Addabbo Legislation Would Create Electronic Waste Recycling Task Force

By Forum Staff State Sen. Joe Addabbo, Jr. (D-Howard Beach) this week announced that he is sponsoring legislation to establish a task force within the State Department of Environmental Conservation to conduct an in-depth examination of the e-waste program’s performance and recommend improvements.

Addabbo noted that the e-waste recycling and reuse law, which is intended to allow consumers to work with municipalities and manufacturers to keep electronic devices out of the waste stream, has reportedly been subject to a number of pitfalls. There have been instances reported in which manufacturers have refused to accept e-waste or have charged high fees for the transaction. In other circumstances, according to the senator, municipal curbside recycling programs either haven’t been put into place or, when implemented, have not been as effective as possible.

“This waste is dangerous to our environment, and it is time to reexamine our e-waste law to find out how and where it’s working well, and to find ways to improve it in circumstances where it’s simply not living up to expectations,” Addabbo said on

By Michael V. Cusenza State Police investigators have reached out to the public for anyone that may have witnessed a fatal hit-and-run auto accident early Monday morning on Interstate 95 at Exit 18B (Mamaroneck Avenue) that claimed the life of a young Richmond Hill man.

According to State Troopers, Maicol Encarnacion Garcia, 20, was crouched outside

of a tan Volkswagen Tiguan changing a tire shortly after 12:30 a.m. when he was struck by a tractor-trailer that left the scene. The truck is described as towing two trailers at the moment of impact.

Anyone with information on the collision is asked to call the State Police Bureau of Criminal Investigation in Hawthorne at (914) 769-2600. All calls can be kept confidential.

A Brooklyn man has been sentenced to 25 years in prison for viciously biting off the top of his girlfriend’s cousin’s ear when he tried to stop the man from going after the girlfriend and her mother inside their South Ozone Park apartment in October 2014, according to Queens District Attorney Richard Brown.

In April, a jury found Reynoldo Rayside, 28, guilty of first-degree assault and endangering the welfare of a child following a twoweek long trial. He was sentenced last week to 25 years in prison to be followed by five years’ post release supervision.

According to trial testimony, on Oct. 2, 2014, Anthryani Mitchell’s 15-year-old cousin, who lives next door, heard a commotion and entered her South Ozone Park apartment. The teen saw Mitchell’s mother, Norma Mitchell, bleeding and injured on the floor and his cousin lying on the floor a short distance away in the kitchen with Rayside hovering over her. The 15-year-old rushed into the kitchen and put himself between his cousin and Rayside.

Brown said that the cousin managed to get Anthryani away from Rayside, but Rayside’s rage turned to him. Rayside grabbed

the cousin and bit into the boy’s ear and then ripped the top of his ear completely off. The victim was left with permanent and disfiguring scars as a result of this attack, Brown noted.

“The young victim in this case was savagely assaulted when he came to the aid of his female cousin and her mother during an altercation between the women and the defendant,” Brown added. “Violence has no place in a civilized society. This defendant was convicted at trial and a judge has now sentenced him to a lengthy term of imprisonment.”

Coalition of Civics Pushes Petition to ‘Save Lefferts Boulevard Bridge’

So begins the online petition “Save Kew Gardens Lefferts Blvd. Bridge,” recently crafted by the Save Kew Gardens Coalition, a group of area civic organizations looking to preserve the span between Grenfell and Austin streets that features 13 small businesses.

“Since the late 1920’s the Kew Gardens Lefferts Boulevard Bridge over the Long Island Rail Road – home to the mom-andpop stores that give the town its character and serve the shopping needs of its residents – has been the heart of this ‘Urban Village in the Big City.’ MTA and LIRR own the bridge and surrounding real estate,” the group wrote on its petition page at change. org. “Over 26 years ago the MTA set aside plans to develop a high-rise building over the MTA/LIRR tracks at the Kew Gardens Station. The MTA abandoned its proposal in the face of unified opposition by the community’s residents, civic associations, and

elected officials. Hundreds of people came together to fight the proposed destruction of the Lefferts Boulevard Bridge of stores – the heart of Kew Gardens.”

