Army Engineers Cite Lack of Funds in Suspension of Critical Coastal Storm Risk Management Study

By Michael V. Cusenza The U.S. Army Corps of Engineers recently acknowledged that it has indefinitely suspended the vital New York-New Jersey Harbor and Tributaries Coastal Storm Risk Management Feasibility Study due to lack of funding.

The analysis focuses on developing measures to manage future flood risk in ways that support the long-term resilience and sustainability of the N.Y.-N.J. coastal ecosystem and surrounding communities, and reduce the economic costs and risks associated with flood and storm events such as Superstorm Sandy.

However, the study lost out to other priorities in the USACE budget, agency spokesman Michael Embrich said in a Newsday report.

By Michael V. Cusenza A South Ozone Park man has been charged with raping a woman at knifepoint earlier this month inside the Richmond Hill spa in which she is employed as a masseuse, Queens District Attorney Melinda Katz announced Thursday.

Luchiano Crooks, 26, was arraigned on a complaint charging him with first-degree

rape, first-degree robbery, and criminal sex act in the first degree. Bail was set at $100,000 bond/$50,000 cash/$500,000 partially secured bond.

According to the complaint, on Monday, Feb. 17, at approximately 4:50 p.m., Crooks entered the Vivi Massage Spa at 134-10 Jamaica Ave. and asked for a massage. He was told to go to room #2 by the staff. When the victim, a 45-year-old female masseuse, entered room #2, Crooks allegedly displayed a knife and demanded money. The victim turned over $100 in cash to him and then Crooks allegedly raped her at knifepoint before fleeing the scene.

“Thankfully the video surveillance that captured this defendant was crucial in locating his whereabouts,” Katz said. “This alleged culprit has now been apprehended and will be prosecuted for raping this unsuspecting woman.”

It seems that Crooks has a history of violence toward women. Eight years ago, when he was just 18, Crooks pleaded guilty to first-degree sexual abuse, a felony defined as touching of the sexual or intimate parts of another person for sexual gratification without that person’s consent. According to court records, Crooks got 10 years’ probation and agreed to abide by a final order of protection for 8 years.

If convicted of the Feb. 17 attack, Crooks faces up to 25 years in prison.

In the missive, Stringer castigated the corps’ proposal for not adequately protecting coastal communities from the threat of sea level rise and associated flooding. The comptroller’s letter also highlighted the long construction timeline associated with

the storm barriers and their high cost estimate — noting that the largest of the options outlined in the proposal would take a quarter of a century to build out, cost six times that of shorefront resiliency options, and endanger the delicate ecosystem of the harbor including the region’s network of marshes and wetlands that are critical to mitigating storm surge.

Stringer called on the corps to implement an integrated and environmentally-conscious approach that’s focused on onshore resiliency measures including localized floodwalls, dune and wetland restoration, living shorelines, reefs, and levees. Stringer’s message pointed out that this approach was the only way to protect the city from rising sea levels, storm surge from noncatastrophic weather events, and increasingly catastrophic storms in the future.

In October 2012, Superstorm Sandy eviscerated parts of the city, especially Howard Beach, Broad Channel, and the Rockaway Peninsula, leaving 43 fatalities and more than $20 billion in damages in its wake.

Armored Car Heist Culprits Sentenced

By Forum Staff The three men who pleaded guilty last year to stealing an armored car on Long Island and absconding with its lucrative contents have been sentenced to federal prison, prosecutors recently announced.

In a Central Islip courthouse last week, Richmond Hill residents Raymond Soto, Sr., 49, and Raymond Soto, Jr., 29, and Alexis Laguerra, 32, who lives in Brooklyn, were sentenced to 30 months, 33 months, and 18 months in prison, respectively, for bank larceny in connection with the theft of more than $500,000 from an armored car on Nov. 2, 2018, in Valley Stream.

The three defendants were also ordered to pay forfeiture of $300,000, and restitution of $510,000 to GardaWorld, owner of the armored car.

