set the School Department’s continuing budget struggles. The budget will keep the schools going through what is proving to be a difficult budget season citywide, but not without 98 layoffs, 67 of them teachers. According school officials, an additional $5.5 million would be necessary to keep on these employees. But with the city low on cash reserves, a tightening-of-the-belt going on across the city awaits the new revenues it expects to accompany Encore Boston Harbor’s opening in 2019, and additional state appropriations unlikely to arrive in time, officials have shown little optimism in their prospects of digging up such a sum.

However, school administrators and city officials are downplaying that those layoffs will change performance in the district.“The feeling is that even though you’re short, you’re going to find a way to get the results,� Council President Peter Napolitano told Superintendent of Schools Fred Foresteire. “The kids have always been at the forefront.�

Foresteire maintained that turnover is a natural part of school administration. It’s not strange for any school system to see people go and people come,� he told the Budget Committee. “There’s always turnover. Every year there is.�

n Tuesday, June 5, Mayor Carlo DeMaria, along with over 110 mayors and county officials, sent a letter to the Speaker of the U.S. House of Representatives, Paul Ryan, and the U.S. House Minority Leader, Nancy Pelosi, urging them to bring the DREAM Act up for a vote. (DREAM stands for Development, Relief, and Education for Alien Minors.) The letter commends the bipartisan efforts on House Resolution 774, which seeks to break the impasse in Congress and allow the House of Representatives to vote on four bills, including the DREAM Act, which would provide a pathway to citizenship to Dreamers.

Although the localities with officials who have signed the letter have made significant local efforts to support Dreamers, the signatories want Congress to use its power to pass legislation to protect Dreamers and provide them with a permanent place in the country they call home. The mayors and county executives who have signed the letter to Congress are part of Cities for Action, a coalition of over 175 cities and counties that represents over 70 million residents and leads on immigration action through federal advocacy and local programs.

Mayor DeMaria has strongly advocated continuing to protect residents through the DREAM Act. In November he sent a resolution to the U.S. Congress and held a press conference highlighting the importance of the DREAM Act and Temporary Protected Status (TPS) and the need to create a legal pathway to citizenship for those affected by these programs, as they can make even larger contributions

to our country, whose greatness has always relied on the hard work, innovation and diversity of its newest citizens.

Mayor DeMaria stated, â&#x20AC;&#x153;I implore Congress to act immediately on immigration reform, which has long had support from both political parties. We need to create pathways to citizenship for those here through TPS and through the DREAM Act, through federal legislative action, before the programs expire. This is who we are as Americans; we simply cannot turn our backs and remain silent when we see such injustice. Let us continue to work together and demand action.â&#x20AC;?

Below is the letter: Dear Speaker Ryan and Minority Leader Pelosi: We, the undersigned mayors and county executives, urge you to move expeditiously to pass a bipartisan solution with a pathway to citizenship for Dreamers that does not further harm immigrant communitiesâ&#x20AC;&#x201D;the DREAM Act. We are gravely concerned about the futures of Dreamers, hundreds of thousands of whom know our cities and counties as home. We

are equally concerned about the increases in immigrant detention and non-criminal arrests over the past year. Congress can and must provide permanent protections for Dreamers without increasing enforcement measures against immigrants at large.

As local leaders we work closely with our residents. We know first-hand that immigrants are cornerstones of our communities who contribute with their diverse perspectives and ingenuity to our local economies and participate robustly in civic life. This is why we are members of Cities for Action, a national coalition that advocates for inclusion of immigrants into our communities to create stronger, safer, and more prosperous cities. Our coalition includes over 175 mayors and county executives, representing over 70 million residents, including 17 million foreign-born residents. Everett Independence Day Celebration on July 7 Fireworks a Celebration highlight for a second year in a row

ayor Carlo DeMaria and the City of Everett are pleased to once again invite Everett residents to the Cityâ&#x20AC;&#x2122;s Independence Day Celebration. This yearâ&#x20AC;&#x2122;s event will be held on Saturday, July 7 beginning at 4:00 p.m. at Glendale Park. For a second year in a row, a grand finale fireworks show is featured.

The fireworks show, which will be shot off at Glendale Park and timed to an exciting musical accompaniment, will be after sundown at approximately 9 p.m.