The Metropolitan Transportation Authority is reportedly mulling what to do with the admittedly decaying structure that activists have compared to the medieval Ponte Vecchio overpass in Florence, Italy.

This is not sitting well with the coalition.

According to the organization, “The heart of Kew Gardens is once again threatened. The MTA/LIRR is using the results of their intentional neglect as the excuse for a revived attempt to destroy the heart of our community. This site – a one-of-a-kind structure in New York City and the United States – is now once more the target of destructive development.”

The MTA this week told The Forum that it will reach out to the neighborhood regarding the fate of the bridge and its tenants.

“We’re committed to working with the community to find the best possible outcome for this location,” said agency spokesman Aaron Donovan.

By Forum Staff City Councilman Eric Ulrich (R-Ozone Park) recently honored Howard Beach resident Jacqueline Gagliano, who has been named “Woman of the Year” by Zonta International’s Queens Chapter.

Gagliano was recognized for her 30 years of humanitarian work for women’s rights, the protection and welfare of children, and for promoting Italian culture.

“Women and children internationally have one voice to be recognized and validated,” Gagliano said. “I’d like to thank Councilman Ulrich for this recognition. I am truly humbled.”

Zonta International is a leading global organization of professionals empowering women worldwide through service and advocacy.

“Jacqueline is the epitome of a good citizen, having dedicated her life to advocacy,” Ulrich said. “I commend Jacqueline on this much-deserved honor. Your tireless commitment to our community has not gone unnoticed.”

Gagliano has served on the faculty of The City University of New York and New York University, where she taught graduate and undergraduate classes in early childhood development, family psychodynamics and treatment protocol. While on-staff for the New York State office of mental health, she supervised graduate interns in social work and psychology.

According to Ulrich’s Office, Gagliano is a licensed psychotherapist and board certified diplomat with more than 30 years of profes-

sional experience working with women, children and families. Her main focus has been to facilitate the empowerment of women at home and in the workplace as well as helping children in conflict. She has a private practice in Howard Beach, where she currently resides.

For five years, Gagliano served as the Director of In-Service Training for the Department of Family and Children Services, Archdiocese of New York. She has studied and worked abroad in Madrid, Rome; and Guadalajara, Mexico, and lived on a kibbutz in Israel for two months. Visiting small pueblos of Mexico City, the mountains in Cali and the city streets in Caracas, she witnessed the poverty of children and the exploitation of women and from this, organized health resources into her practice.

Gagliano has also been a strong voice promoting the richness of her Italian heritage. She is a second- generation Italian-American with deep roots in the tradition and values taught by her grandparents and parents. As a Board Member of Bella Italia Mia and the Association of Italian-American Educators, she was a catalyst in recognizing talent in education, music, film and Italian cuisine.

Additionally, Gagliano is a member of the American Association of the University of Women, the Italian Welfare League, and Famee Furlane of North America. As a board member of the Italian-American Women’s Center, she has been instrumental in awarding scholarships to high school students bound for college.

Mayor, City Council Reach Early Agreement on $85.2B Fiscal Year 2018 Budget

By Michael V. Cusenza Mayor Bill de Blasio and City Council leadership on Friday announced an agreement for an on-time and balanced City budget for Fiscal Year 2018, marking the earliest handshake since 1992.

The deal on an approximately $85.2 billion budget, according to de Blasio, “builds on the administration’s ambitious plan for investing in our public schools, youth workforce development, seniors and veterans, while protecting and strengthening the City’s long-term fiscal health.”

The highlights of the new budget include: • $105.53 million in capital funding and $1.8 million in expense to ensure Universal Physical Education by 2021.

• $23 million to eliminate the Home Care and Case Management waitlists, create a new program to offer relief to caregivers, provide weekend meals to seniors utilizing Senior Centers or the Home Delivered Meals programs, and enhance rates paid to senior centers.

• A Veterans Property Tax Exemption for any veteran who served during a war, saving an average of $443 per year, per person at a cost to the city of $25 million annually.

• $20 million to provide 6,500 year-round jobs through the Work, Learn and Grow.

