City Council approves $196M FY19 operating budget

T

he City Council passed Mayor Carlo DeMaria’s FY19 budget Monday night with only minor cuts, despite a few efforts to make deeper cuts.

After two weeks of budget hearings, the council’s budget committee recommended out to the full council a $196,427,922 FY19 operating budget, which included $60,171 in cuts from the mayor’s salaries line item, $100,000 from his marketing and business development line item,

$15,000 from his afterschool program line item, $10,000 from the planning and development intern account, and $100,000 fixed costs. On Monday, the council cut an additional $25,000 from the mayor’s celebrations account, leaving the final operating budget at $196,402,922.

The council approved the revised budget, 8-2, with Ward 1 Councillor Fred Capone and Ward 2 Councillor Stephen Simonelli voting against it.

Major impacts This yearâ&#x20AC;&#x2122;s budget is expected to raise taxes by a staggering 11 percent, even after the council voted to use the final $12.5 million pre-opening payment from Encore Boston Harbor to reduce the tax rate.

When asked to estimate the financial impact of not applying the Encore Boston Harbor money to the tax rate, Everett CFO/City Auditor Eric Demas guessed that under such a circumstance the rate would have gone up as much as 25 percent.

City officials have stated repeatedly that FY19 is a difficult financial year for the city for a number of reasons: rapidly raising home values yet unmatched by the growth in commercial values, the financial blows the School Department has received due to changes in the state aid formula, and the preparations being made for Encore Boston Harborâ&#x20AC;&#x2122;s June 2019 opening. â&#x20AC;&#x153;Some of the largest increases the city has seen over the last few years have been in public safety, all in getting prepared for opening day [of the casino],â&#x20AC;? said Demas. â&#x20AC;&#x153;You canâ&#x20AC;&#x2122;t hire 30 officers the day it opens, so thereâ&#x20AC;&#x2122;s been a natural progression as we spend this money so that the city is fully prepared day one, when the operation opens.â&#x20AC;?

Councillor Capone stated that he was disappointed that the Encore payments were not having a more significant impact on the tax rate. â&#x20AC;&#x153;[Eleven percent] is a horrifying number. If we donâ&#x20AC;&#x2122;t approve the $12.5, itâ&#x20AC;&#x2122;s game over. When we were talking money coming in the casino, I was hopeful that instead of being a little bit of a boon, it was going to be a huge boon. Nothing has been done wrong; it has

been utilized by the administration as a funding source. I was hopeful that instead of being used as a funding source, we would look at the budget, have it stand on its own, get the tax rate and then take that $12.5 million and make a larger benefit to the taxpayers.

That was my hope.â&#x20AC;?

Mayor Carlo DeMaria reminded Capone that after opening day, Encore will be making $30 million payments to the city annually, a windfall that will have a major impact on the cityâ&#x20AC;&#x2122;s finances. He also argued that the cityâ&#x20AC;&#x2122;s use of the $12.5 million allowed them to meet a number of financial challenges. â&#x20AC;&#x153;The $12.5 million is also filling gaps â&#x20AC;&#x201C; like we lost the direct certification for our schoolchildren, thatâ&#x20AC;&#x2122;s $6.5 million weâ&#x20AC;&#x2122;re giving the schools above net school spending,â&#x20AC;? said DeMaria. â&#x20AC;&#x153;If we have a problem with $12.5 million â&#x20AC;Ś we wouldnâ&#x20AC;&#x2122;t be hiring the police and fire that have been requested by this council; we wouldnâ&#x20AC;&#x2122;t be submitting $6.5 million to the schools. Those are the things we have the luxury of doing because we have the additional funds. â&#x20AC;Ś Itâ&#x20AC;&#x2122;s a huge boon.â&#x20AC;?

Mayor DeMaria vigorously opposed the cut, praising Dr. Easy as a major asset to the city. â&#x20AC;&#x153;The man who operates in this position has a PhD from Penn State University,â&#x20AC;? said DeMaria. â&#x20AC;&#x153;He gives so much back, not only to this department, but to the kids in this city. We go through this city â&#x20AC;&#x201C; every single kid in this city knows who Dr. Omar Easy is. â&#x20AC;Ś Heâ&#x20AC;&#x2122;s driven my department heads to make sure that they do their jobs on a timely basis. He makes no friends.

