De Blasio Signs Bill Prohibiting City Employers from Asking Job Applicants about Salary History

By Forum Staff Mayor Bill de Blasio recently signed into law a bill prohibiting all employers from inquiring about a prospective employee’s salary history.

According to the administration, the bill expands upon the Mayor’s Executive Order 21 signed in November 2016 to include both private and public employers.

“It is unacceptable that we’re still fighting for equal pay for equal work.

The simple fact is that women and people of color are frequently paid less for the same work as their white, male counterparts,” de Blasio said last Thursday. “This administration has taken bold steps to combat the forces of inequality that hold people back, and this bill builds upon the progress we have made to close the pay gap and ensure everyone is treated with the respect they deserve.”

The new law, which goes into effect in 180 days, dictates that it is an unlawful, discriminatory practice for an employer to inquire about or rely upon the salary history of a job applicant to determine their sala-

ry amount during the hiring process, including the negotiation of a contract. An applicant’s salary history includes current or prior wage, salary, benefits or other compensation. The bill allows employers to discuss with job applicants their expectations about salary, benefits and other com-

pensation. If an applicant, voluntarily and without prompting, discloses salary history to an employer, the employer may consider salary history in determining salary, benefits and other compensation for such applicant, and may verify that salary history.

“This law is a major step toward achieving pay equity, particularity for women,” said Public Advocate Letitia James, the bill’s sponsor. “By prohibiting employers from asking about salary history during the hiring process, we will ensure that being underpaid once does not condemn anyone to a lifetime of inequity. I’m grateful to Mayor de Blasio and members of the City Council as well as advocates and leaders across the country for supporting this historic initiative. Together, we will keep up the fight for fairness and make ‘equal pay for equal work’ a reality.”

The administration also noted that individuals can file a complaint with the City Commission on Human Rights, which has the ability to fine employers with civil penalties of up to $250,000 for willful and malicious violations of the law, and can award compensatory damages to victims, including emotional distress damages and other benefits. The Commission will also create educational materials on this protection and conduct community outreach to ensure that NYC workers’ know their rights.

Richmond Hill Man Sentenced to 30 Years to Life in Prison for Brutal Murder and Arson

Cusenza The mastermind behind the vicious February 2013 execution-style shooting death of a fellow Richmond Hill resident, who was bound with electrical cords, robbed of his bank card and then shot several times in the head before his apartment was set ablaze to cover up the crime, has been sentenced to 30 years to life in prison, according to Queens District Attorney Richard Brown.

In January, a jury found Stephen Peters, 26, guilty of second-degree murder, firstdegree robbery, first-degree burglary, firstdegree kidnapping, third-degree arson and tampering with physical evidence. Peters received his prison sentence last week, while a second defendant in the case, Jason St. Hill, 21, pleaded guilty to first-degree robbery and was sentenced last month to 12 years, six months in prison.

Peters’ attorney, Edward Muccini, did not return a call from The Forum seeking comment on the sentencing or if his client is appealing the verdict.

Ali, 43, shortly after midnight on Feb. 24, 2013. Inside Ali’s second-floor apartment, the victim was beaten by Peters, had his hands and feet tied with electrical cord, and while St. Hill held a gun on Ali, Peters went to the building’s basement for gasoline.

According to court records, Brown said, Peters demanded and got Ali’s bank card, along with his PIN number, and then shot him three times in the head. To cover up the

crime, Peters then poured the gasoline on the dead man’s body and around the apartment and set the place on fire. Firefighters responding to the two-alarm fire at the apartment building made the grisly discovery shortly after bringing the blaze under control – Ali’s badly burned body was found in his bed, his hands and feet still bound with the cords.

It took more than 100 smoke-eaters to get a hold of the fast-moving fire.

“Somebody was yelling, ‘Fire, fire,’ and there was smoke all over. I got the kids and ran out,” said one of the tenants, a man who lived with his two children in the other second-floor apartment. “It was very frightening.”

The district attorney added that after leaving the apartment, according to court records, Peters went to a restaurant on Liberty Avenue and used the ATM there to withdraw $100 in cash. Peters also went to a gas station on Atlantic Avenue and attempted to withdraw more money from the ATM there, but was unsuccessful.

