nce again, several thousand Saugus residents – from tiny tots to senior citizens – will welcome in Christmas Eve with a special visit from Santa Claus.

“The parade will start at 6pm at the Central Fire Station with a Police and Fire escort, and some cool special vehicles,” reads the official notice “To the Children of Saugus From The North Pole.” “Santa will make a very special visit to Saugus Center in front of Town Hall, between 6:30 and 7:00 to wish the townspeople a Very Merry Christmas. Santa would like to see as many children as possible, so listen for the sirens and come out and greet Santa as he passes by!”

Santa’s Christmas Eve Parade has been part of the town’s holiday tradition, which goes back three decades or more, according to Town Manager Scott C. Crabtree.

This year’s parade route has been reduced by about two hours, with several streets being eliminated. It will start a half hour later and end an hour and a half earlier. But any parent who wants their

child to watch the parade and get a glimpse of Santa will still have the opportunity to meet Santa in front of Town Hall or at various locations along the route.

This year’s Tree Lighting Ceremony and Festivities was bigger and more magical than ever, thanks to all the hard work from volunteers and Town employees, and the continued support and generosity from residents and local businesses.

On Friday, November 30, 2018, from 5 to 8:30 p.m., thousands of Saugus residents gathered outside the Town Hall to meet Santa, ride a horse-drawn sleigh and trackless train, jump in the bounce houses, pet animals, listen to live entertainment, sip hot cocoa, munch on cookies and popcorn, and of course, watch the tree lighting. At 7 p.m., a handful of children joined the massive crowd of residents on the front steps of Town Hall to flip the special switch that lights the Town Tree and all the other Town lights, which once again included bright red and white lights strung along Central Street.

WHEELABRATOR| from page 1 “I think they deserve our ear,” Cicolini told The Saugus Advocate. “They are our largest taxpayer and they deserve to speak. I’d like to think I represent all taxpayers. I don’t have an issue having a dialogue with them,” he said in an interview this week.

Cicolini, who is vice chair of the Board of Selectmen, said he met informally with James Connolly, Wheelabrator’s Vice President of Environmental, Health and Safety, and Jack Walsh, a community relations specialist.

Several Saugus residents said they saw the selectman talking with the two Wheelabrator officials and wondered what the meeting was about.

Cicolini said the meeting has nothing to do with official business between Wheelabrator and the Town of Saugus. And he stressed that the pending litigation between the Town and Wheelabrator is strictly a Board of Health matter and that selectmen have no involvement in the matter.

“I have nothing to hide,” Cicolini said, noting he met Wheelabrator officials in a very public place.

“They did a lot of talking and I did a lot of listening,” Cicolini said. “I’m listening as a selectman and as a taxpayer in town. They’ve had a lot of bad press. I just felt like I wanted to hear their side of the story and that’s a good thing.”

“It’s always good to maintain communications. Let’s see if we can reach a common ground and avoid making lawyers rich,” he said.

Pending litigation The Conservation Law Foundation (CLF) filed a complaint earlier this year in Suffolk Superior Court, claiming the state Department of Environmental Protection (MassDEP) violated a longtime law that requires local review of Wheelabrator Technologies Inc.’s plans to expand its ash landfill.

The CLF lawsuit seeks to appeal the decision by MassDEP granting Wheelabrator’s request for a permit to increase the ash landfill at the site of its trash-to-energy incinerator on Route 107 in Saugus.

MassDEP ’s decision approved Wheelabrator’s plans for a major modification of its ash monofill that will pro-

vide an additional estimated 400,000 cubic yards of disposal capacity. MassDEP approved the project despite the fact that Wheelabrator Saugus, which owns and operates the landfill, never obtained a required site assignment permit from the Saugus Board of Health, according to CLF. The Saugus Board of Health notified Wheelabrator in 2016 that it was required to apply for a new site assignment from the Town of Saugus, but Wheelabrator has failed to do so. The Saugus Board of Health is also appealing MassDEP’s approval to expand the landfill.

Cicolini stressed that his meeting will have no bearing on the lawsuit and will not lead to any potential action by the Board of Selectmen.

“It’s really a Board of Health matter. Ultimately, it’s their call,” he said.

“I want them [Wheelabrator] to know my ears are open. I’m not pro-Wheelabrator and I’m not against them,” he said.

