RAMPAGE CONTINUES The unceasing gun violence that has gripped the nation claimed two more lives on Wednesday afternoon. Two men were gunned down in separate shootings in broad daylight in Belize City. One of the murders took place on Cemetery Road while the other in Castle Street. Police authorities do not believe the shootings are related, but suspect that they are part of the ongoing gang rivalries in the old capital.

And I will not allow my integrity to be questioned either because of some seemingly incompetent people, or, because of some “imaginary document” that was concocted for the reasons of self-preservation and personal gain.

Today, I say to all my fans out there that there’s no need for you to question, whether if I have been robbed or not of an opportunity that I deserve, but to question if other Belizean athletes are being robbed as well? Like, Alexia Neal, who runs the 100m hurdles the Belize best recorded hurdler and Ashontie Carr, the best 800m runner.

Dear Editor, Something has to be very wrong when the Prime Minister of Belize can come on T.V. and tell us that he took Belize Telemedia Limited for Belizeans and puts his family and UDP cronies to feed from it.

Something is very wrong when the Prime Minister tells us Belizeans, ‘oh it is only valued $90 million but we end up getting a Billion Dollar Bukut.

Something is seriously wrong when the President of Guatemala tells Belizeans they can’t go to the Sarstoon and Belize’s Prime Minister passes an S.I. forbidding Belizeans to go also. Something is wrong when instead of investing in Belizeans industries; Social Security is instead scheming with the politicians in Belmopan with the people’s money.

Something is very, very wrong when our loving teachers choose to sacrifice their teacher’s day to send a message to Government that our national sovereignty is in peril.

Something is terribly wrong when the PM says the economy of Belize is robust and our industries are in trouble, oil exports are going down, shrimp sector is out for over a year due to virus attack, citrus is operational with only one factory, the banana industry is taking a beating, and papaya is gone. We cannot forget that First Caribbean Bank closed down and the remaining banks are in deep trouble with de-risking and losing correspondent banking. To top it off, the housing mortgage melt-

down continues with thousands of Belizeans watching as their homes, land and precious assets are being auctioned off.

Dean Barrow and the UDP administration have brought all these storms to our country. If the Petrocaribe $325 million was used for the right reasons, our country would have been in a better position. But instead, it was wasted for a third term in Government.

Now, with his third term, Barrow has created a perfect storm where everything that can go wrong is going wrong. Now, Barrow is exposed and everyone can see why he HAD to call early elections in November. Now, we know why Gapi is calling it quits.

Barrow’s mantra into the second term was “the best is yet to come”, but judging from the past six months of his third term, it is clear that a bigger mess has come.

simply because when a country like ours has no qualified standard athletes, then, we should send our best male and female athletes. The Olympic rule for the wild card is not for track events unless there’s a special invitation. According to the Olympic rule, is that no combine events get the wild card, meaning our best heptathlon athlete cannot go for heptathlon. Therefore, our heptathlon athlete will represent Belize in 100m hurdles even though she is not our best hurdler?

Really?

So, do we get any explanation as to why our best hurdler like Alexia Neal is not selected?

Alexia achieved it through her determination and persistence in order to make a difference. And here personal record shows the following: Alexia clocked and achieved: 14.35, back in 2015 and 14.92 achieved 2016 vs. Katy who clocked a15.35 achieved in her Heptathlon event in 2015 and 15.46 achieved 2016 With regard to the registered document that I supposedly did not submit on time as claimed by the BAA, then, why was the next best Belizean athlete not selected?

And why does the BAA continue to ignore my continued request and not provide the documentation, along with proof of delivery?

What are they hiding? I’ll tell you why! It’s really quite simple, they don’t have one, and they can’t provide proof. I only ask this so that I can get closure for myself, friends/ family, and especially for my fans, that have supported me from the beginning.

The BAA and Mr. Deon have not broken my spirit, but may have hurt my feelings, but that’s okay!

What’s not acceptable is that the BAA may have broken the hope of many who may use my determination and courage to go on. However, I am an Olympian and have already been to Brazil to represent Belize in “track and field”, so going back to Brazil was not my initial drive, but, making a difference for all Belizeans was.

Although my personal integrity may have been questioned and my feelings attacked, I promise you that I will not remain bitter, or, disgruntled. I only ask now for those who are interested in this development, to question the credibility of the BAA and those who represent them.

STATEMENT FROM THE CERVANTES FAMILY On the 1st of July, 2014, our patriarch, Don Ramon Cervantes was kidnapped from his cane field and was murdered the following day. On the 5th of July, one of the murderers led the police to a shallow grave where my father was buried. When his body was exhumed, we saw that he was blindfolded with duct tape that was wrapped around his head and eyes.

He had a deep dent on his forehead.

His hands were tied with handcuffs, which were later proven to be police handcuffs. Attached to the handcuffs was a long chain that extended all the way along his left leg, down to his feet. His body was already decomposing.

The post mortem was performed on the spot on a sheet of plywood. After the post mortem, his naked body was wrapped with plastic, doused with kerosene and placed inside the coffin. I remember when I looked at him and his ashen grey eyes were open and they stared at me deeply as if wanting to tell me how much he had suffered.

The handcuffs that tied my father’s hands were traced to police officer Javier Alvarez. Until more than 2 months later, the police reported that Alvarez was given only disciplinary charges and fined $200. As far as we know, he was never detained. We later learned that he was suspended with half pay.

We were very shocked a few days ago, when we learned that Alvarez has been reinstated as a policeman at the Belmopan police station.

We therefore ask the top echelon of the Belize Police Department the following questions:

SSB CEO RESIGNS! Are share purchases illegal?

Belize City, July 06, 2016 The BELIZE TIMES has confirmed that Social Security Board’s Chief Executive Officer Richard Flowers has tendered his resignation.

Flowers, who was appointed in July 2012, has indicated that he will not renew his contract which expires on July 29, 2016.

The announcement is sudden, and seems strongly to be over the Board’s decision to proceed with the purchase of Government shares in Belize Telemedia Limited (BTL) and Belize Electricity Limited (BEL) for $10million and $45million.

The share purchase is to assist a desperate Barrow Administration to meeting its financial and legal obligations in relation to the over $450m arbitration award to Lord Michael Ashcroft.

The Government is broke and in need of bailouts. The Prime Minister himself wrote SSB suggesting the deal.

This is not the first time that SSB is purchasing shares in BTL and BEL which raises questions about the legality of the approved purchase and whether it complies with international Social Security

Investment guidelines.

