Cash Cow under fire for loan application fee Feferman’s office has never sued us before.”

I

t seemed like business as usual at Cash Cow July 14.

The phones were ringing.

Customers and employees were interacting. Deals were being made. But Quick Cash, Inc., doing business as Cash Cow Loan Company, is being sued for reported unfair business practices for loans it made over the past four years, which could potentially include thousands of customers.

In a move to protect his assets, Cash Cow principal owner Tim Delgado filed for Chapter 11Bankruptcy protection July 6.

MEET THE CLASS ACTION ATTORNEY A law firm in Albuquerque, that specializes in suing companies for consumer fraud is targeting Cash Cow. Feferman and Warren handles a wide va r iety of indiv idua l a nd class action consumer cases throughout New Mexico as well as in A rizona. Their cases mainly consist of unfair practices in cash, vehicle and mobile home loans.

Richard Fefer man won the 2014 Countryman award for legal services or special contributions to the practice of consumer law that have strengthened and affirmed the rights of low-income people in the United States.

“We’re just trying to get money for our clients.” he said.

He hopes businesses in this area reform their practices.

MILKING THE ‘CASH COW’ OR CUSTOMERS? In the 16-page, class-action, lawsuit against Cash Cow, Feferman cites a number of alleged wrong-doings that he said violates both the Truth in Lending Act and the New Mexico Unfair Practices Act, including misstating the nature of the loan, the interest rate of the loan, the schedule

of payments, and the security interest.

Caroline Tullie of Ganado, Ariz., is the plaintiff in the complaint filed in U.S. District Court May 23, 2014, which states: “Cash Cow told Ms. Tullie she must refinance all three of Mr. Tullie’s outstanding loans into her own name, or Cash Cow would repossess her 2001 Dodge Ram.” T u l l ie’s hu s ba nd, Nel son Tullie, was the original loan holder, but he passed away in August 2013.

Delgado did not comment about the lawsuit saying it would violate Caroline Tullie’s right to privacy.

The class-action portion of the lawsuit is built around a $25 fee that Cash Cow previously charged for all loan applications. Adding the $25 to a contract of less than $2,500 will increase the Annual Percentage Rate by at least 1 percent.

It is anticipated that over 1,000 Cash Cow customers will be impacted by this lawsuit if it is successful. Any customer borrowing money or refinancing a loan within four years of the filing of the lawsuit would be included in the case.

The $25 fee is labeled an application fee. However, Cash Cow only charged the fee for approved loans. Therefore, it

is a cost of the loan, and falls under the Truth In Lending Act explained Nicholas Mattison, an attorney for Feferman and Warren. The purpose of the TILA law is to provide a uniform set of disclosures so shoppers can compare the cost of one loan to another.

After the lawsuit was filed, Delgado filed for protection under Chapter 11 of the U.S. Bankruptcy Code. Under Chapter 11, Delgado will be able to create a plan to pay all creditors over time. The bankruptcy lists debts in excess of $7 million including back taxes and personal loans.

The lawsuit also alleges that Cash Cow knew of the problems with their loan structure because of a previous lawsuit, Laughing v. Quick Cash (Cash Cow), filed against them. When asked if Cash Cow had changed their practices since that lawsuit, Delgado responded, “Mr.

Feferman’s partner, Elizabeth Warren, also worked for DNA in Shiprock before joining the Albuquerque practice.

T he L aug h i ng lawsu it alleges Cash Cow, also known as, Quick Cash, sold Lula Laughing, a resident of Navajo, NM, a mattress on credit at a rate of 66.54 percent interest.

The lawsuit states the loan was to be paid off in eight installments of $110 each.

The difference between the payment amounts and the original loan value is $184.44 which calculates to 27 percent interest. Delgado said an interest rate of 68 percent is not a part of his business practice but would not

comment specifically on the Laughing case.

As security for the loan, Cash Cow reportedly took interest in Laughing’s 2000 Chevy Cavalier. It is alleged that the vehicle was repossessed when Laughing became delinquent on her payments. Reportedly, when she paid off her loan, the vehicle was never returned to her. This case was dismissed.

Both parties referred to a confidentiality agreement, declining to reveal the reason for dismissal of the case.

Cash Cow’s attorney, Harry Kassakhian said “Quick Cash (Cash Cow) does not want to make any statement that would violate Ms. Laughing’s right to privacy. Quick Cash values the dignity and privacy of all of its present and former customers.”

REBUTTAL A s to the Tullie ca se, Kassakhian said Cash Cow relied on a software program that did not accurately calculate the interest rate of the loans.

“Since Ms. Tullie filed the lawsuit, Quick Cash stopped charging the $25 loan fee,” he said.

“Anybody can file a lawsuit whether it has merit or not,” Kassakhian said.

No court decision has been made regarding the Tullie class action case.

He cited a report by NBC, in which he was profiled, “Endless Debt: Native Americans Plagued by High-Interest Loans” as his reason for not trusting interviews.

He believes NBC did not por tray Ca sh Cow honestly i n their report.

In his written response, Delgado said, “We will survive! Gallup is our home and we love this community. We opened Cash Cow with the intention to build a better life for us and those around us. A hundred percent of our customers are from Gallup and the surrounding area. We believe that they will support us through this lawsuit. We look forward to bigger and better things in the future.”

A

t the regular meeting of the Gallup City Council held July 14, the council voted to renew their contract with the Gallup-McKinley County Chamber of Commerce for promotional services. City Manager Maryann Ustick recommended approval of the contract that will give the chamber $145,000 to be used toward promoting Gallup and for administrative costs associated with those costs.

