A warm welcome to the July 2020 edition of Dorset Business Focus and it’s great to be back in print again! We are now in the final stages of lockdown and light is at the end of the tunnel for most sectors after an unimaginable 3 months. All non-essential shops are now open as will bars, restaurants, holiday parks and hotels will be from 4th July, and we are able to connect with loved ones in a ‘support bubble’. It’s been a long time coming but of course social distancing measures still have to be maintained to prevent a second spike. It’s fair to say that some sectors have felt the impact more than others. Whilst all businesses were of course initially impacted on by the lockdown, we’ve seen many now return to work (both in the real and virtual sense). We’ve seen businesses in the professional and business services return to work as well as the engineering and manufacturing sector. Businesses in retail, hospitality and tourism have been hit very badly. From the latest statistics on the economy it’s clear we all face some tough times ahead. We’ve been strongly campaigning on behalf of the many businesses who have been falling through the gaps. Our membership of the British Chambers of Commerce has proved invaluable and connects our business community with policy makers at the highest levels. The British Chambers of Commerce should be applauded for the incredible job they have done in working with and lobbying Government on behalf of business over the last few months. It was a tremendous honour to also receive a letter of thanks from HRH The Queen

to the British Chambers of Commerce, thanking the accredited Chamber network and members for all our work during this crisis. We are also working closely with partners including both councils and Dorset LEP. We’ve heavily promoted the grants and explained how to access them and supported many individual businesses in accessing their grants. The Gateway team have also done an amazing job in this respect. Looking forward we will continue to work closely with Dorset LEP and the Councils, ensuring business has a voice in the development of strategies and support for the recovery of our economy. Over the last 3 months we’ve done our best to support businesses across Dorset and beyond through over 30 video updates, explaining support schemes and how to access them, our regular updates through our digital channels and of course through the Dorset Gateway, an invaluable information, advice and signposting service we deliver on behalf of Dorset LEP. We’ve undertaken several interviews on key issues and topics and this includes interviews with the Chief Executives of both BCP and Dorset which you can see them in the Business Insights

section within Membership on our website. We’ve also launched a new Business Buddy programme, enabling our members to provide valuable support to each other. Our networking events continue to be a huge success and over the last couple of weeks we’ve welcomed Adam Marshall, Head of the British Chambers of Commerce and Tobias Ellwood MP as our guests at policy-focused events. There is no doubt we face challenging times. However, we must maintain a keen and optimistic focus on recovery. We must get back on our feet again. Brexit Update by Camilla Call, Brexit Advisor

Overview In recent months Brexit has been completely overshadowed by coronavirus and while focus has started increasing again, it’s been difficult to know what’s happened/is happening and what’s speculation; there’s been increasing noise in the media and on social media, but we’ve not seen much formally from the Government. There’s even been rumours from some media outlets that coronavirus has been used as a mask to progress our exit from the EU behind closed doors. The Government came under increasing pressure to help the economy by extending the transition period, but on 12 June they formally confirmed they’d neither accept or seek an extension. This now leaves a small window to complete the trade talks before the end of the year when we’ll stop trading under EU terms and potentially move to World Trade Organisation (WTO) rules. Trade There’s one more round of talks scheduled this month before a planned high-level "stock take" between Boris Johnson and President of the European Commission Ursula von der Leyen, where both sides will consider the progress made so far. Trade talks with Japan begun on 9 June, the UK’s 11th largest trading partner, and the fourth largest outside the EU. On 12 June the Government announced it would introduce new border controls in three stages up to July 2021 and shared details of a £50 million support package to boost the capacity of customs brokers, freight forwarders and express parcel operators . Regarding the Northern Ireland Protocol, a published action plan states businesses will need to complete export declarations for goods moving from Great Britain to Northern Ireland. While this raised some noise in the media as Boris Johnson had originally said there wouldn’t be a hard border, the Commons were told that declarations were needed to “ensure UK trade qualifies for tariff free status” (Independent). The Government outlined the intention to create up to 10 freeports in the UK and invited responses to the Freeports Consultation. This was originally due to close 20 April but has been extended to 13 July to allow key sectors with an interest, including ports, businesses and local government, the time to submit views following disruption due to coronavirus. 4

The UK Global Tariff, Published 21 May, will replace the EU’s Common External Tariff from 1 January 2021 with the intention of "lowering costs for businesses, ensuring they can compete on fair terms with the rest of the world, as well as keeping prices down and increasing choice for consumers." Businesses can now familiarise themselves with the changes and tariffs being maintained in order to back UK industry, including agriculture and cars. Trade/Sentiments There’s been lots of noise in the media recently regarding the trade deal with America and food standards/animal welfare. In initial talks our Government said it would under no circumstance lower the high standards we enjoy in the UK. However, much has been reported about the potential that we’re moving towards a trade deal that would open the gates for lower food standards and animal welfare. This followed MPs voting against an amendment to the Agriculture Bill that would have meant the high standards of current UK food and farming must be applied to future deals on international trade. Supply Chains Andrew Opie, director of food sustainability at the British Retail Consortium stated that “if we get a disorderly Brexit we potentially face a /company/dorset-chamber/