The International Social Security Association (ISSA) investment guidelines limit the SSB to a single investment with a ceiling of 20% of the reserves. SSB’s total reserves as per the latest SSB Financial Statements are calculated at $510,248,041.00.

20% of total reserves is approximately $102m.

According to its latest financial report, SSB’s total investment in Equity Associates is $162,932 of which $95.6m is in BEL and $67.2m is in BTL. The SSB presently owns 26.92% of total shares in BEL and 20.18% of total shares in BTL. Using the equity method to value the shares, SSB would only be able (as per law) to invest $6.4m in BEL and $34.8m in BTL. However, as this devious Government has become accustomed to rigging figures, to justify the purchase of more shares the SSB is using purchase prices (BTL $39.5M and BEL $50M) against adjusted reserve

03 3 figures ($434,288,748.00 at May 31, 2016) to arrive at 10.5% of reserves for BEL and 12% for BTL. Using this rationale, SSB has justified that it can invest up to $40M in BEL and $35M in BTL. The BELIZE TIMES has learnt that originally it was requested that SSB purchase $50M in BTL shares and $15M in BEL shares.

However when the discussion of the value of the shares came up and the members of the Board brought up the point that the value of BTL shares, as per arbitration award, presently only value $2.16 per share, the GOB changed the investment values and decided that a bigger investment be made in BEL and not BTL. But what does CEO Richard Flowers, a well-respected accountant, thinks of the move? It seems the CEO is not buying this creative method of arriving at a justification to invest larger amount of shares in BTL and BTL, which would allow the circumventing of the SSB Act. Flowers also knows that SSB’s actuary advice does not support the continued used of SSB funds for investments that do not provide liquid cash returns. This is because, as the actuary report states, SSB will need its funds to meet pension payments which are expected to reach a peak in the very near future.

Flowers decision to walk away from SSB during this time raises serious questions.

The $550 million dollars which Belize must pay Lord Ashcroft for the 2009 grab of Belize Telemedia Limited, the $70 million which the Government must pay to Fortis for Belize Electricity Limited, the legal battle over the takeover of the International Business Companies and Merchant Marine Registries which could cost the Government up to $90 million, and the borrowed $325m Petrocaribe loans, all easily add up to over ONE BILLION dollars which the people of Belize will have to be pay.

The debt has surpassed unsustainable levels with the public debt to Gross Domestic Product at 90.8%.

Last week’s news that the cost of Barrow’s takeover of BTL is over half billion dollars or $550 million

dropped like a bomb on Belizeans.

Barrow was deceitful in his response. Belizeans will pay dearly, but according to Barrow it’s a win. A win for whom? For Aschroft who will be paid half a billion for a company worth a quarter of what he will collect? Or a win for the attorneys, including private attorney, Brother Denys Barrow, who will be collecting for his years of “legal representation” at a fee no less than $1,000 per hour.

The cost of Barrow’s arrogance is more debt and less development. That $550 million which Belizeans will pay Ashcroft could have educated 50,000 students from Primary up to University level; or built 20,000 new classrooms; or funded National Health Insurance for the next 18 years; or paved 550 miles of highways. Instead, it will just be more money for Ashcroft and the Barrow family.

WAS GIOVANNI GENTLE MURDERED IN A JEALOUS RAGE? Belize City, July 6, 2016 Another man was gunned down in a hail of bullets over the weekend, but Police say it doesn’t appear to be gang related. They believe that Giovanni Gentle, 31, was killed over a woman with whom he has four children.

The incident happened at around 2:00am Saturday morning as Gentle left an event at the Loyal Endeavor Lodge Hall located at the corner of Regent Street West. The coconut water vendor had just gotten on his bike to head home when a long gunman allegedly came out from the nearby Thurton Lane and fired more than ten shots at him. Gentle was rushed to the KHMH but died before he could go into surgery.

According to ACP Chester Williams, Commander of Eastern Division South, while there may have been witnesses to the crime, Police are facing the usual challenges. Individuals fear for their lives so do not want to provide statements to the Police. “We currently have two

persons in custody that we are interviewing as our investigation into that latest homicide continues. What we know and what we have in writing are two different things and we already know what the dilemma usually is where witnesses are concerned, that people are reluctant to give statements because they fear for their lives,” Williams told the media.

The family of Gentle is adamant that their loved one was not killed as a result of gang affiliation nor was he killed because of a “street beef.” They claim that he had been receiving threatening texts, but allegedly because of jealousy over the mother of his four children.

Police have been particularly tight-lipped in this case while they try to connect the dots. According to ACP Williams, they will not release any information which will act only to “glorify” the killers.

Haul Out the Champagne!

Hope you’re ready for the big bashment next week Tuesday. Mark it down in your lil black books okay? That’s the day when we celebrate the victory for the government and people of Belize (Dean Barrow seh soh) by giving Lord Ashcroft about $190M, give or take a couple million. Funny thing is that nobody seems to be able to say why it’s a victory. According to Mr. Barrow it is, and everybody clapped. All these CEOs and cronies and Anwar and Net Vasquez clapping and grinning and I can’t for the life of me figure out why. What is so victorious about paying out nearly $200M at a time when things are as bad as they have ever been? So we print money to pay Lord Ashcroft and then everything goes up. Fuel will go up and the cost of basic goods will go up and the cost of electricity done gawn up and the cost of water will go up and GST will go up and sure as hell teachers and public officers ain’t getting that promised raise. But we clap anyway because Mr. Barrow says it’s a victory.

Misleading the people!

Mr. Barrow says he will be able to access the money which is being paid to Lord Ashcroft for the value of the Accommodation Agreement. But that’s not true. Mr. Barrow says that he will be able to use that money to fund government projects to make up for the Petrocaribe money which is all but done. That’s not true either. All the money which Mr. Barrow is paying Lord Ashcroft for the Accommodation Agreement will go into trusts held and operated by Lord Ashcroft or persons designated by him. According to the terms of the Trust, that money may be used, at the discretion of Lord Ashcroft, to fund charitable projects to benefit the people of Belize – not government projects and not projects determined by the government of Belize. Mr. Barrow is trying once again to mislead the Belizean people and to make this seem like a sweet deal. There’s nothing sweet about this deal.

Asking the Tough Questions!

Mr. Barrow needs to explain why his son Anwar is leaving BTL in March 2017. If Anwar is so tech savvy and brilliant and wonderful and great, and if BTL has done so great under his watch then why is he leaving? Mr. Barrow needs to tell Belizeans why Anwar could be getting a severance payment of almost $400,000 in addition to his big salary and benefits. Mr. Barrow needs to tell Belizeans why his son Anwar collected almost $200,000 as a Christmas bonus? What is so special about this golden child that he is getting almost one million dollars for one year of work at BTL? The people want to know Mr. Barrow. Why is it that only your family members and friends seem to be able to guzzle at the trough while normal Belizeans can’t seem to get ahead?

