For most, superannuation really only gathers relevance in the later stages of life. This makes sense, as the goal is now in view and preparations to build the funds become the primary focus as the picture of what retirement might actually look like becomes clearer.

For those fortunate enough to have built a substantial amount during their lives, this is a happy period and brings with it the comfort that their lifestyle will be preserved (or increased) once they finish work and move into the next phase of life. For many, this is also a time of regret that they didn't start earlier or make more effort to contribute more to their retirement savings or focus on how it was invested.

Strata & sinking funds can be looked at similarly, but thankfully with a much higher level of clarity over what is required at the other end. The increasing requirement for buildings to have a 10-year plan (now mandatory in many states for specific sized buildings) has meant that much of the ambiguity found in personal retirement plans can be removed, and more defined costings and timelines can be established.

So, with the periodical and significant costs of replacing substantial components of a building now clearly defined, the 'financial plan' of a building is thankfully a lot easier to compose. There is an existing amount and a reasonably good idea of the end amount required, and all that is left is the pathway there.

Essentially this all now boils down to two major components: 1. Contributions to the fund (strata levies) and 2. The rate of return available to compound the accumulating funds.

New QLD Smoke Alarm Regulations Are You Compliant?

Who is responsible for making sure the new QLD smoke alarm regulations have been addressed?

The owner, managing agent or committee.

I live in a complex with approximately 30 rental properties. Some of the owners live interstate or overseas and may not be aware of the new QLD regulations to have smoke alarms fitted

by January 2022 to domestic buildings leased or sold. Who is responsible for making sure the alarms have been fitted? The owner, managing agent or committee.

It would be prudent of a body corporate to request a copy once a unit has been upgraded.

From January 2022 the smoke alarms require to be upgraded at the beginning of a new lease or at the renewal of an existing lease. This can be managed by the landlord or the managing agent, reputable installers will provide a certificate of installation. It would be prudent of a body corporate to request a copy once a unit has been upgraded to indicate that the installation is in compliance with the legislation.

Submitting Motions Is validity in the Detail?

An owner has submitted a motion but the name on the motion is not the same as per the Titles office. Does this make the motion invalid?

I am the chairperson of a BCC. We have an AGM coming up. Our Body Corporate Managers have received a motion from one of our Lot’s but the name on the motion is not the same as per the Qld Land Titles Registry.

Does this make the motion invalid?

It depends on whether the motion has made its way onto the agenda.

If the agenda has been finalised and sent with the motion included, it is arguably approved by the committee and now the property of the meeting such that it can only now be ruled out of order if it: 1. Would conflict with the Act, the regulation module, the by-laws, or a motion already voted on at the meeting; 2. Is unlawful or unenforceable for another reason; or 3. Does not include the substance of the motion in the agenda for the meeting.

If the agenda has not been finalised – the committee can reject the motion on the basis it was not submitted by a member of the body corporate. However, I would caution the committee on taking this approach if the difference between the name on the motion and the owner according to the titles office is a technical one. If it is the same person, who just goes by a different name, the committee should include the motion.

We own and live in a duplex. The other owners rent their duplex. Both lot owners are on very good terms and we have always come together for reasonable strata insurance.

Go to market and seek quotes

There are a number of things that can be done to reduce your premium.

Firstly, go to market and seek quotes.

For duplex’s direct insurers are often the best insurers to approach.

The next thing is to check your building sum insured. Some insurers will increase the sum insured by 5% each year even in years where the actual increase is much less.

This can have the impact of inflating the sum insured above what is required. In QLD it is a requirement that an insurance rebuild valuation is conducted every five years – an opinion by a valuer may recommend a reduction in your sum insured which will reduce premiums.

Lastly, you can consider increasing your excesses as a way of reducing premiums.

We are currently experiencing a hardening market which means premiums are increasing, but the above three measures should be considered as options for reducing premiums.

Who Replaces Downlights in My Lot? Is it my responsibility to replace a downlight in my lot ceiling or is this a Body Corporate responsibility, i.e. common property?

I live in a relatively new high rise apartment complex in Queensland. The apartment is fitted with downlights installed in the ceiling. Is the replacement of a blown light my responsibility or is this ceiling light a Body Corporate responsibility, i.e. common property?

I ask this question because if individual owners start replacing these lights, the building will have no common light setting and will end up like a Christmas tree.

Owners are entitled to have lights at a brightness level that suits them.

Light bulbs within the unit are the lot owners responsibility. I have never heard of a consideration for having a common light setting and such a thing would likely not be possible. Owners are entitled to have lights at a brightness level that suits them.

