School Improvement Plans cover all the bases

urriculum Director Michelle Crowell recently went before the School Committee to share the myriad of robust ideas that each K-8 principal plans to implement.

“They are based on real data, data that we’re collecting daily,” she said during the committee’s October 21 meeting.

In presenting the School Improvement Plan for the Adams School/Webster School Extension.

Crowell said the district’s youngest students will work on identifying letters and overall knowledge of the alphabet. They will also be focusing on counting to 10. In addition to reaching out to parents about the importance of attendance, communication between school and home will

entific strategies that promote thought-provoking questions.

The school will also be working with the city to further the Art and Green Infrastructure Project.

At the Keverian School, Crowell said, the CUBES Strategy will be used in math to assist students with solving word problems. There are also plans to augment the science curriculum through partnerships with Mass STEM Hub and Project Lead The Way. In terms of community involvement, the Keverian School will be working with the YMCA to host a pop-up market and food truck.

As with the Madeline English School, Restorative Justice will have a place at the Lafayette School. There will also be a student mentoring program, English Language family nights and parent breakfasts. In academics, the goals at the Lafayette School

are similar to the goals at the English School, those being fluency in the four major math operations, reading comprehension and thought-provoking scientific strategies.

Crowell said there will also be a push to increase reading comprehension at the Parlin School.

In math, she said, students will be taught to solve “multi-step real world problems.” In addition to the Guidance Department’s tiered intervention system, the school will adopt the PAWS program, which teaches the values of respect, responsibility, safe actions and hard work.

At the Webster School, Crowell said, in addition to reading comprehension, efforts will also be made to incorporate science into other subject areas. Regarding social/emotional learning, the Webster School has launched a Kindness Initiative and a Cultur-

al Pride Committee.

Crowell said the Whittier School will focus on building math vocabulary and creating vertical alignment science teams in grades 4-8. There will also be a push to increase growth mindset strategies.

Enrollment Update In other news, Assistant Superintendent of Schools Kevin Shaw said there are currently 7,411 students in the district.

He said this year’s enrollment figure represents an increase of 250 students compared to last year.

Shaw said there are now 950 students at the Keverian School despite having a capacity of 650.

He also said the school picked up 101 new students over the summer. In addition, he said the Lafayette School has 1,009 students this year, its largest enrollment figure in 10 years. There are 998 students at the Parlin School and 2,224 students at Everett High School. As a result of space constraints, Shaw said, it may not be possible for additional new students to attend their neighborhood school.

Shaw said the only decline has been on the preschool level, which has 130 fewer students this year. He said that is primarily the result of a new policy that requires those students to be toilet trained prior to starting school.

However, Shaw said he does not expect the preschool decline to last very long. “The enrollment increases all year long as students turn three years old,” he said.

Encore poker room springs a leak

oker players at Encore Boston Harbor were dealt an unexpected hand when water suddenly began leaking from the ceiling late last week.

The incident occurred on the afternoon of October 18, just as a poker tournament was getting underway. Encore spokeswoman Rosie Salisbury said a burst pipe caused water to pour into the second floor poker room from five different locations. However, the room was reopened two hours later. Patrons were immediately evacuated from the room, although the leak did not disrupt activities elsewhere in the $2.6 billion resort.

“There was no impact to any other part of the building,” said Salisbury. “We are thoroughly inspecting piping in the area to help prevent this in the future.”

Slow progress in Greater Boston on ADUs

F

or decades, housing experts and planners have been advocating for cities and towns to allow for the owners of single family houses to add Accessory Dwelling Units (ADUs) to their properties. Skim any municipal master plan or housing plan, and you will likely find the recommendation. I know, because I read all of the plans for Greater Boston in 2004, and I read them again in 2018.

Greater Boston needs much more housing. The most conservative policy for adding more housing to neighborhoods, without changing the neighborhoods, is to allow ADUs. An ADU is a secondary apartment that can be rented out, on the property of an owner-occupied single family house – that appears from the street as a single family house, not a two-family.

