DR, the owner of the Gateway Center mall is out of compliance with its license and will have to work with Encore Boston Harbor to complete a key connection in the Northern Strand Community Trail, the state Department of Environmental Protection (MassDEP) ruled recently.

Because the mall is located on filled tidelands, DDR had to receive approval from the state environmental agency to build on the property. The license issued to the company in 2001 requires that it maintains a 23.5 acre waterfront park and its associated pathways and amenities. DDR has disputed its responsibility to build the bike path since the original paperwork in the possession of the state was lost in a fire.

Smith an embarrassment to Everett politics and voters

It was an exceptional Fourth of July with the Boston Pops running a three-hour concert. While at home, escaping the heat, I was amazed to see a “close to extinct� butterfly. What a shame! Shouldn’t the butterfly be on the government’s endangered species list?

Just thinking, which is hard to do in the boiling hot summer heat, that Smith should give back to the state the Rep’s pay he was paid in two elections that he plead guilty in Federal Court for tampering with absentee ballots that won him a rep’s seat twice illegally.

And about the call for a Reps debate by Smith and Gerly: They said there will be an empty chair if Rep. McGonagle doesn’t take part. A debate? What a joke. What’s Gerly going to ask Smith – where have you been the last five years? It won’t happen. Ask yourself why.

How about another question Gerly should ask Smith: What did you use to white-out the names on the absentee ballots you stole from the voters? Was it white-out and a Q-tip? How many ballots did you change? Well, I guess enough to illegally y win two elections. If Joe McGonagle skips this nothing debate you can’t blame him.

He’s focusing on door-to-door. To Joe that’s more important. Both Smith and Gerly have very little, if anything, to debate with an experienced Councillor and Rep such as Joe McGonagle. Smith pled guilty to absentee ballot fraud, and Gerly suddenly appeared on the local political scene without any past experience as an elected official. By the way, one might ask, where has Gerly been on the political scene the last two years after McGonagle won the last election for State Rep? Nowhere to be heard from on any state or local issue.

Don’t be fooled, folks. Smith is greedy and arrogant. He’s an embarrassment.

This blog says a lot about Smith and his character. It’s surely worth repeating. According to a “Massachusetts Politics� blog, “At the time of Smith’s “guilty plea,� here’s what Lanny Breuer, then an assistant attorney general of the Commonwealth said: ‘Representative Smith compromised the legitimacy y of his races for public office by facilitating the casting of invalid ballots for ineligible and unaware voters. In doing so, [Smith] undermined the democratic process in Massachusetts and violated the public’s trust.’ “Carmen Ortiz, then the U.S. Attorney for the District of Massachusetts, said: ‘Fair and free elections are the foundation that this great nation was built upon. DDR officials have reportedly been concerned about liability should building the path disturb soil contamination that is capped on the property.

Other violations according to the letter include: • Failure to submit a copy of a final Easement and Maintenance agreement for approv-

al to DCR • Failure to construct a lookout platform and the appropriate lighting • Failure to submit a revised landscape plan with written approval in consultation with DCR

by October 12, 2001 • Failure to provide 40 parking spaces for Gateway Park patrons (only 39 spaces are currently provided) • Failure to construct authorized structures within five years of date of issuance of the license These failures, according to the letter, “prevented the Department from participating

with DDRC Gateway LLC to develop or refine a mutually agreeable final design for implementation and maintenance of the Gateway Park. Absent these submittals and cooperative approval, several additional Gateway Park amenities such as fully accessible walkways and crosswalk connects, a viewing platform, park lighting, signage and Gateway Park promotion were either inadequately met or were not implemented at all. The Department is requiring the cooperating of DDRC Gateway LLC to resolve these matters as soon as possible.”