Codicader left hanging!

We can find $190M to pay Lord Ashcroft for the PM’s bloody foolish, hardheadedness and almost a million dollars to pay the crown prince but we can’t find any money to put into one of the biggest things to happen to this country where sports are concerned. All the countries in the region except for Guatemala (cause no matter what Sedi says they don’t like us) coming to our little Belize for Codicader and the Sports Council has to be begging all around for a little thousand here and there to host the delegations. Man the Ministry of Sports should be ashamed. The priorities of this government are really completely skewed. Imagine…if BSI hadn’t come up with a little pilinki money our Belizean athletes wouldn’t even have had sweatshirts. That’s what this government thinks about the youths of this country. But I bet you if dih youths mih name Barrow it wouldn’t have been a problem.

arrownomics at its basis means Barrow and the economy noh mix. Put another way, Dean Barrow has mixed up the economy, or what is left of it.

No Prime Minister, not even the coldhearted Manuel Esquivel, preening and pruning and pretending to be an economist, could out do the damage Dean Barrow has inflicted on the economy of the country. If it is not a mortal wound, it is a severe and critical injury that will leave the patient in surgical ward for a very long time.

No Prime Minister has been so fast and loose, so utterly squanderous of public monies; presiding over the most wasteful and corrupt regime of the nation.

Under Dean Oliver Barrownomics forty-four million dollars disappeared from the Treasury within one month of the November 2015 general elections. There are no details of expenditures; no list of procurements, no proper accounting and certainly no audited financials. Forty-four million dollars of public monies gone just like that.

Of course, for a man with an ego the size of the mountains, forty-four million dollars means nothing to him. It is not his money. Each year millions of taxpayers monies are given to his constituency as to the other UDP’s for various sundry dubious payments and “Mother’s Day” and Christmas and tacos and pibil. Millions.

This was a politician who promised the workers union, teachers, public officers and citizens that he will manage the government funds with openness, accountability and transparency.

How shallow and empty and bogus has he turned out to be.

There was a time, three or four years after becoming Prime Minister, that Belizeans were prepared to overlook the hubris and the arrogance and give Barrow the benefit of the doubt regarding his handling of the public purse. The millions he personally approved to ex-wife Lois Young Barrow kept nibbling at the growing public concern. The misappropriation, malfeasance in office and the increasing nepotism were not easily swept under the rug of distractions, stage-managed press conference and grandiloquent verbs and adjectives.

Then the Elvin Penner criminality broke, exposing a naked, lying Dean Barrow and UDP Ministers accused of allegedly being soaked up to their necks in hustling from immigration visas and passports.

All this while the spreading cesspool and corruption at the Land Ministry had become so deep and widespread that even hard-core UDP’s in Los Angeles began crying “shame, shame” on Dean and his Barrownomics.

Millionaires were sprouting up overnight from the wanton,

free- for all gangsterism that has taken root under the Prime Ministership of the man aptly described as all glitter and no substance.

As if things couldn’t get worse, and even as blood brother Dennys Barrow was choking with greed from his one thousand dollars every hour legal fees, the Petro Caribe millions exploded.

Greedy hands and blood red eyes became the order of the day.

Barrownomics at its most obscene. Over a year of unbridled expenditures topping one hundred million dollars were secretly spent by the Right Honourable Dean Barrow (they are all Honourable men, aren’t they?)

Over one hundred million dollars spent from a secretive account at the Central Bank. An account set up deliberately to deceive the nation and the lawfully constituted scrutiny institutions. No consolidated funds as mandated by the Constitution.

No report so the National Assembly as the law required. No document available to the Public Accounts Committee and none submitted to the Auditor General.

Put another way, no openness, no accountability, no transparency. None!

This saga continued until the opposition filed a lawsuit in the Supreme Court. The response of the Prime Minister? A despot’s counter-attack. Pay public monies to party hacks and the desperate poor to gather at the National Assembly signing“PetroCaribe –Roll It”. At fifty dollars per person it was a cheap ploy and an ever cheaper performance for the benefit of the gullible. But it covered over the ultimate sins of deliberately abusing hundreds of millions of dollars marked by Venezuela to uplift the poor people of Belize.

Millionaires were now openly feeding at the trough. All hail to the evil genius. All hail to Barrow and Barrownomics.

Picture this, an over ailing Pharoah disembarking American Airlines in Miami. Official explanation is another visit to his doctors over a spinal cord problem that all of King Midas gold cannot heal. Instead of checking into the Medical Center the slippery Prime Minister is in a hotel room signing a Secret Accommodation contract.

That secret contract came to light last week. Its contents reeled a nation; socking it so hard its citizens remain dumb-founded.

A whopping HALF of a BILLION dollars handed over by Dean Oliver Barrow to Michael Ashcroft.

Barrownomics had reached its unwholesome pinnacle. Foul, dirty, stinking to high heaven. Filthy lucre. The epitaph for a man who lost his way and dragged a poor and struggling country to the ground.

The Belize we used to know is no more. Where there was laughter, only bitterness, pain and suffering. Where there was hope, alas! Only despair.

Belize City, July 05, 2016 A report by the International Monetary Fund on the global impacts of de-risking has revealed that the Central Bank of Belize has also been negatively affected.

The bank, which regulates Belize’s entire banking sector and which oversees Belize’s financial operations, has lost major correspondent banking relations with two international banks: CitiBank and Commerzbank.

The loss of two of its three correspondent relations is a major hindrance for the Central Bank as it is responsible to carry out all international transactions. It has further exacerbated the banking crisis in Belize which had already seen seven of nine domestic and international banks lose relations.

There has been no official word

from the Central Bank on how it will cope with the drastic deterioration of the banking system. This may be because there is also a leadership crisis at the bank. Very reliable sources have indicated to the BELIZE TIMES that Central Bank Governor Glenn Ysaguirre will be demitting his post in September. His replacement, we are told, is the political deadweight Joy Grant, who since returning from her high-salaried diplomatic posting in Brussels, has been holding various high-level Government posts including Senator and Minister of Science and Technology (2012-2015), Chairperson of National Bank (2014-Current), Head of Financial Intelligence Unit (2015-2016) and now, soon to be Central Bank Governor.

Grant had no background in banking prior to her political appointment at the National Bank.

