State Suspends Liquor License of Richmond Hill Bar that Violated Emergency Shutdown Order

By Michael V. Cusenza The State Liquor Authority has suspended the license of a Richmond Hill bar that was found operating “in flagrant violation” of Gov. Andrew Cuomo’s executive order to cease on-premises sales of food and alcoholic beverages to combat the spread of the coronavirus, agency officials announced Friday.

According to the SLA and City Police Department, on Wednesday, March 18, cops discovered New Oriental Guyana Restaurant Inc., at 115-22 Liberty Ave., in full operation with approximately 40 patrons inside, ignoring not only the clear directives of the governor, but also a warning from NYPD officers the night before to cease operations.

Police report the bar attempted to avoid detection by functioning in quasi-speakeasy fashion: closing the rolldown gate at the front entrance to the premises and slipping patrons in through a rear alley door.

As soon as Prohibition went into effect in 1920, law enforcement agents began shutting down bars and clubs across the country.

However, the ban on alcohol didn’t keep people from seeking it out, and almost as quickly, “speakeasies” began to emerge, according to American Addiction Centers. Speakeasies, often located in underground dens or dark saloons that did not draw much attention from the outside, were illicit establishments that sold alcoholic beverages.

On Friday, the SLA charged the New Oriental Guyana Restaurant, which remained shuttered this week, with multiple violations, including for its failure to comply with Cuomo’s executive orders concerning coronavirus restaurant restrictions and for its failure to supervise the licensed premises.

cy action. When the SLA summarily suspends a license, it also serves a Notice of Pleading alleging one or more disciplinary violations. In invoking a summary suspension, the SLA has deemed the violation to be sufficiently serious upon initial review to warrant an immediate suspension.

The U.S. Army Corps of Engineers has recommended four initial sites in New York for locating temporary hospitals: the Jacob K. Javits Convention Center, and locations at SUNY Stony Brook, SUNY Old Westbury and the Westchester Convention Center, Gov. Andrew Cuomo announced Saturday.

Upon Cuomo’s determination, the USACE is expected to immediately begin work to construct the temporary hospitals. The governor is also requesting that the Federal Emergency Management Agency designate four field hospitals with 250 beds each for the state, intended for use in the Javits Center in Manhattan in addition to the temporary hospital to be constructed by the corps.

The licensee is entitled to an expedited administrative law hearing before an administrative law judge. An order of summary suspension remains in effect until such time as it is modified by the SLA or

Javits Convention Center in Manhattan, locations at SUNY Stony Brook and SUNY Old Westbury on Long Island, and the Westchester Convention Center—had to disappoint at least one area elected official.

Assemblywoman Stacey Pheffer Amato (D-Howard Beach) recently penned a letter to Gov. Andrew Cuomo supporting his request for federal assistance to build more hospital beds, and to expand the existing capacity of hospital beds in the five boroughs. The missive also requested that the first new beds and capacity increase come to Rockaway.

Pheffer Amato noted that Assembly District 23 has more adult homes and nursing homes than any other district in New York

State. St. John’s Episcopal Hospital is the only hospital servicing the Rockaway Peninsula, and the nearest Level 1 trauma center is Jamaica Hospital Medical Center in Richmond Hill.

“My constituents face a number of difficult circumstances which make fighting the spread of an illness like the coronavirus especially challenging,” Pheffer Amato wrote in her March 16 message to Cuomo. “Here in Rockaway, we have a particularly vulnerable population which includes over 12 adult homes and 16 nursing homes, we are geographically isolated from most healthcare services, and we have only one hospital which has already taken in a confirmed coronavirus patient. It is imperative that our community has access to an increased capacity of hospital beds, hospital personnel, and medical resources in order to fight the spread of this illness.”

By Michael V. Cusenza The City could lose between $4.8 and $6 billion in fiscal years 2020 and 2021 due to the ripple effects of the coronavirus pandemic on Gotham’s economy, according to updated economic analysis released Monday by City Comptroller Scott Stringer.

The range of the estimate depends on the severity and duration of the pandemic, and the duration and extent of the resulting economic shutdown, Stringer noted.

His analysis forecasts a very sharp decline in specific sectors from March through the end of June, particularly in hotels, restaurants, retail and the cultural sector, as earnings collapse and unemployment soars.

The comptroller’s analysis outlines two economic scenarios for New York City in FY2020 and FY2021 and estimates lost tax revenue from personal incomes, sales, hotels, real property transfers, businesses’ incomes, and other taxes.

