ment (TIF) with the Exelon Mystic Generating Station on Alford Street, the city’s larger industrial taxpayer and the largest power plant in the state, for a couple of years. Though city officials have been reluctant to speak publicly on the issue for fear of inadvertently affecting the city’s legal position, the basic dispute is clear: the city thinks that Exelon owes the city more money than it’s been paying after additions at the site increased its value far beyond what was evaluated in the late 90s, when the agreement was negotiated.

In the late 90s, the station’s current owners, Sithe Energies (acquired by Exelon in 2003) undertook a $604 million project to demolish the site and construct a new natural gas plant. In the midst of this project, Sithe negotiated a TIF with the City that promised to create 1,100 construction jobs and 35 permanent full-time jobs, in exchange for a Payment in Lieu of Taxes (PILOT) agreement with the City. Under this agreement, the company paid $1.5 million to the City in 2000, as well as a one-time, $1 million contribution to the refurbishment of the Central Fire Station. The plant was to make a payment to the city of $17.9 million a year during the first decade of the agreement, and $15 mil-

State Senator Sal DiDomenico reflects on busy 2017 Dear Friends, Now that the holidays are over and we are already well into the New Year, I wanted to take this opportunity to share some of the important achievements that my colleagues and I in the Senate accomplished during the previous legislative year.

2017 was a busy and productive year for both me and my colleagues on Beacon Hill.

We began our work in the Senate by traveling across the state for our second annual Commonwealth Conversations tour where we visited with residents, businesses, and interest groups alike to listen directly to their needs and concerns. Throughout the tour, we heard a variety of

ideas from improving health care and fixing our criminal justice system, to improving our transportation system, among others. In response, over the past year, the Senate has worked hard to prioritize the peopleâ&#x20AC;&#x2122;s vision and turn your feedback into reality.

On a personal note, 2017 was particularly special for me. In addition to being reappointed as Vice Chairman of Senate Ways & Means, I was also appointed to serve as Chairman of the Senate Committee on Intergovernmental Affairs, charged with identifying federal funding opportunities for the Commonwealth and fostering a strong partnership between the Legislature and the federal government.

As part of my duties as Chairman of this committee, I led two trips â&#x20AC;&#x201C; one in April and again in November â&#x20AC;&#x201C; to our nationâ&#x20AC;&#x2122;s capital to gather information on the future of the federal budget and to advocate against potential spending cuts and policy changes that would have a negative impact on the Commonwealth.

My Senate colleagues and I returned home from these trips with greater knowledge and

City funds study on linkage fees

A

s rents continue to increase in Everett and the region, the city may introduce a new tool to increase its affordable housing stock: a linkage fee.

Linkage fees are fees imposed on development projects of certain size â&#x20AC;&#x201C; the rate typically based on their square footage â&#x20AC;&#x201C; which are later used to fund the creation of affordable housing.

Along with Inclusionary Zoning, an ordinance passed by the city last year which requires developments of a certain size to create affordable housing themselves, linkage fees are one of the commonest tools used by municipalities to create affordable housing.

The city has considered enacting linkage fees in the past, but never successfully. That changed last year, when State Senator Sal DiDomenico and State Rep. Joseph McGonagle guided a home rule petition through the State House, and Mayor Carlo DeMaria announced his intention to pass a linkage fee ordinance in 2018 during his Inaugural Address earlier this month.

The first step of that legislative process began Monday night, when the city council voted 9-2 to approve $50,000 for a study of the cityâ&#x20AC;&#x2122;s housing market that would ultimately yield a linkage

fee draft ordinance for the councilâ&#x20AC;&#x2122;s consideration, along with recommendations about what kinds of properties to which the fee should apply.

"They're going to look at the entire market in our city and the entire Metro-Boston region to think about what makes sense, what won't prohibit development from happening, what will actually be helpful and help us create more affordable housing," said Catherine Rollins DeNisi, Deputy Chief of Staff and Director of Policy.

