What is Voltin? The Voltin System is a world‑first digital building façade survey and assessment system.

WHAT CAN IT DO? Voltin combines imaging and position technology in an autonomous device to deliver a service that is more affordable, safer and accurate than existing systems in the market. The Voltin AutoBAT is an innovative building inspection system. The apartment building illustrated was inspected using this system. Significant defects were identified, then detailed in a report and digitally located on a series of 2D models. The digital report revealed all the flaws and a number of significant problems.

6 www.lookupstrata.com.au

Voltin assisted the Body Corporate to identify and diagnose the building façade problems.

How uncovering defects saves money

voltin.com.au

1800 VOLTIN

Visual data captured by the AutoBAT2.0 was fed into an artificially intelligent thirdparty defect detection software and photogrammetry modelling process to accurately identify the location of defects. The image capture process included both visual and thermal spectrums to provide a very effective comparative tool in the analysis. Often what is invisible to the naked eye is shown in stark relief as a thermal signature. For example, what looked like delaminating paint turned out to be a much more concerning problem. THE VALUE OF A DIGITAL REPORT Consider the benefits of having: •

A comprehensive summary of all building defects by type and severity

•

All defects identified, with close-up images magnified by a factor of 10

•

A downloadable report from a digital platform in PDF or CSV

•

An integrated defect list, segmented into a maintenance and repair schedule.

Find out how Voltin can help you save time and money. Visit voltin.com.au

THE INSPECTION OUTCOME A detailed digital report of all building defects by type and severity with the ability to zero in, compare and magnify the images by a factor of 10. A downloadable report from the digital platform into a PDF / CSV format with a defect list creating a maintenance and repair schedule. 7

Minor Defects Warranty

Does this expire 2 years after Settlement? We purchased our brand new apartment after the building’s minor defects warranty had expired. Or had it? For our new complex of 9 units, the units were purchased over a two and a half year period. We purchased our unit after the minor defects warranty had expired. Or had it? The unit is brand new. Since moving in, we have found defects we would like rectified by the builder or developer. Are they still liable?

The current statutory warranty period that applies is 6 years for major defects and 2 years for minor defects work from the date of completion of the works. Without having seen the relevant occupation certificate to determine the completion date, I am guided by the information provided.

8 www.lookupstrata.com.au

It appears that as it is a recent development, the current statutory warranty period that applies of 6 years for major defects and 2 years for minor defects work from the date of completion of the works. I note that any defective work in your unit should be brought to the attention of your strata manager on behalf of the Owners Corporation. Clause 6 in Schedule 1 of the Strata Schemes Management Act 2015 which requires that on the agenda for each annual general meeting defect items should be considered.

6 Required items of agenda for AGM Specifically it provides that “until the end of warranty periods for applicable statutory warranties under the Home Building Act 1989 for buildings of the strata scheme, an item to consider building defects and rectification.”

ENERGY MANAGEMENT

The future of energy in strata The energy landscape within strata title communities is often overlooked, difficult to navigate, and expensive. The conversation to define your Energy Strategy is more important now, than ever before. What is Energy Strategy in Strata? Energy Strategy for strata title communities (Strata) is the collaborative process of planning, executing, adapting, and managing energy infrastructure, investment, and compliance requirements for the future. Collaboration It is no secret that Strata can be slow and reactive when it comes to making decisions. With the multitude and variability of stakeholders, this is understandable; however, not reason enough to fail in meeting your Energy Strategy obligations.

The process of collaboration captures the broader economic, social, technological, environmental and compliance related issues and opportunities early and ensures all relevant stakeholders are involved and informed. The engagement of all relevant stakeholders ensures that with regular communication and review, planning can be adapted swiftly and effectively. Consider forming a subcommittee that can work through your Energy Strategy. Planning The first step in the planning process is to evaluate and define the current ’state of play’. This establishes the starting point from which to build your Energy Strategy, and asks questions surrounding how your Strata will report and evaluate performance and consideration on whether a private electricity network (Embedded Network / Microgrid) is required. Microgrid

Solar Panel

Inverter

Embedded Networks An Embedded Network is a cornerstone of energy management in Strata. It is a privately owned and operated electricity network at a site that has multiple customers and are frequently found in strata title communities. Many readers may have had negative experiences with these networks; however, when the Strata is in control there are a plethora of benefits. These include, greater visibility of consumption, utilising common areas for the benefit of all occupiers (by installing Solar Generation, Battery Storage and EV Charging), and a clear transition to a Microgrid. For more information on Embedded Networks, visit www.ENMSolutions.com.au.

