Borough Pols Demand Answers from USPS for ‘Abysmal Postal Service’

By Michael V. Cusenza No less than four elected borough officials this week blasted the U.S. Postal Service for what they characterized as ongoing and serious mail delivery issues throughout Queens.

City Councilman Eric Ulrich sounded the alarm on Monday, noting that his office has fielded at least 20 complaints this month alone about increasingly unreliable USPS service, with grievances ranging from late and missed deliveries, to careless errors in which mail – oftentimes containing important and sensitive information – is delivered to the wrong address.

“It is completely unacceptable that the community – and even government offices – have had such abysmal postal service.

Sensitive mail – including checks, tax documents, bills and medicine – is often missing or delivered to the wrong address,” Ulrich said. “Constituents have gone an entire week without a delivery—some of whom rely on USPS to deliver checks so that they can afford to eat.”

A USPS spokesman told The Forum that New York Postal Service leadership is working on the matter.

Ulrich said at least 20 constituents this month alone have contacted his office with Postal Service issues.

“U.S. Postal Service management regrets reading reports of delivery service issues that City Councilman Ulrich has reported on behalf of his constituents and his office staff in Ozone Park. The Post Office always attempts to deliver every piece of mail in a timely, accurate, and efficient manner, and we regret any instance when we have failed to do so.

Management officials are aware of delivery issues, as they relate to Winter Storm Grayson, and worked diligently to resolve dangerous conditions which prohibited some mail delivery,” said Xavier Hernandez. “Area Postmaster Paul Stremel has taken this matter on personally and is working with Councilman Ulrich’s office to ensure his constituents’

On Tuesday, U.S. Reps. Grace Meng (D-Flushing), Joe Crowley (D-Queens and Bronx), and Greg Meeks (D-Jamaica) penned a letter to the head of USPS calling for a plan to address the problems.

“It has come to our attention from our constituents that mail delivery standards throughout Queens are not meeting even the most basic expectations,” the representatives wrote. “As you know, New Yorkers rely on the United States Postal Service (USPS) as an effective and dependable means of communication. Essential matters, such as Social Security benefits, bills, vital medical prescriptions and equipment, government issued identifications, and financial documents are processed and delivered by USPS every day. It is critical that USPS maintain reliable mail delivery service. The current mail delivery problems plaguing the residents of Queens must be addressed immediately.”

Hernandez said that customers in Queens with delivery service issues are encouraged to contact the USPS directly at (718) 348-3900.

EDC Adds New Stops to Ferry Rockaway Shuttle Bus

By Michael V. Cusenza Two new stops have been added to the NYC Ferry Rockaway Shuttle Bus service, the City Economic Development Corporation and Hornblower, operator of the Ferry, announced on Friday.

The latest posts are located at 77th and 96th streets along Rockaway Beach Boulevard. Additionally, the Beach 67th Street stop has been moved from Beach Channel Drive to Rockaway Beach Boulevard.

According to EDC, the new stops on the free shuttle bus route are in direct response to community feedback received at a town hall meeting held by Mayor Bill de Blasio and City Councilman Eric Ulrich (R-Ozone Park) in December.

“The community spoke and we listened. Based on their feedback, we’ve added two new stops to the Rockaway Shuttle Bus,” said NYCEDC President James Patchett. “It’s going to be even easier for Rockaway residents to ride NYC Ferry, and connect to good jobs and opportunities throughout the city.”

Earlier this month, State Sen. Joe Addabbo, Jr. (D-Howard Beach) indicated that he would be reaching out to EDC about possibly expanding shuttle service to accommodate residents in Broad Channel and Howard Beach.

“Currently, residents of Broad Channel who drive and park their cars before boarding the NYC Ferry in the Rockaways can do it

for free, while residents of Howard Beach who wish to do the same are inundated with the toll for crossing the Cross Bay Veterans Memorial Bridge,” Addabbo said. “That just adds an additional fare for those people, which isn’t fair.”

Since it officially launched last May, NYC Ferry has served three million commuters, far outpacing preliminary ridership projections.

In response to its popularity, EDC announced that it will be adding capacity to six new boats starting in 2018. State Announces Additional Immigrant Rights Seminars

By Forum Staff Additional “Know Your Rights” immigration seminars are being offered over the next couple of months, including in Queens, by the New York Department of State’s Office for New Americans, Gov. Andrew Cuomo announced on Monday.