• $9 million to expand the Summer Youth Employment Program from 65,000 to 70,000

• $7.2 million – an increase of 15 percent from last year’s spending – for the Emergency Food Assistance Program to address the projected demand.

• $2.1 million to expand Breakfast in Classrooms to an additional 303 buildings, bringing the total to 833.

• $10.4 million to expand the Free School Lunch program in schools.

• $110 million to assist with capital projects in libraries across the city.

De Blasio indicated that he was especially

proud of several initiatives, including those that focus on veterans issues.

“Once again, localities have to step up where the federal government has been absent. And there’s something we can do for our veterans, and this was a major priority for both the administration and the Council,” the mayor noted. “This budget expands the property tax exemption for veterans who served in wartime. And it’s going to put money back in their pocket. And it’s what we owe our vets.”

While this year’s agreement arrived remarkably early, one stalemate, regarding immigrant legal defense funding, still lingers.

This year’s budget includes a $16.4 million allocation that de Blasio featured in his Executive Budget to provide free defense counsel to immigrants under threat of deportation – provided that those immigrants haven’t been convicted of any one of a list of 170 serious offenses. City Council Speaker Melissa MarkViverito wanted the stipulation removed.

They agreed to disagree on the matter.

“We’re acknowledging a difference. And, right now, what we’ve all agreed on is there needs to be money for legal services for undocumented folks facing deportation,” de Blasio said. “The issue will be resolved in the contracting process. Now, I have very strong views I’ve made clear. And the contracting process resides in the executive branch, so I’ll leave it at that.”

Upstate Couple Plead Guilty to Hate Crime, Sentenced to Jail for Targeting Elderly

By Forum Staff A Dutchess County couple have pleaded guilty to grand larceny as a hate crime and were sentenced to nine months in jail for separately targeting three elderly Flushing residents – ranging in age from 68 to 81 – to rob of their gold necklaces, according to Queens District Attorney Richard Brown. The three incidents took place between March and April of this year.

Marcideza Dumitru, 29, and her husband, Constantin Miclescu,

30, appeared in court last week and entered guilty pleas to fourth-degree grand larceny as a hate crime.

Dumitru and Miclescu, who have been held in jail in lieu of $30,000 and $20,000 bail, respectively, since their arrest early last month, were immediately sentenced to nine months in jail.

Reagan “Flex” Conception, 28, was arraigned on Friday on a 76-count indictment charging him with first- and second-degree kidnapping, first- and second-degree rape, first- and second-degree criminal sexual act, sex trafficking, compelling prostitution, first-, second- and third-degree pro-

moting prostitution, second- and third-degree assault and endangering the welfare of a child. He was ordered held without bail.

According to the charges, the then 14-year-old victim was introduced to Conception in September 2016 and was sexually assaulted by the defendant on multiple occasions between the time they met and November 2016. Con-

ception then allegedly forced the victim to engage in prostitution acts during this same time period and physically assaulted her when she did not comply with his demands.

Brown said Conception “is accused of profiting from prostitution by forcing a teenage girl into having sex dates with men for money. I want to stress that pros-

titution is not a victimless crime and that sex trafficking is an incessant act of brutality and degradation. This teenage girl was finally freed but she will have to live with this horrible experience for the rest of her life.”

Conception, who faces up to 25 years to life in prison if convicted, was ordered to return to court on July 5.

The defendants allegedly purchased sought-after electronics, such as the Apple iPads and other Apple products. Between October 2016 and February 2017, “shoppers” are alleged to have purchased in excess of $50,000 worth of makeup, gift cards and other items from Sephora stores in New York, Connecticut, Virginia and Maryland. The defendants also allegedly used online financial services to purchase stolen credit card information and to transfer proceeds from their alleged illegal enterprise between each other and with other individuals.

As indicated in the indictment, the Rosedale home of defendant Jordan Clarke, 26, was used as a mill where the defendants allegedly created the forged credit cards. His home was also allegedly a gathering point at times for “shoppers” to drop off merchandise that was then distributed amongst the defendants. It is alleged that the gift cards purchased along with some of the other merchandise were sold to fences in Queens for cash.