Mayor DeMaria stated,â&#x20AC;&#x153;This is a day that you donâ&#x20AC;&#x2122;t want to miss â&#x20AC;Ś I am glad we were able to bring this tradition back to our community. As Mayor, it has al-

DiDomenico supports extreme risk protection order legislation

L

ast week Senator Sal DiDomenico (D-Everett), who is Assistant Majority Leader of the Massachusetts Senate, and his colleagues voted to engross H.4539, An Act relative to firearms. The legislation, which was cosponsored by Senator DiDomenico, allows a judge to order the immediate suspension and surrender of any license to carry firearms from an at-risk person when petitioned by that per-

sonâ&#x20AC;&#x2122;s family or household member. Such an order is called an Extreme Risk Protection Order (ERPO). The bill is also known as the â&#x20AC;&#x153;red flagâ&#x20AC;? or ERPO bill.

The legislation supplements Massachusettsâ&#x20AC;&#x2122;s extensive commonsense gun control and public safety regulations, which have led to the lowest rate of gun deaths in the nation. Additionally, the bill amends the statute regulating stun guns.

â&#x20AC;&#x153;This Extreme Risk Protective Order bill will provide us with the additional tools necessary to help prevent gun-related tragedies and protect public safety,â&#x20AC;? said Senator DiDomenico. â&#x20AC;&#x153;With todayâ&#x20AC;&#x2122;s vote, Massachusetts is once again taking the steps needed to lead the nation with commonsense gun legislation that will undoubtedly help

Mayor DeMaria stated, “Every day firefighters put their lives on the line to save people and property. I want to thank them for the valuable service they provide, and let them know that we are very aware of the positive impact they have on our community.”

By participating in this event put on by the IAFF and Boston Fire, Mayor DeMaria and fellow mayors were able to see firsthand what firefighters do on a daily basis to protect cities and towns. VERETT – Today, during a special ribbon cutting ceremony, the Baker-Polito Administration celebrated the completion of the new Allied Veterans Memorial spray deck in the City of Everett. The Massachusetts Department of Conservation and Recreation (DCR) oversaw the construction project, which will provide children and their families with additional recreational opportunities and a respite from the summer weather. The total cost of the project is approximately $1.8 million, which will include

the future renovation of the Allied Veterans Memorial pool later this fall.

“The Baker-Polito Administration remains dedicated to enhancing the Commonwealth’s state parks system in an effort to provide exceptional outdoor recreational opportunities for people of all abilities to enjoy,” said Department of Conservation and Recreation Commissioner Leo Roy. “The DCR is excited to deliver this new family-friendly spray deck within the City of Everett, where area children will be able to play and in-

BUDGET | FROM PAGE 1 There’s another personnel wrinkle: No raises are included in this year’s budget, but employees and the administration are currently in the midst of negotiations. Any contract increase would likely require the schools to go before the City Council for an additional appropriation.

Despite the growing pains of this year’s budget, Foresteire remained bullish throughout the meeting on the School Department’s accomplishments in the face of underfunding. “There’s a misconception that

growth is bad. It’s a good thing to see that people are coming here and not running away from us,”said Foresteire.

“It says a lot for the city. We’ve been in the Mayor’s Office many times where representatives from various countries wanting to know why their people are coming to this city: what’s happening in the schools, what’s happening in the city. It’s a good thing. And our thing is to manage it, that’s all.

And I know one thing: If we shortchange those children, young people, young families, we’re in trouble.”

With the schools already on such a reduced budget, no cuts were se-

riously considered by the committee. It was almost unanimously recommended out for the full council’s review and approval at their June 22 meeting. Only Ward 2 Councillor Stephen Simonelli voted against recommending the budget.

With an additional appropriation from the city provided by Mayor Carlo DeMaria of $6,500,000, as well as a special education transportation budget of $4,700,000, the school’s total FY19 budget will be $81,380,955.

According to Assistant Superintendent Charlie Obremski, this budget represents a minimal increase, even as the district is educating several hundred more students. “Without the help of the mayor or the auditor proposing an additional $6.5 million, the budget would only be up $95,665 from what it was set at in FY18,” said Obremski.

“At that May 2 meeting, the mayor made it clear that he saw no cuts in the budget,” said Foresteire. “He’s offering the $6.5 million to try and relieve this problem, and to quote him, ‘If I had more money, I’d give it to you.’The fact is, we have not kept pace as a city. If you see what oth-

er communities are paying above net school spending – because the state wasn’t paying their share, the cities were paying more – and that wasn’t happening with us, and now we get caught where we are right now.”

According to Obremski, the local contribution towards the foundation budget is $28,814,865, with Chapter 70 aid from the state amounting to $66,400,961.

The School Department has been struggling for three years with a change in how the state allocates aid for free and reduced lunches for economically disadvantaged students.

