De Blasio Touts Accomplishments, Ambitious Ideas in Sixth State of the City

By Michael V. Cusenza Mayor Bill de Blasio on Thursday used his sixth State of the City address to tout his administration’s past achievements and detail a series of ambitious new proposals as Hizzoner continues to seek the mantle of “Fairest Big City in America” for Gotham.

“I believe we can look back at what we've accomplished together over the past year, and we can feel a lot of pride,” de Blasio said.

Here are some of the initiatives de Blasio unveiled on Thursday at the Symphony Space in Manhattan as part of his 2019 agenda: Guaranteed Healthcare for All: The administration will launch the largest, most comprehensive plan in the nation to guarantee health care for every New Yorker, the mayor promised. The plan will serve the 600,000 New Yorkers without insurance by strengthening NYC’s public option, MetroPlus, and guaranteeing anyone unable to afford or ineligible for insurance – including undocumented New Yorkers – has direct access to NYC Health + Hospitals’ physicians, pharmacies and mental health and substance use services through a new program called NYC Care. All services will be affordable on a sliding scale. The programs will include customer-friendly call lines to help New Yorkers – regardless of their in-

Bus Acceleration and Lane Enforcement: De Blasio pledged that the Department of Transportation will work with the Metropolitan Transportation Authority and the NYPD to take action to reverse the decline in system ridership and increase average speeds by 25 percent by the end of 2020. The City will perform street projects

to benefit 600,000 daily riders across the city in 2019. DOT will increase the pace of bus lane installation from an average of 7 miles per year to 10-15 miles per year and add traffic-signal priority at 300 intersections per year, doubling the number of intersections where buses get green lights. The City will improve 5 miles of existing Select Bus Service routes per year with extended hours, restricted turns, and piloting up to 2 miles of physically separated lanes in 2019. The administration will also press for all-door boarding and off-board fare collection, and improve bus stops. To keep bus lanes clear, de Blasio said the administration will advocate for expanded camera enforcement of bus lanes with the State Legislature and the NYPD will create seven dedicated tow truck teams for continual bus lane enforcement and towing.

Retirement Security for All: De Blasio is proposing to provide access to Individual Retirement Accounts for all working New Yorkers. The mayor said he will work with the City Council to pass legislation in 2019 that requires all employers with at least five employees to either offer access to a retirement plan or auto-enroll their employees into the City plan with a default contribution of the employees’ own earnings of 5 percent, which can then be increased or reduced by the employee.

Planet Fitness Open for Business as Concerns are Raised Regarding Permits

Cusenza The new Planet Fitness gym opened its well-toned arms this week: welcoming members, signing prospective clients, and wowing guests at the franchisor’s latest outpost on Cross Bay Boulevard between 160th and 161st avenues, even as some community leaders have raised concerns regarding the shape of the establishment’s operating permits.

The Howard Beach Lindenwood Civic on Sunday posted to its Facebook page photos of Planet Fitness adorned with banners announcing that the gym is open for business.

“Please be advised that this business is opening without any of the permit sign-offs from the Buildings Department, Fire Department, Board of Standards and Appeals and the Community Board’s approval,” the group wrote in an FB post. “That means that their sprinkler, fire alarm, and plumbing permits have not been approved yet. If they do open tomorrow, it will be without a Temporary Certificate of Occupancy from the Department of Buildings. All of these permits are required for MEMBERSHIP SAFETY.

The latest Planet Fitness franchise is located on Cross Bay Boulevard near 160th Avenue.

“Everything is in place; everything passes inspection. You have to go through this process. We’ve done it almost 50 times already,” said Jeff Innocenti, CEO of PFNY, which currently operates more than 40 Planet Fitness franchises in the Big Apple.

tablishment’s lack of a permit to allow the operation of a Physical Culture Establishment, which is issued by the City Board of Standards and Appeals. Innocenti acknowledged that PFNY has applied for the PCE permit and that the process can take anywhere from 6 to 12 months to be resolved.

“We’ve never had BSA approval declined,” he added.

The HBL Civic noted that the “Community Board 10 public hearing regarding this permit will take place on Feb. 7. Generally, the BSA will not render a decision on the permit application until AFTER the Community Board votes on this issue.”