“They’re open-minded. It’s not like they’re looking for 50 years. They understand there has to be an endgame. So I would be remiss if I didn’t listen to what they had to say.”

Cicolini noted that the pending decision by MassDEP extends the life of the landfill by another seven years.

Wheelabrator seeks “a broader discussion with the town” Wheelabrator’s Connolly told The Saugus Advocate that there was nothing unusual about last week’s meeting. “We meet periodically with various town officials and community members in Saugus as an engaged corporate citizen,” Connolly wrote in an email.

“We are hopeful that we may have a broader discussion with the town about our longterm relationship and how we can best serve the community.

We remain open to conversations with the town and others regarding our shared future,” he said.

The meeting between Cicolini and Wheelabrator comes on the heels of a recent vote by the Board of Selectmen to submit a letter to MassDEP objecting to a new Emission Control Plan filed by Wheelabra-

tor. Board of Selectmen Chair Debra Panetta said Wheelabrator “does not want to adhere to the required emission standards that the DEP has imposed.”

In his email, Connolly defended the plan submitted by Wheelabrator. “The waste-toenergy industry is among the most stringently regulated in the world. Wheelabrator Saugus complies, and will continue to comply with the current emissions standards the Massachusetts Department of Environmental Protection (MassDEP) deems safe,” Connolly wrote.

“Our facility operates in compliance with all regulations established by MassDEP as well as the U.S. Environmental Protection Agency (EPA). These limits are not a choice, they are mandatory and a base requirement, and Wheelabrator continues to be in compliance,” he said.

“Earlier this year, MassDEP lowered limits for several constituents, including mercury, while establishing an alternative limit for nitrogen oxides that is well below the EPA standard,” he said.

“We will continue to operate in compliance with the new state standards and below the federal limits. We have submitted a permit application to MassDEP that outlines how Wheelabrator Saugus will meet the reduced standards. That application is currently being reviewed by MassDEP.”

For a Safer Saugus

Town Meeting members say they are ready to support life-saving measures for streets

M

omentum is building for traffic safety issues affecting pedestrians, motorists and bicyclists to become a key top of discussion at next year’s Annual Town Meeting.

Some members say they like the idea of a 25 mph speed limit town-wide as proposed by a grassroots group that calls itself “Citizens for a Safer Saugus.” Meeting members William B. Stewart of Precinct 3 and Thomas E. Traverse of Precinct 8 said they would gladly show their support for the speed reduction by putting one of the group’s new bumper stickers on their cars.

“See me at the American Legion for breakfast Friday morning,” Stewart told The Saugus Advocate this week, referring to anyone who wants to give him a bumper sticker.

“Sure, I’d put it on,” Traverse said.

And even more Town Meeting members interviewed by The Saugus Advocate say they would gladly support an initiative proposed by Town Manager Scott C. Crabtree to create a special traffic enforcement division within the Police Department. Of course, that could be quite an expense if Town Meeting members were willing to support such a unit, which Crabtree and many town officials say must go hand-in-hand with any kind of reduction in posted speed limits.

“If it comes before Town Meeting, would it be acceptable?” Precinct 2 Town Meeting Member Peter A. Rossetti, Jr. asked. “You’re probably talking about four officers, which would be about a quarter of a million dollars. But how much is a life worth?”

DiNardo wants a master plan first Without even knowing the actual costs, a number of Town Meeting members said they don’t mind paying for hiring additional police officers to enforce speed limits.

“I don’t see why Town Meeting would not approve it,” Precinct 4 Town Meeting Member Albert J. DiNardo said of paying for a traffic enforcement division.

But DiNardo said he would like to see a prudent approach taken by the town, with any safety improvements based on a master plan. “I think we need to do it the smart way. It’s too expensive not to do it the smart way,” DiNardo said.

DiNardo said he prefers to see the results of an ongoing town-wide traffic study before

he supports the idea of a 25 mph speed limit, but said it’s meaningless without traffic enforcement. “I think 25 mph would be a good number, but I’d get the study done first before we move ahead on this,” Serino said.

“And I support the traffic enforcement unit. You can talk about lowering all the speed limits you want. But it’s not going to accomplish anything until you have enforcement … In my district, right now, I can tell you that speeding is pretty bad on Ballard Street” he said.

Rossetti said a lot needs to be done to improve traffic safety in the Cliftondale Square area, which encompasses the precinct he represents. “We’ve had several fatalities in this area and numerous pedestrians being hit,” Rossetti said.

