top & Shop has donated 2,000 Thanksgiving turkeys to the Food Bank for New York City to help New Yorkers in need. These 2,000 turkeys are being distributed across the five boroughs as part of the Food Bank for New York City’s Five-Boro Turkey Tour. The tour began in Harlem at the Food Bank For New York City’s Community Kitchen and Pantry (on Monday, November 18th.

The Five-Boro Turkey Tour will continue throughout the week of November 18th, making stops at: M.S. 22 Jordan L. Mott in the Bronx, Medgar Evers College in Brooklyn, the Legacy Center Community Development Corporation in Queens, and Project Hospitality on Staten Island.

Racially Discriminatory Legislation and Policies Must Be Stopped The Unintended Consequences of a Menthol Cigarette Ban to Black America From pro-slavery laws to Jim Crow, to Prohibition, to racial profiling, to Stop-and-Frisk, history is clear: racist laws and discriminatory bans have been devastating for Black America.

Today, Law Enforcement Action Partnership (LEAP) and National Newspaper Publishers Association (NNPA) have joined together with other African-American law enforcement executives to call on you - our readers in Black communities across the nation - to see the warning signs of yet another proposed racially discriminatory law: the menthol cigarette ban.

It is a well-known fact that over 85 percent of African Americans who smoke prefer menthol cigarettes. There is no factual basis to assert that a menthol cigarette ban will stop African Americans from smoking. In fact, the unintended consequences of such a raciallydiscriminatory ban will set the stage for more negative and more likely counterproductive interactions between law enforcement and African Americans.

While proponents argue that a menthol cigarette ban could encourage menthol cigarette smokers to quit smoking cold-turkey, another possible outcome could be extremely dangerous—the creation of an illicit market. If this happens, illegal sales of menthol cigarettes will likely be concentrated in communities of color, leading to a greater police presence, citations, fines, and arrests for selling a product that for the past 50 years has been legal.

Possible bans on menthol cigarettes are now being considered throughout the United States as add-ons to e-cigarette bans. It must be said that while FDA has deemed teen vaping an “epidemic,” there is no teen menthol cigarette epidemic. The fact is teen cigarette use has steadily been on the decline over the past decade.

Recently in New York, the mothers of Trayvon Martin and Eric Garner courageously issued a public statement warning against the consequences of a proposed menthol cigarette ban. Sybrina Fulton and Gwendolyn Carr stated, “When you ban a product sold mostly in Black communities, you must consider the reality of what will happen to that very same over-represented community in the criminal justice system.”

Law enforcement leaders like Law Enforcement Action Partnership (LEAP), National Organization of Black Law Enforcement Executives (NOBLE), Grand Council of Guardians, and National Association of Black Law Enforcement Officers (NABLEO) have stated countless times that a ban on menthol cigarettes will have unintended negative consequences, especially for African Americans.

Over the past 30 years, we have reduced tobacco consumption overall across this country by about 40 percent. And we did not do that with the criminal justice community. We did that with education, we did it with treatment, we did it from a health and educational perspective. Let’s continue with that. Let’s not do something that’s going to end up with these unintended consequences of increasing interaction between police and community members.

Major Neill Franklin (Ret.), Executive Director of the Law Enforcement Action Partnership (LEAP): “I dedicated 34 years of my life to public safety, enforcing the laws that our legislators placed before me. That’s what cops do, and we trust that those laws are well thought out, studied and based upon sound data and evidence. As we begin to mirror the days of alcohol prohibition with tobacco bans, expect the violence and corruption that comes with the illicit market and add something else, the over criminalization of the black community.”

Jiles Ship, President of the National Organization of Black Law Enforcement Executives – New Jersey (NOBLE): “Banning menthol cigarettes would be a 21st Century attempt at Prohibition, a past failure of government to restrict a previously legal product. As we learned with Prohibition, every time the government tries to ban something, it seems to cause other problems. And unfortunately, a menthol cigarette ban would be another example of government action that disproportionately disrupts the Black community.”

Charles Billips, National Chair Person of Grand Council of Guardians, “The first question I asked is how are they going to implement this ban on menthol cigarettes, knowing that a large number of Black and Brown people smoke menthol cigarettes? It would be best to educate the communities on the affect it has on our health instead of a ban enforced through Law Enforcement.”