This money is tapped from the lodger’s tax fund.

Ustick said the only change is the administrative portion of the contract is less this year, giving Gallup the benefit of more dollars for advertising.

Chamber CEO/President David Hinkle said he wants to study the ways they are investing the advertising dollars to be sure the money is being used wisely.

He also plans to leverage these funds with the State of New Mexico tourism

department to capitalize on the state’s programs. The money contracted to the Chamber in 2014 was largely used in connection with the New Mexico True campaign, promoting Gallup as an adventure, cultural and recreation destination.

Mayor Jackie McKinney said in the two years since Kevin Menapace, Dr. Lawrence A ndrade and other GABC

board members took over the organization, they have managed to bring a world series to Gallup and they have been financially sound.

Holland said there are plans to bring applicants in and educate them regarding the lodger’s tax application process. At this time there is no program to teach the public how the tax can be used.

Landavazo asked Holland if she could work with GABC to educate them regarding state requirements so they could use the money legally and efficiently. Holland agreed to meet with members of the board.

The council also voted to allocate $10,000 to GABC for the Pee Wee Reece/Willie Mays Baseball Series. Councilor Fran Palochak voted no.

“It is in no way that I don’t support the event,” she said.

Palochak explained that she is concerned that at this late date the GABC will not be able to spend the allocation for lawful expenses since the tournaments are already underway. Councilors Linda Garcia and Landavazo voted

After failing several field sobriety tests, she was taken to the New Mexico State Police Office and given a breathalyzer. The results on her breathalyzer tests were .15, .15. She was taken to the jail and charged with Aggravated DWI and careless driving.

Larry Francisco, 63, Tohatchi, NM 7th DWI Francisco was arrested for DWI July 6 by GPD Officer Steven Peshlakai after an automobile accident, involving F ra ncisco, had occurred on Munoz Overpass.

After failing several field sobriety tests, Francisco was placed under arrest and taken to the hospital for a blood draw. He was subsequently booked into the county jail for his seventh or subsequent offense of DWI, following too closely, no insurance, driver’s license suspended or revoked (due to a previous DWI), and failure to register vehicle.

Upon attempting to stop the vehicle, the driver “oversteered causing the passenger side tires of the vehicle to drive off the roadway onto the sidewalk.” Martin did find a temporary registration on the front windshield of the vehicle,

According to her report, Romancito spoke to several witnesses which all said that Chee came around the corner at Arnold and 66 and struck a vehicle that was stopped for the red light, pushing the vehicle back “about 20 feet” and continued to drive south,

pulling into the parking lot of El Sombrero and switching over to the passenger seat.

Chee refused to take any field sobriety tests and was placed under arrest. He was taken for a breath test, which the first result was .32, but he refused a second sample and was taken to the hospital for a blood draw.

Pete’s vehicle was found in the Mesa View Plaza area unoccupied, he later ret u r ned to the area while h i s veh icle wa s being towed, he was muddy and missing the shirt that witnesses described.

Severa l witnesses identified Pete as the man behind the wheel when the crash occurred. Pete was arrested and charged with aggravated DWI, duty to give information and render aid, open container in a motor vehicle, mandatory financial responsibility, driver’s license required and concealing identity.

DOWNTOWN AREA Ga llup Police a re cu rrently looking for an unknown male who attempted to rob Subway at 409 West Aztec Ave. According to the poster, on July 13 a male entered the establishment and told the cashier that he was robbing her. Due to the male appearing intoxicated, she didn’t take him seriously and closed the drawer. The male left the business in a Navy Blue Jeep Patriot, and he is being described as being possibly in his late 20s, tall and heavy build. Anyone with information is asked to contact GPD Detectives at (505) 863-9365.

E d l e n Begay, 29, of Mentmore, was arrested Ju ly 13 for shopli f ti ng almost $950 worth of merchandise from Walmart. Although two females were a l so w it nes sed, by Walmart loss prevention, placing items into a blue storage tub in a cart, they left prior to Begay leaving the store without paying for the items. Begay also said, according to GPD Officer Victor Rodriguez’s report, that the females “had nothing to do with it.” Shoplifting in that amount is a fourth degree felony.

Thomas was arrested after he was seen by a s h o p owner at the Rio West Mall July 8, stuffing a t-shirt into “the front waist area of his shorts,” according to GPD Officer Ryan Blackgoat’s report. The shop owner also told Blackgoat that Thomas had pulled a black in color folding knife on him. Blackgoat did locate the knife and charged Thomas with aggravated assault, a fourth degree felony, as well as the shoplifting, a petty misdemeanor.

On July 13, a Gamerco homeowner called MCSO in regards to three of his home windows being broken. The homeowner told Deputy Josie Bowman that his 12-year-old son was home alone when he heard the the window crack and then two subsequent windows were hit. Two males were seen outside of the fence area. Anyone with information is asked to call MCSO at (505) 863-1410.

That same day, or possibly the night before, another home in Gamerco was violated. The homeowner came home and went to sleep after being called out on an emergency clean up call and later found that approximately $700 worth of clothing and $ 40 wor t h of meat were taken from his home. “Friday, about 11:16pm, officers were dispatched to First and Lincoln in reference to shots being fired,” White said.

North First and East Lincoln is located a mere two blocks from Maloney Avenue and just a short walk from two highly utilized neighborhood parks as well as a school and a church.