ADUs are virtually invisible and highly dispersed across neighborhoods. The owners of ADUs live on the property, so the risk of neglect that people might associate with rental properties is minimal.

The same goes for loud parties. (Which is not to say that it is fair to restrict other types of rental property.)

ADUs provide needed rental housing in residential neighborhoods, and the apartments tend to be relatively affordable for being modestly sized. The rents provide a stream of income for the homeowners.

No new public investments in infrastructure are needed to serve the new housing. And the typical size limits on ADUs make teardowns for redevelopment less likely.

During a housing crisis, after concerted advocacy over a span of decades: Only 37 out of 100 cities and towns in Greater Boston allow for ADUs to be put in and rented out. Another 31 municipalities also allow them, but only for occupancy by relatives of the homeowners, or caretakers, or the elderly; the units are supposed to be removed when the in-laws move out.

Many of the 37 municipalities highly restrict the houses eligible for ADUs. For example, Manchester allows ADUs, but only on exceptionally large lots, and only in houses

built before 1984. In Dedham, ADUs can be added to houses where the lot is 10 percent bigger than the minimum lot size, but most of the houses in Dedham are on lots smaller than the zoning requires.

Dedham has more than 6,000 single family houses, but the town receives only a few applications per year to add ADUs. In Medfield, ADUs are allowed in houses built before 1938 that have a minimum

floor area of 2,000 square feet. In Weston, ADUs can be put into houses that have at least 3,000 square feet. In Belmont, ADUs are only allowed

verett Police recently took Wilbert Charles, 34 of Everett, into custody in connection with the October 2 traffic collision that resulted in the death of 59-year-old Michael Delp of Revere.

According to the Middlesex County District Attorneyâ&#x20AC;&#x2122;s Office, Delp was riding his motorcycle along Broad-

way when he was struck

by Charles at approximately 5:52 a.m. near the Lexington Street intersection.

Upon arriving at the scene, police found Delp to be unresponsive. He was then taken to Massachusetts General Hospital, where he was pronounced dead.

The District Attorneyâ&#x20AC;&#x2122;s Office also indicated that based on the preliminary investi-

gation, Charles sped up and struck Delp from behind, causing him to fall off the motorcycle. He then allegedly struck Delp a second time before leaving the scene.

Charles has been charged with motor vehicle homicide, leaving the scene of an accident after causing death and operating to endanger.

He was arraigned on October 22 in Malden District Court.

Why have a zoning law?

Our zoning law exists for a very good reason: to protect us from aggressive owners who own nearby property. The law protects our homes, our neighborhoods, our “peace and quiet,” our property values … and our parking spaces.

Everett has a long established zoning bylaw. Lately, it’s considered inconsistent with the newly expressed “vision” for Everett. So, what’s been happening in our hometown?

Developers have been going to the Board of Appeals seeking permission to build bigger and more intrusive projects.

And they’ve had “cover” from the out-of-town urban planners. Zoning variances have been supported in the interest of “density.” That’s the new buzzword to describe big “out of place” buildings with little to no parking.

So, instead of our City Council doing the difficult, and controversial, job of rewriting the zoning law to make it more consistent with the Mayor’s vision for the city, the Board of Appeals has been given the very difficult and uncomfortable job of deciding what should, and shouldn’t be in our neighborhoods. That’s not their role. The zoning law is meant to do that.

This situation in Everett has made the appointed board members very powerful. With a single vote of the Board of Appeals, a variance gives a developer, or a business, the right to avoid the law. With a single vote of the ZBA, vast amounts of wealth can be created overnight for the aggressive developer. With a ZBA decision to allow a more intensive use, a property’s value can increase significantly.

Let’s consider a pending appeal before the board. It’s for 295 Chelsea Street, Everett.

An old two-family home sits on this property. It has been owned by an Everett family for generations. When the elderly occupant decided to sell the property, she retained an experienced and competent Realtor.

The Realtor did what Realtors do: he provided a professional estimate of value after researching our zoning law.

