MISCONDUCT

LATROBE City councillor Melissa Ferguson has been found guilty of misconduct following comments made during an explosive council meeting in August last year. A Councillor Conduct Panel (CCP) consisting of Jo-Anne Mazzeo (chair) and Helen Buckingham OAM, found Cr Ferguson, who represents the South Ward, made abusive and threatening statements as part of a discussion about bushfire recovery funds. The August 2 meeting, which was not broadcast live on Facebook due to

a “technical glitch” was later posted to YouTube with parts redacted on legal advice. The panel report stated that during the council meeting, Cr Ferguson made abusive statements towards council staff and made accusations of “appropriation of funds, fraud and missing money”. “I believe that my constituents who were affected by (the) bushfire have been dudded,” Cr Ferguson said. “And I would like to see more about this and where this money went.” Latrobe City councillors voted to accept the panel statement of reasons at last week’s ordinary April council meeting,

however, Cr Ferguson was an apology from the meeting. Councillors Sharon Gibson and Dale Harriman abstained from voting to accept the statement of reasons. The application to the CCP was made by councillors Darren Howe, Brad Law, Tracie Lund and Dan Clancey on August 25, 2021. Former Latrobe City general manager of Community Health of Wellbeing Suzanne Miller told the panel she resigned after the August interaction with Cr Ferguson. Ms Miller, now a director of Primary Care with the Yarram & District

Health Service said this incident was not the first, saying there had been “a culmination of events over a long period of time”. “Her staff were fearful of councillors, and that this fear was indicative of an unsafe work environment,” the report stated. Cr Lund,wholikeCrFerguson,wasvoted into the position at the November 2020 election, talked about “the struggles she continues to face” after a 2021 briefing which involved the South Ward councillor.
