He said that movement was similar to the crusade that King launched during the 1960s. “He wasn’t looking for the spotlight,� said Watson. “Dr. King was very much a latter day visionary; he was heeding a call that was beyond him.�

Therefore, Watson encouraged those in attendance to be optimistic about the future. “We are constantly peering into the edge of tomorrow,� he said.

Despite growing up in Cambridge, State Senator Sal DiDomenico said he chose to raise his family in Everett as it is a community that values inclusion and diversity. “We have risen to new heights; our diversity makes us stronger,� he said.

DiDomenico also spoke about how King convinced then-President Lyndon Johnson to sign the Voting Rights Act of 1965. “One man did this; Dr. King was an American hero,� he said. “He was a powerful man because he

n January 14, State Representative Joseph McGonagle testified before the Legislature’s Joint Committee on Housing about his bill H.1306, An Act to further protect low-income tenants following termination of affordability restrictions. H.1306 per-

tains to Section 7 of Chapter 40T of the Massachusetts General Laws. Chapter 40T was designed to help both tenants and landlords by using publicly assisted buildings as affordable housing. In return for the landlord receiving the public funds, they must offer housing according to the affordability restrictions. However, after a certain period of time, these restrictions are terminated.

The current law of Section 7 under Chapter 40T provides a three-year leeway period where the rent can only be increased once annually. McGonagle’s bill differs slightly by changing the three-year leeway period to five years. This would give tenants more time to either adjust to the new cost of living, or in the worst case, to find other housing.

“Amidst our housing crisis,” said McGonagle, “it is crucial that we remember how difficult it is for low-income families to find and retain affordable housing, and thus we must grant them extra time to either adjust to the raise in rent or find other affordable housing.”

recent review of the city’s municipal buildings revealed the need for a significant renovation project at the Connolly Center on Chelsea Street.

Anthony Sousa, director of Planning and Development, said the $1.5 million project will be funded by the Capital Improvement Fund and is slated to begin later this year. The project’s primary focus will be on the building’s basement.

“The basement has been underutilized for decades,” he said. “If you go downstairs, it’s dark.”

Specifically, Sousa said there are plans to install an elevator, additional fitness space, a four-lane bowling alley and a 50-seat theatre. “It opens up the possibilities for more programming for Everett’s seniors,” he said.

Resident thanks DPW for snow removal efforts Dear Editor: I would like to commend the Department of Public Works on a job well done during Saturday’s snowstorm.

I drove from Woburn to Everett via 93 south. When I got on to 93 south it was a snow covered ice skating rink. It did not look like a plow or sander had touched the road in hours.

I was very concerned how I

was going to get through Everett if the highway was that bad. Well imagine my surprise when I got to Hancock Street on the Everett/Malden line and saw pavement!

Everett had the best plowed streets I drove on that night!

The streets were plowed better than the highway. I was also impressed when I woke up Sunday morning to Brad-

ford Street being plowed to pavement as well as Moreland Place (and I didn’t have to use 311 to get Moreland Place plowed!) Thank you so much for a great job with the plowing and keeping the people of Everett safe!

Everett prepares for decennial census

Brown also presented this year’s MLK Scholarship to Darryl Grant II, a theatre arts student at the University of Massachusetts Boston. Grant is a 2018 graduate of New Mission High School in Hyde Park and graduated with a 4.13 grade point average. During his senior year, Grant and nine classmates created their own business, Youth Vanguard. The company focused on preserving Art of Ball, a program that “enables middle school students to play basketball on teams and express themselves artistically.”

Mayor Carlo DeMaria spoke about how Everett has epitomized King’s ideals. “We walked last summer to raise funds to combat domestic violence following the death of Ersilia Matarazzo,” he said. “We, as a community, raised over $50,000 to help a paralyzed young man get vital services he needs to live a full life. Everett girls roll to ninth win against Salem

t didn’t take long for the Everett High School girls’ basketball team to get back on the winning track after suffering its first setback of the season last week.

The Crimson Tide girls had little trouble against the winless Salem Lady Witches in a Martin Luther King Day tilt Monday at Salem High School.

Good Samaritans on the scene attempted to intervene before the shooting and also to render first aid. The victim was subsequently transported to Massachusetts General Hospital, where he was pronounced dead.