Defining what you want to achieve by evaluating ‘non-essential’ upgrades, such as solar generation, battery storage, lighting and electric vehicle (EV) charging; and, ‘essential’ upgrades, including switchboard and wiring (for safety and amperage requirements), roofing membrane (for installing solar generation), and Heating, Ventilation, and Air-Conditioning (HVAC). The next step is when the challenge really takes shape, addressing the ‘how’ rather than just the ‘what’. Working backwards from what you want to achieve, by defining goals and setting stage gates, will help set your budget and allocate responsibilities. Failing to plan can lead to unexpected costs, safety and compliance issues, lost value, and profit that could have been invested. Executing and Adapting Having taken the time to ask the necessary questions you can comfortably and confidently begin to execute your Energy Strategy. Working with specialist partners ensures your vision is executed within a defined scope, keeping sight of the goals set by the Strata.

As technology progresses, regulations change and opportunities continue to be realised; adapting, and refining the Energy Strategy, to remain current and optimised, is crucial. Although a plan has been agreed, it must be made clear from the start that the plan could change, and you may need to adapt your strategy. Managing Owners, committee members, and other stakeholders can be transient and lose interest over time. Who will be managing the progress over the following weeks, months, and years? Are they an independent and qualified party, without a conflict of interest?

Case study – Energy Strategy in action In 2018, ENM Solutions was approached to conduct a business case and feasibility study to determine the suitability of an Embedded Network with solar generation for an apartment building in Queensland.

Built in the 1960’s, the building required significant upgrades to the wiring and electrical switchboards to improve power quality/amperage, and to comply with safety and compliance requirements. This triggered the replacement of electricity meters which provided the added benefit of clear visibility of consumption for both the consumers and owners corporation. ENM Solutions was engaged to procure electricity metering and project manage the brownfield retrofit of an Embedded Network which required approval from the Australian Energy Regulator (AER) through an Individual Exemption. Achieving the exemption required a thorough and rigorous process to obtain “Informed Consent” from all Occupiers at the site. We received consent, submitted the application, and gained approval in less than 12 months from commencement. With solar generation as the next step for the site, the ability to store energy in an onsite battery and how EV Charging will be incorporated is being discussed. This is an example of how a collaborative, well planned, adaptable Energy Strategy, including an Embedded Network, can provide a path to the future of energy in Strata. Should you or a project you are involved with be interested in discussing Energy Strategy, including consideration of an Embedded Network or Microgrid, please contact us for an informed discussion about your Energy Strategy.

Retiling the Balcony

Do we need acoustic underlay?

Can we retile over existing tiles on a balcony? Our downstairs neighbour is concerned about the possible noise implications. I have a tiled balcony that is on top of the living area of the unit downstairs. I am wanting to get the balcony retiled. The tiler has suggested we tile on top of 12 www.lookupstrata.com.au

the existing tiles and rewaterproofing. My neighbour below wants me to get acoustic underlay. This will effectively double the price. Do I have to do this as the area is already tiled and I am not changing the material? My tiler has informed me that adding waterproofing and new tile will improve the acoustics from what they are anyway.