As The Reverend Dr. Martin Luther King Jr. once prophetically said, “The time is always right to do what is right.” And the right thing to do for our families and communities and for all who stand for freedom, justice and equality is to speak out against all forms of racial discrimination and disproportionate law enforcement, as well as the systems, laws, bans and policies that perpetuate them.

Speak out against racism. Stand up against discrimination. Let your voices be heard.

n December 7th, Saturday night at 7:30 pm to 9:30 pm, the Schiller Institute NYC Chorus returns to the Bronx at Our Lady of Mt. Carmel Church, 627 E. 187th Street, in the Little Italy neighborhood. They will present the Bach Magnificat, and part 1 of Handel’s Messiah, in a Holiday Concert. Soloists will be Alyson Spina, Soprano; Mary Phillips, Alto; Everett Suttle, Tenor, and Costas Tsourakis, Bass. The Schiller Institute Chorus is impressive as a community-based chorus that accepts all applicants at least to its rehearsals. Over the last 5 years it has helped popularize classical music in all of New York City.

The chorus has now expanded to Queens and Brooklyn, and in 2017 performed at Carnegie Hall as part of a Centennial Tribute to Sylvia Olden Lee. The Schiller Institute NYC Chorus now has up to 150 singers at any major concert.

The chorus is committed to creating a renaissance in the United States based on principles of Classical Composition as advocated by Giuseppe Verdi of Middle C = 256 Hz (“A” no higher than 432 Hz).

The chorus is also committed to the performance of African-American Spirituals as an important American contribution to great music.

The Schiller Institute New York City Chorus began on December 20th, 2014 at

a Sing-Along performance of excerpts of Handel’s Messiah. The concert had been organized in answer to the outrage over the Staten Island Grand Jury decision on the death-by-suffocation of Eric Garner, which had come in the wake of the riots in Ferguson, MO, after the killing of an unarmed African-American teenager. Also, not long after, two police officers were murdered in Brooklyn as they sat in their patrol car.

The chorus will perform Bach’s Magnificat in D major, and part 1 of G.F. Handel’s Messiah with a set of Christmas spirituals, including Eugene Simpson’s arrangement of Sister Mary Had-a But One Child. Tickets $20, $40, $100. he Bronx Night Market has been appearing monthly in Fordham Plaza, by Webster Avenue, and is now appearing more often as it gets closer to the holidays. The Market is sponsored by NY City Council members Ritchie Torres, Fernando Cabrera, and the Fordham Road BID. There are performances at times, as well as attempts at outdoor heating around the bar area. The market, organizers said, is an “effort to bring awareness of just how amazing our borough is, and how much there is to offer by way of food, drink, culture, and performers.”

More than half the vendors serving up international eats will be Bronx-based businesses. Those include: Empanology, a catering company making Puerto Rican-style empanadas with creative fillings like chicken truffle mac ‘n’ cheese and summer squash; Tripla Panna Ice Cream, a fledgling ice creamery scooping out of the Mottley Kitchen cafe in Mott Haven; and Millie Peartree Fish Fry & Soul Food, a Southern kitchen serving up catfish strips and fried shrimp on the Grand Concourse.

OP-ED: How heavy a burden does a person of color alleging discrimination have to carry to have his day in court?

he case, Comcast Corp. v. National Association of African American Owned Media and Entertainment Studios Networks, is, on the surface, a case about procedural issues. Beneath the surface it is about the ease or complexity a plaintiff may face when raising claims of racial discrimination under 42 US 1981.

Even though it has reached the United States Supreme Court, procedurally, the lawsuit is in the beginning stages, and the Supreme Court will be deciding whether the plaintiffs (Byron Allen company) may move forward in the legal process to have its “day in court” before a jury, or whether its suit should be dismissed before it reaches a jury or the investigatory process that we lawyers call “discovery.”

In short, whether a case makes it to the discovery process, depends on whether the case is allowed to move forward after the plaintiff files a complaint. As common practice, defendants usually file a motion for summary judgement, asking the court to dismiss the plaintiff’s complaint prior to discovery and prior to any decision on the merits of the plaintiff’s claim along with its answer to the plaintiff’s complaint. It is a procedural tactic to prevent the lawsuit from moving further than the written complaint.

There are valid reasons for motions for summary judgement (dismissal). It is designed to make sure that frivolous claims do not overwhelm the court system and to ensure that the court’s limited resources and time are spent on legitimate claims.