bigger challenge to the food supply chain than was faced with Covid.” Sticking Points Initially there was a deadline of 1 July for the fisheries agreement but this is now looking unlikely as it appears we’ve reached a deadlock. A number of rounds of talks were held recently but with no progress towards a deal, which Europe state may get pushed back towards October (Guardian). The UK’s position is that trade and fisheries should not be linked while the EU’s position is that it should (House of Commons Library). Finance Andrew Bailey, Governor of the Bank of England, has advised banks to “step up their plans for a no-deal Brexit” and a senior EU official echoed this stating “Britain’s financial services sector should be ready for a no deal Brexit.” Our desire to retain passporting rights is driving us to ensure we secure a “binding commitment from the EU on financial market access.” Dorset Chamber will be sharing regular updates on the UK’s exit from the EU. Beales Store to Open in Poole August 2020 On 1st August 2020 the Beales store in Poole is set to reopen its doors as an independent department store. Under new management, and with a change on emphasis, the store has already attracted interest from local independent retailers looking to take space. Tony Brown at New Start 2020 explains: “After the company went into administration earlier this year, new company New Start 2020, took over the lease with a view to reopening the landmark store in Poole. “We believe that there is plenty of life in the department store concept if it is delivered differently and integrates with 21st century shopping trends including internet shopping and ‘click and collect’. retail and when customers feel comfortable to do so.” As part of its five-year plan, the new team is currently working with the national, high-end brands it was known for such as Apricot, which it knows work well for customers, but it has also been delighted with interest from smaller, local independent outlets interested in taking space. As well as delivering fashion and homeware, the store will retain a furniture department and the addition of individual local brands reflecting its ethos of ‘quality and value’ will be a positive step change for the store. Tony adds: “Smaller brands can see the benefit of taking space in-store to give them high street presence without the overhead commitments of a dedicated shop front. They

will also benefit from being part of our online offering. We are looking forward to working with local companies who may not have tried this path before and welcome enquiries from them.” Ian Girling, Chief Executive at Dorset Chamber said: “Significant investment in the Dolphin Centre by Legal & General in recent years has given the area a welcomed face lift and the store reopening fantastic news for Poole. The site is a very large and the store would have been greatly missed. Customer confidence levels in Dorset

“Get the confidence of the public and you will have no difficulty in getting their patronage.” This quote from the founder of Selfridges has never been more relevant. It’s no secret that retaining existing customers & attracting new ones are corner stones to commercial success, but this may be challenging in the current circumstances. Whilst restrictions vary dramatically by sector, customer emotions (and expectations) are running high across the board. insight6 provide their clients with insight into, and development of, their customer & staff experience and have been focussing recently on customer confidence as lockdown begins to lift.

As businesses reopen, there are a multitude of feelings that will influence our choice of activities to return to, and when. According to research published by Ipsos MORI the national picture indicates that customer confidence varies dramatically by activity. insight6 were keen to understand how the residents of Dorset & Wiltshire specifically were feeling and heard that; In summary residents of Dorset & Wiltshire feel predominantly comfortable about meeting with family & friends and more comfortable than not about shopping and returning to their place of work. As schools begin a phased return parents have split feelings about sending

So, what can you do to reassure your customers and deliver great customer experience as lockdown lifts? Never has there been a greater need time to look at new businesses models, embrace technology, and adapt and explore new ways of working. Never has there been a greater time for a friend in business to give you an independent perspective, help develop new ideas and support your creative thinking. That’s why Dorset Chamber have has created the Business Buddy Programme.

Business Buddies are volunteers from the business community, all Dorset Chamber members, who are happy to give their time freely to other Dorset Chamber members. They are to be that friend in business; , someone who is there to help and act as a sounding board for fellow Chamber members. The President’s Column by Liz Willingham