Meanwhile, Innocenti indicated that, as his group has done countless times in the past while waiting for PCE approval, he can open the gym to its new community.

“We respect our community—they’re our members,” he said. “We really like working with the community. If the community has issues, if the BSA has issues, we always work it out.”

The social media posts garnered dozens of comments, including some from skeptical area residents wondering if the questions surrounding the status of Planet Fitness’ permits were the product of area businesses that would be in direct competition with PF. “Someone must have their own agenda against Planet Fitness,” one commenter wrote.

Area Officials Hail Election Reform Legislation

By Michael V. Cusenza Area elected officials this week praised election reform legislation that recently passed both the State Senate and Assembly.

In the Senate, bills were approved to establish initiatives to enable 16 and 17 year olds to preregister to vote; establish a system of early voting; and consolidate the state and federal primary elections into one day.

Additional measures would make it easier for voters who move within the state to transfer their voter registrations to their new addresses; amend the State Constitution to allow voting by mail; and reform existing absentee ballot rules. The Upper Chamber also voted to support a proposed constitutional amendment to allow residents to register to vote on the same day as an election.

By Patricia Adams What do you get when you cross two middle aged guys with a guitar, a set of drums, hopes, dreams, some original songs and what some might call –fate?

The answer is relatively simple: the newly released CD, "Perfectly Imperfect", by the Goodheart Band.

What is not so simple, however, was the road to get there. For Clem Buonocore– the Italian last name translates to Goodheart–, guitarist and vocalist, it began fooling around on the guitar with brother Pat in their basement. But soon, the music got shelved. Lost in the wake of work and raising a family.

The vocals, the song writing, the guitar playing would have to wait for another day. They were not a part of everyday, real life, but the yearning to get back to them never left.

And then it happened.

In 2014, Clem brought his guitar along to a family 4th of July party where he jammed with his nephew. Shortly after he went to jam with his brother Pat again and the drummer at the session was John Mandelino. Playing since he was 5, chosen to represent the US in a band concert for Who’s Who in American Musicians, Mandelino was playing in Bubbling Brown Sugar on Broadway at 19. Along the way, Mandelino toured the US

and Europe with the Nobleman Orchestra and then with punk bands.

He played a lot of music and made a lot of friends. But the difficulties of breaking into the professional world of music left him unfulfilled and he too shelved his aspirations and opened an auto body shop.

Where they cut their new CD, Perfectly Imperfect joined by Jeff Ganz, bass player for Rita Moreno, Melanie, The Village People, Marvin Hamlisch, Cleo Laine, Liza Minelli, Clint Holmes, Andy Williams, Ben Vereen and a host of others.

And so it seems that the two guys who started “a little late” at 57-years-old have shown that dreams don’t die when you keep them alive with determination and love of the art. Suboxone is an opioid medication used to treat opioid addiction and is prescribed by physicians, nurse practitioners or physician assistants to patients for at-home treatment.

By Forum Staff The federal government shutdown is preventing Gotham and Long Island doctors from prescribing the anti-opioid drug buprenorphine (commonly known as Suboxone) that is needed and prescribed as part of recovery and treatment from addiction, Senate Minority Leader Charles Schumer said on Sunday.

Buprenorphine is an opioid medication used to treat opioid addiction and is prescribed by physicians, nurse practitioners or physician assistants to patients for athome treatment, according to the National Alliance of Advocates for Buprenorphine Treatment. The drug is an ideal treatment tool to wean an individual off prescription or other addiction, Schumer noted.

And according to the NAABT, buprenorphine helps suppress symptoms of opioid withdrawal, decrease cravings for opioids, reduce illicit opioid use, block the effects of other opioids, and help patients stay in treatment.

New York’s senior senator also noted that in order to prescribe Suboxone, physicians must go through a process with both the Substance Abuse and Mental Health Services Administration and the Drug Enforcement Administration. SAMHSA provides the training and certification needed to prescribe the drug, and the DEA regis-

ters the physician as someone authorized to dispense controlled substances. The doctor’s DEA identification and registration numbers must appear on every Suboxone prescription they write.

When a physician is first approved to prescribe Suboxone, they may only treat 30 patients at a time. After a year, they can submit a request to treat up to 100 patients at a time, Schumer said, which requires going through a second application process.