He drives the agenda in staff meetings. He serves as the chair on School task force. â&#x20AC;Ś Heâ&#x20AC;&#x2122;s the first one in the door in the morning, doing his job.

He has a great relationship with the residents of the city.

Sen. DiDomenico’s landmark bill to protect workers’ pay passes the Senate

O

n June 21 the Massachusetts Senate unanimously voted to pass legislation by Senator Sal DiDomenico (D-Everett), the Assistant Majority Leader of the Massachusetts Senate, in partnership with Senators Jason Lewis and Karen Spilka, to help prevent the illegal practice of wage theft and promote employer accountability. The bill, S.2327, gives the state greater power to go after wage violators and provides additional tools for the Attorney General’s Office to hold violators fully accountable. This is landmark legislation for workers’ rights, and it is one of the strongest wage theft bills in the country.

Ward 5 Councillor Rosa DiFlorio suggested that any cuts as minor as the one suggested by Capone would not have an appreciable impact on the cityâ&#x20AC;&#x2122;s taxes. â&#x20AC;&#x153;I donâ&#x20AC;&#x2122;t want to be nickle and diming â&#x20AC;&#x201C; making the taxpayers think theyâ&#x20AC;&#x2122;re going to be saving money when theyâ&#x20AC;&#x2122;re not going to be sav-

ing anything,â&#x20AC;? said DiFlorio. â&#x20AC;&#x153;If this body is not going to find $11 million, Iâ&#x20AC;&#x2122;m not going to sit here until three oâ&#x20AC;&#x2122;clock in the morning so the people can save three cents. â&#x20AC;Ś I donâ&#x20AC;&#x2122;t know how youâ&#x20AC;&#x2122;re going to cut $11 million without laying off half the city.â&#x20AC;?

DeMaria echoed DiFlorioâ&#x20AC;&#x2122;s comments, stating that a cut of a few hundred dollars â&#x20AC;&#x153;makes no differenceâ&#x20AC;? on the tax rate. â&#x20AC;&#x153;You want to make a big difference in the budget? Cut $10 million from the budget. That makes a serious difference. Cut a million dollars, youâ&#x20AC;&#x2122;ll save taxpayers 25 cents on their tax rate. You might save them $40,

$50 for the year. I cut from my department heads $2.5 million already. I gave them no raises.

Gave them nothing they wanted. I have one, Jim Soper, whoâ&#x20AC;&#x2122;s going to apply for the job in Somerville because theyâ&#x20AC;&#x2122;re paying $130,000 and heâ&#x20AC;&#x2122;s gonna get the job. So what do I do then? Capone pushed back against this argument, stating that â&#x20AC;&#x153;one of most important functions we have as a legislative body is to watch the funds, so if weâ&#x20AC;&#x2122;re here until four in the morning, so be it.â&#x20AC;? â&#x20AC;&#x153;We talk about a lot of things

up here; we talk about taking care of the taxpayer; we talk about spending wisely, but then when we bring up a cut, everyone starts screaming bloody murder,â&#x20AC;? said Capone.

Caponeâ&#x20AC;&#x2122;s initial attempt to cut the department line-byline failed in a 5-5 vote, with Councillor Capone, Ward 6 Councillor Michael McLaughlin, Council President Peter Napolitano, Councillor-at-Large Wayne Matewsky, and Councillor-at-Large Michael Marchese voting to cut, and Councillor DiFlorio, Councillor-at-Large John Hanlon, Councillor-at-Large Richard Dell Isola, Ward 4 Councillor John Leo McKinnon and

Councillor Simonelli voting against cutting. Believing any subsequent attempts to cut the remaining line items would be futile, Capone relented.

Caponeâ&#x20AC;&#x2122;s was not the only unsuccessful attempt to cut.

Councillor Marchese proposed a major $3.5 million cut from the schoolâ&#x20AC;&#x2122;s budget to shut down the preschool program.

