Stop the Charade of “Public Comment”
Dave Kisker, President, People United for Responsible Goverment If you have ever attended a land use hearing before the Weld County Commissioners, you will have observed a quasi-judicial, several step process concluding with a decision to approve or deny the application. First, the County Planning Staff gives a presentation about the application, concluding with a recommendation for the outcome—denial or approval. This is followed by a presentation from the applicant that attempts to justify the proposed change, whether it’s a use by special review (USR) or a proposal to rezone their parcel that would allow other uses. In both cases, specific criteria are supposed to be met according to the Weld County Code. The Commissioners would have you believe that the next step, Public Comment, is an important part of the process, and that they might even depend on competent testimony from knowledgeable members of the public on the impacts, positive or negative, of the proposed land use. Public Comment is then followed by an opportunity for the applicant to respond to the concerns that were voiced by the public, and then, the County Commissioners render a decision on the application. Since this is a “quasi-legal” process under State law, it is supposed to be fair and honest. However, the reality is different. After watching numerous such hearings over the last several years, it has become clear that in nearly all cases, the outcome is a foregone conclusion. Public Comment does not matter. Simply put, the Commissioners are merely “letting members of the public talk”. As suggested by their complete disinterest in this part of the proceedings confirmed by their lack of questions or other engagement, any hope that Public Comment has an impact is misguided. And, in some cases, such as the Martin Marietta rezoning hearing on 22 July 2020, these same people, who you have elected to be your representatives, blatantly ignored the well documented public input (available here: https://tinyurl.com/y2xk9377 ) while at the same time accepting without scrutiny the falsified contributions from Martin Marietta Materials. But, the Martin Marietta Materials rezoning was just the most recent example. I can’t think of many, if any, examples where public comment changed an outcome. It simply doesn’t make a difference unless it happens to coincide with the specific concerns of a Commissioner, such as an RV storage facility, or if the proposed use would be near one of the Commissioners, such as a compressor station near Johnstown. I suppose that in this day and age of government “openness”, public “participation” is the politically correct approach, but, if it doesn’t matter, what’s the point? In fact, in this case, there is evidence that in this case, at least one of the Commissioners had decided to approve this rezoning days in advance of the hearing and said so in conversation. So, since Public Comment will be ignored anyway, I suggest that it’s time to stop the charade. Let’s just save everyone’s time, and let the County Commissioners get together in a smoke-filled room with their crony applicants and decide what’s “good” for the rest of us. That’s essentially what happens anyway, but at least then, we could all save hours of wasted time and avoid the window-dressing of “fairness”.

by Bob Grand The world never slows down, have you noticed? Election day is coming in November. In reality, it will probably be a lot earlier with mail in ballots. I am not going to suggest who you should vote for. That is up to you, as it should be. All I ask is that you look at the facts, think about them, and base your decision on who to vote for, whoever it is, on which candidate would best represent what you believe to be the best course for the future for you, your family, your town, your county, your state, and the country. There is a large percentage of voters who will not do that. They will either vote Democratic or Republican, blindly. I challenge you to explain the difference between the Democratic National Committee and the Old guard Republican party members in Weld County. Do either really care about the people they are supposed to represent, or do they just want to maintain the status quo control of their organizations, the public be damned? There is a quote often attributed to George Orwell, author of 1984, that goes something like this: During times of universal deceit, telling the truth becomes a revolutionary act. He really did not say it. The point is, we live in times where statements are made by people who want you to believe what they say. Supported by a media that plays extremely fast and loose with the truth. Because it is America you have a right to say what you think, that does not mean that what you say is true. Be aware and be questioning. Just