Dear Readers, I often begin my letter with a look back at our industry such as “Last year at this time …” If I am to stick with that sentiment, I have to say that since last November, the struggling economy and challenges for small businesses look pretty much the same. It’s tough out there – but history has shown that the good people who make their living in the tan biz are tougher!

On another positive note, you’re about to make it through the final month of “JASON” and should be starting to prepare for the busy holiday season ahead. This includes choosing which of the many brand new tanning and skincare products you will offer your salon guests for both tanning and gifting. Maybe you’re planning to install a new tanning unit or add a spa service to your menu. New products and services can create a lot of excitement for both your tanners and staff. DEVOTED CREATIONS WINS PRESTIGIOUS AWARD pleased to announce its recent recognition of product packaging excellence at the Foil & Specialty Effects Association’s (FSEA) 30th Annual Gold Leaf Awards.

Overnight Labels, a Premium Label & Packaging Solutions company, received a Bronze Award for Best Use of Cold Foil (Label or Carton).

The competition evaluates submissions that utilize a wide range of specialty finishing techniques, from foil stamping and embossing to specialty coating, film-laminating, laser-cutting, die-cutting and cold-foil applications. A record number of entries were submitted from countries worldwide, including the U.S., Canada, India, Italy, Switzerland, Poland, Denmark, Japan, South Africa and Taiwan.

“We are honored to win this product design award!” stated Devoted Creations President Lewis Henry. “It’s a testament to the incredible teamwork and creativity that brought our vision to life. This recognition inspires us to keep pushing the boundaries of design that allows us to create cutting edge products for our clients.”

In the September issue of Global Cosmetic Industry Magazine, FSEA Executive Director Jeff Peterson commented, “Our FSEA Gold Leaf Awards Competition showcases how embellishments have become a catalyst in the printing

industry. The creativity and technology used in the pieces we receive continue to amaze us every year.”

The award considered use of specialty finishing techniques, including foil stamping, embossing, specialty coating, film laminating, laser cutting, die-cutting and cold foil applications.

The winning label is a shrink-sleeve produced for Devoted Creations’ highend tanning lotion, Metaphoria Infinite Auto-Darkening Iconic Bronzer. Lisa Saavedra, Director of Brand Development, was very happy about the award.

“The green, black and gold marbled packaging design is intended to evoke the product’s luxury ingredients,” she stated. DC products are consistently voted “favorite package design” by tanning business operators who vote in the annual IST Magazine “Industry Choice Awards” campaign.

Salon Spotlight features highlight businesses that have achieved success by partnering with the team of professionals at tanning and wellness system manufacturer and worldwide industry innovation leader, JK Products & Services.

This month, we talked to Richard Samuel, Owner of seven Maximum Tan facilities in the Rochester, NY area. At the time of this writing, Maximum Tan had just installed two Vitality TLT3 (Total Light Technology) tanning systems and was awaiting delivery of three more this month! Richard had high praise for the many outstanding features of

the Ergoline tanning and wellness systems he offers at his salons, for his company’s relationship with Team JK and the ways it benefits his business.

IST: What led you to pursue a business in the tanning industry?

RS: I was fresh out of high school in 1997 when a local salon right down the road from where I lived closed its doors. At the time, I was a competitive bodybuilder; I had frequented many salons and was familiar with how they work. I knew that I wanted to own my own business and thought this may be

a good opportunity to get started at a lower investment, since the buildout was already done. Admittedly, I was young, inexperienced, and really didn’t know what I was doing! But, I did have a good instinct for business and the tanning industry was still young at the time so I was able to survive and eventually thrive. The timing actually worked out well, and as the industry evolved and became more advanced, I did, as well.

IST: How have your tanners responded to the Vitality TLT3 and other Ergoline systems you offer at Maximum Tan? RS: We purchased our first Vitality TLT3 in March of this year. Since then, it has become the most popular bed in our salon by far. Aesthetically, the design attracts a lot of attention and overall, it delivers a much better experience than any other bed in our salon! People love the fact that the technology combines red, blue and UV light. It is easy to use, yet has a ton of features people love. The LED facial tanners are a hit! Some of our customers love the fact that you can turn off all the UV light on your face and expose your face to just red and blue light, if you wish. Climate control keeps the session at just the right temperature.

