DiDomenico announces landmark criminal justice reform law Sweeping bill signed by the governor enator Sal DiDomenico (D-Everett), the Assistant Majority Leader of the Massachusetts Senate, recently announced that the landmark criminal justice reform package crafted by the Massachusetts Legislature has been signed into law. He had previously joined his legislative colleagues in overwhelmingly voting to pass this sweep-

ing piece of legislation, and last week Governor Charlie Baker signed the bill into law.

An Act relative to criminal justice reform will lead to a more equitable system by supporting our youngest and most vulnerable residents, reducing recidivism, increasing judicial discretion and enhancing public safety. The legislation contains provisions to pro-

vide better care for vulnerable populations in the criminal justice system, and it implements policies to strengthen protections for public safety and witness protection.

The Legislature also passed an accompanying bill, An Act implementing the joint recommendations of the Massachusetts criminal justice review, which is designed to complement the comprehensive criminal justice reform legislation. The bill allows individuals to earn early release by participating in recidivism-reduction programs. â&#x20AC;&#x153;The provisions in this reform package make critical changes to outdated and unjust aspects of our criminal justice system, bringing it in-line with our principles of rehabilitation and reduced recidivism to promote better outcomes and ensure the welfare of all,â&#x20AC;? said Senator DiDomenico. â&#x20AC;&#x153;This bill passed by my

colleagues and I in the Legislature is both thorough and thoughtful, and I am confident that it will go a long way towards addressing the issues plaguing our current criminal justice system.â&#x20AC;?

For the first time in Massachusettsâ&#x20AC;&#x2122;s history, this legislation establishes a process for expunging criminal records.

Courts will now be able to expunge certain juvenile and young adult (18-21) records, and records in cases of fraud or where an offense is no longer a crime.

The Legislature has a longstanding legacy of supporting the Commonwealthâ&#x20AC;&#x2122;s most vulnerable children, particularly those facing trauma and adversity. Accordingly, this bill raises the minimum age of criminal responsibility from seven to 12 and decriminalizes a first-offense misdemeanor if the punishment is a fine or imprisonment for not more than

The legislation establishes a Juvenile Justice Policy and Data Commission, which will make the state eligible for additional federal funding, and a Childhood Trauma Task Force to study and recommend gender responsive and trauma-informed approaches to treatment of youths in the juvenile justice system. The bill also extends Good Samaritan protections to alcohol incapacitation for individuals under 21.

This legislation reflects a balanced, modern approach to sentencing. It eliminates mandatory and statutory minimum sentences for many low-level, nonviolent drug offenses. Additionally, it creates the nationâ&#x20AC;&#x2122;s strongest law for Carfentanil trafficking and strengthens the existing Fentanyl trafficking law, bolstering the Legislatureâ&#x20AC;&#x2122;s multitiered approach to the opioid epidemic. The legislation also strengthens penalties for repeat offenders convicted of Operating Under the Influence (OUI).

The new law requires district attorneys to create pre-arraignment diversion programs for military personnel, veterans and individuals with addiction and/or mental health issues in order to combat the opioid epidemic and provide healthcare parity. It also expands diversion programs to the Juvenile Court and removes the existing age restriction on diversion in the District Court.

SOUNDS OF E VERET T City Council to review three candidates for legislative aide on Monday The Legislative Affairs Committee has recommended three candidates for the council’s open Legislative Aide position after over two hours of interviews in executive session with 11 candidates last

Thursday, April 12. The committee recommended Joetta Lynn Yutkins, former Councillor-at-Large Michael Mangan and David Flood. The full council will review the candidates and make a decision

during the council meeting on Monday, April 23.

The other applicants for the position were Diana Guardado, Kathy Samartino, Sergio Valle-Rodriguez, Gregory Carnick and Jessica Menjivar.

Smith pulls papers after five year ban Former State Representative Stat Smith, freshly able to legally run for elected office, is looking to get his old job back, having taken out nomination papers for the Democratic nomination for the 28th Middlesex District State Representative seat last Friday, April 13. Smith’s entrance will make for a threeway race between incumbent Joseph McGonagle and returning challenger Gerly Adrien.

Smith was a member of Everett’s Board of Aldermen in the

late 1990s, and a member of the Common Council in the early 2000s before running an unsuccessful campaign for mayor. In 2006, he was elected State Representative after the passing of Representative Edward Connolly.

Smith served in the seat for six years. He was forced to resign on January 1, 2013, after pleading guilty to two federal misdemeanor counts for a voter fraud scheme in which absentee ballots were cast for voters who were ineligible or unaware that

ballots were being submitted in their names. Under a plea deal, Smith served three months in a federal prison in Fort Devens and wasbarred from running for office for five years. That ban ran out at the end of 2017.