Some of the issues facing his precinct include a lack of speed limit signs, a lot of areas that don’t have sidewalks for pedestrians and traffic congestion that creates unsafe conditions.

“On some of the streets off of Cliftondale Square, 25 miles per hour may be too high,” Rossetti said.

“It’s not really in the Town Meeting’s purview to set speed limits … Selectmen are the traffic commissioners. They’re pretty much in charge of public safety,” he added.

Traffic improvements that require spending taxpayers’ money are the issues that would come before the Town Meeting, he added.

“We’re not like the federal government where we can deficit-spend,” DiNardo said.

“Some of the people who are complaining about taxes are willing to introduce proposals without having a plan and a budget. I just think we’re jumping the gun when we do that. It’s too expensive to go off half-cocked and do things political instead of doing things the smart way,” he said.

Precinct 1 Town Meeting Member Ann Devlin said she wants to see some action taken to eliminate “excessive speed” on roads through town, like Summer Street in her precinct, which she said has become “like a drag way for a lot of young people.”

“I walk my dog through the neighborhood, and I’m often amazed at how fast the cars are going by … Unless there’s enforcement, I don’t think it will change a lot of the driving habits in town,” Devlin said.

“But I don’t think it’s good use of taxpayers money to have police everywhere,” she added.

Devlin said she would like to see the installation of automatic traffic signs that warn drivers when they are driving over the speed limit. She said she would also like to see dropping the speed limit in certain areas.

A victory for the consumer

Saugus homeowner gets her money back from solar panel company that tried to scam her

ate last month, Stephanie Hamilton finally got all the money she claimed she was owed by the owner of a now-defunct solar panel company that defrauded her out of $4,500 for panels that never got installed on her Oakridge Drive home.

“I feel good considering I felt I wasn’t going to get any of my

money back at all,” Hamilton said in an interview this week.

“I think it’s a victory for the consumer, and kudos to the Saugus Police Department for being right on top of this. I’d be better off if this didn’t happen at all. But I’m very grateful that I got my money back,” she said.

But Hamilton filed a complaint that was investigated by Saugus Police and later led to a clerk magistrate’s hearing in Lynn District Court to determine whether a criminal charge of larceny over $250 by false pretense should be filed against William B. Woods, formerly of New London, N.H. He owned Twin State Sun, LLC, which operated in New Hampshire and Massachusetts – where it was the subject of numerous complaints

Following a clerk magistrate’s hearing this past spring, Hamilton said, she learned that she would be receiving all of her money back. “They came out and said, ‘Don’t worry. You’re going to get your full $4,500,’” Hamilton said “They told me he would be going to jail if he didn’t pay it all back,” she said.

In a document filed with Lynn District Court last fall, Hamilton recommended that Woods receive “maximum imprisonment based on willful defrauding of many victims.”

Hamilton traveled to Lynn District Court three times and twice to U.S. Bankruptcy Court in Manchester, N.H. over the past year.

Hamilton was the subject of an “Advocate Asks” question and answer interview published in The Saugus Advocate last year. She agreed to talk publicly about her case in hopes that it might help others avoid the problems she encountered. She also wanted to express gratitude to the Saugus Police Department for investigating her case. “The Police Department is proactive and is there to protect you against larceny,” she told The Saugus Advocate this week.

Meanwhile, Woods maintains he’s done nothing wrong and denies that he was facing criminal charges despite the case being prosecuted by the Essex County District Attorney’s Office. “I agreed to reimburse her just to make the case go away.

There was never any admission of guilt,” Woods said in a telephone interview this week.

“Did I want to fight this thing from Myrtle Beach? No. So, I paid her back the deposit. I felt bad that she fell into a spot where my company started to slide downhill,” he said.

Woods insists he did nothing wrong and that he was unable to pay her back at the time because of his pending bankruptcy case. “But I wanted to do the right thing. And I was happy to pay her off out of my personal money. Stephanie was just a casualty in a failing company,” he said.

Hamilton said she had another company install 38 solar panels on the roof of her house without any problems.

Hamilton spent more than 36 years working as an auditor and financial specialist with the State of Massachusetts. She retired several years ago as a semi-senior accountant for the state Department of Education.

She had also worked previously as a tax auditor and supervisor at the state Department of Revenue.