The study is expected to take about six months.

Exactly what the ordinance will require and on what kind of properties will depend entirely on the findings of the study and the will of the council.

According to Rollins DeNisi, because the city already has inclusionary zoning ordinance on the books, her â&#x20AC;&#x153;best guessâ&#x20AC;? was that the study would not recommend applying linkage fees to residential developments â&#x20AC;&#x153;because that is already subject to an affordable housing requirement.â&#x20AC;?

One question to be answered is whether the ordinance will only apply to new construction or to major expansions as well, as some cities with linkage fees do, such as Boston.

one way or the other, and we'll be looking to the consultant to be looking at the economic impact."

The council was largely open to the study, though Ward 1 Councillor Fred Capone wanted some clarification on exactly how the mayorâ&#x20AC;&#x2122;s office intended to spend money raised by the fees before voting on the study.

He also wants to know what affordable housing units the city is currently responsible for and what it's spending to maintain them. In order to gather that information, Capone made a motion to postpone the vote until the councilâ&#x20AC;&#x2122;s next meeting in February.

That vote failed in a 5-6 vote, with councillors Capone, John Hanlon, Michael Marchese, Stephen Simonelli, and Peter Napolitano voting for a delay, and councillors Richard Dell Isola, Rosa DiFlorio, Anthony DiPierro, Wayne Matewsky, John Leo McKinnon, and Michael McLaughlin voting against a delay.

A subsequent vote to pass the funds for the study was passed in a 9-2 vote, with councillors Capone and Marchese in the opposition.

Developer Charlie Zammuto donates 100 trees to the City of Everett M

ayor Carlo DeMaria would like to thank Charlie Zammuto for donating 100 trees to the City of Everett. This past summer, the Department of Public Works continued to beautify and prepare the neighborhoods of Everett with the planting of trees that were donated

by Zammuto, who is currently developing a multi-residential building on Main Street at the former Sonny’s Pizza location.

Mayor DeMaria stated, “I would like to thank Mr. Zammuto for his generous dona-

tion to our City. I remain truly humbled by his gesture in helping my administration continue to improve the beauty of our community.”

St. Louis is a certified engineer with over 15 years’ experience. He holds a Bachelor of Science Degree in Civil Engineering with a concentration in Environmental Engineering from Northeastern University. For the past three years, St. Louis served as the City Engineer for Beverly, Mass. During his time in Beverly, he managed and coordinated the progress of multiple Public Services and Capital Improvement Projects.

Mayor DeMaria stated, “Greg is a motivated and responsible professional engineer with over 15 years’ experience. He will be a tremendous asset to our team and our City moving forward.”

St. Louis looks forward to continually striving to provide a higher level of perfor-

Mayor applauds MIAA for holding Inclusion Summit T

his past October, Emily Nash of Lunenburg High School was denied first place at the Central Massachusetts Division 3 Golf Tournament because of her gender and Massachusetts Interscholastic Athletic Association (MIAA) rules. According to MIAA rules, Nash was allowed to compete as part of a team; however, since she was competing in a fall boys’ tournament, she was not allowed to compete as an individual, which made her ineligible to accept first place.

Mayor DeMaria recently expressed concerns on the current rules and standards in high school athletics. He stated, “When incidents of inequality such as this come to light, it is important that our community takes a stand and asserts our shared values of fair and equal treatment. I recognize the problematic actions that inhibited a champion golfer from receiving the award she deserved. As a father of two daughters and Mayor, I am wholeheartedly committed to ensuring equitable opportunities for everyone – regardless of race, gender, sexual orientation or physical abilities.”

He further explained the impor tance of educating our young people on the inequalities within our society.

He emphasized that it is necessary for all, especially as leaders and educators, to develop awareness and knowledge regarding this topic to better serve the entire student population.

