verett High School was recently chosen as one of 31 schools in Massachusetts to receive vocational funding from the current $3.3 million Skills Capital Grant Program under the Baker-Polito Administration.

Specifically, the high school is slated to receive $124,528 for its Advanced Manufacturing Career Program. The program will “give students more opportunities to study advanced manufacturing to be ready for high-demand career opportunities.� The grant will also fund the purchase of a CNC Haas Toolroom Lathe, CNC Haas Mini Mill, Stratasys uPrint 3D Printers and an Epilog Zing Laser Engraver.

Councilor-at-Large Michael Marchese presented an ordinance to bolster the city’s nuisance/panhandling law by adding the language “It shall be unlawful for any person to beg or solicit money or aid in his own behalf in any place of business, house, or upon any of the streets of Everett.� “This is something we should strengthen and start enforcing,� said Marchese.

Councilor-at-Large Wayne Matewsky said there are individuals who will lie about being homeless as a means to make money. “Some people actually derive a pretty good income out of conning people,� he said.

Matewsky also said panhandling could escalate with the opening of Encore Boston Harbor in June.“The city is changing, we have to be prepared,� he said.

However, McKinnon said panhandling has been an issue “for years.� “This is happening now; take a walk through Walgreens,� he said.

Napolitano said there are 12 lights out on Ferry Street between Glendale Square and the Malden/Everett line. “Is that end of Ferry Street such a low priority?� he asked, adding that another seven lights are out on Main Street.

However, Ward 5 Councilor Rosa DiFlorio said the wiring for some of the Ferry Street lights is underground, which could be a reason for the delays.

Ward 4 Councilor John McKinnon said the City Council needs to be taken seriously.“We’re not a joke up here,� he said. “If we can’t get the answers, then we have to do something.�

Therefore, Daniel Cameron of National Grid will be called before the City Council to provide an update on the outages.

Capone continued to discuss the possibility of creating “open area storage� for dry bulk items.

He said this would apply to “anything in excess of 25 cubic yards.� “Every parcel will be a different size; every use will be a different use,� he said, adding that a $250 fee would be assessed for each parcel.

School Committee stands behind Promise Act

By Christopher Roberson he School Committee voted unanimously on Jan. 22 to support refiling the Education Promise Act on Beacon Hill. Although a similar bill was filed during the last legislative session, the six-member Conference Committee was unable to reach an agreement.

However, State Sen. Sal DiDomenico said he is optimistic about refiling this year. “We’re taking another crack at it,� he said. “I’m not just going to sit tight and wait and hope; this is something I’ve been fighting for.�

If people want to get this done – quick – it can be done quick.�

DiDomenico also underscored the importance of passing the bill in its entirety. “If we don’t get it all this year, there will be other priorities,� he said. “We have one shot at this.�

Pay increase for Aramark employees In other news, the committee voted unanimously to approve a pay increase of $3 per hour for the 84 Aramark employees working in the district. “None of this money comes out of the school budget,� said Charles Obremski, assistant superintendent of Business Affairs, adding that the increase will be funded through the cafeteria revolving account.

He said increasing the rate to $15 per hour is necessary as it was becoming difficult to hire new employees at the prior rate of $12 per hour. The increase will be retroactive to Jan. 3.

He also said bombs were planted in Dr. King’s home on numerous occasions.“Just imagine a bomb in your own home,� said DiDomenico. “I think a lot of us would back off completely. Dr. King never gave up.�

He said Dr. King first made a name for himself at the age of 26 when he led the Montgomery Bus Boycott. The boycott, which began in December 1955, resulted from civil rights activist Rosa Parks being arrested for refusing to give up her seat on a city bus.

However, almost one year later, the U.S. Supreme Court ruled that such acts of segregation violated the Fourteenth Amendment of the U.S. Constitution.

Therefore, the state of Alabama was subsequently ordered to integrate all its bus lines.