According to the administration, the seminars complement efforts of the Liberty Defense Fund, the nation's first public-private immigrant legal defense initiative, to ensure impacted residents and communities across New York understand their rights and legal opportunities. The NY Department of State, two philanthropic allies—the Carnegie Corporation of New York and the Ford Foundation—and a statewide coalition of 182 advocacy organizations and legal entities, continue to work together to provide pro bono legal assistance and representation to immigrants, regardless of status, in New York.

On Thursday, Feb. 1, at 5 p.m., and Friday, March 16, 9:45 – 10:45 a.m., the Queens Library Long Island City branch (37-44 21st St.) will host the “Know Your Rights!

Cuomo launched the Liberty Defense Fund last March. The investment included in the Fiscal Year 2018 Budget committed $11 million toward the project, in addition to $400,000 via public-private contributions.

In response to changes in immigration policies by the federal government, the LDP, in partnership with Equal Justice Works, has placed attorneys and law students in communities with limited legal resources and high immigrant populations to address the scarcity of immigration attorneys in areas outside New York City. The initiative also works with established state partners and immigrant advocates, including Catholic Charities, to

help expand access to legal services for immigrants, Cuomo noted.

“As Washington continues to roll back rights of immigrants living throughout this state and nation, this administration is taking steps to ensure these New Yorkers know their rights and have access to legal services, as well as a chance to remain at home,” the governor added. “In New York we know that our diversity is our strength and we will continue to uphold the principles of liberty and

equality that this state and this nation were founded upon.”

According to the State, in addition to the seminars, the LDP will continue to: • Provide legal assistance and representation to immigrants in New York through a network of pro bono attorneys, other legal professionals and law students.

• Assist immigrants in deportation proceedings.

• Assist in completing and filing applications for lawful permanent residence (also known as a green card), or temporary status, as well as work permits.

• Provide outreach and educational help to assist parents who are potentially at risk of deportation to fill appropriate forms and prepare emergency plans for the care of their children in case they are detained or deported. This will enhance the work already being done at centers run by the State Office for New Americans throughout New York.

“In today’s climate, this project can change New Yorkers’ lives,” said State Secretary of State Rossana Rosado. “New York will always fight for immigrant rights—no matter what draconian steps the federal government tries to instill on vulnerable communities.”

City Sues Nation’s Largest Painkiller Producers and Distributors

The City has filed a multimillion-dollar lawsuit in State Supreme Court against the country’s top manufacturers and distributors of prescription opioid painkillers in an attempt to hold the companies responsible for the costs NYC will incur to combat the epidemic of addiction, Mayor Bill de Blasio announced on Tuesday.

The suit – which names Purdue, Teva, Cephalon, Johnson & Johnson, Janssen, among others – aims to recover half a billion dollars in current and future costs.

De Blasio noted that in 2016, more than 1,000 people in the five boroughs died in a drug overdose which involved an opioid, the highest year on record. More residents died from opioid overdoses last year than from car accidents and homicides combined.

“Big Pharma helped to fuel this epidemic by deceptively peddling these dangerous drugs and hooking millions of Americans in exchange for profit,” the mayor said. “It’s time to hold the companies accountable for what they’ve done to our city, and help save more lives.”

through increased substance-use treatment services, ambulatory services, emergency department services, inpatient hospital services, medical examiner costs, criminal justice costs, and law enforcement costs.

Furthermore, according to court papers, manufacturers sought to create a false perception that using opioids to treat chronic pain was safe for most patients and that the drugs’ benefits outweighed the risks. This was perpetrated through a “co• THE FORUM NEWSGROUP

ordinated, sophisticated and highly deceptive” promotion and marketing campaign – including unbranded messaging to evade extensive regulatory framework governing branded communications. These communications, which began in the late 1990s, became more aggressive around 2006 and continue today, the City said.

“Corporations that spend millions on research and marketing cannot claim that they did not know the consequences of

their actions,” said Queens District Attorney Richard Brown.

Additionally, the suit indicates that the distributors, who have both the obligation and the tools to track suspiciously large surges in opioid demand, including at the level of individual pharmacies or clinics, have failed to use these tools to warn public officials about suspicious orders, which they are legally required to do, or to reasonably exercise controls over the obvious oversupply of opioid pills.

The prescription painkiller, heroin, and fentanyl crisis has had serious impacts on the city. According to the administration, the number of drug overdose deaths has increased within the five boroughs in each of the last six years. Rates of drug overdose deaths in NYC more than doubled between 2010 and 2016. The City Department of Health and Mental Hygiene reports that while drug overdose deaths impact every neighborhood and demographic in New York City, residents of impoverished neighborhoods are the hardest hit. Roughly 2.7 million opioid prescriptions were filled in the Big Apple each year between 2014 and 2016.