Do I have to pay to fix my neighbours noisy floors?

Q

My upstairs neighbour installed tiles without soundproofing. To fix the noise issue, he wants me to contribute to the cost of laying carpet. Is this legal?

The owner of the unit above has had tiles laid without soundproofing. We have complained about the noise. In response to our complaints about the noise, he has arranged a quote to put carpet down.

In compensation for the laying of the carpet, the neighbour wanted me to pay him $4000.

He has now reduced this amount to $3000 and he would like $2000 in advance before he goes ahead and orders the carpet!

Can he do this to me? Is it legal?

Should I be paying him for work to be carried out in his unit to fix a problem he created?

There is a statutory obligation not to use your lot or common property in a way that interferes unreasonably with the use and enjoyment of others. It would appear that the complaints about noise may have merit – otherwise why would the upstairs owner do something about it?

If that is the case the upstairs owner is obliged to do something. That may involve changing their floor coverings to address the issue, and if so, the downstairs owner should not have to contribute to that.

Our Body Corporate manager advised they should attend meetings as only their minutes will be accepted by the Commissioner’s Office in event of a dispute.

Is this correct?

Our Queensland property is a Building Format Plan and we come under the Accommodation Module. Our Body Corporate Managers have advised that they should attend our Body Corporate meetings and prepare the Minutes.

Of course, this would be at a cost.

They have advised us that the Commissioner’s Office will not accept Minutes that are not prepared by a Strata Management Company in the event of a dispute. This information implies that any Minutes our BC Secretary prepares are not valid. Is this correct?

That being said, the Commissioner’s Office does not need to review or approve minutes, but if a meeting is ever challenged, the minutes will be scrutinised.

Sharing Committee Information

Is a committee member permitted to share financials with another lot owner as published to the committee by the strata manager?

Is a committee member permitted to share financials with another lot owner as published to the committee by the strata manager – eg. the quarterly income and expenditure statement for admin and sinking accounts and the general ledger.

Are they regarded as private documents, available only to the committee?

In some circumstances, it may not be in the Body Corporate’s interests for the information to be shared Under section 231 of the Standard Module, a body corporate is obliged to keep certain records, including accounting records and statements of account for each financial year.

Likewise ‘associated committee meeting material’ must be retained. That associated material includes notice of meetings, including agendas and attachments (such as financial statements).

Under section 233 of the Standard Module, a lot owner can access the records of the body corporate by completing and lodging the required BCCM Form 12, with the Body Corporate (where the body corporate is managed, care of the body corporate manager) and paying the required fee.

Access is via inspection or delivery of copies.

There is no (direct) injunction upon a member of the committee providing body corporate records to a lot owner, but committee members should ensure that in doing so they do not breach their obligations under the Code of Conduct in Schedule 1A to the Act. In some circumstances it may not be in the Body Corporate’s interests for the information to be shared, for example until after the relevant committee meeting is conducted.

Committee members are not permitted to disclose information held by the body corporate, including information about an owner of a lot, where that would be unfair or unreasonable (unless required by law to make the disclosure).

Can a By-Law Contradict the Statutory Obligations of Bodies Corporate?

A

The simple answer is ‘no’.

We understand the reader’s question can be summarised as follows: • The reader’s Scheme has some lots which are registered under a Building Format Plan of subdivision (BFPs) and some lots registered under a Standard Format Plan of subdivision (SFPs).

• A by-law within the Scheme’s Community Management Statement (CMS) provides that an owner is responsible for the maintenance and decoration of their lot. We presume that this by-law purports to apply to the BFPs, or silent on its application to BFPs and/or SFPs. • Does this by-law contradict the statutory obligations of bodies corporate insofar as BFPs are concerned?

The simple answer is ‘no’.

This by-law appears to be intended to reflect section 211(3) of the Standard Module / 201(3) of the Accommodation Module, which relevantly states: “The owner of a lot included in the scheme must maintain the lot in good condition.”

However, in our respectful opinion, the wording of the quoted by-law is vague and ambiguous as to its scope and application. Accordingly, there would no doubt be several different interpretations of this by-law which might be formed by different owners and the Committee.

Our complex has two plan formats, building and standard. The CMS states “maintenance and decoration of the lot is the owners responsibility”.

Does this override the Building Format rules?

In our view, given the ambiguity of the by-law, whether the by-law contradicts the statutory obligations of bodies corporate (insofar as BFPs are concerned) will come down to how the by-law is interpreted and implemented by the Body Corporate.

