its “Annuity Fund,” a retirement benefits program funded by the City that invests more than $70 million for correction officers’ retirements.

According to the indictment, on a 2013 jaunt to the Dominican Republic, Seabrook told Rechnitz that he worked hard to invest COBA’s money and was not getting anything out of it, and it was time that “Norman Seabrook got paid.”

Seabrook faces a maximum term of 40 years in federal prison when he’s sentenced in November.

An admitted former Nazi labor camp guard living in Jackson Heights was finally removed this week by U.S. authorities to Germany, according to Department of Justice officials.

Immigration and Customs Enforcement put Jakiw Palij, 95, on a plane early Tuesday morning based on an order of removal obtained by the DOJ back in 2004.

“Those who are accomplices to the horrific crimes of the Holocaust will never be accepted in our free and civilized society. It was an affront to justice that Nazi prison guard Jakiw Palij was allowed to enter our country and live freely in the most diverse place in the United States,” said Assemblyman David Weprin (D-Fresh Meadows). “Our government has served this monster justice by permanently removing him from the country and deporting him to Germany to face charges for his transgressions at the Trawniki concentration camp.

Reputed Mobster Sentenced to 25 Years in Federal Prison for Whitestone Murder Conspiracy, Racketeering

By Michael V. Cusenza A reputed Genovese Organized Crime Family associate has been sentenced to 25 years in prison for conspiring to murder a Whitestone man in 2014 and other racketeering charges, federal prosecutors announced on Thursday.

Salvatore Delligatti, 42, of Oakland Gardens, was convicted of racketeering conspiracy, conspiracy to commit murder in aid of racketeering, attempted murder in aid of racketeering, murder-for-hire conspiracy, participation in an illegal gambling operation, and a firearms offense in March after a threeweek jury trial in Manhattan.

According to charging papers and evidence presented during trial, from at least in or about 2008 through in or about May 2016, Delligatti was an associate of the Genovese family.

In this capacity, Delligatti conspired with others to participate in and conduct the affairs of the Genovese family through a pattern of racketeering activity that included a murder conspiracy, an extortion conspiracy, and the operation of an illegal sports betting business.

From in or about May 2014 through in or about June 2014, Delligatti conspired with Robert DeBello, a Genovese soldier from Whitestone, and Ryan Ellis, an associate of the Genovese family who lived in Bayside, to murder Joe Bonelli, a reputed neighborhood gangster from Whitestone. Delligatti sought and obtained permission from DeBello to murder the intended victim.

However, instead of carrying out the murder himself, as DeBello had authorized him to do, Delligatti hired a crew of hitmen from the Bronx to ambush and kill Bonelli at his residence. Delligatti provided the hitmen with a loaded .38 revolver and a get-away vehicle, and offered to pay them several thou-

sand dollars for the murder. As a result of wiretap surveillance of Delligatti by the Nassau County Police Department and the Nassau County District Attorney’s Office, the crew of hitmen was apprehended in the get-away vehicle just a few blocks from Bonelli’s residence on June 8, 2014. In their vehicle, law enforcement recovered the loaded revolver, a spray bottle containing a bleach solution, and other materials.

Additionally, from in or about April 2014 through in or about May 2014, Delligatti and others in the Genovese Family, including DeBello and Ellis, participated in a conspiracy to use threats of violence and economic harm to extort the owners and promoter of a night club located on the rooftop of a hotel in Queens. And Delligatti participated with others in a large-scale bookmaking and sports betting operation that took bets from bettors in Queens and Manhattan, among other locations, and made use of an offshore wireroom.

“Salvatore Delligatti, in order to increase his standing in the Genovese Family, recruited a group of hitmen to murder an individual. But Delligatti’s hitmen were caught red-handed by the Nassau County Police Department and the Nassau County District Attorney’s Office before they could carry out their hit.

Delligatti now stands convicted of this foiled murder plot and other crimes he committed with the Genovese Family,” said Manhattan U.S. Attorney Geoffrey Berman.

DeBello and Ellis previously pleaded guilty to racketeering conspiracy offenses for their roles in the murder conspiracy, the extortion conspiracy, and the illegal gambling operation.

City Unveils Plans for New Borough-Based Jails

Cusenza Four modern, neighborhoodbased detention facilities—complete with community space, ground-floor retail, and parking— in four boroughs will replace Rikers Island when the infamous jail complex is closed, according to plans recently unveiled by de Blasio administration officials.

The centers in Queens (126-02 82nd Ave.), Brooklyn (275 Atlantic Ave.), Bronx (320 Concord Ave.), and Manhattan (80 Centre St.) also will provide a safer environment to work and will allow people in jail to remain closer to their loved ones, as well as offer quality health, education, visitation and recreational services that will help people reintegrate once they return to their communities, the City pledged.

“Now we can move full steam ahead on the engagement and planning for our new facilities so we can close Rikers as fast as possible,” said Mayor Bill de Blasio, who wants to shutter the island in the next 10 years.

Thanks to historic reductions in inmate population, the City announced in January that it will permanently padlock one of Rikers’ nine jails by the end of this summer. The closure of the George Motchan Detention Center would be made possible by the reduction of the City’s jail population, which fell below 9,000 for the month of

December 2017, a record-low figure last reported in 1982. As of Jan. 1, 2018, the Department of Correction’s jail population was 8,705.

In March 2017, de Blasio and then-City Council Speaker Melissa Mark-Viverito announced the plan to leave Rikers Island. That roadmap included a series of strategies

to bring the jail population down even further to 5,000 people and transition to the local, boroughbased jail system.

According to the administration, each borough facility will contain approximately 1,500 beds in order for the City to meet the needed 6,000 beds to accommo-

date an average daily population of 5,000 people, while allowing space for population-specific housing requirements, such as those related to safety, security, health, and mental health, among other factors, as well as normal fluctuations in the jail population. Currently, existing borough-based facilities only have the

combined operational capacity to house approximately 2,400 people.

The plans also boast hundreds of parking spaces, community space and ground-floor retail as well as on-site support services.

The proposal will need to go through the Uniform Land Use Review Procedure – the public scrutiny process that includes hearings and recommendations by the community board, borough president, the City Council and the City Planning Commission. In February, de Blasio and Council Speaker Corey Johnson agreed to consolidate the proposal to renovate or construct jails in Queens, Manhattan, Brooklyn, and the Bronx into a single ULURP process, which will allow for a more expedited review. An application will be submitted for certification by the end of the year and the design process could begin as early as next summer.

“Closing Rikers Island and opening community-based facilities is not only beneficial for New York City’s correction officers and incarcerated population, but also beneficial for the Kew Gardens community,” said Councilwoman Karen Koslowitz (D-Forest Hills).

“The new facility in Kew Gardens will bring significant economic development, and provide hundreds of new parking spaces for the community. I look forward to taking the next steps in opening communitybased facilities.”
