AMESSAGEFROMOUR

Ibelievebyansweringessentialquestions regardingourcurrentandpotentialnew stateconstitution,itisinthevoter’sbest interesttoopposeconstitutionalchanges untilwetakethetimeandenergytovet, discuss,anddeliberateramificationsfor changestoourcurrentstateconstitution.

Whatisthepurposeofastate constitution?

Thestateconstitutionisthekeystoneof thelawofLouisianaensuringtherightsof individuals,describingthedistribution andpowerofstateofficialsandlocal government,establishesthestateandcity civilservicesystems,createsanddefines theoperationofstatelottery,andthe mannerofrevisingtheconstitution.

Whychangethecurrentstate constitution?

Manylawmakershaveassertedthe currentconstitutionistoolongandneeds tobesimplifiedlikeotherstates.There’s truththattheconstitutionisverylongbut that’sbecausevotersovertheyearshave approvedamendmentsthatclarifythe currentdocument,manyofwhichinclude protectionslistedinthepurposeofthe constitution.Thefactis,simplification soundsgood,butthere’sbeenverylittle discussionwiththepublicregarding whichprotectionswillbemodifiedor removed.There’salsobeendiscussion aboutmakingconstitutionalchangesin ordertofreeupmoremoneyinthestate budgettodealwithanexpectedbudget shortfallnextyear.However,wedon’t

knowifthatmeanstakingmoniesthatare alreadyprotectedanddedicatedto anothersourceintheconstitution.There hasalreadybeenconversationregarding movingtaxprotectionsthatcouldhave negativeconsequencesformostcitizens inourstate.

Arecertainaspectsofthecurrent stateconstitutionexemptfrom discussionintheproposed constitutionalconvention?

Someamendmentswereadoptedthat wouldexemptcertainprotectionsfrom theproposedconstitutionalconvention, includingeducationalfunding, retirement,andhomesteadexemptions. Scholarshavepointedoutthatoncethe constitutionisreconsiderednothingis exemptasdemonstratedduringour state’slastconstitutionalconventionin 1974.WhileHouseBill800(HB800)did notpass,SenatepresidentCameron Henrysaidlegislatorsmightstillconvene anAugustspecialsessiontoreviewthe state’sfoundationalgovernance document.Thismeanstheamendments toHB800wouldnolongerapply.Thisalso implieseducationandretirementareno longerexempt,puttingtheseandother protectionsatrisk.

Whyrushtheprocessofwritingand votingonanewstateconstitutionby November2024?

TheLouisianaRetiredTeachers Association(LRTA)supportsthe developmentofsoundpolicythatwould potentiallybecomeournewormodified stategoverningdocument,butweneedto takethetimetodiscussanddeliberateany changestothestateconstitutionthathas servedourstatewellsince1974.Inthe pastthestatehastakenatleasttwoyearsto conductaconventionandmake recommendationswhileseekingpublic inputbeforesubmittinganewdocument tothepublicforconsideration.Currently theplanisforcommitteestomeetinJuly andmakerecommendationsduringa specialsessionforconsideringarticlesto changeduringatwo-weekperiodin August.That’sanextremelyshortperiod

oftimetodevelopanewdocumentgiven thelengthofourcurrentconstitution. Thatleavesonlytwomonthstoinform thepublicaboutthechangestoa documentthatcouldremoveprotections andchangethewaywegovernourcitizens atthelocalandstatelevels.

Whorepresentsthevotersatthe proposedstateconstitutional convention?

Duringpriorconstitutionalconventions, bothinLouisianaandotherstates, delegatescampaignedandwereelectedby thevotersofthestate.Underthenew scenario,thelegislatorsthemselveswould developtheproposedchangesforthe publictovoteonduringthefallof2024. Thisisproblematicforseveralreasons. First,manylegislatorsdidnotrunona platformforconstitutionalchange. Therefore,theydonotknowourviewson whatkindsofchangesmightbemadein theconstitution.Second,wehada significantturnoverof48newlegislators beingelectedlastfall.Finally,intermsof representingthepeople,68current legislatorsranunopposed.Itstandsto reasonthatifweelecteddelegatesforthis importanttasktherewouldbegreat interestfromthevotersincreatinga sounddocumentthatgovernsourgreat state.

Whyopposeanewstateconstitution?

LRTAopposesthestateconstitutional conventionandthewritingofanew constitutionorconstitutionalchanges, becauseprocedurallythetimenecessary tothoughtfullydeliberatechangewithout appropriateinputandnoticefromthe residentsofLouisianacouldcreatea documentthatwouldbedetrimentalto thecitizensofourstate.

