‘New Era in Queens’: DA Katz Hails Policies ‘that will Enhance the Safety of all those who Live, Work and Visit’ The World’s Borough

By Forum Staff Mere hours before Monday’s inauguration ceremony at her alma mater, St. John’s University, Queens District Attorney Melinda Katz outlined new initiatives and policies that, as the Forest Hills native put it, “will make the criminal justice system more fair and equitable for the 2.3 million people of Queens County.”

The policy changes implemented on day one include four major revisions. First, the 180.80 waiver policy is abandoned. The “top count only” plea policy after indictment is also eliminated. Getting rid of the so-called 180.80 waiver policy allows assistant district attorneys at all times to discuss resolving cases through plea negotiations without a defendant waiving their statutory right to grand jury proceedings, Katz explained. She also noted that the restrictive top count plea policy limited post-indictment pleas to the top count only.

Katz immediately established a Conviction Integrity Unit and a Community Partnerships Division.

Prior to Monday’s action, Queens had been the lone borough sans a Conviction Integrity Unit.

A Conviction Integrity Unit is now in place to examine cases and make recommendations for exoneration if someone is found to be wrongfully convicted. Katz has pledged to work with defense attorneys and community leaders to determine which cases should be reviewed in

order to prevent a miscarriage of justice. A wrongful conviction not only destroys the life of that innocent individual and his or her family, but it also undermines the faith we all have in our justice system, Katz noted.

And the newly minted DA indicated that the Special Prosecutions Division has been renamed the Community Partnerships Division—and “justly empowered to work with the community to foster communication and effectuate change,” Katz said.

The borough’s top prosecutor also posited that the first responsibility of the district attorney is to make our streets and neighborhoods safe. That means reducing crime and taking the necessary steps to prevent crime from happening in the first place. That means taking guns off our streets, finding avenues for young people to resolve their differences without resorting to violence, fairly investigating accusations of wrongdoing and creating diversion programs in partnership with the community. In order to advance these changes, Katz said she organized a new nine-member executive team.

“We have created a team with the unique kind of expertise and specialized skills that will usher in a new era here in Queens County,” she added.

“The new policies and appointments are just the start, as we look forward to innovative ideas that will enhance the safety of all those who live, work and visit Queens.”

Cusenza Powerful gusts teased the flames and seemed to breathe new life into the stubborn Beast over two hours Sunday morning in Ozone Park before the City’s Bravest could corral it—but not before the four-alarm fire injured 10, displaced at least 30, and destroyed six buildings, according to the Fire Department and published reports.

More than 200 firefighters attacked the inferno that started around 11:30 a.m. in the Ozone Park Supermarket at 101st Avenue and 80th Street. The formidable wind allowed the blaze to infect neighboring homes, making it especially difficult for smoke-eaters to get it under control.

“The heavy winds definitely contributed to the fire,” FDNY Chief Dan Browne told the New York Daily News.

were rushed to Jamaica Hospital Medical Center with nonlife-threatening injuries.

“It was extremely bad,” one eyewitness told the New York Post. “Fire was shooting out the windows and firefighters were really having to battle to put it out.”

The cause of the blaze is under investigation by fire marshals, FDNY officials said.

“My thoughts go out to all of those that were affected by the terrible fire that destroyed the Ozone Park Supermarket and four apartment buildings on Sunday morning,” said State Sen. Joe Addabbo, Jr. (D-Howard Beach).

The Metropolitan Transportation Authority has conducted several town halls across the five boroughs over the last two years, but this will be the agency’s first in Rockaway.

“The purpose of this meeting is to give our commuters a voice. As I continue my #MassTransitMonday tours around my district, I hear about their numerous challenges and journeys to and from work. My constituents’ daily commutes are some of the longest in the nation.

That’s why I am so excited for them, and for us, to have this platform with President Byford,” Pheffer Amato said. “It is extremely important that our voices are heard and challenges considered, as the MTA moves forward with the modernization of our entire public transportation system. We must take full advantage of this opportunity.”

According to State Comptroller Tom DiNapoli’s 2018 “Economic Snapshot of the Rockaways” report, transportation is still a major issue for residents because 90 percent work outside of the Rockaways and face the longest commute among the 55 neighborhoods in the city (averaging 52 minutes). NYC Ferry and a Select Bus route were added in 2017, but subway service remains unreliable, DiNapoli noted.