Marchese argued that the program was drawing children into the school system and straining the cityâ&#x20AC;&#x2122;s resources, and suggested that the preschool program be rebuilt with a lottery system for future school years. His motion did not receive a second.

n Wednesday, June 20, Everettâ&#x20AC;&#x2122;s Department of Public Works began installing â&#x20AC;&#x153;level boardingâ&#x20AC;? on Broadway; the Chelsea Street and School Street bus stops on Broadway are being revamped. Starting this summer, the HYPERLINK "https://www.facebook. com/cityofeverettma/?fref=mentions" City of Everett and the Massachusetts Bay Transportation Authority (MBTA) are collaborating to test level boarding at these two bus stops in Everett Square. Station platforms are being installed at the same level as bus doors to empower all bus riders on Routes 97, 104, 109, 110 and 112 to board and exit without delay â&#x20AC;&#x201C; just like on a subway.

Mayor Carlo DeMaria stated, â&#x20AC;&#x153;Taking the bus should be easy and fast for everyone. The design of traditional bus stations and stops isnâ&#x20AC;&#x2122;t inclusive to riders who have mobility challenges or who travel with baby

Help available for those suffering from substance abuse

T

his June and the start to summer have been less than spectacular for the city and the Fire Department. On June 13, the City of Everett posted a message on its Facebook page urging residents to be aware of the recent upsurge in drug overdoses. The post urged residents and addicts to reach out for help and be aware of the recent increase.

June has been a hotbed when it comes to overdoses for the city. So far this June, there have been 13 overdoses that have been reported. But the good news being, there were zero fatal overdoses. The Fire Department classifies a fatal overdose as a DOA, or dead on arrival.

So far 2018 has had 80 overdoses and only eight fatal overdoses. January and March led with 15 overdoses each month and are followed by April and June with 13. June, however, faced a tough first two weeks.

Within those first two weeks, June had 10 overdoses, and then only three after the city put out the Facebook post. Finally, February and May end with 12. February, being one of the lower overdose months,

had the highest amount of fatal overdoses at four.

Even though these numbers seem high, they are lower than last year’s. Last year at this time, there were 86 overdoses and nine fatal. Last year, June also recorded the highest number of overdoses for the year at 22. It was then followed by May and August at 19. Despite the high numbers for June last year, there were zero fatal overdoses.

Tori Cyrus, the Social Welfare Officer for the Fire Department, has done a lot to help people struggling with addiction. When asked why they’ve seen a recent upsurge in overdoses, Tori Cyrus answered, “You get bad batches, but they are happening in a short time span, and people don’t understand the potency of the drug they are using, and people are using different drugs and not knowing what’s inside of them,” she said. “The state released a huge warning on cocaine because people are dying, but their results are coming back as fentanyl,” she continued.

Fentanyl is a deadly synthetic opioid that has a very high level of potency. “Fentanyl is being cut into everything and

people don’t know that,” Cyrus added.

Cyrus along with Dennis Doris and Paul Guarino started the Roadmap to Recovery program. The program is offered on the fourth Thursday of everything month, and it allows people to come in and get the

Sen. DiDomenico co-sponsors bill banning toxic flame retardants Legislation unanimously passes State Senate

n June 21, Senator Sal DiDomenico (D-Everett), the Assistant Majority Leader of the Massachusetts Senate, and his colleagues in the Senate unanimously passed legislation to ban certain toxic chemical flame retardants from children’s products, in-

cluding toys and nap mats, upholstered furniture, window dressings, carpeting and bedding that has been made or sold in the state. Senator DiDomenico is a cosponsor of this critical bill and has been a longtime supporter of its passage.

“For years, flame retardants have provided us with a false sense of security, all while posing a serious health threat to the people of the Commonwealth, especially our children and firefighters. By reducing the amount of dangerous toxic

chemicals in our homes, this bill will go a long way towards improving public health and protecting our first responders,” said Senator DiDomenico.

The bill seeks to establish an initial list of 11 chemical flame retardants that would be

banned. The list is based on scientific research which shows that exposure may lead to an increased risk of cancer, neurological issues, fertility problems and other health concerns. In addition, the bill seeks to require that manufacturers notify retailers about those products which contain the chemicals before the ban goes into effect.