Additionally, defending a lawsuit can be time consuming and extremely costly for a defendant. A defendant should not have to spend thousands (or in this case probably hundreds of thousands) on legal fees and lost pro-

ductivity to defend a frivolous claim.

The motion for summary judgement acts as a gatekeeper to the legal system.

In this case, the National Association of African-American Owned Media and Entertainment Studios Networks, Inc. (the “Plaintiffs”) filed suit against Comcast, Time-Warner Cable, the former FCC Commissioner, the NAACP, the National Urban League, the National Action Network, and Reverend Al Sharpton alleging that Comcast and the others conspired together to deny it a contract to carry its network/television shows because it is a 100% blackowned company. (Editor’s note: NAN, NUL, and NAACP each are no longer party to the lawsuit).

However, the Court dismissed the suits against everyone except Comcast and Time-Warner for lack of personal jurisdiction, and the plaintiffs abandoned its argument of conspiracy.

At issue now, and before the United States Supreme Court, is whether Comcast, in refusing to contract with the Plaintiff, is in violation of 42 USC 1981. More specifically, whether a plaintiff who alleges discrimination in violation of 42 USC 1981 must allege that racial discrimination was the but for cause of the refusal to contract: “But for the plaintiff’s race, Comcast would have contracted with the plaintiff,” or whether the plaintiff may allege that race was a motivating factor in Comcast’s refusal to contract.

Even though there may have been other reasons that Comcast did not contract with Plaintiffs, the fact that it is a black company was a motivating factor.

Comcast argues that it did not extend a contract to Plaintiff’s as a result of legitimate business practices, e.g.: that it did not have the bandwidth necessary, that it had a preference for sports and news programming, and that there was a lack of demand for

Plaintiff’s programming. As a result, Comcast argues that Plaintiffs have failed to show that Comcast would have contracted with them but for Plaintiff’s race.

Comcast points out that it had, within the same time period, considered contracting with ESN; that it had in fact contracted with “Aspire” led

by Earvin “Magic” Johnson and Revolt TV led by Sean “Diddy” Combs, which it claims has majority or substantial African-American ownership. Additionally, Comcast alleges that it has carried two 100% blackowned networks, African Channel and Black Family Channel.

Lastly, Comcast argues that Plaintiff’s case should be dismissed because Plaintiff has failed to show that it was similarly situated to the white-owned channels that it did contract with. The reasoning there is that apples must be compared to apples.

For instance, if there is a white-owned channel with tremendous interest that is within Comcast’s preferred programming, then the fact that Comcast contracted with that network as opposed to Plaintiff’s — which Comcast alleges does not have interest and is not its preferred programing —is not a result of race discrimination, but instead is Comcast simply choosing the best content for its company.

On the other hand, Plaintiffs allege that it has attempted to contract with Comcast for approximately 8 years and has repeatedly been passed over for white-owned companies despite Comcast’s assurances that its channels were “good enough” and that it was on a “short list.” Additionally, Plaintiff offered its Justice.TV network to Comcast for free and without licensing fees. Comcast declined.

As it relates to the lack of bandwidth that Comcast claims is a reason for its refusal to contract, Plaintiff notes that Comcast carries every channel (more than 500) that its competitors carry, except for Plaintiff’s.

Plaintiff’s channels are current-

ly carried on Verizon, FIOS, AT&T, U-Verse, Direct TV, Sudden Link, RCN, Century Link, and many others. Additionally, despite its refusal to contract with Plaintiff as a result of its alleged bandwidth scarcity, Comcast has launched more than 80 lesser known white-owned channels. Plaintiff alleges that during the 8 years that it attempted to contract with Comcast, Comcast directed it to gain field support within the Comcast corporation, once that support had been gained, Plaintiffs were told that field support was no longer a factor.

Most explicit, is Plaintiff’s claim that a Comcast Executive stated, “We’re not trying to create anymore Bob Johnsons.” Bob Johnson is the founder and former owner of B.E.T. which was sold to Viacom for a reported $3 billion.

Plaintiffs allege that Comcast’s refusal to contract, in addition to being motivated by race alone, is also motivated by its desire not to have its networks (and the white-owned networks that it carries) be required to compete with Plaintiff’s networks, which are black-owned.