While the incident is still very much under investigation, witnesses were able to identify a vehicle that was in the area at the time the shots were heard.

“A white Blazer was seen leaving the scene,” White said.

Officers quickly located that vehicle, shortly after, at Third and Maxwell. They identified all the occupants whose identities have not yet been released, according to Sergeant of Detectives Rosanne Morrissette.

“The people in the vehicle were spoken to and released,” she said.

The incident itself is still under investigation and GPD is looking into the motivation, whether intentional or accidental. They are also investigating who fired the shot that wounded Brown, who was later flown to a Albuquerque hospital. They are currently waiting for Brown to be able to provide a statement. His current condition is unknown.

Ustick said the management plan for removal of sludge from the wastewater treatment plant has been updated and resubmitted to the state. Further progress is on hold until the plan is approved.

Bar room brawl leads to arrest

Pinto asked for the vehicle keys so that he could charge his cell phone and his brother later discovered that Pinto had taken off with his vehicle. He told police that he called his brother told him to bring his “vehicle back to the bar due to his intoxication level.”

Pinto returned to the bar

where they began to argue.

The argument continued into the bar where the bouncer, Gary Hallock, 44, of Gallup got involved and asked Pinto to leave. When Pinto “made an aggressive move towards”

Hallock, he put Pinto into a headlock and attempted to remove him from the bar.

Hallock told Hughte that they then fell to the floor and Pinto bit Hallock’s left upper inner arm.

“On his left upper inner arm he had a bite mark [which] was very red and blue. The skin was broken and you could see the teeth markings on the top and bottom of the bruising,” Hughte said in his report.

After that, several other patrons got involved, and Pinto was taken to the parking lot to await police arrival.

Another witness came forward and told Hughte that an unknown male also joined in the scuffle and he was swinging a belt buckle.

“The male possibly hit Mr. Hallock in the back and then started to swing back toward himself and then struck himself in the head with his own belt buckle,” Hughte said in his report.

Hughte’s report also said that he attempted to calm Pinto down upon his arrival. Pinto was handcuffed and placed into the back of Hughte’s patrol car where he laid down and began to kick the patrol unit door.

Pinto was removed until he calmed down and then was placed back into the patrol unit and secured with a seat belt.

“I looked to my patrol unit again and did not see Mr. Andres Pinto sitting up. He had laid down and proceeded

to kick the patrol unit doors again. He was able to get his seat belt unlocked and laid down,” Hughte said in his report.

Pinto was finally placed into a Community Service Aide van. While being put in the van, Hughte’s report said that Pinto attempted to spit on him, but missed.

“The doors were closed and the van started to shake with Mr. Andres kicking and screaming inside,” Hughte said.

Pinto continued his disorderly behavior at the jail where he was booked for aggravated battery and resisting, evading or obstructing an officer.

fter almost two hours of handling burglary calls and searching for a male subject in the Mossman area, Jeremy Henry, 23, OF Gallup was arrested on multiple burglary counts July 14.

According to the statement of probable cause, filed

by Gallup Police Department Officer Matthew Ashley, officers responded to a call of a broken window at the New Mexico Gas Company on East Aztec in the early morning hours,.

While searching the area, Officer Victor Rodriguez “saw movement in the bushes, then he saw a male subject.”

Rodriguez ran after the man who had took off running eastbound from the area of Verdi Drive and Aida Court.

Rodriguez lost visual contact with the man.

While getting back to his unit, he came upon a vehicle with a window broken out.

“Officer Rodriguez went back to the area behind Verdi Drive and found a Sig Sauer

308 rifle laying in the bushes,” Ashley said in the statement.

The rif le turned out to belong to the owner of the vehicle whose window had been busted out. The owner informed police that there had been “other weapons” in the vehicle. The GPD K-9 unit was then deployed to check the area.

At approximately 6:33 am, Ashley wrote in his statement that he was sent to an East Aztec residence where another vehicle had been broken into.

At 6:42 am, Ashley said that he “noticed a male walking out from behind 1910 E. Aztec.” The man was acting suspicious, walking with his hands in his pockets and keeping an eye on Ashley. He matched the description of a man that Officer Chanelle Preston had seen in the area.

TRD secretary named in investigation

ANTA FE–An investigation into the state Taxation and Revenue Department is implicating cabinet Secretary Demesia Padilla for alleged illegal behavior.

State Auditor Tim Keller recently revealed (http: // nmpoliticalreport.com/6182/ auditor-finds-possible-abuseof-power-in-tax-and-rev/) that his office received a complaint in February that senior TRD officials gave a certain politically connected taxpayer preferential treatment. Part of the reason for the alleged preferential treatment centered around how a cabinet level TRD official previously worked for this taxpayer.

A letter sent yesterday from State Auditor Tim Keller to Gov. Susana Martinez says that the allegations surround Padilla, the highest-level employee in

the department. According to the letter, Padilla allegedly “improperly inf luenced, or attempted to influence, the TRD tax audit of a former client.”

A preliminary report by a n i ndependent aud it i ng f i r m fou nd rea son for a deeper investigation into the allegations. It also concluded that “actions were taken to protect the Secretary from possible individual liability stemming from her previous work for the taxpayer” as an accountant.

President Begaye, Vice President Nez meet with U.S. Dept. of Veterans Affairs

ASHINGTON, D.C.—A veterans summit is in the works to bring together the U.S. Department of Veterans Affairs, Department of Navajo Veterans Affairs, congressional members, senators and most importantly, Navajo veterans seeking assistance.