It must be incredibly difficult to balance the delicate dynamics of keeping Covid-19 suitably contained yet knowing that if we don’t wake up the economy across all sectors as soon as possible the lasting damage is going to be catastrophic. Things are already functioning in many areas, and here in Dorset we have seen some amazing examples of workplaces, factories, many engineering works continuing to operate safely throughout lockdown. A mission to keep our workforces functioning in whatever way possible is definitely apparent in our business community, once again demonstrating our strong work ethic, resilience, and refusal to be beaten. And many of those who just couldn’t open pivoted, provided much needed support to their communities, and thought creatively about how they can operate. Everyone will have opinions on how our ministers have handled this pandemic. What decisions were made too soon, too late, whether communications were effective or not. I appreciate the complexity of the calls they had to make and just grateful that businesses have had champions such as the British Chambers of Commerce and the entire chamber network to ensure government understands the needs of industry. And that our government listened. As I write this, the hospitality industry has been given the green light from 4th July, with conditions surrounding social distancing. In a county so reliant on tourism, we really needed this call to be made, to get people back out enjoying our beautiful landscape in beer gardens and tea rooms, filling our hotel beds and getting our economy back up and functioning. One of our LLPR clients is Visit Dorset which has been surveying its members and hospitality businesses to assess the true scenario we are facing through lockdown. It has had to look at predictions for business survival and, clearly, the longer the situation continued the higher the chances tourism businesses would not be able to survive. We have some idea now we know hospitality businesses can operate from July, that 80.5% operating in these sectors will be likely or highly likely to survive. This significantly declines to 41% if we had to wait until September and 29.6% if measures were still in place come December. It is therefore critical to so many working in hospitality and leisure that we can get them back in their jobs, for us to be able to go out and support them, and most importantly further lockdowns do not happen. Visit Dorset’s surveys show optimism, but even as we see them reopen, a third of businesses believe it unlikely they will return with full staffing levels. This already highlights how difficult it is going to be for many in Dorset who have relied on hospitality for jobs. may not have felt this appropriate before but being open minded and supporting those on our doorsteps is critical now. They will be hungry and keen and could potentially be huge assets for our businesses. Its clear to us all that thinking differently, acting decisively, and applying innovation in our working environments will see us through. I am relieved that we at Liz Lean PR have been thinking differently for a while about how our workforce functions. And ironically the skills shortage pre Covid-19 was partly responsible for that. Being able to work remotely for some time enabled us to have team members as far as Liverpool over the past year, and we have an account exec currently living in Cornwall. The team continues to thrive very much as a team, with a vigour of spirit which is nothing but exciting. I am immensely proud of all of them. What it has proved is that despite being staunchly loyal to Dorset and our talent pool here, we are a global community; our clients have always been UK-wide, the media we deal with national and international, and it’s therefore positive that our team can be based anywhere they want to be. I extend my support to all of you finding your way, hopefully thriving, if not planning and reinventing for what we all need to recognise is going to a bumpy ride for a while. As the furlough scheme evolves and finally disappears, and the true ability for businesses to function will become clear, we need to be on our guard and push forward in whatever way works for us. Buy local, think global. Support those in your communities, trade with the small independents where you can, keep the cogs turning on our doorstep. I know I keep banging on about it too but keep communicating! I know, it’s my profession and I would say it wouldn’t I? But I know that talking to your audiences regularly at this time will help you enormously. Keep the profile high and customers will stick with you, and new ones will find you. Dorset Chamber welcomes top business leader One of the UK’s top business leaders has praised Dorset Chamber members for helping to directly influence Government coronavirus policy. Dr Adam Marshall, who is director general of the British Chambers of Commerce (BCC), said concerns raised by Dorset firms had helped the organisation lobby successfully in the corridors of power. He told how the BCC had cited issues in weekly discussions with Business Secretary Alok Sharma and in conversations with other senior ministers. Dorset Chamber – the county’s leading business support organisation – welcomed Dr Marshall for its inaugural Business Leaders event, which has replaced its ‘Signature’ events. He told nearly 50 business owners, directors and senior managers over Zoom how well Dorset was regarded at a national level as a ‘modern, forward-looking and optimistic’ chamber. Dr Marshall also urged businesses to keep raising concerns so it could continue to influence and change government policy at an early stage. “Tell us what the issues are, what the trends are and where the difficulties are. Tell us what is going on in your business so we can tell government. Every piece of information is really important.” Chamber president Liz Willingham led a discussion with Dr Marshall before questions from members. Subjects included the economic outlook, business support, the value and role of chambers during the pandemic, retail and town centres, banks, international trade and new working patterns. Dorset Police are warning businesses to be very vigilant against fraud and scams Neighbourhood Policing Chief Inspector Jim Beashel said “Just as businesses have had to adapt and find new ways of working during the COVID-19 crisis; criminals have looked for opportunities to exploit the situation for financial gain. By early June Action Fraud, the National Fraud and Cyber Crime Reporting Centre, reported that over £5 million has been lost by victims to coronavirus-related scams”. Dorset Police have seen a number of scams recently such as: • • • •

Phishing – emails that entice the recipient into opening attachments which could lead to personal information being accessed. To achieve these aims through the Covid-19 crisis, we have put in place a package of measures to support jobs and growth, help the economy recover, and keep the financial system safe. We have introduced a new bank funding scheme (the TFSME), giving banks incentives to pass the Bank Rate cut on to their customers and keep on lending to small- and medium-sized businesses. We have also reduced the amount of their own financial resources, or capital, that banks need to hold when they make loans. And we are injecting £200 billion of new money into the economy via quantitative easing, or QE, which should help boost spending by households and investment by businesses. But despite the support provided by the Bank and the Government, the impact of Covid-19 is likely to be a reduction in jobs and growth in the UK. In the latest Monetary Policy Report, the Bank’s Monetary Policy Committee (MPC) set out one plausible scenario to illustrate how the UK economy could evolve from here. It is likely that UK economic activity will fall dramatically in the current quarter of the year, and unemployment is likely to rise rapidly. How the economy recovers from that point will depend on how the pandemic develops and how governments, central banks, businesses, and households respond. In the MPC’s illustrative scenario, which is based on a number of crucial assumptions, economic activity picks up as social distancing measures are lifted gradually in the UK and the rest of the world through the summer and autumn. Because the MPC assume that households and businesses remain cautious about their spending, even after the social distancing measures are fully lifted, the economy does not get back to where it was until around the second half of 2021. That recovery is supported by measures taken by the Bank and the Government. And it is supported by the UK banking system,