She and her husband – Saugus Fire Department Deputy Fire Chief Tom D’Eon, Jr. – have two children: Ally, 16, and Jake, 12. They were both born and raised in Saugus.

D’Eon is one of four “recall” candidates who were elected to join Debra Panetta on the Board of Selectmen after the firing of Town Manager Scott C. Crabtree by four selectmen who were later ousted. Panetta was the sole supporter of Crabtree. Soon after emerging victorious in the recall election, D’Eon and the other selectmen voted unanimously to rehire Crabtree.

D’Eon and her colleagues were reelected in November 2015 and again in November 2017. D’Eon has not yet decided whether she will seek another two-year term on the board in next year’s town elections. She has an associate’s degree in business from North Shore Community College. Some highlights of the interview follow.

Q: Jen, do you plan on running for reelection next year?

A: Right now, I want to run for reelection in 2019. It will depend on whether or not I pull papers in July. That will depend on what is happening at that moment; if I feel in my heart that I am still contributing – what have I and if I have

met my goals – which I came onto the board wanting new parks and schools in town, which we accomplished. I was told we never would [accomplish those goals], but we did, but we accomplished all that I wanted and I feel proud about that. As long as there is still good work to do, I want to do it. I just feel that come July 2019, when the time comes to decide am I going to run, there are a lot of factors that will determine if I say, “Yes, I definitely am going to run for another term” or “No, I’m not going to run.” But right now, yes, I do want to run.

Q: Now, were you inspired to run on the parks improvements because of what happened to your daughter – getting injured on the playground?

A: Yes. Yes. Because my daughter broke her arm at a playground in Saugus and subsequently needed surgery and has a steel rod that she will have for the rest of her life in her arm. I met other figures in town, including Greg Nickolas over at the Saugus Youth and Recreation Department [he is the director]. Our children have been injured at our parks, and I knew it was time to make some improvements.

Q: So that was the motivating thing?

A: Yes. That was the motivating thing. It was the right time. There was an opportunity at that time that I could run for selectman and get my voice heard. I just felt like

our priorities at that time were not in the right order. I felt that we needed to take our bottom priorities and make them our top priorities. I’ve got children, and the educational and recreational areas in this town were top priorities for me at that time.

Q: Now – the time that you have been on the Board of Selectmen – what do you consider your best accomplishment or the thing that you are most proud of?

A: I am very proud to have been part of getting the town to vote and approve to build a new high school-middle school. I’m so proud, because while we needed it 20 years ago, you could not get it back then, but now was the time when the entire community came together and said, “Yes, we need this for our children, for their education and to give them the best chance in their lives to the best education” – I am so proud to be a part of that and a part of our history.

Q: Okay, let’s look ahead.

It’s Christmastime and I want to ask you some questions.

If you could give five Christmas presents to the town, what would they be? And in their priority, so what would be your first?

A: Well … if I knew what the town’s wish list was, I would try my hardest to get them everything on the list. Anything that is within my wheelhouse to do, I would try my

Bright lights at Town Hall The Board of Selectmen couldn’t have had a brighter ending to their year on Wednesday night -- their final meeting for 2018.

The turnout was low for a very light agenda.

But anyone who walked into the second floor auditorium at Town Hall couldn’t help but notice just how bright the huge room was.

The town was able to install new and more cost effective lighting in the high ceilings overhead.

Mandy is the owner and creator of “Wicked Good Henna” and has been creating henna designs for more than a decade.

A “Lego Animation Workshop” is set for Thursday, Jan. 24, from 4 to 6pm. This is also for Grade 6 and up. Please sign up because space is required. Empow Studios expert instructors will work with participants to develop storytelling skills, learn animation software and capture the action of their Lego movies. I’m reading and I’m listening and I’m hearing at my meetings that people do want a 25 miles per hour town-wide speed limit – and I want that, too, and I think the rest of the board wants that, too. We’re doing the studies right now, and I hope that as soon as possible that we can help make that come true to the town.

People in my neighborhood are buying their own “slow down” signs. This is a new phenomenon for us.

Q: Did you get one of those “Citizens For A Safer Saugus,” 25 miles per hour bumper stickers yet?

A: No, I have not gotten one yet.

Q: Are you looking for one?

A: I did not even know that they had them available until I read about it in the paper.

Does Bill Brown have one?

Q: You could probably get one from him.

A: I’ll have to reach out to him.

Q: So, you would put the bumper sticker on your car?