One year later, physicians can now apply to increase patient limits to 275 at one time if they have such high patient demand that such an increase is needed.New York physicians and medical centers are reporting that they are unable to contact the DEA to verify and update their registration, and this is preventing them from completing the application to increase their patient load.

Continuing the shutdown would “adversely affect patient access to treatment and New York City providers’ ability to effectively respond to the overdose epidemic,” according to the City Department of Health and Mental Hygiene.

“One of New York’s best arrows in the quiver to beat back the opioid scourge and save so many lives is a drug called buprenorphine, and right now its access is under serious threat if critical federal agencies like the DEA continue to remain shut down for no good reason,” Schumer said.

A federal court in New York on Tuesday ruled against the Trump administration and its plan to include a citizenship question on the 2020 census.

Citing it as “unlawful,” the judge ordered the removal of “Is this person a citizen of the United States?” from all forms of the upcoming national enumeration.

The decennial Census determines an area’s representation in the U.S. House of Representatives, as well as how much federal funding it will receive for schools, infrastructure, health services and more.

Grace Meng (D-Flushing) said. “Since last year, I have continuously warned that asking respondents if they are citizens would likely decrease response rates and as a result produce an inaccurate and incomplete count that would have a decade’s worth of consequences.

Ozone Park Man Charged in Gunpoint Rape

By Forum Staff An Ozone Park man has been charged with raping a woman last month in Jamaica, Queens District Attorney Richard Brown announced on Thursday.

George Persaud, 24, was arraigned on a complaint charging him with first-degree rape, first-degree criminal sexual act, seconddegree kidnapping, and first-degree sexual abuse. Persaud was ordered held without bail and to return to court on Jan. 25.

According to the charges, on Dec. 29, around 11:45p.m., Persaud approached the victim, 40, on the street, displayed what appeared to be a black firearm and said “Don’t do anything stupid or I’ll kill you,” and proceeded to sexually assault the woman.

where he continued the sexual assault, and over the course of several hours repeatedly sexually abused and raped her. At one point, Persaud appeared to let the woman leave—but he followed her to her vehicle,

According to the charges, Persaud allegedly took the victim’s car keys and drove the two of them to an alleyway on 100th

Street. When he exited the car to relieve himself, the victim remembered she had a spare key in her handbag, retrieved it and fled the scene.

Brown said that fingerprints retrieved from the interior rear driver’s side window were matched to Persaud.

If convicted, Persaud faces up to 25 years in prison, Brown noted.

“The allegations in this case are very disturbing,” the DA added.“The defendant encountered the woman shortly before midnight on the street, displayed what appeared to be a firearm, threatened and then repeatedly raped and sexually abused her for several hours. The alleged culprit has now been apprehended and faces a lengthy term of incarceration for the torture and abuse inflicted on this woman, who feared for her life.”

Jamaica Man Charged in 17,725-Count Indictment for Possessing Thousands of Images and Clips of Child Porn

By Forum Staff Seventeen thousand, seven hundred and twenty five. That's the number of counts in an indictment charged against a Jamaica man after he was found with thousands of images of child sexual abuse. Vishal Lalbeharry, 30, of 95th Avenue, was also charged with sexual misconduct for bestiality.

The defendant downloaded thousands of photos and videos of children as young as six months-old being abused by adult men and women, in addition to recording himself having sexual relations with an animal.

DA Brown. Said, “…the internet is a valuable learning tool, it unfortunately is also a doorway for deviant sexual predators who trade and sometimes act on these vile and disturbing collections of videos and photographs of children being abused.

The images accumulated by this defendant allegedly contained some of the most horrific ways imaginable to sexually abuse a child - even babies were defiled. The children …must live with the scars on their bodies as well as in their memories forever.”

Lalbeharry was arraigned before Acting Queens Supreme Court Justice Stephanie Zaro on 5,903 counts of promoting a sexual performance by a child as a sexually motivated felony, 5,903 counts of promoting a sexual performance by a child, 5,903 counts of possessing a sexual performance by a child and 16 counts of sexual misconduct. The defendant’s next court date is April 22, 2019.