In a more moderate scenario, the measures taken to contain the spread of the COVID-19 virus are successful and the shutdown of the economy would essentially end

by May. There would be relatively limited impacts on sectors outside hotels, restaurants and retail. This scenario predicts a tax revenue loss of $1.28 billion in FY2020 and $3.5 billion in FY2021 totaling $4.8 billion, which would be a 2-percent decline in FY2020 and 5.4-percent decline in FY2021.

The higher-range scenario presumes the state of emergency lasting at least into June or July, with a slower recovery to normal economic activity, and larger impacts on other sectors of the economy. This scenario envisions a tax revenue loss of $1.5 billion

in FY2020 and $4.6 billion in FY2021 totaling $6 billion, which would be a 2.3-percent decline in FY2020 and a 7-percent decline in FY2021.

“The COVID-19 pandemic is already putting enormous financial strain on our City’s workers as millions of New Yorkers grapple with the uncertainty of their next paycheck, paying rent, and taking care of their families. At the same time, the massive slowdown of our City’s economy is going to result in substantial losses of the tax revenue that keep this city running,” the comptroller said. “Our economic forecast highlights the significant financial pressure on our City’s coffers. We are staring down a fiscal emergency and need the federal government to step up by injecting as much funding into our city’s economy as possible—our healthcare system, infrastructure, transit network, and so much more depend on it. And our City government must act immediately to protect our fiscal position so that we can continue to provide vital services for our most vulnerable New Yorkers in the face of this emergency.”

In order to weather the coming economic downturn, Stringer has urged City Hall to immediately identify savings in agency budgets.

“I commend the mayor for taking this step to mandate finding savings across agencies. The vital services for our most vulnerable populations and institutions during the economic fallout of COVID-19 will depend on responsibly saving today, as will the level of relief our City can deliver to the hotel, restaurant, entertainment, social service, and retail workers who are bearing the brunt of this crisis,” the comptroller added.

EDITORIAL Six Feet Apart Or Six Feet Under Now that the toilet paper shortage has become a part of our everyday conversation, it seems that we need to make room for another shortage in our vocabulary. There seems to be a shortage of tape measures as is obvious by the alarming number of people who do not seem to understand what 6 feet of distance means.

Now while the old adage “Ignorance is bliss” might be one that we are most familiar with, the pandemic situation in today’s world calls for a modification––“Ignorance brings sickness and death.”

SIX FEET APART OR SIX FEET UNDER. This is not a punishment assigned by the government; it’s a fact of life, which can turn into a fact of death.

We realize we are expressing this sentiment in somewhat harsh terms. But it’s not too much news or Google and falling prey to many of the vast inaccuracies on the information highway about this virus that leads to this stern expression.

It’s me, driving around the neighborhoods this newspaper has served for more than 40 years, and observing from the windows of my car the behaviors of people, despite the flood of warnings––backed by science.

On Liberty Avenue, three women, most likely a mother and two teenage daughters, huddled together while walking on the deserted stretch–– none wearing gloves, a mask, a scarf or anything else remotely protective, passing a water bottle between them.

Or how about the four young people on the corner of hugs. Again—no masks, no gloves, no 6 feet.

And what about the two men, standing and waiting 92nd Street and 157th Avenue in Howard Beach who encounter each other and exchange a series of handgrips and for a bus on Cross Bay Boulevard in a bus shelter? One

is smoking and the other apparently asks for a light. The smoking man takes the cigarette from his mouth and passes it to the other one who lights his cigarette and passes it back at which point the other guy takes back his cigarette and puts it back in his mouth. I wonder whom those two wizards were going home to…

While there are really no words to describe these types of individuals, fortunately there are words to describe other people around our communities: Selfless, dedicated, determined, compassionate–– the list of adjectives for them goes on and on.

People who are working tirelessly so that those needing help get it. The full compliment of first responders, every nurse, doctor, technician, and physician’s assistant in our hospitals. They are risking their lives for us all the while that careless and selfish individuals do nothing to stop the stem of the virus.

Then there are the unsung heroes. They are people who are cooking for elderly neighbors and leaving packages outside doors. They are people who are working in supermarkets pulling orders and preparing them for delivery.

They are people behind the counters in pharmacies, getting medications and healthcare supplies prepared. They are drivers for UPS and FedEx and Amazon delivering essentials people can’t otherwise get. They are to be thanked, praised and appreciated.

The least we can do for these people is show them the respect and the love they deserve from all of us to in some way repay their sacrifices.

Get smart people. Be home. Be safe.

By Forum Staff To help keep borough residents and families prepared for the ongoing public health and economic emergency during the coronavirus pandemic, the Borough President’s Office and FreshDirect are partnering for “Operation 5-Borough Food Drive,” Acting Borough President Sharon Lee announced Tuesday.