A: Oh no, my husband wouldn’t allow me to put it on my car, but I would put it in the window.

Q: Any other thoughts on what you plan to do for the new year on this issue?

A: I’m going to be as proactive as I can and as involved as I can. We are the traffic commissioners for the town, so I’ll be involved every step of the way with that.

I read every single piece of documentation that I get, before the meetings and as the weeks go on. We are very well informed as to where they are doing the [traffic safety] study. We do know that this is going to come down to an enforcement issue. It’s going to be enforcing the new speed limit that is ultimately going to make it successful.

Q: Should this be like a major theme of next year’s Annual Town Meeting?

A: Yes. Q: Articles to improve traffic safety.

A: I think the Town Meeting realizes this is a very important issue to the town right now, and something needs to be done. The town manager and the Board of Selectmen are well aware of it, too.

Q: Okay, you have 10 precincts, so do you think maybe that members should get with residents of their precinct and propose things to help their neighborhoods out?

A: I think a good amount of them are doing things right now. Town Meeting members have come to us over

time about stop signs and speeding, so I think that Town Meeting members are aware of the problems, so we’ll see in 2019 what comes up.

Q: Okay, for Christmas present Number Two, what will you offer?

A: Well, I have some pet projects that I hope that the town will like. One of my goals is revolving around beautification projects. I would love to see some projects done on Route 1 to improve the overall appearance – maybe filling in the holes and the guard rails, and metal fences coming down – coming more up to the times with what some other towns have on their highways. They have the sound barriers. They don’t have any more of the guard rails. It would be really nice if we could get some funding for improving the appearance of Route 1 and making it look much better.

Q: Christmas Present Number Three, what would that be?

A: Christmas Present Number Three, if I could give to this town, I would like very much to hear from some of the developers and see what they are willing to do for improvements. From the Square One Mall, I’d love for them to come to us and see if they have any plans to

make any improvements to that mall. I know that a restaurant is coming. I know that it’s a steakhouse – the Longhorn Steakhouse – but as far as the inside of the mall, I’d like to hear if they plan to do any refurbishing or anything.

It seems like the trend now is for outdoor walking mall– type of thing. And I think that Square One Mall could definitely use a little help with its image and a little refurbishing inside.

Q: Okay. Christmas Present Number Four?

A: Christmas Present Number Four for the Town of Saugus, if I could give anything … I would just love to be able to let more people know and give them directions if they have an issue in their neighborhood or a concern: how they can reach out when they approach the town. I would like to make it easier for people; I would love to explain to them to make it easier. I would really love to make it easier for them to get help on projects that are important to them. I’d just like to help them to get where they need to be to get information and to get answers.

Q: That sounds like a little more transparency in town government.

A: Yes: better access to town government.

Q: Okay. And Christmas Present Number Five?

A: Christmas Present Number Five to the Town of Saugus: I vow to make myself available to residents of Saugus any way I can, to do the best job that I can. If there is something that I’m not informed on – and I need to be as one-fifth of the Board of Selectmen. I volunteered for this job, and I’m open to hearing from anybody who needs to tell me anything that would help me do my job better, so my Christmas present to the Town of Saugus is my time.

I am very happy when residents come to our meetings and tell us their personal points of view, because it only helps the cause. That’s what we’re there to do – to listen and to try to help our citizens.

Q: Great. I have a couple of other questions that might dovetail into some of the things that you have been talking about as presents. Do you have any thoughts on a West Side Fire Station?

A: I do have thoughts on a West Side Fire Station.

Q: Please expound.

A: The time has come for a West Side Fire Station. There’s a lot of development coming in town and it’s happening quickly. I do believe that this

ASKS | from page 14 topic has been on the table before, and the town knows that it is needed. Working with the town manager and Town Meeting and all the other different boards in town, I think that this [new fire station] will come to fruition.

Q: Is this something that should be on the agenda for the Town Meeting in this coming year?

A: In 2019? Probably. Yes, I think it should be on the agenda. It should be discussed, because there are many, many new apartment buildings that are coming along. There’s going to be a real need quickly; a West Side Fire Station is definitely needed in this town.

Q: Do you have any more thoughts on transparency? On how to make the town more transparent to its citizens?

A: I hope that we are transparent. We hold the meetings in public. Anybody can come.

The meetings are posted, and anybody can come and speak to us. There is nothing I could tell you that the public doesn’t know. We don’t do anything in private.