Smith’s seat was filled by Wayne Matewsky after a special election in 2013. In 2014, then-Councillor Joseph McGonagle defeated Matewsky in a regular election. McGonagle went on to defeat a challenge

by Adrien in 2016.

Shortly afterward, Wynn Resorts’ CEO, Matthew Maddox, released a somewhat cryptic statement, seemingly to justify any potential sale as something the company may find itself forced to do, should some of the implications of Crosby’s comments begin to manifest. “Our company stands for quality and five-star service and is uniquely situated to deliver one the best integrated resorts in the world for both customers and employees in Everett, Massachusetts,” said Maddox. “We remain very excited about the Boston mar-

The investigation took on new urgency for the developer on March 29 when Gaming Commission Chair Steven Crosby informed casino officials that Wynn Boston Har-

Any sale would produce a sea change in the state’s casino economy before it even begins. MGM is currently only a month away from completing a $960 million Springfield, Mass., resort, but because gaming regulations prohibit a company from holding more than one license in state, MGM would have to sell that property to another operator in order to purchase Wynn Boston Harbor.

“More than just a casino” Officials in Everett are nervous about the prospect of a new operator in the city, having worked closely with Wynn Resorts for more than half a decade and fearing that a new operator may not live up to what Wynn has promised the community. It is common to hear city officials talk about Wynn Resorts as “more than just a casino,” using phrases like “transformative” and “catalyst” and imaging the property as more of a massive entertainment resort. Many seem to fear that with MGM what the city would be hosting on Lower Broadway would, in fact, be “just a casino.”

Mayor Carlo DeMaria, one of the casino project’s staunchest supporters in the city, has been particularly bullish on Wynn Resorts’ continued involvement in the project. “There’s a grander vision here than just a casino,” May-

The Wynn Corporation has demonstrated it can partner with us to fulfill that vision. Mayor DeMaria went on to state that he was “encouraged” by the fact that the commission had begun the process of removing Steve Wynn as a qualifier from the project’s gaming license. “I believe that anyone else who is found unsuitable as a result of their process should also be removed so we can move forward on this project,” said DeMaria.

“This high-performing organization of 27,000 employees worldwide is the right partner for us, right now, and I want their work to continue on in Everett.”

The City Council is also looking to make sure that its voice is heard, with Councillors Wayne Matewsky, John Leo McKinnon, and Rosa DiFlorio filing an order for Monday’s meeting agenda calling for reps from Wynn and MGC to give them an update.

Everett baseball coach puts emphasis on improvements

By Julian Cardillo he Everett baseball team is dealing with its youth and inexperience and taking its knocks, and head coach Joe Lento is preaching patience.

Everett is now 1-4 on the season after Wednesday’s loss to Peabody, and Lento insists his team is a work in progress.

“It pains me to say we’re 1-4 so

far,” Lento said during practice this week. “It’s not that it’s okay to lose or that we’re fine with losing – but I think it’s part of the process, and this team – this inexperienced and young team – has to find itself and carve out its identity.”

The Crimson Tide are playing in the Northeastern Conference (NEC), one of the top leagues in Massachusetts

baseball. Most of the teams north of Everett have a long and established history of high-level competition; The Tide, who are in their second season in the NEC after leaving the Greater Boston League, are still finding their footing.

“It doesn’t get easier for us but we’re going to push through,” Lento said. “We’re still learning. But high school

baseball is fairly straightforward, and we’re showing progress. You have to throw strikes, limit your mistakes …”

Everett’s next game is tentatively scheduled for Friday against Revere. Those interested in attending should double-check on a potential change in location, per Revere’s head coach.

Lento is looking forward to

the game and is pleased with how his team is progressing, particularly on the mound.

“Honestly, I think our starting pitching has been great,” Lento said. “They’ve all been solid for us, and we just need to give them more support. Revere may be in a rebuild but they’re already 3-1, so they’re doing something right. It should be a good game for us.”

Though the Crimson Tide fell, 19-1, to Peabody on Wednesday, the team put together a well-rounded, 12-7 victory over Salem on Tuesday.

“Unfortunately our bats just weren’t there against Peabody,” said Everett coach Stacy Schiavo. “Peabody was hitting the ball very well, and our errors only helped them score

more runs. The wind held the ball, making our outfield have a hard time adjusting to the direction. When you face a good hitting team, like Peabody, we need to make sure that routine plays are done correctly to help the pitcher out.”

The Tide played a more complete game against Salem the previous night. Ariana Garay was on the mound for seven innings, giving up five hits, a walk and four earned runs.