For a number of reasons, the recommended pathway of applying tiles and waterproofing over existing tiles is not recommended. Navigating the pitfalls of Strata living, for all the benefits it brings, is not an easy task. The question raised branches across several areas with regard to construction and

performance of works under the Building Code of Australia and Australian Standards as well as Strata Law and specific by-laws for the property. Unfortunately, it’s not possible to provide a black and white yes or no answer without consideration for a number of factors. The recommended pathway of applying waterproofing over existing tiles before laying new tiles is not recommended. There are several compliance considerations in terms of waterproofing, weatherproofing and safety that should be reviewed. You don’t want to spend a lot of money on new tiles to later find out later you have to remove it all! If there are no existing waterproofing issues with the balcony, it may be feasible to lay new tiles over the existing after review of the existing site conditions/constraints and especially with respect to any balustrading. New tiling may only add 10-15mm in overall height, but this may result

in what is now a compliant balustrade height (minimum 1m) becoming non-compliant. Can the new tiling be installed without impacting balcony drainage (including any overflow), weep holes in walls and drainage of the balcony door itself? Application of waterproofing and tiling over existing will have negligible impact/ improvement on the acoustics. A proper acoustic, under tile layer, installed strictly to the manufactures requirements is necessary to achieve a notable reduction in sound transmission. Measurements by an acoustic consultant would allow you to determine what products are suitable to reduce the sound transmission by a certain level. Your Strata Manager will be able to advise if there are any specific by-laws that apply to

your property in this situation and can also advise on matters regarding the Strata Schemes Management Act/ Regulation, especially in terms of “peaceful enjoyment” and how this can be interpreted. Any external waterproofing works where these relate to a Class 2 Building are also now subject to the requirements under the Design and Building Practitioners Act and Regulations. This requires the waterproofing to be designed and declared (certified) by a registered design practitioner and the works performed by a registered building practitioner. A remedial engineer/consultant can help guide you through the works, ensuring the correct documentation is collected and the correct process is followed, as well as manage the works from start to finish.

Better Return From the Capital Works Fund

Can we invest?

Can we move part of our capital works fund into a term deposit or shares to get a better return on investment? We recently asked our strata manager about whether we should move part of our capital works fund into a term deposit to get a better interest rate. The bank had offered 0.045% p.a. interest in a term deposit to a strata scheme, so the strata manager’s view was that it wasn’t worth moving a portion of the capital works into a term deposit until the interest rates improve. I’ve seen that it is possible for a Queensland body corporate to invest part of their sinking fund into shares or managed funds. If a prudent low-risk investment e.g. an ASXlisted ETF with a dividend stream could be found and agreed upon, could a NSW-based strata scheme make such an investment? What hoops would the strata committee and strata manager have to jump through to achieve this? 14 www.lookupstrata.com.au

What options are allowed, and how do we go about it? It’s a sad state of affairs when the only available solution to a near-zero (or zero!) cash rate is a term deposit that yields 0.045% p.a. This is due to a host of factors we haven’t got time to dive into today. Still, unfortunately, it is the situation that we all now find ourselves in. There are two components to answering this query being; what other options are allowed, and how do we go about it?

Allowable investment options for NSW Section 75(1) of the SSMA 2015 (NSW) forwards the allowable options for investment of administrative or capital works funds to any manner permitted by section 4 of the Trustee Regulations 2020 (NSW). This section offers guidelines that draw a line in the sand at trusts with a value of the funds of $50,000 or below. For this part, investment choice is limited to Government debentures and securities, or bonds (both at a Commonwealth and

State/Territory level) and, as we all know, interest-bearing deposits (cash accounts) and term deposits at a host of authorised deposit-taking institutions (major banks). Whilst government bonds do offer a point of difference, they share similarities in yield with term deposits and may not be worth exploring at this point.

So, what about trusts with a value of funds above $50,000, such as well-established capital works funds? Thankfully this is where the investment palette broadens, but with a couple of significant caveats. Division 2 of Part 2 of the Trustee Act 1925 (NSW) offers a series of confirmations and considerations when working through some alternatives for your longer-term savings as a trustee: • An initial review of your trust deed is required to ensure no limitation on the allowable investments above and beyond what is prescribed in the Act. • Notwithstanding the above, the ability to invest in ‘any form of investment’ and at any time vary any investment is then permissible. • Exercise the care, diligence and skill that a prudent person would exercise in managing the affairs of another person. • Implement annual performance reviews of the trust investments • Provisions to seek advice and use trust capital to pay for this advice Like all well-considered investments, Section 14C of the above Act details a list of further factors that strata committees should address to ensure the validity of the decision when exercising the power of the investment. Here are a few points of note, but not all of them: • The purpose of the trust and circumstances of the beneficiaries • The desirability of diversifying the trust’s investments