FDNY Touts Drop in Fire Deaths

By Forum Staff The City recorded 66 fire deaths last year, 25 percent fewer blaze-related fatalities than 2018, when 88 people lost their lives in fires in the five boroughs, Fire Commissioner Daniel Nigro announced Wednesday.

And 2019 marks the 14th-consecutive year there have been fewer than 100 fire-related deaths in the city—“an unprecedented period” in Gotham’s history, Nigro noted.

“This outstanding achievement is the result of our members responding quickly, working together to remove those trapped by fire, providing unrivaled emergency medical

care, thoroughly investigating fires, educating the public, and inspecting buildings and areas of public assembly throughout the city to ensure the safety of the public we serve,” the commissioner said.

Additionally, FDNY Emergency Medical Service responded to a record high number of medical emergencies last year (1,531,870) up from 1,529,569 medical emergencies in 2018.

According to the department, EMS responses fall into one of two broad categories: Segment 1-3, which include life-threatening emergencies such as cardiac arrest, unconscious and choking calls; and Segment 4-8, incidents which are triaged as non-life-threatening incidents. FDNY EMS responded to 563,920 Segment 1-3 calls and 967,950 Segment 4-8 incidents in 2019.

“The men and women who serve in the FDNY are everyday heroes,” Mayor Bill de Blasio added. “Their hard work and commitment to public safety have resulted in a sharp decrease in the number of New Yorkers who needlessly lost their lives last year. From fighting and investigating fires to providing outstanding medical care, I applaud each member’s bravery and service to our city.”

The deadliest year in New York City for fires was 1970, when 310 people died in infernos across the five boroughs. In 2016, 48 people died in fires in the Big Apple.

Man Indicted for Rockaway Beach Slay

By Forum Staff A Far Rockaway man has been indicted in the shooting death of a fellow borough resident outside a Rockaway Beach deli days before Christmas, Queens District Attorney Melinda Katz announced Tuesday.

Michael Hall, 33, was arraigned Friday on a six-count indictment charging him with second-degree murder, second degree criminal possession of a weapon, and endangering the welfare of a child. Hall was remanded into custody when his defense lawyer reserved a bail application for a later date.

Hall is scheduled to return to court on April 9.

According to the charges, shortly after 6 p.m. on Dec. 18, Hall was allegedly observed on video surveillance in front of a deli at 8718 Rockaway Beach Blvd. The victim, Dion Gumby, was seen a short time later on the same video surveillance at the location and he and the defendant had a brief conversation. As Gumby, 45, walked away, Hall allegedly drew a handgun, cocked it, and fired several rounds in his direction—in front of a number of people, some of whom were children. Gumby was struck in his arm, chest, and abdomen; he would later succumb to those injuries.

If convicted, Hall faces up to 25 years to life in prison.

NY Pols Allot $90M for Nonprofit Security

Cusenza As part of the federal appropriations legislation passed last month, Congress increased funding for the Nonprofit Security Grant Program to $90 million—a 50-percent boost from previous funding levels, 10 members of the House of Representatives who serve New York communities announced Thursday.

According to the elected officials, the grants provide support, and help improve security and safety at vulnerable institutions throughout the Empire State, including synagogues, mosques, churches, and community centers.

“We have all been horrified by the anti-Semitic attacks over the past few weeks and the rising trend of terrorist attacks on houses of worship,” the NY delegation said in a joint statement. “This cannot continue, because everyone should be able to worship and pray in peace. That’s why we fought to increase critical funding for the Nonprofit Security Grant Program by 50 percent to help protect and secure these institutions. Additionally, in the coming months our offices will be working with organizations throughout New York City and the entire metropolitan area to ensure those in the community have all the federal grant funding, resources, and tools they need at their fingertips.

Because we all must work together to not only educate and eradicate hate, but to leave no stone unturned in our efforts to ensure safety and security in our communities.”