In fact, it was under her watch that the bank reported losses of up to one million dollars in its first year of operation.

Of course, we must note than Ysaguirre’s appointment to the Central Bank was also political.

His few public comments on Belize’s economy and financial state have been less than objective and

07 7 seemed to have been part of the political rhetoric that the UDP Government chooses to spew.

We still remember Ysaguirre’s remarks that the global recession of 2010 will not hurt Belize in any way. We wonder what he has to say now.

With exiting in mind, Ysaguirre must be occupied with sorting out a deal on his way out.

Our sources tell us that there has been a spat between the Governor and the Chairman of the Bank, John Mencias, over his financial package following a request for “compensation” for his use of a late-model Denali SUV which he acquired following his appointment to the bank. The question we put to Mencias is whether tax-payers’ funds were used to purchase the vehicle for the Governor.

While Belize is in the worst economic state it has ever been with high debt, a gaping budget deficit, banking crisis and dwindling revenues, the Central Bank has failed to properly provide the accountability and leadership that can steer our country out of the mess. On the contrary, it has been a key player to the mess that has come thanks to the UDP.

Illegal Salvadorans jailed, but Belizean “coyote” goes free Belize City, Friday, July 1, 2016 Seventeen Salvadorans, made up of 10 men, 4 women and 3 minors, appeared in the Belize City Magistrate’s Court on Friday to answer to a charge of failure to produce valid visitors’ permits.

The group was caught travelling on the Philip Goldson Highway heading towards the northern border in a van driven by a Belizean. That Belizean, Anivar Alvarenga, the Belizean farmer of Valley of Peace was charged with 14 counts of aiding and abetting the Salvadorans to remain in Belize.

When Alvarenga asked that the court to provide him with an interpreter and explained that he would like to have counsel present to represent him, the Immigration prosecutor suddenly withdrew the charges and he was set free.

The 10 men and 4 women, however, all pleaded guilty to one count of failure to produce a visitor’s permit.

Senior Magistrate Sharon Fraser fined them $1,000 each and ordered that they pay forthwith.

They were unable to come up with the money; therefore, they were taken to the Belize Central Prison to begin serving their six-month-sentence.

In the case of the 3 minors, the Immigration Department handed them over to the Department of Human Services, for them to be processed and cared for, until they are repatriated to their native El Salvador.

by Drunken Mob in Cayo Wednesday, July 6, 2016 A female Police Officer performing special duties outside the Blue Angels Nightclub in San Ignacio was assaulted by an angry mob over the weekend. Reports to the BELIZE TIMES are that WPC Tracy Stevens was hit in the back with a cement block and when she fell to the ground at least six persons attacked her.

According to Police, the altercation started when a female who appeared to be under the legal age to enter the club tried to push her way inside. WPC Stevens allegedly demanded her ID and that’s when things got out of hand, with the male companion of the young female hitting Stevens with the cement block.

Stevens was rushed to the San Ignacio Community Hospital while Police reinforcements called in from the nearby station tried to calm down the situation and ascertain who was responsible for the assault on the cop.

“As a result of the incident Marcos Juarez was charged for Obstruction, Selvin Juarez for Harm and Troymane Harris for Assaulting a Police Officer and we are still seeking two other individuals,” Superintendent Richard Rosado told the media on Tuesday.

Supt Rosado denied reports that several of the persons detained were released on Sunday so that they could vote in Village Council elections in Esperanza, claiming that “all the individuals were brought into the station and subsequently questioned.

In San Jose Village, the results are very positive for the PUP with the margin of loss cut significantly to a mere 70 plus votes.

While Vega and his most loyal supporters might claim that people are reacting to the news of his departure, the truth is that the dominance Vega usually displayed in general elections showed serious signs of fading even in the last general election held in November 2015 where Ramon Monchi Cervantes put up a tremendous fight and cut Vega’s support by hundreds of votes. PAUL JEX JR. SLAPPED WITH RAPE CHARGE Belize City, Tuesday, July 5, 2016 Paul Jex, 21, appeared before Magistrate Emmerita Anderson today and was read a charge of rape.

Police have indicated that they have several more charges that they will level against Jex. Those charges, however, were not read today.

The question of granting bail was the issue that was dealt with in today’s hearing.

Court prosecutor Corporal Christopher Smith informed the court that he has received information from the Supreme Court that Jex, who was initially granted bail from that court on the charge of handling stolen goods, must apply for a new Supreme Court bail.

With that being the situation, Magistrate Anderson remanded Jex to prison until his next court date on July 28.

On Monday, Assistant Commissioner of Police and the Officer Commanding Eastern Division Rural, Edward Broaster told the media that the police received DNA samples results back from a lab in Miami and that the DNA results confirmed that Paul Jex Jr. was the one who raped a maid during the home invasion.

Broaster also indicated that the police are awaiting another result from the lab that may tie another person to the rape.

Broaster told the media that more charges will be levied on Paul Jex, and that these charges include theft, aggravated burglary, conspiracy to commit burglary and conspiracy to commit rape.

Early police investigation of the home invasion had led police to charge both Jex and his father Paul Jex Sr. with handing stolen goods.

Ladyville Police, however have gotten back a DNA lab report and as a consequence of that they charged Jex with the rape of the caretaker’s wife. Initially, when charges were being laid in connection with that incident, police had charged Tyrone Meighan with the assault of the maid.

During the home invasion, the caretaker was severely beaten by the armed home invaders who stormed on to the property of Lebanese diplomat Sarkis Bou Nahra in Burrell Boom. Sarkis was out of the country when the incident occurred and had to cut his trip short to return home.

Kieran Morrison’s Murder Could Flare-up Gang Rivalry Belize City, July 6, 2016 Police have made no arrest in the murder of Kieran Morrison, 20, or the shooting of Kent Brooks Jr., 19 on LaCroix Boulevard which is located behind the Charles Bartlett Hyde Complex Building last Wednesday night.

The two youths were hanging out in front of Morrison’s home at around 8:30pm when one gunman came out of a nearby alley and started shooting. Morrison was hit multiple times and was pronounced dead on arrival at the KHMH, while Brooks was hit in the stomach and admitted in a critical condition.

Even as Police hunt for a killer they are also trying to deploy already scarce resources to offset the escalation of tensions between the two active gangs in that neighborhood – the PIV and Backaland gangs.

Lionel Messi sentenced to jail for hiding profits in Belize and Uruguay BBC.com, July 6, 2016 Argentina and Barcelona footballer Lionel Messi has been sentenced to 21 months in prison for tax fraud.