• The liquidity and marketability (i.e. ability to sell) of the investment • Costs and fees of the investment – are they reasonable? • The likelihood of inflation affecting the value of the trust and its investment

Going about it

Suppose you feel that your trust has met the above criteria (or have had it confirmed through legal advice, highly recommended), then great! All that is left is a committee resolution approving the decision, and the world of broader investments awaits. So, where to start? Market linked investments like exchange-traded funds (ETF’s) are a terrific and often costeffective way to achieve sound diversification through a simple transaction. The rub is which ones to purchase, in what amounts, and then who oversees the management. Herein lies the danger, as it is easy to see a strata committee member (or members) now be knighted as the fund manager, a job with a unique set of skills that brings with it some serious responsibility. We are happy to say that help is at hand, however, so if you feel you would like to explore some options, feel free to reach out to Strata Guardian and see if our investment service can help your strata savings diversify away from negative real returns and the prospect of rising strata levies.

Too Many Insurance Claims?

No-one wants to insure us

18 www.lookupstrata.com.au

What can we do if, due to our claims history, we are unable to get strata insurance? Since insurance cover is a legislative requirement, what can the committee do when insurance companies do not wish to cover us because we have had too many claims? Our premium has nearly doubled in the last 4 years and only one company agrees to insure us. What If we have more claims and no company wants to insure us next year? What do we do then?

Where a building shows a consistent history of claims, insurers will usually apply hefty excesses or exclusions for the problem claims. It is extremely rare to have no insures offering a policy solely due to claims history. Where a building shows a consistent history of claims, insurers will usually apply hefty excesses or

exclusions for the problem claims. This usually compels the owners corporation and lot owners to take preventative maintenance actions. Where compliance with the building insurance requirements is impracticable (i.e. you can’t get insurance), section 172: Exemption by Tribunal from building insurance requirements of the Strata Schemes Management Act 2015 allows an owners corporation apply for an exemption from the building insurance requirements. Presumably this application would require you to demonstrate you have taken all reasonable steps to exhaust your options. If you have difficulty in getting insurance, you should discuss your options with your insurance broker or strata manager.

Neighbour’s Renovations Without Approval How do we stop this?

Our neighbours have undertaken extensive renovations without approval. I’ve notified the committee but nothing is being done. Our neighbour submitted major works at the 2019 AGM. This work was not approved. Regardless, they started working on the extensive renovations. A stop order was given in May 2020. They have started work again, although I’m sure no approval has been given. They’ve built a toilet on their rooftop terrace and are intending to install a gas fireplace. I’ve provided evidence to the strata committee, but the committee has not taken any action. What else can I do?

You do have a few options You may: • Make your own complaint to your Local Council • Requisition a motion at a general meeting of the Owners Corporation (in compliance with the strata legislation) that the Owners Corporation take action against the lot owners carrying out works without the proper approvals including issuance of a Notice to Comply with the by-laws applicable to the scheme • Apply to NCAT for urgent/interim orders that the works stop • NSW Fair Trading offers free general advice on such matters and you may wish to consult a lawyer in case the works directly impact your lot or your enjoyment of it.