The law allows a buyer the right to build a new building with eight apartments after demolishing the house. His listing in the MLS property database said: “there is a possibility to put up to 8 units on the property.” Based on the property’s development potential, a sales price was set

at $729,000. Most developers would purchase land for about $100,000 for every apartment they can build on a piece of land.

But, what if the buyer of this property could somehow get permission to build thirty units on the same piece of land?

What’s the land value then?

Based on the $100,000 per unit “rule of thumb” that builders typically pay for land value, would the value approach $3 million? Maybe. For sure, $2 million. In any case, you get the point. Overnight, with a zoning variance from the ZBA, a property can double or triple in value.

Who gets the windfall profit created with such a variance?

It won’t be the Everett family who just sold it for a sales price limited by our zoning law. The profit will go to the well-connected buyer who was con-

Marcony Almeida-Barros backed by current and former city officials Dear Editor, We are elected officials and former candidates who have served or run for office in Ward Five. Although we may have shared our disagreements in the past, thereâ&#x20AC;&#x2122;s one thing we can all agree on this year: we urge you to vote for Marcony Almeida-Barros for School Committee, Ward 5, which is voted citywide, this November 5.

Marcony was unanimously appointed to serve in place of Robert Carreiro, who sadly passed away before his term began. Marcony works for the Attorney General, where heâ&#x20AC;&#x2122;s the Director of Community Engagement and was previously an adjunct professor at Northeastern.

Over the last 18 months, weâ&#x20AC;&#x2122;ve been impressed by the energy and effectiveness that

Marcony has brought to the job, becoming a strong advocate for our schools and students.

He helped secure a $5,000 donation from the Cambridge Health Alliance Foundation to buy Chrome Books at the Devens School so students could practice for the MCAS test, which is now administered online.

Marcony fought for and

won a $30,000 grant from the Mass Housing and Shelter Alliance to help Everett students whose families are in housing crisis, to cover emergency expenses for temporary food and lodging. This program has already helped improve graduation rates and lower absenteeism. Remarkably, he was able to renew the program for this school year, securing another $25,000 for our students, and it may become a model for similar programs

across the state.

He also helped sponsor the Crimson Community, a mentoring program led by two former EHS graduates who plan to match other Everett High graduates with students to help them navigate life after high school. A pilot program starts later this school year.

Finally, Marcony has been a constant presence at school events, taking the time to

Opinion from Ward 3 School Committee Member candidate Dear Editor, While observing the meeting of the Everett School Committee on the evening of Monday, October 7, I was startled by a comment from one of the longest serving members of the committee in local history.

Rising to speak on some aspect of the academic restructuring efforts now under way at Everett H igh School, Frank Parker de clared, “You have heard me for years, and you are going to hear me for years.”

This may have been an offhand comment or slip of the tongue. But even if it was, it clearly suggested that Mr. Parker has succumbed to an especially virulent form of smugness and entitlement.

been around so long, they can’t help but take the voters for granted. They ’ve gotten re-elected so many times, they believe they will never lose.

Yo u w o u l d t h i n k t h a t someone who has held political power for 35 years – as Mr. Parker has – would be careful to avoid saying stuff like “you are going to hear me for years” when his name will be appearing once again on the local ballot in a matter of days.

You’d think that person could at least act like he had a normal amount of respect for the electoral process, that he’d be asking humbly for the people to support him.

But that’s the thing about Longtime Incumbent’s Syndrome: Normal tends to go out the window.

Those who hold political

power for three -plus de cades tend to lose all normal perspectives on public life. Their egos have become unmanageable. They no longer understand that a public office is about serving the public, as opposed to serving themselves and their relatives who yearn for the comfort of the public payroll.

I’m running for the Everett School Committee against Frank Parker because I want to bring new ideas and new energy to the leadership of our public schools.

We’ve been hearing from the other guy for years – way too many years.

i! My name is Vivian Nguyen and I wanted to introduce myself as the candidate for Ward 5 City Council. Like many others in Everett, I’m a child of immigrants and refugees who came to America for a better life. For all the places they could have ended up, it was fitting that they moved to Everett. I have only lived in Everett, Massachusetts, but the unique culture I was raised with is deeply ingrained in my identity. As a child of immigrants/refugees who grew up low income, I was motivated to run because of personal experiences of not feeling represented in my personal life and in the political world.

