Long term neglect of defects can render a building uninsurable Our building has had defects and water ingress issues for years. Due to ongoing neglect of the issues, our insurance company did not renew the insurance and it has lapsed. What do we do now? I am an owner of one of 40 units in an 8 story building in Parramatta. The building has had defects and water ingress issues for years. Due to ongoing neglect of the issues, our insurance company did not renew the insurance and it has lapsed. Our Strata Management Company resigned due to our insurance situation, but luckily they are still working tirelessly behind the scenes on insurance and trying to assist. Do you have any suggestions regarding insurance or what else the strata committee should also be doing?
Insurers are more favourable to buildings that demonstrate a proactive approach to dealing with building issues. Since the Miami building collapse in 2021, which has a legal settlement of $997m, insurers have become more wary of covering buildings guidelines are becoming more stringent for defects. We recommend an owners corporation takes reasonable action to address defects when they arise. The duty of disclosure applies when the policy is taken out, renewed or altered and for this reason, if you are undertaking a defects report and have no grounds for doing so from a safety or damage perspective, we recommend such reports are commissioned in the months after the policy has been renewed as opposed to the months prior.

For decades the brutalist apartment block at 20 Illawong Avenue, Tamarama, was known as the ugly duckling of the east. Occupying one of the most sought-after pieces of land in Sydney, the 7 story, 1960’s apartment block had seen better days.

For starters, the building had concrete cancer and there were two council fire orders. There was only one lift to service 78 units and parking for only 50 cars (none of which were under cover), and despite every apartment having 180-degree ocean views, there were no balconies. Today the building has been completely transformed with the one-time ugly duckling now looking more like a contemporary 5-star hotel overlooking one of Sydney’s most iconic beaches.
Due to efforts of the forwardthinking executive committee led by persistent chairman Christine Smetsers, the owners have not only fixed the defects but improved the property enormously by putting balconies on the ocean side for all 78 units; replacing the existing lift and adding a second lift; building an underground carpark for all units; and adding terraces on the western side of the property.

A strata loan is an unsecured loan to the owner corporation. The funds can be used for strata improvement projects like refurbishment, renovations, defects, green projects and repairs. This allows owners to complete capital works on their buildings, often without the need to raise special levies.
And this was all achieved with minimal upfront costs being incurred by the owners. So how did they do it? Strata finance is gaining momentum in Sydney’s east as owners corporations look to fix defects and undertake aesthetic improvements to aging buildings.

Can the OC be fined for not enforcing the collection of levies?
Due to a lack of management, our OC has neglected to collect enforcing strata fees? The owners corporation did not renew our strata management contract due to the cost of the service. This has caused us to fall behind in our levy collections and therefore, our capital works funds. Can the OC be levies? To catch up, each owner needs to pay over $2000. It’s not clear if you have had any kind of interaction or conversation with your neighbour. If not, then that course, to that being safe and appropriate to do so). WHAT BY-LAWS SHOULD EVERY STRATA SCHEME HAVE?
We are now around 4 years into the “new” Strata Schemes Management Act (SSMA), and there have been other legal changes in that period, for example with pets and short-term letting. Below is a list of by-laws that most or all schemes should consider having, outside the usual statutory ones included in the Regulations.

Developers should consider including these in their original by-laws registered with the strata plan, as their inclusion usually makes the scheme easier to manage. Strata specialist lawyers who carry out back-end strata work on behalf of strata managers are therefore usually better placed to prepare the original developer by-laws than a property-only lawyer.

Cost recovery Most owners corporations value a by-law allowing them to recover costs resulting from false fire alarms, dumping rubbish, damage to common property and Annual Fire Safety re-inspections (apartment not available when inspector comes). By-laws operate as a contract signed between owners, occupiers and the owners corporation. There have been challenges to this type of by-law in NCAT and the Appeal Panel, but no successful ones yet. Until invalidated, such a by-law can be relied on to recover these costs in the Local Court.

