Can I insist we appoint a body corporate manager so I can sell my lot? I want to sell my lot in a 3-lot self-managed scheme. The other owners vote down my proposal to appoint a body corporate manager, so how do I get things moving? I want to sell my lot in a 3-lot scheme. I’ve lived there for one year. The scheme has no committee, no manager and no budget. I wanted to appoint an external manager to run the body corporate. The prospective manager told me I needed a majority vote. At a meeting, I lost the vote 2 to 1. Due to age and health issues, the other lot owners aren’t interested. If one says no, the other agrees. I can’t supply a Form 33 disclosure because there’s no authorised person to sign it, and even if I were authorised as a signatory, it would be a conflict of interest. Can I hold an EGM to force a 25% vote to install a manager? If not, how do I get the sale moving? If I asked my solicitor to search the documents, can they fill in the Form 33 and sign it on my behalf?
There’s no quick legal shortcut here, so your best path is likely persuading the other owners or raising a dispute with the commissioner’s office. It’s a tough situation. Owners aren’t obliged to appoint a manager, and if you get 2 vs 1 vote against, there isn’t much you can do about that. Technically, yes, you could call an EGM and issue the papers, but the other owners would still have the opportunity to vote in that scenario. 4 www.lookupstrata.com.au
However, while the body corporate doesn’t have to have a manager, it is obliged to have certain legal standards, which would include the provision of a Form 33, if required. Do you know who the committee members for your scheme are, as the responsibility would sit with them? You could then file a dispute with the commissioner’s office. This may be an effective way to force the other owners to take the issue more seriously. What you probably shouldn’t expect is a quick resolution. The commissioner’s office is slow, and even if a body corporate manager were appointed, it would take time to complete the appointment and set up the process. Depending on the books and records available, they may not be able to provide a complete Form 33 straight away. If I were you, I would look to have a meeting with the other owners and discuss the legal obligations of being a member of the body corporate and the implications if those obligations are not met. See if they can accept this proposition, and perhaps a constructive resolution can be reached. It would be important to acknowledge your own role, as you have been an owner in the scheme and have had the opportunity to influence the body corporate’s setup. All parties share responsibility for the current situation, and acknowledging that may help resolve it. I would also frame any pitch in terms of a benefit for all owners. It is you who wants to sell now, but other owners will want to in the future, and they will face the same issue when they do. If an agreement can be reached, great. Is the committee required to estimate building insurance in the annual budget? Is the committee required to make provision (an estimate) in the budget pursuant to section 150 to cover the cost of building insurance for the coming year, rather than just helping itself to meet the cost of insurance premiums? The only mention of our insurance costs is the “amount of premium…” in the AGM motion, which applies to the existing policies, but building insurance is omitted entirely from the actual proposed budget.

Who pays to fix ceilings opened for fire damper repairs?
Who is responsible for making good ceilings opened up to replace fire dampers? I am chairman of our committee. Recently, while a unit was being renovated, we discovered by chance that several units have fire dampers installed. A specialist company inspected the units and found that the fire dampers in each one had been sealed up, either by owners, previous owners, or at the time of construction.

Owners paid to have their own ceilings exposed so new fire dampers and ducting could be installed for $7,000 per unit. The committee paid for this work and will continue to inspect the dampers. The owners have now asked the body corporate to pay for making good the ceilings. We’ve stated this is down to the owners, since the ceilings are internal, inside their own units, and are the owners’ responsibility.
We feel this is fair to the other owners who aren’t affected, as those on the top floor have a different exhaust venting system that vents directly onto the roof, with no fire dampers involved.

If the ductwork was the body corporate’s maintenance responsibility, it’s likely reasonable for the body corporate also to pay to make good the ceilings. If a body corporate is responsible for maintaining part of a building, the body corporate will also generally be responsible for any incidental works required to investigate or gain access to that part of the building. This includes any make-good works to reinstate affected property to its original condition. I assume the internal ceilings were exposed at the request of the body corporate, or that those works were necessary to investigate

Must a caretaker hand over common property keys to the committee?
Our caretaking agreement says the caretaker must keep all common property keys. The body corporate passed a motion that the caretaker must hand copies to a committee member. Does the caretaker need to comply? Our caretaking agreement states the caretaker is to keep possession of all keys to the common property. It does not state that any committee member must hold a copy. The body corporate passed a motion requesting the caretaker provide copies of all common property keys to one appointed committee member.

Should the caretaker provide copies of all keys to this appointed member? We understand that the keys are body corporate assets. However, the body corporate and the caretaker signed the caretaking agreement, which clearly states that the caretaker is to keep possession of all common property keys, and no one else. The caretaker is concerned about potential uncontrolled risks if others hold the keys. How should this situation be handled by the caretaker?
The caretaker shouldn’t hand the keys over unless the agreement is formally amended, or the body corporate releases them from liability for doing so. Without reviewing the entirety of the agreement, it is difficult to provide a complete response. Usually there would be a duty in the agreement also requiring the caretaker to comply with the directions of the body corporate.