With two outs in the third, Nearen doubled and later scored as Izza Bourouis notched an RBI single to make it 5-0.

The Crimson Tide made it 8-0 in a monster fourth inning.

With two outs, Kloey Cardillo hit a triple and later scored on an error at first involving Garay. Garay moved to second on a pass ball, then scored on Duraes’ outfield single. Everett rounded out the scoring as Smith recorded her second RBI double.

In the fifth, Lexi Bartolomeo reached first on a pitching error and moved to second on a pass ball. Ashley Fitzgerald got on first on a throwing error at third, and then Veronica Bento drew a walk. With the bases load for Everett, Cardillo singled to score Bartolomeo and Fitzgerald. With two outs, Duraes doubled to score Bento and Cardillo, making it 12-5.

Dear Savvy Senior, What numbers constitute high blood pressure? I use to be pre-hypertensive, but they keep changing the guidelines, so Iâ&#x20AC;&#x2122;m not sure where I fit in now.

Approaching 60 Dear Approaching, If youâ&#x20AC;&#x2122;re unsure what your blood pressure levels should be, youâ&#x20AC;&#x2122;re not alone. Recent changes in the hypertension guidelines made by the American Heart Association and the American College Cardiology mean that roughly 30 million more Americans than previously thought are now considered to have high blood pressure (hypertension).

According to the new guidelines, anyone with a blood pressure reading above 130/80 is considered to have high blood pressure.

Previously, those with a blood pressure reading between 120/80 and 139/89 would have been put in the prehypertension category and wouldnâ&#x20AC;&#x2122;t have been considered hypertensive until they got to 140/90.

But the new guidelines eliminate the prehypertension category, putting everyone with systolic pressure readings (top number) between 120 and 129 and a diastolic reading (bottom number) below 80 in a new â&#x20AC;&#x153;elevatedâ&#x20AC;? category. And those with a reading of 130/80 or higher fall in some stage of hypertension. Hereâ&#x20AC;&#x2122;s a complete rundown of the new five category blood pressure ranges: Normal: A top number less than 120 and a bottom number less than 80.

Elevated: A top number between 120 and 129, and a bottom number less than 80.

Stage 1: A top number between 130 and 139, or a bottom number between 80 and 89.

Stage 2: A top number of 140 or higher, or a bottom number of 90 or higher.

Hypertensive crisis: A top number over 180 or a bottom number over 120.

Even if your blood pressure numbers are in the â&#x20AC;&#x153;stage 1â&#x20AC;? category, lifestyle changes are recommended first, unless youâ&#x20AC;&#x2122;ve had a heart attack or stroke, or youâ&#x20AC;&#x2122;re at high risk for cardiovascular problems because you smoke, have high cholesterol or type 2 diabetes. Then medications may be prescribed.

But if your blood pressure falls in the â&#x20AC;&#x153;stage 2â&#x20AC;? or higher category, the new guidelines suggest medication, regardless of age, plus lifestyle changes.

There are several different kinds of drugs used to lower blood pressure. It usually makes sense to start with the oldest, safest, and least expensive drug: diuretics, or water pills, such as chlorthalidone or hydrochlorothiazide. But these meds can drive up blood sugar levels, so if you have type 2 diabetes or are at risk of it, your doctor may prescribe another drug, such as an ACE inhibitor, ARB or calcium channel blocker.

Following reforms in 2010 and 2012, this legislation again updates the Commonwealthâ&#x20AC;&#x2122;s Criminal Offender Record Information (CORI) system to help individuals secure gainful employment and housing, enacting the following policies: â&#x20AC;˘ Reduces the wait time to seal a conviction from 10 years to seven years for a felony, and from five years to three years for a misdemeanor. â&#x20AC;˘ Allows a conviction for resisting arrest to be sealed. â&#x20AC;˘ Expands the ability of an applicant with a sealed record to be able to answer â&#x20AC;&#x153;no recordâ&#x20AC;? on housing and professional license applications. â&#x20AC;˘ Establishes protections for businesses and landlords who shall be presumed to have no notice or ability to know about

criminal records that have been sealed or expunged.

This legislation updates the Commonwealthâ&#x20AC;&#x2122;s bail system and enhances judicial discretion by requiring a judge to take a personâ&#x20AC;&#x2122;s financial resources into account when determining bail. Also, it raises the threshold for larceny to qualify as a felony from $250 to $1,000. It also creates the crime of solicitation that is tied to the severity of the underlying crime. Additional policy changes include the following: reduction of fees imposed on defendants; decriminalization of minor offenses; enhanced limits on solitary confinement; improvement of prison conditions; and release of prisoners who are permanently incapacitated and pose no safety risk.
