If a lot owner mows the council property outside the strata property for free and someone gets injured, can the strata get sued?

The injured person would have to demonstrate the owners corporation were negligent or otherwise legally responsible for the injury.

Liability claims are considered on a case by case scenario by insurers, solicitors and judges (if the claim ends up in court). Claims are never black and white and legal liability will vary based on the circumstances.

While Strata Insurance Solutions does not give advice on legal issues, the injured person would have to demonstrate the owners corporation were negligent or otherwise legally responsible for the injury. In the instance where

the owners corporation are not responsible for the mowing and the injury does not happen as a result of their ownership of common property, I would find it difficult for the owners corporation to be held legally responsible.

The person conducting the mowing, however, may have a greater exposure to liabilities.

The owners corporation should have public liability insurance which is designed to cover legal liability claims that may arise from such instances and likewise the person doing the mowing may want to check with their contents insurer as to whether the public liability section under the contents policy would extend to provide cover.

Lot owner paying for urgent repairs to common property

The front balcony timber steps and rails are in urgent need of repair. For this to be done quickly, I’m happy to organise and pay for repairs, but the OC is insisting a bylaw is created for exclusive use of the area.

Is a bylaw really required?

The front balcony timber steps and rails are in urgent need of repair. I know that this is understood to be common property. I have offered to have this work done at my own cost and not seek reimbursement from the owners corporation.

A builder has given me a quote and a scope of work for the repairs. The builder has classified the work as repairs, which is old for new. The strata management company is saying that I am wanting exclusive rights over the common property (which I am not) and must have a special by-law registered and added to the existing by-laws.

All I am wanting is the urgent repairs carried out as soon as possible, all at my own cost.

Is a by-law really required?

If you wish to pay to repair the common property, I agree that a by-law is not required, however, there may be another way.

You appear to be on the right track.

Although your question relates to the payment of the repair work I will comment briefly on the owners corporation’s obligations in relation to the repair work as it would appear that the owners corporation is not functioning as it should under the Strata Schemes Management Act 2015.

It is good that you have identified the timber steps and rails as common property. This is an important preliminary step and you should double check you are correct in relation to this.

You should review the registered strata plan and the registered by-laws and clarify if the stairs are the original stairs which were in place when the strata plan was registered.

You mention that there is an urgent need to repair the stairs. If there is a safety risk, you should ensure that the strata committee and the strata manager are aware of this risk by giving notice in writing, explaining the nature of the risk and including photographs to substantiate your concerns.

The owners corporation has a strict obligation to maintain the common property pursuant to section 106 of the Strata Schemes Management Act 2015. From your email, it appears the strata manager is aware that the stairs are in need of repair. If this is the case, the owners corporation is likely in breach of section 106.

Assuming it is clear that repair work is required and you have correspondence to prove the owners corporation is not attending to the repairs, you appear to have a strong case to compel the owners corporation to undertake the necessary repair work. You may compel the owners corporation to undertake the work by making an application in the NSW Civil and Administrative Tribunal. However, before you make your application in the Tribunal, you must attempt mediation through NSW Fair Trading. There is a link on the NSW Fair Trading website to initiate a mediation.

If you agree to pay for the work, you should take care to properly understand the terms of the contract and the scope of work to be sure you are aware of how much the total cost of the work could amount to. Even a fixed price contract is susceptible to price increases and you do not want to be caught out having to pay substantially more than what you originally contemplated.

You should obtain advice from a solicitor prior to making an application in the Tribunal, signing a contract or entering into an agreement to pay for the work.

If the cost to repair the stairs is substantial, and an agreement cannot be reached at mediation, instead of paying for the work yourself it may be more cost effective for you to make an application in the Tribunal.

Returning to your original question, should you still wish to pay to repair the common property, I agree that a by-law is not required. As you have indicated, you do not seek to undertake the work. You want the owners corporation to undertake the work pursuant to its statutory obligations and you are simply offering to pay for the work. The contract for the work will be between the owners corporation and the builder. The builder may render its invoices to the owners corporation for you to reimburse the owners corporation, or the builder may render the invoice directly to you, in which case you will pay the builder directly. Such an agreement is able to be approved by the 7

When we requested that Strata Management provide documents that were missing (and within the 7-year period) from the request, they informed us that they didn’t have them on record.

These requested documents include quotes for repairs, invoices relating to repairs, profit and loss or income and expenditure for each financial year, insurance claims made and accepted or rejected, balance sheets for each FY and so on.

