Bonta leads 20 States in opposing Indiana anti-transgender law

OAKLAND – California Attorney General Rob Bonta today led a multistate coalition of 20 attorneys general in opposing a state law in Indiana that severely blocks the ability of transgender youth to access critical, lifesaving gender-affirming care.

Today, the coalition, led by Attorney General Bonta, filed an amicus brief in support of the plaintiffs, stressing the importance of gender-affirming care for the health and well-being of transgender youth.

“Every person deserves equal and comprehensive access to medical care to lead a healthier and happier life,” said Bonta. “As we continue to witness the growing number of attacks against our LGBTQ+ community in California and across the nation, today’s legal action is a testament to our ongoing commitment to ensuring the rights of transgender youth are safeguarded and fully available. At the California Department of Justice, we will continue to stand up against any ac-

tion that targets and compromises the physical, mental, and emotional well-being of our most vulnerable communities.”

Many transgender teens suffer from gender dysphoria, which results from the incongruence between their gender identity and sex assigned at birth. Gender dysphoria has been found to cause severe distress and anxiety, depression, fatigue, decreased social functioning, substance misuse, and a poorer quality of life. Among transgender people, suicide attempts are nine times more common than in the overall U.S. population. Those risks are even higher among transgender youth.

Enacted in April 2023, Indiana’s S.E.A. 480 is aimed at blocking transgender minors’ access to medical treatment such as hormone therapy and puberty blockers that help treat gender dysphoria.

In their amicus brief today, the coalition supported the plaintiffs’ lawsuit seeking to block the enforcement of S.E.A. 480, arguing that the law: Significantly harms the health and lives of transgender people by denying them medically necessary care that protects their physical, emotional, and psychological health.

Is discriminatory and violates the Equal Protection Clause of the U.S. Constitution by banning medical treatment for transgender youth while permitting the same treatment for cisgender youth.

The Attorney General continues to stress an ongoing commitment to protecting the rights of transgender individuals.

Last month, he announced a lawsuit to immediately halt the enforcement of the Chino Valley Unified School District Board of Education’s mandatory gender identity disclosure policy, which threatens to cause transgender students with mental, emotional, psychological, and potential physical harm.

In August, Bonta led a multistate coalition in filing an amicus brief opposing state laws in Kentucky and Tennessee restricting transgender youths’ access to critical and lifesaving healthcare. In June, the Attorney General issued the «State of Pride Report” highlighting the California Department of Justice’s recent efforts to support, elevate, and defend the rights of LGBTQ+ communities throughout California and beyond.

In May, he led a multistate coalition in supporting a challenge to a Florida rule restricting access to gender-affirming care and joined another multistate coalition defending a Colorado law that prohibits gay and transgender conversion therapy on children and youth. In June, he joined a coalition in support of the Ludlow School Committee’s efforts to create a safe and supportive environment for transgender children and all students.

In filing today’s amicus brief, Attorney General Bonta was joined by the attorneys general of Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont, Washington, and the District of Columbia.

LGBTQ+ ally Tony Thurmond announces his bid for governor

SACRAMENTO, Calif. - California State Superintendent of Public Instruction and long-time LGBTQ+ community ally Tony Thurmond, announced Tuesday that he is running to be the next Governor of California.

He is running to replace incumbent Democratic Governor Gavin Newsom, who is term limited by state law to two four-year terms. Newsom assumed office on January 7, 2019 and his current term ends on January 4, 2027.

If elected, Thurmond would make history as California’s first Black Governor and the first Latino Governor since 1875.

Thurmond made the following announcement on X, formerly Twitter, Tuesday morning: “I didn’t come from money, power, or influence. I’m running for Governor to be a voice for those who need one — because California may be working for millionaires and billionaires but for the rest of California — we need real change.”

“California should be a place where everyone has a chance to succeed, no matter who you are or where you’re from, and together, we can make that a reality,” he said in his announcement video.

In addition to his commitment to improving opportunities for all Californians, stabilizing the housing market, and contributing to ending homelessness, Thurmond has shown his continued support for children in LGBTQ+ community.

With several school districts across California passing mandatory outing policies and rules targeting the safety of LGBTQ+ students, Thurmond told The Blade in an interview last week that he has and will continue to fight for the

rights of LGBTQ+ children.

“My position on these actions is that they are misinformed and misguided. They are a blatant attack on LGBTQ+ kids. These are bigoted efforts to harm a group of students...This is purely a bigoted action by extremists, whose real effort is to bring harm upon LGBTQ plus students, and I will not stand for that,” he said.

Thurmond told the Blade about his involvement in creating policies that allowed for safe and gender-inclusive bathrooms in the Chino Hills school district. He also mentioned two bills that he supports: SB 760, sponsored by Senator Josh Newman (D-Fullerton). The bill would require the all-gender restroom to meet certain requirements, including, among other things, that it has signage identifying the bathroom facility as being open to all genders and is unlocked, unobstructed, and easily accessible by any pupil.

by Assemblymember Dr. Corey Jackson (D-Moreno Valley), which bans “book bans” in schools, prohibits censorship of instructional materials, and strengthens California law requiring schools to provide all students access to textbooks that teach about California’s diverse communities.

With this new law, we’re cementing California’s role as the true freedom state: a place where families — not political fanatics — have the freedom to decide what’s right for them,” Governor Gavin Newsom said as he signed the bill last Friday.

“We have an opportunity now to say that every person can be treated with love and respect and dignity, regardless of who they are and how they see themselves and who they love,” said Thurmond.

“Many times, young people are not in a space where they can talk about how they identify in terms of their gender identities. It is our responsibility to get them resources and to help them, not to attack them. I sponsored legislation to provide more resources and training, and teachings to be able to support students and our LGBTQ+ students. The data shows that when we do this work, we support our LGBTQ+ people, they do better at school. They have better self-esteem and better grades. They are less likely to feel suicidal.”

Thurmond has been elected statewide in the nation’s most populous state twice, in 2018 and most recently in 2022, when he earned 63.7% and 5,681,318 votes.

Prior to serving as California’s Superintendent of Public Instruction, Thurmond served in the State Assembly and before then on the Richmond City Council and the West Contra Costa School Board. Beyond his service in public office, Thurmond is a public school parent, a former social worker, and a public educator.

