Members approve new by-law to crack down on illegal stormwater discharges and bring town into compliance with EPA By Mark E. Vogler

H

omeowners and businesses could be paying criminal fines of up to $300 per violation each time they are cited for illegal discharges under a new stormwater By-law adopted unanimously Monday night during the opening session of this year’s Annual Town Meeting. As an alternative to criminal prosecution or civil action, the town could also pursue noncriminal dispositions against violators -- ranging from $100 for the first violation up to $300 for the third violation.

Those are some of the monetary consequences of Article 15 -- which provides for the regulation of discharges to the municipal storm drainage system, with the town’s Department of Public Works designated as the official agency authorized to enforce the new law. “The purpose of this By-law is to improve and protect water quality, reduce erosion and sedimentation, promote environmentally sensitive site design practices, and insure longterm maintenance of stormwater controls,” noted the 11-page document.

he state Department of Environmental Protection (MassDEP) violated a longtime law that requires local review of Wheelabrator Technologies, Inc.’s plans to expand its ash landfill, a regional environmen-

tal group claimed in a lawsuit this week. “MassDEP approved the expansion of the Landfill despite the fact that Wheelabrator does not have a valid site assignment for the Landfill,” the Conservation Law Foundation Inc. (CLF), alleged in its complaint filed Wednesday in Suf-