which is in a very strong position, unlike at the time of the global financial crisis. In the interim Financial Stability Report, which was published alongside the Monetary Policy Report, the Bank’s Financial Policy Committee gave the results of a stress test based on the MPC’s scenario. The test showed that major UK banks and building societies have, as a result of the reforms brought in following the global financial crisis, plenty of capacity to absorb the losses it’s estimated they would make. It is important that banks use this strength to support the economy by expanding lending to businesses to avoid long-term economic damage. The TFSME and the Government’s loan-guarantee schemes will help them do so. There are many possible scenarios for how the economy evolves. Depending on the development of the pandemic, the Government may lift socialdistancing measures more quickly or more slowly than the MPC’s scenario assumes. It may take longer than assumed for UK households’ and businesses’ caution to lessen. Distancing measures may be lifted at a different pace in the rest of the world, affecting the demand for UK businesses’ exports of goods and services. ‘Scarring effects’ from the pandemic may affect the capacity of the economy to recover lost ground. For example, some businesses may no longer be viable, if spending patterns change permanently as a result of the virus. We will continue to monitor the economic and financial situation closely. The intelligence I and my fellow Agents gather from businesses in Dorset and across the UK will help the Bank to understand how the economy is evolving. Whatever happens, the Bank will take the actions necessary to support the recovery, ensure inflation returns to target, and maintain the stability of the financial system. The reality behind the latest unemployment figures The Office For National Statistics has released its latest set of employment figures and although we braced ourselves for bad news, they certainly make for grim reading. Initial findings show 600,000 fewer employees in the UK on the payroll in May compared to March and the number of claims for Universal Credit is also on the rise. For those looking to get back into employment the outlook is bleak, with the number of vacancies falling to a record low in May. Certain sectors are going to be hit particularly hard and we are likely to experience this more here in Dorset where our local economy relies heavily on tourism and leisure. The ONS cites

the accommodation and food service industries to have suffered a particular decline in total pay. The bigger picture shows that for the first time since January 2018, total pay fell in real terms (in the three months to April). The reality is, the situation is likely to get much worse. So far in this country we’ve benefitted from a range of government initiatives, including Small Business Rate Relief, self-employed grants and of course, the Coronavirus Job Retention Scheme. Yet whilst the nation has been scooping out the water, the ship is still sinking. Deferral payments and bounce back loans will come due. No matter how well businesses will have tried to reduce risk and

forecast ahead, inevitable decisions will only have been delayed. The first phase of the furlough scheme will be coming to an end in late July, with the next phase requiring company contributions gradually scaling up between August and October. The greatest barrier we face is uncertainty we just don’t know. Will there be a second wave? When will there be a vaccine? Will children be able to go back to school after summer? Hendy opens to the public Hendy Group’s showrooms and service centres have re-opened across the south coast including those in Dorset. The motor group has now opened all of its sales and aftersales departments after initially keeping four sites open for essential maintenance to key worker vehicles. Hendy has introduced a number of changes to its service centres to ensure all they are in line with Government guidelines. Customers will be given a timeslot in which to come in for their service to reduce the number of people in waiting areas, and all aftersales departments and waiting areas will feature clear signage to indicate two metre distances as well as hand sanitising stations to ensure the safety of customers and colleagues. Where possible, all paperwork will be digital

to avoid unnecessary physical contact and all payments are requested to be by card rather than cash. Vehicle collection and delivery will be unavailable until further notice. Hendy has seen high demand from customers throughout the strict lockdown period. Group service director Pete Walker said: “We have worked hard to ensure the dealerships are in keeping with the Government guidelines on social distancing and we have been thorough in our approach bringing in all the necessary changes.” All customer vehicles will be thoroughly sanitised before collection using KleenAir Bio Steri-7, an effective product that keeps surfaces

protected for up to seven days following application. Pete added: “We have seen an incredibly high volume of enquiries from customers through our digital channels while our physical dealerships were closed. Suttles’ Swanworth solar system IN A bid to reduce Suttle Stone Quarries’ carbon footprint and energy costs, Swanworth Quarry’s workshop has recently undergone installation of photovoltaic (PV) solar panel system supported by Low Carbon Dorset and installed by Wessex Eco Energy. Throughout the year when solar radiation is produced (not just in bright sunlight), the panels will generate electricity to provide power for the workshop, security and any fixed electrical systems within the quarry. Importantly it will also help to power the quarry’s 160kW crusher motor which was upgraded to electric from diesel back in 2014, significantly reducing bills and some reliance of fossil fuel energy sources. The system, which has a capacity of around 49kWp (Kilowatt peak of a system), has been part funded by Low Carbon Dorset as part of the European Regional Development Fund (ERDF) and will save around 25 tonnes of CO2 per year. This along with an ever-increasing fleet of electric and hybrid vehicles means the company is estimated to be saving in the region of 60 tonnes of CO2 emissions combined. Suttles Stone Quarries began working on the project in the latter part of 2019 and was approved for the grant from Low Carbon Dorset in time for work to be ultimately completed in October. The process, which included numerous site visits from Low Carbon Dorset’s Renewable Energy Technical Officer, Dr Derek Moss, was concluded with a feasibility study and application for £16,693 of grant funding. Once the supplier