The Department has issued a number of new requirements for the company in order to bring their license back into compliance. Within eight months of the notice, DDR “shall construct and open for public use a bicycle path … OR, within-30 days of this NON, DDRC Gateway LLC shall submit to the Department a fully executed Memorandum of Agreement with Encore Boston LLC containing timeline commitments and agreements for access and construction as necessary to ensure completion and opening for public use said path within 8 months of this NON.” Within 21 days of the notice, DDR is to submit a timeline, approved by the state, for the submission of a final Landscape Plan, which will address all of the deficiencies described in the

decision, along with a timetable for completing all of the missing Gateway Park elements.

Within 30 days of the decision, DDR must submit a final Easement and Maintenance agreement between DDR and the Department of Conservation and Recreation, including a schedule for implementing all of its outstanding commitments.

City of Everett and Encore officials have been pushing for the state to intervene in the case after months of unsuccessful negotiations with DDR. In May, the Conservation Law Foundation sent a letter to the state asking them to require DDR to provide “compensatory mitigation commensurate with the duration and severity of the site’s deprivation of the proprietary rights of the Commonwealth.”

Conversion therapy exposes the person to a stimulus while simultaneously subjecting him or her to some form of discomfort. â&#x20AC;&#x153;The idea of conversion therapy is that there is something wrong with being LGBTQ, and that a licensed medical professional can eliminate those feelings through practices like hypnosis, aversive conditioning or inducing nausea,â&#x20AC;? said Rep. Jeffrey Sanchez (D-Boston). â&#x20AC;&#x153;The reality of the matter is that it has been proven ineffective, is contrary to medical research, and subjects young people to the risk of suicide and other serious psychological harms. We should validate our youth for who they are, and not try to shame them by subjecting them to harmful therapies and antiquated social norms.â&#x20AC;?

The Massachusetts Family Institute (MFI) opposed the bill and any laws that restrict the ability of licensed counselors to help clients make personal life changes related to their sexuality or identity. â&#x20AC;&#x153;Denial of treatment options for children undermines their dignity and integrity,â&#x20AC;? MFIâ&#x20AC;&#x2122;s president Andrew Beckwith said. â&#x20AC;&#x153;The freedom for parents to seek and decide what counseling is best for their child, without interference from politicians, is a basic liberty that must be upheld.â&#x20AC;? â&#x20AC;&#x153;Junk science has no place masquerading as mental health, said Grace Sterling Stowell, Executive Director of the Boston Alliance of Gay, Lesbian, Bisexual, and Transgender Youth (BAGLY). Stowell continued, â&#x20AC;&#x153;The Houseâ&#x20AC;&#x2122;s definitive rejection of the dangerous and discredited practice of â&#x20AC;&#x2DC;conversion therapyâ&#x20AC;&#x2122; for minors is an important step forward in the legislative process of protecting LGBTQ youth and their families. BAGLY is proud to be a member of the coalition advocating for this legislation.â&#x20AC;? â&#x20AC;&#x153; I agree with banning aversion therapies that involve uncomfortable or painful stimuli to attempt to modify behaviors, but this bill outlaws all therapies, including doctor-to-patient discussions, that could lead to a patientâ&#x20AC;&#x2122;s change in in gender identity, said Rep. Randy Hunt (R-Sandwich). â&#x20AC;&#x153;In my opinion, that is unconstitutional according to a recent U.S. Supreme Court decision.

Officials at the RMV and MassHealth would be required to explain to each person that the transaction automatically registers them to vote, unless they opt out; and also inform them that non-citizens are ineligible to vote.

Supporters said an estimated 680,000 eligible voters in the Bay State who are not registered to vote.

Utilizing existing technology to modernize the voter registration process just is basic common sense.”

“We need to preserve the integrity of our elections,” said Rep. Shaunna O’Connell (R-Taunton). “This new law is riddled with major problems from creating another unfunded mandate on cities and towns to giving felons with stolen identities the right to vote.”

