Everett Uber driver faces rape charges

n Uber driver from Everett is facing charges for allegedly raping an intoxicated female passenger in Boston last weekend.

Police are accusing Ranjan Thapa, 26, of sexually assaulting a passenger so intoxicated that she had difficulty speaking with investigators soon after the incident.

Thapa has pleaded not guilty to the rape charge in Roxbury Municipal Court Monday. He is being held on $10,000 cash bail.

According to his public defender,

In a statement, Uber has committed to cooperating with the investigation.

“What police describe is deeply troubling,” the statement said.

“The driver has been removed from the app, and we stand ready to assist the Boston Police Department with their investigation.”

n Monday, March 12, Mayor Carlo DeMaria, the Office of Veterans Services, local veterans and community members gathered at Everett City Hall to reflect and remember those who didn’t come home from war by dedicating a Chair of Honor in their memories. Mayor Carlo DeMaria, First Lady Stacy DeMaria, Ella DiPrima, George Riley and Angelo “Butch” Fiorentino helped unveil the chair in recognition of veterans who have been held prisoner of war or are missing in action. Both George and Butch are Everett residents and have family members missing in action.

The Chair of Honor is a single chair with the POW/MIA logo emblazoned on it, which is then flanked by the American Flag and the POW/MIA Flag. It is in the honor of over 86,000 servicemen and women who remain unaccounted for since World War I, and it will remain empty and on display until they are all accounted for and finally come home.

The chair is a reminder that even though they are not here, they will never be forgotten; a simple yet powerful display of honor and remembrance. Currently, there is a Chair of Honor in dozens of locations across Massachusetts as well as in the rest of the country. Everett City Hall is honored to join the list.

During the ceremony, Mayor DeMaria addressed the audience about how honored he was to help unveil this addition to City Hall. Veterans’ issues have been and will continue to be the utmost importance to him. Ways & Means approves $500,000 to fund schools

By Brendan Clogston he Ways & Means Committee unanimously recommended the mayor’s proposed $500,000 transfer to end the School Department’s winter budget woes, though not before tensions between the mayor and school officials over the handling of the crisis threatened to spill out once again.

Last week, the mayor proposed to transfer $500,000 from the city’s stabilization fund to the School Department in order to fund “all ongoing and upcoming extracurricular activities,” including the EHS band trip to Washington, D.C., and to ensure that no layoffs would occur at the schools this school year. This transfer would follow an earlier $5 million transfer from the fund to fund to offset the schools’ budget shortfall.

These transfers were made to

fill a $9 million shortfall in the School Department’s budget, which was caused by a number of factors, including a major change in how the state calculates how much aid to provide cities to feed students from poor families, and a number of unforeseen expenses thrust upon the school district over the course of the school year.

Other factors were disputed between the City of Everett and School Department; however, such as Medicaid chargebacks.

The $500,000 figure proposed by the mayor was arrived at after a meeting between the Mayor’s Office and school administrators. “We said, what does it take for you to fill the needs, the educational requirements that you have promised, to all children and their families, and the number was $500,000,” said Mayor Carlo DeMaria.

As the School Committee and officials had a meeting of their own Monday night, and so could not attend the Ways & Means Committee meeting, Ways & Means Committee Chair John Leo McKinnon requested a letter of explanation for the request. “I want to make it perfectly clear,” read the letter from Superintendent of Schools Fred Foresteire he received in reply. “The School Department and Administration of the Everett Public Schools did not request this $500,000. The mayor proposed this transfer … due to the backlash that was caused when there was a very real threat of our students not being able to participate in various competitions … If that happened, our STEM team was not going to be able to compete in the National Championship in New York. Our Percussion Ensemble and Chorus were not going to be able to compete in the New England Championships. Our award winning band was in danger of not being able to represent the state of Massachusetts in the National Memorial Day Parade in Washington, D.C.”

That threat referred to the mayor’s institution of a travel ban in February, something the mayor said was only meant to apply to administrators or teachers traveling for professional development or conferences at School Department expense, and not to students.

