Cuomo Announces Reforms to Establish ‘MTA Accountability’ as Part of Budget Amendments

By Forum Staff Governor Andrew Cuomo on Friday announced a series of amendments to the Fiscal Year 2020 Executive Budget that, he indicated, will establish accountability, provide new funding, and overhaul the Metropolitan Transportation Authority’s bureaucracy.

The amendments outline a set of proposals for the Legislature, including measures to provide a dedicated funding stream through congestion pricing; additional expert oversight of MTA finances and operations; reforms to the MTA Board and management structure, authorize new board members; and improve processes for major agency projects.

The amendments are: • Create an Expert Panel to Set Congestion Pricing Rates and Provide Oversight of MTA Finances and Operations: The amendments would establish an expert MTA oversight panel, which would be comprised of six members with extensive backgrounds in critical areas, including auditing, public finance, engineering, transportation/transit, corporate restructuring, and risk management, Cuomo noted. The panel will be tasked with a number of functions, including setting and approving the rates within the proposed congestion pricing zone, which then will be implemented by the Triborough Bridge and Tunnel Authority. will also be charged with overseeing an audit of the MTA’s operating and capital budgets, approving the next MTA capital plan and operating budgets, and analyzing and ultimately approving MTA plans for reorganization.

• Establish a Variable Pricing Structure and a Lockbox for Congestion Pricing Revenue: The amendments would require that rates for the congestion pricing plan must be set using a variable pricing structure, which would take into account the type of vehicle, the time and day of the

week, credit for any tolls paid at other bridges and tunnels, as well as other factors that will be determined through conversations with the Legislature, according to the governor. The amendments also would require the creation of a dedicated lockbox to ensure that 100 percent of congestion pricing revenue goes to the MTA capital budget and prohibits the use of congestion revenues for non-capital spending. The expected revenue generated by the plan would provide $15 billion for the MTA’s next capital budget, which begins

in 2020 and runs through the end of 2024.

• Require MTA to Develop a Reorganization Plan: The amendments require the MTA to develop a comprehensive reorganization plan to end the agency’s “decades of mismanagement and bureaucracy,” Cuomo said. The MTA’s plans would be subject to the approval of the expert panel.

• Ensure MTA Board Member Terms Align with Their Appointing Entity: The amendments establish provisions to ensure MTA Board member terms are

aligned with the terms of the official who appointed them. When the appointing individual’s term ends, the board member would be placed on holdover status until a successor is appointed to the board by the newly elected official.

The proposal is designed to create additional and necessary accountability so that board members are answering directly to the authority by which they were appointed, the governor noted.

• Implement Design-Build for Major Capital Projects: The amendments would require the use of design-build for all major MTA capital projects. Designbuild—which combines the design and construction services into single contracts—reduces the bureaucracy and costs of major infrastructure projects, and shifts the responsibility to the private sector. New York uses designbuild for major projects, including for the Governor Mario M. Cuomo Bridge and the new Kosciuszko Bridge, which will be completed in 2020, four years ahead of schedule. Cuomo pointed out that MTA construction projects rarely come in on time, and design-build is inarguably the most efficient construction method, he added.

“The MTA desperately needs money, but it also needs a structure that is rooted in accountability and new ideas that will ensure the agency is finally operating as it should be and as New Yorkers demand,” the governor said.

Brooklyn Man Charged with Murder in Shooting Death of 102nd Precinct Detective

By Forum Staff A Brooklyn man has been charged with two counts of second-degree murder, among other crimes, in the fatal shooting of a 102nd Precinct detective and the wounding of a sergeant during a robbery in Richmond Hill last Tuesday, according to Queens District Attorney Richard Brown.

Christopher Ransom, 27, who was shot several times in the incident, was arraigned bedside via video link from New YorkPresbyterian Queens Hospital in Flushing on a criminal complaint charging him with two counts of second-degree murder, four counts each of first-degree assault and first-degree robbery, second degree aggravated manslaughter, two counts of second-degree robbery and menacing a police officer or peace officer. Ransom was ordered held without bail.