Renovations, Design or Building Works to

Strata Buildings

Greater certification needed since July 2021

What new laws came into effect in July 2021 requiring greater certification, including the involvement of an approved architect for renovations to strata lots? New regulations require the registration of Professional Engineers, Designers and Builders where they are completing class 2-related work On 1 July, the Design & Building Practitioners Regulation 2021 came into force. This new regulation, delivered by the NSW Building Commissioner; David Chandler OAM requires the registration of Professional Engineers, Designers and Builders where they are completing class 2-related work. This covers any renovations, design or building works to Strata buildings and certainly means the architect, fire system designer and builder must be registered. 22 www.lookupstrata.com.au

The changes make steps towards individuals taking responsibility for their work on class 2 buildings and therefore deliver greater quality to property owners in Strata. Any design or compliance documentation now needs to be uploaded to the NSW Planning Portal to ensure records are not lost as buildings are built or modified. NSW Fair Trading provides detailed information here: Class 2 building industry reforms In addition to the above major building changes on 1 July, 2021; when producing an Annual Fire Safety Statement the owners must only select Accredited Practitioners (Fire Safety) who are listed on the register for the specific measures accredited to endorse. Here is that list: FPAS Accredited Practitioner Search. By all means look me up.

Maintenance of a Neglected Water Feature A water feature has not been maintained and is now causing water to seep into the basement. A group of lot owners would like to remove the feature. How can we ensure it is repaired and maintained?

24 www.lookupstrata.com.au

We have a water feature that has not been well maintained over the 20 years I have lived in the building. We now have water dripping into the basement. A group of Owners would like to close, rather than fix the issue. The water feature is an integral part of the atrium and is a selling point for the building. If the area was either re-waterproofed or retiled as it was in 2002 and the pond motor was serviced regularly, the issues could be resolved. The cost has been worked out to be less than a cup of coffee per unit per year. Under the Strata Act, can the Owners Corporation insist on closing the water feature? Do they have to propose a way to enhance the area created by removing this feature?

The Owners Corporation must maintain the structure. The Owners Corporation must maintain the structure. This would include the water feature in the atrium see (section 106). However, the Owners Corporation, by Special Resolution, can ‘alter the common property’ (see section 108 (1)). ‘Special Resolution’ (see section 5) is included within the response above. In essence the removal of the ‘water feature’ needs to go to an Annual General Meeting and secure not more than 25% against the motion by the votes cast.

A scope of Works for remedial repairs should then be obtained from appropriately qualified building consultant and/or other experts as required. The Owners Corporation will then be in a position to understand the true cost of remedial repairs by taking the Scope of Works to the market. Upon their return quotes, an informed decision can then be made regarding the best course of action.

Due Diligence When Purchasing Pre-purchase building inspections We are looking to buy a townhouse but we note that the carpark air vent is vented out into our courtyard. The present owners have covered the vent, maybe to minimise noise or pollution. Is this allowed or do we run away from this purchase? Have the property inspected by a qualified and experienced builder that offer pre-purchase building inspections. If you are seriously considering a purchase of this townhouse, we recommend that you have the property inspected by a qualified and experienced builder that offer pre-purchase building inspections. Without seeing the property or the particular issue, it’s difficult to provide much help but we assume the vent was installed to provide ventilation, so blocking it would not seem appropriate. The placement of the vent in a courtyard seems a bit strange but we don’t have any background information about the possible reasons for this. Again an experienced person might be able to provide advice on the placement of the vent and whether there’s a solution to this issue.

No TV Reception in the Loungeroom

Who fixes this?

We seem to be the only apartment in our 70 lot building without TV reception in the loungeroom. Is it strata’s responsibility to fix this? Our unit appears to be the only one out of 70 units that has no TV signal coming out of the socket in our loungeroom wall. The fire cupboard outside our

28 www.lookupstrata.com.au

unit door has signal to it but then it is failing somewhere between there and our wall socket in the lounge room. The aerial guy that came to investigate said there must be a splitter box somewhere inside our unit but he cannot find it. It could even be in a wall or the floor slab. We have a second aerial socket in the wall of our main bedroom that works. Apparently, the only way to

get a signal to the loungeroom is to run a separate cable through the apartment. The quote is $1200. The Strata Committee has said this is a lot owner responsibility and I must pay if I want TV reception in my loungeroom. Are they correct?

The general rule is that anything behind the TV wallplate is the responsibility of the owners corporation. When it comes to the TV reception in apartment buildings, it can be complicated to determine who’s responsible.