“I am grateful that my last 15 years of elective service have all centered around some form of education, formally or informally,” said Thurmond. “I do think education is a great equalizer. It has been for me. I want this to be available to all six million students who are interested to our school system in California.”

A look back at Feinstein’s career A native San Franciscan born in the city on June 22, 1933, she first attended San Francisco public schools and then graduated from the Convent of the Sacred Heart High School in 1951.

She earned her degree at Stanford University in Palo Alto in 1955 and became actively involved in government service first serving as a member of the California Women’s

LOCAL Board of Terms and Parole 1960-1966.

In her first foray into city politics she won a seat on the San Francisco Board of Supervisors representing the Marina neighborhood, serving from 1970-1978, and as president 1970-1971, 1974-1975, 1978.

In 1978 Feinstein was thrust into the state and national political spotlight when on November 27, 1978 she became the mayor of San Francisco, after disgruntled former city supervisor Dan White entered City Hall and assassinated Mayor George Moscone after Moscone refused to appoint White back into his seat he had resigned from days before.

White then also murdered openly gay city supervisor Harvey Milk who had sparred with White over gay rights and had opposed White getting his seat back.

Feinstein served as mayor for ten years from 1978-1988 then she served on the board as a director of the Bank of California 1988-1989 at which point she made an unsuccessful run as a candidate for Governor of California in 1990.

After losing that race for governor in 1990, Feinstein later won a special election on November 3, 1992, as a Democrat to the U.S. Senate. The special election was triggered by the resignation of Pete Wilson, who had defeated her in the 1990 gubernatorial election. She took office on November 4, 1992, and was subsequently reelected in 1994, 2000, 2006, 2012, and again in 2018 for the term ending January 3, 2025.

Bay Area Reporter’s Assistant Editor John Ferrannini who noted: Earlier in that campaign [1979] she’d faced some opposition from members of the LGBTQ community after she made remarks to Ladies’ Home Journal perceived as homophobic, but later won community support after gay candidate David Scott endorsed her in a runoff against independent Quentin Kopp. Scott endorsed Feinstein after she committed to appoint a gay person to the police oversight panel, which Feinstein followed through on with her appointment of lesbian Jo Daly.

Feinstein’s veto of city employee benefits for domestic partners led to a recall effort in 1983, though she won 81% to 18%.

In the Senate she was one of the few Democratic members who voted against the Defense of Marriage Act in 1996, which had been supported by then-senator and current President Joe Biden (D). The last vestiges of DOMA were formally repealed in December when Biden signed the Respect for Marriage Act. DOMA had key provisions struck down by the U.S. Supreme Court in 2013 (Section 3, U.S. v. Windsor) and 2015 (Section 2, Obergefell v. Hodges).

Feinstein was never without controversy though, and in 2004 upset more progressive Democrats when she said then-mayor and now Governor Gavin Newsom’s decision to order San Francisco officials to issue marriage licenses to same-sex couples was “too much, too fast, too soon.”

She was criticized in 2020 when she said U.S. Supreme Court Justice Amy Coney Barrett’s confirmation hearing was “one of the best” and hugged Senator Lindsay Graham (R-South Carolina), then the chair of the Senate Judiciary Committee. Barrett’s vote last June on the Supreme Court was key for the overturning of Roe v. Wade, which had protected abortion as a constitutional right, a key issue for Feinstein.

In 2017 the Senator openly criticized then President Trump’s ban on trans military service.

Feinstein in February announced her decision to retire at the end of her term. “I am announcing today I will not run for reelection in 2024 but intend to accomplish as much for California as I can through the end of next year when my term ends,” she said in a statement.

Out gay California state Senator Scott Wiener (D-San Francisco) wrote on Twitter: “Dianne Feinstein has been a trailblazer for more than 50 years,” he stated. “Her accomplishments are legion. We’re so proud of her in San Francisco & grateful for her service to our city & our state.”

Equality California released a statement from Hoang: “Throughout her storied political career, Dianne Feinstein has been a champion for LGBTQ+ rights – from her early days on the San Francisco Board of Supervisors serving alongside Harvey Milk, to her historic service as the first woman Mayor of San Francisco and the first woman to represent California in the United States Senate.

“From being one of only 14 Senators to oppose the discriminatory Defense of Marriage Act (DOMA) in 1996 to being the lead Senate sponsor on the recently-signed Respect for Marriage Act, which repealed DOMA, Senator Feinstein has worked tirelessly to improve the lives of not only her constituents, but all LGBTQ+ Americans.

“She has supported landmark federal hate crime legislation, fought for access to life-saving treatment for people living with HIV, sponsored the Equality Act, spoken out in support of LGBTQ+ service members before and after ‘Don’t Ask, Don’t Tell’, and has stood up for our community – even before it was popular to do so and when it presented significant political risks. Newsom appoints Laphonza Butler to Feinstein seat

By BRODY LEVESQUE SACRAMENTO, Calif. - On Sunday evening, California Governor Gavin Newsom announced he is appointing Black openly lesbian EMILY’s List President, Laphonza Butler, to the vacant seat of the late U.S. Senator Diane Feinstein who died Friday at age 90.

Butler’s wife is Neneki Lee, the Washington D.C.based Director for labor union SEIU’s Public Services Division.

News of Butler’s selection by Newsom was first reported by POLITICO’s California Bureau Chief Christopher Cadelago. A source knowledgeable on the governor’s team told POLITICO there were no preconditions about whether she could run in 2024.

Newsom’s office confirmed that he has picked Butler, a Democratic strategist who rose to prominence in the labor movement, to fill Feinstein’s seat.

In an emailed statement, Governor Newsom said: “An advocate for women and girls, a second-generation fighter for working people, and a trusted adviser to Vice President Harris, Laphonza Butler represents the best of California, and she’ll represent us proudly in the United States Senate. As we mourn the enormous loss of Senator Feinstein, the very freedoms she fought for — reproductive freedom, equal protection, and safety from gun violence — have never been under greater assault. Laphonza will carry the baton left by Senator Feinstein, continue to break glass ceilings, and fight for all Californians in Washington D.C.” Equality California tweeted a statement praising New-

Butler is a longtime leader in Democratic politics in California and beyond. She has been involved in campaign strategy, and the labor movement for two decades, and according to her official biography she has dedicated her life to empowering women and supporting them in finding their voice, and using it to make meaningful change.

