had been previously laid off and to reduce class sizes throughout the school district. â&#x20AC;&#x153;We are asking the Mayor and the City Council to give the School Department the money that State Senator Sal DiDomenico worked very hard to get, and the State Legislature allocated to the students in the Everett Public Schools when the final state budget was passed on August 21 in the amount of $2,515,109,â&#x20AC;? said Assistant Superintendent of Schools Charles Obremski.â&#x20AC;&#x153;I know that the Mayor and the City Council will do the right thing and whatâ&#x20AC;&#x2122;s best for the children of Everett, and will allocate this money to the children and the School Department and reduce our class sizes.â&#x20AC;?

However, the council declined to take the matter up on Monday. While an item was on the agenda to hold a Committee of the Whole meeting on the issue, when the issue was taken up, Councillor-at-Large John Hanlon, the first to speak on the item, immediately moved to refer it to the School Finance Review Commission, arguing that the council has â&#x20AC;&#x153;no authority to put money into a budget.â&#x20AC;?

After Hanlon made his motion, several councillors moved to call for the question, preventing any further debate on the item, to the visible irritation of several councillors. Only Councillors Fred Capone, Michael McLaughlin and Peter Napolitano voted against referring the question out, with Councillors Hanlon, Richard Dell Isola, Rosa DiFlorio, Anthony DiPierro, Michael Marchese, Wayne Matewsky, John Leo McKinnon and Stephen Simonelli voting for it.

The School Finance Review Commission is expected to meet on November 1 at 5:30 p.m. in the City Council Chambers on the third floor of City Hall. The meeting will be open to the public.

Later in the week, the Mayorâ&#x20AC;&#x2122;s Office and members of the School Department held a meeting on the funds, which the mayor described in an extended statement as â&#x20AC;&#x153;productive.â&#x20AC;? â&#x20AC;&#x153;This past week, my administration had a productive meeting with the School Departmentâ&#x20AC;&#x2122;s finance officials and I expressed my desire to ensure that funding to schools needs to go through a transparent process in which funds are spent wisely, efficiently, and prudently,â&#x20AC;? said DeMaria. â&#x20AC;&#x153;That is why I am placing the issue of the $2.5 million in state funding before the cityâ&#x20AC;&#x2122;s School Finance Review Commission for analysis and input. The Commission will also be closely reviewing non-instructional expenditures for appropriateness, which is certainly fair given that the school department has requested and received from the

city a budget several million dollars above net school spending.

This review process represents the same type of financial diligence and careful oversight that is applied to every other city department.â&#x20AC;? â&#x20AC;&#x153;As mayor, my most important job is to carefully consider how we spend taxpayer money to provide city services, while maintaining long-term financial stability and keeping down how much we ask our residents to pay in taxes each year, especially those who are living pay check to pay check and struggling to make ends meet.â&#x20AC;?

The city and schools have been struggling over the funds since the Mayor announced several weeks ago that he would not send the funds to the City Council to transfer to the School Department, as had been anticipated by the schools and Senator DiDomenico, who fought for the funds at the State House. Instead the funds would be used by the city to reduce the tax rate and ameliorate some of the financial hardships created by its attempts to fix the schoolâ&#x20AC;&#x2122;s financial issues.

The Mayorâ&#x20AC;&#x2122;s Office is arguing that it has â&#x20AC;&#x153;fully fundedâ&#x20AC;? the School Department because it provided the School Department with $6 million over the â&#x20AC;&#x153;foundation budgetâ&#x20AC;? it was required to spend by the state, and that it taking this $2.5 million still leaves the School Department with $4 million over the foundation budget.

However, the School Department is arguing that if fully funded means being able to fund all of its employees and services, it has not been fully funded. School administrators stated earlier this year that they would need $10.5 million to be able to keep all School Department staff and services on with no raises. The City provided $6.5 million at the time to avoid catastrophic layoffs at the School Department, but the schools were still forced to lay off over 100 people to make ends meet.

State money must be used to reduce class sizes Dear Editor, Due to the events of last Mondayâ&#x20AC;&#x2122;s City Council meeting, I feel compelled to write this letter.

One of the biggest topics going around the City the past few weeks has been regarding the money for low income students procured by Senator Sal DiDomenico. This money from the State is intended to provide much needed relief to Everettâ&#x20AC;&#x2122;s underfunded school system.