MIAA issued a statement on its website concerning Nash and the tournament, noting that its girls’ golf tournament is in the spring and its boys’ golf tournament is in the fall, but “fem a l e g o l fe r s h ave b e e n welcomed to par ticipate on a boys team in the fall if their school did not sponsor a girls golf team in the spring. Approximately 26 female golfers participated in 2017 fall boys golf tournaments.” On Thursday, January 18, MIAA and the Multiple Sclerosis Association of American (MSAA) held “Inclusion Summit: Exploring our Differences,” which promoted social inclusion and attitudes of nondiscrimination towards cultures, gender, race, physical disabilities and sexual orientation.

“We as leaders and educators have attained responsibilities within our society to promote and enhance diversity, as well as handle any issue regarding this topic fairly,” stated Mayor DeMaria. “I

applaud the MIAA for having the Inclusion Summit last week and I look forward to changes to the MIAA rules, so all individuals can receive the recognition they earned no matter what their gender.”

By the time the project was actually finished in the mid2000s, however, a $600 million project had become a $1.3 billion one, however, and that additional value has never yielded any additional revenue for the city and possibly preventing the city from collecting around $400 million since 2000, when the agreement went into effect.

The city council voted in February of 2017 to decertify and revoke the city’s tiff agreement with the Mystic Generating Station. Though the agreement naturally runs out in 2020, the city is hoping to receive damages equal to the amount of unpaid taxes.

That vote required approval from the state’s Economic Assistance Coordinating Council (EACC), however, and on December 13 of last year, the EACC voted against the city.

The state’s argument is that in order to revoke a TIF agreement, the company in question must be so in violation of the agreement that it’s risking the economic benefits it produces, something the state says hasn’t happened with the Exelon Mystic Generating Station.

The decision gave Everett 30 days to dispute finding in court, a remedy the city is taking. According to reports, the city has hired outside counsel Mintz Levin and former Governor Bill Weld to represent them in their suit against the state.

Exelon spokesman Mark Rodgers said that the company maintains that it has followed all of the stipulations of its agreement with the city, and expects a judge to uphold the state’s decision.

“Exelon Generation has a good relationship with the City of Everett and we look forward to continuing to work together as a responsible business member of this community,” said Rodgers in a statement.

et’s face it. Everett was, is, and will always be synonymous with the sport of football. It’s a community that breeds football players. They are groomed to play for either the former Eagles or Huskies, and presently the Everett Crimson Tide Pop Warner program, which is just another indication of the EHS football program’s“pursuit of excellence” and the extent to which its captured the hopes and passions of the people of Everett throughout the past century.

The school’s latest successful chapter on the gridiron started in 1992, when the program’s 1975 starting quarterback, John DiBiaso, returned home to take over a team that was struggling for renewed respectability. DiBiaso started his head coaching career with St. Patrick’s of Watertown and then Weston. He was also Everett’s boys’ basketball coach, when he agreed to also take over the top football post.

From the start, DiBiaso’s football teams in Everett enjoyed

nothing but success. In his first two years – 1992 and 1993 – they recorded identical backto-back 7-3 records. It set the stage for unprecedented success that was literally the envy of every high school football program, both public and private, in the state. The Crimson Tide’s record through the years in the DiBiaso era included the following winning records: 1994 (8-2-0), 1995 (8-1-0), 1996 (101-0, the team’s first Super Bowl appearance), 1997 (11-0-0, the team’s first Super Bowl win), 1998 (9-1-0), 1999 (9-1-0), 2000 (8-1-0), 2001 (11-1-0), 2002 (120-0), 2003 (11-0-0), 2004 (10-10), 2005 (10-1-0), 2006 (12-0-0), 2007 (13-0-0), 2008 (9-2-0), 2009 (8-3-0), 2010 (12-0-0), 2011 (130-0), 2012 (11-1-0), 2013 (8-2-0), 2014 (9-2-0), 2015 (5-5-0), 2016 (10-2-0) and 2017 (11-0-0).