Q: You are talking from the perspective of the Board of Selectmen, but there are other aspects, like some people complain that when they go to Town Hall, they request something and they don’t get the information, and sometimes they are discouraged from seeking it – that they have to pay so much for documents when the information could be sent to them for free via email documents.

A: I don’t have much power over people getting documents from Town Hall, but

there is the Freedom of Information Act [state Public Records Law], and they should be able to get the documents that they request. Every department is different, I think, depending upon what office you should go to, but they should be able to get them.

Q: One of the common complaints is that they are being told, “Oh, you have to put it in writing or I’m not going to honor it,” which is contrary to the Public Records Law. As a citizen, it’s better if you put it in writing, in order that you can protect yourself and be able to appeal if you are denied timely access to the records, but it’s not a requirement that when they come in, let’s say, the Town Clerk’s Office, and say, “I want to see the campaign expenses” – in fact, that is one area where those documents, because they are campaign-related, need to be readily accessible. They have to be produced on the spot – as required by the state Office of Campaign and Political Finance.

A: I thought those records are online.

Q: They are supposed to be online, but they are also supposed to be produced on the spot. There is no “file a written request and we will get the information to you.” That would be a violation of the laws coming under the state Office of Campaign and Political Finance. There are some instances throughout town government where things haven’t been accessible as they should be. There’s one town board that had trouble with following the Open Meeting Law, and the state Attorney General’s Division of

Open Government set them straight on that. So, do you have any thoughts on this issue?

A: Going forward, we should look to see if there are any improvements that we can make.

Q: So, how do you see your role as one five members of the Board of Selectmen?

A: I consider myself to be the mom on the Board, looking out for children in the future and looking to promoting events that are good for the town. I’m 100 percent available to anyone that needs me, because the people elected me to do this job. The job as I see it is to have the best Town of Saugus we can possibly have.

Q: And what if people have some ideas or suggestions they want to pass along to you?

A: They can send an email to me at selectmen@saugusma.gov and put my name in the subject space, but they should know that I’m elected as one of five members of the Board. I’m elected to speak, and speak for myself. I think all five of the members of the board bring a different perspective.

Q: Anything else that you would like to share – maybe a holiday message to the residents of Saugus?

A: Yes. I would like to say Merry Christmas and happy holidays to all of the residents of Saugus, and I hope that all of the children of Saugus enjoy their holiday and that they get to see Santa on Christmas Eve and the Annual Christmas Eve Parade. And I just hope that everyone has a happy and healthy new year.

“The group believes that Saugus needs to take a long overdue step forward to have a reduced town-wide speed limit like many of the surrounding towns and cities,” Davis said in a recent press release.

“Two fatalities, an excessive

amount of traffic accidents, many people injured, damage to motor vehicles and property and many traffic violations has made for a very sad and frustrating year on the streets of Saugus. Citizens for a Safer Saugus want to change that,” he added.

Citizens for a Safer Saugus are calling town residents to

come to the Jan. 9 meeting to support the 25 mph speed limit, Davis said.

DiNardo said the bumper sticker and campaign for a 25 mph speed limit sends “a confusing message” to the public.

He also called it an “unfair” attack on the current town administration. “To say somebody is not doing something

because they are not putting a bumper sticker on is the wrong approach,” DiNardo said.

“I don’t think that’s the issue,” he said of the speed limit.

“There are a lot of things needed to improve traffic safety … On some roadways, 25 mph may work. But I want to see what the experts say in a traffic study first,” DiNardo said.

REGULATE MARIJUANA (H 3818) House 136-11, Senate 32-6, approved a bill changing some provisions and adding other provisions to the law, approved by voters on the 2016 ballot, legalizing the possession, growing and sale of marijuana.

The measure taxes all marijuana sales with a 10.75 percent excise tax, 6.25 percent state sales tax and a local option allowing cities and towns to impose an additional tax of up to 3 percent. In addition, any agreement between a retail marijuana establishment and a host community for the first five years may include a community impact fee of up to another 3 percent paid by the seller to the city or town to cover the costs imposed

upon the municipality by the operation of the establishment. Medical marijuana remains tax-free.

If a city or town voted for the 2016 marijuana ballot question, the decision to prohibit or restrict marijuana establishments will be determined by a local city or townwide referendum.

If a city or town voted against the ballot question, the decision would be made by the municipality’s governing body until December 2019 and then by a local city or town-wide referendum.