Beginning Tuesday, March 24, and for the next four weeks, 400 grocery boxes a day prepared by FreshDirect will be picked up by participating Queens communitybased organizations to distribute amongst their constituents, including seniors, lowincome families, and other vulnerable populations across all 14 Queens community districts. The Port Authority of New York and New Jersey will assist with transporting some of the bulk grocery boxes to limited CBOs, Lee noted.

Quiet Queens: The Bustling World’s Borough Shutters as Pandemic Fallout Continues

Officials Emphasize Support for Small Businesses amid Economic Fallout of Coronavirus

By Michael V. Cusenza Over the past three weeks, small businesses across the city have been absorbing an economic beating the likes of which most, if not all, have never experienced.

And so, elected officials on all levels have been urging administrations to direct robust financial support to these hard-hit establishments.

On Thursday, City Comptroller Scott Stringer penned an open letter to small business owners detailing what governments must do to help small businesses survive, recover, and rebuild in the economic fallout of the coronavirus pandemic.

“We need to act now to protect our workers and our economy. I urge the City to immediately take the following steps to provide urgent relief to our small businesses: Suspend all collections of outstanding small business fines for six months; Automatically renew all licenses and permits (liquor licenses, sidewalk café licenses, Health Department permits, etc.) without payment of fees, for the next three months; Suspend payment of the Commercial Rent Tax for two months for ground-floor retail businesses with demonstrated business losses; Expand the City Department of Small Business Service’s no-interest loan program to include any business of up to 100 employees that has experienced a significant quarterly decline in revenue, and increase the maximum loan amount to $150,000; Enact immediately legislation capping delivery platform fees at 10 percent. Deferring fees, as GrubHub and others are doing, is simply not good enough, and is taking advantage of businesses that are already struggling to just survive; And in addition, the State should consider a limited sales taxes holiday for all restaurants, hotels, and street-level retail stores.

“Once the public health is stabilized and businesses are allowed to re-open, the State and City should join to create a “ReStart” loan and grant program to help small independent businesses that have closed temporarily to re-open their doors, re-hire their workers, and welcome back their customers,” Stringer wrote.

The comptroller noted that the above measures would cost the City and the State millions of dollars in lost revenue, on top of the projected lost sales, income, and other tax revenues caused by the current crisis— at least $3 billion in the next six months— and likely more as long as the fight to contain the pandemic continues.

“Our small businesses, our arts community, and our cultural organizations are core to our economy and our identity as a city,” Stringer concluded his missive. “Our workforce is the best in the world. I urge all levels of government to act now to make sure that we can recover and rebuild—stronger

According to Johnson, the components of the plan include: Institute a temporary universal basic income: New York’s economy needs an immediate boost. Even if current federal proposals for immediate payments of $1,000 or $2,000 to Americans pans out, the impact of those dollars is far less in New York than almost every other city in the country, Johnson noted. Under the Council’s proposal, every Gotham resident would get money in their pocket—$550 for each adult and $275 for each child.

Provide extra help for impacted New

Yorkers: Unemployment insurance is a critical safety net, but it doesn’t provide enough support and doesn’t cover enough workers, Johnson said. Right now, unemployment helps less than half the unemployed and provides people with less than half of what they need.

“To truly provide comprehensive coverage, we must temporarily expand eligibility for unemployment to freelancers, gig workers, and those who have had their hours reduced. This plan would also temporarily enhance benefits for everyone by 30 percent,” Johnson wrote. “To do so, we would also need to shore up New York’s unemployment insurance trust fund, which started the year with a balance of $2.6 billion. With this massive surge in workers applying for benefits and fewer businesses paying in, the

fund won’t hold out long. Under this proposal, we can continue providing benefits without depleting the trust fund.”

Cover fixed costs for businesses: The City needs to make sure that impacted small businesses are able to survive until a return to normalcy, Johnson said. Businesses have certain bills that need to be paid whether or not they’re operating—rent, utilities, loan payments, insurance, and taxes. Getting cash in their hands during this crucial period is essential, the speaker noted.

To do this, the City must: Immediately defer sales and use taxes due in March, as well as the commercial rent tax and business taxes; institute penalty-free deferment of the collection of City fees, such as sidewalk cafe fees and permit renewal fees.

For many businesses, that will mean an instant influx of thousands of dollars; build on the City’s small business loan program by expanding eligibility to reach more businesses and increasing the maximum loan amount to $250,000.