In addition to the arrests, search warrants were executed at various locations in Queens, Brooklyn and

in Ronkonkoma. The items allegedly seized include four firearms, ammunition, 81 forged credit cards, 43 oxycodone pills, 25 morphine sulfate pills, credit card faces, a NYPD-issued bullet-resistant vest panel, an expandable baton, a USB drive containing instruction manuals on how to create forged credit cards and forged drivers licenses, approximately 150 templates for credit cards, three card reader/writers, a credit card embossing machine and a manual credit card imprinter. Numerous vehicles, allegedly used in the operation of this credit card fraud ring, were also seized, including a Maserati, Ford Mustang, Jeep, BMW and G35 Infiniti.

“The defendants’ alleged crimes not only victimized department stores – costing those businesses thousands of dollars in losses – but also the consumers whose personal information were stolen and used to carry out the alleged scheme,” Brown added. “Even after the alleged culprits are prosecuted, the individual victims will still face difficulty in repairing their credit ratings and credit scores. The financial repercussions from being a victim of identity theft can last for years.”

The City Police Department recently reached out to the public for help in identifying a man wanted for questioning in connection with a knife-point mugging that occurred late last month in Kew Gardens approximately a block away from Forest Park.

According to police reports, on Sunday, May 21, around 8:20 a.m., the two female victims were talking in the vicinity of Mayfair Road and 116th Street when an unknown male black armed with a knife approached the women and forcibly removed the purse of Victim 1. When she attempted to assist her friend, Victim 2 was pushed to the ground by the suspect causing an injury to her hip. Both women were removed to Jamaica Hospital Medical Center with non-life threatening injuries, cops said.

According to investigators, the suspect being sought is described as a black man, 6-foot-1, 200 pounds; he was last seen wearing a white T-shirt, blue jeans, and white sneakers.

Barzola has pleaded guilty to first-degree burglary for his role in the violent home invasion of an elderly Bayside couple in April 2014.

By Forum Staff A Brooklyn man has entered a guilty plea on charges that he robbed and brutally assaulted an elderly Bayside couple in 2014.

Vincente Barzola, has pleaded guilty to first-degree burglary for the violent home invasion of the husband and wife’s apartment back in April of 2014.

Barzola, now 41, and an accomplice, now also in custody, impersonated building maintenance personnel at the couple’s door.

When Barzola rang the doorbell, the 85-year-old wife let him in after he told her she needed to sign a maintaineance form for the building.

The pair of thugs stormed the door as soon as she unlocked it, and bound her wrists with plastic ties. Her husband,

87 at the time, was asleep in the upstairs bedroom where the bandits woke him violently, tied his wrists with plastic ties and pepper-sprayed him in the face.

The defendant pleaded guilty to firstdegree burglary before Queens Supreme Court Justice Richard L. Buchter, who indicated he would sentence Barzola to 12 years in prison to be followed by two and a half years’ post release supervision.

“The victims in this case – both octogenarians – weren’t just robbed of their precious possessions,” said District Attorney Brown. “The defendant also stole their sense of security that they were safe in their own home… and will be sentenced to a lengthy term of incarceration.”

Barzola ransacked the home and stole a safe that contained more than $15,000 in cash along with gold and diamond jewelry.

Amtrak and MTA Must Finalize Plan to Use Fed Funds to Repair Sandy-Damaged Tunnels: Schumer

By Forum Staff U.S. Senate Minority Leader Charles Schumer and a bipartisan group of elected New York officials and commuter advocates last week demanded that Amtrak and the Metropolitan Transportation Authority set a plan with an ambitious deadline to use $432 million in federal funds Schumer secured to repair the East River tunnels— before its “festering issues” get even worse.

Despite Schumer successfully securing $432 million in unused Superstorm Sandy relief funds for repairs to the tunnels, Amtrak and the MTA have yet to make any meaningful or real progress on dedicating the funding to the critically needed project and repairs, according to the senior senator from New York.