At the end of the day, the strata contract should outline what equipment is the responsibility of the strata versus what is the responsibility of the apartment owner.

is the responsibility of the owners corporation to repair. If we are talking about a new outlet (not a repair of existing equipment), this would be the responsibility of the apartment owner.

The general rule is that anything behind the TV wallplate is the responsibility of the owners corporation. On the other hand, if it is something inside the apartment that is causing the TV reception to fail (for example a faulty fly lead), that would be the responsibility of the apartment owner. In your case, this would probably mean that the hidden splitter or any other cabling that has failed behind the wallplate

There is a blurred line when there are accessible communications cupboards for each apartment (within each apartment) that are accessible. It is more often the case that if there is equipment (eg a splitter) located in one of these cupboards, this is the

responsibility of the apartment owner. However, with your particular situation, this does not sound like it is the case. The technician’s solution sounds plausible. There may also be a way to locate the internal cabling and install a tap or splitter so the new cable run isn’t as difficult. However, it is very difficult to determine a solution without an onsite visit to look at the exact circumstances of the apartment.

Owners Corporation Repairs in My Lot Can I select my own builder?

My bathroom is being repaired by the owners corporation. Their appointed builder does not return calls. What are my rights to select my own builder? My bathroom waterproofing has deteriorated. The building manager has viewed the bathroom and agreed the owners corporation will cover the repairs, including removing tiles, new waterproofing and retiling. The owners corporation’s recommended building company does not return correspondence. As such, I do not wish to use their services and I have found my own builder who has provided a similar quote. The OC have since advised that for an owners corporation funded repair, I must use their suggested builder. What are my rights to select my own builder?

The Owners Corporation have the right to use a preferred tradesman that they have ensured are vetted, insured and licensed to complete the works. No works should be completed to common property without approval from the Owners Corporation.

30 www.lookupstrata.com.au

Although the contractor selected isn’t as responsive as you would wish them to be, the Owners Corporation and their agent (e.g. an appointed Building Manager) have the right to use a preferred tradesman that they have ensured are vetted, insured and licensed to complete the works. If you were to undertake the works without approval you would run the risk of not being able to recoup the cost of the work, as they would be completed without authority. You might be able to negotiate using your preferred contractor or even undertaking a renovation of the bathroom and receive a payout to complete the works yourself (although that would require approval as a renovation of this nature always must) but it sounds like this avenue has been explored. If you are not satisfied with the progress being made due to the selection of contractor remind the Owners Corporation of the requirement

under Section 106 (5) of the Strata Schemes Management Act 2015 which specifies “An owner of a lot in a strata scheme may recover from the owners corporation, as damages for breach of statutory duty, any reasonably foreseeable loss suffered by the owner as a result of a contravention of this section by the owners corporation.”. If you remain unsatisfied the correct avenue for you to take is through an application with NSW Fair Trading and if the desired outcome is not reached you have the right to make an application for an Order to NSW Civil and Administrative Tribunal.

Terminating Your Strata Manager

Why this may NOT save on fees

To save fees, the other two owners in my three lot scheme want to cancel the strata manager’s contract and self manage. Can they do this? I am 1 of the 3 Owners of a Strata Complex which is currently managed by a normal fullservice Strata Manager. To save on Management Fees, the other 2 owners are contemplating effectively cutting out the Strata Manager and self managing. I am totally opposed to this. What are my legal options for stopping this from happening?

Unless the contract between the owners corporation and the strata manager is terminated lawfully, cutting out the strata manager may not save any fees at all. Assuming there is a contract between the strata manager and the owners corporation, then the strata manager’s appointment and the contract can only be terminated in accordance with the contract and the law such as the Strata Schemes Management Act 2015. The other 2 owners wish to “cut out” the strata manager to save on fees however unless the contract between the owners corporation and the strata manager is terminated lawfully, cutting out the strata manager may not save any fees at all. A party to a contract is not free to terminate it simply for a change of mind to save money unless the contract expressly provides a right to terminate for convenience.