Mayor DeMaria stated that he found the letter’s tone “unnecessary” and “disappointing,” but he called on the City Council to approve the transfer so that the city government and schools could get to work on next year’s budget. “I just want to get this over with, work on next year’s budget, and make sure the kids get what they need for this year,” said DeMaria. “You won’t see this happen again. We will work together diligently to get a budget before the City Council that’s a true budget – that any employee, that’ll be working for the city of Everett, when they’re offered a position, the funds will be there for that position.”

Council President Peter Napolitano echoed DeMaria’s statement. “I understand the tone of the letter, but I don’t think the letter is going to determine whether we give the

money or don’t give the money,” said Napolitano. “Let’s move forward.”

Ward 2 Councillor Stephen Simonelli was more vocally frustrated with the School Department. “The superintendent is putting the mayor and the City Council on the spot,” said Simonelli. “This is not our problem.

We all thought the $5 million was enough, and it should be enough.” Simonelli ultimately voted with his colleagues on the committee to unanimously recommend the transfer to the full City Council, which will consider it at their March 26 meeting.

Looking forward to addressing a major cause of the shortfall, Ward 5 Councillor Michael McLaughlin encouraged the mayor to consider following the Cities of Brockton and Worcester in suing for underfunding the districts, the merits of which Mayor DeMaria said he found “persuasive.” McLaughlin has placed onto the agenda for the council’s Monday, March 26 meeting a resolution “(r)equesting the City of Everett join a joint law suit with Low-income communities regarding Chapter 70 funding.”

DeMaria Administration holds healthy food discussion

n Monday, March 19, the DeMaria Administration, in partnership with Everett Community Growers, Mass in Motion and the Metropolitan Area Planning Council, met to assess the local food system through the Everett Community Food Assessment and Action Plan. The goal of the project is to develop a food system plan for the city that is guided by Everett residents and advances equity and public health.

At the event City representatives, community members and food system stakeholders assessed both assets and issues. Community members spoke of farmto-school programs to support Mayor Carlo DeMaria’s vision of ensuring that all residents are made aware of the availability of healthy, fresh, locally grown produce and to educate the public

about how they can join or participate in urban farms or community gardens. The project is focusing on the following areas: workforce and business, school food, food production, food security and cultural diversity.

Mayor DeMaria started this initiative to help reduce the amount of processed foods being served in Everett Public Schools and to increase healthier options, including fresh, locally grown produce, for Everett students. He has received the Robert Wood Johnson Culture of Health prize and the United States Conference of Mayors Childhood Obesity Prevention award, and he is looking to reinforce good nutrition and eating habitats within the schools. Under Mayor DeMaria, the City of Everett has taken a role in offer-

ing Everett residents the tools to improve their health – in particular, the Healthy Meals program allows members to buy healthy precooked meals at an affordable price.

Mayor DeMaria stated, “In 2016 approximately 47% of our children were overweight or obese, a rate amongst the highest in the state. This public health problem jeopardizes the quality of life for our residents and is of great concern to me personally.”

He also stated, “Throughout my life I have never felt better than when I committed myself to eating a balanced diet. It is truly amazing how much better you feel when you know you are building a better body through proper diet, and it is important that we express that to the youth of our community.”

According to the mayor, operations at the site are moving ahead rapidly. “The conversations I have on a daily basis with the team here in Boston – with Bob DeSalvio

[Wynn Boston Harbor President] and Chris Gordon [President of Wynn Design and Development], Jackie Crumb [Wynn Senior Vice President and General Counsel] and John Tocco [Wynn Community Relations Director] – it’s full steam ahead,” said DeMaria.

“They’re continuously buying properties, continuously looking to develop more hotel space. … They’re spending a million dollars a day, I think it is. Construction’s at 1,000 men and women working on that site. A lot of good things have happened already.”

The mayor was less certain whether Wynn’s name would be on the building at the end of construction. “I hope it stays in the existing corporation,” said DeMaria. “Regarding changing the name and all that, I think you’ll see some movement on that.”