Demos allegedly fled the scene in a vehicle later identified by police as a Volkswagen Passat registered to a person in New Hampshire known to Demos. Police subsequently identified Charles Demos as the alleged shooter and obtained a warrant for his arrest. Demos was located the following day at a Seabrook, New Hampshire, home and arrested on a fugitive from justice charge by the Massachusetts State Police Violent

Fugitive Apprehension Section with the assistance of the United States Marshal’s Service and Seabrook Police. At that time police also arrested the resident of the home, Joshua Demos, 35, on a federal probation violation unrelated to this case.

As part of the ongoing investigation into this incident, investigators learned that David Landry, 32, of Everett, and Joshua Demos, 35, were the other individuals allegedly present with Charles Demos during the fatal altercation. Investigators also learned that Landry allegedly handed the gun from inside the trunk to Charles Demos prior to the shooting.

David Landry was indicted by a Middlesex Grand Jury on December 20, 2019, on the charge of murder in addition to possession of a firearm as an armed career criminal, and assault with a dangerous weapon; he will be arraigned in Middlesex Superior Court on January 24, 2020. He

Tide boys on four-game winning streak

he Everett High School boys’ basketball team appears to be progressing steadily in the right direction. The Crimson Tide notched two more wins to improve to 8-2 on the season.

A 53-34 drubbing of Somerville last Tuesday, Jan. 14, and a hard-fought 56-48 victory over Snowden in a Martin Luther King Day contest Monday gave Everett four consecutive wins, and head coach Stanley Chamblain, for the most part, is liking what he sees.“Both games were the result of great team effort,” he said. “Even scoring across the board, and defensively we really got after it, and we were able to hold both teams under 50 points.”

However, the performance on offense, despite the balanced scoring, shows room for improvement. “We have to do a

much better job of attacking the zone looks [opposing] teams are throwing at us,” Chamblain explained. “We’ve had a tendency in the past couple of games of relying on the three-point shot, which is what teams want us to do.”

Even with the concerns, the coach thinks his squad will figure it out offensively by becoming more aggressive and not just settling for the outside shot.

“We need to attack those [zone] looks to create better scoring opportunities around the basket. Over time, I’m confident we’ll adapt and become more fluid within those sets.”

The Tide boys took on Chelsea at home Wednesday night and have an away contest against Brookline on the UMass-Boston campus. Entering Wednesday’s tilt, Everett needed just two more wins to secure a playoff berth.

Does Medicare Cover Counseling Services?

Dear Savvy Senior, Does Medicare cover outpatient counseling services for its beneficiaries? Since the death of my sister last year, I’ve struggled with depression and anxiety and would like to get some help.

Sad Senior Dear Sad, I’m sorry for your loss. Yes, Medicare covers both outpatient and inpatient mental health services to help beneficiaries with depression, anxiety and many other needs.

Here’s what you should know.

Outpatient Coverage If you have original Medicare, your Part B coverage will pay 80 percent (after you’ve met your $198 Part B deductible) for a variety of counseling and mental health care services that are provided outside a hospital, like individual or group therapy, family counseling and more. They also cover services for treatment of beneficiaries who struggle with alcohol and drug abuse.

You, or your supplemental insurance is responsible for the remaining 20 percent coinsurance.

Medicare also gives you the option of getting treatment through a variety of mental health professionals such as psychiatrists, psychologists, clinical social workers and clinical nurse specialists.

To get this coverage, you’ll need to choose a “participating provider” that accepts Medicare assignment, which means they accept Medicare’s approved amount as full payment for a service.

If you choose a “nonparticipating provider” who accepts Medicare but does not agree to Medicare’s payment rate, you may have to pay more. And if you choose an “opt-out provider” that does not accept Medicare payments at all, you will be responsible for the entire cost.

To locate a mental health care professional in your area that accepts Medicare assignment, use Medicare’s online Physician Compare tool. Go to Medicare.gov/PhysicianCompare and type in your ZIP code, or city and state, then type in the type of profession you want to locate, like “psychiatry” or “clinical psychologist” in the search box. You can also get this information by calling Medicare at 800-633-4227.

Inpatient Coverage If you need mental health services in either a general or psychiatric hospital, original Medicare Part A covers this too (after you’ve met your $1,408 Part A deductible). Your doctor should determine which hospital setting you need. If you receive care in a psychiatric hospital, Medicare covers up to 190 days of inpatient care for your lifetime. And if you use your lifetime days but need additional care, Medicare may cover additional inpatient care at a general hospital.