Other key provisions of the new law include: Allowing persons over 21 to give an ounce or less of marijuana to others; possess up to one ounce of marijuana outside their home and ten ounces in their home. Any quantity above one ounce in the home must be under lock and key.

Allowing each person to grow six plants per person in his or her home, with a maximum of 12 plants per household.

Prohibiting plants that can be visible by neighbors or from a public place and putting growing areas under lock and key.

Giving landlords the right to prohibit smoking or growing of marijuana on their properties.

Allowing advertising on TV, radio, billboard, print or the Internet only in markets where at least 85 percent of the audience is over 21.

How to Cope with Seasonal Affective Disorder Dear Savvy Senior, What can you tell me about seasonal affective disorder?

I have always hated wintertime, but since I retired and am home a lot more, the dark and cold winter months make me depressed and lethargic.

Fighting the Blues Dear Fighting, If you get depressed in the winter but feel better in spring and summer, you may indeed have seasonal affective disorder (or SAD), a wintertime depression that affects roughly 6 percent of Americans.

In most cases, SAD is related to the loss of sunlight in the winter months. Reduced sunlight can upset natural sleepwake cycles and other circadian rhythms that can affect the body. It can also cause a drop in the brain chemical serotonin, which affects mood, and can increase the levels of the hormone melatonin, which can make you feel more tired and lethargic.

If you think you may have SAD, a trip to your doctor’s office is the best way to diagnose it or you can take a SAD “self-diagnostic” test at the Center for Environmental Therapeutics website at CET.org/self-assessment. In the meantime, here are several treatment options and remedies that can help.

Light therapy: The most effective treatment for SAD is sitting in front of a specialized light therapy box for 15 to 20 minutes a day. Light therapy mimics outdoor light to cause a change in brain chemicals linked to mood. It’s most effective when timed to fit a person’s individual circadian rhythm, which varies widely from person to person depending on whether they’re a night owl or a morning lark. You can calculate the proper time for doing light therapy by taking the circadian rhythm test at CET.org/self-assessment.

The best light therapy lamps provide 10,000 lux of illumination, many times stronger than typical indoor light, and have a diffuser screen that filters out ultraviolet rays and projects downward toward the eyes.

Cognitive behavioral therapy: Even though SAD is considered to be a biological problem, identifying and changing thought and behavior patterns can help alleviate symptoms too. To help you with this, choose a therapist who specializes in cognitive behavioral therapy and who has experience in treating SAD. To locate someone in your area, check with the Association for Behavioral and Cognitive Therapies (FindCBT.org), or the Academy of Cognitive Therapy (AcademyofCT.org).

Antidepressants: Some people with SAD benefit from antidepressant treatment, especially if symptoms are severe. Some proven medications to ask your doctor about include the extended-release version of the antidepressant bupropion (Wellbutrin XL, Aplenzin), and antidepressants selective serotonin reuptake inhibitors (S.S.R.I.s), sertraline (also known as Zoloft) and fluoxetine (also known under the brand name Prozac).

But keep in mind that it may take several weeks to notice full benefits from an antidepressant. In addition, you may have to try different medications before you find one that works well for you and has the fewest side effects.

Lifestyle remedies: Some other things you can do to help alleviate your SAD symptoms include making your environment sunnier and brighter. So, open up your blinds, sit closer to bright windows and get outside as much as can. Even on cold or cloudy days, outdoor light can help, especially if you spend some time outside within two hours of getting up in the morning. Moderate exercise such as walking, swimming, yoga and even tai chi can also help alleviate SAD symptoms, as can social activities.

The measure raises the governor’s salary by $33,200, from $151,800 to $185,000; and provides hikes for the other five constitutional officers. It also requires that every two years the salaries of the governor, the other five constitutional statewide officers and the House speaker and Senate president be increased or decreased based on data from the Bureau of Economic Analysis (BEA) that measures the quarterly change in salaries and wages. It also requires that the same formula is used every two years to increase or decrease the stipends that more than 100 other legislators receive for their service in Democratic or Republican leadership positions, as committee chairs or vice chairs and as the ranking Republican on some committees. There is a caveat in all of these cases that the amount of money they receive can never be less than it was when it became law in February 2017.

The measure puts an end to legislative per diems which are travel, meals and lodging reimbursements collected by the legislators.