was selected and the grant was officially awarded, Suttles were able to instruct Wessex Eco Energy to complete the works. In October, over the course of a week, 120 Canadian Solar 405w PV panels were expertly and neatly installed onto the workshop roof. John Suttle commented on the project’s completion; ‘I was really impressed with the professionalism and speed of the installation by Wessex Eco Energy and I think Low Carbon Dorset are doing a great job in helping to fund projects like this. I think that every business that is suitable for solar or other renewable energy generation and efficiencies should be applying and hope that Low Carbon Dorset continue to be able to provide funding in future.’ In the coming years it is hoped that a decision on an extension to quarrying at Swanworth will mean that Suttles can extend to a larger solar system that could entirely power activities on site and give scope to more electric vehicle charging. Nonetheless, after a lot of research and determination a low carbon vision is slowly becoming a reality and Suttles aim to roll out such technologies throughout other parts of the business. STARS Dorset launches first Crowdfunding Page STARS Dorset launches it’s FIRST Crowdfunding Page with the help of the Aviva Community Fund. Sexual Trauma and Recovery Services (STARS Dorset) has been chosen as one of the projects supported by the Aviva Community Fund. With the help of Aviva the charity has set up a Crowdfunding page, it’s first ever, and is asking the local community to pledge their support and help STARS Dorset raise funds to ensure its services are available to all those who need their support across Dorset during these unprecedented times. The charity is hoping to raise £2500 to cover the increased costs it has and will incur from continuing to support clients through and after COVID-19. Before the pandemic hit its Counselling Service and Independent Sexual Violence Advisor Service were provided as one to one, face to face support services. Due to the restrictions

put in place the charity has changed the way it works and in doing so it has and will continue to incur costs such as creating an online assessment team, training all its counsellors to be proficient in online counselling and covering additional phone and video platform costs. The charity is hoping through the money raised it will be able to create and maintain its free support services enabling everyone across Dorset continued access to its services. REIDsteel lifts off for new Biggin Hill service centre Structural steel firm John Reid & Sons Ltd (REIDsteel) and design and build specialists Civils Contracting Ltd (Civils) have started work on another major new business aircraft service centre at London Biggin Hill Airport. The REIDsteel and Civils partnership has been successfully delivering aircraft hangars for over 20 years. The state-of-the-art development for Bombardier Aviation will comprise a hangar of nearly 250,000 sq ft, including workshops and office space, plus 650,000 sq ft of apron area, car park and external works. The service centre will be capable of housing up to 14 Global 7500s at any one time, and provides a significant expansion of Bombardier’s service facilities at London Biggin Hill Airport. Dorset-based REIDsteel is providing design, drawing, fabrication and construction services for all steelwork, wall cladding, roof cladding, glazing and hangar doors – for main contractor Civils Contracting Ltd. Civils has already started the site works with extensive clearance, reduced dig and ground engineering works. The first steel reinforced cages are now being installed in readiness for the pouring of

the foundations which have to resist the 2000T uplift loads that the 45m cantilever rafter trusses will create. The development is due to complete in 2022. REIDsteel Project Director Richard Hanson said: “From our early beginnings making hangars for the famous French airman Louis Bleriot, REIDsteel has worked with aviation pioneers. “We are proud to support Bombardier and London Biggin Hill on this latest, exciting development with Civils Contracting Ltd. “It highlights our ability to provide more than just the steel frame with design, fabrication and construction of essential parts of the building envelope, including cladding, curtain walling, decking and our own aircraft hangar doors. “Civils has an exceptional reputation and hold values to match our own. COVID-19: what will the future look like? With the pandemic continuing to impact professional services firms, in this insight we assess potential long term consequences. Economy During the early stages of lockdown, we were reminded that the UK economy was in a robust position before the pandemic hit and therefore there was a reasonable expectation that it would recover promptly once this was all over. However, more recently the mood music has changed with a warning that the economic impact could be felt for much longer. Getting the economy moving again is going to take longer that we all originally thought and there will have been some permanent damage. Some businesses are already going into administration and others are putting plans in place to downsize their operations dramatically. Traditionally, professional services firms grow in the same direction as GDP but at a faster rate. However, when GDP growth is negative, professional services firms contract at a faster rate. Another point to bear in mind, is that the transition period for the UK’s departure from the EU ends in just over six months’ time. Who is paying for all this? While the speed and generosity of the various UK Government support schemes has been welcome and the professional practices sector has taken advantage more than might have been envisaged at first, the now record levels of UK Government borrowing will need dealing with at some point. Will the UK Government - not wanting to risk a nascent economic recovery - decide to take advantage of record low interest rates, simply kicking the debt pile down the road? Alternatively will it look to increase tax rates? (Not something historically associated with Conservativeled administrations). Where would these tax increases be felt most? The burden of any increases might be felt disproportionately by partners in LLPs: Rishi Sunak has observed that the self-employed currently pay lower levels of National Insurance than employees and “If we all want to benefit from state support, we must all pay equally in future”. If National Insurance rates are aligned, the benefit of being an LLP versus a company will shift. People Those firms that have furloughed staff will have to work out when and how to re-engage with people that have been disengaged for a lengthy period of time. Only a few months ago the war for talent was one of key challenges for all firms, but with the expected decline in activity levels, the need for people will reduce. However, will those who have been furloughed, or had their pay reduced, remain loyal to firms for keeping their job open or will they feel hurt by the experience and look to move to more financially sound firms? Recruitment will no doubt be closely watched over the next few months or years, so expect a shortage in qualified professionals in, say, five years’ time, when the economy will be growing again. Remote working More positively, we have all learned how to work remotely and it hasn’t been as bad as some had feared. However, before we all claim that offices won’t be needed going forward (big real estate savings there) we need to take a closer look at what we might lose in a more remote working environment. Working remotely can work effectively when everyone is remote, but how does it work when some are and some aren’t?