According to the charges, Ransom entered the T-Mobile store at Atlantic Avenue and 120th Street between 6 and 6:30 p.m. on Tuesday, Feb. 12, wearing a dark hoodie covering his head, a mask covering his face, and brandishing what appeared to be a pistol. Ransom then allegedly ordered the two employees of the store to remove iPhones and money from the cash registers and back room safes. Shortly thereafter, Ransom al- Christopher Ransom

legedly exited the backroom only to re-enter the main store area moments later – still holding what appeared to be a gun – as members of the NYPD simultaneously entered the location.

The district attorney added that, according to the complaint, after observing the police retreat from the store to take up position outside, Ransom exited with his weapon – which was later determined to be an imitation firearm – pointed at the police officers who began discharging their weapons. Detective Brian Simonsen was fatally shot once in the torso and Sgt. Matthew Gorman was seriously wounded as a result of being shot in his left leg. It was later determined that Simonsen and Gorman were hit by friendly fire.

In remarks issued on Friday, Brown vowed that Ransom will be “vigorously” tried.

“This tragic incident once again reminds us of the dangers that our police officers face each day as they risk their lives to keep our streets safe,” he added. “The defendant is accused of robbing a Richmond Hill phone store and then upon exiting pointing what appeared to be a firearm at responding police officers, which, regrettably, led to the death of one police officer and the wounding of another.”

If convicted, Ransom faces up to 25 years to life in prison.

Diocese of Brooklyn Releases List of Clergy ‘Credibly Accused of Sexual Abuse of a Minor’

Cusenza The Roman Catholic Diocese of Brooklyn, which serves the boroughs of Brooklyn and Queens, on Friday released its list of 108 members of the clergy who have been credibly accused of sexual abuse of a minor. By credible, diocesan officials believe that the allegations may be true.

The list spans the 166-year history of the diocese, and contains names of clergy who have been convicted, who have admitted to sexual misconduct with a minor, or have had allegations determined credible by the Independent Diocesan Review Board.

“It is my hope that the publishing of this list will provide some assistance to those who are continuing the difficult process of healing, as well as encourage other victims to come forward,” Bishop of Brooklyn Nicholas DiMarzio wrote in a “Letter to the Faithful” also released on Friday. “Sexual abuse is a heinous, sinful crime and we as a diocese are committed to remaining vigilant against such abuse.”

The list features the names of priests who were assigned to such borough Catholic education institutions as Archbishop Molly High School, St. Francis Preparatory School, and Christ the King High School; and Queens parishes, including St. Helen

Approximately two-thirds of the accused priests are deceased, DiMarzio said.

“We know this list will generate many emotions for victims who have suffered terribly. For their suffering, I am truly sorry,” the bishop added. “I have met with many victims who have told me that more than

anything they want an acknowledgment of what was done to them. This list gives that recognition and I hope it will add another layer of healing for them on their journey toward wholeness.”

DiMarzio also noted that he committed to releasing the list at regional meetings he held with the lay faithful late last year where he answered parishioners’ questions about the sex abuse crisis. In those meetings, the

2017 to 21 months in prison for texting obscene material to a 15-year-old girl, was recently transferred to a Residential Reentry Management facility in Brooklyn from Federal Medical Center, Devens, in Massachusetts, where he served most of his sentence. The RRM location is either a home confinement residence or a halfway house.

Weiner is scheduled to be fully released from BOP custody on May 14. Thanks to good behavior at Devens, three months was lopped off of his original 21-month sentence, according to a New York Post report.

In addition to the prison term, Weiner, who resided in Forest Hills for many years, was sentenced to three years of supervised release, must register as a sex offender for the rest of his life, and pay a $10,000 fine.