Previously allowing districts to count the number of students in need of aid on their own, the state instead created a system whereby only student’s whose families receive benefits under federal and state poverty programs, such as food stamps, would qualify. In Everett, where a number of students who do need assistance but whose families either do not qualify for the programs or face significant barriers to access them, that meant that it suddenly lost funding for 2,000 students. At roughly $4,000 a student, that change has blown an $8 million hole into the School Department’s budget year after year.

A change to the formula has been included in the State Senate budget by Senator Sal DiDomenico that would fix the problem, allowing the city to use the old formula while other communities continue to use the new one. Even if that change makes it into the house budget and survives the conference process, it would have no impact on this year’s budget, being able only to prevent similar shortfalls in future budgets.

Recent federal court decisions currently allow DACA recipients to apply for renewals but DACA recipients are hesitating to renew because of the uncertainty over the future of the program, despite our robust efforts at the local level to conduct community outreach.

We are concerned that Dreamers without DACA status will be in danger of deportation. Every day that Congress fails to pass legislation, more young lives are thrown into chaos.

DACA recipients have done everything the government has asked of them in good faith: they have proven that they are not public safety threats, submitted to regular check-ins, earned degrees, served in the military, and paid their taxes. They deserve a permanent place in this country they call home. We commend the bipartisan efforts on House Resolution 774 which already has the support of over half of the House of Representatives. We urge you to listen to these Members of Congress and bring legislation that protects Dreamers up for a vote. This is an opportunity to pass the DREAM Act, and finally provide Dreamers the protection they deserve.

Everett softball team bows out of post-season

T

he Everett softball team bowed out of the 2018 season, falling in the state tournament on Monday night at Concord-Carlisle. Everett showed off some good offense in the elimination game, but ultimately fell 9-4.

For coach Stacy Schiavo, reaching this point in the campaign was a huge step forward.

“The girls improved so much from the beginning of the year,” she said. “Once they got comfortable in their positions, the lineup fell into place for them.

Standing out at Everett High School is no easy task with the amount of students that go there. However, Fonseca was not afraid to stand out at the large school. The class of 2018 had 497 graduating students.

Fonseca has been stepping out of his comfort zone all four years, and says that’s the key to stand out among 497 students. “You need to get really involved in community service and just put yourself out there,” Fonseca said.

Kiwanis hosts Inaugural Mastrocola Bocce Tournament E

verett Kiwanis is proud to announce the winners of its inaugural Frank Mastrocola Bocce Tournament, which was held on Saturday, June 9.

A team sponsored by Rocco Longo of Sabatino Insurance won the daylong double elimination tournament. It consisted of John Bonanno, Neil Perry, Pia Frittitta and Ralph Bagarella.

The winning team immediately donated the $750 back Neil Perry, Pio Frittitta, John R. Bonanno, and Ralph Bagarella to Everett Kiwanis. This genRita Eliseo Tammy Turner erous act brought the total earnings of the event to over $6,000. All of said money goes to a Kiwanian scholarship fund that this year again awarded $10,000 to graduating Everett High School students.

Carmine Matarazzo captained the second-place team, which was awarded $250 in prize money. Attorney John Mackey won the largest of the many raffles, securing a book of lottery tickets worth $750.

Fonseca worked hard to get involved in clubs and the community, but he worked harder to achieve high school’s greatest honor. Fonseca said “being valedictorian was incredibly tough,” but the competition between him and salutatorian My Doan all four years seemed like a battle. “We were battling our entire high school career; we were .02 GPA points apart at the end,” Fonseca said.

Being valedictorian is incredibly tough, but Fonseca’s work ethic is really what he gives credit to. “People assume that I spend 40 hours a week studying and doing homework.

That’s not the case at all,” Fonseca said. Fonseca would usually finish all his work at school

and then finish the rest, if any, at home, and on top of that he would also work 20 hours a week at an accounting office.

Fonseca will be starting a new chapter of his life in the fall when he will attend Brown University in Providence, R.I. However, the recent grad did have some mixed emotions about attending a school so far from home. “I’m excited and a little anxious at the same time,” Fonseca said.

Fonseca is excited that Brown offers a flexible schedule so he can take the subjects that interest him the most; yet he is also very anxious about living away from home and being on his own. However, Fonseca’s excitement for the fall outweighs his nervousness. Brown is the valedictorian’s number one choice, and he is “beyond blessed” that he will have the opportunity to attend his number one choice. If he had not gotten into Brown, he would have had to pick between two other Ivy League

schools: either Princeton or Yale.

Fonseca is the youngest of three boys, and will be following his brothers as business majors. Fonseca plans on majoring in Economics and already has a set of goals that he wants to achieve. “My goal is to lead a company dedicated to improving people’s lives somehow,” Fonseca said, “or maybe it could have another focus, but I’ll certainly make sure to donate a portion of our revenue to charities and other organizations.”