“Plain and simple, the MTA and Amtrak need to repair the East River tunnels, fast. The $430 million in federal dollars that I secured are sitting there and now we just need MTA and Amtrak to set a plan with real deadlines to put that money to work for Long Island Rail Road commuters. Those tunnels are the most important link in the commute of hundreds of thou-

sands of Long Islanders and a problem in one tunnel—like we saw [last] week—creates a nightmarish domino effect for the entire LIRR system, and that’s not acceptable, especially considering we have the funds to fix this,” Schumer said. “With train delays and disruptions on the rise, it’s time for Amtrak and the MTA to immediately commit to repairing and upgrading the East River Tunnels and use the $432 million

we’ve already secured.”

Schumer pointed out that, since Sandy, the number of trains that were delayed, canceled or terminated because of issues with the East River tunnel have increased by 72 percent, a problem that Schumer says is likely to get worse as time goes on. While not necessarily as a result of damage from Sandy, given that salt water is corrosive to electrical systems and more, the prior dam-

age to the tunnels from Sandy flooding will only lead to more problems in the future.

Last week’s third rail electrical problem led to a three-hour LIRR delay and impacted thousands of commuters, a situation which will only repeat itself if repair work to the tunnel does not begin soon. Schumer has already written to Interim MTA Director Ronnie Hakim and Amtrak President Charles Moorman asking for an immediate update on the status of repairs to the East River tunnels and said that the two agencies should quickly work together to address these desperately needed repairs.

“The Long Island Rail Road Commuter Council strongly supports Senator Schumer’s call to promptly repair Sandy related damage to the East River Tunnels. Long Island depends upon Amtrak’s East River tunnels, with LIRR riders making up the vast majority of the 300,000 passengers that pass through them each weekday. Although Amtrak faces substantial other needs, the project to repair the East River tunnels must keep moving forward to prevent an already intolerable situation from getting worse,” said Mark Epstein, chairman, Long Island Rail Road Commuter Council.

AARP Touts Funding for Seniors in New City Budget

By Michael V. Cusenza The New York chapter of AARP on Saturday gushed about Mayor Bill de Blasio, City Council Speaker Melissa Mark-Viverito, and the funding for seniors featured in the Fiscal Year 2018 Adopted City Budget.

“Mayor de Blasio and the City Council have hit a home run for the city’s growing senior population. AARP is grateful that our city leaders listened to the 50+,” said AARP NY State Director Beth Finkel. “The baselining

of critical senior services and an expansion of funding for caregiver support and other programs that help New Yorkers age safely and with dignity in their own homes is exactly what our aging city needs.”

De Blasio and Mark-Viverito last Friday announced that they had reached an agreement on the 2018 budget.

According to Finkel, the city’s 65-andover population is expected to increase 40 percent between 2010 and 2040, “and without the services the new city budget funds and expands both this year and into the future, too many older New Yorkers would be left with no choice but to enter nursing homes that cost taxpayers – and families – much more.”

Finkel went on to say that the City’s new spending plan “should serve as a model” for Albany.

“The inclusion of $6.5 million to end wait lists for homecare services, $1.2 million apiece for case management services and the weekend meal program, and $4 million for a new caregiver support program are all key to keeping families together and older New Yorkers where the vast majority of them want to age – in their own homes,” Finkel added.

“Family caregivers represent the backbone of the City’s long-term care system, providing $13 billion annually in unpaid care to 425,000 loved ones. Caregivers need support, and this budget provides it.”

Medications are often left out of people’s emergency plans. Lost or damaged medication can be a life-threatening situation.

Here are some tips to be prepared: Make a medication list: Keep an updated list of all medications, dosages and phone numbers for your doctors and pharmacies in a waterproof bag or container.

Carry your prescription card: Keep your health insurance or prescription-drug benefit card with you at all times, It can help you obtain an emergency supply of any lost or damaged medication.

Order early: Reorder as soon as you are able. Don’t let your perscriptions sit around and stockpile. Yoe need to ensure you always have enough on hand. it could be days before you are able to get what you need.

Keep your medications together: Keep medications in original containers with original labels and place prescription bottles in a waterproof bag or container.