His father, Jorge Messi, was also given a jail term for defrauding Spain of €4.1m (£3.5m; $4.5m) between 2007 and 2009.

They also face millions of euros in fines for using tax havens in Belize and Uruguay to conceal earnings from image rights.

However, neither man is expected to serve time in jail.

Under the Spanish system, prison terms of under two years can be served under probation.

The footballer and his father were found guilty of three counts of tax fraud in Wednesday’s ruling by the court in Barcelona.

As well as the jail terms, Messi was fined about €2m and his father €1.5m. They made a voluntary €5m “corrective payment”, equal to the alleged unpaid tax plus interest, in August 2013.

The sentence can be appealed against via the Spanish supreme court.

The Brown Bombers eliminated the Hattieville Riverside Boys, 2-0 with Eldon “Tuncy” Reneau scoring both goals. Clinton Dawson scored a 2nd goal in the 52nd minute, and a miscommunication between the Ladyville defense and their keeper gave Jonathan Perrera the chance to score a 3rd goal: 3-0.

Ladyville tried to even the score, but the Stars’ keeper Elden Linares was on top of his game making 2 magnificent saves. Germany won 1-0 over Portugal, who had stopped all of Germany’s attacks for 50 minutes of regulation, until Freddy Lopez scored the winning goal in the final minute.

TIER THREE

The latest US State Department Trafficking in Persons (TIP) Report, which once more places Belize at the bottom of the barrel in failing to meet minimum standards in fighting this worldwide scourge, is no mere kerfuffle. It points to a serious and ongoing problem in our country, our inability to respond in an adequate way to trafficking and the sexual exploitation of children and women in particular. This is of course a serious indictment of the government, since as a country Belize has been expected to do its part for the past fifteen or so years. To be at the very bottom along with such countries as Belarus and others tells us that the political directorate is just not taking the issue of people trafficking seriously at all.

This year’s TIP Report is damning of Belize indeed. Child sex tourism with family members facilitating, and complicity from law enforcement officers and government officials including those at high levels, as is stated in the Report, continues as a major problem. One especially damning story is of a girl child of 13 yrs. who apparently was promised a babysitting job, but was instead forced to prostitute herself. She was never paid, and she was threatened with detention, as she had entered the country illegally. She was fearful of “a complicit law enforcement official who sexually exploited her.”

Whoever this official is, the book should be thrown at him.

I was the first chairperson of the Anti Trafficking in Persons Committee, and along with many committed partners we worked assiduously to bring about a paradigm shift in trying to get immigration and police officers in particular to look keenly for trafficking and exploitation and not to focus solely on illegal entry into Belize and violation of labor laws.

Believe me, it was very hard, and it seems that all these years later so many key front-line officers are still just not getting it in how important it is to search for victims from the child protection and protection of vulnerable persons point of view.

It is also incredible that police found a van-load of persons being smuggled and or trafficked on the Philip Goldson Highway. They took the Central Americans into custody for immigration violations, while letting the “coyotes” off scott free!!

This smacks of gross incompetence and the failure of government officials to understand basic facts regarding the Trafficking in Persons (Prohibition) Act. Remember that the first Trafficking in Persons (Prohibition) Act was hurriedly passed back in 2003, when pressure came from the United States for us to begin responding to the reality of people trafficking and the first TIP Report was released. The second Act, which we passed in 2013, repealed the earlier legislation, plugged various gaps, increased the penalties for trafficking in persons, and provided for restitution for victims.

But the laws on our books are simply not enough. Ms. Judith Alpuche of the Ministry of Human Development and her partners across various sectors are doubtless doing what they can to educate and sensitize government workers and officials and the general public on the problem of human trafficking. And it must be frustrating for her and others who care to be seeing our country get the big black eye of being on Tier Three. Those of us who have been sensitized and who have continued to work on prevention and interventions are similarly discouraged at this latest 2016 Report. But the problem lies clearly with the leaders and the political directorate, who have not shown the political will to really give this issue the seriousness it deserves.

It also sent the wrong message when convicted trafficker Estela Gonzalez was let off with a fine but no jail time.

Politicians now in power who continue to ride roughshod over the very vital pieces of legislation that they themselves passed, the continuing ignorance and insensitivity of government officials in the police, immigration and labor departments, trafficking-related complicity, and even adults who are willingly allowing their children to be exploited; all these are undermining the efforts of the National Committee for Families and Children, the Human Development Ministry, UNICEF and other partners who “get it” that Belize has just got to do better in fighting all forms of exploitation. Belize cannot continue to be on Tier Three, despite whether we think it is fair of the US State Department or not to have placed us there two years in a row.

We must fight against trafficking and exploitation not because the United States of America dictates that we must, but because it is the right thing to do.

The BTL Saga: Legal Robbery

Michael Reid “Well I would say to the consumers - as I would to any group of citizens in a country - you get the politicians you vote for.” ~Michael Ashcroft The Prime Minister of Belize last week called a Press Conference to inform the people of Belize that the BTL matter was concluded and done away with. According to the Prime Minister, it turned out to be a good deal for Belize and he feels “utterly vindicated by the conclusion.” While the Prime Minister is feeling “utterly vindicated” however, the people of Belize, who at the end of the day will be the ones who must foot the bill, are feeling utterly violated.

The on the surface cost of the government of Belize forcefully acquiring Belize Telemedia Limited (BTL) stands at over half a billion dollars; that’s billion with a “B”! That of course, does not even take into consideration what Jules Vasquez referred to as “those little things called lawyers’ fees”. Over the seven plus years that this case has been going on, legal fees to the government have been adding up to millions and millions of dollars. The truth of the matter is that the Prime Minister can be as flippant and cavalier as he wants to be but at the end of the day, what we have here is a travesty of the highest order.

The saga that is Belize’s telecommunications industry is indeed an interesting one, fraught with drama, compromise and drawn out litigation. In 1987, the British company that was Cable and Wireless became Belize Telecommunications Limited and shares in the company were sold to Belizeans at home and abroad.

Among those buying shares was a shrewd businessman named Michael Ashcroft who in 1992, acquired major-

In August of 2009, the UDP government of Prime Minister Dean Barrow embarked on a period of nationalization; first forcefully taking BTL and then Belize Electricity Limited.

Both moves were ill-advised at best and together have cost the people of Belize well over a billion dollars in debt that will hang over the working class of this country for generations to come. BEL, of course, is another story so let us stick to the BTL travesty. As could have been expected, Ashcroft did not take the strong-arming of his company lightly and what ensued were seven years of costly litigation. Litigation that has left the people of Belize very poor but has also left the Barrow family of lawyers very rich.

