Our boys and I are carrying on the Fulton Family Tradition that Brian and I originally set out with… “To breed, start and offer to our customers the most athletic two-year-old performance prospects and large selection of horses to fit any discipline”. Our foundation approach of starting our colts in a slow, consistent and kind manner ensure an end product with a sound mind and body. PERFORMANCE PREVIEW All of the Fulton horses can be seen at the ranch until Thursday, August 16, 2018. On sale day (August 17, 2018), all Fulton horses and consignor horses will be standing at the Cherry County Fairgrounds in Valentine, NE. Preview begins at 1:00 P.M. CST. PHONE BIDDING To be eligible for phone bidding, it is required that you sign up by filling out the phone bidding sign up form on FultonRanch.com by Thursday, August 16, 2018. A letter of credit from your bank is also required and must be sent to lisa@fultonranch.com by Thursday, August 16, 2018. Terms of sales are cash to be paid in US funds by Monday, August 20, 2018 by wire transfer or certified check overnighted to Fulton Family Performance Horses, LLC. REGISTRATION & TRANSFER All horses are registered with the AQHA/APHA. Registration transfers along with a $20 Registration fee will be sent directly to the AQHA/APHA for each horse once payment clears. Report any discrepencies to the AQHA/APHA upon receipt of papers. Most of the sale offering is sired by the Fulton Family Performance Horses cornerstone stallions: A STREAK OF FLING, CS FLASHLIGHT, and A DASH TA STREAK. These stallions have proven themselves as great performers and have continued on to become great sires. This year, we wanted to also put an emphasis on the great mare power behind these solid, performance pedigrees. You will find a strong maternal history throughout the catalog in efforts to “Focus on the Female.” The two-year-olds from Fulton Family Performance Horses are not only from strong, proven, and consistent sires, but also strong and fundamental females. The combination of a powerful paternal side and an equally intense maternal side has brought together a forceful set of two-year olds that are strong, good boned, willing, and sure-footed athletes that will be a reckoning force in any arena. Our colts are not only started in the arena but get a lot of outside miles in some rough country, which, we believe, teaches them how to use their feet and bodies to the best of their abilities. TERMS & CONDITIONS The following terms and conditions shall apply to all sales of horses at auction by Fulton Family Performance Horses, LLC (“Fulton”), whether on its own behalf or on behalf of its consignors (each, including Fulton when selling on its own behalf, a “Seller”), provided that any changes in terms announced by the auctioneer with Fulton’s approval on the day of the sale (the “Sale Date”), not including any statements relating to any express or implied warranties of any kind, shall supersede and take precedence over any statement to the contrary contained in this catalog or otherwise made to Buyer. Bidding and Sales. Each horse shall be sold to the highest bidder, and the “Buyer” shall be the high bidder when the gavel falls as to a particular horse, provided that the Sellers reserve the right to set a reserve as to any horse. The Sellers also reserve the right to bid, as allowed by law, unless otherwise announced at the sale. The auctioneer shall settle any bidding disputes, in his discretion, and in doing so may, but is not required to, take further bids from the disputing parties. In such event, if no higher bid is made, the Buyer shall be the bidder having the last bid recognized by the auctioneer. The auctioneer’s decision as to disputes will be final. Acknowledgment of Purchase. Upon the auctioneer’s declaration that a horse is sold, the Buyer must sign an Acknowledgment of Purchase (“Acknowledgment”) presented by Fulton, the terms of which are incorporated herein and shall be available upon request before the sale. Fulton reserves the right to void a sale and to re-present a horse for sale at auction if: a) the Buyer refuses to execute the Acknowledgment or otherwise repudiates or fails to perform according to these terms and conditions, b) the auctioneer or Fulton identifies a material mistake, or c) the bid is declined by Fulton due to the Buyer being a non-qualifying bidder. A non-qualifying bidder shall be one who, in Fulton’s sole judgment, lacks financial responsibility, has falsified information to Fulton or any Seller, engages in conduct that interferes with the sale, lacks capacity, fails to comply with these terms and conditions, or engages in other conduct that leads Fulton to conclude that the bidder is not reliable and responsible. Buyer shall be liable for any damages, including incidental damages and attorney’s fees, caused by Buyer’s refusal or failure to perform its obligations hereunder or by a voided sale resulting from Buyer being a non-qualifying bidder. Payment. Unless otherwise agreed, the Buyer must pay Fulton the purchase price for each purchased horse (plus any applicable taxes and incidental expenses and fees) in cash, by personal check acceptable to Fulton, or by certified or cashier’s check on the Sale Date, or by wire transfer on the first business day after the Sale Date. For any purchases by personal check, Buyer must submit to Fulton a proof-of-funds letter from Buyer’s bank showing sufficient funds in Buyer’s account as of a date no earlier than two days before the Sale Date. A charge of $75.00 will be added for any check that is returned for non-payment upon presentation. Any Buyer who fails to make full payment when due shall pay interest on the remaining amount owed at a rate of 1.5% per month or the highest rate allowed by law, whichever is lower. Possession. For all purchases made by cash, personal check, or certified or cashier’s check, Fulton or Seller will tender possession