Foam products, including toys, are the most likely item to be treated with flame retardant chemicals. Over time, the chemicals are diffused throughout the home as dust, which can be inhaled or absorbed by children, pets and other family members. The Professional Fire Fighters of Massachusetts support this legislation, and have raised special concern about the heightened health risks that result from chemical flame retardants when they are exposed to high heat and combustion.

Chemical compounds used as flame retardants can change as chemists develop new formulas. The Senate bill calls for the Massachusetts Department of Environmental Protection (MassDEP) to update the list of prohibited chemicals every three years. MassDEP would do so in consultation with the state’s Toxics Use Reduction Institute and the Science Advisory Board, and would identify newly developed chemicals and promulgate new rules within nine months of identification. The full prohibited chemical list would be updated every three years.

Senator DiDomenico previously voted to pass this legislation in 2016. This is the second time the Senate has considered and passed the bill. On June 25, the House of Representatives referred the bill to its Committee on Ways and Means.

he Everett City Council has proudly announced that it is bring back a long-standing tradition for Everett’s youngsters at the Independence Day Celebration at Glendale Park. The children’s races and decorating contest will resume this July 7, the day of Everett’s Independence Day Celebration. The boys & girls races will start at 9:30

a.m. and will be in the following age groups: 3-4, 5-6, 7-8, 9-10 and 11-12. The races will be followed by a watermelon-eating contest. Illegal housing targeted

by Everett Task Force T

he Code Enforcement Task Force has recently established a unit dedicated to investigating illegal apartments.

The unit consists of Lieutenant Christopher Jewell of the Everett Fire Department, Building Inspector Martin Furtado and Code Enforcement Inspectors Peter Sikora and Michael Mastrocola. Each member brings a specific expertise to the team, and the results are a testament to their hard work.

Illegal apartments generally consist of basement or attic units that are unsafe and pose a danger to the inhabitants, as well as to first responders. Other illegal units consist of houses subdivided into smaller apartments by illegally partitioning off and creating rooms without proper permitting, leading to dangerous and hazardous conditions. For instance, an owner may take an existing living room and partition it, so that it be-

comes two or more bedrooms.

These units will oftentimes have dangerous makeshift kitchens and keyed locks on the doors.

These illegal units can result in fire hazards related to issues from improper wiring to inadequate means of egress. Oftentimes these conditions remain dangerous. Many of these homes are owned by an absentee landlord, who does little to keep safe conditions.

Such a house that could comfortably fit five people now might have a dozen or more occupants. Issues resulting from illegal housing can be overcrowded schools, increased sanitation cost, streets with too many vehicles to accommodate neighborhood parking, and traffic increases affecting the quality of life for all residents.

The evidence of an illegal apartment can be in the form of a tip form a resident or a tenant complaint. There are other indi-

cators as well: A property might have several mailboxes or several different names on the door; there might be an air-conditioner in a window that indicates occupancy of a space not fit for occupation.

The Code Enforcement Task Force goes out in the evening to follow-up on information regarding illegal units, and to inspect the properties. A large majority of the inspections result from consent of a tenant or owner. In a rare case, an administrative warrant is sought at Malden District Court for entry on the affidavit of Lieutenant Jewell.

Mayor Carlo DeMaria stated, '”We want people to understand that this is a health and safety issue. One of our main concerns is that most of these units don’t provide for proper means of egress in the event of a fire, turning the unit into a firetrap, putting both residents and first responders at risk.”

Cambridge Church of 7th-Day Adventists in Everett receives $500 Community Spirit Grant from Harvard Pilgrim Health Care Employee-directed program has awarded $5.7 million to New England nonprofits since 2002

ellesley, Mass. – Harvard Pilgrim Health Care Foundation has announced that the Cambridge Church of Seventh-Day Adventists in Everett was awarded $500 from the Foundation’s Community Spirit 9/11 Mini-Grant program. Maria Shakes, an employee of Harvard Pilgrim Health Care, nominated the organization for the award. Funds will be used to purchase food and necessary items for people experiencing homelessness.