Can a building manager rent out common property car parks? Can a building manager rent out common property car parks to short-term tenants without body corporate approval? Our building is under the Accommodation Module of Queensland’s Body Corporate and Community Management Act 1997 framework. We suspect our building manager rents common property car parks to shortterm tenants as part of their short-term accommodation (STA) offering, without body corporate approval. Is this legal? If a short-term rental (STR) tenant’s car is damaged while parked, who’s responsible for covering the cost of repairs? Will the body corporate’s insurance policy cover the damaged vehicle? What steps, if any, should the body corporate take to resolve this?
The building manager’s authority is a governance matter, and public liability cover depends on the circumstances of the claim. The first point to note is whether the use of common property car parks in this manner has been properly authorised by the body corporate (if authorisation is required). Whether the building manager has authority to rent common property car parks will depend on the relevant management agreements, by-laws and any approvals granted by the body corporate. 16 www.lookupstrata.com.au
This is a governance and legal matter rather than an insurance matter, and the body corporate should review with their strata manager or consider seeking independent legal advice regarding its rights and available actions under the relevant legislation and management agreements. From an insurance perspective, the public liability section of a strata insurance policy generally responds when the body corporate is found legally liable to pay damages to a third party for personal injury or property damage. It will also respond to defend against such claims. In the scenario provided, if the body corporate receives a claim from a third party for damage to their vehicle whilst parked in a common property car park, the insurer would review the circumstances of the claim in full and respond in accordance with the policy wording. A vehicle being damaged on common property does not automatically mean the body corporate is legally liable for that damage. Responsibility for the cost of repairs will ultimately depend on the circumstances surrounding the incident and whether any party is found legally liable for the damage. Regardless of whether the third party is an owner-occupier, short-term tenant or longterm tenant, the claim would be assessed in the same manner, and the policy will respond in the same way.
It is also critical that, regardless of the circumstances, the body corporate and its representatives do not invite the third party to make a liability claim against them or make any admission of liability before notifying their insurer and obtaining appropriate guidance. That said, it is worth highlighting that if a component of your complex is leased out in a commercial nature, this should be disclosed to your insurer, as insurers require notification if any part of a complex is used for commercial purposes. With respect to the actions of the building manager, this would fall outside of what is considered by the strata insurance policy. We therefore suggest that the body corporate discuss the matter with the building manager, review any relevant agreements or approvals, and seek independent legal advice where appropriate.

Do minor VOC decisions require owner notification? Our committee has to report VOC decisions back to owners, but that comes with an admin cost. Doesn’t it make sense to report only spending decisions over, say, $500? Our committee is appointed to act on behalf of owners, and it’s required to report decisions back to them. However, VOCs incur an admin cost. Wouldn’t it make sense to streamline the whole process by not being required to report expenditure decisions under a figure of, say, $500? Matters above that still trigger the “red tape”. Are there guidelines as to when owners need to be notified about a VOC? Most owners aren’t interested in the really minor stuff, so why bother? 18 www.lookupstrata.com.au
Owners who don’t want the detail can opt out of VOC notifications, since the transparency exists for those who care. We’re not sure what you mean by “report back”. A committee’s role is to make decisions, and minutes record those decisions. Perhaps that’s the “report” aspect you mean. Also, to clarify, a VOC is distinct from a committee meeting. In any event, refer to sections 67, 68, 69 and 70 of the Standard Module for provisions about voting outside of committee meetings. The provisions allow owners to opt out of receiving details. Those owners who are uninterested can avail themselves of those opt out provisions if they wish.
We can’t agree with either your “red tape” comment or that most owners “don’t care”. While it’s true some owners are disengaged from the operations of a body corporate, it’s dangerous to generalise about their level of interest. On the issue of red tape, it might seem there are a lot of bureaucratic mumbojumbo provisions in strata legislation. Having dealt with said legislation for over a decade, we can say with some certainty that every provision has a valid reason. In most cases, and especially in this case, the reason is transparency. It’s essential for committee operations to be transparent to all owners. If some owners don’t care enough to take advantage of that transparency, that’s on them, and they’ll have to bear the consequences. Respectfully, though, we don’t think it’s appropriate to reduce those transparency aims. What may be “minor” to you may be essential to someone else. At the end of the day, all owners’ money is contributing to the running of the body corporate, so the