With the ever-increasing popularity of Uber Eats, Menulog and other food delivery services, common issues arise such as food left in the lobby unclaimed and unidentified visitors in security common areas. A food delivery by-law can regulate who can be allowed in, where the driver can be met, and whether and where food can be left in common areas.
Pets The Jo Cooper vs The Horizon Building case, where Ms Cooper successfully challenged a “no pets” by-law (in the Court of Appeal), has resulted in the creation of section 137B in the SSMA. The new position is that pets cannot be banned unless the pet “unreasonably interferes with another occupant’s use and enjoyment of the occupant’s lot or the common property”. Any schemes with the standard pet by-law (pets need approval but it cannot be unreasonably refused) can stay with that by-law if they wish, but any no pet by-laws are no longer enforceable, so those schemes must update this by-law. Other schemes may decide this is a good time to make a longer-term decision on pets in their scheme.

Short-term letting Various anti short-term letting by-laws had been prepared a few years ago, in response to some controversial Tribunal decisions that owners corporations cannot ban short-term letting. Section 137B of the SSMA has now clarified the position, so that owners corporation can ban short-term letting, but only by non-resident owners. If an occupant (owner or tenant) wishes to rent out a spare bedroom for shortterm letting while they are living there, no by-law can stop this.

Vehicle charging stations With the current and anticipated future surge in electronic vehicles, a bylaw permitting owners to install a charging station at their lot’s car space will be attractive and will save individual costs. Including such a by-law in the original developer by-laws may also make the building more appealing to prospective purchasers.
Generic bathroom renovation by-law For any building that is more than 10 years old, a by-law allowing all owners to renovate their bathroom – on certain obvious conditions like providing waterproofing certification – is preferable to requiring each owner to pay the cost of preparing their own by-law, holding a new meeting and having the by-law registered.
Major renovations with short-form by-law Whilst major works need their own separate approval and by-law, it makes sense to have one main by-law setting out the terms applying to all major works, and then a small one-page short-form by-law at the back. This makes the process of applying for approval and preparing and registering a bylaw much faster and cheaper. Once the main by-law is passed, the owner simply needs to sign a consent form and fill in the “short form” one-pager at the back of the main by-law, with details such as the lot number, the scope of works and any plans or reports that are needed.
Common Property Memorandum Most owners corporations value a by-law allowing them to recover costs resulting from false fire alarms, dumping rubbish, damage to common property and Annual Fire Safety re-inspections (apartment not available when inspector comes). However, it is important to keep the “by-law buster” in mind, which is the provision in every council’s Local Environmental Plan that says if someone gets a DA for short-term letting, it will override any by-law banning it. A developer may not be sure whether purchasers will be for or against short-term letting in their building, but existing buildings (especially near the city or a beach) need to consider this.

Parking This is a chronic problem in many buildings, with occupants taking up visitor spots. Towing has been made harder by removing it from the strata legislation, but wheel-clamping remains an option. Also helpful is defining what visitor parking is (eg how long can they stay) and the power to install bollards as well as signs warning against illegal parking and showing the consequences.
Minor reno by-law giving the committee power to approve Section 110 of the SSMA and clause 28 of the Regulations set out what work is a minor renovation and s110 allows minor renovations with only an ordinary resolution and no by-law.

Old cables in old buildings
We have old cabling in our 1930s How can I get this actioned? I live in an Art Deco building built in the 1930s. There are 5 units in the Building that have had rewired done in the ceilings. The committee is sitting on the decisions to carry out the rewiring n the remaining 7 units. I ensure the repairs are completed as soon as possible?

In our business, the way we combat that is by a strict policy around levy arrears.

Admin fee charges for serving a bylaw breach notice
Can our strata managers charge lot owners an administration fee for serving a bylaw breach notice? I’ve received a by-law breach notice from the strata manager along with an invoice for an admin fee for the investigation of the bylaw breach. The breach was for a noise complaint from our downstairs neighbours. There are signs in our common areas stating that a breach of a bylaw will result in a breach notice accompanied by an admin fee of between $110 and $220 for breaches like: parking in visitors parking for more than 8 hours disposing of unwanted household goods in the garbage room. taking glass containers into the pool area Can our strata managers charge us an administration fee for serving a bylaw breach notice?