because it appeals to you on the surface does not mean it is right. We have been going through a period that all Americans should be concerned with. Being vilified because you disagree with someone is wrong. We have a right to our opinions, and we are entitled to voice them, protected by the United States Constitution. That does not mean you should fabricate a set of facts to support it. There is some justice. Nicholas Sandmann, the Covington High School student who sued the Washington Post for defamation, has settled his case for an undisclosed sum. There is still half a dozen more suits he has filed. It is unfortunate but all of us should be concerned that the press and the government should pursue individuals for political objectives without having consequences if it is proven they have violated the constitutional rights of anyone. Recently there was an interesting piece about applying the Bivens Act (403 US 388 1971), where the Supreme Court established the right to bring lawsuit for financial damages against individual law enforcement officers acting under the color of Federal law, for violations of constitutional rights. With the announcement this past Friday of the first guilty plea in the Russian investigation one has to wonder how far up the chain the path will lead and to what criminal and civil actions might evolve. We all should be concerned. This time around it was the President and some of the people around him that were accused, and because many people do not like the President little was said. This time is was the President, if left unchecked who does it happen to next? You or a family member? Our Governor and the state legislature have a very unpleasant budget experience to deal with, a significant revenue shortfall. This year the pain was offset by having large COVID 19 payments to dip into that were not scrutinized very hard as to where they went, not so in the future. Colorado, by law, has to have a balanced budget. Our entire state budget needs to be reviewed, line by line, something the federal government would be wise to do. Do not hold y7our breath. Did you know that the Colorado Oil & Gas Conservation Commission raised the mil levy used to fund operations rate it charges oil and gas companies 36% to fund operations including the five new full-time paid Directors at $150,000 per year each? Did anyone ask what the level of oil & gas exploration is projected to be and does the COGCC staff of 140 really need to be at the same staffing level that was supporting almost twice the production rate that is being forecasted? The Governor and the state legislature have a tough task, I do not envy what they will have to do but do it they must. You think you hear squealing at the county fairs? The RTD has the same issues, aggravated by a continuing reduction in ridership. The new normal of working from home generated by the COVID 19 has changed RTD demand and will continue to do so. Will we continue to follow a theoretically plan for urban transportation demand or will we realize and accept demand is changing, not that I am convinced it was there to begin with. Why don’t our elected officials start asking questions? Tax monies are not unlimited. Someone will eventually ask how come we are paying full salary and benefits for government employees, who for many, are providing a shadow of services that they did before COVID 19. Unpleasant to talk about, you bet. The reality is someone needs to be asking what are the options? The old normal is dying. Where is the reality to face the new world we are dealing with? Small business owners, the core of our economy, the core of our employment opportunities, are facing challenges every day just to survive. When will government employees begin to taste the realities of life? In my view only when we hold our elected officials accountable. Perhaps then, we might see more solutions being developed. Education is not exempt from the issues we are all facing. Going back to school is important for our young people. It represents many challenges to both parents, school districts and the young people themselves. This is all uncharted waters. Colleges have the same issue. Online learning programs are very real and how do you balance an infrastructure that was designed to support in person learning to something way different. Change will have to come. Like in business there will be those who do better than others and they will survive. Those that don’t, won’t.

Times we are in call for leadership. There is no guidebook on what right thing is to do. All we can do is vote for who we think can do the best job and see what happens. LETTER TO THE EDITOR Letter to the Voters for Weld County Commissioner District 3 Race