Which tasks are done more efficiently when working remotely, which are less efficient and how can we structure our workforce to deal with this? As the more mundane of our tasks become automated, the benefits of engaging a professional services firm will come through the collaboration they can provide with the enhanced problem-solving that many minds achieve over a single mind. We therefore need to think how people collaborate and whether our infrastructure (both physical and IT related) enables it to happen successfully. Ultimately humans, unlike some species, are a sociable race and enjoy the connections they make with their colleagues. I don’t hear of many leaving speeches where people say they will miss the quality of work they did – I would suggest it is always their work friends and engagement with them in the office place that is their biggest loss. We need to think carefully how we plan our offices of the future if we are not to lose out when the war for talent returns. Funding However, if there is one thing the pandemic has demonstrated is that the more financially sound firms have been better placed to deal with the uncertainty. If there is one legacy that I hope firms will adopt, it is the need to have a stronger balance sheet in future. The solution is there, staring partners in the face, in the form of their unpaid bills. Health and Wellbeing centre reopens for physiotherapy treatment Bridge Health & Wellbeing in Christchurch has reopenened for face-to-face physiotherapy treatments. Following the situation caused by the COVID-19 pandemic and the nationwide lockdown, the clinic was temporarily closed on 23rd March for all face-to-face contact. In line with guidance from the Chartered Society of Physiotherapy (CSP), the clinic is now able to reopen. Two years of GDPR compliance and Coronavirus: the perfect storm

Monday 25th May 2020 marks the two year anniversary of GDPR coming into force across the EU, including the UK. The GDPR requires you to always be compliant with its rules. In normal times the fact that GDPR is two years old this month would be enough for most businesses to be thinking about reviewing their GDPR compliance, checking they’re still doing all the right things. Afterall, most businesses evolve in one way or another, whether that’s changing services or changes to their teams, so, a lot could have changed that requires revisiting GDPR, to ensure they’re still on the right track. However, during the Coronavirus “new normal” the importance of maintaining compliance is even more relevant as businesses adapt to working in different ways or welcoming employees back as lockdown begins to lift, processing employees’ Covid-19 data, taking their business online, etc. Being GDPR compliant was not a one off for May 2018. Ongoing compliance is a key part of the accountability principle the GDPR introduced, the data protection rule that says you have to show you are compliant and continue to be. EAT, SLEEP, GDPR, REPEAT should be your compliance mantra! Talbot Village Trust COVID support fund concludes The final beneficiaries of the Talbot Village Trust COVID-19 Support Fund have been announced. In this last round, more than £200,000 of grants have been issued to 28 Dorset charities, community groups and others. Talbot Village Trust launched the £1 million fund on Monday April 6 2020 to help charities, community organisations and others in Bournemouth, Christchurch, Poole, East Dorset and Purbeck that are struggling to provide critical support to their communities during the coronavirus crisis. However, the high-level of need in the community has resulted in more than £1.1 million being donated to 120 charities, community groups and others in just six weeks. Over 80% of applications were successful from both past recipients of Talbot Village Trust and new ones. Sir Christopher Lees, Chair of Talbot Village Trust, said: “First and foremost we want to say a huge thank you to all local charities – those that received funding from the Trust and others – for working so hard to support their communities through this

incredibly turbulent time. It is a testament to their commitment to helping those in need and we are humbled by it. “From the beginning, the COVID-19 Support Fund has seen huge levels of demand, and we are grateful to have been able to help these charities in our own small way to carry on through the crisis. Our grants will continue as normal and as always, we urge any group in need as this crisis continues, to consider applying. Dorset Chamber Business Partners Q&A with Tobias Ellwood MP On 20th May Dorset Chamber hosted a Business Partner Q&A session with Tobias Ellwood MP, who gave an overview of his view on areas relating to a post-pandemic economic recovery; the current state of international relations; the progress already made by HM Treasury on the business support package and the need to ensure it goes further to ensure everyone is looked after. Tobias also highlighted the need and opportunity for councils and other governing bodies to think beyond their traditional remit and be creative when it comes to solutions for the region’s specific needs. The Q&A session invited pertinent questions from the audience across a range of subjects including: • ensuring the regional needs for recovery are understood at government level; • the challenges colleges and the University face with reopening; • the need for local organisations to work collectively to support regional recovery; • a request for the language to be changed at government level from ‘social distancing’ to ‘physical distancing’ as ‘social connection’ is important for recovery; • government guidance on employer liability; • a request for policy change to protect subcontractors, especially micro businesses; • a request for the planningprocess to bemade less protractedwhen companies are wishing to move and expand; • and a request for ministers not to talk up a recession as it is unhelpful to those organisations who can and are still doing business.