According to prior guilty plea proceedings, Laguerra, an employee of GardaWorld, used his insider’s knowledge of the company to plot and carry out the theft. Laguerra was the assigned GardaWorld driver for the overnight shift and left the armored car unoccupied and unguarded outside an HSBC Bank branch on Sunrise Highway. Soto Jr.

Soto Sr., driving a getaway car, picked up Soto Jr. and the cash and fled. Law enforcement executed a search warrant at the Sotos’ 91st Avenue residence and recovered $131,000 in cash packaged in the same manner as cash is packaged by GardaWorld.

Authorities also allegedly found a gun, ammunition, and a quantity of marijuana and cocaine in the Sotos’ apartment.

Ban on Plastic Bags Begins March 1

The plastic bag ban goes into effect this Sunday.

By Forum Staff A statewide education and outreach campaign has been launched to ensure that New Yorkers are aware of the Sunday, March 1, ban on single-use plastic bags, Gov. Andrew Cuomo announced Thursday.

According to the administration, the State Department of Environmental Conservation’s BYOBagNY campaign, includes TV and radio advertisements, social media, Google Ads, and events hosted by Feeding New York State food banks across the state. As part of this effort, DEC is also distributing more than 270,000 reusable bags with a focus on low- and moderateincome communities.

Additionally, the DEC is bolstering its ongoing outreach to stakeholders and industry associations, including the Food Industry Alliance, the Retail Council, the New York Association of Convenience Stores, and partnering with State agencies to distribute reusable bags and elevate the BYOBagNY message. DEC is also providing its nine regional offices with BYOBagNY educational materials for use as outreach at public events and is working with New York State Department of Taxation and Finance to coordinate cross-agency efforts related to clear communication of the law entities required to collect state sales tax.

Earlier this month, DEC released final regulations to implement the State Plastic Bag Waste Reduction Act. After a review of the approximately 2,500 comments received from stakeholders and communities during the 60-day public comment period and hearing, these final regulations will be published in the State Register on Wednesday, Feb. 26, 2020. DEC updated the pro-

posed regulations that were released in November 2019 based on the comments received from the public to include minor refinements in keeping with the overriding objective of the act to reduce plastic bag waste.

According to the administration, New Yorkers use an estimated 23 billion plastic bags annually—each for about 12 minutes—and approximately 85 percent of this total ends up in landfills, recycling machines, waterways, and streets.

“Right this minute, plastic bags are hanging in trees, blowing down the streets, filling up our landfills and polluting our lakes, rivers and streams—all hurting our environment,” Cuomo said. “Twelve million barrels of oil are used to make the plastic bags we use every year and by 2050 there will be more plastic by weight in the oceans than fish. We took bold action to protect our environment and ban these environmental blights and with this campaign we’re going to make sure New Yorkers are ready and have all the facts.”

Cuomo signed legislation to ban the sale of single-use plastic bags in the Empire State on Earth Day, April 23, 2019.

“New York continues to be a national leader on environmental issues, and the plastic bag ban is the latest in a series of actions Gov. Cuomo has directed to preserve our air, land, and waters for future generations,” DEC Commissioner Basil Seggos added.

DEC officials have indicated that the agency will continue to focus its outreach and education efforts to ensure a smooth transition for consumers and affected retailers, with enforcement to follow in the months ahead.

EDITORIAL Clear Vision Finally—the City’s Vision Zero has some teeth.

Mayor Bill de Blasio on Wednesday signed the Dangerous Vehicle Abatement bill into law. Introduced

by City Councilman Brad Lander (D-Brooklyn), the measure passed the council with an overwhelming majority.

That’s because it contains common-sense protocols and punishments that actually fit the crimes.

The new law establishes a Dangerous Vehicle Abatement Program and targets the most reckless drivers by allowing the City to seize and impound vehicles with 15 or more school speed-camera violations or five or more red-light camera violations during a 12-month period unless the registered owner or operator completes a driver accountability course overseen by the City Department of Transportation.