The NY pols also have pledged to host grant workshops throughout the five boroughs in the coming months to help high-risk nonprofit institutions

Thursday’s press conference announcing the security funding increase was held at the Museum of Jewish Heritage – A Living Memorial to the Holocaust in Manhattan, and at a tumultuous time rife with a rising trend in anti-Semitism and terrorist attacks on religious institutions. Last month, within 24 hours, Jewish worshipers were attacked during a Hanukkah celebration in Monsey, N.Y. and a gunman fired on worshipers at a Texas church, killing two. This follows the anti-Semitic mass-shooting in Jersey City, and a spate of anti-Semitic attacks in NYC during Hanukkah that are being investigated as hate crimes.

Anti-Semitic assaults doubled in 2018, while attacks against Jews and Jewish institutions across the country remained at near-historic levels, according to the Anti-Defamation League’s annual Audit of Anti-Semitic Incidents.

We’re in desperate need of such a straight shooter right about now.

We’d send him straight to 2 Broadway, to Metropolitan Transportation Authority headquarters.

Because it’s painfully obvious that the chief decision-makers of this oft-beleaguered bureaucratic behemoth quite obviously don’t know whether they should lead, follow, or get out of the way.

The latest example of ridiculousness courtesy of the MTA stems from botched rail cars.

“New York City Transit President Andy Byford announced Wednesday morning that all of the new R179 subway cars have been removed from the rails for door inspections. That forced the MTA to return into service this morning( and until further notice) some of the older train cars the new models were to replace,” Mark Hallum wrote in AM New York.

Yup, you read that correctly.

The best part about this - and trust us: We’re only laughing to stave off the tears - the MTA was warned, quite publically, about the problems with these particular

cars and the contract attached to them.

“The New York City subway riders who foot the bill for the MTA’s $600 million contract with Bombardier were promised new, state-of-the-art train cars to help modernize our ailing transit system. Now, all the cars that were delivered so far have been pulled from service due to critical defects. It is completely unacceptable,” City Comptroller Scott Stringer fumed Wednesday. “Last month my office released an audit that exposed how this contract became three years behind schedule and cost taxpayers millions of additional dollars. Our investigation

revealed layers of mismanagement in the MTA’s oversight of the contract - repeated failures to meet contract deadlines and requirements, poor project management and technical breakdowns, structural defects that delayed cars being put into service, and several earlier structural problems that caused some of these trains to be pulled from service.

“Bombardier sold us lemons,” Stringer continued. “Straphangers need the MTA to manage these contracts from the beginning - before the trains go off the rails.”

That’s right. We even covered that audit,

which found that throughout the seven-year extended contract term Bombardier consistently failed to timely meet project milestones, comply with technical requirements, produce acceptable work, and promptly correct serious defects in critical structural components of the subway cars. In addition, the report showed that the MTA failed to adequately oversee Bombardier’s contract performance and timeliness and failed to complete required annual contractual evaluations to hold Bombardier accountable.

Wait - it gets better.

The Comptroller’s Office noted that MTA New York City Transit said it “fundamentally disagrees with the audit conclusions in several respects. It is dramatically short-sighted of the audit to conclude that the completion of the contract had been substantially delayed from the outset of the contract in 2012. Further, in measuring the quality of Bombardier’s performance and NYCT’s oversight primarily on the basis of the original milestone dates, the audit fails to recognize the complexity of the typical rail vehicle design and manufacturing process and the valid reasons for delays that occurred including unforeseeable technical issues.”

MTA - Please just get out of the way.

Murder, Shooting Incidents Increased Last Year: NYPD

By Forum Staff Though the City achieved record low overall index crime in 2019, improving upon 2018’s records for public safety and crime reduction in the modern era, two vital offenses—murder, shooting incidents—increased last year, according to recently released City Police Department statistics.

Murder is up 7.8 percent compared to last year (318 vs. 295). Citywide shooting incidents are up 2.9 percent (766 vs. 754) when comparing 2019 vs. 2018. However, as Police Commissioner Dermot Shea noted, there were demonstrable decreases in shootings in the last quarter of 2019, including the lowest number of shootings, 56, in any December since the start of the CompStat era. The number of shootings in the final six months of 2019 was the lowest figure for any six-month period in the CompStat era.