To commemorate those Harvard Pilgrim members who lost their lives on September 11, 2001, Harvard Pilgrim and the Foundation created the Community Spirit 9/11 Mini-Grant program. This program allows each Harvard Pilgrim employee to award a $500 grant, completely funded by the Foundation, to the local charity of his or her choice each calendar year. Since this community grants program began in 2002, Harvard Pilgrim employees have directed more than $5.7 million to thousands of organizations throughout Connecticut, Maine, Massachusetts and New Hampshire.

“We are so fortunate to have generous and dedicated employees who enrich our company and the communities in which we all live and work,” said Harvard Pilgrim Foundation President Karen

City holds spectacular grand re-opening of Swan Street Park O

n Saturday, June 16, Mayor Carlo DeMaria and the City of Everett held an impressive grand re-opening of Swan Street Park with over 500 residents in attendance. This project began in the spring of 2017 and is now a state-of-art facility that will make every resident proud.

“Together we are making our City a better place to live, work and play,”stated Mayor DeMaria.

“By building a strong community foundation, we will know not only what Everett was, but also everything it can be.”

The renovation project included the playground, splash pad, picnic tables, playing turf and independent pedestrian lighting that illuminates areas of the park, such as the perimeter walkways. The tot lot has also been completely overhauled. It has been made larger, with all new play equipment, and it is also Americans with Disabilities Act (ADA) compliant. The most dramatic improvement is the overall beautification of the park. Formalized entrance areas, ornamental fencing, decorative lampposts, drinking foun-

tains and standardized benches and trash receptacles highlight the significant improvements in landscaping, such as retaining walls, flowerbeds and planters.

Representative Joe McGonagle addressed attendees at the ribbon-cutting and expressed the importance of renovation and development within Everett, especially in community areas, such as parks and playgrounds.

Swan Street Park is one of many parks and tot lots around the city that has or will receive updates and renovations. Mayor DeMaria has continuously highlighted that keeping the community’s recreational areas and green spaces current and well maintained is an essential aspect of retaining value in Everett.

Brenda Dalrymple stated, “We had a great time. The park came out amazing, and its great seeing so many kids using it.”

The grand re-opening included face painters, balloon twisters, PAW Patrol characters, a giant inflatable obstacle course and demonstrations from the Everett Health and Wellness Center on fun games that can be played at all parks. Additionally, there were plenty of treats and healthy snacks courtesy of New England Banana Company and the Everett City Council.

The Everett Fire, Police, and Library Departments, YMCA and Boy and Girl Scout organizations were in attendance.

ttorney General Maura Healey joined Whittier middle school students and teachers Wednesday for a roundtable discussion highlighting the use of Project Here, a public-private collaboration led by the AG’s Office and the GE Foundation that is tackling a significant unmet need in the state’s battle against the ongoing opioid crisis. Healey’s visit followed a lawsuit the AG filed against the opioid manufacturer Purdue Pharma Inc., its executives and board members for misleading prescribers and consumers about the addiction risks of their opioids.

It’s really outrageous and arrogant when you think about Stephen Stat Smith running for State Rep after pleading guilty in federal court to tampering with absentee ballots and then ending up with a jail sentence and being banned to run for political office for five years. The absentee ballot thieff must think that voters are dummies. For some candidates “dirty tactics” are usually part of the political landscape, and Smith is a good example with his scurrilous “dirty tactic” of tampering with absentee ballots to get elected.

Smith should give the money he was paid back to the state.

Thousands of dollars were paid to Smith after being elected as a Rep by voter fraud by tampering with absentee ballots. As part of the plea bargain Smith had to resign from the Rep’s seat he stole with illegitimate absentee ballots.

According to a “Massachusetts Politics” blog, “At the time of Smith’s “guilty plea,” here’s what Lanny Breuer, then an assistant attorney general of the Commonwealth said: ‘Representative Smith compromised the legitimacy y of his races for public office by facilitating the casting of invalid ballots for ineligible and unaware voters. In doing so, [Smith] undermined the democratic process in Massachusetts and violated the public’s trust.’

“Carmen Ortiz, then the U.S. Attorney for the District of Massachusetts, said: ‘Fair and free elections are the foundation that this great nation was built upon. Our electoral system is unrivaled, and it is egregious that an elected member of our Commonwealth [Smith] would rob his constituents of a fair and honest election.’