We strive to offer quality facilities with the best equipment around, so Ergoline has always been our first choice. The Vitality TLT3 has been so popular, we had to buy another for this store and have purchased five more in total for the other salons!

IST: What is your favorite JK system?

RS: My personal favorite is the Wellsystem Wave hydromassage table – it is incredibly relaxing! Since I work out all the time, the hydromassage is really enjoyable and loosens up my tense muscles. I am excited to add another Wave unit to my equipment lineup this month.

IST: What challenges have you faced in the salon business and how did you overcome them?

RS: Over the years, Maximum Tan’s biggest challenge has been competition. At times, our market has been oversaturated with salons and highly competitive – but that competition has brought out the best in Maximum Tan! Our business model is based on offering the best equipment, modern and upscale facilities, and a super-clean environment with top-notch customer service. Ergoline equipment has been one of the major keys to winning with this strategy.

Having the very best tanning equipment gives you an advantage over your competitors and for me, it has been well worth the extra investment.

IST: How has Team JK helped you grow your business?

RS: JK has been a major factor in growing my business. Hans (Hans Both, Director Distributor Sales) has always given us solid advice and kept us in the loop with industry trends. He has helped me network with some of the most successful salon operators in the country, which is invaluable. Owners can learn a lot from each other and it’s great that Ergoline has helped facilitate this. The products JK provides have always been top-notch and tech support has been great, as well, keeping our equipment up and running. We are not always the cheapest salon in town, but we do consistently deliver a quality product and Ergoline has been instrumental in providing quality, reliable equipment. The look, performance and reliability has always been there and we have built a successful business on that. ■

ASA Government Relations E�forts Succeeding

ASA Executive Director Joe Levy testifies on behalf of the tanning industry at a meeting of the Senate Health Committee.

THE

American Suntanning Association is staying ahead of attempts to over-regulate professional indoor tanning facilities at the state and federal level in 2023.

Efforts to keep under-21-year-old clients from using sunbeds in professional salons have been introduced in New York state, with anti-sun groups in California looking at the same. An under-18 bill in Ohio has been reintroduced once again as well, while other states continue to look at finding ways to restrict access to professional salons.

ASA has worked to stop any of that from moving, with victories in the book or paths to victory still in play in all of our efforts this year.

And, more than ever, ASA’s promotion and defense of the market with policymakers is founded in constructive dialogue that positions tanning professionals as part of the solution in real-world sun care.

ASA came out on the winning side in all 11 state legislative issues raised in 2022 without a defeat, using science to convince legislators that our approach to sunburn prevention and parental consent for tanners is the best way to address sun care issues. In the past two years, ASA is 25-0 in state capital issues.

Many of these issues involved proposed under-18 or even under-21 age restrictions for usage of a professional sunbed facility. In many cases, ASA

convinced would-be bill sponsors not to even introduce bills after seeing the science that does not support that approach. Some of our victories involved tax bills and other issues.

“We have blazed a common approach of putting real-world sun care in constructive, scientifically supported terms,” says ASA Executive Director & Director of Scientific Affairs Joseph Levy. Since 2015, ASA has convinced state legislatures 120 times that our positions make sense – continuing to win when we have the opportunity to lay out the unintended consequences of anti-sun legislation.

“We can demonstrate that our position is scientifically solid,” stated Levy, who has now traveled to 43 different state capitals on behalf of ASA and ASA partners.

Levy has met with state officials and legislators nationwide again this year, with meetings in California, Ohio, New York and New Jersey already leading to positive results.

“The best way to keep legislation from getting any traction is to re-dedicate your tanning business to professional practices, sunburn prevention and to be worthy of the path that is being blazed for the tanning market of tomorrow,” Levy added. “And get involved with ASA. We need your support.”■

This strong dependency is enough to give any salon and spa operator the motivation to always have an overall maintenance plan in place.

To start, your tanning and spa-related equipment are most likely controlled by a salon management program and a timer system. Not only is your equipment operated via these technologies, but your point-of-sale and back office systems are likely to include an equipment maintenance function.

As a result, it’s imperative that as part of your IT-related preventative maintenance, your operating systems and software are up-to-date and running supported versions, and that you’ve installed anti-virus programs. And so, the alignment of the stars seems to be in play for our industry. Yet, this will not be without challenge nor without need for further education, even within some of our own ranks. A classic example of a message that needs clearer understanding is that UV light is the same, whether from the sun or a tanning bed. There are those who would have our customers, and indeed potential customers, believe that the UV light generated in

a tanning bed is somehow different – and not in a good way – to that generated by the sun that reaches the Earth’s surface.