If an owner fails to complete the course, their vehicle may be seized and impounded by the City Sheriff.

Officials estimate that the new law will affect about 3,000 to 6,000 vehicles, or less than 1 percent of

the nearly two million vehicles registered in the five boroughs. The law will take effect on Wednesday, Feb. 26, 2021, and apply to red-light camera and school speed-camera violations incurred after Oct. 26, 2020. The program will run for three years, at which point the may-

“Today we are taking a big step forward to make our streets safer,” Lander said on Wednesday. “The Dangerous Vehicle Abatement Program will be the first in the country to hold owners of the most danger-

ous vehicles accountable for the impact on the safety of their neighbors.”

City school zone speed cameras issue violations to vehicles traveling more than 10 miles per hour over the posted speed limit. Both speeding and red-light violations

carry a $50 fine. DOT currently operates more than 600 speed cameras in school zones around the five boroughs. By the end of 2021, the number of cameras across the city is expected to reach 2,000. The city also operates red-light cameras at 150 intersections.

DOT Commissioner Polly Trottenberg called the new law “landmark legislation,” and “a monumental step forward for Vision Zero.”

“We know that vehicles with the highest number of red-light and speed-camera violations are significantly more likely to be involved in serious crashes,” she added. “Through an unprecedented program of education and enforcement, including the possible loss of a vehicle, this new law will help us change driver behavior so we can keep driving down traffic deaths and serious injuries.”

Councilman Ydanis Rodriguez (D-Manhattan) praised the new law for ensuring “that only the safest drivers remain on the road,” and for creating “a deterrent for drivers who refuse to correct their actions.”

Cuomo Launches Campaign to Ban Flavored Nicotine Vaping Products

By Michael V. Cusenza Governor Andrew Cuomo on Thursday launched a new campaign to ban all flavored nicotine vaping products, including menthol flavors, and to restrict vaping advertisements aimed at youth in the Enacted Budget this year.

Cuomo’s proposed legislation would authorize the State Department of Health to regulate the sale of vaping product carrier oils deemed to be a public health risk.

The measure would also prohibit the online, phone, and mail-order sale of e-cigarettes; only registered retailers would be allowed to purchase e-cigarettes using those methods.

“The dangers of vaping and flavored e-cigarette products are becoming more apparent by the day, and it would be a tragedy if our successful efforts to combat the tobacco industry were reversed by allowing the vaping industry to get a whole new generation hooked on their products,” the governor said. “This is a scourge on our state and our nation: If these chemicals don’t kill you, you wind up addicted to nicotine.”

Cuomo noted that the campaign includes a new hashtag— #NoVapeNY—as well as a petition where New Yorkers can show their support for the legislation, and a new website—ny.gov/endvaping—with more information about the proposals.

Cuomo on Thursday also announced that he will visit states that have legalized cannabis programs to learn more about them

to help inform his efforts to pass similar legislation in the State Budget this year.

According to the governor, the announcement builds on the regional cannabis regulation and vaping initiatives previously announced with Connecticut, New Jersey, Pennsylvania, Rhode Island and Massachusetts to establish a set of core principles on issues related to market regulation

and empowerment; public health; public safety and enforcement; and vaping best practices.

“The conclusion is we want to coordinate our laws the best we can. In other words, you don’t want New York competing with New Jersey, you don’t want New York competing with Connecticut. You don’t want people driving to New Jersey, because they can get more in New Jersey, or a

higher percentage in New Jersey, or they have a different age in New Jersey, or a lower tax rate. So, it’s regional coordination,” Cuomo said. “But then if you look at what has happened in states that have done it, about 11 states have legalized marijuana. Everybody talks about the goals—we want a social equity component, we want to make sure it’s policed. They have all these goals, but many of the programs once they’ve been implemented and they went back and looked, they didn’t meet those goals.”

That’s why he’s planning the visits to states that have legalized It, Cuomo noted.