According to court records, between January and March 2016, Weiner, 54, used online messaging and video chat applications to communicate with a minor girl he knew to be 15 years old. In the course of those communications, Weiner transferred obscene material to the North Carolina teen, including directions to engage in sexual File Photo conduct and sexually explicit images.

diocese outlined the numerous programs mandated by the Charter for the Protection of Children and Young People, including, but not limited to, a zero tolerance policy in which any clergy member credibly accused of sexual abuse of a minor is permanently removed from ministry. Since 2002, the diocese has shared all of its files and allegations against clergy with the district attorneys of Brooklyn and Queens, DiMarzio said.

Jeff Anderson & Associates, a law firm that represents victims of childhood sexual abuse, blasted the diocese for releasing a list that is “seriously deficient and raises several public safety issues.”

The firm pointed out that DiMarzio fails to address the percentage of priests on the list “who are NOT in fact deceased, but whose whereabouts the Diocese of Brooklyn has failed to share with the public and its parishioners,” and that the diocese has produced the list as a result of their own internal investigation, not that of a law enforcement agency.

“Without releasing a complete list with a full account of the perpetrators’ histories and their current whereabouts, a public safety imperative remains,” the firm added in a statement issued on Friday.

By Michael V. Cusenza The City’s latest Vision Zero plan focuses on the most dangerous thoroughfares in the five boroughs—including Rockaway Boulevard in South Queens, Mayor Bill de Blasio announced on Tuesday.

Using crash data, new Priority Corridors were added to the new Borough Safety Plans.

The new PCs in The World’s Borough are: Rockaway Boulevard (Eldert Lane in Woodhaven to 3rd Street in Rosedale); 37th Avenue (114th Street to Woodside Avenue); and 21st Street (50th Avenue to 20th Avenue).

According to the administration, the Borough Pedestrian Safety Plans use the latest crash data, showing that just 7 percent of the city’s streets – 424 miles – are responsible for nearly half of all pedestrian fatalities. By the end of 2019, the City will change traffic signals on all the newly added corridors to discourage speeding, and give pedestrians exclusive crossing time at 300 intersections to prevent crashes. The new priority streets and intersections are the roadmap for future Vision Zero safety projects and enforcement – ensuring tools like speed cameras, police enforcement and re-engineering are applied where they’ll save the most lives, according to de Blasio.

“We will never stop working towards our goal of Vision Zero and saving lives across the city,” Hizzoner said. “Using our data-driven approach, we have identified hotspots around the city that are driving the majority of traffic fatalities, and are implementing targeted plans there and across the city that will make our streets safer for all. After our success last year with the safest year on record, we will continue building towards a safer and fairer city for all.”

The City Department of Transportation is identifying new Priority Locations

around the city, the administration noted.

Some locations are receiving more indepth interventions than they had previously, while new locations will receive critical safety upgrades. Places where crashes declined by the greatest margins will continue to be closely monitored.

New DOT actions for 2019 include: • Add exclusive pedestrian crossing time at every feasible intersection on all new Priority Corridors by the end of 2019 • Modify signal timing to reduce speeding on all feasible new Priority Corridors by the end of 2019 • Launch Integrated Data-Driven Speed Reducer Program (speed humps & speed cushions) • Track Vision Zero Violations at the Priority Corridors, Intersections, and Areas • Launch a High Visibility Enforcement Program on Priority Corridors • Launch a targeted Corridor Outreach Program • Launch a Driveway Safety program to address issues with vehicles crossing sidewalks • Conduct a comprehensive study of senior pedestrian injuries • Collaborate with the Business Integrity Commission to improve the safety of commercial waste fleets “Preventing traffic fatalities and promoting the peaceful co-existence of pedestrians and motorists should be applauded,” said State Sen. James Sanders, Jr. (D-South Ozone Park). “Vision Zero has made positive improvements in keeping New Yorkers safe and I look forward to its continued success in the future. Traffic fatalities may not be at zero yet, but the numbers are getting lower and that’s a good sign that we moving towards that ambitious but worthy goal.”