Legal advice for food and drink businesses during the pandemic The Covid-19 pandemic and associated “lockdown” has hit the UK economy hard with certain businesses unable to trade at all, whilst others have abruptly lost their traditional customer bases. This applies none-more-so than in the food and drink sector where the production and supply of goods has been largely unaffected but their routes to market, including supplying to restaurants, bars and wholesalers, have been cut off or substantially reduced. In addition, restaurants and bars, who have only just been given the green light to reopen at the start of July, found creative ways throughout lockdown to continue to trade with their customers whilst complying with government guidance surrounding social distancing and health and safety. Many within the food and drink sector have therefore made the decision to take their offering directly to end-user customers which for some within the industry has caused a shift away from their usual business to business trading. In law, consumers have enhanced statutory rights and where business to consumer trading is not a business’ usual way of operating, some may fall foul of consumer laws. In addition, a large number have shifted focus to increase their online presence and have been conducting digital marketing campaigns, alongside website and social media revamps. Therefore, they need to also consider data protection and privacy, electronic communications legislation and regulations, especially when it comes to contacting existing and/or new customers. Where food and drink businesses have made changes to their more traditional ways of trading, they should be mindful of the following:

contractual information, enhanced cancellation and return rights and there are many provisions that may be acceptable in a business to business contract that would be deemed unfair within a business to consumer contract. Therefore, any business who does not usually sell on a business to consumer basis and is now looking to sell their products directly to endusers should review their terms and conditions and contractual provisions to ensure that any necessary adjustments are made to ensure they comply with the various consumer contract laws and regulations. The adjustments to be made will also vary depending on whether you are selling to consumers onsite at the business’ premises or via some form of online or distance selling method.

1. Status of Existing Contracts – making sure you are not in breach of existing contracts as a supplier At some point, restaurants and bars (and other business that are currently closed) will reopen. Food and drink businesses with a contract to supply these entities need to be mindful that, unless their contract with the closed business has been terminated, frustrated or you have agreed some form of suspension of contract with that customer, you will have to meet your contractual obligations again in the future. Whilst survival is key at the moment and diversifying is important, this should not be done to a degree that you may fail to meet any future contractual obligations owed to your existing customer base. Failure to meet future obligations could lead to breach of contract claims which could result in an order for damages against your business.

4. Marketing – do you have the necessary consents to contact people directly for marketing purposes? A business may be tempted at this time to drum up as much business as it can by sending marketing to its existing database of customer contacts and/ or otherwise undertaking specific advertising campaigns. Where advertising/marketing is individually directed to customers such as emails, it will be subject to a variety of specific direct marketing rules under data protection and privacy legislation. This includes the obligation to obtain certain consents for marketing which must be in a specified format and obtained prior to any marketing activity. The content of direct marketing will also be subject to the same rules as other advertising and marketing and there are a number of other regulations and codes in addition to the well-known data protection and privacy legislation that must be considered to ensure that the advertising is appropriate, not misleading, not discriminatory etc. There are a variety of sanctions such as fines that may be imposed for breach of the various regulatory requirements with different enforcement bodies depending on the breach

Sales to Consumers – making sure you comply with direct to consumer sales regulations The sale of goods on a business to consumer basis is subject to a higher degree of regulation than supplying goods on a business to business basis. Consumers benefit from an increased right to transparency of contractual terms, specific pre50

3. Website requirements – are your GDPR & privacy policies up to date? Regardless of the type of website operated, whether it is for advertising goods only or is in fact used to take and conclude orders for goods and/ or services, there are certain rules that business owners will need to adhere to. One of the most basic of requirements is the disclosure of certain information about your business i.e. name, registered company number, registered office address, contact information and VAT number. As well as the above, where your website uses cookies (which most do), you will need to have an appropriate cookie policy that tells visitors to your website what cookies are in use and asks them to confirm that they accept the cookie policy that applies to your website. In addition, a privacy policy should be included on your website, especially where you are collecting personal information (e.g. names and addresses for delivery of goods, to inform the customer what information you collect and how that information is used and stored).