Hill, who lived less than a block away from Ali’s building, was taken into custody for questioning around 11 a.m. on Feb. 24, a few hours after the blaze had been extinguished.

“The victim was bound at his ankles and wrists and posed no threat to the defendants, yet the decision was made to fatally shoot him and then – in an attempt to cover up their heinous, cowardly crime – set his residence on fire, thus endangering more lives,” Brown said. “Both men have now been sentenced to lengthy terms of imprisonment – one of whom will likely be locked away for the rest of his natural life.”

Howard Beach Man in Critical Condition after Being Struck by Car on Cross Bay Boulevard

By Michael V. Cusenza An elderly Howard Beach man on Wednesday remained in critical condition at a borough hospital, three days after he was struck by an SUV as he attempted to traverse Cross Bay Boulevard at 160th Avenue, according to the City Police Department.

According to police reports, the unidentified 89-year-old victim was walking across the busy thoroughfare around 12:45 p.m. when

a 2002 Honda Pilot, driven by a 39-year-old man, turned left from 160th Avenue onto Cross Bay Boulevard and struck him.

The victim suffered severe head trauma and was rushed to Jamaica Hospital Medical Center. The driver remained at the scene. The NYPD is investigating the incident. No charges have been filed.

Addabbo Bill Calls for Crossing Guards near Every City High School

By Forum Staff State Sen. Joe Addabbo, Jr. (DHoward Beach) has introduced legislation that would require crossing guards to be placed on the corners of every city block that hosts a public or private high school during arrival and dismissal.

“During the academic year, the lives of well over one million New York City school children hang in the balance as students travel back and forth for classes on local streets, and crossing guards are absolutely invaluable to ensuring the safety of these young people,” said Addabbo, a long-time member of the Senate Education Committee.

“In recent years, a number of innocent children have been struck and killed on their way to school, and adding more crossing guards around education facilities would help to prevent this kind of devastating and unnecessary heartbreak.”

According to Addabbo, in 2015, there were approximately 2,300 crossing guard posts throughout the five boroughs, although vacancies were reported to be as high as 200, he noted. Since then, the City

oughs,” Addabbo said. “I appreciate this effort, but I would like to see this expansion implemented more efficiently to provide maximum protection for our children walking back and forth to class through busy intersections. 2020 is a long way down the road, and some of our local thoroughfares are already extremely dangerous for school children and others to travel.”

“In 2015, 134 pedestrians lost their lives in traffic crashes in New York City,” the senator said. “This is a welcome reduction from previous years, but we have more work to do to protect our residents, and especially our children, from injury and death while they are crossing our neighborhood streets. Boost-

ing the presence of crossing guards around all of our private and public schools is an important part of that equation.”

Assemblywoman Stacey Pheffer Amato (D-Howard Beach), who is introducing the bill in the Lower Chamber, also mentioned Jazmin as inspiration for such legislation.

“Seven months ago, a 13-yearold girl with a sunny disposition and a bright future was killed going across Cross Bay Boulevard. If there’d been enough crossing guard coverage, Mr. Marin might not have lost his daughter. I’ve been working to get better signage in the area, and I’m so glad to join Senator Addabbo today as we introduce a bill to ensure that this never, ever happens again,” Pheffer Amato stated. “Crossing guards are an obvious need, and broad coverage – which, per this new bill, will be every corner of a high school and opposite corners for large roads, like we have in our district – is a must. We must see this bill through to the governor’s signature, because every parent in NYS deserves for their child to have reasonable protections if they have to cross the street to get to school.”

Six Purported Members of Latin Kings Indicted for Attempted Murder, Gang Assault

There may soon be a few less Latin Kings on the street, after a Queens grand jury charged six reputed members of the gang in the attempted murder and gang assault of a 24-year-old man in Jackson Heights last October.

“The defendants are accused of viciously attacking and seriously injuring a young man apparently for no other reason than he was not a member of the Latin Kings gang,” said District Attorney Brown. “Gang violence will not be tolerated in Queens County. The defendants’ poor choice in pursuing gang membership and the violence that are a part of that lifestyle have led them to be charged with serious felonies that carry the possibility of lengthy prison sentences.”