of the purchased horse to the Buyer upon execution of the Acknowledgment and payment of the purchase price on the Sale Date. For purchases made by wire transfer, Fulton or Seller, as the case may be, will tender possession either at the Fulton Family Performance Horse Ranch at Todd County, South Dakota, or at Seller’s designated location, upon Fulton’s receipt of the purchase price, provided that for any purchases by Canadian Buyers, possession will be tendered at the aforementioned location once all Canadian health tests (“Canadian Health Tests”) have been passed. Fulton may withhold tender of possession of any horse if Buyer should fail to make timely payment or refuse to sign an Acknowledgment as to any or all of its purchases at the auction. Fulton may hold any purchased horse’s registration papers and any other documents necessary to transfer registration of the horse to the Buyer until such time as all of Buyer’s payments have cleared (estimated to be within thirty days after the Sale Date). Post-Sale Inspection. Beginning at 9:00 p.m. on the Sale Date, Buyer shall have twenty-four hours (the “Inspection Period”) within which to have a complete veterinary inspection of the horse performed (a “Post-Sale Inspection”), at Buyer’s sole expense, by a veterinarian acceptable to Fulton. If Buyer should have a Post-Sale Inspection made within the Inspection Period and the veterinarian should determine the Horse to be unsound and the disease or defective condition to be material to the purpose of the horse, Buyer may rescind its purchase of the horse by delivering written notice of rescission to Fulton by e-mail at horses@fultonranch.com or by fax at 605-429-3204 no later than two hours after the veterinarian’s inspection is completed (the “Notice Period”). If Buyer should fail to have the horse inspected within the Inspection Period or to give notice of rescission within the Notice Period, or if the veterinarian performing the inspection should find the horse to be sound or any defect or disease to be immaterial to the purpose of the horse, then Buyer shall be deemed to have accepted the horse “AS IS” and “WITH ALL FAULTS” and to have waived any and all claims Buyer may otherwise have had with respect to the horse. Sales to Canadian Buyers. For Canadian Buyers, Fulton shall arrange for all Canadian Health Tests to be performed as soon as practicable after the sale, at Buyer’s sole expense. If a horse should fail such tests, Buyer may rescind its purchase of that horse by delivering written notice immediately to Fulton by e-mail or fax at the e-mail address or fax number stated above. Refund and Return of Horse. If Buyer validly and timely provides a rescission notice to Fulton due to the horse’s failure to pass the Post-Sale Inspection or the Canadian Health Tests, Buyer shall, as soon as practicable, tender possession of the horse to Fulton, in the same condition as at the time of sale, at a mutually agreeable location within 250 miles of the Fulton Family Performance Horse Ranch. Fulton shall then refund to Buyer the purchase price and shall pay or reimburse Buyer for the cost of the veterinarian’s inspection or the Canadian health tests, as applicable, within seven days after the horse is returned to Fulton, as provided above. Vaccinations, Veterinarian Examination. Unless otherwise disclosed at the sale, (a) all horses are current on worming and vaccinations, in accordance with the vaccination program selected by Fulton Family Performance Horses, LLC, the details of which are available upon request, and (b) prior to the sale, all horses will have passed a general, visual veterinary examination for physical soundness. Disclaimer of Warranties. NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, NEITHER FULTON NOR SELLER MAKES ANY WARRANTIES WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTY AS TO THE SOUNDNESS, HEALTH, OR BEHAVIOR OF ANY HORSE, AND, WITH THE LIMITED EXCEPTION OF THE BUYER’S RIGHT TO RESCIND IF THE HORSE FAILS THE POST-SALE INSPECTION OR THE CANADIAN HEALTH TESTS, THE BUYER’S PURCHASE OF A HORSE IS “AS IS, WHERE IS” AND “WITH ALL FAULTS”. Limitation of Claims and Remedies. For any claims not waived as provided herein, Buyer shall make no claim against Fulton, the auctioneer, or Seller arising out of or relating to the sale or the Buyer’s purchase of a horse, unless the Buyer shall have first notified Fulton, the auctioneer, and Seller in writing of the basis and nature of the claim within thirty (30) days after the Sale Date. Buyer’s sole remedy in contract, tort or otherwise shall be limited to a refund of the purchase price of the horse Buyer purchased, which shall in all cases be conditioned upon return of the Horse to Seller in the same condition as it was delivered to Buyer following the sale. NEITHER FULTON, NOR THE AUCTIONEER, NOR THE SELLER SHALL BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. Title, Risk of Loss, Indemnification, Care of Horses. Title and risk of loss to each horse shall pass upon Buyer’s execution of the Acknowledgment. Buyer shall defend, indemnify and hold harmless Fulton, the auctioneer, and Seller from any and all claims arising out of the Buyer’s purchase or in any way related to the purchased horse from and after the time risk of loss passes. Buyer will be responsible for all care, board, veterinary, and transportation expenses relating to the horse from and after the signing of the Acknowledgment. For any sold horses that should remain in Fulton’s or any Seller’s possession after the Sale Date, Buyer shall pay Fulton or such Seller, as the case may be, board of $20 per day. Governing Law. All sales shall be governed by the laws of the State of South Dakota. Assumption of Risk. Anyone attending the sale does so at his own risk. Neither Fulton, the Sellers, the auctioneer, nor Cherry County Fairgrounds, nor any other person connected with this sale assumes any liability.