“I want to make sure we learn from them. We have the regional coordination piece. We are the first state that has really been looking through that lens,” he added. “I now literally want to go to California, Illinois, Massachusetts, sit with them—What was your plan? How did it work out?

What did you learn? What can we incorporate? So that we have the best bill and the best system when we pass it. And I want to pass it by April 1.”

City Looking to Continue Slashing Small-Business Fines

By Forum Staff The City is expanding relief for small businesses, including eliminating fines for first time violations and expanding the list of violations that will have cure periods, Mayor Bill de Blasio announced Thursday.

According to de Blasio, fines subject to relief include select Department of Buildings, Department of Environmental Protection, Department of Transportation, Department of Sanitation, and Department of Consumer and Worker Protection violations. The administration indicated that it will work with the City Council to review more than 75 violations.

The Buildings and Transportation departments can implement their own rule changes, and will begin providing additional relief in the fall, de Blasio said.

“New York City is not New York City without our small businesses,” Hizzoner added. “We will not be a city that gives in to corporate takeover. Instead, we’ll fight for our mom-and-pops and do all we can to help them thrive.”

“In order to protect public health and the environment we work with businesses every day to come into compliance with our

rules and regulations,” said DEP Commissioner, and Howard Beach resident, Vincent Sapienza. “Expanding relief for small businesses makes sense and we applaud the mayor for extending this initiative.”

To ensure businesses are aware of these changes, City agencies will update their summonses to include clear and easy ex-

planations for how to fix the violation.

In partnership with these agencies, the Department of Small Business Services will also organize a canvassing effort across the city to spread the word.

“Our small businesses are the core of New York City’s economic engine, and it is no secret being a business owner is often an arduous task,” said Councilman Paul Vallone (D-Bayside), chairman of the Committee on Economic Development. “In these difficult economic times, this muchneeded relief for our mom and pop institutions will go a long way in helping our city’s business owners and their employees thrive and continue to serve their communities.”

According to the City, the de Blasio administration has cut small-business fines by more than 40 percent since 2014 and will cut an additional 10 percent by the time the mayor leaves office. The administration noted that it has put more than $100 million back in the pockets of small business owners, and the relief announced Thursday will raise the amount of money saved yearly from $20 million to $26 million.

Still, some say it’s not enough.

“Reducing fines and helping educate business owners on how to resolve or pay off penalties is a positive step forward but there is more to be done,” said State Sen. James Sanders, Jr. (D-South Ozone Park).

By Michael V. Cusenza Governor Andrew Cuomo on Monday blasted the Trump administration for its $8 billion cut to the State’s healthcare system, calling it the President’s “latest calculated attack on New York.”

“The federal government last Friday notified us that they were cancelling what is called the DSRIP funding, healthcare funding to the State of New York which we had previously been granted in 2014. For those of you who weren’t here in 2014, we won a big federal grant which allowed us to transition our healthcare services from primarily hospital driven, which is very intensive and very expensive, to more of a community-based healthcare system,” Cuomo said. “And the grant was for eight billion dollars.”

According to the State Health Department, the Delivery System Reform Incentive Payment program is the main mechanism by which New York will implement the Medicaid Redesign Team Waiver Amendment. DSRIP’s purpose is to restructure the healthcare delivery system by reinvesting in the Medicaid program, with the primary goal of reducing avoidable hospital use by 25 percent over five years.

“This healthcare denial is really obnoxious, you know. If there’s one area that you’d think should be beyond politics, it’s healthcare. And what the federal government is doing is hurting Democrats and Republicans,” the governor said. “It’s not whether you’re blue or you’re red. These are needy New Yorkers, they’re primarily senior citizens, who are hurt. And we fought all of these cuts all along, but we’re going to fight this cut.

I’m going to contact our congressional delegation. We’re going to marshal all our allies because it’s unconscionable. There has to be a place where you don’t play politics. It has to end somewhere. It should end at healthcare. We all say healthcare is a human right; we’re up to 96 percent healthcare coverage in this state, which is a great accomplishment.