This is, of course, scaremongering nonsense from people typically overcome by ideology and self-obsession. We know that, unlike sunbathing in the sunshine, a tanning bed session is a controlled UV exposure designed to tan and not burn.

And this is just one example of the misinformation we need to continue addressing as part of our ongoing education about responsible tanning.

Exciting times ahead, I think, and as an industry we need to ensure the volume is turned up fully to ensure we are heard. ■

popularity of tanning beds is growing. That is a fact – a gloriously welcomed fact and one that we as an industry should maximise upon for all the right reasons and irrefutably, in a professional and responsible manner.

Driving this popularity are predominantly those aged 18-25, with recent data by a UK charity suggesting as many as 42% of this age group have used a tanning bed. And it is this age group that we need to connect with, in particular, to ensure they are receiving the correct advice and information about tanning responsibly, thereby helping the industry grow organically and aiding retention of their custom going forward.

Alongside the provision of correct information and protocols in salons, social media is undoubtedly key to achieving this objective and, as mentioned last month, I would love to see our industry commission a globally-blended campaign that takes our established in-salon professionalism and focus on responsible tanning directly onto the platforms engaged with by this age group.

Generally, successful salons will already have a well-honed social media presence and the influence of good content delivering increased salon footfall is undeniable.

And for those yet to dip their toes in the social media water, it never is too late! I know of a salon that has just ten videos on their account but one of those has attracted just under 1 million views! Many of this salon’s new customers visited the salon after seeing the video and almost without exception, they were ages 18-25.

A replacement lamp must not emit UV output that is + or - 10% of the originally installed lamp’s output, nor can it alter

All sunlamps must also have a “warning” label etched on the glass. Simply put, just because a lamp “fits” in the sunbed, does not mean that it’s FDA compatible. A letter of compatibility that’s been registered with the FDA must also accompany the replacement lamp and that letter must originate from the lamp’s manufacturer.

To determine exposure schedules, the industry standard for salons is to use an individual tanner’s skin type as rated 1-6 on the Fitzpatrick scale. Note that the exposure schedule is based on the output of four MED (Minimal Erythemal Dose) for a Skin Type II person. Huh? Well, an MED is the least amount of UV exposure needed to create a

discernible pinkening of the skin on a person with Skin Type II. No sunbed can emit more and this output is adjusted by the exposure schedule. Typically, the higher the UV output, the shorter the tanning session. But it’s not only the lamp; the thickness of the acrylic shield, proximity of the tanner’s body to the sunlamps and output of the system’s ballast are also considered for the schedule.

The FDA does not list the number of hours of usage after which a lamp should be replaced, only that “worn out” or non-functioning lamps should be replaced.

Hey, did you know that if a sunbed’s exposure schedule label or warning label is worn off (illegible), it’s the responsibility of the salon operator to replace it? Yup, and it’s the bed manufacturer’s responsibility to make the replacement label available.

media has typically had a disdainful view of indoor tanning.

This includes the position that among the biggest problems with our industry is that it’s not regulated. Well, that would come as a shock to the Food and Drug Administration which has regulated sunlamps and sunbeds in the U.S. since the inception of modern indoor tanning in 1979! Here’s some of what that regulation entails.

Section 1040.20 of the Code of Federal Regulations Title 21 (21CFR1040.20) under “Performance Standards for Light-Emitting Products” covers such items as sunbed timers, compatible sunlamps, exposure schedules, eye protection and more. However, these regulations are geared toward manufacturers of products rather than the salons where they are used.

A question from the Sun is Life® Certification exam that tangles many students concerns eye protection. One would assume that the FDA would absolutely mandate that reusable eye protection (goggles) be cleaned and disinfected after every use. A no-brainer, right? Wrong!

The FDA Code of Federal Regulations regarding eye protection covers several specifics: Code-compliant eyewear must block 99% UVA and 99.9% of UVB rays from penetrating the eyelids. Its lens must also allow visible light sufficient for a tanner to read the exposure schedule posted on the sunbed and reset the timer (to wit, turn the sunbed off) if needed.