DiDomenico also spoke about the events of March 7, 1955, which became known as Bloody Sunday. On that day, 600 civil rights activists attempted to march from Selma, Ala., to the state capital in Montgomery to register to vote. They were stopped on the Edmund Pettus Bridge by law enforcement officials armed with nightsticks and tear gas.“They viciously beat the folks coming across that bridge,� said DiDomenico.

Tide boys’ track fall behind Malden, 52-28

Malden senior Mattheus Farias won the 600 meter run at 1:34.1 and it was a 1-2 finish for Malden with sophomore Brendan Santos second at 1:35.9. Everett's Jason Louis was third at 1:37.1.

Malden swept 1-2-3 in the 1000 meter run with junior Yousef Lahkiky first at 2:55.1 and freshman Josue Iziharry second at 3:19.4, and junior Gerard Mauriello third at 3:23.1. Everett's Frank Caiascibetta was fourth at 3:25.9.

Malden also went 1-2-3 in the one-mile run. Omar Asoucy (4:50.4), Kevin Fuentes (5:24.0) and Aman Chhetri (5:28.0) were the top finishers. Everett's Arthur Rose (5:28.4) was fourth and

Everett Marching Band Returns to Washington D.C.

By Katy Rogers he Everett High School Crimson Tide Marching Band will return to Washington D.C. to be featured in the 2019 National Memorial Day Parade along Constitution Avenue. Everett has had the privilege to perform in the nation’s capital four times, but this will be the first time students will return for a second consecutive year.

With plans to retire, Marching Band Director Charlie Poole will accompany the band for his final time in their venture to Washington. Poole has been a staple in the Everett music department, having taught students of all ages for twenty-one years.

Under Poole’s tutelage, the Everett Crimson Tide Percussion Ensemble has won numerous awards, including the New England Scholastic Band Association and Winter Guard International Regional Championships.

“Over the last several years, the Marching Band has been growing in size and quality. One of the most exciting things for me is to see that growth, particularly where many school districts have cut back support and funding for the arts,” Poole shared.

“The thing I cherish is that we’ve been given the opportunity as teachers to do what we do and share our knowledge and passion with these students.”

Poole praised State Senator Sal DiDomenico for his support of the arts in Everett. The band has been invited to perform at

and the State of Massachusetts for back to back years to perform in the National Memorial Day Parade,” O’Brien said. “I would like to thank Senator Sal DiDomenico for whom procured state funding to allow the band and orchestra to represent Massachusetts.”

DiDomenico and friends from Everett plan to visit Washington D.C. in coordination with the band’s performance.

O’Brien and Poole credited the students for their dedication and described them as hard workers who succeed in all departments, beyond just music.

Poole remarked that he is not surprised when his students receive awards and recognitions in their various academic pursuits.

During the visit to Washington D.C., the music teachers take the opportunity to expose their students to history and culture by bringing them to various attractions. Amidst their tour last year,

the acapella choir demonstrated their vocal skills at the WWII Memorial, and collectively, the music department left a wreath at the base of the Massachusetts pillar. The trip allows students who may not otherwise have the opportunity to travel, exposure to America’s finest museums and landmarks.

A total of 120 Everett students

will take part in the opportunity to visit Washington D.C., a number of them visiting for the first time. In addition to performing in the parade this year, their itinerary includes a tour of the National Zoo, the National Memorial Day Concert at the United States Capitol, and a visit to the Museum of African American History.

Page 14 THE HOUSE AND SENATE: There were no roll calls in the House or Senate last week.

The 2017-2018 legislative session ended on January 1. Thousands of bills that were not approved by that time by both branches and sent to Gov. Charlie Baker are now dead.

Beacon Hill Roll Call’s research shows that there are at least 12 bills that were approved unanimously by the Senate but were stuck in a House committee – in most cases the House Ways and Means Committee — for up to a year or more. With no opposition in the Senate, observers question why the bills were stalled and died in the House.

Under House rules, any individual representative can move to discharge most bills from the Ways and Means Committee. There is a 7-day waiting period prior to the House considering the motion to discharge.