The meeting is planned for autumn and will take place on the Navajo Nation, possibly during the Navajo Nation Fair.

That was the result of a July 8 meeting between Navajo Nation President Russell Begaye, Vice President Jonathan Nez and Stephanie Birdwell, Director of the Office of Tribal Government Relations for the VA. The meeting took place at the VA headquarters in Washington, D.C. Begaye focused on four key areas during the meeting: veterans housing, collaboration between Indian Health Services and the VA for veterans health care (in particular mental health), designation of the Navajo Nation as a regional veterans services center and passage of the Navajo Nation Veterans Act. The Begaye-Nez administration platform of Navajo veterans, elders and youth, infrastructure and job creation will focus on the needs of veterans, he said.

“Veterans are number one on our platform because they are the protectors. They fought for our people and we don’t want to forget them,” Begaye said.

The Southwest Region of the Office of Tribal Government Relations under the VA covers the Four Corners and works with 50 tribal governments.

The services provided by the three administrations of the VA – National Cemeteries, Veterans Benefits, and Veterans Health – are provided to veterans on tribal lands. “(Office of Tribal Government Relations) is going on five years old, based here in D.C., but we have tribal relations government specialists located across the country,” Birdwell said.

She said they manage portfolios of relationships with tribes, with the primary focus and function of implementing the VA’s tribal consultation policy, engaging in activities that promote increased access to care and benefits, and promoting economic sustainability for veterans in Indian Country.

A reimbursement program between two federal agencies is an innovative agreement providing services for veterans.

Birdwell described the VA and IHS memorandum of understanding as “a book of possibilities,” and said

the reimbursement agreement program is an important component.

The VA has reimbursed more than $22 million over the past two years. About $1 million per month has been reimbursed to IHS and tribal health care facilities.

“Some of the sites on the Navajo Nation are billing (for reimbursements) quite well and it’s exciting to see,” Birdwell said.

Begaye introduced Jamescita Peshlakai, the liaison for tribal veterans at the Navajo Nation Office of the President and Vice President. She joined by teleconference.

“Jamescita is our point person on veterans affairs,” Begaye said. “She is highly educated, a former Arizona State Representative, a Gulf War veteran and she is politically connected.”

He said the Navajo Nation is going to join the five tribes that have tribal cemeteries on their nations that were funded by the VA National Cemetery Administration.

There are 131 national cemeteries across the country, five of which are located on tribal lands.

The program came online in 1978 and $264 million is available for grants, according to George Eisenbach, director of the Veterans Cemetery Grant Program.

“It’s a dynamic program that honors our warriors.

South Dakota is working on their third tribal cemetery,” Eisenbach said.

He said the Navajo Nation is eligible. All that is needed is a tribal resolution and 10 percent in

matching funds.

President Begaye said land was identified in the Chinle Agency years ago for a veterans’ cemetery.

Vice President Nez brought up the case of John Kinsel, a 94-year-old Navajo Code Talker that has been struggling with the VA to get benefits for injuries he suffered from World War II. “Mr. Kinsel has been getting the run around from the Prescott VA and we would like for you to provide assistance,” Nez said.

Before concluding the meeting, Begaye said they would send an invitation to the VA, Congresswoman Ann Kirkpatrick and others for the Navajo Nation Veterans Summit during the tribal fair in Window Rock.

State police warn of warrant fee scam Staff Report

NM Supreme Court to review copper rule

ANTA FE –The state’s h i g he s t cou r t w i l l review New Mexico’s controversial guidelines to copper mines.

Opponents of the copper rule argue that it viol a t e s t h e s t a t e’s c l e a n water laws, which say that groundwater with a present or foreseeable future use must be protected from pollution.

The copper rule, adopted in 2013, allows groundwater within a “capture zone” of a copper mine to be polluted above state- regulated levels.

Dougla s Meik lejoh n, a n at tor ney for t he fou r organizations and an individual asking for a legal review of the copper rule, notes that nine out of 10 New Mexicans get their drinking water from groundwater.

“This allows the writing off of an enormous amount of groundwater and allows it to be polluted,” Meiklejohn said of the copper rule.

Among the plaintiffs asking for a legal review include Bill

Olson, the state Environment Department’s former bureau chief for groundwater. Capture zones can be as big as one square mile, Olson said, but he also argued pollution can also seep outside of those zones.

Copper mines, he said, are essentially large open pits.

Miners excavate rock out of the pit, which can contain ore.

But the part of the rock that isn’t deemed economically useful gets discarded, often outside of the mine’s capture zone. Discarded rock still has copper in it, Olson said, and that copper can seep into groundwater underneath where it gets discarded.

“In this case they exempted water from other mine units outside [the capture zone],” Olson said.

T he se pr a c t ice s, bot h Meiklejohn and Olson argued, violate clean water rules that have been in place in New Mexico since 1977. The new rule has been controversial since it was implemented and environmental groups have been highly critical of the rule.

Previous efforts to get a court to overturn the copper

rule have not worked. who cheat the public, and to protect New Mexico’s economy a nd v ulnerable consumer populations from abusive business practices.”

The F raud Recover y Strike Force is charged with investigating false claims and deceptive practices, and is partnering with whistleblower s to ex pose abuse and corruption. The strike force will enforce state and federal law in order to recover millions of dollars f leeced f rom t he publ ic t rea su r y and New Mexico’s economy at no additional cost to the taxpayer.

Its efforts will be directed to high priority risk areas including securities fraud, i nve s t ment s w it h publ ic employee retirement funds, hea lth ca re fraud, a nd marketplace fraud.