Council Approves Basement Apartment Pilot Program

Brooklyn Councilman Brad Lander sponsored the bill to establish the basement apartment pilot program.

By Forum Staff The City Council recently voted in favor of creating a pilot program to expand the City’s housing stock by facilitating the creation of basement apartments in East New York. The program would also aid eligible property owners with low-cost loans.

Introduction 1004 would establish a pilot program in Brooklyn Community Board 5 to facilitate the creation and alteration of habitable apartments in basements and cellars of certain one- and two-family dwellings. This pilot program would also assist eligible property owners with lowcost conditional loans to be overseen by the Department of Housing Preservation and Development.

“Converting basement units into safe and legal housing is an important way to address New York City’s affordability crisis,” said City Councilman Brad Lander (D-Brooklyn), the measure’s sponsor.

“Together with advocates from the BASE (Basement Apartments Safe for Everyone) Coalition, including Chhaya CDC, Cypress Hills LDC, and the Pratt Center for Community Development, we’ve been pushing for years to bring underground units into the light. Thank you to Council Members Rafael Espinal (D-Brooklyn) and Inez Barron (D-Brooklyn) and the de Blasio administration for developing this thoughtful pilot program for East New York. I look forward to working with our partners to establish the pilot program, and then to learn the lessons we’ll need to expand the program to neighborhoods around the city.”

The council also recently voted in favor of requiring public guidelines for traffic flow designations, and increasing the requirements for street sign and pedestrian countdown display placement throughout the city.

Introduction 867 would require the City Department of Transportation to establish and maintain guidelines on its website for the criteria and considerations used to assess proposed changes of one-way streets to two-way streets and vice versa, and the process by which traffic flow changes can be requested. Additionally, the department would be required to post on its website, yearly, the requests for traffic flow changes received and the status of those requests.

Introduction 928 would require that at least two corners of a street intersection have the appropriate street name signage installed.

“Far too often, when driving it is difficult to tell what street you are on because the signs are completely faded or not there at all,” said Councilwoman Adrienne Adams (D-Jamaica), sponsor of Intros. 867 and 928. “It is important that the Department of Transportation make it a priority to replace all sun bleached signs and missing signage.”

Introduction 206 would require DOT to install pedestrian countdown displays at any intersection where there is a photoenforced traffic violation system.

“The Department of Transportation has already determined that the intersections where they have installed red light enforcement cameras are among the most dangerous in the city, so it is just common sense to also install countdown clocks to improve safety for pedestrians and motorists at these same intersections. Pedestrian countdown clocks simply make crossing intersections safer,” said Council Minority Leader Steven Matteo (R-Staten Island), the bill’s sponsor. “DOT, to its credit, has already expanded the use of these safety devices to intersections all over the city, but I felt it was important to ensure all red light camera intersections have them.”

EDITORIAL The Case for the People’s Advocate Outside of races for offices that represent the interests of South Queens communities, The Forum generally shies away from political endorsements.

However, there are special cases. And since this Tuesday, Feb. 26, is the special election for public advocate—this is one of those rare instances in which your favorite newspaper feels the need to wade into citywide office waters and offer an opinion on a candidate.

Before we get into our recommendation, let’s learn a bit about the office. According to the City, the public advocate acts as an ombudsperson for all New Yorkers – a government official who champions the public and ensures government is responsive to their needs. In addition to other duties, the public advocate shall: monitor the operation of the public information and service complaint programs of City agencies and make proposals to improve such programs; review complaints of systemic problems with City services and programs, and make proposals to improve the City’s response to such complaints; and to take, investigate and otherwise attempt to resolve complaints from individuals concerning City services and other administrative actions of City agencies. The PA also is an ex-officio member of all City Council committees, with the power to introduce legislation.

Seems like crucial duties for an office that so many elected officials and pundits have been calling to be eliminated for many years.