“Richard DesLauriers, then the special agent in charge of the FBI’s Boston Division, said: ‘Over the last two years, the FBI methodically uncovered a voter fraud scheme designed to strip Massachusetts voters of their right to a fair election. Representative Smith, who was a member of the legislature’s Joint Committee on Election Laws, embarked on a scheme that he knew violated the ideals of our nation and disregarded the proud history of the Commonwealth.

Whenever the pillars of government administration – equity, efficiency, and effectiveness – are undermined by corrupt public officials, the FBI will focus on those responsible.’”

For a guy who altered absentee ballots to get elected in two Rep races, he should hide his head in shame instead of pounding on his chest like he’s someone special. Stay tuned, folks. There’s more to come. Had enough to digest? In the fall the voters should show Smith that they’ve had enough of the absentee ballot thief, too.

Candidate Gerly Adrien Gerly wants the Rep’s seat even though she never held public office. In other words, Gerly wants to start at the top.

In my opinion, that’s not the way to go. Stepping-up to the Rep’s seat after serving on the Council is usually thought of as a promotion. Just as Joe McGonagle has done in the past years in local politics, you have to pay your dues. It has to be earned by letting voters see you in the local arena and what you have to say, before you ask for a promotion to a higher office.

Paul passed away unexpectedly Wednesday afternoon, June 20, 2018. He was 75 years of age.

Born in East Boston, he is the son of the late Guido and Anna (Vassallo) Schiappa. Paul grew up in South Hadley and attended public school there. He graduated from South Hadley High School with the Class of 1961. Just after high school, Paul enlisted in the US Navy on August 29, 1961. SR Schiappa was stationed on the USS Lorain County (LSTâ&#x20AC;&#x201C;1177).

He was honorably discharged on August 27, 1965. Paul was very proud of the military and he took great pride in being a part of defending his country during the Vietnam era. Years after completing his time in the Navy, Paul became a self employed tile setter.

He owned and operated Schiappa Tile Company for 33 years before retiring in 2007. Paul settled in Everett with his wife Sandra M. â&#x20AC;&#x153;Sandyâ&#x20AC;? (Cregan). The couple shared 44 years of marriage. Paul is a late member of the US LST Association #1177 and a late member of the Loyal Order of Moose, Malden Lodge #1910. Neighbors on Clark St. will always remember Paul sitting on his front porch with a warm smile and friendly wave, ready to say hello and share a story with anyone nearby. He will be greatly missed by all who loved him.

Charlie Baker a bill that would hike the minimum wage from $11 to $15 over five years; increase the wage for tipped workers from $3.75 to $6.75 over five years; phase out over five years extra pay for employees who work on Sundays and holidays; institute a permanent sales tax holiday on a weekend every August; and establish a $1 billion family and medical leave program funded by a payroll tax paid for by both employers and employees.

Dubbed the â&#x20AC;&#x153;Grand Bargain Billâ&#x20AC;? by its supporters, the compromise bill is in response to the likely successful effort by the Raise Up Massachusetts coalition to get the minimum wage and paid leave questions on the November ballot; and the likely success of the Retailers Association of Massachusetts (RAM) to get a question on the ballot to reduce the sales tax from 6.25 percent to 5 percent.

Raise Up Massachusetts has agreed not to bring its family and medical question to the ballot while RAM has agreed to drop its effort to reduce the sales tax to 5 percent. The fate of the minimum wage ballot question is undetermined. The version passed by the Legislature differs from the ballot question version in several ways. The legislative version gives the raise to $15 over five years rather than the four years on the ballot version; does not include tying the minimum wage to inflation; and includes phasing out extra pay for employees who work on Sundays and holidays.

RAM President Jon Hurst had mixed feelings about the compromise but ultimately embraced it. "The compromise legislation passed today contains very costly initiatives that will negatively impact the thousands of small business owners and their employees that RAM represents,â&#x20AC;? said Hurst. â&#x20AC;&#x153;The retail marketplace has never been more competitive, and the margins have never been smaller. The new payroll mandates passed today will significantly increase costs, resulting in businesses being less competitive, forcing some doors to close and good jobs to be lost. This is not rhetoric, but reality. At the same time, the results would be far worse had these measures gone to the ballot, and the Legislature deserves credit for bringing the parties together to bring a balanced resolution."