Some of these efforts are already underway in the form of ongoing litigation being handled by the Office of the Attorney General’s Medicaid

Fraud and Elder Abuse Division against companies misusing public funds and offering subpar care to vulnerable New Mexicans.

Other active cases include litigation against credit card companies for restraint of trade and litigation against private colleges for deceptive marketing, unfair practices and misrepresentation.

More than 900 overdoses reversed in 2014

T

he New Mex ico Department of Health announced July 15 that more than 900 opioid overdose reversals were reported in 2014 due to the use of the drug naloxone. That’s almost a 29 percent increase in reversals from 2013. The Department of Health has been working with various partners and agencies to increase access and availability of naloxone in New Mexico as part of a multi-pronged approach to reduce overdose deaths in New Mexico.

“Overdose deaths impact just about every family in New Mexico in one way or another.

Addiction is a complex public health issue that requires the collaborative efforts of many agencies, stakeholders, and individuals,” Department of Health Cabinet Secretary Retta Ward, MPH said. “The Depa r t ment of Hea lt h is involved in a number of collaborative efforts to train law enforcement and family members on how to administer naloxone.”

The Department of Health has worked with the Santa Fe Sheriff’s Department and District 7 of the New Mexico State Police to train their officers to carry and administer naloxone if they are the first responders to a possible drug overdose.

District 7 includes Taos, NEWS

Rio Arriba, and parts of Santa Fe and Colfax counties. The Department of Public Safety hopes to expand its training to officers in other districts, and efforts are underway to work with additional police and sheriff’s departments to distribute naloxone to their officers.

Here are some other numbers about naloxone efforts in New Mexico in 2014: • The Department of Health trained and enrolled about 1,700 new people in the use of naloxone kits.

• The Department of Health distributed 5,874 doses of naloxone in 2014, a 55 percent increase from 2013.

• Pharmacists are now allowed to prescribe naloxone.

• New Mexico pharmacies are beginning to stock naloxone. About 10 percent of pharmacies have dispensed naloxone kits and 166 kits have been dispensed via Medicaid Even with the success of more than 900 opioid drug reversals in 2014, New Mexico’s drug overdose death rate increased last year. In 2014, 536 New Mexico residents died of an overdose – compared to 449 in 2013. That’s a 20 percent increase in the death rate from 2013. In 2013, the death rate was 21.8 per 100,000 compared to 26.4 in 2014. The increase comes after two consecutive years of decreases in overdose deaths rates in New Mexico. The drug overdose death rate fell 16 percent from 2011 to 2013.

Overdose deaths often involve more than one type of drug. Prescription opioids accounted for about 51 percent of the drug overdose deaths in 2014.

The Department of Health and the Board of Pharmacy have been ramping up efforts to more closely mon itor prescribing in an effort to

reduce the risk of addiction.

The Prescription Monitoring Program (PMP) allows prescribers and pharmacists to check the prescription history of their patients.

Licensing boards require that health care providers who prescribe drugs such as opioids check the PMP for high risk patients. Training is also provided on safe prescribing and PMP use.

The Board of Pharmacy recent ly m a de a ch a nge requiring pharmacies provide prescribing data to the P r e s c r ipt ion Mon it or i n g P rog ra m w it h i n one day instead of seven days. Any health care provider prescribing an opioid can also prescribe naloxone.

• In 2014, there were 927,333 PMP reports requested by users, an increase of more than 325,000 requests since 2013.

• I n 2014, prescr iber s checked the records of 56 percent of patients receiving an opioid prescription for three

or more months in the PMP, an increase of six percent from 2013.

• In 2014, pharmacists checked the records of 49 percent of patients receiving an opioid prescription for three or more months in the PMP, an increase of five percent from 2013.

“The Department of Health and its partners have been working hard to make policy changes and build infrastructure to help reduce drug overdose deaths. Now we need the help of providers and pharmacists to increase access to naloxone. We also need to ensure prescribers are consistently using the prescription monitoring program,” Ward said.

New Mexico has been recognized as a leader in innovative policies addressing prescription drug overdose by being one of two states that has implemented 10 out 10 promising policies according to the Trust for America’s Health.

This bike was donated by Mr. Cable Hoover and will go to help a wounded warrior ride again. The Comfort Suites first involvement with the Combat Hero’s Bike Build was in May 2015 as SSgt Brian Mast and the Run for the Wall Midway

DVD/Blu-ray Roundup For July 17, 2015

I

t’s a very busy week for Blu-ray and DVD releases with just about every kind of genre represented. That means we had better get right to the highlights. So, if you can’t make it out to the movies this week, be sure and give one of these titles a try.

BIG NEW RELEASES!

Can’t Stand Losing You: Surviving The Police - Based on the book by guitarist Andy Summers (member of the famous 80s band The Police), this documentary details the group’s rise, breakup, and reformation a few years back. It features previously unseen footage and photographs from Summers. Reviewers weren’t all that enthusiastic about the movie, calling it too limited in perspective and safe in approach. They believed that it would have benefited from the participation (and differing viewpoints) of band mates Sting and Stewart Copeland.

It’ll likely still please fans, though.

Ex Machina - A young employee of an internet-search firm is awarded a chance to meet with the mysterious president of the company.