The IRS has previously withdrawn its proposed regulations that would have allowed charities to file information returns with the IRS and donors instead of providing contemporaneous written acknowledgments of charitable donations. If a charity elected to use the new procedure, it would have required the charity to obtain donors’ social security numbers or other taxpayer identification number in order to complete the information return.

The IRS received over 38,000 comments in response to its proposed regulations. The vast majority of those comments were in opposition to the proposed regulations. The reason is that opponents considered this to be a real identity theft problem by having the donors provide their social security numbers to the charitable organization. Another reason for opposing these regulations is that they might discourage people from donating to charitable organizations.

I just recently had a client of mine inquire as to whether or not she should provide her social security number to the charitable organization that she was

donating her car to. She expressed sincere concern in providing that information to the charity. I informed her she did not have to provide the information. I advised her to obtain an acknowledgment in writing from the organization.

Other opponents stated that although the donor reporting under this proposed regulation was voluntary, they thought that eventually the reporting would become mandatory.

Pursuant to Internal Revenue Code Section 170(f )(8), a donor claiming a charitable donation deduction must obtain from the charity a contemporaneous written acknowledgment that contains specific information, with respect to any dona-

tion over $250. The acknowledgment must be received by the taxpayer no later than when the taxpayer files his or her tax return for the calendar year in which the donation was made.

An exception under Internal Revenue Code Section 170(f )(8) (D) allows a donor to avoid the contemporaneous written acknowledgement requirement if the charitable organization files a return in a form provided

by IRS regulations that includes the information required under Section 170(f )(8)(B). For many years, the IRS did not issue regulations to cover this exception.

The proposed regulations by the IRS represented an attempt by the IRS to deal with this statutory exception.

Now that the proposed regulations have been withdrawn, taxpayers cannot avail themselves of the exception. Therefore, if a charitable donation is made in excess of $250, the taxpayer must receive a contemporaneous written acknowledgment from the charitable organization that essentially contains the name of the donor, the date of the gift, the amount of the gift and the nature of the gift (e.g. cash, car, clothing, etc.).

At 81, of Peabody and formerly of Everett, died Sunday afternoon at Beverly Hospital with his loving family by his side following several years of illness.

He was the devoted husband to Antonietta (Simeone) Zarro with whom he shared over 53 years of marriage.

Born in Chianche, Avellino, Italy, he was the son of the late Salvatore and Carolina (Polcari) Zarro. He was raised in Italy and finished high school in Belgium. He later lived in Canada and finally spent the last 60 years living in the United

States. He spent 16 years in Everett and the last 43 years in Peabody. Giuseppe first worked in the Belgium Coal Mines for a couple of years and then moved to British Columbia, Canada where he worked as a lumber jack for eight years before he immigrated to the United States. While living in the United States, he was employed with General Electric for 25 years in the aircraft division as a welder in the Everett Plant. He enjoyed traveling with his wife and enjoyed swimming with his friends at the local pool. He was a true family man who enjoyed being with his family. However, his favorite endeavor was spending time with his grandchildren and sharing in all of their activities. Besides his loving wife, he is survived by his son and daughter-in-law, Salvatore G. and MaryEllen Zarro of Peabody, his two daughters and sons-in-law, Teresa and Ronald Higinbotham of Peabody and Antonietta and Paul Caputo of Billerica, his brother, Nazzareno Zarro of Everett and Teresa Toneguzzo of Canada, and

is also survived by his beloved 7 grandchildren, Giuseppe, Salvatore, and Michael Zarro, Emilia Rose and Austin Higinbotham and Alyssa and Ashley Caputo and by several nieces and nephews.

His funeral was held on Friday, January 19 at the Conway, Cahill-Brodeur Funeral Home, Peabody, followed by his Funeral Mass at St. John’s Church, Peabody. NET NEUTRALITY Senate 39-0, approved the creation of a 7-member Senate committee to review the Federal Communications Commission’s December 14th ruling that repealed a 2015 Obama-era net neutrality regulation. The ruling overturned the regulation that required Internet service providers to treat all data on the Internet the same and barred them from blocking or slowing down traffic or offering “paid fast lanes.” The committee’s is charged with making recommendations and/or filing legislation that would protect Massachusetts consumers.