“These should be structured as zerointerest loans, but the City, with the help of the federal government, should be prepared to forgive some of this debt if it’s necessary to keep businesses afloat,” Johnson wrote. “All these programs must also be expedited to get money out the door as quickly as possible to help prevent permanent closures and save jobs.”

Johnson is calling for the plan to be paid for by the federal government. If the federal government fails to step up, it can be funded by bonds. The City has a history of selling bonds to rebuild its economy after a disaster, including after the terror attacks of Sept. 11, 2001.

The NYPD will be out in neighborhoods across the city to ensure compliance with new outbreak activity policies, Police Commissioner Dermot Shea noted.

By Forum Staff Mayor Bill de Blasio on Sunday announced new guidelines related to the coronavirus outbreak that City authorities are set to enforce.

Effective Sunday night, the City began to enforce the closure of all non-essential businesses in the five boroughs, pursuant to State regulations. Only businesses with essential functions will be permitted to operate. Examples include grocery stores, pharmacies, internet providers, food delivery, banks, financial institutions and mass transit. Businesses that provide essential services must implement rules that help facilitate social distancing. The NYPD will be out in neighborhoods across the city to ensure compliance with these policies, Police Commissioner Dermot Shea noted.

The City is also enforcing the following rules for non-vulnerable individuals with fines and mandatory closures, according to the mayor: no non-essential gatherings— any concentration of people outside their home must be limited to workers providing essential services; practice social distancing in public (6 feet or more); limit use of public transportation to only when absolutely necessary; sick individuals should not leave home except to receive medical care.

Correctional Health Services is now screening detainees before entering and leaving City jail facilities, de Blasio also noted. Those who manifest symptoms while attempting to enter will be isolated from the general population. All staff will be screened before entering, as well. To ensure the Correctional Health Services is able to adequately house detainees with COVID-19, the Department of Correction is utilizing its communicable disease unit and is opening additional housing units to expand spaces for isolation and increase social distancing.

The has already banned team sports and

revoked all permits for organized sports and large gatherings, and has increased the presence of NYPD and Parks Enforcement Patrol officers to enforce social distancing. The City is closely coordinating with the State to evaluate these efforts and will consider expanded restrictions as necessary, the mayor said.

Signage will be by NYC Parks at all fields and courts to indicate that all tournaments and sports practices have been cancelled. In addition, Parks has closed all nature centers and recreation centers, and many concessions including ice rinks, amusement parks, carousels, indoor tennis facilities.

Playgrounds run by the Parks Department remain open to provide children with solitary, active recreation. It is critical to practice social distancing among people who do not live in the same household while playing on the playground, de Blasio emphasized. Playgrounds will be monitored by the NYPD and Parks Enforcement officers, and new signage will warn parents and guardians to maintain social distancing among children. Over the next week, the Parks Department will evaluate compliance and adopt more stringent rules if needed.

By Forum Staff In the midst of the coronavirus pandemic, the Queens District Attorney’s Office has implemented massive changes to ensure good health for its staff and “swift justice for defendants during this unprecedented time,” DA Melinda Katz said Wednesday morning.

Katz noted that the Office has set up office workstations with access to Skype for Business so that Assistant District Attorneys can virtually arraign defendants without being physically present and putting their health at risk. All arraignment proceedings have shifted from in-person court appearances to fully virtual appearances. The same applies to Supreme Court matters. An All Purpose Part will entertain all felony matters going forward including Supreme Court arraignments, pleas, and sentencings. A second Supreme Court Part will serve as a Youth Part where adolescent offenders will have their cases adjourned for a six-day review after they are arraigned.

Additionally, Katz said that over the past few days a panel of nearly a dozen prosecutors has been working to identify defendants, “who in light of the COVID-19 pandemic and in the interest of justice,” should be released from Rikers Island. The

panel is considering each defendant’s age, criminal history, the remaining time on their sentence, and the defendant’s current health condition in reaching a determination. The panel has also reached out to the victims of the crimes committed by these defendants to consider their positions in making recommendations before presenting its findings to the Katz for her final decision. While the process of release is ongoing, so far the DA has determined that approximately 30 defendants should be released from the island.

In the coming weeks, Katz concluded, her Office “will continue to provide the essential services necessary to keep Queens County’s residents safe while we do everything possible to avoid COVID-19. Therefore, we are operating within the office with a skeletal crew while most of our employees work remotely from home.”

As you might imagine the news released about the possibility of treatment with the drugs Hydroxychloroquine and Chloroquine for Covid-19 has caused a frenzy among people suffering with the disease and those afraid of being stricken.

We would like to use this space for the week to tell you whatever we know about how soon, if ever, these drugs will be available to the public.