The discharge motion must receive a majority vote of the members present. If the measure is discharged from the committee, the committee has four days within which to report the measure for placement on the House’s agenda for action.

A bill may also be discharged from the Ways and Means Committee by any representative by filing a petition signed by a majority of the House. The bill would then be discharged seven days later and go onto the House agenda for the next session.

A state legislator who spoke on the condition of anonymity told Beacon Hill Roll Call that some bills are likely held up in committee because someone in a high position either inside or outside the Statehouse is opposed to it. "If a powerful person wants the measure never to see the light of day, there is little that a rank and file representative can do," said the legislator.

The legislator added that it was common practice back in the 1970s and 1980s to make motions to discharge a bill from a committee and bring it to the full House for debate and a vote.

“That rarely, if ever, happens anymore,” said the legislator.

“And if does, it is destined to fail.”

Another state legislator who wished to remain anonymous said, "Under House rules, every representative has to power to attempt to discharge a bill but hardly any try out of fear of offending the powerful speaker, his leadership team and committee chairs."

Here are six of the important bills that were approved unanimously by the Senate and died in the House Ways and Means Committee: PROPERTY TAX REDUCTIONS (S 2124) Senate 39-0, approved a bill providing a variety of property tax breaks for seniors, veterans and disabled persons.

Provisions include raising from $1,000 to $1,500 the amount of property tax reduction veterans can earn by doing volunteer work in their city or town; creating a new local option property tax exemption for deaf persons of $5,000 of taxable valuation or $437.50 of actual taxes

Supporters say it is up to cities and towns whether to offer these tax breaks because the breaks are not state-mandated.

They note the reductions will be good for countless low-income seniors, military personnel and disabled persons and might even help some of them remain in their homes, rather than having to move because they can’t afford to pay their property taxes.

Sal DiDomenico Yes COST OF COLLEGE (S 2247) Senate 39-0, approved legislation that would require all colleges in Massachusetts to give applicants who have been accepted to the college, a uniform financial aid information sheet, developed by the student’s decision whether to enroll in that school. Currently, an estimated 3,300 U.S. institutions across the nation, including 66 in Massachusetts, already use the information sheet.

Supporters say requiring each college to present the costs of the school per semester on the same standard form will allow potential students and their families to make apples-to-apples comparisons of the benefits and costs of attending a school. They argue it is difficult to compare costs when they are presented in a different way by each school.

Sen. Sal DiDomenico Not yet a senator SOCIAL MEDIA PRIVACY PROTECTION (S 2320) Senate 36-0, approved a proposal designed to protect students and employees from being forced or bullied into providing schools and companies with information about and access to their social media accounts.

Provisions prohibit any school from requiring a student or applicant and an employee or applicant to disclose photographs, videos, a user name, password or other means of access to a personal social media account; allow an aggrieved student or applicant to bring a civil suit against the school for violating these new laws; permits the attorney general to investigate any violations by employers; and permit schools to disclose lawfully obtained information from a student’s personal social media account to law enforcement to protect against immediate danger of death or seri-

ous physical injury to a student or other individuals.

Supporters say that a growing number of employers and schools are demanding access to the social media account of students and employees and prospective students and employees. They argue this is an invasion of privacy that should not be allowed in the Bay State.

They say demanding access to a social media account is the same as demanding offline access to a person’s diary, regular mail, photo albums and conversations the person has with family and friends – offline things that which would never be demanded by a school or employer.

Sal DiDomenico Yes ACTION PLAN IN RESPONSE TO CLIMATE CHANGE (S 2196) Senate 38-0, approved and sent to the House a bill requiring the state, led by the secretaries of energy and environmental affairs and public safety, to study, create and implement a comprehensive adaption management plan to protect and ensure the preservation, protection and restoration of the state’s "built and natural environment" from the risks of climate change.

The plan would be updated every five years.