Meanwhile, critics of the compromise say that RAM was able to extract compromises from Raise Up by using the sales tax cut as a bargaining chip.

The Supreme Judicial Court had just ruled that a proposed ballot question imposing an additional 4 percent income tax on taxpayersâ&#x20AC;&#x2122; earnings of more than $1 million cannot go on the November 2018 ballot. Supporters of that measure saw millions of tax dollars lost as a result of the decision and said that reducing the sales tax would cause a fiscal crisis and require cutbacks of many programs.

â&#x20AC;&#x153;This bill empowers workers, recognizes the needs of business owners, and ensures that Massachusetts residents will no longer have to choose between caring for a sick relative or losing their job,â&#x20AC;? said Rep. Paul Brodeur (D-Melrose). â&#x20AC;&#x153;It is the result of months of negotiations and demonstrates that regardless of what happens in Washington, here in Massachusetts we focus on cooperation and compromise.â&#x20AC;? â&#x20AC;&#x153;I fundamentally disagree with the premise that we have to give up some workersâ&#x20AC;&#x2122; rights in order to gain new workersâ&#x20AC;&#x2122; rights,â&#x20AC;? said Sen. Kathleen O'Connor-Ives (D-Newburyport). â&#x20AC;&#x153;This bill ends time and a half on Sundays in order to start paid family and medical leave and phase-in a $15 minimum wage. This was a strategic decision in order to prevent these issues and the sales tax roll-back from going on the ballot. I would rather see the ballot question process play out and then respond as a Legislature and raise lost revenues by ending wasteful corporate tax credits if the sales tax was rolled-back to 5 percent.â&#x20AC;? â&#x20AC;&#x153;This deal represents a series of compromises made in the best interest of the commonwealth," said Rep. Joseph Wagner (D-Chicopee). "By reaching a thoughtful balance, this package will protect Massachusetts workers while promoting a competitive environment for our local businesses." â&#x20AC;&#x153;Myâ&#x20AC;&#x2DC;noâ&#x20AC;&#x2122;vote is for a better minimum wageâ&#x20AC;?said Sen. Marc Pacheco (D-Taunton). â&#x20AC;&#x153;My â&#x20AC;&#x2DC;noâ&#x20AC;&#x2122; vote is for hardworking Massachusetts citizens, many of whom depend on the guarantee of a fair wage for working Saturdays and Sundays. ALLOW AMENDMENTS REDUCING THE MEALS TAX AND SALES TAX (H 4640) House 116-34 and 115-35, upheld the ruling of Acting Speaker Paul Donato that amendments reducing the meals tax and sales tax from 6.25 percent to 5 percent are beyond the scope of Grand Bargain Bill and will not be allowed on the House floor for debate and a vote.

Supporters of the ruling said the ruling is correct because both amendments introduce a new subject that is not already part of the bill and bypass the legislative process.

Opponents of the ruling said the bill deals with taxes and the amendments are appropriate because they also deal with taxes. They noted that on the sales tax reduction amendment, the bill specifically creates a sales tax holiday which clearly is directly related to an amendment to reduce the sales tax.

LOWER WAGE FOR YOUNG TEENS (H 4640) House 35-116, rejected an amendment allowing employers to pay workers under 18 years the $11 minimum wage instead of hiking it to $15 over five years.

HEALTH CARE CHANGES (H 4617) House 117-32, approved a complicated 130page bill imposing assessments of $247.5 million on health insurers and $90 million on the largest hospitals. The funds would be used for grants to community hospitals. The measure also hikes fees for doctors, nurses and other medical professionals who pay the state to obtain their state license.