The members of the committee were quickly appointed and Sen. Cynthia Creem (D-Newton) will lead the effort.

“This special committee will give the Senate a chance to learn about the difficulties our constituents and businesses may face with the federal government’s wrongheaded net neutrality repeal,” said Senate President Harriette Chandler (D-Worcester). “It is my hope that we can respond to the federal government in a way that best serves the residents of the commonwealth.”

The first public hearing of the committee is in Room 437 of the Statehouse at 11 a.m. on Tuesday, Feb. 6.

COST OF COLLEGE (S 2184) Senate 39-0, approved and sent to the House legislation that would require all colleges in Massachusetts to give applicants who have been accepted to the college, a uniform financial aid information sheet, developed by the federal government, to assist with the financial part of the student’s decision whether to enroll in that school. Currently, an estimated 3,300 U.S. institutions across the nation, including 66 in Massachusetts, already use the information sheet.

Supporters said requiring each college to present the costs of the school per semester on the same standard form will allow potential students and their families to make apples-to-apples comparisons of the benefits and costs of attending a school.

They argued it is difficult to compare costs when they are presented in a different way by each school.

“This bill represents an inexpensive solution that, starting in the 2019-2020 academic year, would help students find the colleges that will graduate them on time and with as little debt as possible,” said the bill’s sponsor Sen. Eileen Donoghue (D-Lowell). “Given our knowledge-based economy and the increasing costs of earning a degree, the commonwealth needs to

Mayor DeMaria and his team are also working with the Mystic River Watershed Association (MyRWA), Wynn Development, National Grid, the Massachusetts Department of Conservation and Recreation (DCR) and the Massachusetts Department of Transportation (MassDOT) to create a complete system of pathways along the Malden River and utilize the new Woods Bridge on Rte. 16 to connect to Wellington and River’s Edge in Malden.

COMMENTARY | FROM PAGE 2 understanding of changes to expect at the federal level, helping us to finalize our own state budget and make important policy decisions throughout the current legislative session here in Massachusetts.

Now more than ever, the ongoing work of this committee is of the highest importance as my colleagues and I in the Senate continue working to protect the Commonwealth from regressive policy changes and budget cuts on the federal level.

Another highlight from 2017 was the release of Kids First: A Vision for a Stronger Commonwealth. As many of you already know, I was appointed by Senate President Stan Rosenberg to lead the Senate’s Kids First initiative tasked with proposing a series of recommendations to build strong and resilient kids in the Commonwealth. After collecting extensive input, my colleagues and I on the Senate working group unveiled our vision statement of strategic priorities, including budget and policy recommendations, selected to reorient Massachusetts towards a twenty-first-century education system and to begin prioritizing long-term, smart, and strategic investments in children and their families. I am proud of the vision and values laid out by the Senate in Kids First, and I am confident that this document will provide our Commonwealth with a critical road map of steps we must take to make serious, significant, and sustained investments in our children’s futures.

I also had a number of legislative achievements in 2017, with one of the biggest being the signing of the LOOK bill into law. As the lead Senate sponsor of this bill for many years, I was very proud to sit on the conference committee that crafted the final version of this bill and to see this signed into law. This legislation takes crucial strides towards guaranteeing that every student receives a fair opportunity at educational success, and I have no doubt this bill will help to improve educational outcomes for all of our students, especially our schools’ English learners.

This new law is the culmination of years of hard work by many legislators, advocates, and staff, and I am very grateful to everyone who helped make this law possible.