And as an Asian-American who comes from a family that experienced political intimidation in their home country, it’s important for me to help give unheard voices a platform. I know what it’s like to not always be included in the narrative and my intentions involve running to advocate for the underrepresented and next generation of Everett.

Although this is just the beginning of my political career, I have always been politically active and an active member of my community. I have a strong background in journalism, and in the past have used my platform to advocate for myself and others.

From writing for my school newspaper to writing for a paper that was distributed at a state-wide level, I worked my way up from answering minor questions my classmates wondered about to covering major issues like my high school’s discriminating hair policy and being a catalyst for “controversial” conversations. By covering bill hearings, I was exposed to issues that did not affect me, which inspired me to be the voice of the underrepresented. Through reporting, I learned my voice is im-

roviding educational programs to our st1udents today is a complex issue. My name is David M. Ela, Jr. and am I announcing my candidacy for re-election to the Everett School Committee representing Ward IV. In my years as an elected member of the Everett School Committee, I have seen various changes, which have allowed our students more opportunities to succeed when they graduate from the Everett Public Schools. My goal is to continue working for Everett’s stu-

dents to assure adequate school funding, to continue to advocate for our students receiving Special Education Services, and to support legislative changes to improve educational programs.

My wife, Nancy, and I live at 19 Henry St. and we believe that providing children with a quality education is important. All three of our children attended and graduated from the Everett Public Schools. Additionally, they all graduated from college, two from Boston University and one from The College of the Holy Cross. I graduated from Boston University with a Bachelor of Science in Physical Therapy and from Framingham State University with a Masters Degree in Health Care Administration. I am employed by Winchester Hospital as the Supervisor of Inpatient Rehabilitation Services.

My wife, Nancy, is a Registered Nurse at Cambridge Health Alliance Everett Hospital. Two of our four grandchildren have already started their educational journey.

As a member of the School Committee, I serve on the following subcommittees: Finance, Contract Negotiations, Legal and Cafeteria.

This year I was elected by my colleagues to be Vice Chairman of the school committee. I am one of the two school committee representatives to the Everett School Finance Review Commission. Since 2007, I have been Everett’s appointed representative to Shore Educational Collaborative and have been Chairman of the Board of Directors for the past seven years. In 2004 and 2005, I served as Chairman of the Everett School Committee. Since 2002, I have served as Everett’s Delegate to Massachusetts Association of School Committees (MASC) and in 2007, I was honored to receive the All State School Committee Award.

Funding for Education in Massachusetts is at a crossroads. The Foundation Budget Formula is undergoing legislative change focused on amending the formula to improve funding for Economically Disadvantaged students, Special Education, and employee health insurance.

The State Senate recently passed the Student Opportunity Act and this bill addresses comprehensive changes in the Foundation Budget formula with proposed changes scheduled to start in Fiscal Year

2021. I would like to thank Senator DiDomenico for his perseverance and support of this bill. This bill requires further approval by the State House of Representatives and Governor Baker. I know that Representative McGonagle is supportive of changes to funding education and I will request his support of this bill.

Special Education services funding, both in and out of district, is based on the number of students enrolled in Kindergarten through Grade 12. Providing services to these students can have a detrimental effect to other programs throughout the district due to the amount of needed funding. We need to continue our Pre-School program for 3 and 4 year old children and focus on literacy, while also providing the therapeutic services these students may need. We also need to continue providing Social and Emotional Learning Programs to provide a safe environment for our students so they can learn and succeed.

As a member of the School Finance Commission, my colleague Frank Parker and I have been able to express our ideas about the school department budget with Mayor

DeMaria, members of his administrative team, members of the City Council and School Department Administrators. We understand that municipal revenue changes will affect future budgets and how resources are allocated. My knowledge and understanding of the Foundation Budget Formula will be an asset in developing these future budgets.