The Mayor appears to have decided that the money, $2.5 million, should go somewhere else instead of being used to reduce class sizes. Councillor Michael McLaughlin and I had planned to request the Mayor appear before the City Council at a Special meeting to discuss this important issue. The ramifications of his decision not only affects the quality of our communities education system but also our state senatorâ&#x20AC;&#x2122;s ability to obtain additional funding for any City proj-

ect by raising the question at the State House whether funds will go where they were intended. Unfortunately this discussion will not occur due to the use of Parliamentary procedure by some members effectively blocked any efforts or comments by Councillor McLaughlin and myself on this issue.

One of the co-sponsors for the piece spoke against it and sent it to the School Finance Committee which is conducted by the Mayor. As the Council President, I have strived to ensure each memberâ&#x20AC;&#x2122;s voice is heard.

It is frustrating to not be allowed the same courtesy. Ultimately if the Mayor decides to apply the monies, it will come before the City Council to appropriate the funds but the Council missed an opportunity to weigh in and side stepped the issue for now.

“Nearly 100 staff members quietly laid off over the summer, and according to the state legislatures own accounting, Everett is still $19 million short of being underfunded, let alone $2.5 million,” she said. “Just

imagine what that money could do for students in Everett. We could have more teachers so that elementary school students would not be languishing in developmentally inappropriate classes of almost 30 children. There could be more special educators so that stu-

dents in more pull out classes could actually see small groups, and not class sizes of 20. … This $2.5 million encompasses an ethical debt that the Massachusetts State Legislature already have to Everett parents, students and teachers. Every day, the fine staff of the Everett Pub-

lic Schools work very hard under austerity conditions that we don’t recognize. They do more with less, every single day, to give our kids a world-class education. I’m reminded of the quote that budgets are moral documents, and that we fund what we value.”

Soper argued before the council Monday night that the city’s original affordable housing requirement of 20 percent was too stringent. Developers, they said, had complained that they “couldn’t afford” such a rate. A better rate for encouraging development, they argued, was the 10 percent recommended by the planning board.

“It’s the ability of developers to determine if their able to make a profit, and they have to make a profit to do these developments,” said Soper. “This is pushing developers out of our com-

munity.”

One of these developers Soper referenced is Andy Montelli, the developer of The Batch Yard, who is currently developing the former Harley-Davidson site on Revere Beach Parkway. “He said, ‘This, Jim, is going to prevent me from doing any more business in this community. I cannot afford it.’ So his next project is in Revere. It’s not in our great city of Everett. We want to entice these good developers into our city.”

Sousa, who has often called inclusionary zoning “more of an art than a science,” stated that

the city had seen no new affordable housing yet from the ordinance, which was approved in spring 2017. “On paper, 20 percent looks great,”said Sousa.“On practice, we haven’t seen proj-

ects take hold at the 20 percent threshold. Looking around, generally speaking, those communities that do have inclusionary

On hearing their testimony, Ward 5 Councillor Rosa DiFlorio argued that the ordinance is slowing down growth in the city. “It took us 30 years to grow in the city of Everett, and now that we’re growing, we’re telling the contractors that they’ve got to give us so much,”she said.

“I am for affordable housing …

So you know what I say? Give the building of City Hall, make it all affordable housing. Do it a different way, find a different way, because people are in business to make money.”

DiFlorio successfully motioned to add a provision automatically lowering the affordable housing rate to 5 percent when the developer is working with contaminated land,

bypassing the earlier requirement to seek a reduction from the zoning board.

For Ward 1 Councillor Fred Capone; however, while 20 percent might have been too high, 10 percent would only let the city tread water. Under state law, the City of Everett is required to maintain at least 10 percent of its housing stock as “affordable.”

If it fails to do so, the state could rule a 40B affordable housing development could effectively bypass any of the city’s zoning ordinances. By the last official count, only six percent of Everett’s housing stock is affordable, and Capone believed that given the explosion of new development, that number could have sunk as low as four percent. Capone pointed to developments, such as The Batch Yard and the former Harley-Davidson site, which had created hundreds of units, none of them affordable.

more units, if you’re bringing in a development with less than 10 percent, what you’ve just done is you’ve taken the burden off the developer, and you’ve placed that burden on the rest of the community,” said Capone. “The community at large has to have 10 percent. A developer comes in and does three percent, good for that developer – they make a little more profit – bad for the rest of the city.”