Prepare for special needs: If your medication requires refrigeration or electronic equipment, have a plan for temporary storage and administration.

Make a plan: Discuss your medication disaster plan with your doctor, especially if your medication has special shipping or electronic equipment requirements. Also discuss plans for your child’s medication with your child’s day care provider or school.

Maintain an emergency healthcare kit: Stock a supply kit with any nonprescription medications you may need such as pain relievers, cold medications and antacids.

Finally, if you experience an emergency situation, it’s important to check that your medication hasn’t changed--did it get wet? Does it smell different? If you’re unsure-ask your pharmacist! And never skip or make up doses without consulting your pharmacist or doctor.

City Announces Universal Physical Education Initiative

By Forum Staff City leaders this week unveiled the Universal Physical Education initiative to provide all schools with a designated PE space by 2021.

According to the de Blasio administration, the initiative will focus on around 200 schools, out of a total of 1,629, that do not currently have a gymnasium. The first phase will focus on 76 schools that do not have any designated PE space and will cost approximately $385 million over the next four years in Capital funding, including $105.5 million in new Capital funding as part of the recently-announced Adopted Budget for Fiscal Year 2018. As part of the budget agreement, the City will also invest an additional $1.8 million for some of the schools to lease nearby PE space.

“Every student needs quality physical education to stay healthy and remain focused during the school day. Not only are we committing to providing all students with PE space, but we are also strengthening physical education curricula with more trained PE instructors and new educational resources,” said Schools Chancellor Carmen Fariña. “This is part of equity and excellence in all our schools, and setting stu-

Mayor Bill de Blasio and Fariña announced Universal PE at PS 81 in Ridgewood, where in 2018, the school will break ground on a new, stand-alone gymnasium.

Starting next school year, the school will also have a new, full-time certified PE instructor, according to the City. Addition-

ally, starting this week, air conditioning installations will begin to address the nearly 80 percent of classrooms that lack units.

This will be completed by the end of summer 2017 and all classes will have air conditioning for the 2017-18 school year.

“The lack of physical education classes in our schools has been a concern of mine

for over 20 years,” de Blasio said. “I could not be more proud to be dedicating resources to ensure that every school will have an adequate PE space by 2021. Incorporating physical activity into the day isn’t just the healthy thing for our young people, it is the law and one that was ignored for far too long.”

According to de Blasio, Universal PE will build upon the administration’s PE Works initiative, an unprecedented, multiyear, $100 million investment launched in April 2016 that envisions PE as a foundational component of our schools, and seeks to revitalize this subject area for all students. PE Works began as a pilot in approximately 400 schools in the 2015-16 school year, and included jumpstart funding for 50 elementary schools without a certified PE teacher to hire and retain one.

And of the 76 schools included in the first phase of Universal PE, 16 are in Queens, 30 are in Brooklyn, 13 are in the Bronx, 8 are in Manhattan, and 8 are in Staten Island.

While all schools are required to provide PE, not all schools have PE space. Universal PE, coupled with PE Works, will ensure that all students have access to a PE space, resources and instructors who can provide them with the rigorous PE instruction.

De Blasio Signs Executive Order to Adopt Goals of Paris Climate Agreement for NYC

Cusenza A day after President Donald Trump announced that the United States would be withdrawing from the Paris Climate Agreement, Mayor Bill de Blasio signed an Executive Order committing to honor the goals of the historic accord “so our city can remain a home for generations to come.”

“President Trump can turn his back on the world, but the world cannot ignore the very real threat of climate change,” de Blasio added. “This decision is an immoral assault on the public health, safety and security of everyone on this planet. New Yorkers are already experiencing hotter summers, more powerful storms and rising seas, which disproportionately affect already vulnerable communities.”

The Executive Order is composed of three sections: Adopt and Commit to the Principles and Goals Set Forth In the Paris Agreement “To protect our residents and all human beings from the effects of climate change, New York City will adopt the principles and goals of the Paris Agreement to deliver

climate actions that are consistent with or greater than its own commitments to reduce its greenhouse gas emissions 80 percent by 2050 and that support the critical goal of , holding the increase in the global average temperature to below 2° Celsius above pre-industrial levels and pursuing efforts to limit the temperature increase to 1.5° Celsius above pre-industrial levels, as set forth in the Paris Agreement, which entered into force on November 4, 2016.