Once there, he’s asked to help test the next step in Artificial Intelligence, a robot who looks and behaves like a human being. As the story progresses, relationships form and motivations become fuzzy. The press adored this sci-fi drama, with most giving it raves (myself included). They called it an intelligent, suspenseful, amusing and at times creepy film that effectively explores the

deeper issues of its subject matter. Domhnall Gleeson, Oscar Isaac and Alicia Vikander play the lead roles.

The Longest Ride - This Nicholas Sparks adaptation involves a bull-rider and a college student who cross paths and fall in love. But can the relationship survive their different goals and ideals in life?

Additionally, their romance is intercut with an older, friendly acquaintance who remembers his own, decades-spanning love affair. While a few were charmed by the cast, the majority of press members were not taken with this melodrama, calling it corny, contrived and impossible to take seriously.

It stars Scott Eastwood, Britt Robertson and Alan Alda.

Paul Blart: Mall Cop 2 Arriving some 6 years after the original, this comedy sequel features no mall to speak of.

Instead, it follows the lead character on vacation in Las Vegas. While there, he must foil a heist plot from a nasty villain out to steal art from one of the hotels. Slapstick shenanigans ensue. As one might imagine, reviews were particularly terrible for this feature, saying that lead Kevin James could do nothing to salvage the script’s attempts at juvenile humor and the consistent barrage of product placements. Besides James, the cast includes Raini Rodriguez, Daniella Alonso and Neal McDonough.

The Unwanted - A young woman arrives in a small town hoping to find her mother. After forming a relationship with a local waitress, the two attempt to uncover the truth behind her parent’s disappearance.

This low-budget Gothic tale is said to involve vampirism. It hasn’t gotten any reviews as of yet, so viewers will have to embrace the darkness solely on their own. It stars Christen Orr, Hannah Fierman and William Katt.

BLASTS FROM THE PAST! Once again, Olive Films is bringing a number of curious out-of-print features to Blu-ray.

Adventures of Captain Fabian (1951) is a lesser known Errol Flynn adventure flick that features the actor as a sea captain falling for a femme fatale.

Arquette and Vincent Spano in the well-regarded coming-ofage romantic drama Baby, It’s You (1983). The story follows a conservative high school senior in the 60s who and her tumultuous relationship with an academically challenged tough guy.

T he Eter nal Sea (1955) is a naval war drama with Sterling Hayden. Not only is Hell’s Five Hours (1958) a great pulpy title for a thriller, but it has an interesting plot about a military rocket fuel pla nt worker who is fired from his job - he immediately straps dynamite to himself, takes hostages and plots to blow the place up.

Olive Films also have the interesting Blu-ray King of the Gypsies (1978) scheduled this week. It’s about a young man torn between the modern world and his old world family. Events get even more complicated when he’s chosen as the new leader of the community. The movie features an impressive cast, including Eric Roberts (in his first role), Sterling Hayden, Susan Sarandon, Shelley Winters, Judd Hirsch, Brooke Shields and Annette O’Toole. Finally, Man of Conquest (1939) is a biography and war film about the first president of the Republic of Texas, and follows the man’s life right through the Battle of The Alamo.

There are also some noteworthy titles arriving courtesy of Shout! Factory. It may not be quite as impressive as the original, but the TV movie remake of All Quiet on the Western Front (1979) was a well regarded production that won a Golden Globe at its time of airing. This “Uncut Edition” features over 25 minutes of extra footage. It stars Richard Thomas, Ernest Borgnine, Donald Pleasance and Ian Holm.

There are plenty of genre pictures coming from Shout! on Blu-ray as well. Howling II: Your Sister Is A Werewolf (1985) is the extremely cheesy sequel to the 80s horror classic. The numerous extras in this edition include multiple audio commentaries, interviews with cast and crew members, as well as an alternate opening a nd ending.

I’m fascinated to revisit The Legend of the Lone Ranger (1981), an expensive retelling

of the famous western character that bombed during its original release nearly 25 years ago. Reportedly, the lead actor was chosen for his physical prowess and not his acting - his lines ended up being rerecorded by thespian James Keach in the finished product. It was directed by famed ci nematog rapher Wi l l ia m A . F r a k e r (R o s e m a r y ’ s Baby, Bullitt) and features Christopher Lloyd and Jason Robards in supporting roles.

Morbidly curious Western fans will want to check this notorious flick out.

Finally, Shout! have a pair of Double Feature discs that include some goofy B-movies that have been given high quality transfers. The first set features Cellar Dweller (1988) and Catacombs (1988). The second release pairs The Outing (1987) with T he Godse nd (1980) - please note that the disc contains only the US cut of The Outing. None of the four movies are masterpieces, but they will appeal to the old school horror completist.

Not to be outdone, Kino Lorber are delivering Blurays of some noteworthy 80s and 90s films. Blown Away (1994) is a fun little thriller from Stephen Hopkins (24) about a mad bomber - the cast includes Jeff Bridges and Tommy Lee Jones. Life Stinks (1991) is a comedy starring and directed by funnyman Mel Brooks. James Belushi and John Ritter play the leads in Real Men (1987), an action/comedy about a CIA agent and insurance salesman who get mixed up in an alien plot. Finally, Rush (1991) is a drama with Jason Patric and Jennifer Jason Leigh. It’s about cops going undercover to hunt down a drug dealer who become addicts themselves.

But that’s not all. Criterion also have two Blu-rays to consider. The first is The Black Stallion (1979), a beautifully photographed film about a young boy who befriends a wild horse and eventually becomes its jockey. The movie was produced by Francis Ford Coppola and was nominated for two Oscars. The Blu-ray includes a restored digital transfer, plenty of interviews about the making of the movie, and five short films from director Carol Ballard that were made in the

60s and 70s.