Supporters point to the flooding and massive damage caused

by Hurricane Sandy and other disasters. They argue the state must prepare in advance and be proactive and not just reactive to similar threats and disasters.

Sal DiDomenico Yes PROTECT PUPPIES AND KITTENS (S 2331) Senate 36-0, approved a bill ensuring that puppies and kittens are bred and sold in a safe and healthy environment and strengthening the current “Puppy Lemon Law” to give pet owners additional options if they unknowingly purchase a sick pet.

Provisions prohibit the sale of puppies and kittens younger than eight weeks old; allow for inspection by the Commissioner of Agricultural Resources of kennels and catteries and persons keeping at least five non-spayed female dogs or cats; create a process by which a puppy or kitten suffering from a significant adverse health condition may be

declared “unfit for purchase” by a veterinarian; and provide remedies to a buyer of a puppy or kitten declared unfit for purchase including exchange of the puppy or kitten or a refund and reimbursement for reasonable veterinary fees.

Supporters say this will reduce the number of animals that are born sick. They argue that pet owners deserve protection when they unknowingly purchase a sick animal that requires expensive veterinary care.

STUDENT LOAN BILL OF RIGHTS (S 2380) Senate 36-0, approved a bill giving greater protections to borrowers in disputes with companies servicing their student loans.

Provisions include requiring that all student loan servicers be licensed by the Division of Banks; creating the position of Student Loan Ombudsman in the attorney general’s office; assisting in resolving complaints from students; allowing the Commissioner of Banks to revoke or refuse to renew a lender’s license if the company is engaged in abusive practices such as overcharging students or steering them into costlier repayment plans to make higher profits; and permitting the Commissioner of Banks to take enforcement action against companies that are violating any of these laws or regulations.

Supporters say that because of the high cost of college, students are taking on substantial debt, and are being taken advantage of by loan servicers.”

Many legislators say that legislative sessions are only one aspect of the Legislature's job and that a lot of important work is done outside of the House and Senate chambers. They note that their jobs also involve committee work, research, constituent work and other matters that are important to their districts. Critics say that the Legislature does not meet regularly or long enough to debate and vote in public view on the thousands of pieces of legislation that have been filed. Encore Boston Harbor traffic update he following is planned roadway improvement work associated with the opening of Encore Boston Harbor, barring any changes due to weather. All work locations and durations are subject to weather.

The Alford Street Bridge will be reduced to one lane of traffic in each direction for an extended period of time. This work – which is not related to Encore Boston Harbor – is expected to have a significant impact on traffic. Commuters are advised to seek alternate routes or travel during off-peak hours.

Sullivan Square Roadwork will continue at the Sullivan Square rotary on Cambridge Street, Maffa Way, Main Street and Rutherford Avenue. This work will include interconnect duct bank and traffic signal and drainage installation. The work will require sequenced lane shifts as well as off-peak lane closures.

Work will continue at the Sullivan Square MBTA station upper bus way and parking lot. This work will include electrical installation. This will be done by crews working in isolated areas outside of the roadway. There is no anticipated impact to traffic.

Route 16 work will continue at Bell Circle. This work will include traffic signal installation. The proposed work zones will require the closure of small lengths of outside travel lanes for short durations.

Alford Street/Broadway (Route 99): No work is planned on Alford Street/ Broadway.

How to fight age discrimination in the workplace Dear Savvy Senior, How does one fight against workplace age discrimination, and where can I turn to for help if I think Iâ&#x20AC;&#x2122;ve got a case?

Discouraged Donna Dear Donna, Age discrimination can happen to anybody over age 40, but itâ&#x20AC;&#x2122;s difficult to prove. With that said, here are the steps youâ&#x20AC;&#x2122;ll need to take to fight this growing problem if you think youâ&#x20AC;&#x2122;ve been treated unlawfully in the workplace.

ADEA protection The Age Discrimination in Employment Act (ADEA) is your first defense against age discrimination. This is a federal law that says an employer cannot fire, refuse to hire, or treat you differently than other employees because of your age. Some examples of age discrimination: You were fired because your boss wanted to keep younger workers who are paid less.