In science it often happens that scientists say, ‘You know that’s a really good argument; my position is mistaken,’ and then they would actually change their minds and you never hear that old view from them again. They really do it. It doesn’t happen as often as it should, because scientists are human and change is sometimes painful. But it happens every day. I cannot recall the last time something like that happened in politics or religion.” ― Carl Sagan Weld County Government has been coasting. It has been coasting for a very long time. When done correctly governing is of the people, by the people, for the people. We, the citizens of Weld County have abdicated our responsibility because it seemed unimportant and mundane. Roads got fixed, not quickly or well. The Sherriff’s Department grew, but could not retain qualified individuals, because of low pay and morale. Morale is low within the department because jails are being used as storage facilities for humans who have mental problems. Weld County Government has outsourced the management of the county wherever it can. The management of that growth is now in the hands of for profit developers. The fluid that has calmed the normal forces that would have brought change over the decades? Oil. The resource curse, often spoken of in places like Nigeria or Congo, can effect places as small and localized as a county. Mistakes and bad decisions can be ignored or paved over when taxes from the sale of oil and natural gas can be used to cover them. Pet projects like paved roads to county commissioner’s houses can be green lighted and justification for them never explained. A time of reckoning is upon Weld County which has relied on this as an excuse for true fiscal responsibility. In July of 2020 only 5 rigs are currently active in the state of Colorado. In normal times a rig count in excess of 30 is considered normal. Oil and Gas tax revenue has been the proverbial tide that has covered up Weld County’s naked swimming. It will not last. Oil and Gas in the Wattenberg Field isn’t as easy or as cheap as it once was, and unless some dramatic new technology comes along that refreshes and invigorates the Niobrara Formation it is unlikely that the Northern Colorado fields will be as cost competitive as the Texas and California fields are, much less the Saudi, Russian and even Venezuelan fields are. Good news is that we will always beat the cost and difficulty of production of Brent, North Sea Oil. Bad news to be Norway or The United Kingdom! Speaking of Norway, Did you know that they have a sovereign fund that they use to maintain fiscal and political independence? Weld County could have done something similar, but the Republicans chose to lobby for a 51st state. We must stop this silliness and short sighted way of dealing with the problem faced by the county. One way or another the county will have to diversify out of oil and gas and into its primary source of its wealth, the people of Weld County. Barbara Kirkmeyer has been County Commissioner for District 3 from 1993-2001, 20082020. She’s now running for State Senate 23 because she has been term limited twice now at the county level. Her Republican replacement is Lori Saine, whose sole claim to fame is an arrest for trying to board a plane with a loaded 9mm, and being called by Denver’s weekly Westword, “Colorado’s Nastiest, Most Clueless Politician.” Lori is leaving her term limited position at House District #63, to continue employment in governmental bureaucracy having failed at the state level and bringing that failure to a more home level, Weld County District 3. Where her cluelessness, and poor decision making can continue the legacy left by Barbara Kirkmeyer of ignoring the needs of Southern Weld County and it citizens the same way she’s ignore common sense and good taste. She hopes to use District 3 like Kirkmeyer is, as a home base while they plot their never ending climb for ever higher political office. Are we really just a jumping board to them? Can’t we encourage them to seek greener pastures in private industry, something neither one knows anything about? By Linda Meyer Summer is here, and with summer comes garden produce. Two weeks ago, Loaves & Fishes Food Bank received a phone call from someone who wanted to donate extra garden produce. Loaves & Fishes does not normally accept fresh fruit and vegetables. Since that phone call, I found out there is an organization that connects growers with area food banks who will accept garden produce. The organization is Ample Harvest, and their website is ampleharvest.org . I checked their website, and there are several food pantries in Brighton that will accept garden produce. Brighton Mobile Food Pantry is one of them, also St. Augustine Community Food Pantry, and His Hands Food Cupboard. If you want to donate to one of those food banks, please contact them in advance to make sure they will accept your extra produce. With