Forthesereasonsweencouragemembers, andperhapsmostimportantly,allvoters inLouisiana,toopposeconstitutional changesnowandinthefuture.

AMESSAGEFROMOUR LRTAPresident

In 1991 I made a promise on behalf of all retirees tomy mentor,Warren Sevin. Warren preceded me onthe TRSLBoardofTrusteesfrom 1978-1991andwasachampionof theretirementprotectionsin1974 StateConstitution.Hewas instrumentalingettingadditional protectionsforretirementsystems throughthe1987amendmentsto Article10Section29.Warren instilledinmethepassiontoprotect thebenefitsofallretireesandthe promiseImadewastwo-fold:tokeep thoseprotectionsintheconstitution andneverletourretirementsystem fallpreytothelegislatureorany electedofficial.Overtheyears,we managedtodefeat legislative attemptsandattemptsbyelected officialstoweakenourcontrol ofour constitutionallyprotectedfunds.We nowfaceanotherpotentialthreat—a newconstitution.

Led by theefforts of LRTA, a convention bill failedtopass, but the Senate president was quoted saying,“Lawmakershaven’tshut thedooronitcompletelyyet.”That said,Ipredictaspecialsessionto bringitbacksince theconvention is theGovernor’s top priority. Honoring my promise toWarren, I will continue to opposeanyefforts thatthreatenourconstitutionallyprotectedretirementfunds.

The governor picked 27 of his own

delegates totakepart in a convention; the rest of the delegates wouldbethemembersoftheHouse andSenate,171total.Forthe1974 convention,voterselecteddelegates havingaclearpurpose,explicit goals,transparency,andspecific proceduraldirection.These measuresarecurrentlyunknown, andwillcontinuetobe,ifthe conventionisproposedagain.That isaclear-cutissuethatcontributes tomyhesitancytosupporta conventionandmysuspicionof evenalimitedconstitutional convention.

Furthermore,thelimitedperiodto revisetheconstitutionmakesit difficulttofullyexplorethe implicationsofrewritinga complexdocument—twoweeks— the1974conventiontook110days. Mostimportantly, the public is deprived of participation inthe process when citizens should have an opportunity tovoicetheir opinionsandactivelytakepartin shapingthestate’sfoundational document.

Therecanbepotentialbenefitsofa newconstitution,butwithbenefits comerisks.Updatingthe constitution canaddress current needs and remove outdated provisions.However,with the expiration ofthe state salestaxnext year,willthoseso-calledoutdated provisionsandcurrentneeds simplygivethegovernorand legislatureeasieraccessto constitutionallyprotectedfunds? Theexpectationisthatthedebates willfocusonwhichfundswith constitutionalprotectionsshould beremoved.Supportersofthissay removingtheseprotectionswould allowbetterandmoreflexible budgeting,butatwhoseexpense?

The convention should be an

opportunity to focus onspecific issues that the 216 piecemeal amendmentsmaynotadequately address.Itshouldsimplifyand streamlinetheconstitutionby consolidatingandreorganizing amendments,makingiteasierfor citizenstounderstand.These outcomesaregood,butindoingso anewconstitutioncouldremove constitutionalprotectionsfor educationfundingorprotections forretirementfunds,makingthem moreaccessibleandeasiertouseby thegovernorandlegislatureif thereisashortfallinthestate budget.Remember,aportionofthe statesalestaxgoesawaynextyear. Thatmoneymustbereplaced.

A convention can reexamine the balance of power among branches of government. The delegates may propose changes to enhance checks and balances or clarifythe roles of differentinstitutions. It is another risk.Thatbalanceofpowershould beequalforallthreebranches-executive,judicial,andlegislative-andinstitutions,suchasstate boards,shouldbefreeofpolitical influencetoworkeffectively.

Theprobablerisksassociatedwith aconventionoutweightheunlikely benefits.GovernorLandry’s goal is to present a new constitution to voters on November 5. On that day, I will keepmy promise to Warren!

Thisbillproposedarewriteof theLouisianaState Constitution.Itstatesthatthere isaneedtoaddressanumber ofareasthatrequire constitutionalchange,thatthe constitutionrestrictsthe legislaturefromeffectively addressingstateand constituentneeds,andthat revisionofthestate constitutionisneededto addressthestate'scritical needsandtransitionprovisions thatdonotconstitutethe fundamentalandfoundational lawofthisstatetostatutory provisions,andtocraft provisionsthatallowlegislative solutionswithouttheneedto constantlyamendthe constitution.