You were turned down for a promotion, which went to someone younger hired from outside the company, because the boss says the company â&#x20AC;&#x153;needs new blood.â&#x20AC;?

When company layoffs are announced, most of the persons laid off were older, while younger workers with less seniority and less on-the-job experience were kept on.

Before you were fired, your supervisor made age-related remarks about you.

You didnâ&#x20AC;&#x2122;t get hired because the employer wanted a younger-looking person to do the job.

The ADEA protects all workers and job applicants age 40 and over who work for employers that have 20 or more employees â&#x20AC;&#x201C; including federal, state and local governments as well as employment agencies and labor unions.

If your workplace has fewer than 20 employees, you may still be protected under your stateâ&#x20AC;&#x2122;s anti-age-discrimination law.

What to do If you think you are a victim of employment age discrimination, you may first want to talk to, or file a grievance with, your companyâ&#x20AC;&#x2122;s human resources department, but itâ&#x20AC;&#x2122;s important to remember that HR works for your

employer, not for you. If that doesnâ&#x20AC;&#x2122;t resolve the problem, you should file a charge with the Equal Employment Opportunity Commission (EEOC) within 300 days from the date of the alleged violation. In some states, itâ&#x20AC;&#x2122;s 180 days. You can do this by mail or in person at your nearest EEOC office (see EEOC. gov/field/index.cfm) or call 800669-4000. They will help you through the filing process and let you know if you should also file a charge with your state anti-discrimination agency.

If you do file, be prepared to provide the names of potential witnesses, your notes about age-related comments and other episodes.

Once the charge is filed, the EEOC will investigate your complaint and find either reasonable cause to believe that age discrimination has occurred, or no cause and no basis for a claim. After the investigation, the EEOC will then send you their findings along with a â&#x20AC;&#x153;notice-of-right-to-sue,â&#x20AC;? which gives you permission to file a lawsuit in a court of law.

If you decide to sue, youâ&#x20AC;&#x2122;ll need to hire a lawyer who specializes in employee discharge suits. To find one, see the National Employment Lawyers Association at NELA.org or your state bar association at FindLegalHelp.org.

If you lose your job in a group termination or layoff, you should consider joining forces with other colleagues. There are advantages to proceeding as a group, including sharing costs of the litigation and strengthening your negotiating position.

Another option you may want to consider is mediation, which is a fair and efficient way to help you resolve your employment disputes and reach an agreement. The EEOC offers mediation at no cost if your current or former employer agrees to participate. At mediation, you show up with your evidence, your employer presents theirs and the mediator makes a determination within a day or less.

SECTION 199A RENTAL PROPERTY SAFE HARBOR

here were 335 comments sent to the IRS regarding its proposed regulations on Internal Revenue Section 199A dealing with the qualified business income (QBI) deduction.

The majority of those comments dealt with rental real estate activities and whether or not such activities would qualify for the deduction. Pursuant to IRS Notice 2019-7, if the safe harbor provisions are met, a rental real estate activity will be treated as a trade or business and as such, will qualify for the Section 199A QBI deduction. The notice states in part: “solely for purposes of this safe harbor, a rental real estate enterprise is defined as an interest in real property held for the production of rents and may consist of an interest in multiple properties”.

Taxpayers must treat each property as a separate enterprise or elect to group them together. Furthermore, commercial and residential real estate must be considered separate enterprises. This condition becomes important as it factors into the record keeping provisions of the new safe harbor provisions of Internal Revenue Code Section 199A. Below are the requirements that must be satisfied during the taxable year in order to meet the safe harbor and have the rental activity treated as a trade or business and be entitled to the new QBI deduction: 1. Separate books and records are maintained to reflect income and expenses for each rental real estate enterprise; 2. For taxable years beginning prior to 1-1-23, 250 or more hours of rental services are per-

formed per year with respect to the rental enterprise. For taxable years beginning after 1231-22, in any three of the five consecutive taxable years that end with the taxable year (or in each year for an enterprise held for less than five years), 250 or more hours of rental services are performed per year with respect to the rental real estate enterprise; and 3. The taxpayer maintains contemporaneous records, including time reports, logs, or similar documents, regarding the

following: a. Hours of all services performed b. Description of all services performed c. Dates on which such services were performed d. Who performed the services The contemporaneous records requirements will commence beginning 1-1-19. What constitutes rental services you might ask?