TRANSPORTATION FRUSTRATION Excelsior. Ever upward.

The invigorating one-word motto is emblazoned on our State crest and flags. However, these days, if you were to use the Metropolitan Transportation Authority subway system for your journey ever upward, it would come complete with extended waits, crowded cars, and ancient infrastructure.

Put simply, the city’s subway system is a putrid mess, with no saving grace in sight.

The latest well-publicized incident comes courtesy of the vaunted F Train.

On Monday around 6:20 p.m. – peak rush hour – the southbound subway lost power, leaving an F train – and hundreds of straphangers – stalled in a tunnel between stations for at least an hour.

“S/b F train stuck for over an hour w/o light and air just rolled up-passengers dripping with sweat begging to get off #mta @MTA#effedtrain,” rider Chelsea Lawrence tweeted on Monday.

No lights. No air conditioning. No wonder some commuters reportedly came close to passing out due to the thick underground heat.

“The situation on the subway is no longer inconvenient; it’s now dangerous and

scary. New York is trying to run a global capital on third-world infrastructure, and that’s clearly unsustainable,” said John Raskin, executive director of the Riders Alliance. “What is Gov. Cuomo’s plan to fix the subway? We’ve heard big talk but no actual plan from the governor, and it’s clear that rhetoric can’t fix this problem.”

While the City contributes to MTA funding it exerts zero control over the sys-

tem. That’s why Mayor Bill de Blasio lately has understandably deflected questions to the capital and Gov. Andrew Cuomo, because the MTA is a State agency that answers to Albany.

So, the proverbial ball is in your court, Gov. Cuomo. Whenever you’ve wanted a political feather in your cap – marriage equality, statewide $15 minimum wage – you have relentlessly pushed your people

to get it done. The time has come to make the MTA your number one priority. Because as it stands now, the decaying system is nothing short of a global embarrassment. It is not the public transportation operation befitting the greatest city in the world.

“We know what we need: new subway cars, new signals, emergency attention to MTA operations, and leadership from the governor to make it all happen,” Raskin added. “Until Gov. Cuomo produces a real plan, riders will continue to sit and wait and fume as breakdowns and delays multiply. What will it take to get Gov. Cuomo to take action?”

Last month, days after distancing himself from the beleaguered agency, Cuomo said he was throwing down the gauntlet, issuing a “challenge” to the MTA “to modernize the New York City subway system and increase the number of trains at peak periods to relieve crowding and reduce delays.”

We’ll see what that produces.

Until then, whenever the letters “MT-A” are uttered in front of any number of vexed straphangers, expect a certain, single finger on their hands to quickly flip ever upward.

As the daughter of a retired firefighter and the sister of two firefighters who also worked on the “pile,” his death hits close to home.

Ray could have spent the last three years of his life after retiring solely on the fight of his life to beat the cancer that was destroying his body – but he did not. Instead, he became a tireless advocate of the James L. Zadroga 9/11 Health and Compensation Act, commonly known as the Zadroga Bill, which provides health care monitoring and treatment to first responders and was set to expire in 2015. He was a familiar sight in Washington on his electronic wheelchair as he lobbied

Congress to pass the bill that would help first responders. He used his kindness and his humanity to shame those who opposed the bill and was instrumental in getting Congress to pass federal legislation that extended medical treatment for another 75 years for those sickened after 9/11. It was during these lobby days in Washington that he met and befriended comedian Jon Stewart who was one of those who spoke at Ray’s funeral mass.

Ray Pfeifer has been lauded in life, and in death, by many politicians, including U.S. Senators Charles Schumer and Kirsten Gillibrand, New York City Mayor Bill de Blasio who awarded him the key to the City in 2016, and thousands of others who owe him a debt of gratitude that this nation can never repay.

His passing is tragic, causing unimaginable pain to those who knew and loved him, but his legacy will remain. He was a true American hero. May he rest in peace.