Newsom’s office noted in its statement: “Butler, a longtime senior adviser to Vice President Kamala Harris, labor leader, and advocate for women and working people, will be the first openly LGBTQ person to represent California in the Senate. She will also be the first Black lesbian to openly serve in Congress in American history and the second Black woman to

represent California in the Senate following Vice President Kamala Harris.”

Prior to joining EMILYs List, Butler served as Director of Public Policy and Campaigns in North America for Airbnb. With nearly 20 years in the labor movement, Butler has served as the president of the biggest union in California, and the nation’s largest homecare workers union, SEIU Local 2015. She was elected to this position at just 30 years old, one of the youngest to take on this role. As president, Butler was the leading voice, strategist, and architect of efforts to address pay inequity for women in California and a top advocate for raising the state’s minimum wage to $15 an hour – the first state in the nation to do so, benefiting millions of working women in low wage jobs. That effort also gave hundreds of thousands of home workers access to paid time off. She also served as an SEIU International Vice President and President of the SEIU California State Council.

Throughout her career, Butler has been highly regarded as a strategist working to elect Democratic women candidates in political offices across California and nationally. A long-time supporter of Kamala Harris in her California runs, Butler was a key leader in Vice President Harris’s presidential campaign. She served as a senior advisor to Hillary Clinton’s presidential campaign in California during the primary and general elections. Most recently, Butler was a campaign operative behind the campaign to make the Los Angeles Board of Supervisors all-women for the first time in its history with the election of Supervisor Holly Mitchell.

She has been a member of the University of California Board of Regents and a member of the board of directors for the Children’s Defense Fund and BLACK PAC. Laphonza grew up in Magnolia, MS, and attended one of the country’s premier HBCUs, Jackson State University. She lives in Maryland with her wife, Neneki, and together they have a daughter, Nylah.

EMILY’s List is an American political action committee that aims to help elect Democratic female candidates in favor of abortion rights to office. It was founded by Ellen Malcolm in 1985. The group’s name is an acronym for “Early Money Is Like Yeast”. Malcolm commented that “it makes the dough rise”.

Lesbian mother from El Salvador released from ICE custody in La. LAFAYETTE, La. — A federal judge last week ordered the release of a lesbian mother from El Salvador who had been in U.S. Immigration and Customs Enforcement custody since June 2017.

Jessica Patricia Barahona-Martinez and her three children entered the U.S. on May 31, 2016. A court filing notes she fled “persecution she faced in El Salvador as a lesbian, and because the government had falsely identified her as a gang member.”

Barahona-Martinez lived with her sister and other relatives in Woodbridge, Va., until ICE arrested and detained her on June 26, 2017. She was housed at two ICE detention centers in Virginia until her transfer to the South Louisi-

ana ICE Processing Center, a privately-run facility the GEO Group, a Florida-based company, operates in Basile, La., in October 2020.

An immigration judge in November 2019 granted Barahona-Martinez asylum for the second time. The government appealed the decision and the Board of Immigration Appeals, which the Justice Department oversees, ruled in their favor.

The American Civil Liberties Union and the ACLU of Louisiana last month filed a writ for habeas corpus petition in the U.S. District Court for the Western District of Louisiana’s Lafayette Division that asked for Barahona-Martinez’s release. U.S. District Judge Terry A. Doughty on Sept.

27 ruled in her favor.

“Petitioner (Barahona-Martinez) ultimately argues that her prolonged detention violates due process; she moves that this court issues a temporary restraining order, requests release, a bond hearing, an expedited hearing and costs and attorney fees,” wrote Doughty.

“This court finds that petitioner has plausibly alleged her prolonged detention violates due process,” added Doughty.

An ACLU spokesperson on Monday told the Blade that ICE has released Barahona-Martinez and she is once again in Virginia with her children and sister.

Virginia students walk out protesting trans outing policy VIRGINIA BEACH, Va. - Students at five Virginia Beach high schools on Friday staged walkouts in support of transgender rights.

The walkout is in response to the Virginia Beach School Board potentially approving policy 5-31, which the Pride Liberation Project says will require schools to out trans students to their parents.

Students have been organizing walkouts across the state since Republican Gov. Glenn Youngkin earlier this year announced new guidelines for trans and nonbinary students.

According to NBC affiliate WAVY 3, the Virginia Beach School Board has delayed a vote on proposed updates on its current non-discrimination policy that in some ways is consistent with Gov. Glenn Youngkin’s model policy, and in other ways, is taken verbatim.

A vote is now expected at the board’s Oct. 10 meeting, WAVY reported.

Dozens of LGBTQ+ students came out to the school board’s meeting and spoke out during public comment.

The group was dressed in black to symbolize the deaths of their identities if VBCPS aligns the current non-discrimination policies with Youngkin’s model policy.

State Department hosts five intersex activists from around the world

WASHINGTON — The State Department last week hosted five intersex activists from around the world.

Kimberly Zieselman, a prominent intersex activist who advises Jessica Stern, the special U.S. envoy for the promotion of LGBTQ+ and intersex rights abroad, brought the activists to D.C. • Morgan Carpenter, co-founder and executive director of Intersex Human Rights Australia • Natasha Jiménez, an intersex activist from Costa Rica who is the general coordinator of Mulabi, the Latin American Space for Sexualities and Rights • Julius Kaggwa, founder of the Support Initiative for People with Atypical Sex Development Uganda • Magda Rakita, co-founder and executive director of Fujdacja Interakcja in Poland and co-founder of Interconnected UK • Esan Regmi, co-founder and executive director of the Campaign for Change in Nepal.

Special U.S. Envoy for Global Youth Issues Abby Finkenauer and Assistant Health Secretary Rachel Levine are among the officials with whom the activists met.

Zieselman told the Washington Blade on Sept. 21 the activists offered State Department officials an “intersex 101” overview during a virtual briefing.

More than 60 Save the Children staffers from around the world participated in another virtual briefing. Zieselman noted the activists also met with Stern, U.N. and Organization of American States officials, funders and NGO representatives while in D.C. “The people we met were genuinely interested,” Rakita told the Blade.

Stern in an exclusive statement to the Blade said “the visiting intersex activists clearly had an impact here at State, sharing their expertise and lived experience high-

lighting the urgency to end human rights abuses, including those involving harmful medical practices against intersex persons globally.” Andrew Gleason, senior director for gender equality and social justice at Save the Children US, in a LinkedIn post he wrote after attending his organization’s meeting with the activists echoed Stern.