Detectives conducting an online investigation on March 27, 2018, used an internet investigative tool to detect IP addresses sharing child sexual abuse images. The software identified the defendant’s computer address as having allegedly downloaded 1,150 files containing images of children

being sexually abused. Some of the files had the titles “Babies F**ked,” “Judyan 04,” “2006 Tara 7 yr" and numerous others.

Some of the photos showed babies actually being penetrated anally and vaginally by adult men.

Lalbeharry’s computer was active on a network between March and April 2018, acquiring as many as 10,240 files of photos and videos of children - none older than 10 years old being sexually abused. At the time of the defendant’s arrest, he told police that no one else uses his computer.

He told authorities that, “while I was downloading regular porn, some images of child pornography were in the files...I have seen this by mistake.”

Police seized four, four cell phones and five hard drives from his room and a forensic analysis of the items showed thousands images of children - from infants to 10 year olds with their genitals exposed and being sexually abused in numerous ways. Included in the defendants collection were 16 video recordings with him engaged in sexual intercourse with a dog.

If convicted, Lalbeharry faces 7 years in prison.

Borough-based Vehicle Forgery Crew Nabbed after Long-term Investigation

By Forum Staff A seven member vehicle forgery crew, based in Queens was busted and indicted by a grand jury on various counts of conspiracy, enterprise corruption and money laundering, after a long-term investigation revealed they raked in over $400,000 from their illegal enterprise.

The defendants are accused of delivering fake auto documents printed from cars and – operating as early as July 2015 – are accused of supplying forged temporary license plates, registrations and other documents to buyers throughout the five boroughs and Long Island.

The defendants set up an illicit business - complete with a payroll and forgery-machines installed within vehicles for quick delivery and printing on-demand. Authorities noted that this type of fraudulent documentation is commonly used to disguise stolen autos, facilitating buyers to cheat the system.

The investigation leading to the indictment and arrests began after members of the NYPD’s Auto Crime Unit spotted Craig’s List advertisements for New Jersey State temporary license plates and vehicle registrations. Undercover detectives contacted the seller and successfully purchased fraudulent vehicle identification documents and other material.

Utilizing court-authorized eavesdropping tools undercover detectives intercepted phone calls made and received by Andrew Pandiani, the boss of the business named Verrazano Collision Specialists LLC, proven to be a shell company, never registered or licensed by the state.

City Expands NYC Ferry System

The NYC Ferry will serve all five boroughs by 2020, according to Mayor de Blasio.

By Forum Staff The popular NYC Ferry system is expanding to serve all five boroughs by next year, Mayor Bill de Blasio announced on Monday.

According to the City Economic Development Corporation, the expansion includes the addition of two new routes that will run from Staten Island and Coney Island, plus the modification of two existing routes to include new stops in the Bronx and Brooklyn. A new ferry stop in the Throggs Neck/Ferry Point Park section of the Bronx will join the Soundview route, and a stop at the Brooklyn Navy Yard will be added to the Astoria Route.

The EDC commenced the 2018 Feasibility Study to determine whether the system could expand to serve more waterfront communities throughout the five boroughs. The analysis included feedback from New Yorkers, elected officials, and community boards.

The NYC Ferry expansion includes: • Modification of the Astoria Route in 2019 to include the Brooklyn Navy Yard: This May, a stop will be added at the Brooklyn Navy Yard on the Astoria Route. The Navy Yard, which currently serves as NYC Ferry’s homeport, is undergoing a historic expansion of the campus and is expected to more than double its workforce by 2020, EDC officials noted. Starting this May, the Astoria Route will take ~45 minutes from start to finish, according to the administration.

• Launch of the St. George Route in 2020: The new route will run from St. George to Battery Park City/Vesey St., ending at Midtown West (W. 39th Street / Pier 79). Anticipated total run time is ~35

minutes.

• Launch of the Coney Island Route in 2021: The Coney Island route will launch in 2021, with a stop in Bay Ridge, before ending at Wall St. /Pier 11, an anticipated total run time of ~35 minutes from start to finish. The route is estimated to serve approximately four thousand NYCHA residents that live within a half-mile radius of the landing.