“We keep talking about supporting affordable housing, and yet we’re voting against affordable housing,” Capone continued. “What we’re doing is we’re maintain the status quo at best.

You don’t see development? I see development everywhere.

I’m not against growth. Growth is good. Uncontrolled growth is bad, and I would suggest to you, that’s what we have going on in this community right now. Our infrastructure cannot handle it.

Our school department cannot handle it. We’re being presented fantasy ideas: that people are going to move into properties and not own a vehicle. I don’t think that’s realistic. We’re being told that they’re going to be one-bedroom apartments, studio apartments, because we all know people don’t move families into one-bedroom apartments. … These developers coming in, they’re not coming in for charity, they’re coming in to make a profit, and they’re making a profit at the expense of the residents of this community, and it’s our responsibility as elected officials to make sure that whatever development comes into this community isn’t going to further strap us.”

Capone also motioned to soften the reduction from 10 percent to five percent. Such a rate would not fix the city’s affordable housing problem overnight, but it would show, Capone argued, that the city is making a “good faith effort” to address the problem.

Capone also motioned to allow the zoning board more discretion with developers working with contaminated properties, arguing that some develop-

City of Everettâ&#x20AC;&#x2122;s new water billing information eginning with the January 2019 bill, the City of Everett is transitioning all water customers who were formerly billed quarterly to monthly billing. Providing 12 smaller bills instead of four larger bills makes it easier for customers to include the cost of water and sewer charges in their monthly budgets.

The conversion to monthly billing will not result in higher water and sewer bills. The metered flow for each step has been prorated for monthly billing.

Monthly billing provides customers with more frequent and timely information about their water usage. This benefits customers in two ways. It allows customers to adjust their water and sewer usage habits if they feel they are using too much water, and it allows customers to detect leaks on their household plumbing sooner. Detecting leaks early and conserving water not only protects our precious natural resource, but it also saves money.

All water customers with existing Automatic Meter Reading Equipment technology will receive a water and sewer bill in January 2019. The water and sewer bill will cover all usage from the last quarterly bill through the January bill. For example: â&#x20AC;¢ For customers who were last billed in October: The water and sewer bill covers the water and sewer used from your October bill through the

Mayor Carlo DeMaria took issue with Capone’s comments, arguing that redevelopment was improving the quality of life in the city, and that only through increasing the city’s general housing supply could rents go down.

“If you recall what The Batch Yard looked like, for the 14 years I was on the City Council it was a blighted, empty, dirty building,” said DeMaria. I know we all forget. I know, when it comes to politics, sometimes people forget. … We worked tirelessly to get that redeveloped and cleaned up. At Wood Waste, we had a facility that was poisoning

our neighborhoods with smells and contaminants and pollutants, and now you have someone who’s taking this contaminated property and building housing, 14,000 square feet of commercial space with lighting and trees and landscaping. We all want affordable housing. We can obtain that, and we’re going to obtain that, just by doing some zoning changes that we’re going to work on. … Let’s not tear down everything we’ve done here.”

“We understand that people are being forced out of the community because rents are skyrocketing,” continued DeMaria.

“That is about supply and demand. There’s a demand for housing, and there’s very little supply. We need to create more housing. You create more housing, you draw down prices for real estate. When you have a lot of housing on the market, rents go down. That’s how you create affordable housing.”

None of Capone’s amendments initially passed. When the item as a whole came up for a vote, it failed to gather enough support. Being an ordinance, eight yays were required for it to pass, while only six councillors supported it with four against. The roll call was Richard Dell Isola, DiFlorio, Anthony DiPierro, Wayne Matewsky, John Leo McKinnon and Michael McLaughlin voting for the change, and Capone, John Hanlon, Stephen Simonelli and Peter Napolitano voting against it.

Round two Later in the meeting, after a 10-minute recess during which councillors attempted to reach a compromise, Capone motioned to reconsider the item. Saying that he didn’t want the ordinance to remain at 20 percent “because clearly we’ve found that 20 percent isn’t working,” he offered his amendment once again: 15 percent affordable housing. This time, the council reluctantly agreed, as did the city officials.