“There are many learnings to recount from today’s discussion, but one thing is clear, this is unequivocally a child rights issue, and one that demands attention and action at the intersection of LGBTQI+ rights, reproductive rights and justice, disability justice and more,” wrote Gleason.

“Gratitude to the panelists for sharing such poignant testimonies and providing insights into what organizations like ours can do to contribute to the broader intersex movement; and thank you to Kimberly for your leadership and bringing this group together.”

The activists’ trip to D.C. coincided with efforts to end so-called sex “normalization” surgeries on intersex children.

Greek lawmakers in July passed a law that bans such procedures on children under 15 unless they offer their consent or a court allows them to happen. Doctors who violate the statute face fines and prison.

Germany Iceland, Malta, Portugal and Spain have also enacted laws that seek to protect intersex youth.

A law that grants equal rights and legal recognition to intersex people in Kenya took effect in July 2022. Lawmakers in the Australian Capital Territory earlier this year passed the Variation in Sex Characteristics (Restricted Medical Treatment) Bill 2023.

vide transparency on medical practices and decision making.” It further points out the statute “will criminalize some deferrable procedures that permanently alter the sex characteristics of children” and provides “funding for necessary psychosocial supports for families and children.”

“It’s amazing,” Carpenter told the Blade when discussing the law and resistance to it. “It’s not perfect. There was some big gaps, but physicians are resisting every step of the way.”

The State Department in April 2022 began to issue passports with an “X” gender marker.

Dana Zzyym, an intersex U.S. Navy veteran who identifies as non-binary, in 2015 filed a federal lawsuit against the State Department after it denied their application for a passport with an “X” gender marker. Zzyym in October 2021 received the first gender-neutral American passport.

With respect to the Defense Department spending bill, for example, GOP members have advanced proposals that would defund healthcare services for transgender service members and ban Pride flags from military bases.

On X, U.S. Rep. Mark Pocan (D-Wis.), chair of the Congressional Equality Caucus, wrote that “Republicans claim to support the military but Rep. Boebert, just spent 5 minutes misgendering & attacking our Assistant Secretary of Defense for Readiness—just because she’s trans. Ms. Skelly serves our country w/ honor. I can’t say the same for Boebert.”

The Caucus added, “It’s disgusting that a Member of Congress would use their platform on the House Floor to misgender & attack a top-ranking @DeptofDefense official and veteran just because she’s a trans woman.”

Saskatchewan Premier vows to bypass Canadian Charter of Rights

REGINA, Saskatchewan, Canada - Saskatchewan Premier Scott Moe has announced he plans to override Canada’s Charter of Rights to pass a law requiring students to get parental consent before using a name or pronoun other than the ones indicated by their birth certificate in schools, after a judge in Regina issued an injunction blocking the rule from coming into effect.

The policy was announced this summer, as a wave of Canadian provinces governed by Conservatives enacted similar rules across the country. The rules were immediately denounced by LGBT activists, teachers’ associations, and school boards, who said the rules violated trans kids’ privacy rights and right to gender expression, as well as being impractical to enforce.

In his decision Thursday, Judge Michael Megaw sided with University of Regina Pride, which filed a lawsuit seeking to have the rule struck down. Megaw’s decision doesn’t kill the rule, but blocks schools and the province from enforcing it while the constitutional challenge goes forward.

“The protection of these youth surpasses that interest expressed by the government, pending a full and complete hearing into the constitutionality of this policy,” Megaw wrote in his decision. “I find this to be one of those clear cases where injunctive relief is necessary to attempt to prevent the irreparable harm referred to pending a full hearing of this matter on its merits.”

The province had previously told the court that it drafted the policy in nine days and did not consult with stakeholders before enacting it. It also told the court that the government had received just 18 letters over the summer asking the government to enact the “parental consent” policy.

In response, Moe announced he would recall the provincial legislature on Oct 10 to pass a law backing up the rule by using the Canadian Constitution’s “notwithstanding clause,” which allows the federal and provincial governments to pass laws that violate the constitution’s Charter of Rights and Freedoms. A law invoking the clause can only be in effect for five years but can be renewed and cannot be challenged under the Charter of Rights in that time.

The notwithstanding clause was included when the Canadian Charter of Rights was enacted in 1982 specifically because certain provinces were afraid that gays and lesbians would use the Charter to demand equal rights. The Liberal government at the time believed that use of the clause would be so unpopular that no government would dare try it. For most of its history, that’s been true, but there has been a growing trend of Conservative provincial governments across Canada invoking the clause to override Charter rights since 2018.

Moe’s threat to invoke the clause was immediately denounced by federal Justice Minister Arif Verani.

Pakistan resumes issuing ID cards to transgender people

ISLAMABAD — Pakistani authorities have resumed the registration of Transgender people and issuing identity cards to them after the Supreme Court’s Sharia Appellate Bench on Sept. 25 ruled on the issue.

An Islamic court on June 13 ordered all data acquisition units to halt the registration of Trans people and to issue identity cards only to males or females.

The Supreme Court in 2009 extended civil rights to the trans community. Pakistani MPs in 2018 passed a historic law, the Transgender Persons (Protection of Rights) Act, that guaranteed all the rights available for all citizens to Trans people, and prohibited any discrimination based on gender identity.

Jamiat-e-Islami, Jamiat Ulema-e-Islam and Tehreek Labbaik Pakistan and several other Pakistani religious political parties in 2022 raised objections to the law, stating it was un-Islamic.

The Federal Shariat Court in May struck down three sections of the Transgender Persons (Protection of Rights) Act and said Islamic teachings do not allow anyone to change their gender at their will. The court also said gender assigned at birth shall remain intact.

The Islamic court’s June 13 verdict prohibited any new registration for an identity card with an X gender marker or update an older one. The National Database and Registration Authority after the ruling issued that halted the registration of Trans people. Individuals in Pakistan need ID cards to open bank accounts, seek legal aid, report a crime to the police, ask for medical help and receive a passport.

NADRA is an independent agency that regulates the government database and registration of sensitive information of citizens. The Federal Shariat Court is a constitutional Islamic court

that scrutinizes and determines if laws made in Parliament comply with Sharia laws.