In 2019, overall crime is lower than in 2018, dropping to a new benchmark of approximately 95,000 incidents—with 872 fewer victims than last year. This comes as the NYPD responds to an increasing volume of calls for help. Radio runs skyrocketed to 6.4 million last year, compared with 4.8 million in 2015, an increase of roughly 1.5 million radio runs citywide. Since 2015, response

“While crime is at a record low in New York City, there is more work to do to ensure that every New Yorker feels safe in their neighborhood. We will continue to use precision policing to target enforcement and deepen our work with communities to fight

crime,” Mayor Bill de Blasio said on Monday.

“With Commissioner Shea at the helm, I have full confidence the NYPD will continue to make our city even safer.”

Shea noted that the department will be announcing a new comprehensive youth strategy in the coming weeks. One component of this effort includes the establishment of a “Youth Forum,” an initiative, based on the CompStat and RxStat models, where NYPD and City agency partners will work together to design the most effective enforcement and prevention strategies to address rising youth crime. Preliminary meetings have been underway with members of the five district attorney’s offices, the Department of Probation, the Law Department, and the Mayor’s Office of Criminal Justice.

State AG Reaches Agreement with Opioid-Overdose Drug Manufacturer

By Forum Staff The pharmaceutical firm, Emergent BioSolutions—manufacturers of the successful opioid-overdose reversal nasal spray NARCAN—has agreed to renegotiate terms that may have prevented the supply of its patented spray technology to potential competitors, State Attorney General Tish James announced Thursday.

According to James, in February 2016, Adapt Pharma, Inc. launched a naloxone nasal spray, branded as NARCAN, in the United States. While naloxone has been used for decades by first responders and others for the

emergency treatment of known or suspected opioid overdoses, NARCAN’s nasal spray device makes it a convenient, non-invasive option that can be used safely, easily, effectively, and without risk by any person—regardless of medical training. In October 2018, Adapt was acquired by Emergent.

The investigation by the Attorney General’s Office revealed that before being acquired

According to James, after she laid out her concerns, Emergent and the AG’s Office came to an agreement that would ensure Emergent no longer enforces the terms of the previously negotiated exclusivity contract. Additionally, the agreement will ensure Emergent renegotiates the contract with its nasal spray device manufacturer.

“Given the tragic, devastating effects of

the opioid crisis, and the urgent need for additional drugs for the emergency treatment of opioid overdoses, my office will do whatever possible to ensure that there are no unnecessary impediments to the development of additional life-saving opioid overdose reversal drugs,” James said. “I’m proud to announce that, starting today, additional companies will be able to gain access to these nasal spray devices. With more companies able to access this easy-to-use technology, our hope is that we can reduce the number of opioid-overdose deaths across New York and this nation and save millions of additional lives.”

$45M Available to Protect Faith Facilities: Cuomo

The exhaustive, 432-page draft proposal, according to MTA officials, seeks to completely redraw borough bus routes.

By Forum Staff An additional $45 million in State funding is available to help protect New York’s religious-based institutions, including non-public schools and cultural centers, against hate crimes, Gov. Andrew Cuomo announced Sunday at the “No Hate. No Fear.” Solidarity March over the Brooklyn Bridge.

The grants, which will be directed by the State Division of the Budget, provide up to $50,000 in funding for additional security training, cameras, door-hardening, improved lighting, state-of-the-art technology, and other related security upgrades at each eligible facility. Organizations that operate more than one facility have the opportunity to submit up to five applications.

According to the administration, funding is being made available through Requests for Applications under NY’s Securing Communities Against Hate Crimes Grant program.

Created by Cuomo in 2017, the program provides funding to strengthen security measures and prevent hate crimes against nonprofit day care centers, community centers, cultural museums, day camps, and non-public schools, which may be vulnerable because of their ideology, beliefs or mission, the governor noted. Since the program’s inception, more than 500 such projects have been supported by $25 million in State funding.

Cuomo also announced Sunday the creation of a new tip line that New Yorkers should call if they experience bias or discrimination: (877) NO-HATE-NY. Hate crime statistics indicate a surge of anti-Semitism and hate crimes against the Jewish community, nationally and in New York. Nearly half of all

hate crimes in New York over the last several years have been against the Jewish community. The Oct. 27, 2018 mass shooting at the Tree of Life Synagogue in Pittsburgh and the recent terror attack at a kosher market in Jersey City, in which a local Yeshiva and Catholic school faced gunfire, underscore the need to protect Jewish institutions from violent extremism and anti-Semitism, Cuomo said.