“The opioid epidemic has been exacerbated by the irresponsible actions of drug companies—and they need to be held responsible for their actions,” said Deputy Mayor for Health and Human Services Herminia Palacio, M.D.

State Alarmed by Drastic Rise in NY Flu Cases

By Forum Staff The State recently announced a dramatic rise in reported influenza cases across New York as Gov. Andrew Cuomo called on all New Yorkers six months of age and over who have not yet received a flu shot to get vaccinated as soon as possible.

According to the State Department of Health, cases of the flu rose by 54 percent and new cases were diagnosed in all NY counties last week. In addition, 1,606 New Yorkers have been hospitalized with laboratory-confirmed flu, the highest weekly number since DOH reporting began in 2004.

And for the last six weeks, the flu has been geographically widespread across the state. As of Jan. 13, 17,362 laboratory-confirmed cases of the flu have been reported and 5,267 people have been hospitalized with influenza in New York this season.

In addition to calling on all New Yorkers to get vaccinated, Cuomo directed DOH to take the following actions: • Continue surveillance of hospitals statewide on bed capacity and supply of vaccines and antiviral medications; • Coordinate with Greater New York Hospital Association, Healthcare Association of New York State, and the Community Health Care Association of New York State to support hospitals on capacity issues and encourage

them to review their surge plans to expand capacity; • Ensure that New York continues to have an adequate supply of flu vaccine and remaining in close communication with the Centers for Disease Control regarding vaccine availability. CDC is currently

by Google and supported by the CDC, a free online service that allows users to search for locations offering immunizations. To find

“Influenza is a potentially deadly disease, and getting vaccinated is the best thing New Yorkers can do to protect themselves and those around them, followed by good hand hygiene,” said DOH

Commissioner Howard Zucker, M.D. “To address the high number of cases we’re seeing across the state, Gov. Cuomo has directed the Department of Health to work with healthcare associations to take action against the flu and coordinate on issues of hospital capacity and surge planning. I urge all New Yorkers to get vaccinated immediately.”

According to DOH, while influenza A(H3N2) viruses have been the most common ones circulating nationally, at times this season, influenza B has been the most common strain circulating in some areas of the state. The influenza vaccine is typically more effective against influenza B, which reiterates how important it is for New Yorkers to get vaccinated.

Adults aged 65 years and older, people with certain chronic medical conditions, young children and pregnant women are among those at highest risk for serious influenza complications, which may require hospitalization and could result in death. Since the flu can spread through coughing or sneezing, it is especially important for family members and people who have regular contact with high-risk individuals to be vaccinated.

“The extraordinarily high rate of influenza this year underscores the critical importance of preventive care," said Rose Duhan, president and CEO of the Community Health Care Association of New York State.

New Law Limits Overnight and Weekend Construction Noise

By Michael V. Cusenza Mayor Bill de Blasio recently signed legislation aimed at reducing overnight and weekend construction noise.

According to the administration, the new law allows inspectors to take noise readings from the roadway or sidewalk, rather than requiring that they be taken from inside of a complainant’s apartment; empowers inspectors to shut down equipment that is too loud; and calls for new rules for responding when the noise is most likely to happen again.

City Department of Environmental Protection Commissioner Vincent Sapienza said the new measure “will empower our noise inspectors with new tools to more effectively enforce the City’s Noise Code” and provide “some muchneeded relief to New Yorkers.”

Additionally, construction companies will be required to electronically file noise-mitigation plans, which will make it easier for inspectors and the public to review online.

“Noise pollution has gotten out of control when your alarm clock has been replaced by a jackhammer. But the incessant din of construction doesn’t have to be the reality of living in a big city,” de Blasio said. “We can do something about it.”

In November, the City Department of Buildings released a report that indicated that construction in the five boroughs is at an all-time high. EDITORIAL ON THE MONEY With an annoying degree of regularity we come upon tips from sources or stories from fellow journalists that describe, in painful detail, behavior of our leaders in government that leave us scrambling to scrape our jaws off the floor.

This, unfortunately, is one of those instances. However, we actually hope this story offends you, so that it also sparks a passionate desire in you to somehow hold said leaders accountable and affect change.

Because something’s gotta give.

On Monday, Michael Gormley of Newsday wrote, “New Yorkers have paid more than $10 million over the last nine years to settle 88 cases of sexual harassment, discrimination, and related cases in state government, almost all of which were brought by women reporting groping, come-ons and demeaning treatment.”