And why you would want to play politics with someone’s healthcare is just beyond me.

They have no limits whatsoever.”

On Tuesday, Cuomo released a list of healthcare networks, known as Performing

Provider Systems, that will be impacted by the federal cuts. They include borough institutions New York-Presbyterian/Queens PPS; Mount Sinai PPS; NYC Health + Hospitals/Elmhurst; NYC Health + Hospitals/Queens; and Nassau University Medical Center, NUMC, Nassau-Queens PPS, LLC. “In and of itself, it is very counterproductive and hurtful to this State, but when you view it in the series that are going on it is even more disturbing. Because this is not just the federal government takes an isolated action that is hurting the State. There is continued pattern and series of these actions,” Cuomo said. “Connect the dots and you see the line.”

Cuomo added that with the Trump administration, no matter the issue, it always comes down to politics.

“I have never seen government run through a self-serving political lens like this.

But that is what it is,” the governor noted on Monday. “My point is that at one point it has to stop. And the line in the sand has to be healthcare.”

A Sock-cessful Drive Members of the Kiwanis Club of Howard Beach recently responded to the call to join the Queens Week of Service (Feb. 10-17) by donating a staggering 1,200 pairs of socks that will go to those in need.

Volunteers from the 14 Queens community boards and the Queens Borough President’s Office collected more than 3,100 pairs of socks in all, as well as hundreds of toiletries and dozens of sweats for borough veterans.

Although some may argue that it’s too early to introduce the subject matter of this column, I’ve always subscribed to the common sense theories behind early preparation.

After the fabled terror that March weather can often bestow upon us, comes April-- and the long-awaited beginning of Spring!

But the beautiful sights and smells of the blossoms that accompany April are not the only arrivals that mark start of Spring.

The American Academy of Allergy, Asthma and Immunology says that more than 50 million Americans suffer from allergies. Among the most common are food, dust, pollen mold, insect stings, animal dander , medications and latex.

While some allergy sufferers may only face irritations from minor symptomology, others can have life-threatening reactions and without medical attention, they can die.

Fortunately, for those people with less severe conditions, the secret to freedom from those maddening itches, sneezes, scratchy throats and watery eyes, is as near as the counters and shelves of your local pharmacy. A host of over the counter (OTC), remedies available are sure to bring an end to your misery.

Leading experts in the allergy field have made the suggestion that treating your symptoms early can lead to reducing the effects of allergy-associated respiratory distress.

There is also staunch support for monitoring the pollen count and remaining indoors during the hours when the counts are at their highest (10 am to 4 pm). Other advice is to use filters and keep windows closed during the day.

Meng Measure Targets Homelessness, Chronic Housing Insecurity

By Forum Staff Congresswoman Grace Meng (D-Flushing) recently introduced the Pathway to Stable and Affordable Housing for All Act, a 10-year investment plan to end homelessness and housing poverty based on estimates from frontline, on-the-ground service providers, and experts that focus on meeting the challenges states and communities face every day.

“Housing is a human right, and everyone deserves a safe and affordable home. But too many families are stricken with the cruel and impossible decision of choosing between paying rent or paying for groceries or prescription drugs. Homelessness and the lack of affordable housing are moral crises that we must fight, once and for all,” Meng said. “In New York, more than 90,000 New Yorkers are without a home, and nationwide, only 37 affordable and available homes exist for every 100 extremely low-income renter households.

In my own 6th Congressional District, these numbers are even worse; only 18 housing units are available for every 100 extremely low-income households. This cannot be; it must not be. This bill makes monumental investments to existing programs that have been proven to successfully combat homelessness and housing poverty. First, the investments would help get individuals who are most in need off the street and into supportive and

safe housing; and second, the bill expands access to affordable housing for the long-term, while expanding the stock of affordable housing. Every family—every child—deserves a safe and stable home. I urge all my colleagues to support this bill to ensure housing justice for all.”