any luck, they may even take all of that extra zucchini you anonymously leave on your neighbors’ porches! (P.S., your neighbors know it’s you.) This year I grew tomatoes and green peppers. Our yard is small, so I have them in large planters. The cherry tomatoes started producing around the 4th of July. They have been delicious! I am looking forward to more regular size tomatoes, as I have had only two so far. There are lots of green ones, and I know they will ripen eventually. My green peppers are small this year, and with the heat I have not been able to leave them out on the plants very long before they start to go bad. I have been giving my extras to Daughter and her family. Oldest granddaughter loves raw green pepper, especially if it has been liberally coated in ranch dressing! At least she likes vegetables. She is five years old, and I don’t remember her mother to like anything except corn when she was 5. We used to live in Longmont, and our house had a Concord grape vine. I grew up watching my mother can all sorts of jams and jellies, as well as fruits and vegetables, so I tried making grape jelly. It worked! I was so proud of my first batch of jelly. Over the twenty years we were in that house, I made a lot of jelly – including three batches the last year we lived there. That jelly lasted almost three years, plus we gave some away. We gave one jar to friends of Daughter. They told her when they opened the jelly and tasted it, they decided their 2-year old would not appreciate how good it was. They opened a store jar of grape jelly for him, and kept my home-made jelly for themselves. That really made my day, and we still laugh about it. When we moved three years ago, I planted two grape vines at the new house. Two years ago, I had to replace one of the original vines, as it did not make it through the winter. Since then, I have watered both vines all winter to help the roots stay moist. This year, I finally have grapes! I do not think I have enough for jelly, but hopefully I can buy enough grapes to make a batch of jelly this year. My parents had a big garden, plus strawberry plants, asparagus, and fruit trees. About one-third of the garden would be potatoes, and we always dug and picked up those potatoes on the hottest day in August. Didn’t matter what year it was, it was always the hottest day in August. I admit I am a tomato snob. After growing up with home-grown tomatoes, I almost never buy them in the store, and often remove them from restaurant sandwiches. I love tomatoes, but not pink styrofoam pretending to be a tomato slice. My parents planted sweet corn in a field next to the buildings. No matter how much electric fence Dad put around the sweet corn, the raccoons always got their share. That’s it for this month. Now that I have you hungry for fresh sweet corn, tomatoes, and grape jelly, you are going to have to go buy some. Lucky for us, grocery stores and farm stands have fresh sweet corn right now, and hopefully tomatoes, too. West Nile Virus Detected in Town of Berthoud Mosquito Trap
Weld County – One group of mosquitoes collected from traps set during the week of July 27, 2020 on the Weld County side of the Town of Berthoud has tested positive for West Nile Virus (WNV). This group came from traps set as part of the Town of Berthoud’s WNV surveillance program. This is the first positive test of any mosquitoes trapped within Weld County this year. Weld County contracts with an outside vendor to conduct mosquito trapping and testing in three zones within Weld County, which includes the Greeley/Evans area, the Johnstown/Milliken/Platteville area, and the Fort Lupton/Dacono/Firestone area. These traps have not had any WNV positive mosquitoes this year. The results of fifteen mosquito groups trapped the week of August 3, 2020, however, are pending. Although the risk of WNV is currently low, the hotter days in August create perfect conditions for the Culex mosquito and WNV. Currently there are no human cases of WNV in Weld County or in Colorado. Last year, there were a total of 9 human cases of WNV in Weld County. West Nile virus symptoms can appear 3 to 14 days after an infection. Initial symptoms can include fever, headache, nausea and vomiting, muscle aches and weakness and rash, but most infected people don’t exhibit any symptoms. If a person develops symptoms, he or she should see a doctor immediately. There are no medications to treat or vaccines to prevent West Nile virus infection, and less than one percent of infected people develop a serious, sometimes fatal, neurological illness. Health officials recommend following the four “D’s” to prevent mosquito bites: DRAIN standing water around your house weekly. Remember to drain water from tires, cans, flowerpots, clogged rain gutters, rain barrels, toys and puddles. DUSK and DAWN are when mosquitoes are most active. Limit outdoor activities and take precautions to prevent mosquito bites during these times. DEET is an effective ingredient to look for in insect repellents. Always follow label instructions carefully. DRESS in long sleeves and pants in areas where mosquitoes are active. Morgan County Archery Shoot Held on Sunday