Mayor DeMaria stated that he is holding off on any further public comment until the

Massachusetts Gaming Commission offers him an opportunity to discuss it formally.

“Eventually, there will be a time when the Gaming Commission does take this up, and we will speak on it then,” said DeMaria.

In Januar y of this year, The Wall Street Journal published a report detailing dozens of alleged incidents of sexual misconduct by Wynn against employees and others spanning decades. In the months which followed, other women stepped forward with additional allegations.

Wynn stepped down as CEO shortly after the report was released, and Matt Maddox was named his successor. The Massachusetts Gaming Commission is currently conducting a suitability investigation into the company to determine whether the company still qualifies to hold a gaming license in light of The Wall Street Journal’s report.

By Julian Cardillo he Pope John XXIII boys’ basketball team ended the season with a historical finish on March 17, earning the first Division 4 state championship in school history by beating Maynard 89-57. Maynard, the defending champions, were overwhelmed by the Tigers last Saturday at Blake Arena on the campus of Springfield College.

Angel Price-Espada was the leading man for Pope John, coming up with an incredible 49 points to lead his team to victory. He drilled 10 of 16

three-point shots and fell just shy – eight points, to be exact – of the Dana Barros tournament record of 57 points. That said, the offensive blowout is already being touted as one of the top individual performances in Massachusetts basketball history.

“I just wanted to win the game; even if I had zero points, I wouldn’t care,” Price-Espada said after the game.

Pope John ends this season at 24-1. That said, it didn’t seem as though it would be that seamless at the end of last season when Price-Espada and Michael Thompson, who had six points

on the game, were wondering about their futures; the duo was at St. Clement’s in Medford last year, which shut its doors.

“It was really easy to fit in here, because the players that were already here welcomed us with open arms,” said Thompson.

Senior Marques Boyer had 17 points for Pope John; Luis Velasquez had 10; Rashid Griffin had three; Conor Kelly, Jason Ford and Mehkl Collins all had one.

Pope John had an 18-11 lead after the first quarter and were up 52-31 at halftime.

A FORCE FOR CHANGE

unior Yesica Chacon Portillo received an Honorable Mention for her submission in the “Be the Change” Poster Contest for the 2018 Middlesex Partnerships for Youth “Be the Change” Poster Contest. Each year the Middlesex Partnerships for Youth, Inc. sponsors an annual poster project open to all middle and high school students in the county. This year’s theme was “Be the Change, “ which is based on a quote by Mahatma Gandhi: “Be the change you wish to see in the world.” Inspired by this theme, Mrs. Bordieri, one of Everett High School’s digital media art teachers decided to create a class assignment so spark student interest. Students were encouraged consider positive messages in their poster designs such as: speaking up when you see a wrong, showing respect for

all, including those who are different from you, and using your voice to create positive change.

Yesica Chacon Portillo, a Junior at Everett High School, received an Honorable Mention for her poster titled “Accept Who We Are.” To review the posters, the MPY chose a diverse group to serve as a panel of judges including: police chiefs, superintendents, art teachers, students, guidance counselors and principals. iddlesex Sheriff Peter J. Koutoujian welcomed Massachusetts Department of Veterans’Services Secretary Francisco A. Ureña for a visit to the Housing Unit for Military Veterans (HUMV) on Wednesday, March 14. The visit to the Middlesex Jail & House of Correction came nearly two years to the day after Governor Charlie Baker helped formally open the Commonwealth’s only dedicated unit for incarcerated veterans.

“It was an honor to welcome Secretary Ureña to tour HUMV and speak with the nearly two dozen inmates and detainees currently in the program,” said Sheriff Koutoujian. “The Secretary and his team have been incredible supporters and partners in our efforts to help these men build upon their common bonds, right the ship and return to their families in a better place than when they came through our doors.”

In addressing HUMV participants, Secretary Ureña discussed the role of the Depart-

ment of Veterans’ Services, as well as programs, initiatives and resources for veterans in the Commonwealth. “Middlesex County is leading the way in providing positive, appropriate and much-needed services to incarcerated veterans. The reduction in recidivism is one indication that the program is working. I am glad I have been able to see firsthand the good work being done by Sheriff Koutoujian and his staff,” said Secretary Ureña.