And for such an important participant in New York City’s legislative process, The Forum believes that City Councilman Eric Ulrich (R-Ozone Park) is the man for the job.

We feel compelled to publish this endorsement for much of the same reasons we have supported Ulrich’s Queens candidacies. It’s

not because the other candidates are awful— it’s because Ulrich is the best of the bunch.

As a member of the City Council, representing the interests of residents and business owners in the neighborhoods of Howard Beach, Lindenwood, Ozone Park, Belle Harbor, Breezy Point, Broad Channel, Neponsit, Richmond Hill, Rockaway Park, South Ozone Park, Hamilton Beach and Woodhaven for the last 10 years, Ulrich has gained the political

and administrative experience necessary for citywide office.

He has proven, time and again over the last decade, to be the passionate gadfly, speaking truth to those—regardless of political affiliation—who have been elected to lead the City, State, and country, but who often have left much to be desired. You know who you are.

And Ulrich has a track record of standing up for his constituents, something many politicians forget should be Number 1 on their daily to-do list.

With roughly three more years left on Mayor Bill de Blasio’s term (that’s if he doesn’t dip his toe into the 2020 presidential race), wouldn’t you want the person who has been a true check on de Blasio’s power in the office that is charter-mandated to provide said checks on Hizzoner?

“Time and time again, this mayor has let us down, or he sold out the people of this city in exchange for a campaign contribution or a political favor. It’s no secret that it’s the special-interest groups and the lobbyists that are calling the shots at City Hall,” Ulrich said in his video announcing his candidacy. “It must end. And it can end.”

If you vote for Eric Ulrich for public advocate on Tuesday, Feb. 26, that corrosive culture at City Hall will end.

By Michael V. Cusenza Shortly after learning of Amazon’s decision to pull out of the deal to bring its HQ2 to LIC, Gov. Andrew Cuomo on Thursday released a stinging statement in which he blasted “a small group of politicians” for pushing the e-commerce behemoth away from NY, and specifically shellacked the State Senate for what he characterized as its leading role in the three-month saga.

“The New York State Senate has done tremendous damage,” Cuomo said. “They should be held accountable for this lost economic opportunity.”

Amazon on Thursday announced that, “after much thought and deliberation, we’ve decided not to move forward with our plans to build a headquarters for Amazon in Long Island City, Queens. For Amazon, the commitment to build a new headquarters requires positive, collaborative relationships with state and local elected officials who will be supportive over the long-term. While polls show that 70 percent of New Yorkers support our plans and investment, a number of state and local politicians have made it clear that they oppose our presence and will not work with us to build the type of relationships that are required to go forward with the project we and many others envisioned in Long Island City.”

Following a comprehensive, year-long selection process, Amazon in November revealed plans to establish a new corporate headquarters in Long Island City. According to the City Economic Development Corporation, in 2019, Amazon would occupy up to 500,000 square-feet at 1 Court Square while working to construct four million square-feet of commercial space on

Long Island City’s waterfront over the next 10 years, with expansion opportunities for up to 8 million square-feet over the next 15 years. Through a $3.6 billion total investment, Amazon would have drawn from the workforce in New York to fill at least 25,000 new jobs by 2029 and up to 40,000 jobs by 2034 with an average annual salary of $150,000. Construction was expected to create an average of 1,300 direct construction jobs annually through 2033. Overall, the project was estimated to create more than 107,000 total direct and indirect jobs and more than $14 billion in new tax revenue for the State and a net of $13.5 billion in City tax revenue. The project would have provided a 9:1 return on investment.

To bring the enterprise to New York, the State offered Amazon a package of incentives and tax credits totaling several billion dollars.

However, the mammoth deal garnered just as many skeptics and outright opponents as supporters.

“We need jobs, we need tax revenue but we have to not participate in this race to the bottom where corporations and billionaires dictate the values and the process by which we do economic development,” City Councilman Jimmy Van Bramer (DSunnyside) said on Friday’s “Brian Lehrer Show” on WNYC. Van Bramer and State Sen. Michael Gianaris (D-Astoria) led the charge against the Amazon deal from the day it was announced back in November.