Also in 2017, my colleagues and I in the Senate once again passed the Healthy Youth Act, legislation I sponsored that guarantees that students receive medically accurate and age-appropriate sex educa-

tion and that parents play an active role in their child’s education along the way. This is the second time that the Massachusetts Senate has passed the Healthy Youth Act, and it now moves to the House of Representatives for consideration. I look forward to continue championing this important piece of legislation and working with my House colleagues

to secure the bill’s final passage.

Finally, I worked hard over the course of the last year to secure in the Fiscal Year 2018 state budget and bond bill key priorities for the Commonwealth and my district, including millions to eliminate the waitlist for pediatric palliative care services, increase the clothing allowance for children, as well as $244 million for a new Soldiers’

Home in Chelsea and for broadband infrastructure.

Overall, it was a very busy and productive first year of session, and I am already looking forward to the work that lies ahead. In 2018, my colleagues and I in the Legislature will continue to confront many of the most challenging issues that

This bill will give law enforcement officers new tools to prevent poaching and to hold offenders accountable for their criminal acts.â&#x20AC;?

The measure also makes the Bay State a member of the Interstate Wildlife Violator Compact, a reciprocal agreement among 45 other states that allows state law enforcement agencies to share information with the other states.

It recognizes the suspension of hunting, fishing and trapping licenses in all states that are members of the compact.

Any person whose license is suspended in a member state would also have his or her license suspended in all other member states in which that conviction would be a violation resulting in suspension.

The Senate approved a similar bill in 2016 but the House never acted on it.

Many legislators say that legislative sessions are only one aspect of the Legislatureâ&#x20AC;&#x2122;s job and that a lot of important work is done outside of the House and Senate chambers. They note that their jobs also involve committee work, research, constituent work and other matters that are important to their districts. Critics say that the Legislature does not meet regularly or long enough to debate and vote in public view on the thousands of pieces of legislation that have been ďŹ led. The school had captured eight other GBL championships in its long football history, including, ironically enough, in 1975, when EHS Quarterback DiBiaso was behind center.

DiBiaso also had the rare opportunity to coach his son, Jonathan, in high school, when he, too, was the teamâ&#x20AC;&#x2122;s starting quarterback. Jonathan was chosen Gatorade Massachusetts Player of the Year in 2011 after setting career state records in touchdowns (103) and passing yards (7.052) while leading the Tide to another Super Bowl title. He was a perfect 25-0 in his last two years at EHS, before suiting up for Exeter Phillips Academy, and then the Big Green at Dartmouth College. He returned to his alma mater as a teacher last spring, and was an assistant football coach at CM in 2017, where his dad will be the schoolâ&#x20AC;&#x2122;s head coach next fall, while also accepting a position as its associate athletic director.

It was bittersweet to us here at The Everett Advocate to first hear the news from Boston media outlets of Johnâ&#x20AC;&#x2122;s resignation and subsequent hiring at the Catholic Conference school in West Roxbury at a press conference held at CM, because throughout the years he often stopped by to say hello while picking up photos of his teamâ&#x20AC;&#x2122;s most recent game. Many times he had son Jonathan by his side, when the future Tide star was only four or five years old. It was indeed a football family. His wife, Maureen, was the schoolâ&#x20AC;&#x2122;s cheerleading coach, and daughter, Kristina, is also a Tide alumnus and former cheerleader.

While we wish him well, the memories that his teams gave us throughout the past quarter-century will never fade away, including players like Omar Easy and Diamond Ferri, who went on to enjoy stints in professional football, and all the other great Tide players who brought glory to the city.

There will be more Everett players like them who will make their mark as they write the next chapter in the programâ&#x20AC;&#x2122;s longstanding history of success. Coaches and players come and go, but the institution known as Everett football will continue on as long as the Crimson Tide Pop Warner program remains as the feeder system, and the E-Club, the schoolâ&#x20AC;&#x2122;s sports boosters, maintains its strong foundation for the subsequent generations of talented Everett football players. Thereâ&#x20AC;&#x2122;s no doubt in our minds that this will be the case.