Since its opening in 2016, more than 180 individual veterans have participated in HUMV, with 117 having spent at least 30 days in the unit. A recent recidivism review showed that of those 117 men, only six – or 5.1% – have subsequently been convicted of a new crime or had a violation of parole or probation that resulted in additional jail time.

NEW SEXUAL HARASSMENT POLICIES IN THE HOUSE (H 4291) House 151-0, unanimously approved a measure that requires the House to promote the safety and respectful treatment of all members, officers, interns and employees of the House, and all third parties, by establishing uniform procedures for making and receiving complaints of harassment and initiating, conducting and concluding investigations into complaints of harassment. The measure states the House is committed to providing fair and equal opportunity for employment and advancement to all employees and applicants.

It also spells out a specific procedure for handling sexual harassment cases and prohibits anyone from retaliating against a person who has complained about harassment or participated in an investigation into an allegation. Other provisions include employing a fulltime Equal Employment Opportunity Officer and a full-time Director of Human Resources.

Despite the unanimous vote, there was heated debate on the House floor.

Rep. Diana DiZoglio (D-Methuen) told her personal story about how she was sexually harassed in 2011 by many people at the Statehouse following an incident. She was working as a House aide when rumors began to spread about alleged inappropriate behavior with former Rep. Mark Cusack in the House chamber late one night during a party at the Statehouse. An investigation

by Speaker Bob DeLeo’s office in 2011 found that nothing inappropriate had occurred but DiZoglio’s boss decided that the rumors had become too much and he asked her to find employment elsewhere. ”But on my way out the door I was hit with another surprise, the speaker’s office would not release my six weeks’ severance pay unless I signed

a non-disclosure agreement including a non-disparagement agreement that legally bound me from discussing what had happened and from criticizing any past, present or future elected members of this House,” DiZoglio said. ”I hesitated for days because I did not want to sign this document. With my money running out quickly, however, I didn’t feel I had another option, so I signed under duress.”

“No member, officer or employee of the House of Representatives should be subjected to the sort of treatment described by Rep. DiZoglio,” said DeLeo in a written statement e-mailed to reporters while the debate was taking place. “To be clear, yesterday was the first time that I or any member of my staff, House Counsel’s Office or House Human Resources heard of the harassment Rep. DiZoglio experienced after the incident that occurred in the House Chamber in April of 2011.”

DeLeo said DiZoglio was fired by her boss despite being instructed to the contrary and that she was represented by an attorney when a severance agreement was drafted. ”To hear now that she did not want to agree to the terms of the termination and severance agreement is troubling,” DeLeo’s statement said. ”Her attorney competently negotiated the agreement on her behalf and we presumed that his client was in agreement with the terms.”

Things got more heated when Rep. Angelo Scaccia (D-Boston), the longest serving House member, taunted DeLeo. “Mr. Speaker, Come out. Come out of your office and chair.” ”Mr. Speaker, you’ve been getting away for too long in this House with the sound of silence,” Scaccia said, using references to the hit Simon and Garfunkel song. ”This House should call up the attorney general of this commonwealth and let her find out what happened in the past to bring about the present.”

Scaccia called Thursday’s session ”an absolute charade” and said he had heard of harassment on Beacon Hill many years ago. ”Madame Speaker,” Scaccia said to Patricia Haddad (D-Som-

SOCIAL MEDIA PRIVACY PROTECTION (S 2320) Senate 36-0, approved and sent to the House a bill designed to protect students and employees from being forced or bullied into providing schools and companies with information about and access to their social media accounts.

Provisions prohibit any school from requiring a student or applicant and an employee or applicant to disclose photographs, videos, a user name, password or other means of access to a personal social media account; allows an aggrieved student or applicant to bring a civil suit against the school for violating these new laws; permits the attorney general to investigate any violations by employers; and permit schools to disclose lawfully obtained information from a student’s personal social media account to law enforcement to

protect against immediate danger of death or serious physical injury to a student or other individuals.