“Offering massive corporate welfare from scarce public resources to one of the wealthiest corporations in the world at a time of great need in our state is just wrong,” the borough pols wrote in a joint statement.

The Sept. 11 Victim Compensation Fund is significantly decreasing future payouts to claimants, which include City first responders, its special master said on Friday.

By Michael V. Cusenza The Sept. 11 Victim Compensation Fund is significantly decreasing future payouts to individuals who suffered physical harm or were killed as a result of the terrorist-related aircraft crashes of Sept.

11, 2001, or the debris removal efforts that took place in the immediate aftermath of those crashes, the fund’s special master announced on Friday.

“Unfortunately, the situation the VCF currently faces is a difficult one,” said Rupa Bhattacharyya.

The fund published on Friday its Seventh Annual Status Report and the Third Annual Reassessment of Policies and Procedures. While Bhattacharyya noted that 2018 “was an incredibly productive year for the VCF,” in which it issued 8,619 compensation determinations, with initial or revised determinations on almost 7,000 claims, totaling almost $1.5 billion in awards, the largest amount of compensation awarded in a given year since the fund’s inception in 2001, the VCF also received a record number of new claims last year. Bhattacharyya attributed the sudden increase in new claims, in part, to the fund’s Notice of Inquiry published last October, in which it indicated that “current projections, using data as of Aug. 31, 2018, and at the current rate of disbursal, suggest a possibility that the funds that have been appropriated to compensate claimants…may be insufficient to compensate all claims (including those filed and those anticipated to be filed) under the current policies and procedures guiding the calculation of awards.”

The special master said the NOI “likely prompted many individuals—who may

have otherwise waited to submit their claims—to file them now.” However, she pointed out that the bump in fund claims in 2018 “was also due to a number of other factors, most notably the increased rates of serious illnesses suffered by members of the 9/11 community, [and] the increasing number of deaths that can be attributed to 9/11 exposure.”

As of Friday, Bhattacharyya noted, the fund has awarded nearly $5 billion in original and amended determinations on more than 21,000 claims.

“That leaves approximately $2.375 billion of the $7.375 billion appropriated funding available to compensate all pending and anticipated future claims filed through Dec. 18, 2020, the VCF’s statutory end date,” she added.

So, what does this all mean for those pending and anticipated future claims?

For any claim or amendment submitted on or before Feb. 1, 2019, the payout will be reduced by 50 percent. For any claim or amendment submitted on or after Feb. 2, 2019, the payout will be reduced by a staggering 70 percent.

“I am painfully aware of the inequity of the situation. I also deeply regret that I could not honor my intention to spare any claim submitted prior to this announcement from any reductions made due to a determination of funding insufficiency,” Bhattacharyya said on Friday. “But the stark reality of the data leaves me no choice.”

City Police Commissioner Jim O’Neill said “Congress needs to do the right thing and fully invest in the fund.

“We’ve seen growth in these cancer cases and it’s clear that disease doesn’t adhere to the structures, balances and schedules of the current fund,” he added.

Bill to Expand Social Security

“We must not only protect our Social Security system, we must strengthen and expand it,” Sen. Gillibrand said.

By Forum Staff Federal lawmakers are pushing a bill that would expand Social Security benefits and strengthen the retirement program so that it would be solvent for decades.

According to U.S. Sens. Kirsten Gillibrand (D-N.Y.) and Bernie Sanders (I-Vt.), and U.S. Rep. Peter DeFazio (D-Ore.), the Social Security Expansion Act would do the following: • Increase yearly benefits for nearly all recipients by around $800; • Lift the current cap to incomes over $250,000, ensuring those with incomes of more than $250,000 pay the same rate into the retirement system everyone else already does; • Apply the Consumer Price Index for the Elderly to more accurately reflect benefits that keep up with inflation;

• Update the Special Minimum Benefit to make it easier for low earners to qualify for the program; and • Restore student benefits up to the age of 22 so that children of deceased or disabled parents have educational support.