The French drama Hiroshima Mon Amour (1959) is an acclaimed title that follows a roma nce between a European actress and a Japanese architect. This title is also getting lavish hi-def treatment - the Blu-ray possesses another restoration of the film, new interviews with participants and a film historian audio commentary about the production.

If you were a fan of the recent X-Men: Days of Future Past (2014), Fox is putting out a new cut of the film on Blu-ray.

“The Rogue Cut” is 10 minutes longer than the original version and includes all of the material involving the Rogue character that was edited out of the film.

Reportedly, this includes an elaborate jailbreak sequence.

Universal are issuing a couple of older titles on Bluray as well. They include the popular sci-fi suspense film The Andromeda Strain (1971) and the all-star comedy crime thriller S n e a k e r s (19 92) w it h Robert Redford, Sidney Poitier, Dan Aykroyd, Ben Kingley and many other familiar faces.

ANT-MAN Succeeds, But Also Suffers From a Few Tics

ell, comic book enthusiasts, yet a nother Ma r vel Universe character has made the leap to the big screen. The superhero developed this time out is a somewhat surprising selection, with the film taking a more comedic tone than its predecessors.

Ant-man is a decent effort that benefits greatly from a charismatic lead and good cast, although it doesn’t come without a few irritating tics.

Scott Lang (Paul Rudd) is a thief and ex-con who wants to go straight and provide financial support for his estranged family. Yet, with a criminal record he finds it almost impossible to hold onto a job, and is lured back into burglary by his good-natured but slow-witted criminal pal, Luis (Michael Pena). Thankfully, the brilliant and wealthy scientist Dr. Hank Pym (Michael Douglas) has

already taken notice of Scott’s specific skills.

The retired Pym and his daughter Hope (Evangeline Lilly) recruit Lang to wear a secret suit that can not only shirk him to the size of an ant, but give him superhuman powers. With the knowledge that current Pym Technologies President Darren Cross (Corey Stoll) is working on a military version of the same shirking

apparatus, our hero is tasked with breaking in and preventing it from being developed and sold.

In truth, it’s a lean plot. And yet, it seems almost overcomplicated in its development.

This is a two hour film, with the first half introducing the numerous characters (we haven’t even gotten into the details with Lang’s daughter, his ex-wife, her new cop husband

and the many other crooked but pleasant friends of Luis) and the conflict between them all, not to mention explaining the details of Pym Technologies and its research. There are also a few running gags and subplots (including a friendly relationship between man and flying insect) that don’t seem to come full circle, either.

It’s quite talky and as written, often comes across as generic in approach. One would have hoped for a little more wit (or at least some sort of edge) from its characters. At times the humor comes off as too broad, resulting in a successful joke ratio that falls well below fifty percent.

Thankfully, Rudd is amusing and engaging. Many of his dry comments do work and have an almost off-the-cuff feel to them.

They could very well have been improvised on the spot, and if they weren’t, all the more credit to the actor for selling them in a naturalistic manner.

There are a few impressive visual sequences as Lang wears the suit and is able to jump back and forth in size, disappearing and reappearing in various locales. Early on, there’s an impressive scene involving

a bathtub with running water, gushing like rapids and hurtling the character around in its current. The movie could have done with much more of this. There are training montages and a fist fight or two using the special costume, but the script doesn’t really go to town with its premise until the final act.

And as the miniature action goes, the climax is the strongest aspect. While the stakes are high, Lang fights the forces of evil on a very small scale, resulting in some big laughs (particularly a daring face-off on a Thomas the Train set).

Characters are shrunk to even more mircoscopic sizes and other miniature items and life forms are blown up to exaggerated states, resulting in some great images. In all, the finale really is a lot of fun to watch.

So while the movie is awkward and uneven, when it takes full advantage of Rudd and the story’s eccentric peculiarities, it is enjoyable. Ant-man isn’t among the best or most memorable films in Marvel catalog, but it’s an agreeable enough introduction to another new superhero.

President Begaye, Vice President Nez issue proclamation, honor native youth

ASHINGTON, D.C.—About 800 Native American youth from around the country, representing more than 200 tribes, converged upon the nation’s capital last week for two conferences aimed at empowering native youth.

The efforts to inspire these native youth were supported by the two top leaders from the Navajo Nation, especially with regard to native language revitalization and preservation.

President Barack Obama extended an invitation to the Begaye-Nez administration to attend the White House youth summit and support the Obama administration’s outreach to Native American youth.

President Jonathan Nez were on Capitol Hill from July 6 to 10, meeting with congressional members, senators and top federal officials from various departments.

They met with Navajo youth and other youth ambassadors from across Indian Country to

America through greater youth involvement.

One group in attendance, chaperoned by Claud ia Jackson, traveled from Dilkon, Ariz. to represent the Navajo Nation at both conferences.

Jackson works for the Dilkon Youth Ser v ices as a prog r a m a nd proje c t s specialist, a position she has held since October 2014.

“The UNITY Conference is important to Navajo youth because it helps to foster their curiosity of the world and they build on their experiences when they travel to other places and meet new people,” Jackson said.

Vice President Nez was particularly proud of native youth who fostered the effort to preserve tribal languages and speak their native tongue, identifying this as an important aspect of their self-identity.

“Native American youth gathered here in Washington, D.C. stood up for preserving their language. We appreciate that,” Nez said.“Diné bizaad is inherent within you. You just need to bring it out. We’re proud of those Navajo youth that speak the language and we encourage all of our kids to learn.”