The United States Supreme Court’s decision will determine whether a plaintiff who alleges race discrimination pursuant to 42 USC 1981 may have his or her day in court if he or she can show that racial discrimination was a factor, even among others, in a defendant’s refusal to do business. If so, the plaintiff will be able to move forward through the legal process — and most importantly, through the discovery process — to investigate his or her claim and obtain the evidence necessary (if it exists) to put the question before a jury.

This case, like so many other recent cases, will test the Supreme Court’s interpretation of the strength of civil rights law.

Lauder and raised more than $3 million to support the Studio Museum’s mission, vision, and future.

Co-chaired by Studio Museum Trustees Jacqueline L. Bradley, Kathryn C. Chenault, Carol Sutton Lewis, and Dr. Amelia Ogunlesi, and supported by Founder’s Circle CoChairs Ann Tenenbaum and Holly Peterson, the event at the Javits Center included remarks by Thelma Golden, Director and Chief Curator, and Raymond J. formal program included the presentation of the fourteenth annual Joyce Alexander Wein Artist Prize to the New York-based artist Torkwase Dyson. Extending the Studio Museum’s mission of supporting experimentation and excellence in contemporary art, the Wein Artist Prize bears an unrestricted monetary award of $50,000 in recognition of an African-American artist who demonstrates great innovation, promise, and creativity. Born in Chicago (1973) and educated at Tougaloo College, Virginia Commonwealth University, and Yale University, Torkwase Dyson’s work was shown at the Studio Museum in the 2015 exhibition A Constellation.

She is best known as an abstract painter whose poetic, improvisational juxtapositions of dense brush marks and diagrammatic lines grapple

with the ways in which space is perceived and negotiated, historically and in the present moment, particularly by black and brown bodies. Among the notable guests were Darren Walker, President of the Ford Foundation; Agnes Gund, philanthropist and art collector; former Director of the Studio Museum, Dr. Mary Schmidt Campbell; Sarah Arison, philanthropist; and artists Derrick Adams, Teresita Fernández, Maren Hassinger, Glenn Ligon, Julie Mehretu, Jacolby Satterwhite, Mickalene Thomas, and Lynette Yiadom-Boakye.

Health Professions Diversity Award Goes to TouroCOM

ouro College of Osteopathic Medicine New York (TouroCOM) has received the 2019 Health Professions Higher Education Excellence in Diversity (HEED) Award from INSIGHT Into Diversity magazine, the oldest and largest diversity-focused publication in higher education.

As a recipient of the Health Professions HEED Award — a national honor recognizing U.S. medical, dental, pharmacy, osteopathic, nursing, and allied health schools that demonstrate an outstanding commitment to diversity and inclusion — TouroCOM will be featured in the December 2019 issue of INSIGHT Into Diversity magazine. Brain Fitness Strategies

S

cientific studies have changed the way the Brain is viewed and how it functions. There is no longer a belief that we were born with all the brain cells that we will ever have. We also now know that the Brain never really loses the ability to expand. In my latest book “The Art of W.A.R. Strategies for Self-Empowerment” I have three dialogs about this new concept.

The dialog on page

50 titled “You Can Teach Old Dogs New Tricks” is focused on studies conducted by Dr. Norman Doidge and published in his wonderful publication “The Brain That Changes Itself”. On Page 21 there is a dialog titled “ “Memory Maintenance” I provide information on ancient herbs that have been used to improve memory for centuries, and on page 19 there is a dialog titled “Whole Bring Thinking”, here I provide information on how to use both your right and left brain to visualize and manifest your dreams into reality.

Neuroplastic research has shown that the Brain can grow new nerve endings to reconnect neurons

or brain cells whose links were damaged or destroyed. This means that your ability to remember and learn can in many cases improve as you age.

After we turn 40, we lose 5% of our brain cells, this will usually accelerate after the age of 70. The average person has billions of brain cells and these cells can be redeveloped if destroyed, but age-related memory loss is still common among many. As the saying goes if you don’t use it you lose it.

Researchers have identified a molecule -brain-derived neurotrophic factor (BDNF) that’s largely responsible for the brain’s ability to form new neurons and connec-

tions between neutrons.

Studies show that exercise will dramatically increase the levels of BDNF. The BDNF molecule is considered a major factor in explaining why people who exercise are less prone to have memory loss or suffer from depression and have a lower risk of developing Alzheimer’s disease.