Nayyab Ali, a Trans rights activist in Pakistan, during a telephone interview with the Washington Blade said the court’s voting bloc is based on religious elements. She also said rightwing political parties target Trans Pakistanis when they do not get publicity.

“Right-wing political parties picked up the Transgender issues in Parliament, and started hate speeches on transgender laws,” said Ali. “There is also a divide in the Transgender community in Pakistan. Some Transgender factions also support right-wing political parties to strengthen their agenda. People inside the government came from the grassroots level of society. Society has an extreme level of phobia and stigma for the Transgender population, so when they come to power, they make policies that are against the Transgender community.”

Ali told the Blade that former Prime Minister Imran Khan introduced an “Islamic utopia” in Pakistan and implemented an Islamization policy in his day-to-day politics, which created more hatred against Trans community and affected society at large.

Ali on X, formerly known as Twitter, praised the decision that allowed the resumption of issuing ID cards to Trans people.

Documents the Blade obtained indicate she is one of those who challenged the Federal Shariat Court’s decision.

Kami Sid, a Trans activist and executive director of Sub Rang Society, a Pakistan-based LGBTQ+ rights organization, said the community is happy and quite hopeful for a better future.

“First we as a community were very much worried about the Federal Shariat Court’s decision,” said Sid. “But after several ad-

vocacy and meetings we are quite hopeful for the fight against the Federal Shariat Court decision, and now quite relaxed as a Transgender activist, I must say the community is happy.”

Kami, like Ali, also challenged the Federal Shariat Court’s decision.

Kami told the Blade conservative parties over the last few years have become more willing to promote an agenda that opposes rights for women, children and Trans people.

“Transgender rights are human rights,” said Kami. “That is why the previous government refrained from commenting on the Shariah Court ruling out of fear of the right-wing parties and because Transgender people are not a top priority.”

Kami said the Pakistani government has faced several obstacles this year regarding the U.N. Human Rights Council’s Universal Periodic Review.

Foreign Minister Jalil Abbas Jilani attended the annual UPR meeting in Geneva in January and received approximately 354 human rights-specific recommendations.

Sibley’s murder an attack on LGBTQ people and their expression More than 350 anti-LGBTQ hate crimes reported in last year

What do the banning of a children’s picture book about two male penguins, white supremacist stand-offs outside of weekend brunches and a killing during impromptu dancing at a gas station have in common? Plenty. Each impinges on the escalating trend of attacks on LGBTQ+ people and their right to free expression.

On the evening of July 29, O’Shae Sibley pulled into a Brooklyn gas station parking lot with his friends to fill up their gas tank. As they waited for the tank to fill, the group spilled from the car and used the moment to move joyfully in the hot summer night, cranking the car radio’s volume and dancing together. Sibley, a gay man, was also a skilled professional dancer and choreographer. He displayed his talents this night, voguing to the sounds of Beyoncé, an artist that Sibley and his friends were fans of. By coincidence, the artist was performing just a few miles away that night, with professional voguers joining her on stage.

Vogueing, a dance style born out of the traditionally queer ballroom scene, is known for its electrifying dips, drops and duckwalks. The style has been prominently featured in the Golden Globe-winning television show “Pose” — and, more recently, on stage in Beyoncé’s all-consuming Renaissance World Tour. The energy of the ballroom scene has spirited communities across the country, as Beyoncé’s tour has touched down city-by-city, and Sibley and his friends were not exempt to this reach. He was, in fact, eager to participate in his artistry as someone known for his role as a dancer, choreographer, and active member of New York’s ballroom community.

As he and his friends vogued to Beyoncé in the parking lot, moves that Sibley was adept in as an artist himself, they grabbed the attention of hostile onlookers. As captured on surveillance footage, Sibley was first berated with homophobic slurs — Sibley’s vogue performance seeming to signal his sexuality to his attacker. Shortly following the verbal assault, things turned violent. Sibley was stabbed and murdered in a tragic hate crime, fueled by homophobia and triggered by Sibley’s open expression as a dancer and artist.

In mourning, and in defiant protest in the days following, the New York City queer community hosted a memorial at the site of his murder where they honored his memory through performance, with a vibrant and resistant ball.

“You won’t break my soul. / You won’t break my soul, no, no. / I’m telling everybody,” Beyoncé sings defiantly in her single, “Break My Soul.”

The murder of O’Shae Sibley was devastating — and a signal of a disturbing trend. Increasing violence toward LGBTQ+ people, and attempts to quash their personal and artistic expression, are on the rise in the United States. Advocacy organizations such as GLAAD and the Anti-Defamation League have reported surges in harassment, vandalism and physical violence against LGBTQ+ people — with 356 instances being reported between June 2022 and April 2023. Transgender people, as well as drag performers, have been targeted at notably high rates. The Human Rights Campaign reported 34 murders of trans people — mostly trans women of color — in 2022 (HRC emphasizes that the actual number is likely higher,

as most attacks go unreported, or are reported inaccurately.)

Drag shows across the country have faced threats and intimidation from armed protesters, including the far-right extremist group, the Proud Boys. Gay bars have been targeted by armed assailants, such as the tragic massacre thatoccurred at Club Q in Colorado Springs, Colo., last November. Hospitals providing gender-affirming care to transgender youth have been targeted with bomb threats. On Aug. 18, a California store owner was shot and killed for displaying a Pride flag.

Harassment, threats of violence, and hate crimes against the LGBTQ+ community have steadily risen in recent years. It is clear that this bigotry has been emboldened and its first goal is to silence the free expression of LGBTQ+ people, through violence if necessary.

The exponential increase in physical violence against LGBTQ+ people over the last few years cannot be divorced from the recent legislative environment that has grown ever-more hostile to LGBTQ+ expression. Bills categorizing drag shows as obscenity, book bans targeting LGBTQ+ authors and stories about queer identities in schools and public libraries, as well as other legislative attacks are part of this trend against the LGBTQ+ community. The attacks, both physical and through laws and bans, risk enabling a culture that normalizes repression of queer voices and increases the risk of violence aimed, in part, at suppressing expression of LGBTQ+ people, even when individuals are simply voguing to Beyoncé in public.