The Everett School Committee has a goal to have a new Superintendent of Schools hired by the end of this year. I am honored to be a member of the Superintendent Search Committee and I want to be able to work with our next Superintendent of Schools to explore innovative changes to enhance our current programs and develop new programs and opportunities for our students.

the Connolly Center, 90 Chelsea St. Candidates Marcony Almeida-Barros, Frank Parker, Dana Murray, Dan Skeritt, Samantha Lambert, David Lindsey, Edgar Ruiz and Robert Santacroce have already confirmed their

attendance.

Why is this event so important to attend? Schools are the lifeblood of our community and Everett families deserve accountable, transparent public schools.

Unfortunately, the only way Ev-

erett residents could hear from their School Committee in the past was to contact members personally. As any parent or guardian could attest, this is not always accessible to working families – and with no public comment at School Committee meetings, the silence from our community was deafening.

At the October 29 Candidate Forum – which will be broadcasted – candidates will answer questions about important factors affecting the Everett Public Schools (EPS), including the future of the superintendent search. EPS had the same superintendent for over 30 years – what a critical moment for us to remind the School Committee about the kind of school leader we deserve.

Everett already has amazing educators and families, but the only way our schools can truly fulfill their potential is if every Everett resident shares their perspective and keeps our School Committee accountable and transparent. Everett romps over Somerville for sixth win

he Everett Crimson Tide entered their off week feeling pretty good about themselves, having won six straight games and gearing up for the state playoff tournament. The Tide put an exclamation point on their final regular-season game before the playoffs with a decisive 50-7 rout of Somerville last Friday at Veterans Memorial Stadium.

After four highly-competitive contests to open the 2019 season, where they finished 3-1, the Crimson Tide (6-1 and having clinched the Greater Boston League title)) demonstrated their focus and discipline by taking care of business against less-formidable opponents the past few

weeks. Medford, Malden and Somerville own a combined record of 1-18 and the Tide did what was expected of them, outscoring these opponents by a collective 128-13 margin.

In the win over Somerville, quarterback Duke Doherty ran for one score and threw for two others. Backup QB Karmarri Ellerbe, a freshman, later scampered 21 yards for a score in the second half. The game was essentially in the books by halftime, with Everett comfortably ahead, 37-7.

The contest did look potentially competitive early. After Everett went in front on a 26yard TD run by Clarence Jules on its first offensive play of the game, Somerville stunned Everett when QB Louis Jacques Montina blew up the middle

and raced 70 yards for a touchdown to tie the game at 7-7.

That was the lone highlight for the visitors.

Jules' opening score came after Somerville, with the game still scoreless, curiously decided to go for it on fourth down and four inside their own 30 yard line. Everett stopped them and took full advantage of the generous field position. Later on, an 11-yard TD scramble down the sideline by Doherty gave Everett a 14-7 lead after one With help from lineman Junior Pamphile (69), Tide ballcarrier quarter.

A 25-yard scoring run by Clerveaux and Ellerbe's touchdown closed out the scoring over the final 24 minutes. The Tide defense basically stymied Somerville after surrendering the long first-quarter touchdown run.

Everett head coach Theluxon Pierre and his team now await the first playoff round to begin next weekend. The irony is that there must be â&#x20AC;&#x153;hardshipâ&#x20AC;? shown by the petitioner for the Board of Appeals to approve a variance re-

As it turns out, the petitioner may be one of the wealthiest people living, or working, in the city of Everett.

I have been using the word ridiculous to describe this project. Iâ&#x20AC;&#x2122;ll add another word: wrong.

Peter Francis Merenda

Raymond Bower, Jr.

A longtime resident of Malden passed away on Saturday, October 12th 2019. Born in Everett in 1940, Ray was the son of the late Raymond Sr (1911-1941) and Mildred M. (Clark) Bower (1913-2014). He was the husband of the late Patricia A. (Cunningham) Bower (19432007).