These reimbursements are given to legislators above and beyond their regular salaries.

Another provision increases the annual general expense allowance for each legislator from $7,200 to $15,000 for members whose districts are within a 50mile radius of the Statehouse and to $20,000 for districts located outside of that radius. This allowance is used at the discretion of individual legislators to support a variety of costs including the renting of a district office, contributions to local civic groups and the printing and mailing of newsletters. Legislators are issued a 1099 from the state and are required to report the allowance as income but are not required to submit an accounting of how they spend it.

The package also gives a $65,000 housing allowance for the governor. Massachusetts is one of only six states that supplies neither a governor’s residence nor a housing allowance, even as Boston is among the most expensive housing markets of any of the state capitals.

(A “Yes” vote is for overriding Gov. Baker’s veto and is for the pay raise. A “No” vote is against overriding the governor’s veto and is against the pay raise.)

HOW LONG WAS LAST WEEK’S SESSION? Beacon Hill Roll Call tracks the length of time that the House and Senate were in session each week. Many legislators say that legislative sessions are only one aspect of the Legislature’s job

and that a lot of important work is done outside of the House and Senate chambers. They note that their jobs also involve committee work, research, constituent work and other matters that are important to their districts. Critics say that the Legislature does not meet regularly or long enough to debate and vote in public view on the thousands of pieces of legislation that have been filed. They note that the infrequency and brief length of sessions are misguided and lead to irresponsible late-night sessions and a mad rush to act on dozens of bills in the days immediately preceding the end of an annual session.

Qualified Business Income Deduction

T

he new Tax Cuts and Jobs Act, effective January 1, 2018, created a new Section 199A, which is known as the qualified business income (QBI) deduction section. It provides taxpayers with a deduction of up to 20% of QBI earned from a business operated as a sole proprietorship or through a passthrough entity such as an S Corporation, Partnership, Estate or Trust.

If you are conducting business as a specified service trade or business (SSTB), and your taxable income exceeds $415,000 (for married filing joint filers) or $207,500 (for all other filers), you will simply not be entitled to the QBI deduction.The new tax act defines an SSTB as any trade or business involving the performance of services in the fields of health, law, accounting, actuarial science, performing arts, consulting, athletics, financial services, and brokerage services. The law specifically excludes engineers, architects, the banking industry, real estate brokers and real estate property managers.

For all other businesses

that are not defined as an SSTB, if taxable incomedoes not exceed $315,000 for married taxpayers filing jointly and $157,500 for all other taxpayers, the so-called W-2 limitations simply do not apply. The deduction is equal to 20% of your QBI, not to exceed 20% of your taxable income.

Once your taxable income exceeds those thresholds, you then need to look at the W-2 limitations. The deduction would then be limited to the greater of: 50% of the taxpayer’s share of the W-2 wages paid by the business, or 25% of the taxpayer’s share of the W-2 wages paid by the business plus 2.5% of the unadjusted cost basis immediately after acquisition of qualified property This essentially means when you purchase a piece of equipment (qualified property), simply look at what you paid for it without reducing its cost by any depreciation deductions taken.

The IRS issued proposed regulations on August 8, 2018. Final regulations have yet to be issued. This section of the new tax law is certainly one of the most complicated and will involve a trial and error approach to this upcoming tax season. There are, of course, no court cases thus far establishing precedent in order to bring additional clarity to the mechanics of this newly-created tax deduction.

Mayor, City Council to apply $12.5 million Wynn payment to reduce tax rate The City Council unanimously approved a proposal by Mayor Carlo DeMaria on Monday, November 13 to apply the entirety of Wynn Boston Harbor’s $12.5 million payment to the City of Everett toward reducing next year’s tax rate. City Council adopts FY 18 tax rate The City Council unanimously voted to adopt a split levy rate on Monday, November 27, shifting the burden from residential to Commercial, Industrial and Personal Property (CIP) at the highest shift of 175 percent.

The FY 18 tax rate will be $13.78 per $1,000 of valuation on residential properties and $33.74 per $1,000 of valuation on CIP properties. If the council hadn’t approved the shift, the flat rate for residential property and CIP would have been $19.28 per $1,000.

The shift will not prevent homeowners from seeing a small increase in their actual taxes, as home values have skyrocketed in the city over the last year.

On average, single-family home values rose by about $39,000 since the last fiscal year, while two-family and three-family residences on average rose $50,000.