Weird Weekend: Journey into Manhood

FROM STAFF REPORTS Not long after he provided his John Hancock for a non-sexual experience, Matt heard the words he’ll never forget. “Don’t mind me if I have a boner,” a 50-year old man who Matt says “smelled like cat pee” intoned. The older gentleman was assigned to be Matt’s cuddle partner. The idea was to serve as a surrogate father, offering love and affection through touch that dad supposedly withheld.

When the weekend commenced, lights were dimmed in a large room, creating an atmosphere of mystery and foreboding. The campers were disoriented, with their personal items having been taken from them immediately upon arrival.

“We didn’t even have watches,” Matt explained. “We didn’t have cell phones. We had to rely on the sun to tell time. We had no sense of time. We just followed direction from the leaders that were there.”

Most of those who signed up came from stern religious communities where they had very limited access to out gay men. Far away from home, they suddenly found themselves in the forest, surrounded by similar guys with raging hormones. The pent up, closeted sexual energy, whether acted upon or not, was palpable, and lay beneath the surface.

Matt nervously peered at his malodorous cuddle partner. They were instructed to attempt the “motorcycle position”. The much older stranger would sit behind Matt and hold him, as if they were riding a Harley down the highway.

Awkwardly, the guys crouched into position. Matt squirmed and tried not to breathe, though his partner’s stale cat urine aroma gently wafted into his traumatized nostril. He could feel the mature stranger’s member inflating like a birthday balloon, poking and prodding into his backside.

What kind of “straight camp” was this? Matt thought.

Abba Dabba Doo

Twenty-four-year-old Matt Ashcroft traveled from a small town in Ontario, Canada to the woods of New Hope, Pennsylvania to attend Journey into Manhood’s (JiM) weekend retreat. It was a 48-hour “ex-gay” camp experience, that was supposed to put him on the path to heterosexuality.

Arthur Abba Goldberg was out of prison and out of luck.

The disbarred attorney and former Wall Street conman groped to discover the next chapter in his sordid life. He was forbidden from practicing law and banished from the financial industry, so it was unclear how he would make a living. Suddenly, like a revelation from God, it was all too obvious.

His son had come out as gay, so Goldberg would opportunistically capitalize on his family’s situation to cash in. He recruited Elaine Berk, who also had a gay son, to pose together as “experts” who could cure homosexuality. In 1999, they started Jews Offering New Alternatives to Homosexuality (JONAH), in Jersey City, as the vehicle for their scam.

To add a whiff of legitimacy, Goldberg authored, Light in the Closet: Torah, Homosexuality, and the Power to Change, which mostly cribbed NARTH’s fringe ideas and debunked theories. Additionally, Goldberg became the Executive Secretary of NARTH and President of Positive Alternatives to Homosexuality (PATH), a coalition of “ex-gay” groups promoting “non-gay alternatives to homosexual lifestyles.”

In terms of viability, there was pent up demand in the

Orthodox Jewish Community for JONAH’s product. The already existing “pray away the gay” programs were geared towards Christians, offering Jesus as the answer. With an increase in the number of LGBTQ Orthodox Jews coming out every day, flummoxed family members and rabbis searched for answers on how to deal with this “abomination.” Goldberg and Berk would happily fill the vacuum, unethically profiting from other peoples’ confusion and pain.

There was one sticky problem that could potentially derail the whole scam. The name Arthur Abba Goldberg was unique. An online search would immediately reveal that he was a criminal mastermind who had done hard time for heinous crimes. The answer to his existential dilemma was simpler than one might imagine. He simply dropped the “Abba” from his name, and became one of the seemingly countless men named Arthur Goldberg, rendering himself virtually unsearchable. With a new identity and innovative swindle, Goldberg, along with Berk, put out a shingle. The legendary conman was back in business.

The ‘Ex-Gay’ Heyday The discoveries could be startling. Dan Scobey would stumble upon relics from his fiancé Randy Thomas’ disturbing past. The man he loved deeply, and affectionally held hands with during our interview, had not too long ago been the chief lobbyist and former Vice President of Exodus International.

“You know what’s fun,” Scobey told me? “When you move in with someone and you start making your own space, and you start putting some of their things away to make room for your things. You come across framed pictures of your partner in a tuxedo, and your like, ‘that guy he’s with looks so familiar. Oh my God, that’s Karl Rove. [George W. Bush’s political guru] That, goes in the bottom of the closet!’” Scobey joked.

Today, Randy Thomas (now Scobey) embodies the titanic failure of the world’s largest “ex-gay” ministry. At its peak in 2012, Exodus International had 251 member agencies. Its lobbyists strategized with the most powerful political leaders in the land. Exodus was part of the secretive Arlington Group, which was comprised of America’s most influential social conservatives. This included former Indiana Governor and eventual Vice President Mike Pence and Donald Trump’s future political strategist Kellyanne Conway. Exodus was also a member of the DC Group, the Religious Right’s B-Team, consisting of hardcore anti-gay zealots, such as Peter LaBarbera and Robert Knight.

In 2006, the “ex-gay” industry reached its apex.

Then-President George W. Bush hosted Randy Thomas and Exodus President Alan Chambers at the White House.

Their role was to trumpet their “ex-gay” identity in support of Bush’s campaign to pass the odious Federal Marriage Amendment. This unsuccessful effort attempted to change the United States Constitution to ban same-sex marriage nationwide. Thomas now looks back at this epoch in his life with profound shame and regret.

“At the time, I was so proud. I was like, ‘Momma, I’m going to the White House.’ Now I look back on it, I’m like, ‘Why didn’t you yell out? Why did you betray your community like that?’ And it’s a hard thing to think about. But I’m glad that the blinders have been ripped off, and I now, of course, support full marriage equality, and I’m going to marry a dude.”

Vic Basile revisits lifetime of advocacy Another important book debuting this fall is “Bending Toward Justice,” by Vic Basile, the Human Rights Campaign’s first executive director and co-founder of the Victory Fund.

“Bending Toward Justice” shares the history of HRC and the journey through AIDS, the attempts to get government recognition and funding for research, education, and treatment, and how HRC confronted ignorance and discrimination to shift the hearts and minds of Americans about equal treatment, according to a statement from the publisher.

“Drawing on his experience as the first executive director of the Human Rights Campaign Fund, Vic Basile has written a valuable addition to the story of one of the most consequential movements in post-World War II America,” said former gay Rep. Barney Frank (D-Mass.). The book was released this week and is available at HRC.org and Amazon.