Physical activity, mental workouts that increase levels of BDNF in the Brain do not always have to be strenuous workouts.

Yoga, Tai Chi, Ki Training and other moving energy exercises have been used by older adults to improve memory and increase neutron connections. We practice a few brain fitness exercises during our

Wednesday Ki Training and meditation class at the Harlem Ki Energy Center.

Research has shown that meditation can be a more effective way to prevent brain shrinkage then many aerobic exercises.

There is a book published

by Bottom Line Books titled “Super Brain-Boosting Secrets” that has over 400 pages of scientifically proven studies like the above strategies which can reverse memory loss and improve the functions of the brain no matter your age.

One interesting study in the book shows how making a tight fist with your right hand can activate the left side of the brain to store memories and making a tight fist with your left hand can activate the right side of the brain to help recalled memories.

OW TO USE/ P R E PA R E HERBS Different parts of an herb are used in different ways.

The soft, delicate parts (yin) - which include the leaves, buds and flowers, are never boiled because the therapeutic properties will be boiled away. They should be added to the boiling water (in a cup or pot), covered, and allowed to steep for twenty minutes.

The harder, woody parts (yang) include the roots, bark, stems and root barks, need to be boiled in order to release the therapeutic properties from the tough, woody cellulous.

They should be boiled,

covered, for about thirty minutes, then allowed to steep, covered, for another twenty minutes.

Sometimes the “whole herb” is used, referring to every part that is “above ground.” When the whole herb is used, it is usually before flowering.

When the “root bark” is used, it is referring to those roots which have their own bark; you’d just use the bark of that root.

When a formula calls for the leaf of an herb, and the store is out of it and offers you the root, for example, do not accept that substitute – because different parts of the same herb do not have the same therapeutic properties. The

root, flowers, leaves of the same herb each contain different chemical constituents, which give the varying parts different medicinal values.

Y

ou saw that coming.

It was easy to anticipate because the signs were there. It was plain as day, couldn’t have been easier to see if it was flashing neon. You knew what was going to happen next – or, you would’ve, if you were paying attention.

Take, for instance, author Robyn Crawford. In her new book “A Song for You,” she tells of spotting a star.

When Coach Clark called, you responded.

That’s why Robyn Crawford rose early that morning in 1980: her basketball coach needed help registering counselors for summer programs. Craw-

ford was nineteen and thinking about college, but seventeen-year-old Whitney Houston was one of the people waiting to register and Crawford was smitten.

In the following days, as the two got to know one another, they became “inseparable.” Crawford liked “having fun with a new friend” but, she says, “something more was growing between us.”

Before the summer was over, they were lovers.

It was “a typical teenage relationship, with… the exception of cocaine,” although they never named their love. Houston introduced Crawford to her world of music; Crawford attended church with

Houston and Houston caught Crawford’s basketball games. Sometimes, they had to sneak around to be together and they talked on the phone every night when Crawford was at college. Soon after, Houston’s modeling career rose and she was on her way to being a star in the music industry.

On the day she signed her first recording contract, Houston told Crawford that she thought they “shouldn’t be physical anymore.”

The end of the love affair, however, didn’t signal the end of their bond, and Crawford gave her life over to Houston. She served as Houston’s assistant, chauffeur, manager,

record-keeper, and sounding board. She propped Houston up when Houston needed it, sometimes literally, watching and helpless, unable to save Houston from her addictions. And then came the day, says Crawford, when “I realized that I needed to save myself.”

Be honest: you are only the smallest bit surprised at all this. Whitney Houston’s cocaine problem was pretty common knowledge and it’s not a stretch to imagine the rest of what’s inside this book. Even so, author Robyn Crawford has a few secrets to tell you.

That, however, doesn’t seem to be the reason behind “A Song for You.”

way to describe this memoir; indeed, while it’s about Crawford’s decades-long relationship with Houston, it often appears that Crawford is secondary in her own story here. That comes across as selflessly joyful but it also seems, at least initially, to be fraught with fear, as if Crawford recognizes something that’s incredibly fragile. As this book progresses, that fear runs alongside a shrieking siren that announces the inevitable, the approach of which, even now, is impossible to stop watching.

For fans still looking for scandal, know that it’s there and you’ll be happy with “A Song for You.” If you’re not necessarily looking for gossip, though, try it anyhow. You can still anticipate a good read.