Supporters said that a growing number of employers and schools are demanding access to the social media account of students and employees and prospective students and employees.

They argued this is an invasion of privacy that should not be allowed in the Bay State. They said demanding access to a social media account is the same as demanding offline access to a person’s diary, regular mail, photo albums and conversations the person has with family and friends – offline things that which would never be demanded by a school or employer.

PROTECT PUPPIES AND KITTENS (S 2331) Senate 36-0, approved and sent to the House a bill ensuring that puppies and kittens are bred and sold in a safe and healthy environment and strengthening the current “Puppy Lemon Law” to give pet owners additional options if they unknowingly purchase a sick pet.

Provisions prohibit the sale of puppies and kittens younger than 8 weeks of age; allow for inspection by the Commissioner of Agricultural Resources of kennels and catteries and persons keeping at least 5 non-spayed female dogs or cats; create a process by which a puppy or kitten suffering from a significant adverse health condition may be declared “unfit for purchase” by a veterinarian; and provide remedies to a buyer of a puppy or kitten declared unfit for purchase including exchange of the puppy or kitten or a refund and reimbursement for reasonable veterinary fees.

“As an animal lover, pet owner and occasional small-scale breeder, I am deeply aware of the emotional challenges for families when a pet falls ill, as well as the need to protect the health and safety of young animals,” said the sponsor of the bill Sen. Karen Spilka (D-Ashland). “This bill is the result of extensive discussion with both breeders and animal rights activists to protect puppies, kittens and pet owners across the commonwealth.”

“Pet owners deserve protection when they unknowingly purchase a sick animal that requires expensive veterinary care,” said Senate President Harriette Chandler (D-Worcester). “Animals depend on their owners, and we must repay that trust by ensuring that animals are treated with respect and compassion.”

PROTECT ANIMALS (S 2332) Senate 36-0, approved a bill designed to protect the health and safety of animals. Provisions include requiring that animal abuse be reported by the Department of Children and Families, the Department of Elder Affairs and the Disabled Persons Protection Commission; making animal control officers mandatory reporters of child abuse, elder abuse and abuse against disabled persons; increasing non-criminal penalties for abuse of an animal; repealing a current requirement that animals involved in illegal animal fighting automatically be killed and instead creating other options for these victims; prohibiting insurance companies from refusing insurance coverage and housing authorities from refusing to rent to a potential renter based on a specific breed; and requiring property owners and landlords to check property for abandoned animals within three days fol-

lowing a foreclosure or end of tenancy.

Supporters said the bill is long overdue and will protect many animals from injury, abuse and death. They pointed out a recent study which found that a person who has committed animal abuse is five times more likely to commit a violent crime against a person.

“Our commitment towards ending the cruel and inhumane treatment of innocent animals is steadfast, and today we have taken significant action to protect their safety and welfare,” said co-sponsor Mark Montigny (D-New Bedford). “There is zero tolerance for such despicable brutality and today’s action by the Senate sends a clear message.”

TREAT JUVENILES AS ADULTS (S 2332) Senate 19-17, approved an amendment to strike a section of the bill that allows adult criminal sentences for animal cruelty to be applied to juveniles ages 14 to 17.

Supporters of allowing it said this gives prosecutors some flexibility in how to charge a youth. They cited a case in which a 14-year-old boy brutally tortured a friend’s dog and could not be charged or sentenced as an adult because the judge said the law allowing that only applies to human beings and not animals.

Opponents said putting juveniles in prison with adults results in them coming out worse than when they went in.

“I strongly support treating animal cruelty as the serious crime that it is,” said the amendment’s sponsor Sen. Pat Jehlen (D-Somerville). “But, we must be conscious of how we treat juveniles in any criminal context. Putting juveniles into adult prisons almost guarantees that those juveniles will never have their underlying mental health or emotional conditions resolved and will be far more likely to be released in their early adult years with adult criminal skills and thinking. We should not be unintentionally taking steps that train future criminal actors.”