The big mistake that the then PUP government made was they did not make this part of the deal public. After government changed in 2008, the new UDP government, under the shrewd Dean Oliver Barrow, revealed the terms of this agreement to the people of Belize and rode that horse to death. That dead horse is still being ridden today as the Prime Minister in

The Half Billion $ BTL Disaster

By Gilroy Usher, Sr. Last week the Permanent Council of Arbitration ordered the Government of Belize to pay Michael Ashcroft $458 million or almost half a billion dollars for confiscating Belize Telemedia Ltd (B.T.L.) from him in 2008.

That financial burden is an albatross around the neck of the Belizean people, who have to pay the bill. The ruling is like spoilt milk. No matter how you stir it, it’s still bad for the poor people of this nation.

With the ruling the government has to pay Ashcroft almost

$500 million for B.T.L. although the company is worth far less than $200 million. We have to pay Ashcroft two times the value of the company. $200 million is for interest alone. How can that be good for this country? The interest became so humongous because after seizing B.T.L. in 2008, the government refused to adequately compensate Ashcroft for the company for eight long years.

One of the sad things about the B.T.L. takeover is that in these hard times, the Belizean people will be squeezed mercilessly to pay Aschroft the $458 million. That

will be done through even higher fuel prices, higher prices for a wide variety of items in the stores, and interest on Treasury Bills and other loans the administration will have to make to complete the payment to Ashcroft.

Another sad thing about the B.T.L. takeover is that it was used to provide huge contracts to close relatives of the Prime Minister including one of his sons and one of his brothers. Those persons have made tons of dollars as managers, attorneys, and different agents for the company. Now you can bet your last dime that none of them, who laughed all the way to the bank as a result of the takeover, will donate even a dollar to help meet the nationalization settlement.

The third sad thing about the Government’s confiscation of B.T.L. is that the $458 million we have to pay Ashcroft for the company could be used for needed community projects throughout this nation. $458 million is a lot of money. Government got $350 million from PetroCaribe which it squandered mainly on programs that were election gimmicks that

2016 did nothing to lift our people out of poverty. We the hardworking taxpayers of this country have to cough up $100 million more than all the PetroCaribe money the country received, to pay back Michael Ashcroft due to the wrongheaded policies of this UDP administration almost a decade ago.

Belize has tremendous need. Close to half -billion dollars is serious cash. With $458 million, we could build more primary schools, high schools, and sixth forms to educate our people. Out of that money we could concrete 100 more of these bad streets in Belize City. With $458 million we could buy acres of land, fill it properly, and give it to our people for them to build their homes. Out of all that money we could build scores of two and three bedroom concrete houses for deserving families. Some of all that money we have to pay Ashcroft could also be used to assist our farmers, provide more benefits for senior citizens, and create hundreds of needed jobs by assisting small businesses.

Despite the best efforts of the administration’s spin doctors, the people of this nation know that the confiscation of B.T.L. was a half billion financial disaster because they have to pay the $458.00 million debt that is twice the value of the company out of their pockets and its money they badly need.

THE WONDERER AND GUATE”MALA” – THE PROBLEM – PART 2 THE BORDER SOLUTION In last week’s article we wandered around the Guatemala issue and concluded that there were many problems caused by the “Chapines”, the “Cuques” and especially the “Chafarotes” from across the border. Mainly extraction of our timber, our xate, our scarlet macaws (chick & eggs), our entire wildlife, our gold, looting of our archaeological resources and cave systems, plus debushing of our reserve for farming and construction of never ending pickados all over our jungle. To compound it, they are leaving behind garbage, human waste and cianide in the river system from where we source our drinking water.

Benque, San Ignacio, Belmopan, Belize City and all surrounding villages obtain their drinking water after the Guatemalans contaminate it. Makes me wonder! As mentioned previously Peace and Harmony seem to be deteriorating between the populations and both governments seem to be wandering and are in harmony with doing “nada”. As such I make the following recommendations: THE SOLUTION: 1. Tell Guate“mala” and the OAS to hell with the adjacency zone. Across their border is almost completely denuded by agriculture. We are the only fools to leave a reserve.

2. Creation of a Western Border Defense Committee comprised of Minstries of Foreign Affairs, Works, Finance, Lands, Defence, etc. Assisted

by BDF, Customs, Immigration, Police, Environment, Forestry, new Farmers Association, Businesses, Lawyers (please Not Sedi), and NGOs, etc., to develop a plan of action.

3. Dereservation of some 70,000 acres along the border, inclusive of a 66’ reserve along the border and a main road parallel, see figures. These people have already cleaned some 10,000 acres plus pickados.

These lands should be leased for 30 years with specific conditions to be developed by the Western Border Defense Committee.

4. Installation of a border barrier. The so called “Biological corridors” are not functioning along this route as Guatemala has almost all agricultural lands on the other side of our reserves. Additionally the il-

legal farming, deforestation and other illegal activities make the attempt even more futile.

The USA and EU are building hugh fences/ barriers to keep illegal people out. Our barrier would be symbolical and the “human farming barrier” will be the important one along with easy accesibility to the properties via a road.

Eventually we can even open another legal immigration border point here.

5. Creation of 68 x 1000 acre farms, issued out free to agricultural developers willing to develop the access road and do farming operations in the next 12 months, see figures. The cost of these lands are nothing compared to the economic, natural loss and negative impact we are presently having. Perhaps behind the big farms, smaller parcels can be granted to smaller farmers that are willing to work and be productive.

6. The farmers should build observation towers from the timber extracted while preparing the farmland. Perhaps a temporary logging operation could be developed. All the timber could be used for building offices and dorms for our authorities to utilize.

7. The farmers must also be responsible for building an all-weather road along and parallel to the border.

8. Since the present government claims to have bought two helicopters then at least some helicopter pads could be built. I wonder if these helicopters are really here?

9. Have you ever wondered how many rich Guatemalans related to the military bosses have businesses here in Belize? In Tourism, in sugar cane, in importation/exportation, in production, with Belizean passports…at least these are legal so I wonder if the Belmopan Big Ba..s Man can ask them to contribute. Just Wondering!

EDITORIAL en Espanol LA BARROWNOMIA - ECONOMIA ESTILO BARROW

La Barrownomia básicamente significa que Barrow y la economía no son compatibles. Dicho de otra manera, Dean Barrow ha enmarañado la economía, o lo que queda de esta.