“The recent rash of anti-Semitic and other hate-fueled attacks in New York and across the nation are understandably causing anxiety, but we will not be intimidated,” Cuomo said Sunday. “In New York we stand up to those who try to sow division and fear, and this new funding will provide religious and cultural institutions the support they need to help protect themselves and keep people safe. We will not let the cancer of hate and intolerance weaken us—we will continue to stand up and denounce it every time it rears its ugly head.”

Additionally, the Governor announced that State Police will continue increased patrols and security in Orthodox Jewish neighborhoods across NY. On a related note, U.S. Rep. Grace Meng (D-Flushing) is drafting legislation that seeks to improve coordination between local and federal law enforcement in targeting and reporting hate crimes, to make sure that acts of antiSemitism are being handled appropriately at the federal level.

“We need more than words and condemnations. We need action and resources, and we cannot rest until we use every tool at our disposal to eradicate all forms of intolerance and bigotry,” Meng said Sunday. “Enough is enough.”

JOINT EFFORT: YOUR PHARMACIST CAN HELP WITH PAIN Many of our customers who are used to maintaining a healthy active lifestyle are finding themselves compromised by joint pain.

Joint pain is something that is experienced at some point by most people in their lifetime. For some people the pain is minor and non-progressive, but for many it means giving up activities they enjoy and can limit their ability to work.

Avid cooks can lose their ability to cut and chop because of pain and swelling in their fingers, especially thumbs. Swimmers who swim multiple times a week for exercise have such shoulder discomfort that they can lo longer enjoy the benefits of their exercise program.

Joint pain is the main symptom of many different musculoskeletal (MSK) conditions, including all types of arthritis, connective tissue disease and osteoporosis.

Patients typically rely on topical nonsteroidal anti-inflammatory preparations (NSAID) and prescription drugs in order to ease their symptoms and get to sleep at night.

Many rubs, balms and lotion-like/gel preparations are available to address the aches and pains that accompany joint discomfort. Some common names you may recognize are BioFreeze, Icy Hot and Voltaren and in addition, there is the advent of CBD oils and preparations contributing a “healing touch” to joint pain.

Whatever MSK condition you are suffering from, using your local pharmacist as part of your healthcare and pain management team is an oppor-

tunity you should not fail to take advantage of.

Your pharmacist can offer information on lifestyle modification and helping you to navigate to the different specialties that should be involved in your care.

Many pharmacists have the skills needed to significantly assist patients managing joint pain. By knowing and understanding the medications and topical preparations, pharmacists can actually help patients live with less or no pain. Essentially your pharmacist can guide you on a path to the right medications that will help patients live and carry on with their normal activities.

Pharmacists and their advanced knowledge of the medications they dispense can certainly clear up conflict and correct many misinterpretations by their patients. One very prevalent example of this is that most patients know that overusing NSAIDS can lead to a variety of complications, especially in the gastro intestinal tract. But patients do not realize that applying topical meds containing NSAIDS two to three times a day is perfectly fine.

A very critical part of the pharmacist’s role in pain management for MSK conditions is also keeping their patients informed about potential drug interactions between their other prescriptions and those they employ to treat their joint pain.

So if you suffer from joint pain, make the effort to have a talk with your pharmacist. You may just be taking steps toward resolving some of the pain that can limit you life.

MTA Seeks New Contractors to Advance Construction Timeline on Station-Access Projects

By Forum Staff The Metropolitan Transportation Authority is seeking qualified design-build teams to bring full vertical accessibility in accordance with the Americans with Disabilities Act to 23 stations across the five boroughs as called for in the agency’s 2020-2024 Capital Plan, MTA officials announced Thursday.

These expedited design-build contracts will be awarded to the companies whose proposals offer the best value to the MTA based on an evaluation of qualitative factors as well as cost and schedule, officials added.