No, the Owners Corporation or a Strata Managing Agent do not have the authority to breaches of bylaws. After working in strata for so many years I can certainly understand the inclination of Owners Corporations to by-laws, but no, the Owners Corporation or a Strata Managing Agent do not have the authority to do so. The Strata Schemes Management Act 2015 by-laws are to
be enforced and the process that the Owners Corporation can take. Under the Strata Schemes Management Act 2015, NSW Civil and Administrative Tribunal (NCAT) is the only body that has the authority to take place when due process is followed by the Owners Corporation.
A lot owner can be asked to reimburse the Owners incurred (e.g. false alarm fees from NSW Fire & Rescue) but

DO YOU KNOW THE DIFFERENCE BETWEEN A STRATA MANAGER, BUILDING MANAGER AND PROPERTY MANAGER? Everything runs smoothly with the help of a strata manager A Strata Manager is given the most authority and unlike the others, they have the power to enforce the by-laws. Their job is to keep everything running smoothly in your strata and ensure that the owners corporation fulfills all its legal obligations, including: • Coordination of AGMs and committee meetings • preparing the budget and sending out levies to owners • paying invoices and insurance. An owner’s primary point of contact is often the Strata Manager. Managing common property is the job of a Building Manager A Building Manager looks after the common property, such as: • keeping lawns and gardens maintained • doing minor repairs or organising them • managing general safety around the complex, including fire safety, and sometimes doing condition reports. A Building Manager is generally the primary contact for contractors working on-site. Property Managers look after landlords and tenants A Property Manager is responsible for managing a rental lease on behalf of a landlord, such as organizing inspections, move-outs, bonds, and evictions. Any strata issues raised by the tenant will be addressed by the Property Manager with the Strata Manager or owner. A tenant typically has no direct dealings with the Strata Manager, who only represents the owners. Property Managers are the primary contact for a tenant.
NSW’S SHARED EQUITY SCHEME AIMED AT GETTING AUSTRALIANS ONTO THE PROPERTY LADDER The New South Wales state government is launching a shared equity trial scheme to make home ownership more achievable for single parents, older singles and key worker first home buyers. The NSW Government will pay a proportion of the purchase price of a property in exchange for an equivalent ownership share of the property. It has committed $780.40 million in equity contributions to help Australians get a foot on the property ladder. The NSW Government equity contribution is up to 40 per cent of the purchase price of a new dwelling and up to 30 per cent of the purchase price of an existing dwelling. The scheme is a similar proposition to the Albanese government’s pre-election promise of the Help-to-Buy program. The shared equity scheme is open to a single parent of a child or children under 18 years of age, a single person 50 years of age or above, or first home buyer key workers who are nurses, teachers or police. Eligible Australians may be able to purchase new or existing dwellings with a deposit as little as 2% and avoid paying costly Lender’s Mortgage Insurance (LMI). Applicants must demonstrate they cannot service a mortgage without the shared equity scheme but are still able to service the mortgage for the life of the loan.

The gross income of the household must be no more than $90,000 for singles and $120,000 for couples. The participant must be buying a home with a property price less than $950,000 in Sydney and major regional centres or less than $600,000 in other regional areas. To deter speculative investors, applicants must occupy the property as the principal place of residence, and as a tenant they will be responsible for the payment of ongoing property ownership costs like council rates. Each year following the property purchase, scheme participants will be required to complete an annual review and provide supporting information to ensure their continued eligibility for the shared equity scheme. For those considering participating in the scheme, it’s important to remember that taking out a home loan with a smaller deposit always carries a level of risk. If paying the deposit involves contributing all available savings, especially as a lower-income earner, this can lead to significant financial stress when inevitable events occur, and interest rates rise. However, repaying a smaller loan does generally mean smaller, more manageable mortgage repayments. The scheme is set to begin in January 2023 and will accept 3,000 applications per financial year over FY 2022-23 and FY 2023-24.