That’s right. Eighty-eight cases. Ten million dollars.

We bet that your initial reaction was similar to ours (perhaps minus several dozen expletives, but you get the drift): “WHAT?!?!? WHY?!?!?”

According to the Office of State Attorney General Eric Schneiderman, all but five of the cases were brought by women alleging “gender discrimination, discrimination

based on sexual orientation, sexual harassment, hostile work environment, and /or sexual assault.”

That there have been 88 reported cases (think for a second about how many were NOT brought to authorities over that same nine-year period) of such boorish, reprehensible, and damaging behavior is unnerving.

That we have had to pay to settle such matters is wrong and downright sickening.

Some of you may recall that injured workers and their families were used as political scapegoats by big business and insurance interests who blamed them for the high cost of doing business in New York. Workers’ Compensation benefits became an easy target as those who needed these benefits were hardly in a position to fight against the deep pockets and political clout of these lobbying groups.

As a result of political pressure during New York State budget negotiations, there was a direction to update the existing impairment guidelines under the guise of reducing costs to employers while still protecting injured workers. The final budget contained a provision directing the Workers’ Compensation Board (WCB) to put together a task force with input from labor, the insurance industry, medical providers, and the NYS Business Council to revise impairment guidelines to reflect “advances in modern medicine that enhance hearings and 6 JANUARY 25, 2018 • Number 04 VOL. 17

have observed and find very disturbing.

Young people come to the Capitol, brighteyed and bushy-tailed, and they think that legislators or people who work very high up in government are somehow godlike . . . and that if they are paid special attention this somehow makes them special or could be helpful to their own careers,” State Sen. Liz Krueger (D-Manhattan) told Newsday.

“They find themselves through their own naiveté and youth in terrible situations and they don’t know how to handle it and they

don’t know they can come forward. They think, ‘It’s just the way things happen here.’ ” In his State of the State address delivered earlier this month, Gov. Andrew Cuomo established the Women’s Agenda for New York: Equal Rights, Equal Opportunity. This features 30 proposals that, according to the governor, “create opportunity for women to succeed in every area: work, health, safety, education and family life.”

One of those proposals delves into sexual harassment in the workplace. Cuomo has pledged to advance legislation to prevent taxpayer funds from being used for settlements against individuals relating to sexual assault or harassment and to ensure that individual harassers are held accountable; propose a uniform code of sexual harassment policies binding on all State branches of government, agencies and authorities; and propose legislation to prohibit confidentiality agreements relating to sexual assault or harassment for all public entities and branches of government—State and local—unless it is the express preference of the victim.

Bravo, Cuomo.

Because 88 cases and $10 million should actually be zero and zero.

result in better outcomes”. These impairment guidelines determine the amount of compensation payable to an injured worker for a permanent injury.

Unfortunately for injured workers, the WCB unilaterally revamped and rewrote the guidelines and released them during a holiday weekend with a 45-day public comment period. These proposed guidelines bore very little resemblance to the recommendations made by labor groups and the Orthopedic Society, and were an outrageous abuse of power. As a result of a very public outcry, the New York State Assembly Labor Committee held a public hearing during which it became very clear to labor groups, injured workers’ advocates, and members of the State Legislature that the Board’s egregious actions would result in a slashing of benefits to injured workers at a time when they are most vulnerable.

vocates showed up at a number of WCB locations across the state, including Hauppauge, Brooklyn, and Buffalo, for Days of Action.

More than 100,000 postcards objecting to the proposed changes were delivered. Members of the Retail Wholesale and Department Store Union (RWDSU), the AFL-CIO, NYCOSH, New York City District Council of Carpenters, DC37, and countless others all publicly railed against these changes. Members of the Legislature called out the WCB for overstepping its authority and for proposing changes that would vastly favor the Business Council over the injured worker.

The Worker’s Comp Board subsequently issued amended revisions, and while there are still some reductions, it was a significant improvement over the initial version. The final version was released last year on December 29.

It is clear that grassroots efforts sometimes do work. Governor Cuomo and the WCB Chair

clearly listened, and for that we are grateful.

We are also grateful to those State legislators, union groups, and medical providers who submitted their insight on the impact the original proposals would have on injured workers.

Lastly, it is clear that those who may have been past or current recipients of Workers’ Compensation benefits – those who have known injured workers or those who just saw an injustice and wanted to help right a wrong – took the time to make a phone call, send a letter, or sign a petition. The outpouring of support took many by surprise, including those interests that were financed by big business groups. One of my favorite quotes is from Margaret Mead, an American cultural anthropologist, who said, “Never doubt that a small group of thoughtful, committed citizens can change the world. Indeed, it is the only thing that ever has.” Truer words were never spoken.