In our opinion: 1. T he by-law must be read in conjunction with the Body Corporate and Community Management Act Qld 1997 (the Act) and the relevant regulation module; and

2. As long as the interpretation being implemented is consistent with the Act and Module’s position on the maintenance and decoration in BFPs, the by-law would likely be valid and enforceable.

3. However, if the interpretation being implemented attempted to place maintenance obligations on owners of BFPs which are inconsistent with the Act or Module, then the by-law would be invalid insofar as the inconsistency extends (pursuant to section 180(1) of the Act).

We provide a further explanation as follows: Valid interpretation of the by-law: By way of example, where an owner has failed to maintain the tiles within their lot, the Body Corporate could validly enforce the by-law to require the owner to undertake such maintenance, as floor coverings fall within the owner’s maintenance responsibility pursuant to section 211(3) of the Standard Module.

Invalid interpretation of the by-law: By way of example, where balcony balustrades in a BFP lot require maintenance, those works will likely fall within the Body Corporate’s responsibility (pursuant to section 180(2)(a)(i) of the Standard Module). If the Body Corporate attempted to enforce the quoted by-law to require the owner to undertake those balustrade works, there would be a good argument that the implementation of the by-law is invalid pursuant to section 180(1) of the Act, because it conflicts with section 180(2)(a)(i) of the Standard Module.

To summarise, the quoted by-law cannot override the statutory obligations of lots created under BFPs. The quoted by-law is, in our respectful opinion, vague and ambiguous and in turn, depending on the individual circumstances of its application, could be both validly and invalidly applied.

Generating an Income From Common Property

Can a body corporate sell advertising space on a wall facing a busy road?

I am not questioning if it’s possible with council etc, but more is the body corporate restricted from generating any income?

The Body Corporate may grant a lease or licence over an area of its common property.

William Marquand Yes, the Body Corporate can generate income by leasing space for advertising or other purposes such as housing telecommunications equipment.

There will be a number of factors to consider in any such agreement including: • The area to be used.

Alanna Hill The Body Corporate may grant a lease or licence over an area of its common property (see s.184(1)(a) of the Body Corporate and Community Management (Standard Module) Regulation 2020 (‘Regulation’)).

The Regulation does not prevent the Body Corporate from including a term which requires the payment of a fee in exchange for the lease or licence. The lease or licence must be approved by the Body Corporate, with the resolution required dependent on the length of the lease or licence (see s.184(2) of the Regulation). We recommend that the Body Corporate obtain legal advice before granting a lease or licence to ensure that adequate terms are included to protect the Body Corporate’s interests.

Please note that the Body Corporate is prohibited from carrying on a business (s.96(1) of the Body Corporate and Community Management Act 1997 (‘Act’)). While we are not aware of any cases which indicate that a lease or licence granted for profit to an external entity would contravene s.96(1) of the Act, it is possible that an owner may challenge the lease or licence in the Office of the Commissioner for Body Corporate and Community Management if it believed that s.96(1) of the Act is being contravened.

• How that area is to be maintained.

• Length of lease.

As such, a legal representative will probably be required to advise on the process and any proposal will need to be voted on by the body corporate. A by-law may be required to confirm the use of the space.

You will also need to consider any accounting implications and may need to review how the income is managed with your accountant.

Lodging Applications for Conciliation Attempting Resolution Q

What process should the committee follow when responding to an application for conciliation?

We received two similar questions that have been combined into this one article.

Question 1: At a recent BCC meeting the committee by a vote of 4 for and 1 against approved an application for installation of pavers and additional stormwater drainage to drain into the original stormwater drainage.

The committee member who voted against will not accept the majority vote and has now registered a conciliation application against the committee with the Office of the Commissioner for the BCCM for the decision to be overturned. The applicant is nominated as a committee member and the respondent as the committee.

The BCCM provides for either a lot owner with 50% of the body corporate or the affected lot owner can make an application in writing to the body corporate secretary to challenge the decision made by the committee.

The committee believes this is the process that must be followed before any conciliation application can be made.

Are we correct in our understanding of the process and if so can we have the application rejected?

Question 2: The committee has received a conciliation application with the secretary as the applicant wanting a decision reversed from a previous BCC meeting.

In the application, the secretary admits secretly recording the meeting and quotes from that recording.

Should the Committee notify the Commissioner and request the application be refused? Can we take legal action because of recording secretly and quoting in the application?

Let’s go back a few steps.

When someone lodges an application for conciliation, the onus rests on them to ensure their application is legislatively compliant, and the Commissioner and her delegates have the decision-making power as to whether to accept an application (i.e., it is compliant) or reject it (i.e., because it hasn’t met all requirements).