In a very competitive archery shoot, 43 youth competed to capture their place on the Morgan County Archery Team who will compete at State Fair in August. It was held at the Morgan County Fairgrounds on Sunday, July 19, 2020. Youth have participated in practices held by certified 4-H archery instructors for the past three months in preparation for the county fair shoot. In the junior recurve traditional, Soul Keller placed 1st; Elizabeth Whitney, 2nd; Saxson Keller, 3rd; Rylan Schreiner, 4th; and Wyatt Gorrell, 5th. Grayson Johnson was first in the junior archery compound limited class. Quincy Palmer placed 2nd; Cameron Schmidt, 3rd; Riley Thomas, 4th; Ceri Dixon, 5th; and Carston Johnson 6th. Other youth participating were Wyatt Chacon, Chloie Cuckow, Travis Hall, Axel Lorenzini, Tenleigh Lorenzini, Aiden Midcap, Whitnee Palmer, Kirstin Powell, Malachi Thiel, and Anna Werner. Chloe Palmer won the senior division, followed by Allison Thomas, 2nd; Kathryn Schoemaker, 3rd; Mikaela Thiel, 4th; Issac Doll, 5th; and Americo Lorenzini, 6th. Also competing as a senior was Cole Curtis, Rhett Curtis, Cohen Dixon, Jordyn Garcia, and Madison Thomas. The junior archery compound traditional competition was led by Max Curtis, followed by Chase Pollart, 2nd; Katelynn Johnson, 3rd; Dillon Curtis, 4th; Rylee Stevens, 5th; and Cole Curtis, 6th. Also competing as a junior was Cole Goff, Isabella Norton, Adaline Orona, and Cason Tow. The final archery class shot during the 2020 Morgan County Fair Archery Contest was Compound Bow Traditional. Coming in first in the senior age group was Aulden Covelli. Superintendents for the archery shoot were Jesse Koch, Paul Oliveira, and Levi Dixon. Cheryl Flair and Jon Flair, Chad and Katie Lorenzini, Laurie Oliveira and Stefani Oliveira assisted with the shoot. Shooting sports awards will be announced on Facebook on Tuesday, July 21 at 6 pm. Equipment and supplies for the 4-H shooting sports program have been provided through a NRA grant given in 2020. .22 Results from Morgan County Fair Shoots
Twenty-one Morgan County 4-H shooters gathered for their County Fair .22 rifle shoot on July 18, at Muir Springs. Individual champions and place finishers were determined in all .22 rifle shooting disciplines. The shoot also determined who the county representatives would be at the Colorado 4-H State Shooting Championships in August. The state event is held locally this year in conjunction with the Colorado State Fair. Shooters were grouped as juniors (ages 8-13) and seniors (ages 14-18). A total of four different shooting disciplines were available at both the junior and senior levels. The top six shooters in each discipline will comprise the Morgan County team in that discipline at the state shoot. Should a shooter elect to not participate in the state event, the next highest scoring shooter will be asked to join the team in that discipline. Top finishers in junior 3 Position were; 1) Talan Hall, 2) Riley Thomas, and 3) Chad Schilling. Senior 3 Position finishers were; 1) Danielle Moon, 2) Ethan Bohl, and 3) Madison Thomas. Junior 4 Position Sporter winners were; 1) Talan Hall, 2) Riley Thomas, 3) Chad Schilling, 4) Ben Werner, and 5) Eli Williams. Shotgun Shoot, First Pre-Morgan County Fair Event
Jeffrey Lancaster and Odin Nilsen captured the first place awards in the senior and junior divisions at the 2020 Morgan County Fair Shotgun Shoot. Twenty-one youth competed in the contest on July 12, 2020. Placings in the senior division were Jeffrey Lancaster, 1st with a score of 44 out of a possible 50. Americo Lorenzini placed 2nd; Dylan Martin, 3rd; Lilianna Ramos, 4th; and Cohen Dixon, 5th. The alternate for the Colorado 4-H State Shooting Contest is Owen Norton. Other senior shooters were Madison Thomas and Madeline WilsonTurner. Top award in the junior division went to Odin Nilsen who shot 45 out of a possible 50. Second place went to Grayson Johnson, Talan Hall 3rd; Chloie Cuckow, 4th; and Carston Johnson, 5th. The alternate for Colorado 4-H State Shooting Contest is Chad Schilling. Other junior shooters were Pytch Allart, Ceri Dixon, Aysli Kembel, Baylei Kembel, Axel Lorenzini, Tenleigh Lorenzini, and Cameron Schmidt. Superintendent for the shotgun shoot was Paul Oliveria. Oliveria was assisted by Levi Dixon, Dave Martin, and Jay Marshall. The trap shoot was held at the High Plains Trap Club. The next shooting contest will be Saturday, July 20 at 8 am at Muir Spring where youth will compete in .22 rifle, .22 pistol, and muzzleloading. Equipment and supplies for the 4-H shooting sports program have been provided through a NRA grant given in 2020. In lieu of our traditional Shooting Sports Awards Potluck, the top shooters and Mary Seeley Award winners will be announced via Facebook at 7 p.m. on July 21st. Morgan County Fair Muzzleloader Shoot Held