The bill consists of four very expensive

provisions: $10 billion per year in additional funding for the Emergency Solutions Grant Program, which focuses on homelessness prevention and rapid re-housing for individuals and families that find themselves homeless; $10 billion per year in additional funding for the Continuum of Care Program, which

helps organizations move those experiencing longer-term homelessness into the shelter system and provide needed supports; $40 billion per year in direct appropriation to the Housing Trust Fund—on top of the existing funding provided by Fannie Mae and Freddie Mac—to begin to chip away at the deficit of units in the nation’s affordable housing stock; and Fully fund Tenant-Based Rental Assistance (vouchers) to allow all eligible households to get into permanent, safe, affordable housing.

“Through robust investments in the national Housing Trust Fund, housing vouchers, and homeless assistance grants, Rep. Meng’s bill addresses the underlying, systemic causes of the affordable housing and homelessness crisis: the widening gap between incomes and housing costs and severe shortage of homes affordable and available to the lowest-income seniors, people of color, people with disabilities, families with children, and other individuals,” Diane Yentel, president and CEO of the National Low Income Housing Coalition, noted. “We must build the political will to enact this important bill.”

Meng’s legislation is the companion to the Pathway to Stable and Affordable Housing for All Act that was introduced by Sens. Mazie Hirono (D-HI), Kirsten Gillibrand (D-N.Y.), and Cory Booker (D-N.J.).

Schumer Rips TSA Over TikTok

By Michael V. Cusenza Though the U.S. Department of Homeland Security has banned its agencies from using the China-owned TikTok application, the Transportation Security Administration is still using the app on social media, Senate Minority Leader Chuck Schumer revealed Sunday.

According to Schumer, the risks to American and federal agency security via the platform remain very real and urged the TSA to cease its use of TikTok. Schumer says the TSA should not be exempt from the ban, especially given its parent agency already has a prohibition policy in place.

Even amidst federal inquiries into the TikTok app, Schumer said the TSA was posting—and continues to post—a variety of videos from agency accounts, which raises security concerns, according to New York’s senior senator. On Thanksgiving, the TSA posted a TikTok that went viral related to the “nopes” and “yeps” of carry-on luggage. And this past Valentine’s Day, the agency posted “romantic tips” for travelers in another TikTok. In addition, Schumer said, the official TSA account on twitter shares these TikToks, which garner hundreds of views. And the official “AskTSA” Twitter account even comments on them.

Last October, Schumer sent a letter to then-Acting Director of National Intelligence Joseph Maguire requesting that the intelligence community conduct an assessment of the national security risks posed by TikTok and other China-owned content platforms operating in the United States. Schumer said that national security experts have raised concerns about TikTok’s collection and handling of user data, including user content and communications, IP

addresses, location-related data, metadata, and other sensitive personal information, particularly when viewed in light of laws that compel Chinese companies to support and cooperate with intelligence work controlled by the Chinese Communist Party. Schumer added in the missive that, due to a lack of transparency and without an independent judiciary to review requests made by the Chinese government for user data or other actions, that there is no legal mechanism for Chinese companies to appeal if they disagree with a request by the government.

“These videos sure do make you chuckle; they’re creative,” Schumer said Sunday. “But China might be laughing at these TSA postings for very different reasons, and that should concern us and it’s why I am urging the TSA to find a different platform, and cease its use of TikTok now.”

Schumer also recently fired off a letter to TSA Administrator David Pekoske regarding TikTok. “While I recognize that the TSA must adapt its outreach techniques in order to communicate with a variety of Americans, I urge you to assess the potential national security risks posed by China-owned technology companies before choosing to utilize certain platforms,” the senator wrote.

A TSA spokesperson told The Forum this week that while the agency “has an active and award-winning presence on several social media platforms,” it “has never published any content to TikTok nor has it ever directed viewers to TikTok. A small number of TSA employees have previously used TikTok on their personal devices to create videos for use in TSA’s social media outreach, but that practice has since been discontinued.”