An excerpt follows:

Every person in that ballroom lived with this reality, but the older attendees knew firsthand how truly terrifying it could be to be gay during the McCarthy era’s “lavender scare.” They remembered the 1950 congressional hearings on the “Employment of Homosexuals and Other Sex Perverts” that categorized them as national security threats and described them as perverts and child molesters. They remembered when President Dwight Eisenhower issued an executive order that banned “homosexuals” from the military and civilian federal employment. They recalled the horrifying witch hunts that publicly exposed and humiliated many thousands of federal employees. Not only did many lose their careers, but many lost their families as well. Too many died by suicide.

Of Historic Significance It was a historic moment for the fifteen hundred elegantly dressed people in Washington, D.C.’s Grand Hyatt ballroom, just blocks from the White House.

“Ladies and gentlemen,” announced Elizabeth Birch for the Human Rights Campaign, “it is now my deep honor to present to you the president of the United States.”

The crowd rose to its feet in thunderous applause. Never before had a sitting president addressed an LGBTQ audience until that moment on November 8, 1997, when President Bill Clinton was the keynote speaker at the first Human Rights Campaign National Dinner.

Ellen DeGeneres and Anne Heche were in the audience with Betty DeGeneres, Dorothy Height, Wade Henderson, Ambassador James Hormel, and elected officials, labor and corporate executives, and countless LGBTQ leaders from across the country. C-SPAN cameras ran live coverage, enabling many thousands around the country to share the historic occasion.

Although impossible to document, it seemed as though there were more reporters and cameras in the room than had ever covered an LGBTQ event before.

The historic significance of the president’s appearance that night was clear to everyone. No one could deny how far the movement had come since Stonewall. But everyone knew how much further we still had to go and how truly dangerous it could be for us just to live our lives. If those listening to the president that night had been lucky enough to avoid being gay-bashed, a quick scan of the local gay papers too often told of others who hadn’t been so fortunate.

Just eleven months later, there would be no escaping the horrific description of Matthew Shepard tied to a fence and left to die in a Wyoming field.

Those older attendees likely saw the horrifying 1967 CBS documentary anchored by revered journalist Mike Wallace called “CBS Reports: The Homosexuals.”

“Most Americans are repelled by the mere notion of homosexuality,” Wallace reported. “The CBS news survey shows that two out of three Americans look upon homosexuals with disgust, discomfort, or fear. One out of ten says hatred. A vast majority believe that homosexuality is an illness; only ten percent say it is a crime. And yet, and here’s the paradox. The majority of Americans favor legal

punishment, even for homosexual acts performed in private between consenting adults….

“The homosexual bitterly aware of his rejection responds by going underground. The average homosexual, if there be such is promiscuous—his sex life, his love life consists of a series of chance encounters at the clubs and bars he inhabits.”

The animus and discrimination against gay people were not confined to the federal government. Many state and local governments did the same. Florida was especially aggressive, using its notoriously cruel Johns Committee to expose and drive gay teachers, professors, and students from their jobs and academic pursuits at the state’s public universities.

During that time and well beyond it, police routinely raided gay bars, arresting patrons and releasing their names to the media. During one of these raids at the Stonewall Inn in New York’s Greenwich Village in June 1969, the patrons, some who were transgender, fought back in an uprising that would last for three days and mark the beginning of the modern-day LGBTQ rights movement.

That history, filled with richness and brutality, inspired the establishment of what is now the largest and most influential organization supporting LGBTQ rights in the country. I was the first executive director of that organization, taking it in six years from ambitious and almost viable to becoming the twenty-fourth largest of some five thousand political action committees in the United States. I led the organization’s massive lobbying effort to pass legislation mandating federal policy for fighting AIDS, we gave to more than a hundred friendly campaigns and committees, and we initiated several high-pressure actions in response to anti-gay legislation. For better or worse, politics in this country responds to money, and politicians learned they needed to respond to our community and our legislative agenda.

HRC’s growth and influence has multiplied with each succeeding leader. Today the Human Rights Campaign has some three and a half million members and supporters, some one hundred seventy-five people on staff, a building worth more than $50 million, and a budget of almost $70 million. Seven leaders have propelled the organization to its present stature.

HRC lobbies the federal, state, and municipal governments on LGBTQ legislative and regulatory matters, advocates before the courts, participates in judicial and executive branch nominations process, leads and actively works on national civil rights coalitions, educates the public, participates in elections, and works at the grassroots level on civil rights and political matters of national, state, and municipal importance.

But virtually no one remembers the handful of courageous individuals who started a small organization in 1980 to help bend that moral arc toward justice for their community. A few are still here. Many—too many—died of AIDS. All of them should be remembered, and no one more than Steve Endean, the young man who started what is now called the Human Rights Campaign with little money and a whole lot of grit.

New Bayard Rustin book an essential civil rights read ‘Legacy of Protest and Politics’ overcomes minor flaws

You will never settle.

And why should you? If it’s not right, you make it right. If it can be better, well, then get at it. You find the solution or you go on to the next thing because good enough is never good enough. As in the new book “Bayard Rustin,” essays edited by Michael G. Long, there’s always work to do and good trouble.

Somehow, it seems, in the discussion about Martin Luther King and the leadership he brought to the Civil Rights Movement, certain details may be left out. In the case of Bayard Rustin, says Long, the record needs to be altered. Today, now.

His mother was still a teenager, and unmarried, when Rustin’s grandmother helped deliver him in the spring of 1912.

The boy’s father refused to acknowledge him, so his grandparents gave him a family name and raised him in their Quaker faith.

Still, alongside the peaceful, gentle mandate of Quakerism, young Rustin experienced Jim Crow segregation. His grandmother left a major impact on him, teaching him compassion, kindness, and generosity – she reared him to do the right thing – but they lived in Pennsylvania, where racism was common and the Klan maintained a nearby presence. As if that wasn’t difficult enough, Rustin realized he was gay, which was illegal then.

At that point, though, he had seen many wrongs around him, and he became an activist. He also worked for justice as a speaker and organizer; at one time, he’d embraced communism but eventually became a socialist. By his own admission, Rustin was jailed more than 20 times and served on a chain gang for several months – but even then, his nonviolent Quaker beliefs emerged and he befriended his jailers, gaining their respect.