“We must not only protect our Social Security system, we must strengthen and expand it,” Gillibrand said. “We have to make sure that it’s actually giving retirees and their families the support they need – and the support they spent their entire lives earning. For so many retirees and their families all over my state of New York, and all over the country, Social Security is truly a matter of survival.

Social Security is essential, and it’s something that I will do everything in my power to protect and strengthen.”

According to Gillibrand, Sanders, and DeFazio, on average, Social Security beneficiaries receive just under $1,400 a month.

Mayor de Blasio and Schools Chancellor Carranza are encouraging parents to run for seats on Community and Citywide Education Councils.

By Forum Staff Mayor Bill de Blasio and Schools Chancellor Richard Carranza recently kicked off the 2019 Community and Citywide Education Council election cycle by urging parents to run for seats on the education policy advisory bodies.

According to the administration, Community and Citywide Education Council elections take place every two years. There are 36 Councils across the city, which are required by State law and chancellor’s regulations, including 32 Community Education Councils, the Citywide Council on High Schools, the Citywide Council on English Language Learners, the Citywide Council on Special Education, and the Citywide Council for District 75. The 32 CECs are responsible for approving school zoning lines, holding hearings on the capital plan, and providing input on instructional and policy issues. Citywide Councils advise on and advocate for school policy affecting the specific needs of the students they represent. Each applicant for a CEC position must be a parent of a student enrolled in a district elementary or middle school (Pre-K-8), while applicants for the Citywide Council on High Schools must have a child in high school. Eligible applicants for the other three Citywide Councils must have a student receiving the respective services and programs. Parents serve two-year terms.

The following parent leaders are eligible to vote in the Education Council elections, according to the City Department of Education: • Community Education Councils: members are elected by the PA/PTA president, recording secretary, and treasurer of every school in the corresponding community school district.

• Citywide Council on High Schools: members are elected by the PA/PTA presi-

dent, recording secretary, and treasurer of every high school; each borough elects two representatives.

• Citywide Council on Special Education: members are elected by parents of students with an IEP, nominated by each Presidents’ Council in NYC. • Citywide Council on English Language Learners: members are elected by parents of English Language Learners, nominated by each Presidents’ Council in NYC. • Citywide Council for District 75: members are elected by the PA/PTA president, recording secretary, and treasurer of every District 75 school In addition to the nine elected members, each CEC includes two members appointed by the borough president. Each of the citywide councils includes appointees from the public advocate, and CCHS includes two members appointed by the CCSE and CCELL, respectively.

“Students are most successful when parents are empowered to hold the mayor accountable for their education promises.

That is why it’s vital for parents across the city to get involved and run for their local Community Education Council,” said City Comptroller Scott Stringer. “As the proud father of two public school students I know that a great education starts with a real partnership between parents and the City.”

The City is encouraging parents to visit nycparentleaders.org to learn more about the structure and roles of the education councils. The website includes information on eligibility guidelines, key dates, and frequently asked questions. Applications can be submitted online through March 6.

Supreme Court to Hear 2020 Census Citizenship Question Case

By Michael V. Cusenza The U.S. Supreme Court on Friday indicated that it would take up the case to decide whether a controversial citizenship question may be added to the 2020 Census.

In April 2018, then-State Attorney General Eric Schneiderman—leading a coalition of 18 attorneys general, six cities, and the U.S. Conference of Mayors—filed the original lawsuit to prevent the Trump administration from adding a question to the decennial Census that would ask respondents if they are U.S. citizens.