For example The Information Commissioner’s Office is the entity responsible for enforcing data protection and e-privacy law in the UK whereas Trading Standards may take action for breach of consumer and E-Commerce regulations. Consequently businesses should ensure that all relevant regulatory requirements have been checked before carrying out any form of marketing/advertising campaign to avoid being caught out by the various rules. 5. Rent – what are the risks if I cannot/choose not to pay my rent? We are also aware that there has been significant noise, both locally and nationally, within the food and drink sector with regard to the best way to approach landlords in relation to rent payments in situations where a business is struggling, especially in those businesses whose rateable value means they are not eligible for certain of the government assistance schemes or grants. Whilst the government has brought in statutory protections with regards commercial evictions (currently until 30 June 2020, but it is expected that this date will be extended), this does not provide tenants with a carte blanche right to choose not to pay their rent. Where payments are missed, the tenant will still be liable for the missed rent payment and the legislation only protects the tenant from being evicted purely on the basis that they have missed payment due to the pandemic. Further, tenants could be required by their landlords to pay a penal rate of interest on any rent arrears. Our strong advice is to speak with your landlord to agree a way forward, either in terms of a rent break, rent reduction or deferral of rent, so that both parties have a clear understanding of their respective positions. Any agreements reached in this regard should be documented and signed by both landlord and tenant. This is particularly important if you have a break option in the lease which is conditional on the payment of the rent. If you have not reached an agreement with the landlord, and there are still rent arrears at the relevant break date, then the landlord may refuse to accept that the break has been effective, and the lease will therefore continue. Further, even if you have paid all the rent arrears by the break date, the landlord could still be entitled to charge interest on those arrears even if they have not previously demanded payment of the same. If your break is conditional on the payment of all rents due, and interest is charged as rent under the terms of the lease, the landlord could refuse to accept the break due to the non-payment of such interest. *The information set out in this article is correct at the date of publication (08 June, 2020). A favourite Bible quote was, ‘The Joy of the Lord is my strength’, I decided I would choose Joy. The Bournemouth YMCA also called their Intranet ‘Joy’ that year after I won the name ballot! Over the last few years, I have found Joy in many places, Scotland, Lincoln, Singapore, Budapest and Australia, as it travelled with me, in my heart. At work I became known as ‘The Joy Lady’. Joy was always there before, but maybe I just wasn’t looking for it. More recently due to the COVID-19 outbreak, which involved home working, job role changes and new challenges from working remotely, my colleague 52

Cyber warning for returning workers One of the country’s leading cybersecurity experts, based in Dorset, has been made a fellow of the Chartered Institute of Information Security (CIISec).

Matt said: “It was a great achievement to reach fellowship status - and I hope it demonstrates my level of understanding and the input I have made over the years in my profession. “CIISec is the only institution that focusses purely on cyber security and provides a structured approach to professional development for the industry within the UK. “Rightly it is a rigorous process to become a fellow, but any involvement in CIISec ought to be an ambition of everyone in the industry. “I have already been involved in some of the work shaping the future of the UK’s cyber professionals. “And I hope to continue working with other CIISec members and fellows in driving forward enrolment into CIISec and assisting in their Associate Development Programme.” CIISec exists to promote the advancement and dissemination of knowledge in the field of information security, develop high ethical standards and to promote those standards in the UK and overseas. Val and I had several interesting conversations in the course of my work. My new role was to assist Val, our Bid Writer, doing research for her. This was a learning curve for me involving several calls to Val. One day, in my eagerness to get a very small bid submitted, I uploaded a wrong document and could not retract it. I fired off an email but felt that it would be among hundreds of others, and then prayed. The next day they emailed back, sorted my mistake and two weeks later there was Joy when YMCA received £500! Another day, as a distraction for Val’s children, (she was also home-schooling), I asked her daughter, Tilly - 9, if she would draw me a rainbow picture to put in my window. As I live on a main road close to Bournemouth Hospital, I said that it would be seen by all the buses, ambulances, police, and those who walk along the road. Several days later a handmade envelope arrived containing a beautiful painting by Tilly. It was in beautiful rainbow colours and written in her writing the words, ‘Choose Joy’. These are very unusual times where we have all had to make choices. JOY is also a choice and the choice is ours.

Do data protection laws apply if I test my staff for Covid-19? The impact of the coronavirus outbreak has bought many changes to how our workplaces will operate now and in the future, in order to comply with government guidance and to keep people safe. Some employers will be looking at testing their employees for Covid-19 when they return to work, but many will not have considered data protection laws.

Do you need to consider data protection when testing staff for Covid-19?

The answer is yes, as health data is personal data and therefore covered by data protection law. If you decide to test your employees for coronavirus when they return to the workplace, you will need to consider issues such as:

What information you need to collect. You must not collect irrelevant, excessive or unnecessary personal data;

The lawful basis for collecting and using health data. The ‘legitimate interests’ of you and your staff may well be an appropriate basis for processing test data during the Covid-19 outbreak, although you should carry out an assessment to check this is the case;

Whether you can satisfy the additional test for processing health data, which is sensitive data and given additional protection. If it is necessary for you to collect and use test data to ensure the health and safety of your employees, then it is likely that the additional test will be satisfied; Whether you need to carry out a data protection impact assessment. How and what you are going to tell your staff before carrying out any tests;

How you are going to store the health data so that it is secure and only accessed by those who need to see it;

Recruiters take on new role as lockdown eases A Dorset recruitment firm has launched a new service to help businesses support employees being made redundant because of coronavirus.