You can request the Commissioner reject the application and you’d need to state your reasons. If the Commissioner declines your request and accepts the application, then your next decision is whether you would participate

in the conciliation session. Participation is voluntary and it seems from the tone of your emails that you would rather not participate.

I would urge you to look at conciliation as an opportunity rather than something to resist and find reasons to have rejected.

Conciliation has a proven track record in getting workable agreements for parties which then enable them to get on with their affairs. It’s also an opportunity to learn, as a conciliator also has a role to provide information to parties.

In relation to your specific queries: • An applicant must attempt to resolve things themselves prior to lodging an application. The ‘50%’ process you describe can be seen as a reasonable attempt to self-resolve, but it’s certainly not the only way a dispute gets resolved and the Commissioner may decide that the applicant has already demonstrated other, reasonable attempts to resolve the matter.

• The fact that the meeting was recorded without your knowledge, seemingly, is not of itself reason to reject the application.

You can absolutely raise that as an issue if you wish. In relation to taking legal action about the recording, you’d need to obtain qualified legal advice.

Insurance Commissions Are they legal?

Q

Are strata insurance commissions legal and why does the strata manager charge these?

Our building insurance premium recently went up by more than 10%. I have found out that strata managers get a commission on strata insurance. Is this even legal considering our already exorbitant Strata Management fees?

We also pay for security of $48 per annum to a friend of the manager who lives in the building rent-free and it has been suggested that he is not a bona fide security company.

Commissions are legal, and most body corporate companies will collect a commission for placing your insurance and assisting with claims.

There are quite a few issues to unpack in this question so we’ll review one by one.

Firstly, rises in insurance premiums continue to be seen for strata properties nationwide.

Most brokers include standard explanations as to why these changes are happening in their renewal packages and you should check to see if yours has one.

The explanations typically cite a number of factors including: • Fewer specialty insurers in the strata market.

• Risk aversion among strata insurers.

• A move away from a ‘soft market’ where insurers are prepared to accept losses close to the total of premiums collected to a ‘hard market’ where a greater margin is sought.

• An increase in environmental factors impacting property losses.

As a result, it is currently common to see increases of 10 per cent, and if a building has a history of multiple claims 20 per cent or more is within the standard range of expectation.

On top of the industry increases you also need to consider any specific conditions related to your building and see if these have contributed to the premium rise. Again, your renewal documents should have some explanation of this.

If you want to look at controlling the premium you can look at undertaking repairs to the building to limit risks, completing safety reports, making sure your valuation is up to date and staying up to date with your sinking fund report. This is something to speak to your body corporate manager and Committee about.

Commissions are legal, and most body corporate companies will collect a commission

for placing your insurance and assisting with claims. The total of the commission should be disclosed to you during the renewal process, but if it is not clear you are more than entitled to ask what it is.

Different companies will explain the commission in different ways, but broadly they subsidise the time it takes body corporate companies to arrange renewals and process claims on behalf of their clients.

Most body corporate customers won’t be aware of the vast amount of time and energy that goes into this area and to execute the work properly requires consistent diligence.

If you are unhappy with your managers receiving this commission then OK, but you also need to ask how that work is going to be paid for and who is going to do it if there is no commission. It may be preferable to have the commission system replaced with payment by an hourly rate for the work done and this seems like a probable change coming to the industry, but while it may shift costs around between body corporate schemes it is not necessarily the case that it will lower total costs for placing insurance across the industry.

It is also possible for body corporates to arrange their own insurance without the assistance of their manager. Some do this and are happy with the result, although you need to be cautious of any savings reported as these are often achieved by valuing the time the committee puts into the renewal and claims as zero as they generally don’t get paid.

It is difficult to comment on the issue you mention about the security without more information but you are certainly entitled to ask about the qualifications and insurances of anyone doing the work and could arrange an inspection of the books and records to review these.

Q

The Body Corporate wants to install intercom systems in all units. I don’t want an intercom system in my unit.

Can I refuse?

A

If an owner doesn’t want an intercom handset in their lot they are not obliged to connect it.

The body corporate could pass the appropriate resolutions and budget to install a system, the handsets in the units are the responsibility of the owners, so if an owner didn’t want one then he just doesn’t connect to it. If a future owner did, he could purchase the handset and have it connected into the utility infrastructure of the intercom system.

If your preference is to not have an intercom, then the Committee may wish to split the General Meeting motion installation into 2 components:

a. B ody Corporate install the base unit at the building entrance and all wiring,

b. e ach Lot owner is then responsible for the cost of supply and installation of the handset within the unit.

This would ensure the proposal goes ahead but isolates any owner who does not want an intercom.