Six defendants – Michael (“Menace”) Aragundi, Jonathan (“Butters”) Duy, Jordan (“JCap”) Leon, Wilson (“Suave”) Matute, Luis (“Frosty”) Mayancela, and Luis (“Scar”) Minchala – were arraigned before Acting Queens Supreme Court Justice Stephanie Zaro on a seven count indictment charging each of them with one count of second-degree attempted murder, one count of first-degree gang assault, one count of first-degree assault, two counts of first-degree robbery, one count of seconddegree robbery and one count of seconddegree assault.

The victim was attacked outside El Paisa bar on Northern Boulevard in Jackson Heights.

Each defendant faces up to 25 years in prison if convicted, and all were ordered to return to court on July 10, 2017.

According to the charges, the 24-yearold victim was standing outside of the El Paisa bar, located at 87-05 Northern Boulevard in Jackson Heights during the early morning hours of October 29, 2016, when a large group of men, including the defen-

dants, approached him. Seven of the men – including five of the defendants Aragundi, Duy, Leon, Matute and Mayancela – allegedly began punching and stabbing the victim. Although the defendant Minchala did not participate in the assault, he later told police that he was present at the scene to oversee the assault and that he directed other gang members to assault the victim. The victim was holding a cane at the time of the assault and that too was used to beat him.

The group of assailants fled the scene after the encounter, leaving the victim bleeding in front of the bar. He was transported to a local Queens hospital, where he was treated for eleven stab wounds and lacerations, including a laceration to the head and two stab wounds to the neck. He suffered additional physical damage including the possibility of permanent nerve damage to his arm, which finds him with numbness in his left arm and hand.

Jamaica Man Indicted as Sex Trafficker for Pimping out Teen Girl

By Forum Staff The Queens grand jury has indicted another sex trafficker, this time a 27-year-old Queens man who will face multiple charges including sex trafficking, rape, promoting prostitution and other charges after he forced a 15-year-oldgirl into having sex in exchange for money he pocketed.

District Attorney Brown said, “The defendant is accused of forcing a teenage girl into having sex dates with men for money. I want to stress that prostitution is not a victimless crime.

Sex trafficking is an incessant act of brutality and degradation. This teenage girl was finally released but will live with this horrible experience for the rest of her life.”

The defendant is identified as Lance Hamilton, of Foch Boulevard in Jamaica. He was arraigned on a 45-count indictment charging him with first- and second-degree kidnapping, second- and third-degree promoting prostitution, compelling prostitution, sex trafficking, second-degree assault, third-degree rape, criminal sexual act, first-degree unlawful imprisonment, second-degree menacing, aggravated harassment, criminal obstruction of breathing or blood circulation and endangering the welfare of a child.

The defendant was ordered held on $750,000 bail and to return to court on May 8, 2017. If convicted, Hamilton faces up to 25 years in prison.

Authorities say the 15-year-old victim was

brought to Hamilton’s home in December 2015 by a friend and was sexually assaulted by him at the time. Hamilton then stole the victim’s belongings and identification and, over the course of several months, forced her to have sex in exchange for money, which she had to turn over to him.

Hamilton posted prostitution advertisements of the victim on the Backpage.com website. When the victim refused to engage in prostitution, Hamilton repeatedly punched and choked her, and then on one occasion, he threatened her with a gun inside his home.

Attorney Sentenced up to Four Years in Prison for Mortgage Fraud Scheme

By Forum Staff Crime doesn’t pay. That’s a lesson made very clear to a Long Island attorney who will now spend time in prison after admitting she defrauded Queens homeowners out of more than $2 million in mortgage proceeds. A second defendant n the same case pleaded guilty previously.

District Attorney Richard Brown said the two defendants created a “financial nightmare” for the buyers and the sellers of nearly half a dozen Queens properties. “The victims in this case only discovered that something was amiss when foreclosure notices for the pre-existing mortgages were served several months after the supposed ‘short sale’ closings,” said DA Brown. Homeowners were tricked into selling their properties and believed their mortgage obligations were being satisfied while the buyers and new mortgage lenders were deceived into believing that the purchased properties were free and clear.