Ray grew up in Everett and graduated from Everett Vocational High School in 1960. After high school, he went to work as a truck body builder with James A. Kiley Company in Somerville, where he enjoyed 20 years working on utility trucks. He then took a position as groundskeeper at Holy Cross Cemetery in Malden, where he worked until his retirement in 2009. In his work at Holy Cross, Ray received a letter of commendation from his employer acknowledging the numerous compliments from visitors to the cemetery regarding the level of attention and professional care he provided. This was who Ray was; it was simply his nature to be thoughtful and compassionate to others.

A cabinet maker by trade, Ray was an extremely talented woodworker and built many beautiful pieces of furniture in his youth that are still in excellent condition and will lovingly remain with his family. Ray also loved everything about old cars and enjoyed going to car shows, tinkering with and changing their oil, and detailing them.

He spent many hours building and

Of Warwick, RI. He was a remarkable man who lived a truly extraordinary life, impacting people far and wide, across continents. Born in Everett, the firstborn son of Sicilian immigrant parents in 1922, he was raised by an extended family of his adoring Sicilian mother, grandmother and aunts. After completing a special college preparatory program, he received his B.S. and Master’s Degrees in physics and mathematics from Tufts University, then quickly moved into an advanced studies program at Harvard. Along the way, he married the love of his life, Rosie Cafasso, whom he had met in grade school when they were both eleven, and began to start his family. While at Tufts he also participated in the Navy ROTC program, eventually becoming an ensign and serving the US Navy during World War II. Both his brilliance and his lovable personality showed through every facet of his life. After the war, he moved with his family to Norfolk, VA, and then to Kenosha, WI, working as Director of Research at the Naval Examining Center and earning his Ph.D from University of Wisconsin Madison. In 1957, he began working for Walter V. Clark Associates in Rhode Island and moved there with his family.

Peter became professor of psychology at the University of Rhode Island where he co-founded the Departments of Psychology and Computer Science/Statistics. During his tenure in academia he was one of the original members of the American Psychological Association and was granted the prestigious Samu-

el J. Messick Award. Over the years he developed close relationships with scholars across the globe, regularly traveling between the US, Europe and Asia. He also remained a proud member of the US Navy, eventually making Captain (a fact of which he was especially proud). In addition to his exceptional career in academia, research, and military, he was a loyal friend and dedicated father, grandfather, and great-grandfather. He truly enjoyed hosting friends, colleagues, and family at his home, cooking impressive meals, attending wine club meetings, reading WWII history, and taking trips up to Gloucester.

Of all his amazing accomplishments, perhaps the most outstanding is the beautiful family he created with his beloved wife Rose, their three devoted and adoring daughters Anne Giardina, Rosemary Merenda and Pamela Ardizzone, his loving grandchildren Peter Giardina (deceased), Lauren Ardizzone, Kathryn Ardizzone and Pamela Ardizzone, his great-granddaughters Rosie and Alicia Mugica, his two grand sons-in-law Andrew Mugica and Harrison Bookstein, and his loyal Pekingese, Coco. He will always and forever be deeply loved and missed by many.

Richard A. Racki

Passed away at the Massachusetts General Hospital in Boston surrounded by his loving family on October 13. He was 77 years of age.

Born and raised in Chelsea, he attended St. Stanislaus Elementary School & was a proud alumnus of Chelsea High School, Class of 1960. The majority of Richard’s working career was spent as a veteran taxi-cab driver using his uncanny mass of knowledge of the geographics of Everett, Malden, Revere, Chelsea, East Boston and the surrounding communities. He spent over 40 years in the taxi industry, with Independent Cab and Yellow Cab in Chelsea. A Chelsea native, Richard has been a resident of Everett for the past 35 years. One of his passions was

for the game of bowling. He held a fifty-year membership with the Sportsmen’s Bowling League on the Lynnway in Lynn and also a membership with the Pro Bowling League of the North Shore. Richie also held affiliations with the Merritt Club of Chelsea & the former Chelsea Lodge of the Moose #736.

In true spirit to his large personality, he offered on many occasions to orchestrate events as a D.J. for family and friends. For many years, he worked with the organization “Parents Without Partners” as a D. J. He will be remembered by his family and friends for his warm & peaceful heart & his ability to rule as a peacemaker.