Rep. Joseph McGonagle Yes RAISE AGE FROM 18 TO 21 TO PURCHASE TOBACCO (S 2571) Senate 33-3, approved a bill raising from 18 to 21 the age to legally purchase cigarettes and electronic cigarettes in the Bay State. Other provisions ban e-cigarettes and other vape devices from the workplace and prohibit pharmacies and health care facilities from selling any tobacco or vape products.

“Kids and tobacco just don’t mix,” said Marc Hymovitz, Massachusetts director of government relations for the American Cancer Society. “Research shows that if a person does not begin smoking at a young age, they are much less likely to ever smoke. In fact, 95 percent of adults who smoke started smoking before the age of 21 and nearly all of them started by age 26.”

Sen. Don Humason (R-Westfield) said he opposes the bill because it takes away personal freedom and individual responsibility. He revealed that he has never smoked cigarettes or marijuana or vaped.

He said he doesn’t think people should do any of those three things but that he has a hard time when the government tries to tell adults what they can and cannot do. He said the government should provide information to help people make a decision on these matters.

“Massachusetts is poised to be the 6th state in the nation to enact legislation to raise the age of sale of tobacco products to 21,” said Jeff Seyler, Chief Division Officer of the American Lung Association. “This bill will not only protect our young people from beginning a dangerous addiction to tobacco, but it includes safeguards for public health by restricting the use of e-cigarettes and the public’s exposure to e-cig-

arette emissions.”

The House has approved a different version of the bill and the Senate bill now goes to House for consideration.

Sen. Sal DiDomenico Yes GENDER X (S 2562) Senate 36-1, approved and sent to the House a bill which allows the applicant on an application for a driver’s license, learner’s permit, identification card or liquor purchase identification card to designate “X” for gender, instead of male or female.

Supporters said several states including California, Oregon and Maine currently have this civil rights law that allows people to be themselves. They noted that currently a person who is non-binary or gender-fluid has no choice and must check off male or female.

“Drivers’ licenses and other forms of ID are legal documents intended to reflect objective facts, like height, date of birth, current address, and sex,” said MFI’s president Andrew Beckwith. “They are not designed to be tools for the fulfillment of someone’s sexual expression. I’m sure there are plenty of people who would rather not have their true height or age listed on their license, but that’s irrelevant. I may desire to be 6’5” or identify as a 25-year-old but I’m 6 feet zero and 41 years old, and that’s what goes on my driver’s license.”

Sen. Sal DiDomenico Yes ID FOR HOMELESS (S 2568) Senate 37-0, approved and sent to the House a bill that would require the Registrar of Motor Vehicles to create a process for a person who is homeless or is an unaccompanied homeless youth under 24 years old to apply for a Massachusetts identification card at no cost. The applicant would be required to prove his status and submit proof of residency by documenting that he or she receives services from a state or private agency.

Under current law, a person who is looking to obtain a Bay State ID card must provide a proof of residence – a task that is nearly impossible for a homeless person.

Supporters said that the homeless face huge obstacles to receiving an ID card and noted this would make it easier for them.

They said currently eight states have tak-

en this important step in the battle against homelessness and noted that some human service providers estimate that half of their clients lack ID cards.

“People experiencing homelessness encounter countless barriers, trials and challenges in their daily lives, and for youth especially, access to simple educational and economic opportunities is often barred by the lack of official identification,” said Sen. Jason Lewis (D-Winchester). “I’m proud to co-sponsor this legislation, which takes straightforward, concrete steps to improve access to state services for homeless youth.”

Everett middle school students in the Global Scholars Program at the Madeline English, Lafayette, and Parlin schools ended the year by unveiling mobile apps they created as part of a Community Action Project centered on the theme of “Feeding Our Cities.”

Global Scholars is a tech-savvy, direct, peer-to-peer

learning program for students 10 to 13 years old. Its purpose is to develop cultural understanding, knowledge of the world, and global competency skills through direct communication in a digital classroom. Global Cities provides the curriculum, access to the secure e-classroom, and ongoing live professional development for classroom teachers.