If all requested documents are not supplied, it does not necessarily mean the strata manager is withholding documents.

We search strata records every day and we often find problems with the quality or completeness of the records. This issue often arises following a change in strata manager.

When this occurs, the records are required to be transferred to the new manager. However, in many cases the records are transferred as a dump of files with no file names to indicate what they are. The new strata manager then needs to search through these files to find old records. Often this process means only a portion of the past records make it into the new manager’s records keeping system.

The missing documents you have listed seem to be “core” documents, like financial statements. Depending on the age of these documents, we would expect these to be available in normal circumstances. In some cases, like legal action, some documents are held separately for legal privilege reasons.

I hope this helps to explain that this is a problem that occurs too often. It does not mean the strata manager is withholding documents.

The minutes of the AGM will be considered for approval at the next general meeting, whether the next AGM or any intervening general meeting.

It is a statutory requirement that the notice of every general meeting include a form of motion to confirm the minutes of the last general meeting of any kind – this therefore includes the AGM minutes. In your scenario, the minutes of the AGM will be considered for approval at the next general meeting whether the next AGM or any intervening general meeting.

In terms of raising your levies by 65%, if a motion is included to this effect, an explanatory note could explain the background and intention. Your strata manager might include at the end of the minutes a section entitled “discussions/matters arising” and include a mention there. Minutes of meetings do not usually include discussions/negotiations, but merely make record of the decisions made.

Do we need approval to change the lock on a fire door? This door is the main door to our apartment.

What lock can we use?

We have been told the door to our apartment is a fire door and part of the common property.

We have a master key system.

Can I change the lock on the door? As the door will not longer be opened by the master key, do I need approval to change the lock? What lock can I use so the door is still fire safe?

If you wish to modify the fire door in any way, you must get permission from strata. That includes changing the lock.

The Residential Tenancies Act/ Regulation provides the right for lot owners to secure their own premises, but that conflicts with fire door standards. In simple terms, your door is owned by strata, not by you. Therefore, if you wish to modify it in any way, you must get permission from strata and that includes changing the lock.

What can you use? The lock has to be one that is approved for use with that fire door.

You really need to go back to the door manufacturer to find out what locks have been approved for use on that door or on that tested example. So when doors are originally put to market they are type tested. So the tested doorset is essentially one version of that with specific locks and closers and all the things that might be attached to a door are put on and then it’s fired up in a furnace and burnt to see whether it will work in a fire. So this means the lock that you put on, even if it’s approved for A fire door, must match the door type and model you have installed. I know that the Lockwood 001 and 003 series are pretty much approved on every single door set that I’ve ever seen, but you really need to check first.

Changing unit entitlements for lots in a strata scheme

In NSW, the NCAT has power to make an order to do so. Our article: What Are The Principles Applied By The Tribunal In The Re-Allocation Of Unit Entitlements? sets out the principles applied by NCAT. If a lot owner or the owners corporation wants to make an application to NCAT for an order for unit entitlements, before doing so the steps (briefly) are: 1. Obtain a valuation from a registered valuer of all the lots based on market value (note different valuation dates may apply) and a prepare a revised schedule of unit entitlements based on their findings; 2. Consider if there are grounds to request an order that the original owner pay damages for differences in unit entitlements if orders are made to change them; 3. If the owners corporation is making the application then it obviously needs to pass the resolutions to engage the valuer and to support the NCAT application; 4. If a lot owner is making the application we recommend that they provide the valuation to the owners corporation with resolutions that the owners corporation make the NCAT application for orders; 5. Make the application. Note mediation is not required for these orders; 6. If NCAT makes the orders the owners corporation needs to register the orders with the NSW Land Registry Service.

Section 236 of the Strata Schemes Management Act 2015 applies.

In NSW, what is the process for changing the unit entitlements for lots in a strata scheme?

Does the decision require a majority vote for any change to be approved?

The NCAT has power to make an order to change unit entitlements.

If however you have a scheme that was the subject of a strata development contract then a revised schedule of unit entitlements based on market values of the lots can be lodged by the owners corporation with the NSW Land Registry Service up to two years after the completion of the development. Section 90 of the Strata Schemes Development Act 2015 covers this scenario.

There has been a lot of discussion about record increases in the price of real estate over the last 12 months but there is a more pressing issue that strata owners need to be aware of – the rising cost of construction works.