Gallup asking residents to conserve water Staff Report

T

he City of Gallup is asking for your help to conser ve water and avoid mandatory restrictions.

As part of the Navajo Gallup Water Supply Project (NGWSP), the city soon will place the new Gamerco tanks into service that will create a much larger reserve capacity than currently exists. The existing pipeline has reached the end of its service life and will be replaced with a new larger pipeline as well.

The current connection to our system requires us to very closely monitor and restrict flows through the old pipeline until the switchover is completed in late August. The necessary flow restrictions will prevent the city from building its normal overnight reserves. Until the work is completed, residents may experience slightly reduced water pressures.

In order to avoid any mandatory controls on water use, we are asking the public for voluntary water restrictions effective immediately and through August or until the Gamerco tanks are placed into service.

You can help the city by observing the following practices:

Begay is the founder of DYS and is still involved with the program to help educate youth of the Dilkon community. The other primary supporter is the Holbrook Unified School District, in particular, the I nd ia n Wel ls Element a r y School.

The school district has been assisting DYS since its inception and helped develop an afterschool program. The program will again be in place in August, when school starts. “ T h i s Nava jo Nat ion Proclamation will make a difference, with the support of our Navajo leaders, President COMMUNITY

“Let’s nurture our young leaders of today with the k nowledge we a l rea dy possess and help them build a better Navajo Nation,” said Jackson.

The youth ambassadors of Dilkon Chapter will be returning to the Navajo Nation on July 14.

Council may provide a waiver to entities that prove the above section this Ordinance poses a hardship.

• T he Wa t er S y s t em s Superintendent may issue site-specific waivers to the irrigation restrictions to allow for irrigation of new sod/seed areas for a period not to exceed 14 calendar days.

CAR WASHING: • A l l Sel f- Ser v ice Ca r Wash wand nozzles shall not use more than 3.0 gallons of water per minute and be equipped with a positive shutoff nozzle. Such nozzle shall stop the flow of water through the hose when released by the operator.

• The use of garden hoses of any type for vehicle washing at commercial facilities is not considered an approved method; and • Charity carwashes are prohibited, except when in compliance with the provisions of this Ordinance, Section 8-6-1.

Zuni neighborhood watch program holds first cook-off fundraiser

uni Pueblo is holding its first annual A:shiwi A:wan Neighborhood Watch Summer CookOff contest scheduled for July 18 in Zuni, New Mexico.

This event is a combined effort of the AANW Program and the Pueblo of Zuni Police Department, and it’s purpose is to raise monetary funds and awareness of the AANW Program’s goals and objectives for crime prevention.

We have been receiving some outstanding feedback from interested contestants, and we want to make this event a success.

The proceeds will go toward the AANW Program, which will enhanced the working mechanism of the Community

and the local Pueblo of Zuni Police Department and also surrounding LawEnforcement Agencies. As we have grown, so ha s t he need s of t he Community in relation to Crime Prevention awareness.

Southern Plains State Regional a success

he 2 015 S out her n Plains State Regional in Gallup last weekend finished up on Saturday with just a problem or two, but overall it was a success.

One of the problems was the seasonal rain (I refuse to call it a monsoon, since I know the real meaning of the word) on Thursday. Kudos and lots of thanks to the City Parks’ workers for jumping on the problem early and doing a great job in preparing the fields for more action. Well, there was a twohour delay in the morning and

another delay in the afternoon, but putting an hour and 45 minute time limit on the games took care of the rest of that problem and the first round was done by about 9:30.

The only other problem was caused by one of the coaches.

After his team was beaten by two runs on Friday night – the opposing pitcher had 14 strikeouts in the seven-inning game and his only female teammate blasted a solo homerun – the team drew the Gallup Mud Hens in the semi-finals and were blasted 17-4. Before that last game happened, the coach

SUCCESS | FROM PAGE 20 sent two of his assistants to the score booth to claim that the outstanding young pitcher was ineligible because of an inning he had pitched previously.

A solid look at the scorebooks found this NOT to be the case, but the proof had to be reiterated Saturday morning under threat of a protest. The knowledgeable scorekeeper convinced them of his correctness quickly and the result was the final game listed above.

About a 45-minute break between games set up the championship with the Mud Cats being the only undefeated team remaining. Had they lost Saturday, an ‘if’ game on Sunday would have decided the champion. The Mud Hens decided not to let the tournament contine and shut out the challenger, 6-0.

I did mention that it was the GALLUP Mud Hens who won, right? This is actually the sa me tea m that ca me in second last year as the Rangers, but still traveled to Puerto Rico for the National

Tournament. Now they get another chance to travel back to P.R. again, but this time on their own merits and with all 12-year olds. The results should be much better for the local boys this time.

Congratulations, Mud Hens, for a great tournament and Good Luck in August when you get to Puerto Rico!

Last week’s edition of the Gallup Sun did not have a picture of the Sandy Koufax City Champions, the Yankees.

Leandro Griego sent in a picture of the team after deadline though, and it is included on this page. That’s what happens with delays in the news cycle!

All quiet this weekend, but the Willie Mays (9-10 year olds) World Series begins play on July 23 and will continue until July 25.

After that, I hope to have pictures and a story or two from the Adult Softball Leagues to fill the pages. At least until the new school schedules are released. Until the, I’ll see you in the bleachers for the Willie Mays World Series or at the Sports Complex, then we’ll talk.