Elmhurst Man Gets Jail Time for Possessing Rare Tortoise that Vanished from Environmental Center

By Forum Staff The hare might have crossed the road before the fabled tortoise, but it was justice that took steps to stay ahead of an Elmhurst man who plead guilty to criminally possessing Millennium, the 17-year-old tortoise, that went missing from the Alley Pond Environmental Center in Douglaston, in July 2017.

Queens DA Brown announced the six-month sentencing levied on Shawn Waters, 37 of 103rd Street in Elmhurst, referring to the incident as “Millennium the tortoise’s summer escapade.”

Thankfully the rare reptile is back at home after an illicit journey that included crossing state lines. He was located in Connecticut and returned to the park, just a week after his reported disappearance.

Millennium went missing from Alley Pond Environmental Center last July.

DA warned other potential reptile robbers that his office pursues justice for all in Queens County, “whether they are warm or cold blooded citizens”.

An employee at the APEC realized that Millennium, an African spurred tortoise, had disappeared from his habitat around 4:00 p.m. on July 16. Staffers discovered a

Connecticut Man Convicted of Murder in 2011 Road-Rage Shooting

By Forum Staff A road rage incident back in 2011 has resulted in the conviction of a Connecticut man, who shot two brothers, one of them fatally.

George Cupi, 54, of Westside Lane in Shelton, Connecticut will face 50 years to life in prison when he is sentenced in what Queens DA Brown has called a “senseless shooting.”

“The traffic dispute had ended and the defendant had left the scene, but instead of letting it go, he returned just minutes later to the same street. He shot both men as they sat in a park. The defendant will now face the possibility of spending the rest of his life in prison,” said DA Brown.

Cupi was convicted at trial of murder, attempted murder and other charges for

shooting two brothers - killing one of them - following a traffic dispute in July 2011 in Kew Gardens.

After a two week trial, a jury found the defendant guilty of second-degree murder, second-degree attempted murder and second-degree criminal possession of a weapon.

It was just about seven months short of seven years that Cupi double-parked his white van with Connecticut plates on Austin around 8 p.m. on July 14, 2011.

A vehicle approached from behind the van with Jovanny Adames and his wife inside. Adames beeped the car horn several times for the van to move so he could pass.

When the van did not move, Adames got

out of his car and approached Cupi, who was behind the wheel of the van.

An argument ensued and Adames’ brother Roberto heard things getting loud and got out to see what was going on.

All three men argued until Cupi drove away. Minutes later, he returned to the scene of the argument with a .38 caliber revolver and opened fire on the two brothers as they sat in the Eight Oaks Park adjacent to the street where the argument had taken place. Roberto Adames, 25, was shot three times in his chest and died. A bullet hit Jovanny Adames, 31, in the face and lodged in his brain, but he survived the injury. Jamaica Man Indicted for Pimping, Raping Teen Girl

By Forum Staff A multi-count indictment has been handed up charging a 34-year-old Jamaica man with sex trafficking, rape and other crimes for forcing a then-16-year-old girl into having sex with him on multiple occasions. Richard (KB) Trantham also forced his victim to have sex with various other men in exchange for money and then pocketed the cash, according to Queens District Attorney Richard Brown.

“The defendant is accused of profiting from prostitution by forcing a teenage girl into having sex dates with men for money,” Brown said. “I once again want to stress that prostitution is not a victimless crime and that sex trafficking is an incessant act of brutality and degradation.

This teenage girl was finally freed but she will have to live with this horrible experience for the rest of her life.”

Trantham was arraigned on a 16-count indictment

charging him with one count of compelling prostitution, one count of sex trafficking, two count of second-degree promoting prostitution, one count of third-degree promoting prostitution, 10 counts of third-degree rape and one count of endangering the welfare of a child.

He was ordered held on $250,000 bail pending the outcome of a bail sufficiency hearing and to return to court on March 6, 2018.

Trantham met the minor victim through Facebook in September 2017 and invited her to model tattoos for him.

After she accepted his invitation, he picked her up, brought her to his home and sexually assaulted her.

By Forum Staff After failing at an escape attempt from Rikers Island this past summer, Naquan Hill of Far Rockaway will now have many years to ponder his missteps and the two Queens burglaries for which he was convicted.