He is the beloved husband of Laura M. Bessler of Everett. Devoted father of Roberta L. Racki of Chelsea, Brian R. Racki and wife Athanasia of Lynn, Nicole A. Bessler of Freetown and Matthew J. Bessler and wife Michelle of Everett. Cherished grandfather of Ottavia J. Racki of Chelsea, Stephanie A. Racki of Allston, Myranda & Taylor Newton, both of Dracut, Cameron Newton of Woburn, Sydnee, Erin, Macayla & Alyssa Bessler, all of Everett. Adored great-grandfather of Giovanni, Izaiah, Dante, Ayla and Wyatt. As a devout Catholic, she was a communicant of Blessed Sacrament Church in Saugus and previously at St. Theresa’s Parish in Everett.

Where allowed (as rentals or as in-law apartments), ADUs get permitted at very low rates, just 2.5 permits granted per year per municipality, due largely to the restrictive zoning.

If the region were to average five permits per municipality per year across 100 municipalities over a 10-year period, ADUs could provide five thousand apartments, dispersed among 538,000 single family houses. Less than one in a hundred houses would have an ADU, yet the new rentals would house thousands of people. Of course, this would not solve the housing crisis; it is merely the most conservative and incremental reform.

Every municipality should allow for ADUs to be added to owner-occupied single family houses and to be rented out.

The zoning should not restrict ADUs only to old, large houses on large lots or to antique accessory buildings.

Last May, I graduated from the Gender, Leadership, and Public Policy graduate program at the John W. McCormack Graduate School of Policy and Global Studies at UMass Boston where my research work was focused on policy solutions for housing affordability. This program also included an internship at the Joint Committee on the Judiciary at the State House where I was able to aid the work being done on Beacon Hill and learn about different resources that can be brought to the city. I plan to continue my education by pursuing a law degree.

Municipalities are very gradually moving to liberalize zoning for ADUs. Revising zoning regulations is a long, labor-intensive process that involves holding hearings, drafting language and securing two-thirds approval of the town meeting or city council. And it is not as if ADUs are the only item on a planning board’s agenda.

Under a proposal before the state legislature, town meetings and city councils could revise their zoning rules to allow ADUs – by majority vote, instead of the current twothirds threshold. Such a reform would help a lot. Another option could be for the state directly to allow homeowners to add ADUs, and let local leaders direct their attention to more controversial housing decisions that demand long-term planning.

Provisions include $30 million for the Low Income Heating Energy Assistance Program to help low-income elders, working families and other households pay winter heating bills; $10 million for emergency shelter assistance; $8 million for the collection and testing of sexual assault evidence kits; and

creation of the Massachusetts Veterans and Warriors to Agriculture Program to help the education, training and employment of veterans currently working or who hope to work in the field of agriculture.

The bill did not include Gov. Charlie Baker’s proposal to save taxpayers $175 million over two years by doubling the tax exemption for taxpayers with children and other dependent relatives who are elderly or have a disability. Instead, the bill deposits $428 million into the Rainy Day Account, an increase of $360 million from the governor ’s proposed $168 million deposit. The current Rainy Day Fund is estimated to be at $3.3 billion.

Supporters said the package is a reasonable and fiscally responsible one that will begin to close out the books on the fiscal 2020 state budget.

No one spoke against the budget during debate on the House floor but Rep. Russell Holmes (D-Boston) was the only person to vote against the budget. Holmes did not respond to repeated requests from Beacon Hill Roll Call to comment on why he opposed the bill.

Joseph McGonagle Yes $500 MILLION TO COMBAT FENTANYL TRAFFICKING (H 4127) House 38-115, rejected an amendment that would establish a $5 million grant program to help support regional fentanyl interdiction programs focused on combating fentanyl trafficking. “ There have been thousands of opioid-related overdose deaths recorded in Massachusetts over the last several years, and fentanyl is playing an increasingly larger role in contributing to these fatalities,” said the amendment’s sponsor House GOP Minority Leader Brad Jones (R-North Reading.) “Fentanyl has been present in 92 percent of all opioid-related deaths this year, compared to 30 percent just five years ago …

We need to do everything we can to help law enforcement stop those individuals who are putting this poison on our streets.”