Montana Goodman and Talan Hall captured the first place awards in the senior and junior divisions at the 2020 Morgan County Fair Muzzleloader Shoot. Nine youth competed in the contest that was held on Saturday July 18. The contest requires 4-H members to shoot a total of 15 shots, five at targets shaped like bottles, five at bullseye targets, and five at a metal gong. Placings in the senior division were 1) Montana Goodman, 2) Ethan Bohl, 3) Danielle Moon, 4) Wiley Eicher, and 5) Lilianna Ramos. Placings in the junior division were 1) Talan Hall, 2) Ben Werner, 3) Chad Schilling, and 4) Rylan Schreiner. Superintendent for the muzzleloader shoot was D.J. Eicher. Eicher was assisted by John Goodman. These coaches are volunteers through Morgan County 4-H, are trained by individuals with Colorado 4-H using a nationally approved curriculum. The season runs from around April- August, and the coaches spend an average of four hours a month teaching the youth in this discipline. The muzzleloader shoot was held at the Muir Springs. Also held on Saturday, July 18 at the Muir Springs was the .22 Rifle contest. Equipment and supplies for the 4-H shooting sports program have been provided through a NRA grant given in 2020. All members who participated in the Muzzleloader qualified for the Colorado State 4-H Muzzleloader shoot which is held in conjunction with the Colorado State Fair on August 22. Shooting sports awards will be on Facebook on Tuesday, July 21 at 6 p.m. ### Colorado State University Extension is your local university community connection for research-based information about natural resource management; living well through raising kids, eating right and spending smart; gardening and commercial horticulture; the latest agricultural production technologies and community development. Fourteen Morgan County 4-H shooters gathered for their County Fair air rifle and air pistol shoot on July 19, at the Morgan County Fairgrounds Multi-purpose Building. Individual champions and place finishers were determined in all air rifle and air pistol shooting disciplines. The shoot also determined who the county representatives would be at the Colorado State Shooting Championships in August. The state event will be held locally this year in conjunction with the Colorado State Fair. Shooters were grouped as juniors (ages 8-13) and seniors (ages 14-18). A total of four different air rifle shooting disciplines were available at both the junior and senior levels. A single contest was held in air pistol shooting. The top six shooters in each discipline will comprise the Morgan County team in that discipline at the state shoot. Should a shooter elect to not participate in the state event, the next highest scoring shooter will be asked to join the team in that discipline. Top finishers in junior 3 Position International were; 1) Talan Hall, 2) Riley Thomas, 3) Cameron Schmidt, 4) Chad Schilling, and 5) Shylynn Larrick. Senior 3 Position International finishers were; 1) Montana Goodman, 2) Danielle Moon, 3) Madison Thomas, 4) Tyler Messinger, and 5) Johnathan Eggleston. Junior 4 Position Sporter winners were; 1) Talan Hall, 2) Riley Thomas, 3) Cameron Schmidt, 4) Chad Schilling, and 5) Shylynn Larrick. Senior 4 Position Sporter finishers were; 1) Montana Goodman, 2) Danielle Moon, 3) Madison Thomas, 4) Johnathan Eggleston, and 5) Tyler Messinger. Olympic Offhand junior champions were; 1) Talan Hall, 2) Riley Thomas, 3) Cameron Schmidt, and 4) Chad Schilling. Olympic Offhand senior champions were; 1) Danielle Moon, 2) Montana Goodman, 3) Johnathan Eggleston, and 4) Madison Thomas. Air Rifle Utility Class junior winners were; 1) Talan Hall, 2) Riley Thomas, 3) Cameron Schmidt, 4) Chad Schilling, 5) Shylynn Larrick, and 6) Trayne Mese. Luca Petrino also shot at the junior level. Senior Air Rifle Utility champions were; 1) Danielle Moon, 2) Montana Goodman, 3) Madison Thomas, 4) Tyler Messinger, and 5) Jonathan Eggleston. An air pistol shoot was also held in conjunction with the air rifle contest, junior winners were; 1) Talan Hall, 2) Chad Schilling, and 3) Rylan Schreiner. Senior air pistol champions were 1) Tyler Messinger, and 2) Jonathan Eggleston. 4-H Air Rifle coaches are: Karl Dahle, DJ Eicher, John Goodman, and Scott Schmidt. Owen Eggleston and John Goodman coach the air pistol shooters, and Karl Dahle is the overall superintendent. Equipment and supplies for the 4-H shooting sports program have been provided through a NRA grant given in 2020.