• Extension of the Soundview Route in 2021: A new landing in Throggs Neck/ Ferry Point Park will be added to the Soundview route. Launched in August 2018, the Soundview route connects residents and workers in the East Bronx with stops on Manhattan’s Upper East Side (E. 90th Street), Midtown East/E. 34th Street and Wall Street/Pier 11. Riders boarding at the new Throggs Neck/Ferry Point Park ferry stop are able to transfer for free to the East River, Rockaway, Astoria, and South Brooklyn routes at East 34th Street and Wall Street /Pier 11. The extended route will take approximately ~51 minutes from start to finish.

• Modification of the South Brooklyn Route in 2021: The South Brooklyn Route will be reconfigured to start from Sunset Park/Brooklyn Army Terminal instead of Bay Ridge, which will be added to the new Coney Island Route and will no longer stop at DUMBO/BBP1. Alternatively, DUMBO/BBP1 will only be accessible via the East River Route. Starting in 2021, the new estimated run time will be ~34 minutes from start to finish.

“In less than two years, NYC Ferry has become one of the most reliable, affordable, and beloved transit systems in the city,” said NYCEDC President and CEO James Patchett.

Finding Out About Hormones: A new option for women's health The days of people assigning total trust in their doctors and staying out of their health care decisions are long over.

Many factors have contributed to the new-age awareness in personal health care, most notably, rising healthcare costs.

One rising area in personal awareness comes from women’s eagerness to investigate the effects of thier ever changing hormones on overall health.

Hormones provide many clues about women’s health, but diagnostic testing can run into thousands of dollars which prohibits many, both insured and uninsured, from taking advantage of the valuable knowledge to be found in the information provided by the bodies hormones.

Several start up companies launched home testing kits in 2018 with options for testing affects on stress, thyroid and fertility intel among other conditions. Experts are predicting that hormonal home testing will grow three to four-fold over the next few years.

While we support everyone arming themselves with as much information and safe practice diagnostic tools to participate actively in their own healthcare, we want to make you aware of some of the possible pitfalls.

Home hormone testing definitely has a financial advantage. Most of the kits start under $100 and top out at $400, but one the associated drawbacks is not really knowing what to test for to get the

answers you’re seeking could easily be a waste of money on tests that don’t apply.

Additionally, you should always do this testing in conjunction with your doctor’s advice, but be aware that some docs amy not have the expertise to interpret results of the hormone panels.

It’s critical to work with a physician who can help you make sense of your test results and any follow-up measures needed to be taken in reaction to the results.

Many of the kits also include diet and lifestyle recommendations along with supplement suggestions. These kits may very well end up leading to important findings and diagnoses that women might not otherwise seek out. Some of these discoveries could be life threatening and in turn life saving. The kits can be a great option for women, not just those with curiosity, but for those who might not otherwise get essential lab testing.

Civic Set to Host Rally to Demand Action to Combat Increasing Coastal Flooding in Howard Beach and Hamilton Beach

By Forum Staff The New Hamilton Beach Civic Association is set to host a rally later this month to demand immediate action to combat increasing coastal flooding throughout Hamilton Beach and parts of Howard Beach.

The event has been scheduled for Saturday, Jan. 26, 2 p.m., at Our Lady of Grace Catholic Academy (158-20 101st St., Howard Beach, NY 11414).

According to the civic, in May 1965, the U.S. Army Corps of Engineers started construction on the Stamford Hurricane Protection Barrier. It took four years to complete at a total cost of $14.5 million; as of September 2011, the project had prevented $38.4 million in flood and coastal storm damages.

The barrier was able to hold back an 11-foot storm surge caused by Superstorm Sandy in October 2012, helping to prevent an additional $25 million dollars in damage to businesses and homes.

That same year, the civic continued, the USACE completed an additional study after the extensive damage caused by Hurricane

“Our community here in South Queens has been plagued by persistent flooding for far too long,” said Assemblywoman Stacey Pheffer Amato (D-Howard Beach).

our community,” the civic wrote in a statement.

The NHBCA has received support from community leaders.

“The Army Corps of Engineers needs to devise a plan that protects all New Yorkers, not just the lucky few,” said City Councilman Eric Ulrich (R-Ozone Park).