Helene Stetch, 53, of Lindenhurst, worked with attorney Kenneth Schwartz at the law firm of Kenneth B. Schwartz, Esq., located at 555 Westbury Avenue in Carle Place, New York, until her termination in mid-2010. Schwartz, 67, of Huntington, New York, took a conditional guilty plea to fourth-degree criminal facilitation and disorderly conduct on January 13, 2017.

Stetch, who pleaded guilty to one count of first-degree criminal possession of stolen property and six counts of second-degree grand larceny

was sentenced to seven concurrent terms of 1 1/3 to 4 years in prison.

Additionally, Stetch executed eight confessions of judgment totaling approximately$2,325,043.00.

According to the criminal charges, the law firm of Kenneth Schwartz represented sellers, lenders, and sometimes buyers, in the sale of several houses in Queens County, in which the closings were held at the defendants’ Carle Place law offices between October 2008 and May 2010. In each transaction, the seller was delinquent on the mortgages

and sought to sell the property in a short sale to avoid foreclosure. The mortgages on the houses involved typically had a first and second lien holder, both of whom had to approve of the sale..

According to the charges, Stetch represented the property sellers and engaged in short sale negotiations with the goal of persuading the underlying lien holders to accept less than the outstanding mortgage. Stetch proceeded to closing without the short sale approval from both lien holders on any of the properties, and although having proceeded with a sale, Stetch failed to pay off the underlying mortgages. In fact, she continued short sale negotiations – ranging from a few months to more than a year – with the lien holders as if no sale had yet occurred. Since the law firm of Kenneth Schwartz was the lender’s settlement agent, mortgage loan funds were wired into an attorney trust account in Kenneth Schwartz’s name and for which Schwartz and Stetch

were the only authorized signatories on the account. Disbursement of the funds was conditioned upon certain things taking place – including, paying off the underlying mortgages and recording the new mortgages so that the lender would be in position of first lien holder; preparing HUD settlement statements that correctly listed how the mortgage proceeds would be disbursed; and obtaining title insurance on behalf of the lender. In fact, the underlying mortgages were not being paid off, the HUD settlement statements falsely indicated that there were no underlying mortgages to be paid off, and no title insurance was purchased.

Instead, unauthorized and excessive disbursements were made from the attorney trust account where more than $1 million in mortgage loan funds were wired – with Stetch writing the majority of the disbursement checks and Schwartz writing all checks that were payable to himself and a few other checks.

Recently we spoke to you about mistakes made by a chain pharmacy in dispensing the wrong medication to a child. This week we’d like to discuss another at risk group when it comes to medication—older adults.

Whether you’re a full time caregiver to your parents, a volunteer in a senior service program or you just help out an aging aunt or uncle from time to time, part of that responsibility is likely helping them get their medications.

Older adults use more prescriptions than any other age group in the country. In fact although they comprise roughly 13% of the population, they use at least 34% of all prescription medication.

TSA Publishes National Framework for Transportation Security

Cusenza The Transportation Security Administration on Monday announced the publication of the Public Area Security Summit National Framework – a set of recommendations jointly developed with industry, government, academic, international, and public officials that enhance security in public spaces at airports and throughout the transportation system.

According to the TSA, the development of the national framework commenced in mid-September 2016 with the first in a series of Public Area Security Summits, commissioned in response to the atrocities at Brussels International Airport and Istanbul Ataturk Airport, that highlight the evolving tactics and techniques that adversaries use to attack civilian targets in public areas. This threat was further amplified, the agency said, after the Jan. 6, 2017, attack at Ft. Lauderdale International Airport. The group of industry, government, academic, international, and public officials worked together to leverage an

entire network of transportation and security officials to devise a framework that deters terrorist attacks and creates a system that quickly and effectively responds to attacks in the public area to minimize loss of life and disruption of transportation.

“In the past, we focused on deconflicting various security efforts in the public area,” according to the analysis. “Now, with a comprehensive framework, we can align, synchronize, and integrate multiple security-focused agencies and programs that enable the protection of the public area. Each airport or transportation venue will be different, but the approach will be the same.

Partnerships informed by awareness of connected efforts throughout the transportation system are the key to success in the public area.”