Ningún ministro, ni siquiera el insensible Manuel Esquivel, siempre maquillando y podando y pretendiendo ser un economista podría hacer más daño de lo que Dean Barrow ha infligido a la economía del país. Si esto no es una herida mortal, pue es una lesión grave y crítica que dejará al paciente en la sala quirúrgica por mucho tiempo.

Ningún Primer Ministro ha sido tan aligerado y suelto, tan absolutamente derrochador de fondos públicos; gestionando el régimen más derrochador y corrupto de la nación.

Bajo la Barrownomia de Dean Oliver se esfumaron 44 millones de dólares del Tesoro durante el mes de las elecciones generales en noviembre de 2015. No hay ningún dato de los gastos; ninguna lista de contrataciones, no hay contabilidad adecuada y sin duda tampoco hay Estados financieros auditados. 44 millones dólares de fondos públicos se han desaparecido sin dejar huellas.

Por supuesto, para un hombre con un ego del tamaño de las montañas, 44 millones de dólares no significan nada.

No es su dinero. Cada año millones del dinero de los contribuyentes se le dan a los representantes UDP y a su área electoral para proyectos y asuntos precarios como “Día de la madre” Navidad y para comprar tacos y pibil. ¡Millones!

Este era un político que le prometió al Sindicato de trabajadores, maestros, funcionarios públicos y ciudadanos que administraría los fondos del gobierno con transparencia, rendición de cuentas y transparencia. Que superficial, vacío y falso él resultó ser.

Hubo un tiempo, tres o cuatro años después de convertirse en primer ministro, que los beliceños estaban dispuestos a pasar por alto la arrogancia y la petulancia y darle a Barrow el beneficio de la duda con respecto a su manejo de los erarios públicos. Los millones que él le aprobó personalmente a la ex-esposa Lois Young Barrow es lo que fue erosionando la creciente preocupación pública. La apropiación indebida, la malversación y el creciente nepotismo no fueron se pudieron ocultar fácilmente barridos bajo las distracciones, conferencias de prensa arregladas y verbos y adjetivos grandilocuentes.

Los millonarios brotaban de noche a la mañana con tanta perversidad, del gansterismo que ha echado raíces durante

el cargo del Primer Ministro, del hombre descrito acertadamente como mucho ruido y pocas nueces.

Como si las cosas no podían empeorar, e incluso mientras el hermano de sangre Dennys Barrow se asfixiaba con la avaricia de sus honorarios de mil dólares por hora, explotó los millones del Petro Caribe. Las manos codiciosas y ojos ensangrentados se convirtieron en la orden del día. La Barrownomia en lo más obsceno. Más de un año de gasto desenfrenado por más de 100 millones de dólares se gastaron secretamente por el Muy Honorable Dean Barrow (¿son todos los hombres honorables, no?)

Más de 100 millones de dólares se gastó de una cuenta secreta en el Banco Central. Una cuenta establecida deliberadamente para engañar a la nación y las instituciones de control legalmente constituidas. No se gastaron fondos consolidados como manda la Constitución. Nunca se le informo a la Asamblea nacional como lo requiere la ley. Ningún documento se le hizo disponible al Comité de Cuentas Públicas y ninguno se le presentó a la Contraloría General.

Dicho de otra manera, no hay apertura, no hay rendición de cuentas, y no hay transparencia. ¡Nada!

Esta saga continuó hasta que la oposición presentó una demanda ante la Corte Suprema. ¿Cuál fue la respuesta del Primer Ministro? El contraataque de un déspota. Le pago dinero al público y partidarios y a los pobres desesperados que se reunieron en la Asamblea Nacional cantando -” Que siga el Petro- Caribe”. Cincuenta dólares por persona fue el truco barato y un desempeño cada vez más barato en beneficio de los crédulos. Pero cubrió el último pecado de abusar deliberadamente de cientos de millones de dólares marcados por Venezuela para sacar de la miseria a las personas pobres de Belice.

Ahora los millonarios se alimentaban abiertamente en el canal. Todos felicitaban al mal genio y la Barrownomia.

BRICENO BLASTS BARROW! “..the Prime Minister is really trying to take the Belizean people for fools”, PUP Leader Hon. John Briceno says at PUP Press Conference

June 30, 2016 Independence Hall, Belize City We are not surprised that the Prime Minister thinks the Arbitration Award is a victory for the people of Belize. Actually we would have been shocked to hear him say otherwise.

That would have been out of character for him, even if… as far as all our eyes can see, it is mainly the Barrows and Mr. Ashcroft who are the big winners in this Miami DEAL!!

I can vividly recall these words that the Prime Minister so eloquently spoke in his press conference of September 14, 2015, after he had already signed the SECRET Barrow/Ashcroft Accommodation Agreement in Miami. And I quote… “We will no longer seek to skip and jump and dodge and run and postpone the inevitable for another day while interest continues to run” end of quote. In other words, what the Prime Minister stated was a clear indication that he knew all along that the people of Belize would be saddled with close to a HALF BILLION DOLLARS in debt, all because of his ego, his arrogance, because of hubris and his quest to win a third term in government.

There is no good reason, other than being bull-headed, why the issue should have been dragged out in the courts for over six years. There is no good reason why the Belizean people will now have to pay over Half Billion Dollars for a company that is valued less than $100 million dollars. But in vintage Dean Barrow style, and we expected it, he now wants to blame this scandalous award on the PUP, a Party that has been out of government for over eight years.

Well this is not on the PUP: this entire Deal is solely the doing of the Prime Minister. The reality is that the Prime Minister had over seven years to settle this acquisition. He could have settled in 2009, or 2010, or 2011, or 2012, or 2013, or 2014.

But he didn’t. All along skipping and jumping and dodging and postponing the inevitable. All this skipping, and jumping and dodging have cost

the Belizean people $198 million dollars in interest alone while racking up millions of dollars in legal fees. And all this time the Prime Minister has been beating his chest and misleading the Belizean people, but never one day coming clean to explain what the true cost would be. He waited until September 2015, one month before the CCJ would have ruled on the constitutionality of the nationalization.

So why did the Prime Minister not wait for the CCJ ruling? The answer is simple, the man wanted to win a third term by any means necessary.

He timed his concession to Lord Ashcroft just in time to pull the hood over the heads of the Belizean people for a third consecutive election.

The Government does not have any development strategy for our country. With Petrocaribe no longer at their disposal and a Prime Minister who is an economic dunce and who administered a borrow-and-spend policy for the past seven and a half years, Belize is in a financial mess. The economic outlook for Belize is dire and the key issue is that one cannot legislate motivation or competence.