Opponents of rule suspension said it is irresponsible for the House to debate and vote late at night when taxpayers are asleep.

Rep. Joseph McGonagle Yes PROTECT DISABLED PERSONS – NICKY’S BILL (S 2367) Senate 40-0, approved a measure that would establish a registry that identifies individuals who have been found to have committed abuse against persons with disabilities. The measure was filed by Sen. Mike Moore (D-Millbury) at the request of a constituent who is the mother of Nicky, an intellectually disabled and non-verbal individual.

Nicky had been inappropriately restrained and struck multiple times by her caretaker. Under current law, unless the offender is criminally convicted, no system exists to identify caretakers and prevent them from finding employment with another provider licensed by the state.

“Enacting this registry will help disrupt a cycle of abuse of individuals with disabilities and put in place common-sense protections that families in the commonwealth deserve,” said Sen. Moore. “There are clear benefits to screening prospective employees who intend to work within the licensed caretaker field and I am hopeful that the bill will advance to the governor’s desk to help protect our most vulnerable residents like Nicky.”

Sen. Sal DiDomenico Yes CHILDREN’S HEALTH (S 2368) Senate 38-0, approved legislation designed to make it easier for children and their families to navigate the state’s complicated and often difficult to understand health care system. A key

provision requires health insurance companies to perform monthly updates of their provider databases that tell patients which doctors and other medical resources are available to them. Patients complain that many physicians are listed as local and taking new patients despite having retired, moved or stopped accepting new patients.

The measure also allows foster children to remain covered by MassHealth until they turn 26, the same option that children covered by their parents’ private insurance currently have; allows children who have aged out of the foster care system to automatically be enrolled in MassHealth; examines the barriers to mental and behavioral health supports for children; establishes a commission to study mandated reporting laws and provides for increased education around child sex abuse and exploitation.

“The wellbeing of children has been a longtime priority of mine, and I am thrilled that our chamber has passed this comprehensive piece of legislation,” said Assistant Majority Leader Sen. Sal DiDomenico (D-Everett). “By ensuring continuous healthcare coverage until age 26 for these young people, we guarantee they have the same access to basic healthcare that their peers are afforded. We are giving more at-risk youth across the commonwealth a better chance to lead a healthy and successful life. I am confident that legislation will go a long way towards helping thousands of children access the healthcare coverage they deserve.”

The House has already approved a different version of the bill. A House-Senate conference committee will likely be appointed to hammer out a compromise version.

Co-personal representatives

O

ften times when executing a Last Will and Testament, individuals wish to name two children as Co-Personal Representatives of the Estate. Often times, the testator does not want to hurt the

feelings of one child by only naming the other sibling as the Personal Representative. There are other times when the testator does not have children and wishes to name two individuals to serve as Co-Representatives of the estate.

It is often more desirable to have one person serve at a time with at least two backups. This way, there will be no stalemates if the two personal representatives disagree on matters relating to the estate. It is also more efficient for law firms to deal with just one person when it

comes to execution of documents; discussions relating to the estate, correspondence in general, court appearances, etc.

Furthermore, most banks and other financial institutions will require both Personal Representatives to be present when opening and closing bank accounts. Both signatures will be required. This can turn out to be overly burdensome when you have one Personal Representative that is in his or her later years, suffering from health issues, or is out of state.

If you truly trust one individual, then selecting that one individual to serve as Personal Representative should be fine. All beneficiaries of the estate are entitled to see the inventory and accounts if they ask for them. All of the beneficiaries are free to ask the Personal Representative of the estate questions relating to the estate. It is in the best interest of the Personal Representative to be transparent in order to keep the beneficiaries fully informed. To not do so is only an invitation for future conflict.

Certainly, you want to choose someone who is trustworthy and capable in these types of matters.

Living reasonably close to the probate court where the Last Will and Testament will be submitted is also a plus.