The 25-page report lists three tenets – Information Sharing, Attack Prevention, Infrastructure & Public Protection – as key to the framework, and details 11 recommendations for handling public safety at transportation hubs within those tenets, including: Cultivate Relationships;

Additionally, the analysis delves into the “Way Ahead,” and how to implement framework going forward.

“The partnerships established by the Public Area Security Summits do not cease with this framework,” the report says in its final section. “The group is committed to engaging and collaborating with partners, which includes identifying organizations or individuals who have not traditionally been incorporated into either aviation or other transportation security plans. Meetings will continue, in order to affirm partnerships and continue reviewing solutions to improve public area security. Our work continues.

“As aviation is a global industry, airport stakeholders around the world continue to grapple with the multiple challenges of landside security. DHS, along with industry association partners, plans to create and maintain regular forums for U.S. and international counterparts to communicate and strategize regarding best practices and lessons learned in landside security. Discussions between U.S. and international airport managers are already occurring as a result of the Public Area Security Summits.”

City Collected Nearly $1 Billion in Fines in 2016: Comptroller Report

By Forum Staff The City collected $993 million in fines in Fiscal Year 2016, a record high for fine collection and a 16-percent increase since FY 2012, according to new data released by Comptroller Scott Stringer.

The largest category of fines is parking violations, but Stringer said the rise was fueled by a spike in quality of life violations. The City issued nearly 700,000 quality of life violations in FY 2016 – up 51 percent since FY 2013 and generating a total of $184 million. Parking violations accounted for 55 percent of all revenues from fines in FY 2016, now reaching $545 million, the comptroller said.

“Fines are an important tool to discourage behavior that can be harmful to others, like with Vision Zero. At the same time, with the cost of living rising and rents soaring, New Yorkers feel squeezed, and unnecessary fines or overlyaggressive enforcement don’t help,” Stringer added. “We release this data to deliver transparency, and to find out where we can improve. We have to keep working to strike the right balance between effective enforcement and not overburdening our residents.”

ON THIS MOTHERS DAY Last Friday, the City Police Department did what it does every year at this time and solemnly celebrated the lives of officers who sacrificed everything for the five boroughs. Thirty-four deceased members of the service were posthumously honored this year in a ceremony inside the Hall of Heroes at 1 Police Plaza.

“This is the most we’ve had in any given year and it’s too many,” said Police Commissioner Jim O’Neill. “But even one would be too many. Every name here is a precious life. Every name is a person who loved – and was loved by – his or her family, their friends, and their brothers and sisters in blue.”

The 105th Precinct in Queens Village also organized a beautiful ceremony, on Thursday, May 4, marking the two-year anniversary one of the darkest days in the history of this borough: the murder of beloved Det. Brian Moore.

On May 2, 2015, Moore was shot in the face in Springfield Gardens after asking a suspect what he was fidgeting with in his waistband. His family decided to take him off life support two days later.

Last week, Moore’s command dedicated a Memorial Wall inside the 222nd

Street stationhouse featuring the young lawman’s plaque alongside those of three other members of the 105th Precinct who gave everything for the World’s Borough.

Patrolmen’s Benevolent Association President Patrick Lynch delivered stirring remarks that, in large part, were directed toward the families of all fallen officers.

“It doesn’t get easier, the pain doesn’t go away…I wish I could tell you that it will, but it won’t,” Lynch said. “But the

courage you show each and every day to be here with us; the courage you show to sit in a court room and face down his killer – that courage gives the cops out in the street the courage to get in that radio car when the call comes in.”

After that, it was Irene’s turn. It was Det. Moore’s mom’s opportunity to speak about her hero son.

“Anyone who has met my son knows Brian’s smile – his great, big smile,” she began, “and that smile mirrored his great, big heart. The capacity he had to love life, to love to laugh, his wonderful, winning personality will never be destroyed by any bullet. Brian has changed countless lives forever. And because of this, we are able to stand strong, all of us.”

Irene ended her remarks with a quote from former President Ronald Reagan.

“Wherever a beautiful soul has been, there is a trail of beautiful memories.”

And so, on this Mothers Day, Sunday, May 14, we ask you please to remember Irene and all of the mothers of slain New York City police officers. Their unimaginable pain may be eclipsed only by their incomprehensible strength.