Other provisions create new requirements for transparency in health plan network and benefit design and costs; protect consumers from surprise bills; require disclosures related to out of network billing and facility fees; and establish standards for telemedicine, that allows doctors and patients to communicate remotely rather than at the doctorâ&#x20AC;&#x2122;s office. â&#x20AC;&#x153;Massachusetts continues to lead the way in healthcare and this bill takes significant steps at addressing some of the most pressing concerns in our health care system today â&#x20AC;&#x201C; price variation, unnecessary cost growth, consumer engagement, and greater transparency," said Rep. ELIMINATE CALL FOR CONSTITUTIONAL CONVENTION (S 2555) Senate 23-15, approved a change to a bill that calls upon Congress to propose an amendment to the U.S. Constitution to establish that corporations do not have the same constitutional rights as human beings and that corporationsâ&#x20AC;&#x2122; campaign contributions and expenditures may be regulated.

The bill was filed in response to the Supreme Courtâ&#x20AC;&#x2122;s 2010 decision in Citizens United v. the Federal Election Commission. In that decision, the court ruled that the First Amendment prohibits the government from restricting corporations, unions and individuals from donating unlimited funds to Super Political Action Committees (PACs) that do not donate directly to candidates or political parties.

A two-thirds vote in favor of the amendment in the U.S. Senate and the U.S. House would send the proposal to the 50 states and the amendment would become part of the Constitution if at least three-fourths (38) of the states ratify it.

The bill also provides that if Congress does not propose this constitutional amendment within six months of the passage of this bill, then the Bay State calls for a limited Constitutional Convention for the exclusive purpose of proposing the amendment. Congress is required to call the convention If at least two-thirds (34) of the states ask for it. The state Senateâ&#x20AC;&#x2122;s 23-15 vote would strike the provision.

Supporters of the change said there is no basis in law or precedent to limit the topic of a convention. They argued that a convention could result in a free-for-all in which many constitutional amendments are proposed.

Opponents of the change said they believe the convention can be limited to just one amendment.

They argued that the constitution must be amended, and that Massachusetts should take the bold step of joining the call for a convention if Congress itself will not propose an amendment.

HOW LONG WAS LAST WEEK'S SESSION? Beacon Hill Roll Call tracks the length of time that the House and Senate were in session each week. Many legislators say that legislative sessions are only one aspect of the Legislature's job and that a lot of important work is done outside of the House and Senate chambers. They note that their jobs also involve committee work, research, constituent work and other matters that are important to their districts.

Critics say that the Legislature does not meet regularly or long enough to debate and vote in public view on the thousands of pieces of legislation that have been filed. They note that the infrequency and brief length of sessions are misguided and lead to irresponsible late-night sessions and a mad rush to act on dozens of bills in the days immediately preceding the end of an annual session.

WAGE THEFT (S 2327) Senate 38-0, approved and sent to the House a bill to prevent wage theft by employers who, according to the billâ&#x20AC;&#x2122;s supporters, steal $700 million of wages annually in Massachusetts from about 350,000 workers.

Wage theft includes paying below the minimum wage, neglecting to pay overtime and paying workers in cash to avoid paying taxes. Key provisions of the proposal make companies that contract with a subcontractor that withholds wages liable for those wages and empower the attorney general to issue a stop work order to employers committing wage theft and impose a penalty of up to $25,000. â&#x20AC;&#x153;This bill returns workersâ&#x20AC;&#x2122; hard-earned wages to them when they have been illegally underpaid or had their wages outright stolen by disreputable employers,â&#x20AC;?said Sen. Eric Lesser (D-Longmeadow). â&#x20AC;&#x153;If an employer knew or should have known that workers were being denied their wages, this bill will provide recourse to the employee and penalize the employer.â&#x20AC;? â&#x20AC;&#x153;Wage theft remains a major problem in Massachusetts, especially for the most vulnerable workers, like immigrants and low-income families,â&#x20AC;? said the billâ&#x20AC;&#x2122;s sponsor Sen. Jason Lewis (D-Winchester). â&#x20AC;&#x153;This legislation will help prevent and deter wage theft, ensure a level playing field for all employers, and protect the rights of working families.â&#x20AC;?

Although no one voted against the bill, some say said the bill unfairly punishes unknowing contractors for the illegal actions of their subcontractors. They said it is unfair and anti-business to require companies to police the payroll of their subcontractors.