Work at each station will generally include the design and construction of: • Two to three new elevators per station • Structural and excavation work to accommodate new elevator installations • Electrical power upgrades, when necessary • Station communications systems upgrades, when necessary • Relocation of existing public and transit utilities • Replacement, relocation and/or addition of staircases from street to mezzanines and mezzanines to platforms • Reconstruction of entire platform edges and/or reconstruction of ADA boarding areas The MTA noted that additional work may be necessary based on existing conditions at

“Accessibility is a top priority for the MTA, and we are committed to completing these accessibility projects as quickly as possible,” said MTA Chairman and CEO Pat Foye. “The Capital Plan’s historic $5.2 billion investment in accessibility brings us one step closer to creating the equitable transit system New Yorkers deserve.”

The record 2020-2024 Capital Plan pledges to invest $51.5 billion across the region’s subways, buses, commuter rail systems, and bridges and tunnels over the next five years.

The plan is the largest in MTA history and includes $40 billion devoted to NYC Transit’s subway system and bus network, with priority given to accelerating accessibility. NYC Transit’s Fast Forward plan to modernize the subway system established the goal of making at least 50 more subway stations accessible in five years so that customers would not have to travel farther than two stops to reach an accessible station. The 2020-2024 Capital Plan is a bit more ambitious—it calls for making 70 stations accessible in five years.

According to NYC Transit, the first 48 stations identified in September met the “never more than two-stations away” coverage goal, and went even further by including several important transfer points and complexes, and other community priority stations. The 20 additional stations identified in December further increase citywide geographic coverage.

“We are going to deliver these accessibility improvements better, faster and more efficiently, not only by requiring design-build, but also by bundling these projects across MTA agencies to take advantage of proximity,” MTA Chief Development Officer Janno Lieber said. “Innovation is the driving force of this approach.”

The de Blasio administration on Tuesday unveiled the New York City Internet Master Plan, an 88-page “vision” of universal broadband in the Big Apple.

By Michael V. Cusenza Mayor Bill de Blasio this week effusively extolled the potential impact (zaftig figures and all) that universal broadband could have on the Big Apple and its residents—and promptly provided a roadmap to that tech treasure.

Hizzoner and City Chief Technology Officer John Paul Farmer on Tuesday unveiled the New York City Internet Master Plan, an 88-page “vision” for affordable, high-speed, reliable broadband service across all five boroughs that offers “seamless connectivity” at home and mobile.

The administration’s plan is anchored in five principles: equity, performance, affordability, privacy and choice, de Blasio noted. Additionally, the City has pledged to work with service providers that meet the NYC’s principles and expand its role across all broadband components by coordinating among permitting entities, optimizing real estate like rooftops and lightpoles, and building fiber optic lines to connect assets. The City will initiate the plan by issuing a Universal Solicitation for Broadband to steer the relationship between the City and the private sector toward universal service with a focus on covering areas of the City that currently lack connectivity.

The IMP’s planned infrastructure is estimated to cost $2.1 billion.

As it rolled out the Internet Master Plan, the administration noted that current broadband subscription costs can be a burden on the budgets of low-income families. For example, 46 percent of city households living in poverty do not have broadband in the home. The Bronx has the highest percentage of residents without home broadband at almost 38 percent.

The digital divide in New York is considered a barrier to economic oppor-

tunity for residents and small businesses and a threat to long-term economic growth in Gotham, according to the administration. While many New Yorkers use a mobile connection and a home connection, New Yorkers increasingly need both connections to make full use of the internet. However, as the IMP points out, 40 percent of households do not have this level of connectivity today; 18 percent of residents—more than 1.5 million New Yorkers—have neither a mobile connection nor a home broadband connection.

This significant portion of the City faces barriers to education, employment, banking, healthcare, social networks, and government services that other residents do not.

“Over time, without broadband as a foundational resource, neighborhood economies risk losing ground in the face of regional, national, and international competition,” officials posited in the IMP. According to de Blasio, universal broadband “will transform the city with widespread economic benefits.”

Based on the administration’s analysis of the economic impact of universal broadband, getting all New Yorkers connected and establishing equitable infrastructure citywide may result in up to 165,000 new jobs, a $49 billion increase in personal income, and $142 billion in incremental Gross City Product in 2045.

While all New Yorkers will benefit from universal broadband, these impacts will be most dramatic for the people who are currently excluded from full participation in the digital economy.

“Now is the time for the private sector to get serious about working with the City to bring connectivity to all New Yorkers,” Farmer added. “No other city in the nation has introduced such a clear, strategic, and partner-focused roadmap to universal broadband.”