Is my apartment’s smoke detector compliant before I buy? Our pre-purchase checks found no fire safety certificate or asset record for the apartment’s smoke detector. Is the smoke detector compliant, and what can I do before settlement? I’m looking at a 7-level residential building format plan in QLD with a fire panel in reception and a direct alarm to Queensland Fire and Emergency Services. The pre-purchase inspection contractor advised that the smoke detector isn’t independent of the panel. The pre-purchase body corporate search stated no fire safety certificate was available, and enquiries with the building’s fire safety provider revealed no assets are recorded for the apartment. This seems unusual, since the by-laws provide for false alarm call-outs to be billed back to the owner, which suggests there’s an individually coded detector for each location. The sales agent told me the smoke detector isn’t a smoke alarm, so it only has to be installed, not comply. Is this correct? Other providers suggest that compliance of the device (detector or alarm) includes the panel system being checked in accordance with state requirements, and all smoke detectors in the building being less than 10 years old. Detectors are replaced when faulty or non-compliant, with each recorded as an asset so it can continue to be monitored and replaced when due. There doesn’t appear to be any record of replacement in the 17 years of the selling owner. Is the apartment compliant? What can I do before settlement?
Neither compliant nor non-compliant can be confirmed. This is an unresolved due diligence issue requiring written evidence before settlement. The first step is to confirm whether the device inside the apartment is: • a smoke detector connected to the building’s fire indicator panel; or • an independent AS 3786 smoke alarm. If it is connected to the fire panel, it forms part of the building’s fire detection and alarm system. It must be tested, maintained and recorded as part of that 20 www.lookupstrata.com.au
system. It is not sufficient to say that it only needs to be installed. However, the 10-year replacement requirement applying to domestic smoke alarms does not automatically apply in the same way to panelconnected detectors. Their replacement depends on the approved system design, maintenance requirements, the manufacturer’s instructions, and the condition and service history. Seventeen years without any recorded replacement warrants investigation but does not, by itself, establish non-compliance. The absence of an apartment asset record is concerning. Before settlement, I recommend:
• confirmation that the detector is connected to and identified at the fire panel; • the detector’s asset identification, location and most recent test results; • current AS 1851 maintenance records and the annual condition report; • details of any outstanding defects; • the approved fire detection design and asinstalled drawings; • confirmation of the detector’s age and the building’s replacement policy; and • confirmation that the occupant-warning arrangements within the apartment comply with the approved design.
The false-alarm charge-back provisions indicate that the detector location can likely be identified, but this does not prove that the system is compliant or adequately maintained. Based on the information provided, I would not yet describe the apartment as either compliant or noncompliant. I would describe it as an unresolved due diligence issue requiring written evidence. If the requested records cannot be produced, complete an independent inspection before settlement and refer the matter to your solicitor for rectification or appropriate contractual protection. Isn’t the fire contractor responsible for my Body Corporate’s fire compliance? A common assumption in apartment buildings is that if the fire contractor attends regularly, the building’s fire compliance is under control. In practice, that isn’t always the case. Fire contractors inspect, test and maintain the systems they have been engaged to look after, such as extinguishers, hose reels, hydrants, fire alarms, sprinklers, emergency lighting and exit signs. But servicing equipment is only one part of a Body Corporate’s overall fire safety responsibilities.
Instead of asking: “Do we have a fire contractor?” Committees should be asking: “Can we demonstrate that all of our fire safety obligations are being met?” That means knowing where the records are, whether defects have been closed out, when the Fire and Evacuation Plan was last reviewed, whether evacuation requirements are current, and whether the Occupier’s Statement has been completed. This becomes particularly important if the Fire Department inspects the building or there is a fire. An independent review can help identify gaps that routine servicing alone may not pick up.

Are owners who volunteer their expertise covered by body corporate insurance?
Qualified owners who aren’t on our committee have offered to help with maintenance work, but we’ve been told our insurance won’t cover them. What can we do about this? Our body corporate committee includes two people with engineering qualifications. They help when we get quotes for maintenance work. They understand the issues, can prepare a scope of works and can supervise the work. As committee members, they are covered by our public liability and office bearers’ liability insurance policies. We also have owners with relevant qualifications, such as building, project management and engineering. These owners have offered their help and advice. We’ve been told our policies don’t cover them. Is there anything we can do about this?
Voluntary workers cover may extend to a non-committee owner if the committee passes a resolution formally recording the specific tasks they will do. This is a great question. It’s common for lot owners to offer voluntary services and advice to their committees. Generally speaking, if the body corporate holds cover for voluntary workers, this could extend to a non-committee owner carrying out work or duties on behalf of the body corporate without expectation of reward or remuneration. To rely on this, the committee should pass a resolution formally recording the specific tasks the owner will undertake. Professional advice sits differently. The strata policy does not provide professional indemnity cover for owners. This means that where advice is given using a professional qualification, for example, a structural sign-off or engineering design, the insurer may decline any resulting claim, on the basis that a commercial professional indemnity policy should respond instead. If owners do proceed in offering advice or guidance, we’d recommend it be peer reviewed and kept general in nature, with the owner stating explicitly in writing that they are providing informal guidance rather than a certified professional signoff. If the body corporate wants to formally engage an owner for their services, we recommend they hold their own commercial public liability and professional indemnity insurance relevant to their qualifications.