It is the private sector who risks their families, homes, and future to spur economic activity aimed at increasing jobs and opportunities. Government cannot do this. Now, tax payers will have to pay close to a billion dollars for Belize Telemedia Limited (BTL) whose earnings per share

has dropped well over 50% since it was nationalized and is facing true competition from Speednet which can well result in its disappearance in five years or less. This company is only worth 30 cents on the dollar yet we are being burdened with a huge debt. Furthermore both employers and the hard working people of this country are being asked

by Dean Barrow, Anwar Barrow, Net Vasquez and the Social Security Board of Governors to put an estimated $10 million dollars into a company whose profits are constantly declining.

That said, we must now worry that the perfect storm is now on us.

Belize has staggering debts which it cannot realistically pay for and remain viable. The end result will be that some kind of retrenchment or

restructuring WILL happen. Barrow will be forced to reduce government’s payroll dramatically and immediately.

What is needed is a true strategy for development, one which is private-sector led. A strategy that creates opportunities rather than public debt. This UDP Government clearly has and is inept in creating any formidable economic strategy to move this country forward.

With scarce resources and the upcoming storm we must now bunker down and prepare to weather this economic storm. There are so many things that we must do and do quickly. The question is, will the Government realize that it does not now have the wherewithal to get us through this economic storm? The PUP is led by a successful busi-

2016 cent of this money is not going to ASCHROFT but will be held in an account in Belize to be spent on capital projects at the behest of the Government. We have to give the Prime Minister credit for being so brazen or as Belizeans would say barefaced. The Prime Minister is really trying to take the Belizean people for fools. I must say that the Prime Minister is dead wrong. The Belizean people are no fools. They can smell the rankness of this deal from miles away.

What the Prime Minister is saying… is once again completely misleading and untrue. Sixty percent of the money will come into a bank in Belize, probably Belize Bank; but no, that money is not Government’s money and no, that money will not be controlled by Government. It will be controlled by Ashcroft and his people. There is no Government representative on this Trust, no Government representative on this account. Not even Dean Barrow is on this account. This is all Ashcroft money. If it was Government’s money, then why would the Government even have to pay it to Ashcroft? If it was Government’s money, then we should only be paying the 40 percent or $200 million dollars to Ashcroft, and not over half a billion dollars.

In effect, what the Prime Minister is saying is that he will ask the National Assembly to approve Cap 2 projects in the Budget and then he has to go cap in hand and on bended knees to Mr. Ashcroft to beg for monies to fund these projects.

This is truly an insult to the Belizean people and shows how far Dean Barrow would go to secure his third term in government. My friends, for a man who claims to be the beacon for transparency and accountability, the Prime Minister has disgraced himself and our nation!

Guatemala Boycotts CODICADER in Belize Belize City, July 6, 2016 There will be no Guatemalan athletes participating in this year’s Central American Council of Sports & Recreation (CODICADER) Games because the regional sporting initiative is being held in Belize.

The Guatemalan Government will boycott CODICADER as a result of its dispute with Belize, even though it is they who are aggressing Belize and have even annexed the Sarstoon Island, which is part of Belize’s territory.

Guatemala is taking things very seriously. The boycott follows their hardline decision to recall their Ambassador in Belize, Manuel Roland Barillas.

While Guatemala offensive against Belize has not ceased, one can only wonder when Belize’s Government will have the fortitude to take such drastic steps against our neighbors who use intimidation and bully tactics against our military and citizens.

Not even in the incident where Police Officer Danny Conorquie was gunned down by armed Guatemalans was Belize’s Foreign Affairs willing to take a stand. Not when Guatemalans took our Sarstoon and certainly not when Belizean Roger Plett was kidnapped

by Guatemalans. Foreign Minister Sedi Elrington just kept saying that we must be friends with Guatemala.

GOB ordered to pay $5,000 for citizen’s false imprisonment Belize City, Monday, July 4, 2016 Supreme Court Justice Shona Griffith delivered an important ruling in a civil suit brought by the Smith family of Giles Street in Belize City, who were seeking damages for false imprisonment and malicious prosecution by security forces.

While Justice Griffith did not find merit in the claim filed by Alrick Smith Sr., his wife, Sandra Casey, his daughter Tamica Smith and his son Leon Smith, she did find that Smith’s niece, Ishaida Brooks, was falsely imprisoned, so she awarded her $5,000 in damages.

Brooks went to her relatives’ house after she saw a commotion involving Gang Suppression Unit police officers and instead of remaining a bystander, she was pulled into the dilemma and ended up being arrested and charged under the Police’s draconian gun law.

Justice Griffith’s findings that Brooks, 22, had been falsely imprisoned as a consequence of policemen following the dictates of the Firearms Act is the third successful challenge to the Barrow Administration’s cruel law that has deprived a number of citizens of their personal liberty.

The first major judicial blow to the 2010 Amendment to Firearms Act, which prescribed a minimum sentence of 5 years to anyone convicted under the law, came about

when Justice Michelle Arana ruled in a constitutional challenge brought about by Allison Major in April. Major claimed that constitutional right to the presumption of innocence was violated and that he should not have been subjected to arrest and imprisonment because he was not a resident at the house where illegal firearms and ammunition were discovered. Major was represented by attorney Anthony Sylvestre Jr. In May, another major challenge to the Firearms Act was mounted in the Supreme Court, when attorneys Dickie Bradley and Anthony Sylvestre Jr. challenged the constitutionality of the minimum 5-year sentence which the act prescribed.

No less than Belize’s Chief Justice Hon. Kenneth Benjamin ruled that the 5-year minimum sentence was unconstitutional in Vincent Smith’s case. The importance of the Chief Justice’s ruling is that persons who are convicted of illegal firearms and ammunition are no longer subjected to the 5-year minimum sentence, and Magistrates can use their discretion in sentencing those convicted under the act.

In the most-recent case of Ishaida Brooks she went across to her relatives’ house, after witnessing a commotion with GSU police officers. The family had just returned from the internment of its youngest member who was gunned down a few days prior and they were in

the process of holding a repast in their yard when a young man who was pursued by police ran into their home.

Police followed the young man into Smith’s house. When they carried out a search they found a .9mm handgun under a mattress inside a bedroom.

In her ruling, Justice Griffith noted that the police did have probable cause to search the Smith house, but found that the police did not exercise sufficient care to inquire if Brooks was a resident at the house before they arrested and charged her.

Justice Griffith had requested that a senior police officer be present in court when she delivered the judgment because although the Smiths did not succeed in their claims, the ruling must not be seen as a victory for the police who she stressed must exercise more care in enforcing the law.