“That would satisfy our need as a community to move forward and entice developers,” said Soper.

A renewed push by Capone to put the rate for contaminated properties in the hands of the zoning board was met with chagrin by his colleagues, who argued that they had already compromised and such a change was too far.

“I really thank if we’re going to start to clean up sites in our community, we need to give these developers some relief,” said Councillor McLaughlin.

Capone’s amendment failed.

When the full piece, amended to 15 percent, came up for another vote, the council approved it unanimously.

DeMaria signs agreement with Gateway Mall to build pathway ince his first term, Mayor Carlo DeMaria has advocated for multiuse bicycle and walking paths that connect Everett to other neighboring communities, including Boston. In 2008, Mayor DeMaria understood and supported the opportunity and importance of connecting significant destinations.

He became one of the first mayors to promote Bike to the Sea’s vision by connecting Everett to Boston via the Northern Strand Community Path.

This past September, Mayor DeMaria continued to make that vision a realization by sign-

ing an agreement with the Gateway Mall to build a pathway extension from West Street over to the Gateway Mall and Encore Boston Harbor. By signing this agreement, the Gateway Mall is working with the City of Everett on designing and constructing a connection for residents and commuters alike to the Gateway Center, Encore Boston Harbor and destinations across the river in Somerville and Boston.

Soon the bike path that runs from Saugus through this area, and currently terminates at West Street, will be extended in partnership to continue on across Rt.

16, around the resort and into Boston – providing cyclists with an excellent opportunity for a safe, scenic commute.

Mayor DeMaria stated, “The extension of the Northern Strand Community Trail represents a major opportunity for the City of Everett and its resi-

dents. Multi-use bike paths that connect significant destinations can bring increased economic vitality, improved quality of life, and better community health outcomes by providing easy access to physical activity.”

Connecting Everett to Boston via a comfortable and safe mul-

tiuse path would create more affordable, healthier and more enjoyable commute options for hundreds of commuters, and a recreational outlet for hundreds more. The Northern Strand is also an essential section of a much larger vision for a connected statewide bicycle network.

Tide football star has second thoughts for college career

By Jason Mazzilli n Everett High School football star Mike Sainristil made a lot of noise this past spring when he announced that he made a verbal commitment to accept a full scholarship offer from Virginia Tech. The Crimson Tide defensive back/wide receiver may have made an even bigger boom when he announced he was decommitting from that school and restarting his recruitment process.

Following is the text of his announcement via his Twitter account. â&#x20AC;&#x153;After several talks with my family I would like to announce that I am decommiting from Virginia Tech. This being one the hardest decisions Iâ&#x20AC;&#x2122;ve made, I want to thank God for allowing me to stay mentally strong through the process because itâ&#x20AC;&#x2122;s not as easy as it seems. There is no love lost for VT and itâ&#x20AC;&#x2122;s coaches so I want to say thank you for what youâ&#x20AC;&#x2122;ve shown me up to this point. By Steve Freker n the past decade, over 20 players have gone on to play football at the collegiate level who once wore the Blue & Gold of Malden High School. There are a number of former Tornados now toiling in college ranks; most of them starred under the tutelage of former Malden head coach Joe Pappagallo.

Pappagallo and former assistant Steve Macdonald were instrumental in launching the college football careers of all those players from the recent past, including brothers DJ Exilhomme and Danley Exilhomme, who play for Central Connecticut State, and a slew of players for Framingham State University.

Another local player having a terrific season for the Rams football squad is sophomore starting linebacker R.J. Fialli, who was a standout for the Everett High football squad for four years before graduating in 2016.

Representing the Tornados on the 5-2 Framingham State University squad are former Malden captain Jarrad Accardi, Heybert Vilefranche and Jodens Didie. Another Malden resident, Kenny Bartolo, who played for Northeast Regional in high school, is also on the FSU roster. **** Nominations are going in for

One name not on the list but probably should be is former longtime Peabody High School head baseball and head football coach Ed Nizwantowski.