Additional Coverage In addition to the outpatient and inpatient mental health services, Medicare also covers yearly depression screenings that must be done in a primary care doctor’s office or clinic. Annual depression screenings are covered 100 percent.

If you have a Medicare prescription drug plan, most medications used to treat mental health conditions are covered too.

Medicare Advantage If you happen to get your Medicare benefits through a private Medicare Advantage plan, they must provide the same coverage as original Medicare does, but they may impose different rules and will likely require you to see an in-network provider. You’ll need to contact your plan directly for details.

OBITUARIES Richard A. “Rick” Mini

A resident of Revere passed away on Saturday, January 18, at the High Point Hospice House in Haverhill.

Richard was born in Everett in 1953, the son of Joseph and Marjorie Mini.

He was raised in Malden, and graduated from Malden High School with the Class of 1970. He went on to work for the Malden Public School System, starting as a custodian and working his way up until he ran the Maintenance Department for the school. After 40 years, he retired from the city.

In 1992, he married his sweetheart, Vilda “Ann” Smith, and the two first settled down in Malden, before moving to the Jack Satre House in Revere 6 years ago. The two shared nearly 30

years of marriage together.

Rick was an avid golfer, and was a long time member of the Nahant Country Club. He was also active in the building where they lived, serving on the Board of Directors, and getting together to play cards with his friends that lived there.

He is survived by his wife, Vilda “Ann” Mini, his children, Denise M. Grieco and husband Augusto of Medford, and Daniel Scott DiGiacomo, and wife Amy of Thorton, NH., his sisters, Susan Mastrollie of Melrose and Nancy Hannon of Malden, and his grandchildren, Cameron, Anthony, Kyle, Bella and Caiden.

Eugene worked as a geologist for the Atlantic Richfield Company for many years. He enjoyed travelling throughout the U.S. for his job and was a passionate outdoorsman. In Everett, Eugene loved to visit local eateries, catch up on news at the Parlin Library, and show kindness to friends old and new.

RECENT MASSHEALTH MEDICAID ANNUITY CASE A

January 16, 2020 Middlesex Superior Court decision was decided against MassHealth with respect to a Medicaid annuity policy owned by the community spouse that named the Commonwealth of Massachusetts the primary beneficiary“to the extent of benefits paid”.

The plaintiff ’s father had purchased a Medicaid annuity providing him with a monthly benefit for a period of time that was deemed actuarially sound. The plaintiff ’s mother was approved for MassHealth long-term nursing home care benefits on July 23, 2015. She is still residing in the nursing home. The plaintiff ’s father

died in December of 2016 with payments still remaining on the annuity policy.

Nationwide Insurance paid the balance of the annuity policy to the Commonwealth of Massachusetts.

The plaintiff brought an action as the contingent beneficiary under the policy in the Superior Court.

She argued that since no Medicaid benefits were paid on behalf of her father, she should be the rightful beneficiary of the policy. MassHealth initially approved the application with the limiting language “to the extent of benefits paid”.

However, the Court stated that one

could not reason that this language should be construed as “to the extent of benefits paid for the institutionalized spouse” (i.e. his wife who was in the nursing home).

Since the language in the annuity policy did not state that the primary beneficiary was the Commonwealth of Massachusetts to the extent of benefits paid on behalf of the institutionalized spouse, the Court shot down MassHealth’s motion for summary judgment and ordered MassHealth to return the remaining annuity proceeds to the plaintiff. The father, who was the annuitant of the policy and who died, never received MassHealth

benefits.

Going forward, MassHealth has 60 days to appeal this case. The Superior Court judge wrote an excellent opinion and, in my view, the odds of a successful appeal are not great. That being said, at a minimum, it would seem as though we should be able to rely on this case when advising on the purchase of an annuity in being able to name the Commonwealth of Massachusetts the primary beneficiary only to the extent of Medicaid benefits paid on behalf of the community spouse. It seems to me that it is still too early to know whether or not we will be able to name the chil-

dren as primary beneficiaries from the start and not name the Commonwealth of Massachusetts as a beneficiary at all, as long as it is the community spouse that is purchasing the Medicaid annuity policy.