A combination of booming demand, labour shortage, material shortages and supply chain disruptions are creating the perfect storm for increased construction costs.

According to CoreLogic’s Research Director Tim Lawless, the heightened construction activity and rising costs experienced across Australia won’t be going away soon and will likely cause affordability challenges for owners across the country.

“The quarterly rate of growth in construction costs is happening everywhere and is not restricted to one city or state, it’s a national trend,” he said.

“This construction cost inflation could continue for another 12 to 18 months.

It’s unlikely the industry can absorb a cost increase this significant into their margins and higher construction costs will ultimately be passed on to the consumer, placing further upwards pressure on the price of a new dwelling or renovation.”

Already we’ve seen just how much pressure is being placed on the construction industry, with Probuild and Condev both going into liquidation in recent weeks.

In short, costs are going up and the construction industry is buckling under the pressure.

The more you delay, the more you will pay.

Owners corporations who choose to delay any rectification, maintenance or uplift work on their property may be setting themselves up for a shock later on.

Do you have a strata project that is needing finance?

Regarding funding of any works, the corporation always has three options: to accumulate a Maintenance Fund over time, to have a Special Levy or to Borrow (or a combination of these three methods).

It takes time to accumulate moneys in a Maintenance Fund.

Special Levies should be a quick solution but will be delayed if there are owners who find the cash flow impost too large.

A strata loan is immediate, unsecured and does not involve a mortgage, personal financials or guarantees.

What’s the right decision?

As with any big decision, it’s important to be informed. If your clients are looking at rectifying defects or considering maintenance or renewal/uplift projects over the next few years, it will be important to discuss with them the implications should they choose to delay the works.

I’ve requested they be served with a breach but the strata manager is reluctant to do this.

The items include a large box, a mat and multiple pairs of shoes.

I have advised strata about this on multiple occasions.

I recently requested a breach notice be issued to the owner for breaching the common property by-law.

myself and an owner who is a friend of the owner who is breaching strata laws. What can I do?

Request the motion be included on the next General Meeting of the Owners Corporation so a decision can be made by all owners present.

Items should not be stored on common property without approval of the Owners Corporation. As you mention, this is very likely a breach of the by-laws for your strata scheme. The difficulty is that often a strata manager will require that a majority of the Committee support action in regards to breach processes as although they likely have delegated authority to take this action, the next step in

the breach of by-law process will require that a formal Committee meeting be held to issue a Notice to Comply.

If there is not a majority of the Committee approving this course of action you cannot follow that route.

The options you have available are requesting that the motion be included on the next General Meeting of the Owners Corporation so a decision can be made by all owners present.

I would also have to suggest that this is potentially a risk in regards to the fire requirements which require that there is a clear path of egress.

Is there a guideline on how to complete an application for NCAT? How do we determine which sections need to be applied under? For an application dealing with a notice to comply, do we need to identify which sections have been breached?

You do need to identify the sections that have been breached, and you need to be able to prove the breach has occurred.

Even strata managers find that NCAT applications are sometimes tricky. You do need to identify the section. Both NCAT and Fair Trading have a helpline and should be able to assist.

Parking space renters served with increases

Our building manager has increased our parking space rent substantial with little notice.

Can they do this?

My building manager today has emailed everyone renting a car park space stating that rent will increase by $1 per day from the beginning of the month.

Can they legally do this under strata laws, and, how much notice should be given?

I currently already pay $3 per day for my parking space in Waterloo, Sydney.

To determine whether the announcement from the building manager is legal, one must look at the by-laws and terms of the lease.

Section 33 of the Strata Schemes Development Act allows an owners corporation can lease part of its common property by passing a special resolution.

When leasing common property, an owners corporation should always have a proper lease agreement in place (much like one would for leasing an apartment). The lease agreement stipulates the terms such as the rental amount and term, how the lease can be terminated, how rental increases work and so on.

Alternatively, the owners corporation may have a special by-law in place which stipulates the terms of the lease and the motion to approve the lease may refer to the terms of the special by-law as being the terms of the lease agreement.

If there is no lease, these terms are unknown (unless they were specified in the motion to enter the lease) and very difficult for either party to try and unravel. Legal advice would have to be sought as to what rights exist without a proper lease agreement.

To determine whether the announcement from the building manager is legal, one must look at the bylaws and terms of the lease – particularly looking at the terms of rental increases (e.g. how much notice must be given, how frequently rent can be increased and so on).