The suit emphasized the “irreparable harm” that will result from inaccuracies in the 2020 Census caused by demanding citizenship information. Hundreds of billions of dollars in federal funds are directly tied to demographic information obtained through the census, including the Highway Trust Fund and other Department of Transportation grants, Child Care Development Grants, and Medicaid. Consequently, inaccurate counts can potentially deprive states of much-needed funds designed to protect low-income and vulnerable communities, the lawsuit argued.

“Today’s ruling is a win for New Yorkers and Americans across the country who believe in a fair and accurate count of the residents of our nation,” State Attorney General Tish James said on Jan. 15. “The attempts by the Trump administration to mandate a question about citizenship were not rooted in a desire to strengthen the census process

and would only undermine our immigrant communities. Inciting fear in our residents is not only immoral, but also ill-conceived.”

Ten days after the district court decision, the federal government filed an appeal with the Supreme Court. On Friday, the Court granted the appeal and set oral argument for the week of April 22, the Brennan Center for Justice noted.

“Adding a question about citizenship to

the Census would incite widespread fear in immigrant communities and greatly impair the accuracy of population counts. Any underrepresentation of the real number of people living in states and localities could reduce representation in Congress and funding for New York and other states and localities across the country. This would have far-reaching and long-lasting effects and is antithetical to the purpose of the Census,” James said on Friday. “The district court recognized these facts in ruling in favor of our challenge and we look forward to seeing the Trump administration in court once again.”

Over the past year, several elected New York officials teed off on President Donald Trump and Commerce Secretary Wilbur Ross for the decision to add such a question to the Census.

“A fair and accurate 2020 count is constitutionally mandated to ensure political power and resources remain with the people – where they belong,” Mayor Bill de Blasio said. “President Trump’s decision puts our amazing city of immigrants in jeopardy and threatens federal funding for infrastructure, health care and public safety in New York.”

Congresswoman Grace Meng (DFlushing) called the decision “deeply troubling and reckless.”

Lawmakers Unveil Packages of Bills that Tackle Unregulated Renters’ Security Deposits

By Forum Staff City and State legislators recently introduced bills aimed at reforming unregulated security deposits.

New Yorkers spent approximately $507 million on security deposits in 2016, according to City Comptroller Scott Stringer.

The legislative packages, which were unveiled in the City Council and State Legislature last week, address gaps in City and State law that enable landlords to hike upfront rent costs at extreme levels, Stringer noted.

“New York can’t wait any longer to start solving our exploding housing and homelessness crisis. We know that one major reason people can’t afford to live in New York City is out of control and completely unregulated security deposits. That’s money that can’t be used to support a family, pay for an education, medical expenses or be set aside for an emergency,” the comptroller added. “It’s preposterous that a landlord can demand many months’ rent from a tenant and there’s little recourse if they just decide to keep it. Today, we’re moving one step close to making sure no one needs to choose between renting a home and putting food on the table.”

a third-party custodian who would be responsible for the return of security deposits as well as any dispute resolution • Require landlords to return security deposits within 21 days after the lease expires Bills introduced in the council will: • Limit security deposits to one month’s rent

• Give renters the option of paying security deposits in installments • Require that security deposits on rental apartments be returned to the tenant within 60 days of the end of the lease Stringer also noted that the above measures were released in tandem with a survey of New Yorkers about their personal experiences with security deposits. It asks New Yorkers about the burden of security deposits and gauges their interest in new, fairer options for paying security deposits.

Survey results will help guide future action on making renting an apartment in the city more affordable, the comptroller added.

“There are significant costs associated with finding a new apartment in New York City, one of which is security deposits,” said City Councilman Keith Powers (D-Manhattan), who sponsored all three NYC bills.

“While security deposits are typically set at one month’s rent, low-wage tenants who may be considered ‘high risk’ can be charged a security deposit two or three times that amount. With this legislation in the City Council, a one-month cap will set expectations and make these fees predictable. New Yorkers will not only be able to make more informed housing decisions, but tenants— particularly young and low-income tenants—will not have to pay thousands and thousands of dollars to build a home here.”
