Tougher sanctions to tackle illicit tobacco trade The government is planning to introduce tougher sanctions to tackle the illicit tobacco trade.

Legislation will be introduced in the Finance Bill 2021-22 to amend the Tobacco Products Duty Act, giving Her Majesty’s Revenue and Customs (HMRC) the power to issue financial penalties up to £10k for holding or possessing products that do not comply with the UK’s tobacco track and trace requirements.

In addition, the new proposals will empower HMRC to seize legitimate stock if it is found alongside product that does not comply with track and trace requirements, and to withdraw a retailer’s tobacco track and trace ID if they have persistently contravened the rules.

The plans follow a consultation launched at the end of last year which sought views on the tobacco track and trace system, applying new sanctions for tobacco smuggling and extending the powers of trading standards officers.

Larger Londis stores face restrictions on “unhealthy” foods Fatty, salty and sugary foods will be banned from some in-store areas.

Londis stores larger than 2,000sq ft will need to comply with new restrictions on the merchandising of fatty, salty and sugary products from October 2022, the government has confirmed.

The Department of Health and Social Care has confirmed plans to ban products high in fat, salt and sugar (HFSS) from certain locations in-store as part of the Government’s Obesity Strategy, which includes a range of measures aimed at encouraging adults to change their purchasing behaviour, diet and lifestyle.

HFSS foods include confectionery, cakes, crisps, ice cream and soft drinks with added sugar, plus certain breakfast cereals and ready meals.

The restrictions mean that retailers will not be able to put these products within two metres of a checkout area; within two metres of a queueing area; in an end of aisle display; or at the entrance to the store. In addition, volume promotions such as multibuys and ‘buy one get one free’ offers may be outlawed for HFSS products.

All stores below 2,000 sq ft will be exempt from the location restrictions. The regulations will not generally apply to businesses with fewer than 50 employees, but the proposals treat symbol group retailers as parts of larger businesses, so Londis stores above 2,000sq ft will be required to comply.

Small business calorie labelling exemption The Department of Health and Social Care (DHSC) has confirmed that mandatory calorie labelling will be introduced in the out-ofhome food and drink sector but that businesses with fewer than 250 employees will be exempt from the new requirements.

How it works Research shows that ice cream sales spike when the temperature rises by 5°C, starting from a base of 18°C, so this is used as the trigger for the automatic allocation of stock.

Club members can choose a five or a ten–case allocation. Stores with a fivecase allocation receive a £10 credit for the first allocation and then £7.50 credit per subsequent allocation, while for a 10-case allocation there is a £30 credit for the first allocation and then £20 credit for each one following.