By the time he met a young preacher named Martin Luther King, Rustin was well-versed in civil rights work. He had direction, contacts, and the organizational skills the movement needed.

And yet, he was willing to let King take the front stage.

Pulled together as a collection of essays, “Bayard Rustin” has one flaw that probably can’t be helped: it’s quite repetitive.

‘Bayard Rustin: A Legacy of Protest and Politics’ Edited by Michael G. Long

c.2023, NYU Press | $27.95 | 256 pages

Each of the essayists in this book wrote extensively about Rustin, his work, and his impact, but there just doesn’t seem to be quite enough about Rustin himself – perhaps because, as editor Michael G. Long indicates in his introduction, Rustin left a legacy but history left him more in the background. This means that the nearly two dozen contributors to this book had only what they had to go on, hence, the repetition.

Even so, if you look for Rustin, you’ll find abundant tales about him and this book has a good portion of them. Readers will be entertained, confounded, and pleased by what they read here. It’s like finding treasure you never knew you needed.

This book needs to sit on the shelf next to everything written about Dr. King. It’s an essential companion to any volume about the Civil Rights Movement. If you need history, find “Bayard Rustin” and settle in.

Basic training turns to love in ‘Eismayer’ A heartfelt reminder of the transformative power of attraction

Consider the true-life story of Vice Lieutenant Charles Eismayer, a veteran training instructor in the Austrian Armed Forces whose reputation for toughness became a legend that struck terror into the hearts of young Austrians headed for their compulsory National Service; married, macho, and merciless, he shocked both his military colleagues and the public alike when he became one of the first officers in the Austrian military to come out as gay after falling in love with a recruit. Once seen as a paragon of hyper-masculinity, responsible for traumatizing a generation of fledgling soldiers with his brutal training tactics, he’s now widely lauded as a queer pioneer who helped to fuel a shift toward acceptance and diversity in the Austrian military.

This little-known (in the U.S., anyway) chapter in queer history is the basis for “Eismayer,” the feature debut of Austrian filmmaker David Wagner that premiered at the 2022 Venice Film Festival to wide acclaim from critics; after a successful tour of the festival circuit during which it garnered numerous prizes and was frequently cited as an audience favorite, it makes its American debut with a limited theatrical release on Oct. 6 before dropping on digital/DVD on Oct. 10.

Wagner’s somewhat fictionalized treatment of the story — which he wrote in film school after hearing the legend during his own stint in the National Service — begins by introducing its title figure (Gerhard Liebmann) through the perceptions of a group of new recruits who, familiar with his reputation, attempt (and fail) to avoid training under his tyrannical command.

One exception is Mario Falak (Luka Dimić), who has ambitions to continue on to a career as a military officer; openly gay and determined to succeed, he quickly draws the wrath of his new superior with his cocky and defiant attitude.

Despite the perceived challenge to his authority, however, Eismayer — who, unbeknownst to his colleagues, wife, and children, lives a closeted life from which he regularly escapes with secretive anonymous sex with men — has conflicting feelings about this new recruit. Their combative relationship begins to soften, at first with mutual respect and then with something deeper as Falak starts to recognize the truth behind Eismayer’s façade. Soon the attraction between them becomes irresistible — and the drill master is forced to decide to if he is man enough to step out from behind the protective lie of his tough-guy image and risk both reputation and career in order to live a life in the open.

If you don’t want to know what happens, you should stop reading here, because since the film is based on a true story it is no secret — and therefore not really a spoiler — that Eismayer and Falak eventually became a couple and entered into a domestic partnership that continues to this day. Indeed, the film arguably plays better with that advance knowledge, at least in this country, because given the American cultural climate of the moment there is much about its premise that might be hard to get past for sensitive audiences.

To begin with, of course, there is the toxic masculinity and internalized homophobia behind Eismayer’s carefully constructed persona, which might compromise his likability for some viewers to find; combined with what might today be considered an inappropriate power dynamic between them — as a superior officer and his subordinate — the romance upon which the movie hinges could be a non-starter for many audiences today.

Knowing that these two characters will ultimately become a couple, however, it’s easier to recognize it as a love story, rather than just another harrowing tale of bullying and abuse in a boot camp. Further, by focusing on both Falak and Eismayer from early on, the movie helps us see beyond the roles both of them play to find a deeper understanding of what is growing between them than a surface reading based in one perspective could possibly convey.

After all, even in the 1990s setting of “Eismayer,” its title character is already something of a dinosaur; when his conflict with Falak culminates in an incident early on, it is he whose behavior is questioned and rebuked by his superiors. The world is changing, and Eismayer must change with it if he is to keep going; his romance with Falak, whose openness is unencumbered by shame and cultural expectation, becomes his lifeline. The outdated toxic traits that have kept

the older man safely hidden have also kept him imprisoned, and it is through the example of the younger that he discovers the softer strength within himself to break free. There’s a potent lesson there about transformative change that somehow feels just as appropriate for our own troubled and conflicted age as it does the now-decades old world of the film.

That all of this works instead of falling into a trope-dependent, agenda-driven melodrama seems a bit miraculous, given how many movies we’ve seen about military homophobia across the years; but in truth, it’s largely due to the perspective brought to the mix by Wagner, who did extensive interviews with the real Eismayer and Falak in developing the project and subtly crafts his film into a surprisingly sweet and improbably uplifting story of love instead of a scathing and depressing story of hate.

It also owes much to star Liebmann, an already acclaimed Austrian actor who gives a remarkably layered and palpably real performance in the title role. It’s been lauded as a “star-making” turn, which in a completely fair world it should rightly be, but no less impressive, if not as showy, is Dimić’s Falak, eminently believable as a bold-hearted iconoclast who can nevertheless see beyond his own prejudices to recognize the humanity of his perceived enemy. The final glue in the mix is the chemistry between these two co-stars, which not only heats up the screen but makes their romance feel thrillingly authentic.

Despite all that, it’s undeniable that “Eismayer” will likely be unwatchable for some audiences, whether queer or straight, because of what they might consider an “unacceptable” scenario in the surface details of the movie’s plot. We can respect that.

For those who take a more nuanced view when it comes to working through ethical grey areas, or who recognize that matters of the heart have a way of defying hard-and-fast constructs about what is or is not appropriate, it’s a surprisingly entertaining and refreshingly heartfelt reminder of the transformation power of love.