Hill’s sentencing is set for Jan. 31, before Judge Barry Kron who indicated that the persistent felon will find himself behind bars for 16 years to life.

“In pleading guilty, the defendant has admitted to burglarizing two homes – violating the sanctity of the victims’ residences – in an attempt to enrich himself by taking another person’s valuables,” said Queens District Attorney Richard Brown. “As a persistent felon, the defendant will find himself incarcerated for a very long time as a result of this criminal act.”

Police used the Find My iPhone app to trace some of the electronics to his Far Rockaway residence immediately after the property had been taken.

The 25-year-old recidivist also used his own name, phone number and email to register several of the electronic devices.

After executing a court-authorized search warrant on Hill’s residence, police recovered property stolen from the six burglaries, as well as from other burglaries in Queens and Nassau County.

Ozone Park Sex Abuse

By Forum Staff An Ozone Park man has been sentenced to four to eight years in prison after pleading guilty, in November, to sexually abusing and taking nude photographs of a 14-year-old girl in June 2016.

Robert Pou, 54, of 101st Avenue, plead guilty to use of a child in a sexual performance, promoting a sexual performance by a child, second-degree attempted criminal sex act and possessing a sexual performance by a child.

Queens DA Brown praised the court for the imposed sentence. “Betraying the trust of a young innocent girl, the defendant violated her for his own sick gratification. He served her alcohol and then took advantage of her by taking photos of her undressed and manipulating her to perform a sex act on him.”

In June, Pou got the teen drunk and forced her to perform a sex act on him. She was so inebriated tat she passed out.

The following day, the sister of the girl found at least 10 nude photographs of the victim on the defendant’s cell phone.

Authorities Crack Down on Drivers Parking or Idling on Highways near JFK Airport

By Michael V. Cusenza The City Police Department recently led a multi-agency effort to remove vehicles parked or idling dangerously on highways as they wait for passengers arriving at nearby John F. Kennedy International Airport.

South Queens precincts, including the 106th and the 113th, State Troopers, and City Taxi and Limousine Commission Enforcement officials descended on thoroughfares that feed into the airport, such as the Nassau Expressway, to address the pervasive issue where vehicles abruptly pulling into and out of oncoming traffic, endangering drivers.

Goldfeder sent a letter to the TLC urging the agency to ramp up efforts to combat the longstanding practice of roadside parking and idling by for-hire vehicles along a stretch of the eastbound Nassau Expressway between Howard Beach and JFK. “Drivers should not have to contend with parked cars pulling into 50-mile-anhour oncoming traffic,” Goldfeder wrote, noting that the problem has been the subject of multiple enforcement efforts by the 106th Precinct and Highway Patrol in recent years, but that it continues unabated.

A spokesman told The Forum at the time that “the TLC is working closely with the 106th Precinct on a joint initiative to alleviate the problem.”

Comptroller Audit Exposes Access-A-Ride Bureaucratic Breakdowns

According to Stringer, the new audit found problems underpinning the MTA’s systems to address tens of thousands of complaints made by Access-A-Ride users annually.

By Forum Staff Tens of thousands of annual user complaints have had little impact on persistent failures – delays, no-shows, safety issues, and more – that plague Access-A-Ride, according to a new audit released on Sunday

by City Comptroller Scott Stringer.

The analysis, Stringer said, reveals “alarming bureaucratic breakdowns” surrounding the Metropolitan Transportation Authority service and egregious problems underpinning the MTA’s systems to address those complaints.

Under the Americans with Disabilities Act of 1990, public transportation authorities are required to provide a paratransit system for people with disabilities who are unable to use public bus or subway services.

Access-A-Ride primarily delivers service through contracts with a network of private vendors, including 13 dedicated carriers and two broker car service providers.

According to the comptroller’s office, the audit examined more than 21,000 Access-A-Ride complaints taken by the MTA in 2016. Stringer said his staff discovered that the MTA – which contracts with outside vendors for Access-A-Ride service – doesn’t actually investigate the bulk of rider complaints itself. Instead, it sends those complaints to the private contractors who riders claim have provided shoddy service to begin with. The comptroller’s office uncovered massive delays in the contractors’ investigations, and in some cases, no investigations at all – in violation of the agency’s own regulations. The MTA also had no evidence that its own employees ever actually assessed the adequacy of contractors’ responses to complaints referred by the MTA. As a result, the agency doesn’t know if the complaints were ever fixed.