Coach â&#x20AC;&#x153;Nizâ&#x20AC;? is one of the winningest coaches â&#x20AC;&#x201C; in both sports â&#x20AC;&#x201C; in Peabody Tanner sports history. His 1996 Tanner squad appeared in the Division 1 State Baseball Cham-

pionship game before falling to Leominster, 5-4. Many other teams he coached for over 20 years until 2008 won North Championships or were runners-up. Niz is one of the winningest baseball coaches in EMass with over 300 victories.

If you asked him, he would tell you he enjoyed coaching Peabody baseball just as much as he did football, though he was more well-known for the fall sport.

Crimson Tide Pop Warner B team canâ&#x20AC;&#x2122;t corral Cowboys he Everett Crimson Tide Pop Warner B team fell to the Hyde Park Cowboys this past Sunday at Everettâ&#x20AC;&#x2122;s Veterans Memorial Stadium, 2314. On a blustery fall day that belied the heated pigskin battle, Everett ignored the fact that the Hyde Park squad was much bigger and stood toe to toe with them from the opening kick to the final whistle.

The Everett boys drew first blood when Yariel Ortiz danced down the sideline for

a 29-yard score. Gavin Moran held the ball for the conversion kick, and it was 8-0 early in the opening stanza. Hyde Park responded and then some with two scores for a 14-8 lead.

Everett came back just before the half ended when Ortiz again found pay dirt, this time from seven yards out, for a 1414 tie at the half. Hyde Park benefitted from a miscue for a two-point safety and scored a late touchdown for the final score of 23-14.

Even though they lost this non-division game, this might have been the most complete game the team has played all year. Especially strong was the play of the linemen, who are coached by Chris Capavella and Jonathan Long. This hard-fought effort by the boys comes at just the right time â&#x20AC;&#x201C; they have a showdown with the perennial powerhouse and archrival Dorchester Eagles and then the playoffs.

Question 2 asks voters if they approve of a proposed law that would create a citizens’ commission to consider and recommend potential amendments to the U.S. Constitution to establish that corporations do not have the same constitutional rights as human beings and that campaign contributions and expenditures may be regulated.

The proposed law is in response to the U.S. Supreme Court’s 2010 decision in Citizens United v. Federal Election Commission. In that case, the court ruled that the First Amendment prohibits the government from restricting corporations, unions and individuals from donating unlimited funds to Super

LATE RECORDING OF DEED 2017 MassHealth fair hearing decision rendered by a hearing officer with the Board of Appeals addressed a situation where a MassHealth application for long-term care nursing home benefits was denied because a deed was executed in 2007 but wasn’t recorded at the Registry of Deeds until 2016.

MassHealth argued that the transfer of the home by the applicant to the children took place within the 5-year look-back period and thus constituted a disqualifying transfer.

The assessed value of the home was $180,600. MassHealth calculated a disqualification period of 489 days.

The applicant’s attorney argued that the transfer took place in 2007 and that the closing attorney simply neglected to record the deed.

The hearing officer stated that a delay in the recording of the deed does not render it defective. She went on to say that delivery of the deed is essential to the validity and effectiveness of the deed. Delivery occurs when the grantor intends the deed to affect a present transfer of the property conveyed and the grantee assents to the conveyance (i.e. accepts the deed).

The date shown on the deed is prima facie evidence of the date of delivery, but that presumption can be overcome by evidence of extrinsic facts or circumstances. Words or conduct of the grantor evidencing an intention to render the deed presently operative and effectual so as to vest the estate in the grantee, and to surrender control over the title, is necessary and sufficient to constitute a valid delivery.

The applicant paid her attorney to draft and record the deed. This evidenced that the applicant had an intention to execute the transfer of the property in 2007 as well as to record the deed at the time it was executed.

The fact that the attorney neglected to record the deed at the Registry of Deeds was not fatal to the transfer.

The hearing officer ruled that there was an intention to effectuate the transfer, actual delivery of the deed to the grantee and an acceptance on the part of the grantee, all essential elements of a valid transfer. She ruled that there was no disqualifying transfer and honored the 2007 date contained on the deed itself. The application for MassHealth benefits was then approved.

There is much in terms of Massachusetts case law on this very subject.

With registered or certified land, an actual recording would have to take place. It is the land court that registers title in the name of the grantee if all I’s are dotted and all T’s are crossed. It is much more strict than recorded land.