At this point, pharmacists cannot fill prescriptions for either of these drugs because the FDA has not yet approved their use in the fight against Covid-19.

On Tuesday, Gov. Andrew Cuomo said, New York moved to begin trials, procuring 70,000 doses of hydroxychloroquine and 750,000 doses of chloroquine. In addition, Bayer, the drug maker, has donated 3 million doses of Resochin, its brand name for chloroquine, to the federal government.

According to the CDC, Chloroquine is used to treat malaria, as well as in chemoprophylaxis, which is the administering of drugs to prevent the development of disease.

Additionally the World Health Organization includes it on its list of “essential medicines,” meaning it should be kept affordable and accessible at all times.

Hydroxychloroquine is an analog of chloroquine, meaning the two have similar structures but different chemical and biological properties.

Hydroxychloroquine is less toxic than chloroquine.

It’s given to patients with rheumatoid arthri-

tis, lupus and other autoimmune diseases.

Hydroxychloroquine is being studied to determine if it can prevent Covid-19 before or after a patient is infected with the SARS coronavirus strain that causes it, and if it can be used as a treatment for Covid-19.

There has also been much conversation about the two drugs being used as a component of a “cocktail” along with the antibiotic azithromycin (commonly known as a Z-pack) and Medrol, which is a steroid dose pack.

In theory, the z-pack would fight off the respiratory complications associated with pneumonia and Medrol combats inflammation and swelling of the lungs which make it difficult to breathe.

The CDC said the combination can disrupt the heart’s electrical activity and warns against prescribing the paired drugs to anyone with chronic medical conditions, such as renal failure or hepatic disease.

Chloroquine has serious side effects, which occur primarily over long-term use, but some side effects can appear at the onset of taking the drug including irregularities in heart rate and palpitations, which would subside upon discontinuance of the drug.

Essentially, we must wait for information to come in from the trials and we certainly have great hope that our answers to combat this virus will be found in the results of these trials. For now the best “medicine” for all is the safety of our homes.

MTA, Facing ‘Financial Calamity,’ Pleads for $4B in Federal Aid

Cusenza The Metropolitan Transportation Authority recently sent a letter to the New York Congressional Delegation urgently requesting more than $4 billion in federal aid as the agency continues to respond to the coronavirus pandemic. “[T]he stark reality is that as more people stay home following the advice of medical experts, the MTA is now facing financial calamity,” MTA Chairman and CEO Pat Foye wrote.

According to Foye, the MTA continues “to operate our subways, railroads, buses, and Access-A-Ride services around the clock, helping to get essential employees—medical professionals, childcare workers, first responders, public utility employees, our transportation workers—where they need to be. We’ve substantially increased the intensity and frequency of cleaning protocols across the system, disinfecting all stations and touchpoints twice a day. on a 72-hour cycle – except for Access-A-Ride vehicles serving the disabled, which are sanitized daily. Whatever the cost, the MTA’s first priority is protecting the health of our customers as well as the brave MTA employees who continue to show up for work—as they have done after past emergencies like 9/11 and Superstorm Sandy.”

However, ridership has fallen approximately 60 percent on the subways, 49 percent on buses, 90

percent on Metro-North and 67 percent on Long Island Rail Road, Foye noted.

“As a result, MTA revenue has plummeted as we provide these essential services. We project the full impact will be over $4 billion by the end of 2020—even without accounting for the expected collapse of the more than $6 billion in State and local taxes dedicated to the MTA,” Foye added.

For those reasons, the agency is requesting federal aid at the

level of MTA revenue losses ($3.7 billion assuming recent ridership trends continue for six months) and coronavirus expenses (approximately $300 million annualized).

In other public transportation news, MTA New York City Transit, Transport Workers Union and Amalgamated Transit Union announced a new rear-door boarding policy on all buses, beginning on Monday, March 23.

Customers will board and exit

all local and Select Bus Service buses using the rear doors. Express bus customers will board as normal, but will not be permitted to sit in the first three rows of the bus to ensure customers are a safe social distance from bus operators. ADA customers will still be permitted to board at the front of all local and SBS buses, and board as usual on express buses. Regular fare policy remains in effect wherever on-board payment boxes or SBS off-board ticket machines continue to be accessible.

“While Gov. Cuomo has ordered non-essential workers beginning Sunday night to remain in their homes and not take mass transit, we are taking aggressive action to protect our thousands of frontline employees who are delivering a critical service to New York, moving the healthcare workers, first responders, utility workers, and essential employees who are protecting us from this public health crisis,” Foye said Friday.

“Transit workers are the lifeblood of this city and region and we are going to do everything we can to protect their health and safety.”