“When a New Yorker calls the MTA to raise safety concerns or relay complaints about poor service, they expect the agency itself will investigate. But what we’re

showing today is that in most cases, that simply doesn’t happen,” Stringer noted. “Instead, for the bulk of the complaints received, it’s passing the buck to the very providers who are accused of causing the problems to begin with.

Clearly, if you’re not going to bother to understand or investigate the problems plaguing your service, they’re never going to get fixed,” Comptroller Stringer said. “Our seniors, New Yorkers with disabilities, and people from across the five boroughs depend on this service.

But we know that it’s failing New Yorkers. Big changes must happen, because we find ourselves back here again astonished at the lack of accountability at the agency. New Yorkers are being let down by their own government, and ultimately, that puts people at risk.”

The comptroller’s auditors took an in depth look at a sample of 145 complaints and found: • In one case—unresolved 140 days after referral—a rider alleged that the Access-A-Ride driver was an hour late, drove 80 mph in a 40 mph zone, and swerved in and out of traffic. The MTA had no evidence of any investigative results recorded in its complaint-management system and no evidence of any follow-up by the Paratransit Customer Relations Unit.

• In another case a customer was reportedly injured when the speeding Access A Ride driver hit a bump, causing the vehicle to be lifted in the air and break one of its wheels. The MTA’s complaintmanagement system showed that the complaint went unanswered for 95 days, before the Paratransit CRU obtained a response. (The MTA’s contracted Access-A-Ride carrier pulled the driver off the road, pending a hearing.) • Thirteen complaints (three safety-related and 10 others) that appeared to warrant investigation were never investigated. The issues included a rider injury, a late pick-up,

Snoring may seem like a pesky yet minor problem, but it can be much more serious than some people know. Although snoring is a common problem among all ages and genders, the National Sleep Foundation says that men are twice as likely to snore as women, and snoring can worsen with age.

The aging process can lead to a relaxation of the throat muscles, resulting in snoring. Furthermore, the NSF says anatomical abnormalities of the nose and throat, illness and other factors may also contribute to snoring. Drinking alcohol, which can have an effect similar to muscle relaxants, in the evening can make snoring worse.

While many people may think snoring is a mere nuisance, it actually may be a symptom of obstructive sleep apnea. Over time, apnea can be associated with high blood pressure and increased risks of heart attack, stroke or death, advises WebMD.

By Forum Staff The City-funded School Construction Authority has kept more than $100 million in an obscure – and inadequately managed – “miscellaneous” checking account, which could lead to waste or abuse, according to an audit released on Thursday

by Comptroller Scott Stringer.

The study examined a two-year period and discovered insufficient controls over the account, Stringer noted, as well as a failure to follow a State law requiring investment of public dollars entrusted to the SCA in order to ensure maximum returns.

The SCA is funded largely through the City’s capital budget, but it also receives money from other sources, ranging from lease payments to insurance and litigation settlements, the comptroller said. For those external dollars, the SCA created a special account called the “Other Funds Account” (formerly known as the “Miscellaneous Checking Account”). Stringer’s office discovered that the account’s balance grew dramatically—from $20 million to $104 million—between Fiscal Years 2007 and 2016.

When auditing the account for Fiscal Years 2015 and 2016, Stringer found that SCA’s internal controls to ensure proper accountability and transparency were lacking. In addition, the probe found that rather than investing the funds as authorized

by State law, the authority kept them in a checking account that earned minimal interest from May 2015 through June 2016

– a missed opportunity to earn better returns. That failure to follow State law and invest those dollars as prescribed by law, Stringer pointed out, means that hundreds of thousands of dollars that could be going to improving school facilities have been left on the table.

“The SCA’s bungling of financial records potentially cost the City millions.

When we could’ve earned a significant return by investing tens of millions of dollars, the SCA knowingly left money on the table,” the comptroller added. “That incompetence comes at the expense of our children. Hundreds of thousands of critical, additional dollars that could have been put toward supporting our schools, our kids, and facilities were ultimately lost.

That’s unacceptable. The SCA must immediately implement controls that will allow for stronger oversight of public funds in the future.”

Stringer issued a series of recommendations as part of the audit, including: Deposit the funds maintained in the account not needed for immediate use in an investment account; implement proper controls over the account.

In its response, the SCA agreed with the audit’s recommendations and stated that it had begun to implement most of the recommendations prior to the commencement of the audit based on reports it received from the SCA Office of Inspector General and Ernst & Young consultant company.

Fix NYC Panel Report Sparks Congestion Pricing Debate

Cusenza A State task force on Friday released its highly anticipated report that endorses a congestion-pricing plan to relax traffic bottlenecks on Midtown Manhattan streets and help subsidize the Metropolitan Transportation Authority’s overhaul of the city’s antiquated subway system.