“Each year that passes and nothing is done, the residents of Hamilton Beach and other coastal areas of my district remain in harm’s way if another storm like Sandy — or worse — were to reach our shores,” State Sen. Joe Addabbo, jr. (D-Howard Beach) added.

“In our district there are over 6,200 residences located in the current flood plain.

Those homes and the people who live in them deserve protection from tidal flooding.

More and more frequently they are being negatively impacted by smaller tidal events, not just the catastrophic ones like [Hurricane] Irene and Sandy,” said Community Board 10 Chairwoman Betty Braton. “The perimeter plan would go a long way to provide that needed protection.”

Council Approves Bill to Reduce Burden of Awning Sign Violations

According to a New York Times report, complaints to 311 referencing a City statute requiring special permits for businesses to hang signs or awnings larger than six square-feet have increased considerably over the last year.

“Once a complaint to 311 about unlicensed signs or awning is filed, the City is required to investigate and may issue violations that carry a minimum fine of $6,000,” The Times wrote. “Replacing a sign can cost thousands more.”

The recent uptick in complaints has taken a toll on borough shopping strips, including Jamaica Avenue.

increasing safety measures onthe City Department of Education’s school bus system. One of the bills features a requirement that all school buses be equippedwith a two-way communication device and GPS tracking devices.

Another STOP bill would require the DOE to report on complaints and investigations relating to school bus transportation services. Introduction 929-B would require the department to report twice a year on all of the calls and complaints received fromparents and guardians about school bus services, the investigations DOE openedinto school bus employees, the number of those investigations that were substantiated, and a description of outcomes taken by DOE in the event of asubstantiated investigation.

“Every parentfeels anxious when someone else is responsible for their child’s safety, howeverbrief, and these bills will provide additional protections and give parentsaccess to the information they need when they make requests to the DOE’s Office of Pupil Transportation,” said Councilman Joe Borelli (R-Staten Island), the measure’s sponsor.

Jamaica Man Convicted for Viciously Beating Wife while 8-Months Pregnant

The victim was eight months pregnant when she was beaten.

Mark King who resided near the Van Wyck Expressway in Jamaica was convicted at trial after assaulting his pregnant wife inside the Lincoln Motor Inn, where the homeless family was being housed in February 2018.

Following a one-week-long trial, a jury of seven women and five men convicted King on Tuesday of second-degree assault before Queens Supreme Court Justice Richard L. Buchter. Trial testimony revealed that on February 3, 2018, the defendant and the victim, his wife, were living in the shelter located at the Lincoln Motor Inn. The defendant chased the victim from their fourth floor apartment, ultimately catching up with her inside of the lobby, where he was observed, bywitnesses and surveillance video, viciouslybeating his wife while she was eight months pregnant. The defendant threw a cell phone at her and then repeatedly kicked and stomped her in the head and body until she lost consciousness.

King’s sentencing is scheduled for January 29, and he faces five to seven years in prison.

Fresh Meadows Men Charged with Shooting Woman through her Kitchen Window

By Forum Staff A 20 year-old woman suffered a gunshot wound and other extensive injuries after two gunmen fired shots through her kitchen window in the wake of a dispute with her boyfriend.

Identified as Alec Bilciu, 21, and Jacob Yagudayev, 22, both of Fresh Meadows, the defendants were arraigned on a complaint charging them with first-degree assault, two counts of second-degree criminal possession of a weapon and first-degree reckless endangerment.

Last Saturday morning around 5:45 a.m.,the defendants showed up to the victim’s 163rd Street and apartment in Flushing and repeatedly knocked on the door. When the man closed and locked the door the defendants banged on it and ripped the knob off. The defendants then allegedly fired four shots into the apartment through the front door and a side window, striking the 20-year-old victim, who was in bed. The woman was struck in her leg and transported to a local hospital, where she is currently being treated for injuries that include a shattered femur bone.

A prior dispute started on November 25, 2018, when Bilciu and Yagudayev arrived at the victim’s home around 7:30 a.m. and began banging and kicking the door. The young woman’ boyfriend answered at that time too, and a physical altercation with Yagudayev followed. The boyfriend then began receiving threatening phone calls in which someone stated “I’m going to find you.”

Both men were ordered to return to court on January25 and if convicted, face up to 25 years in prison.