Bellevue Apartments needed an update, with remedial issues taking a toll on the building’s streamlined facade in recent years.

The apartment building had suffered from significant water damage for some time due to failing control joints in the exterior cladding, deteriorating sealants and incorrect paint choices.

So when the strata committee asked Higgins for a plan to restore and repaint the building, our team proposed a cost-effective repair and maintenance plan that would not only fix the damage but would also rejuvenate the exterior.

Higgins liaised with Bellevue’s strata committee and had them make a note of some colour schemes they liked. The team then recommended some colour options from which the committee could make their choice.

Our two-person team used swing stages to safely access the building’s facade, completing the repair and repaint project over five months and more than 900 hours.

Not only did the team clean and reseal gaps to fix the construction

faults that were affecting paintwork throughout the building, they removed excess Micaceous Iron Oxide (MIO) and applied a skim coat to ensure future paint coats would stand the test of time.

Two coats of paint were then applied to the building’s exterior panels, using Dulux AcraTex AcraShield, Metalshield and Weathershield paints, resulting in a modern new look.

Bellevue’s strata committee Secretary describes the experience of working with Higgins as “positive and professional”.

No one wants to be on the committee As an over 55s strata, our “pool” of likely contenders for interest in being a committee member is shrinking as lot owners age. We do have a good Strata Manager.

What happens in this situation?

Our NSW over 55s Strata is due to have its AGM next month. At this stage, none of the current committee members are willing to stand again. We have all been on the committee for many years now. It is looking highly unlikely that any other lot owners will be willing to go on the committee.

Our “pool” of likely contenders for interest in being a committee member is shrinking as the lot owners age. We do have a good Strata Manager. What happens in this situation?

The strata managing agent may be delegated the functions of the office-bearers.

Section 29 of the Strata Schemes Management Act, 2015 (NSW) provides:

29 Owners corporation to appoint strata committee 1. An owners corporation must appoint a strata committee of the owners corporation in accordance with this Act. 2. The owners corporation may appoint the strata committee before the first annual general meeting of the owners corporation.

3. The members of the strata committee must be elected at the first annual general meeting of the owners corporation whether or not members were appointed before that meeting.

4. If there is no strata committee of an owners corporation, the strata scheme must be administered by the owners corporation, but nothing in this subsection prevents a strata managing agent appointed under this Act from exercising any functions conferred on the agent.

So, in your situation, pursuant to sub-clause (4) the strata scheme is administered by the Owners Corporation and the strata managing agent may be delegated the functions of the office-bearers.

THE LIFE SAVING IMPORTANCE OF SMOKE ALARMS

The news lately has been filled with stories of tragic house fires. It’s astonishing that NSW residents are still experiencing fatal and often preventable events such as these.

At 16 years on from mandatory smoke alarm legislation being implemented, many of these tragedies are linked to non-working, or nonexistent smoke and fire alarm systems.

Recently in Sydney two people lost their lives in two separate apartment fires and not long after tragedy struck again when three people died, including a 10-year old boy, and another five were injured in a southwest Sydney blaze.

These stories should act as a cautionary tale to everyone on the importance of smoke alarms with Fire & Rescue NSW stating that, “the risk of a fatality in a home fire is halved if there is a working smoke alarm”.

The 2006 regulation requiring working smoke alarms in ALL properties was strengthened in 2020 with the Residential Tenancies Act. For strata and buildings generally, the EP&A Regulation has required building owners ‘maintain their essential fire safety measures’ since the early 2000’s.

Some owner-occupiers who may have not bought, sold or rented since 2006 with old alarms and without Annual Fire Safety Statements, may mistakenly believe the regulation does not apply

to them. But whether it’s in the letter or the spirit of the law, an inexpensive device that saves lives, and prevents injuries and damage, is unarguably vital for all residents, tenants and owner occupiers.

There is a less than a three minute window between ignition and complete combustion of a modern room. No one plans to have a fire, but everyone can plan to survive one. And working, correctly-positioned smoke alarms can be the difference between life and death.

There are thousands of residential properties across NSW that may be behind in maintenance or not have a working smoke alarm and these recent events should act as a wakeup call to property owners and managers.

As professional strata managers, mitigating risk by having working smoke alarms (and essential fire safety measures) maintained and checked annually, as per legislation, is essential for ensuring every resident is protected from the threat of a fire.

Good management of smoke alarms should also ensure they are under ten years old. Here’s a guide to provide more information on the lifespan of alarms.