1. Advertising to rent or lease the real estate 2. Negotiating and execut-

ing leases 3. Verifying information contained in prospective tenant applications 4. Collection of rent 5. Daily operation, maintenance and repair of the property 6. Management of the real estate 7. Purchase of materials 8. Supervision of employees and independent contractors The term“rental services”does not include financial or investment management activities, such as arranging for financ-

ing; procuring the real estate, studying and reviewing financial statements or operating reports; planning, managing or constructing long-term capital improvements, or hours spent traveling to and from the real estate.

250 hours comes down to being able to support you work on average 5 hours per week providing rental services. Time will only tell how strict the IRS will be on the “contemporaneous” record keeping requirement. That will be real difficult for real estate investors to comply with.

This is one of the most exciting changes for accessibility to emergency services in more than 20 years. When a citizen sends a text message to 9-1-1, it will be routed to an emergency call center based on the location information provided by the carrier. For this reason, when a citizen sends a Text-to-9-1-1, they should make every effort to text the town name, address or location that they are located in.

What is Text-to-9-1-1?

Text-to-9-1-1 is the ability to send a text message to reach 9-1-1 emergency call takers from your mobile device.

How Do I Reach Text-to-9-1-1?

When using a texting app on a device, type the numbers “911” into the “To” or “Recipient” field.

What Information Should I Give Text-to-9-1-1?

You should make every effort to text the following:

x what is happening (nature of the incident); x location including the address/location and town name; x any additional details about the location you can provide such as landmarks, cross streets, nearby business names, apartment number, floor, room or suite numbers, or any details that may be helpful in locating you.

When Should I Use Text-to-9-1-1?

Texting should only be used during an emergency when you are unable to make a voice call to 9-1-1. Making a voice call is the most efficient way to get access to emergency services.

Text-to-9-1-1 will be useful for citizens who are deaf, hard of hearing, or speech impaired. Text-to-9-1-1 eliminates the need to use ancillary Teletypewriter (TTY) equipment, or third party services to access 9-1-1.

What Happens Next?

The 9-1-1 professional in the emergency call center will ask you many questions, will assist in sending first responders to the location you identify, and may provide instructions on things for you to do.

Why Didn’t My Text Go Through?

Messages sent to Text-to-9-1-1 may not be received. If you attempt to send a Text-to-9-1-1 where the service is not available, wireless carriers provide an automatic "bounce-back" message. Bounce-back messages are intended to minimize the risk that you mistakenly believe that your text was sent and received by an emergency call center. As part of the bounce-back message, you will be advised to contact emergency services by another means.

Text-to-9-1-1 is currently available throughout the Commonwealth. However, across the country, Text-to-9-1-1 may only be in certain locations. Whenever possible, you should always make a voice call to 9-1-1 during an emergency.

Are There Any Text-to-9-1-1 Limitations I Should Know About?

Text-to-9-1-1 uses native texting technology called Short Message Service (SMS). Therefore, you must have a text or data plan on your mobile device to Text-to-9-1-1 and you should avoid sending:

x multi-media such as pictures, videos and emoticons; x a message to more than one person as a recipient; x messages exceeding the 160 character limit, as the messages will be broken and may be delivered out of order.

Text-to-9-1-1 rules do not apply to the following: third party texting applications (apps) on mobile devices that do not support texting to and from U.S. phone numbers, apps that only support texting with other app users, or texting through social media. This can include message services over WiFi networks, where a text or data plan is not required.