Fonseca looks to continue his community service way beyond his high school and college careers. Fonseca also wants to get his MBA and can see himself working hard enough to obtain one.

As for Fonseca’s final words of encouragement to the class of 2019, as he said multiple times in his valedictorian speech: “No matter where you come from or what your background is, you can do it.”

Livery service licensing authorities (a) An application for a new or renewing license for a livery service operating in the city with no more than two (2) livery vehicles may be approved by the city clerk as long as only the standard conditions and restrictions for a livery service license need to be placed on such license. (b) Requests to amend a livery service license may be handled in the same fashion as a new or renewing livery service license unless such modification will cause the criteria allowed for approval by the city clerk to be exceeded. (c) The city clerk shall notify the city council, in writing and in a timely fashion, of all new and amended livery service licenses that he so approves. (d) All applications for new, renewing or amended licenses for livery services operating in the city not approved by the city clerk shall be submitted to the city council. (e) If, in the opinion of the city clerk, after consulting with the city solicitor and/or the president of the city council, if necessary, the holder of any livery service license is not in compliance with any of the conditions placed on their license, the city clerk may, as circumstances dictate: (1) Issue fines in accordance with Section 1-8 of these Revised Ordinances; and/or (2) Suspend such license if there is sufficient evidence to indicate that the public safety would be endangered by the continued operation of the license holder. Such license may only be suspended until a revocation hearing can be held by the city council. (f) Only the city council may, for cause and after a duly advertised hearing, revoke a livery service license. (g) The city council may, within its discretion, limit the number of livery services licenses issued per capita.

Section 12-264 is hereby amended by inserting the following new subsection (a) and re-sequencing all of the sectionâ&#x20AC;&#x2122;s existing subsections accordingly; (a) Before the city clerk shall issue a livery service license, the approved petitioner shall pay the required annual fee for such license. The base annual fee for a livery service license shall be one hundred twenty dollars ($120.00). The annual fee for a livery service license shall be increased by fifty dollars ($50.00) for every livery vehicle licensed by the approved petitioner in excess of two (2) livery vehicles.

For many years, he loved coaching Everett youth hockey and baseball, and never missed his sons' sporting events, or his nieces' and nephews' games. For George, it was never about winning but it was always about showing sportsmanship and being the best you could be. George also had a love for Cape Cod and the beach. Many happy memories were made while summering in Dennis Port where George taught his sons, nieces and nephews the love of fishing, digging for clams and quahogs, and setting lobster traps in the Cape Cod Canal. A loyal friend, George had several dear friendships that he cherished. With a close circle of friends, George loved a good competitive game of cards, and looked forward to their annual trip to Saratoga, NY for horse racing. George was an incredibly generous and thoughtful man to anyone in need. He took great care of his family, and was always ready to offer his support. George set a quiet example with his actions, and was forever proud of his family. He will be greatly missed, but always lovingly remembered. George was the beloved husband of Phyllis M. IMPLIED LIFE ESTATES T he tax court case in Linderme v. Commissioner, 52 T.C. 305 (1969) clearly states that the value of real estate can still be includable in the decedent’s taxable estate even if there was no actual reserved life estate on the deed itself. For example, if a 90 year old man deeded his home to his 3 children and reserved a life estate on the deed itself, the fair market value of the real estate would become the new cost basis going forward in the names of the three children.

So long as the fair market value of the home is not greater than $1million and assuming there are no other assets owned at the time of death, there would be no Massachusetts estate tax to be paid. Certainly no federal estate tax with the new $11million exemption as part of the new tax act that took effect on January 1, 2018.

If the children sell for $1million, they would pay no capital gains tax as well. Therefore, as part of an estate plan/tax plan, we want the value of the home to be includable in the taxable estate of the decedent.

In the Linderme case, there was no reserved life estate on the deed itself. The judge found that there was an understanding on the part of all parties that the father was to live in the home until the day he died. The father lived in the house rent free until the day he died. None of the children resided in the house with him.

Upon the death of the father, the house was sold, estate bills were paid and the net proceeds were split among the three children.

The Judge ruled that the decedent retained the possession and enjoyment of the home until the day he died. The Judge found that there was indeed an understanding of all parties that this was the case. He found that the value of the home should be includible in his taxable estate under Internal Revenue Code Section 2036(1)(a). The decedent had exclusive possession of the home.

There are times when you really want the real estate to be includible in the taxable estate so that a very large capital gains tax can be avoided. This is one tax court case not to forget.