And, predictably, not everyone is thrilled with the idea.

In October, Gov. Andrew Cuomo organized the Fix NYC Advisory Panel – a mix of community representatives, government officials, and business leaders from across the region tasked with developing recommendations to address the severe traffic congestion problems in Manhattan’s CBD and identify sources of revenue to fix the ailing subway system.

“The panel believes the MTA must first invest in public transportation alternatives and make improvements in the subway system before implementing a zone pricing plan to reduce congestion,” the group wrote in its 35-page report. “Before asking commuters to abandon their cars, we must first improve mass transit capacity and reliability.”

According to Fix NYC’s proposal, all drivers would be charged to enter the Central Business District – an area of Manhattan bounded by 60th Street on the north and Battery Park on the south, the Hudson River on the west and the East River on the east – during weekday business hours.

Car drivers would be charged $11.52; trucks, $25.34; cabs and app-based for-hire vehicles, $2 to $5 per ride. The revenue generated by such a tolling initiative would most likely exceed $1 billion annually.

“Implementing new fees and surcharges should always be viewed as a last resort, but

the dire state of the NYC subway system demands action,” the panel wrote.

And what a dire state it is: • Delays on the subway system have more than tripled in just five years. According to the MTA, on-time performance is down to less than 65 percent, the worst of any major transit system in the developed world.

• The MTA continues to make do with signal technology from the 1930s on most subway lines, and continues to run trains that have been in operation since the 1960s.

• Buses have become increasingly slow and unreliable, and people have started to abandon bus service—bus ridership dropped 16 percent between 2002 and 2015.

Cuomo said he will review and consider the group’s recommendations with the State Legislature over the next several months.

“The report accurately points out that the objective is not to raise tolls entering the borough of Manhattan, but more spe-

Mayor Bill de Blasio has indicated that he is not in favor of a tolling plan, characterizing it as an issue of “fairness.”

“If people have to pay, are they getting something back for it? If people have to pay, does that money stay in New York City?

These are the core questions,” de Blasio said on Wednesday on Fox 5’s “Good Day New York.” “Now, I believe the best way to solve the MTA crisis which is directly related is the millionaire’s tax. I believe taxing New York City millionaires and billionaires and using those proceeds to fix the MTA for the long term is the best and most reliable approach.”

Fix NYC noted that zone pricing “very effectively” reduced congestion, increased average speeds, spurred increased mass transit use, and improved air quality in London, Stockholm, and Singapore.

“To remain a world-class city and region, New York must address the increasing congestion on our roadways and bring the subway system back to a reliable state,” the panel concluded.

“New York’s middle class families and small businesses cannot afford congestion pricing in any form,” Weprin said.

Women’s March Inspires State to Empower Girls

By Michael V. Cusenza Inspired by this weekend’s Women’s Marches across the state, Gov. Andrew Cuomo has announced new actions to empower girls in New York as part of his 2018 Women’s Agenda: Equal Rights, Equal Opportunity.

According to the administration, the proposals will help young people to forge healthy relationships; work to close the gender gap in science, technology, engineering, and math; provide mentoring and leadership opportunities for girls across the state; and ensure access to menstrual products in public schools.

“When New York acts, the nation notices,” Cuomo said on Sunday in Manhattan. “When New York was the first big state to pass Marriage Equality we changed the debate all across the nation and we made it a reality in this country. We’re going to do the same thing with women’s rights. We’re going to pass this women’s empowerment agenda. We’re going to take this moment of pain and outrage and we're going to make it a positive, and we’re going to use the energy, and then we’re going to go across the nation and say it’s a new day, and the dawn of a new era where women get full respect, full equality, no glass ceiling, we respect a woman’s right. We’re going to do it in New York and we’re going to do it all across this country.”

Earlier this month, Cuomo detailed the 2018 Women’s Agenda for New York: 30 proposals “to advance equality and promote opportunity in women and girls’ health, safety, workplace, and family life.”

On Monday, the governor unveiled new actions to empower Empire State girls, including: “Be Aware-Be Informed” Cuomo proposes that the State Education Department and the Department of Health coordinate to create a K-12 learning module for healthy relationships. Such curriculum will include the same definition of consent used in the successful Enough is Enough law to foment a common understanding for all students. Other topics will include age-appropriate information on confronting and avoiding sexual harassment and assault and teen dating violence, as well as medically accurate sexual health.