Most strata management contracts in NSW are likely to be based on the standard form contract of Strata Community Association (NSW). If so, then the only way the contract can be terminated and the strata manager’s appointment terminated is if either the term of appointment is coming to an end and the strata manager’s term is not extended or renewed, or the strata manager has breached the contract in a way that permits the owners corporation to terminate (this process requires the owners corporation to give the strata manager a notice requiring it to rectify its breach and if the breach is not rectified within 28 days, then the owners corporation can terminate). Not every breach of contract allows a party to terminate, so you will need to study the contract carefully to see what process it contains for giving a notice of termination. To terminate for breach, the owners corporation must follow that process strictly.

a termination by the owners corporation for breach to be authorised by a general meeting. Therefore, a strata committee cannot terminate a strata management contract for breach. If the other two owners in your case cause your owners corporation to terminate the contract with the strata manager when the owners corporation is not allowed to, then you should consider applying to NCAT for an urgent order to stop it from doing so. The contract with and appointment of the strata manager usually does not prevent the owners corporation and its strata committee from carrying out management functions see also section 53(2) of the Strata Schemes Management Act 2015 which states to the effect that delegation of a function to a strata manager does not prevent the owners

corporation exercising the function). In your case, unless there is an express term in the contract prohibiting it, there is nothing stopping the other two owners from carrying out management and leaving the strata manager with little work to do. However, it is likely even if they do, the strata manager will still be entitled to its full fee even if it is doing less work. The contract may also provide that even if the strata committee or owners corporation itself takes out an insurance policy, the strata manager is still entitled to a commission as if it took out the policy. Terminating a contract or commencing a case in NCAT concerning termination of a contract can be tricky legal business so before any party contemplates doing either, it should seek legal advice.

If an owners corporation terminates a contract when it is not allowed to, then it is committing a breach of the contract called repudiation and it may expose itself to having to pay damages to the other party. The termination of a strata manager’s appointment must be authorised by a general meeting. Please see section 50(3) of the Strata Schemes Management Act 2015. The Strata Community Australia (NSW) standard form contract also requires 33

Holding Meetings and Making Decisions What if you can’t get a quorum?

We have nine elected members. Three have resigned and two other lot owners won’t attend meetings. Can the four still hold meetings and make decisions? The answer is no The answer is no because you don’t have a quorum if your number of lots is nine. It’s really annoying. As a minimum, I would replace one of those spots with someone. This is a bit technical, but you can have one of those two people that are sleeper members appoint one of the four as an alternate member. The sleeper member can dial into the call or come to the meeting, open the meeting, give the alternate member and then leave. Practically I would get someone to just turn up to the meetings. 34 www.lookupstrata.com.au

Older Buildings and the Building Code Do our balustrades comply? 36 www.lookupstrata.com.au

The balustrades on our 1983 built apartment building as no longer compliant. What do we have to do to make sure the building complies with the current building code? Our apartment building in Wahroonga, NSW was built in 1983. Although the balcony balustrades met the regulations at the time they were built, they are deficient in two ways: 1. they are three feet high 2. t hey are made up of crossed members that would allow a small child to crawl through, or a bigger child to use in order to climb over. If we add panels of Plexiglass to cover the cross-sections and also raise the level of the balustrades to one metre, would we be compliant with the current Code?

We recommend that the Owners engage a private certifier to review their proposed upgrades and ask the certifier to provide advice as to compliance requirements

We understand that this type of improvement may also require approval from the local authority and if the overall cost of the work exceeds $5000 a contract in the prescribed form will need to be entered into by the Owners.

An owners corporation can make changes to their building within certain parameters and in this instance, the Owners would need to consider:

Given the above we recommend that the Owners engage a private certifier to review their proposed upgrades and ask the certifier to provide advice as to compliance requirements for both the proposed upgrades and as to the lodgement of an application for approval with the local authority.

The National Construction Code, Building Code requirements where a substantial change or replacement in respect of a building element is proposed.

This will ensure that the proposed upgrades are certified and will meet the legislative requirements of the Home Building Act, National Construction Code and local authority.

Any upgrade of the balustrading would also need to meet requirements in terms of strength, rigidity and durability, particularly with respect to loading and wind loading.
